OTTAWA — Police officers descended on anti-government protesters in Ottawa on Friday, arresting at least 100 people and towing more than 20 vehicles in a push to end a three-week occupation that has reverberated across Canada and around the world.Dozens of officers who had gathered in the bitterly cold downtown core following an overnight snowstorm started to move mid-morning under a bright sun, pushing the protesters back and making arrests along the way.Supported by officers on horseback and on rooftops, lines of police slowly advanced on an intersection just east of Parliament Hill, isolating one group of protesters.Police blasted warnings over a loudspeaker before officers advanced intermittently, forcing back dozens of demonstrators, some of whom linked arms or laid down in resistance while others hurled insults or tried to flee.Officers in military green, some with gas masks and what appeared to be tear-gas guns, converged on the protesters from another direction in an apparent pincer movement before a third group of police boxed them in.As officers closed on that group, other protesters watched from their main camp further west on Wellington Street near the National War Memorial and Parliament Hill, urging their embattled comrades to “hold the line” and hurling their own invective.By evening, the situation grew more heated. A group of mounted police suddenly charged a large group of protesters facing police lines near the Senate in an apparent effort to move the crowd up toward Wellington Street. Many in the shocked crowd ran, some yelling, "You are trampling us!"Ottawa police said on Twitter that protesters had continued "assaultive behaviour" with the police line and to prevent an escalation or further injury, mounted officers were sent in to create a safe distance between officers and protesters.As this was happening, police said, a bicycle was thrown at the feet of one of the horses in an attempt to injure it. One person was arrested for allegedly intentionally harming a police service animal."Protesters are assaulting officers, have attempted to remove officers' weapons. All means of de-escalation have been used to move forward in our goal of returning Ottawa to its normalcy," the police service tweeted.The police action, which included the RCMP, Ontario Provincial Police, local officers and units from other cities, followed an initial round of arrests Thursday against key organizers.It also came after repeated warnings and signals in the past two days that police were preparing for a crackdown following weeks of accommodating the demonstration, which had left many Ottawa residents angry, frazzled and critical of the city’s police force.Ottawa police interim chief Steve Bell told a news conference Friday that clearing the area will take time, but the operation is "deliberate and methodical" and police are in control on the ground.Those arrested have been charged with various offences including mischief, he said, adding police are still urging demonstrators to leave peacefully.He said there has been no need to interact with the Children's Aid Society of Ottawa, but it still "shocks and surprises" him that children are being put in harm's way in the middle of a demonstration where a police operation was unfolding."We will continue to look after their safety and security. But we implore all the parents who have kids in there — get kids out of there," Bell said. "They do not need to be in the middle of this. It is not a safe place for them."Ottawa police have accused some protesters of putting children between themselves and advancing officers. The allegation was not independently verified.As police pushed back the protesters, tow trucks moved in to remove some of the dozens of big rigs and other vehicles that have been used to essentially blockade the streets around Parliament Hill since late last month.Police were also staffing dozens of checkpoints around the downtown core designed to prevent any new protesters from arriving to reinforce those inside the perimeter.Rows of officers moved in on truckers who were parked at a major intersection near the Parliament buildings, where those inside such as Dale Sherstobitoff were ordered out of their cabs and onto the street."I'm embarrassed of our prime minister. I'm embarrassed of these cops," she said. "This shouldn't be happening in Canada."While some protesters on the outer edges of the downtown protest were starting to pack their bags and rolling suitcases into the back of their pickups ahead of leaving, others said they were unperturbed by the threat of arrest and planned to stay.Some continued to gather in the street in front of Parliament Hill, delivering speeches from a makeshift stage.Yet even as some were digging in, key organizers and figures within the protest such as Pat King were bowing out.King initially urged demonstrators to walk to Parliament Hill and jackknife rigs in front of tow trucks to prevent them from moving vehicles. But he later reversed course, telling protesters on a Facebook livestream to retreat from downtown Ottawa and regroup at a nearby truck stop.He later posted a video of police arresting him in his vehicle.Two other protest organizers — Chris Barber and Tamara Lich — were arrested Thursday. Barber has also been charged