and individual plaintiffs have won their appeal in the Ninth Circuit on
LAUSD’s Employee Covid Vaccination Mandate.Health Freedom Defense Fund
et. al, led by the exceptional legal team of John Howard and Scott
Street at JW Howard Attorneys, have won a significant victory in the
Ninth Circuit, which reversed dismissal of their lawsuit challenging the
Los Angeles Unified School District’s (“LAUSD”) mandatory vaccination
policy for all employees.Reversing the decision of the Central District
of California in Los Angeles, the Ninth Circuit majority held that,
first, the case was not mooted by LAUSD’s rescission of the mandate
after oral argument last September, 2023. The majority called out
LAUSD’s gamesmanship for what it was – a bald-faced attempt at avoiding
an adverse ruling by trying to create an issue of mootness.Unfortunately
for LAUSD, they had already done this once in the trial court. Applying
the voluntary cessation doctrine, the majority doubted LAUSD’s
sincerity in rescinding the mandate immediately after an unfavorable
oral argument in September of last year.On the merits, the majority
ruled that the district court had misapplied the Supreme Court’s 1905
decision in Jacobson v. Massachusetts when it dismissed LAUSD’s lawsuit
on grounds that the mandate was rationally related to a legitimate state
interest. In Jacobson, the Supreme Court upheld the constitutionality
of a smallpox vaccination mandate because it related to “preventing the
spread” of smallpox.The majority, however, noted that HFDF had alleged
in the lawsuit that the COVID jabs are not “traditional” vaccines
because they do not prevent the spread of COVID-19 but only purport to
mitigate COVID symptoms in the recipient. This, HFDF had alleged in its
complaint, makes the COVID jab a medical treatment, not a vaccine.The
court recognized that mitigating symptoms rather than preventing the
spread of disease “distinguishes Jacobson, thus presenting a different
government interest.” Based on this reasoning, the majority disapproved
the trial court’s contention that, even if the jabs do not prevent the
spread, “Jacobson still dictates that the vaccine mandate is subject to,
and survives, the rational basis test.”The court held that “[t]his
misapplies Jacobson,” which “did not involve a claim in which the
compelled vaccine was ‘designed to reduce symptoms in the infected
vaccine recipient rather than to prevent transmission and infection.”’
Jacobson does not, the majority concluded, extend to “forced medical
treatment” for the benefit of the recipient.The court declined to give
any deference to pronouncements by the CDC that the “COVID-19 vaccines
are safe and effective.” As the court asked rhetorically, “safe and
effective” for what? The majority pointed to HFDF’s allegation that CDC
had changed the definition of “vaccine” in September 2021, striking the
word “immunity” from that definition. The court also noted HFDF’s
citations to CDC statements that the vaccines do not prevent
transmission, and that natural immunity is superior to the vaccines.In a
separate concurrence, Judge Collins wrote that the district court
“further erred by failing to realize that [HFDF’s] allegations directly
implicate a distinct and more recent line of Supreme Court authority”
for the proposition that “a competent person has a constitutionally
protected liberty interest in refusing unwanted medical treatment[.]”
Citing the Supreme Court’s decision in Washington v. Glucksberg, Judge
Collins noted that the right to refuse unwanted medical treatment is
“entirely consistent with this Nation’s history and constitutional
traditions,” and that HFDF’s allegations in this case “are sufficient to

