Is there legal recognition for so-called “climate change” refugees?

Last week, a New Zealand tribunal provided the inklings of an answer.After a two-year legal struggle, a family from the small island nation of Tuvalu was granted temporary residency there, claiming they were refugees of climate change.While the ruling rested on humanitarian grounds, the Tuvalu family allegedly constitutes the first successful application for residency based in part on climate change.
With a population of just over 10,000, about the same size of Ontario’s southern Bruce Peninsula (home of Wiarton Willie, Canada’s famed Ground Hog Day meteorologist), Tuvalu, an isolated Pacific island between Hawaii and Australia, has an average elevation of approximately two metres above sea level.With ocean levels predicted to rise up to one metre over the next century, according to the UN’s Intergovernmental Panel on Climate Change, there is great fear that Tuvalu, and other similar island nations, will simply disappear owing to melting polar ice caps and other drastic side effects of continuing greenhouse gas emissions.The fate of Tuvalu was given prominence at the 2009 Kyoto Protocol meetings in Copenhagen, and has become a symbol of the climate justice movement, which highlights the fact that relatively low carbon emitting nations are bearing the ecological brunt of wealthier nations with profligate and in some cases unapologetic fossil fuel consumption.According to the Environmental Justice Foundation (EJF), a social ecology non-governmental organization, nearly one-third of coastal countries, many in the so-called developing world, have over 10 per cent of their homeland within 5 metres of the sea. Should ocean levels continue to swell over the next half century, it is estimated that many nations, in addition to Tuvalu, such as Fiji, the Solomons, the Marshall islands, the Maldives and some of the Lesser Antilles, risk losing most or all of their territory.In addition, according to the EJF, many other coastal countries around the world, including Bangladesh, Kenya, Papua New Guinea, Somalia, Yemen, Ethiopia, Chad and Rwanda, could witness mammoth population displacement owing to climatic whipsaws. Bangladesh, for example, has had 70 climate-related natural disasters in the past decade alone.These stats give a whole new meaning to “homeland insecurity.”The notion of a “climate change refugee” is part of a swirling debate within the international legal community concerning the broader category of “environmental refugees.”According to the United Nations, environmental refugees are those who have been forced to leave their traditional homes because of “marked environmental destruction” (“natural” or human-engendered) that “jeopardized their existence” or seriously impacted their “quality of life.”Yet, to date, the International Refugee Convention, for example, does not recognize environmental refugees or victims of climate change as refugees, nor does Canada accept climate change as a legitimate justification for a refugee claim.

Though environmental refugees, until the New Zealand ruling, do not enjoy formal status or legal protection, the political tide may be turning.One reason for this shift may be the sheer volume of environmental refuges. According to the United Nations High Commission on Refugees, today’s 30 million-plus environmental refugees now outnumber political refugees worldwide.A second reason might lie in the dedicated advocacy of groups such as Holland-based LISER, founded in 2002 to broadcast the plight of environmental refugees and secure legal protection through international law. LISER’s research and expertise helped inform two notable documentaries on the issue, Refugees of a Blue Planet by Canadian filmmakers Hélène Choquette and Jean-Philippe Duval (2006), and Climate Refugees, directed by U.S. filmmaker Michael Nash (2010). New Zealand’s acceptance of climate change as one criterion in refugee adjudication is an important and hopeful development. It implies that the displacement of persons owing to severe climatic events is not simply owing to a capricious “act of God,” but rather to human alteration of the climate.In addition, the ruling suggests that nations in denial of climate change, or acting as if it is not a serious issue, are at risk of violating their own international refugee agreements. If climate change continues to be an acceptable reason for refugee claims under international law, those nations denying or irresponsibly contributing to climate change might find themselves outside the law.Stephen Bede Scharper is associate professor of environment and anthropology at the University of Toronto. Coun. Doug Ford gets defamation notice from Toronto police chief-CBC –AUG 12,14-YAHOONEWS

Toronto police Chief Bill Blair has served Coun. Doug Ford with a notice of defamation, for comments made earlier this month that accused the chief of leaking news about an investigation involving Mayor Rob Ford."The chief said in a statement last week he was prepared to take legal action and he has done that," said Mark Pugash, a spokesman for Blair.Pugash said the chief is seeking a public apology and a retraction.Earlier this month, Rob Ford was served with a subpoena to testify in the extortion case of the mayor's friend and former driver Alexander (Sandro) Lisi.At the time, Doug Ford said the move was politically motivated "payback" and that the police went to the media before telling the mayor about the subpoena."You wonder why we need a change at the top? This is why we need a change at the top," said Doug Ford at the time, referring to Blair, whose contract is not being renewed.Blair immediately threatened legal action and accused the councillor, who is managing his brother's re-election campaign for mayor, of lying.

Doug Ford, and the deputy mayor late last night.Toronto police Const. David Hopkinson confirmed that city hall security reported the letter late Monday morning and officers have since been sent to investigate the veracity of the threat."Toronto police treat these calls quite seriously and we are investigating. The decision whether to evacuate or not evacuate will be made by the officers that are on scene. They have chosen not to evacuate at this time," Hopkinson told Yahoo Canada News.The letter came to the public's attention Monday afternoon when Ford and his brother, who also acts as his re-election campaign manager, announced the threat to the media."This is very, very serious. I don't want people to panic," Ford told reporters. He added that he was acting on his "own advice" when he decided to publicize the letter.In the letter, copies of which were distributed to media at city hall, the unidentified writer says they have set explosives around city hall and that Rob Ford must resign or else."I sent an email to him at city hall and he has 12 hours to vacate otherwise city hall will blow," the note reads.Portions of the letter feature grammatical mistakes and were written in all capitals. The letter gives deadlines of both 12 hours and 24 hours for when the facility should be evacuated. Based on reports that the letter was emailed late Sunday evening, one of those deadlines has already passed.Hopkinson said the Toronto Police Service has bomb-sniffing dogs that could be dispatched to city hall. Officers remain at the scene as the investigation continues.