with counselling to disobey a court order and to obstruct police.A judge with the Ontario Court of Justice granted bail to Barber. Justice Julie Bourgeois released him on a $100,000 bond and on the conditions he leave Ontario by Feb. 23, not publicly endorse the convoy or have any contact with the other major protest organizers. Lich is to appear in Ottawa courtroom on Saturday morning and was to spend the night in jail awaiting her bail hearing.King, Lich and other organizers of the so-called Freedom 2022 protests also saw a temporary freeze to their bank accounts — including Bitcoin and cryptocurrency funds — following an Ontario Superior Court ruling on Thursday.In addition, a class-action lawsuit on behalf of thousands of downtown Ottawa residents seeks millions of dollars in damages for the noise and serious disruptions caused by the protest.Some protesters have said they came to Ottawa simply to demand that COVID-19 measures be lifted. But others, including those who claim to be leading the convoy, have demanded the Liberal government be ousted.The protest in Ottawa quickly spread to other parts of the country, disrupting business and trade amid concerns far-right extremists and hate groups were trying to use the demonstrations to advance their ideological agendas.Police started to clear the protesters in southern Ontario, Alberta and elsewhere earlier this week. The Ottawa force's chief resigned Wednesday amid intense criticism over the state of lawlessness downtown.While police were clearing the streets outside, members of Parliament were forced to cool their heels on a divisive debate around the Liberal government’s decision this week to invoke the Emergencies Act in response to the protests.Government House leader Mark Holland said House of Commons Speaker Anthony Rota and House leaders from all parties agreed to cancel the sitting on the advice of parliamentary security.The government was closely monitoring the police operation and would await further advice from security officials on when the House could reopen, he added.MPs had been scheduled for another daylong debate of the government's emergency orders, which took effect earlier this week but require confirmation by the House of Commons and Senate.The new powers include the ability to freeze bank accounts of protest participants and bar people from assembling in specific places or joining protests that threaten trade, critical infrastructure, individuals or property.It is also now illegal to bring children to within 500 metres of the blockades or provide supplies or property to participants.The measures are facing legal challenges including from the Canadian Civil Liberties Association. The Foreign Ministry on Saturday issued a fresh call for Israelis in Ukraine to immediately leave the country, amid growing Western warnings of a looming Russian invasion.The ministry made the appeal after holding a situational assessment and following talks that director-general Alon Ushpiz held with unspecified figures at the Munich Security Conference.A Foreign Ministry statement also cited “the events in eastern Ukraine,” apparently referring to intensifying clashes there between Ukrainian forces and Russian-backed separatists.“An eruption [of war] will be quick and severe,” the statement said.The ministry said it decided to keep Israeli Ambassador Michael Brodsky in Kyiv to assist Israelis seeking to leave. He and embassy staff will open the consular section on Sunday “to provide travel documents to citizens that require this,” according to the statement.The Foreign Ministry also said it was keeping tabs on the decisions by the US and Britain to move their embassies in Kyiv to the city of Lviv, “with the aim of safeguarding the lives of the State of Israel’s envoys in Ukraine while providing a response to Israeli citizens.”The Foreign Ministry issued a travel warning for Ukraine last weekend and urged Israelis in the country to immediately leave, a call repeated throughout the week by Israeli officials. MOSCOW (AFP) — Russia test-fired nuclear-capable missiles on Saturday as Russian President Vladimir Putin oversaw a dramatic military exercise and as the United States again warned that it believes Moscow plans to invade Ukraine within days.Ukrainian President Volodymyr Zelensky meanwhile arrived in Germany to shore up support among Western allies, despite a significant increase in shelling in the country’s east in which a Ukrainian soldier was killed.The fierce US warnings and the evacuation of civilians from Russian-backed rebel regions in Ukraine have brought fears of a major conflict in Europe to their highest level after weeks of tensions.The Kremlin insists it has no plans to attack its neighbor, which has angered Moscow by seeking closer ties with NATO and the European Union.But Moscow is doing nothing to reduce fears, with state media accusing Kyiv of plotting an assault on the rebel-held pro-Russia enclave in eastern Ukraine.Russian television showed images of Putin and Belarusian leader Alexander Lukashenko sitting at a round table in the Kremlin situation room, in front of a bank of screens showing military commanders as they test-fired their latest hypersonic, cruise and nuclear-capable ballistic missiles.