The operation to rescue Noa
Argamani, Shlomi Ziv, Almog Meir Jan and Andrey Kozlov from their
captivity at the Nuseirat refugee camp in the central Gaza Strip was
postponed four times late last week and into the weekend. The initial
go-ahead was given on Thursday evening, but the special forces waited
for intelligence and operational maturity – before finally, at 11 a.m.
on Saturday, they were given the green light.For the third time since
October 7, Israel’s security forces achieved an intelligence and
operational success worthy of appreciation and praise. This had happened
on October 28, 2023, with the rescue of Ori Megidish in the heart of
Gaza Strip; on May 1, with the rescue of Louis Har and Fernando Marman
from the Shaboura refugee camp in Rafah; and then, on Saturday, in
Nuseirat.But as successful as this latest operation was, and as welcome
the burst of joy and the importance to national morale, it is doubtful
that it will serve as a turning point. It is likely, indeed, that Hamas
has rushed to tighten security around the other hostages, and perhaps
moved them to new hiding places.Every rescue operation needs to be
planned to the smallest detail. In the case of Saturday’s, the planning
spanned weeks – and, during that time, several acts of diversion were
apparently taken.In recent weeks, military intelligence and Shin Bet
provided accurate information about the whereabouts of the four hostages
– including real-time movements – making it possible for the extraction
teams to practice on an accurate model of the buildings where the
hostages were held.A senior army source who was part of the planning
told The Times of Israel, on condition of anonymity, that the Saturday
operation was reminiscent in planning and execution of the legendary
Entebbe Operation in 1976, in which the IDF rescued over 100 hostages
kidnapped to Uganda.Palestinian casualties-Palestinians claim that the
Israeli forces used a humanitarian aid truck carrying furniture to
infiltrate the center of Nuseirat unnoticed, which the IDF has denied
but which has ignited conspiracy theories in Gaza that Israel and the
Arab countries behind the humanitarian aid efforts have joined forces in
military action. View of the IDF’s helicopters taking off from Gaza
with the hostages from nearby the US-built aid pier only fueled these
conspiracy theories.Hamas was quick to embrace this narrative. However,
in a statement, the terror organization refrained from mentioning the
Arab states and accused only the United States of cooperating with
Israel.Hamas was also quick to propagate information on social media,
and subsequently in the international media, claiming there were more
than 270 Palestinian fatalities, many of whom were children and women.
While this number should be treated with great caution, it is clear that
a military operation in the heart of Nuseirat’s overcrowded center
would result in civilian deaths.Wary of the harsh international
criticism, the IDF Spokesperson’s Unit briefed foreign media immediately
after the operation was over, stressing the presence of Hamas
operatives and hostages in the heart of the civilian population, as part
of Hamas’s practice of using civilians as human shields.Once the rescue
force was met with violent resistance when leaving the second building,
where the three male hostages were held, it was IDF fire — both from
the ground and from the air — that allowed the rescue team and the
hostages to escape the area. This is when most of the civilians were
injured. This is also when Yamam officer Chief Insp. Arnon Zmora was
mortally wounded. He died from his wounds shortly after.Milking the
moment-The rescue operation was not approved by the full war cabinet,
but rather only by Prime Minister Benjamin Netanyahu and Defense
Minister Yoav Gallant.It is reasonable to assume that, considering that
war cabinet minister Benny Gantz was about to quit the wartime
government, Netanyahu was unwilling to share the details of the
operation with him. For Netanyahu, this was a gamble: If the operation
had failed, it would have been easier for Netanyahu to account for it
and share the responsibility for its failure had Gantz been
included.Hours after the operation was over, Gantz revealed that he had
known about the operation ahead of time; the head of the Shin Bet, Ronen
Bar, briefed him about it on Thursday night. Despite knowing he
wouldn’t be able to announce his and his National Unity party’s
withdrawal from the government immediately after such an operation,
Gantz chose to schedule a press conference for Saturday evening, when
his ultimatum to Netanyahu expired – so as to convey business as usual
and not alert Hamas that something was afoot.In contrast, Netanyahu
fully exploited the operation’s success for his public relations. While
Gallant sufficed with a statement praising the security forces,
Netanyahu arrived at Sheba Medical Center, took pictures with the
families and the hostages, and rushed to make a statement to the press
at the hospital (with no questions allowed, of course).It’s worth noting
that to date, the prime minister has yet to personally speak to the
families of Nadav Popplewell, Chaim Peri, Yoram Metzger and Amiram
Cooper, four hostages who were declared dead just days earlier, to
convey his condolences.The question now is how Saturday’s successful
rescue will affect the negotiations to release the 120 hostages still
held by Hamas in Gaza. Right now, these talks are on hold as all sides
wait for Hamas’s response to the latest Israeli proposal for a deal,
approved by the war cabinet and detailed by US President Joe Biden.Hamas
swallowed the two previous Israeli rescue operations and continued the
negotiations. But it is quite possible that Hamas, stung and with fewer
hostages, will now harden its demands.Hamas’s leadership issued a
relatively quick announcement after it recovered from the shock of the
operation in Nuseirat: “We have a lot of hostages. The release of some
of them after eight months will not change Israel’s strategic
failure.”Israel would not have expected anything other than obduracy
from Hamas, but the statement was a reality check — a reminder of the
challenges that lie ahead.The IDF is set to complete its operation in
Rafah in the next few weeks, and it is doubtful whether it will
ultimately carry out a major operation in the two remaining refugee
camps — central Gaza’s Nuseirat and Deir al-Balah.Israel went a long way
in its latest proposal, which received American, Qatari and Egyptian
backing, but it has not yet yielded the long-awaited breakthrough. And
Gantz’s Sunday night departure from the government further reduces
Netanyahu’s operating leeway vis-Ã -vis the far-right factions in his
coalition.That might be why Netanyahu called on Gantz, however
improbably, to stay in the government. Amid the jubilation of Saturday
morning’s successful rescue, Netanyahu knows that more difficult times