“All the missiles hit their targets, confirming their performance objectives,” the Kremlin said, adding that the drills included Tu-95 bombers and submarines.Earlier, Kremlin spokesman Dmitry Peskov had made a reference to nuclear launch codes.“Such test launches, of course, are impossible without the head of state. Separatist leaders in eastern Ukraine ordered a full military mobilization Saturday amid a spike of violence in the war-torn region and fears in the West that Russia might use the strife as a pretext for an invasion.Denis Pushilin, the head of the pro-Russia separatist government in Ukraine’s Donetsk region, released a statement announcing a full troop mobilization and urging reservists to show up at military enlistment offices.A similar announcement quickly followed from Leonid Pasechnik, a separatist leader in the Luhansk region.Pushilin cited an “immediate threat of aggression” from Ukrainian forces, accusations that Ukrainian officials vehemently denied earlier.“I appeal to all the men in the republic who can hold weapons to defend their families, their children, wives, mothers,” Pushilin said. ”Together we will achieve the coveted victory that we all need.”The separatists and Ukrainian forces have been fighting for almost eight years. The defense official spoke on condition of anonymity to discuss internal US military assessments.The official also said the number of Russian ground units, known as battalion tactical groups, in the border area had grown to as many as 125, up from 83 two weeks ago. Each group has 750 to 1,000 soldiers.Meanwhile, the Kremlin announced that it would conduct massive nuclear drills Saturday, and Putin pledged to protect Russia’s national interests against what it sees as encroaching Western threats.Russia’s defense ministry said Saturday’s “planned exercises” will test launches of ballistic and cruise missiles.It said the exercises would involve nearly all branches of Russia’s armed forces, including its aerospace and strategic rocket forces, as well the Northern and Black Sea fleets, which have nuclear-armed submarines.“Putin, most likely, will watch the exercises from the situation center,” Kremlin spokesman Dmitry Peskov said.“Such test launches, of course, are impossible without the head of state. US Secretary of State Antony Blinken and Russian Foreign Minister Sergey Lavrov agreed to meet next week.Immediate worries focused on eastern Ukraine, where Ukrainian forces have been fighting the pro-Russia rebels since 2014 in a conflict that has killed some 14,000 people. Violations of a 2015 ceasefire agreement, including shelling and shooting along the line of contact, have been common.However, violence has escalated in recent days. A bombing struck a car outside the main government building in the rebel-held city of Donetsk on Friday, according to an Associated Press journalist there.The head of the separatist forces, Denis Sinenkov, said the car was his, the Interfax news agency reported. There were no reports of casualties and no independent confirmation of the circumstances of the blast. Targeted violence is unusual in rebel-held cities.Adding to the tensions, two explosions shook the rebel-controlled city of Luhansk early Saturday. The Luhansk Information Center said one of the blasts was in a natural gas main. The center cited witnesses as saying the other was at a vehicle service station.There was no immediate word on injuries or a cause. Luhansk officials blamed a gas main explosion earlier in the week on sabotage.By Saturday morning, the separatists in the Luhansk and Donetsk regions, which form Ukraine’s industrial heartland known as the Donbas, said more than 6,600 residents of the rebel-controlled areas had been evacuated to Russia.Separatist officials announced plans Friday to evacuate hundreds of thousands of people. Russia has issued about 700,000 passports to residents of the rebel-held territories. Claims that Russian citizens are being endangered might be used as justification for military action.Pushilin, the head of the Donetsk rebel government, said women, children and the elderly would go first, and that Russia has prepared facilities for them. Pushilin alleged in a video statement that Zelensky was going to order an imminent offensive in the area.Metadata from two videos posted by the separatists announcing the evacuation show that the files were created two days ago, The Associated Press confirmed.US authorities have alleged that the Kremlin’s effort to come up with an invasion pretext could include staged, prerecorded videos.Authorities began moving children from an orphanage in Donetsk, and other residents boarded buses for Russia. Long lines formed at gas stations as more people prepared to leave on their own.Putin ordered the Russian government to offer a payment of 10,000 rubles (about $130) to each evacuee, equivalent to about half of an average monthly salary in the war-ravaged Donbas region.Around the volatile line of contact, a UN humanitarian convoy came under rebel shelling in the Luhansk region, Ukraine’s military chief said. No casualties were reported. Rebels denied involvement and accused Ukraine of staging a provocation.Ukraine denied planning any offensive.“We are fully committed to diplomatic conflict resolution only,” Foreign Minister Dmytro Kuleba tweeted.

The Conservatives said Monday they want to read the details of the motion before deciding whether they’ll be backing it.“I am hoping that we can get to a point of full support. I noticed that even the Bloc, who said that they were against it, are saying they are now looking at some of the details and there is some openness there. So it’s my objective to get as much parliamentary support for this essential implementation of this act as possible,” Holland said.MPs are set to adjourn for a week on Friday and the Senate is not currently sitting until Feb. 22 so it’s possible one or both chambers would have to be recalled or sitting hours extended, depending on when this motion is received. The Emergencies Act has been enacted. Here's what that means-“It’s never been used before… So there’s a lot of procedural things that kind of had to be cleared out and understood first, and now we’re going to be talking brass tacks around when and how and these types of things,” Holland said. “We are seized by this.”Both the House and the Senate have the power to revoke the declaration at any time, as does the government.“If a motion for confirmation of a declaration of emergency is negatived by either House of Parliament, the declaration, to the extent that it has not previously expired or been revoked, is revoked effective on the day of the negative vote and no further action under this section need be taken in the other House with respect to the motion,” reads the Act.If discussion of the Act in the House on Tuesday was any indication of what is to come when the official debate gets underway, there’s set to be some fiery exchanges.“Twenty-four hours in and there are more questions than answers. Questions about whether this is justified, questions around if the criteria is met, questions around what this means to Canadians’ rights and freedoms. Parliamentary approval is required in order for the prime minister to use this unprecedented sledgehammer,” said interim Conservative Leader Candice Bergen leading off question period.More than once during question period, the House of Commons Speaker interjected to address heckling, prompting the prime minister to say it’s “a time for responsible leadership, not crass partisanship.”After three weeks of what Public Safety Minister Marco Mendicino has described as “lawless” behaviour at times, the government is hoping it can move to revoke the emergency powers in less than a month.A cross-party and closed-door Parliamentary Review Committee will also be struck, that must include “at least one member of the House of Commons from each party that has a recognized membership of twelve or more persons in that House and at least one senator from each party in the Senate that is represented on the committee by a member of the House of Commons.”It’ll be the committee’s responsibility to monitor the implementation of the Act and ensure the government is using its powers responsibly.Within 60 days of the declaration of emergency being revoked or expiring, the government will have to convene an inquiry to study the use of the powers. The report stemming from this work will have to then be presented to Parliament within 360 days.