to attend the funeral of Arnon Zmora, the police counter-terror officer
killed Saturday during an operation that rescued four captives from
central Gaza.Zmora, an officer of the elite Yamam counter-terrorism
unit, was shot and critically injured by Hamas terrorists guarding three
of the four hostages. He succumbed to his wounds shortly upon arriving
at a hospital in Israel.He was part of the mission to rescue Almog Meir
Jan, Andrey Kozlov, Shlomi Ziv and Noa Argamani, which was subsequently
renamed “Operation Arnon” in his honor.Even before the arrival of the
funeral procession at Jerusalem’s Mount Herzl military cemetery,

town of Mevasseret Zion, waving Israeli flags in tribute.Inside the
cemetery, Zmora’s mother Ruti eulogized her son, whom she said was not

Some of the Israeli special
forces that entered the Nuseirat camp in Gaza on Saturday to conduct a
large-scale operation to free four hostages posed as displaced Gazans or
as Hamas fighters, according to eyewitnesses quoted in Arab media
outlets.The Saudi-owned Asharq news channel quoted local residents
saying that a special forces unit, including women, entered the camp in
disguise, driving in a white car loaded with mattresses. They said the
women were dressed in clothes “that women are wearing here in the
war.”According to the report, the special forces introduced themselves
to local residents as Palestinians escaping the Israel Defense Forces
operation in Rafah, and said they had rented a place in the area around
the market in Nuseirat, while pointing at the building where hostage Noa
Argamani was being held. The three male hostages who were also rescued
in the operation — Andrey Kozlov, Shlomi Ziv and Almog Meir Jan — were
being detained in another building 200 meters away.Israel’s Ynet news

2024-The four Israeli hostages were rescued alive from Hamas captivity
Saturday from two separate buildings in the heart of central Gaza’s
Nuseirat.Argamani, Meir Jan, Kozlov and Ziv had been abducted from the
Supernova music festival near the community of Re’im on the morning of
October 7, when some 3,000 Hamas-led terrorists killed 1,200 people and
took 251 hostages in a murderous rampage in southern Israel.Officers of
police’s elite Yamam counter-terrorism unit, along with Shin Bet agents,
simultaneously raided two Hamas-controlled multi-story buildings in the
heart of central Gaza’s Nuseirat, a joint statement said.Hundreds more
soldiers of the Israel Defense Forces participated in the operation,
according to the military.IDF Spokesman Rear Adm. Daniel Hagari said the
hostages were rescued by special forces while “under fire.”Yamam Chief
Inspector Arnon Zmora, who commanded the rescue team at the building
where three hostages were being held, was critically wounded by Hamas
fire. He was brought to an Israeli hospital, but died shortly after. The
Hamas guards were killed in the exchange. Known originally as “Seeds of

Yemen’s Houthi rebels said Sunday that they had
targeted ships off the country’s coast with missiles and drones after
maritime security firms said two vessels had caught fire after being hit

attacked “two ships belonging to companies that violated” its directives

rocket and drone attacks on northern Israel set off sirens repeatedly
throughout Sunday and sparked fires in the Golan Heights, as Israel and
Hezbollah once again traded fire throughout the day while international
allies called for a de-escalation.A day earlier, the Iran-backed
Lebanese terror group boasted of using the heavy Falaq-2 rocket, which
holds a 60-kilogram (132-pound) warhead, against Israel for the first
time.Around noon on Sunday, two explosive-laden drones launched from
Lebanon at Israel struck areas in the northern Golan Heights, sparking
fires, the Israel Defense Forces said.A short while before the drone
attack, a barrage of some 10 rockets was launched from Lebanon, hitting
open areas in the northern Golan, the military added. The rocket attack
also sparked a fire. The IDF said it was shelling the launch sites with
artillery.Repeated sirens that sounded in the northern communities of
Avivim, Yir’on and Malkia on Sunday afternoon were all determined to be
false alarms, the military later said.Earlier Sunday, several rockets