Lawyers for indicted former Clinton lawyer Michael Sussmann accused Special Counsel John Durham of adding inflammatory accusations to a legal filing purely to 'taint' the jury pool and 'inflame' the media with claims that Clinton spied on Donald Trump, according to a court document filed on Tuesday.The allegations have electrified Trump allies who claim them as proof that the former president was the victim of subterfuge in 2016.Durham's claim is not included in an indictment but instead offered as 'factual background' in a dispute over Sussmann's choice of lawyers and whether they represented a conflict of interest.'Unfortunately, the Special Counsel has done more than simply file a document identifying potential conflicts of interest. Police in Ottawa see signs that guns have been brought into a truckers' protest against vaccine mandates that has paralysed the Canadian capital, the police chief said on Wednesday, adding that calling in the military would pose major risks."We have had an indication around firearms coming into this jurisdiction as part of this demonstration as much as a week and a half ago," Chief Peter Sloly told a briefing.He said there was evidence of "a significant element from the United States in the funding and organising" of the protest.Dozens of truck drivers protesting about COVID-19 vaccine mandates have blocked central routes in the city for six days. They say they are investigating reports of criminal offences, including hate crimes and desecration of public property, and have made three arrests so far."We're looking at every single option, including military aid," Sloly said. Explosive device, guns, stolen EPS uniforms seized during Edmonton bust BY Sean Amato-CTV News Edmonton-Published Feb. 3, 2022 2:04 p.m. EST

Police are still searching for three men after an explosive device, "numerous" firearms and several first responder uniforms were discovered at a house in southeast Edmonton.Edmonton Police Service said officers noticed the men "loading suspicious items into a taxi" in the area of 44 Avenue and James Crescent at 3:50 a.m. on Saturday. The three men ran into a home when they saw officers, police said.Officers searched the bags left behind and found rifles with silencers, "several other firearms," and an EPS uniform.A tactical team was called in and police said they negotiated with the people inside the house."We got a call from police, nobody was supposed to come into the crescent or go out and stay away from the windows and doors," said Sant Kalirai, who lives near the scene.Kalirai believes the house is a rental and said police have been there several times recently."Kind of seemed like they were not good citizens. I kind of avoided them cause the police were coming by," he said."It was scary, we had no idea what was going on. We just saw all these SWAT team members, the canine team was there. They moved in about a year ago and the police have been there on a weekly basis," said neighbour Melissa Auchenberg.She said the police caved the garage door in, and photos of the scene confirm that. TORONTO — Ontario is ending its vaccine certificate system on March 1, when capacity limits will lift as well, Premier Doug Ford announced Monday, though he said masking requirements will remain for now.Ford insisted the step is not a result of pressure from anti-vaccine mandate protesters."Today’s announcement is not because of what’s happening in Ottawa or Windsor, but despite it," he said."The extraordinary measures that we introduced during this pandemic were always intended as a last resort. I stood at this very podium and promised you that these tools would only be used for as long as they were absolutely necessary and not one day longer. The removal of these measures has always been our objective."Public health indicators have been improving, and Chief Medical Officer of Health Dr. Kieran Moore presented a plan to lift the COVID-19 restrictions and vaccine certificates, Ford said, a plan that has been in the works since before protesters began occupying downtown Ottawa.Ontario is fast-tracking previously announced steps to lift restrictions, including moving the next step of its reopening plan up to Thursday instead of next Monday.On that day, social gathering limits will increase to 50 people indoors and 100 people outdoors, while capacity limits will be removed in places such as restaurants, bars, gyms and movie theatres. And the Bloc Québécois wants his son to apologize for it.Fifty years after the October Crisis of 1970, the Bloc is calling on Prime Minister Justin Trudeau to officially apologize for his father’s use of the War Measures Act and Canadian military — at the request of the Quebec government — to quash terrorist activity in the province 50 years ago. In a motion it plans to debate in the House of Commons, the Bloc says Trudeau should apologize on behalf of the federal government for “the use of the army against Quebec’s civilian population to arbitrarily arrest, detain without charge and intimidate nearly 500 innocent Quebecers.”The reference is to how Pierre Trudeau used the law to suspend civil liberties and sent in the military — uttering his famed quip “just watch me” when asked how far he would go — after members of radical separatist Front de Libération du Quebec (FLQ) kidnapped provincial cabinet minister Pierre Laporte and British diplomat James Cross. Laporte was killed and his body found in the trunk of a car two days after the War Measures Act was invoked.The law suspended normal civil liberties, allowing for searches without warrants, arrests and detentions without bail, and for membership of the FLQ to be deemed a criminal act.Speaking to reporters in Ottawa on Wednesday, Bloc Leader Yves-François Blanchet pointed to how hundreds of people were detained and interrogated during the crisis, and that then-Progressive Conservative leader Robert Stanfield criticized the elder Trudeau’s use of these extraordinary powers. She and her husband were arrested the third time and jailed for 24 hours, during which time she said she was strip searched, interrogated for hours, subjected to a gynecological exam and told she could be shot if she tried to escape.“I had the impression that I was in a film, that I was at the cinema in a horror drama. I had the impression that I was in a totalitarian country,” she said in French.Robert — who also recounted her story in various Quebec media in recent weeks — said she did not speak of her experience for years, and that while Laporte’s death was “terrible” and the situation was “serious,” she believes a government apology would be appropriate for what she and others experienced.“I know well that it won’t change anything,” she said. “But I think on the level of principle, it’s important that the government recognizes that it made a mistake, because I think it was an enormous mistake.”