took responsibility for at least 10 attacks on northern Israel

countries threatened the terror group’s leaders with sanctions,
including the freezing of their assets, expulsion from the Qatari

to Israel over the war against Hamas in Gaza, with relations souring
between two countries that were once close military and commercial
allies.Petro wrote on the social media platform X that coal exports will
only resume “when the genocide” in Gaza stops. Petro also posted a
draft decree that says coal exports will only resume if Israel complies
with a recent order by the International Court of Justice to immediately
halt the military assault on Rafah that would risk the destruction of
the civilian population sheltering there.Israel denies accusations that
its war violates the international genocide convention, stressing that
its military operations are targeted against terror groups which operate
within civilian infrastructure.According to the Colombian government,
the coal export ban will enter into force five days after the decree is
published in the official gazette and will not affect goods that have
already been authorized for shipment.Bogota underscored coal’s role as
“a strategic resource for the manufacture of weapons, the mobilization

American has the right to peacefully express their views. But he has
also always been clear that antisemitism, violent rhetoric, and
endorsing murderous terrorist organizations like Hamas is repugnant,

Gaza on Sunday, the US military said, after a suspension of such

turned to delivering it by air and sea as it pressed Israel to increase
the amount of aid entering the enclave by land.The air drop provided

more than 1,050 metric tons of humanitarian assistance” in addition to

source said a "Russian command node" was hit on Sunday in the area of
Belgorod, western Russia.Belgorod is close to the border with

was used in the attack, including whether or not it had been a Western
weapon.The United States and France recently said the Ukrainian armed
forces were permitted to use their arms to strike military targets
inside Russia - from where Russian forces are launching attacks against
Ukraine.Under new guidance approved by President Joe Biden, American
munitions can be used on Russian soil to help defend the city of Kharkiv
in northeastern Ukraine.Lord Cameron, the UK foreign secretary, has

popular Blue Lagoon geothermal spa on Saturday 8 June, with officials

since a 29 May eruption, the fifth and most powerful since the volcanic

A volcanic fissure on
Iceland’s Reykjanes peninsula erupted in late May 2024, marking the
continuation of a series that began in December 2023. The area
experienced significant magma accumulation since the previous eruption
in March, and the renewed lava flow impacted local infrastructure and
prompted evacuations, including at the Blue Lagoon geothermal spa.

vigorous flows.Iceland’s Reykjanes peninsula experienced a volcanic
eruption in late May 2024, with satellite images from early June showing
subsided activity. The eruption followed significant magma buildup and

(OLI ) captured this image of the ongoing eruption on June 2, 2024. The
natural-color scene is overlaid with an infrared signal to help
distinguish the lava’s heat signature. By this time, volcanic activity
along a fissure extending up to 3.4 kilometers (2.1 miles) long had
subsided after its initial burst. The most active areas, emitting the
hottest thermal signals (light green), are near one of the craters that
erupted in March 2024, according to the Icelandic Met Office (IMO). Much
of the black area in the image is cooled lava, but note that dark
shadows from clouds are also present.Magma Accumulation and Eruption
Dynamics-Models indicated that 18 million cubic meters of magma had
accumulated beneath the fissure since the March eruption, the IMO
reported. This was the largest volume of magma to build up in the
reservoir since the intrusion first formed in autumn 2023. And the lull
in aboveground activity between March and May represented the longest
period since late 2023 that magma had accumulated without
erupting.Impact on Local Areas and Air Quality-When lava did break
through to the surface at 12:46 p.m. local time on May 29, it gushed at
an estimated 1,500 cubic meters per second for several hours. For
comparison, lava discharged at an estimated 1,100-1,200 cubic meters per
second in the early hours of the March eruption and 600 cubic meters
per second at the start of the February eruption.The flows again covered
roads and threatened the town of GrindavÃk, which has largely remained
empty since evacuations in late 2023. Human-built defensive walls along
the northwest side of town diverted lava away from buildings. Flows also
spurred renewed evacuations at the Blue Lagoon, a geothermal spa
several kilometers north of GrindavÃk. When it reopened on June 2,
visitors could see molten lava erupting in the distance.As with previous
bursts of activity, this eruption did not disrupt air travel; effusive
eruptions such as these tend to emit minimal ash. However, the long
daylight hours increased the likelihood for volcanic smog, or vog, to
form, and this haze was observed in different parts of the country, the
IMO reported. Vog, which consists primarily of very fine sulfate (SO4)
particles, forms when sulfur dioxide and other volcanic pollutants mix