In July 1988, the War Measures Act was repealed and replaced by the Emergencies Act. The Emergencies Act authorizes “the taking of special temporary measures to ensure safety and security during national emergencies and to amend other Acts in consequence thereof.” In contrast to the sweeping powers and violation of civil liberties authorized by the War Measures Act, the Emergencies Act created more limited and specific powers for the federal government to deal with security emergencies of five different types: national emergencies; public welfare emergencies; public order emergencies; international emergencies; and war emergencies. Under the Act, Cabinet orders and regulations must be reviewed by Parliament, meaning the Cabinet cannot act on its own, unlike under the War Measures Act. The Emergencies Act outlines how people affected by government actions during emergencies are to be compensated. It also notes that government actions are subject to the Canadian Charter of Rights and Freedoms and the Canadian Bill of Rights.

The War Measures Act was a federal law adopted by Parliament-on 22 August 1914, after the beginning of the First World War. It gave broad powers to the Canadian government to maintain security and order during “war, invasion or insurrection.” It was used, controversially, to suspend the civil liberties of people in Canada who were considered “enemy aliens” during both world wars. This led to mass arrests and detentions without charges or trials. (See also: Internment in Canada; Ukrainian Internment in Canada; Internment of Japanese Canadians.) In 1960, the War Measures Act was amended by the Canadian Bill of Rights, the country’s first federal law to protect human rights and fundamental freedoms. The bill declared that fundamental freedoms of speech, religion, assembly and of the press were to be upheld regardless of “race, national origin, colour, religion or sex.” It also asserted the right to “life, liberty, security of the person and enjoyment of property, and the right not to be deprived thereof except by due process of law.”However, Section 2 of the Bill of Rights stated that Parliament could override the rights afforded by the bill by inserting a “notwithstanding” clause in the applicable statute passed by Parliament — such as the War Measures Act. This was done only once, during the 1970 October Crisis-in Quebec.The suspension of civil liberties in Quebec was politically controversial. When the crisis was over, Prime Minister Pierre Trudeau pledged to refine and limit the application of the Act in internal crises. However, by the time the final Trudeau government was defeated in 1984, the War Measures Act had not been modified. Repealing and Replacing the War Measures Act-In the decades following the world wars, Canadians who had been interned and who had their property seized under the provisions of the War Measures Act began lobbying for compensation for and recognition of their wartime treatment. Under Prime Minister    Brian Mulroney, the federal government repealed the War Measures Act and replaced it with the Emergencies Act, which received royal assent on 21 July 1988.The Japanese Canadian redress movement resulted in an official apology from Prime Minister Mulroney on the floor of the House of Commons In 1988. Financial compensation was also given to people affected by the government’s invocation of the War Measures Act. In the case of people interned during the First World War, a community settlement fund was established in 2008 to support commemorative and educational projects about Canada’s first national internment operations.Characteristics of the Emergencies Act.The Emergencies Act is different from the War Measures Act in some important ways. The Act created more limited and specific powers for the federal government to deal with security emergencies. Under the Emergencies Act, Cabinet orders and regulations must be reviewed by Parliament, meaning the Cabinet cannot act on its own, unlike under the War Measures Act. The Emergencies Act outlines how people affected by government actions during emergencies are to be compensated. It also notes that government actions are subject to the Canadian Charter of Rights and Freedoms and the Canadian Bill of Rights.Canadian Charter of Rights and Freedoms-National Emergency-The Emergencies Act defines a “national emergency” as “an urgent and critical situation of a temporary nature that: a) seriously endangers the lives, health or safety of Canadians and is of such proportions or nature as to exceed the capacity or authority of a province to deal with it; or b) seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada.”If a national emergency is declared, the Act prohibits the federal government from detaining, imprisoning or interning Canadian citizens or permanent residents “on the basis of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.”Public Welfare Emergency-The Act defines a “public welfare emergency” as one “that is caused by a real or imminent a) fire, flood, drought, storm, earthquake or other natural phenomenon; b) disease in human beings, animals or plants; or c) accident or pollution; and that results or may result in a danger to life or property, social disruption or a breakdown in the flow of essential goods, services or resources, so serious as to be a national emergency.”If a public welfare emergency is declared, the federal government is required to specify a) the “state of affairs constituting the emergency;” b) the “special temporary measures that the Governor in Council anticipates may be necessary for dealing with the emergency;” and c) the “area of Canada to which the direct effects of the emergency extend.”Under the Act, a public welfare emergency grants the federal government the right to: regulate or prohibit travel “to, from or within any specified area;”evacuate people and remove personal property from any specified area, and to make arrangements “for the adequate care and protection of the persons and property;”requisition or use property; direct any person or “class of persons” to render essential services, with “the provision of reasonable compensation;”regulate “the distribution and availability of essential goods, services and resources;”authorize and make emergency payments; establish emergency shelters and hospitals; assess “damage to any works or undertakings and the repair, replacement or restoration thereof;”assess damage to the environment; impose fines and indictments “for contravention of any order or regulation made under this section.”If a public welfare emergency is declared, the Act prohibits the federal government from assuming control of any police force that normally falls under the jurisdiction of a municipality or province. The Act also stipulates that a public welfare emergency “expires at the end of ninety days unless the declaration is previously revoked or continued in accordance with this Act.”Public Order Emergency-The Act defines a “public order emergency” as one that “arises from threats to the security of Canada and that is so serious as to be a national emergency.” The Act also stipulates that “threats to the security of Canada” are to be defined in accordance with section 2 of the Canadian Security Intelligence Service Act. (See Canadian Security Intelligence Service.)-If a public order emergency is declared, the federal government is required to specify: a) the “state of affairs constituting the emergency;” b) the “special temporary measures that the Governor in Council anticipates may be necessary for dealing with the emergency;” and c) the “area of Canada to which the direct effects of the emergency extend.”Under the Act, a public order emergency grants the federal government the right to: regulate or prohibit “any public assembly that may reasonably be expected to lead to a breach of the peace; travel to, from or within any specified area; or the use of specified property;”designate and secure protected places; assume control, restoration and maintenance of public utilities and services; direct any person or “class of persons” to render essential services, with “the provision of reasonable compensation;” impose fines and indictments “for contravention of any order or regulation made under this section.”The Act specifies that the application of these powers must not interfere with the ability of a province to respond to an emergency of its own. A public order emergency “expires at the end of thirty days unless the declaration is previously revoked or continued in accordance with this Act.”Other Emergencies and Provisions-The Act lists similar stipulations to be applied in case of an international emergency or a war emergency. It also lists the requirements for proper parliamentary supervision during the application of the Act, and for compensation of people and groups after the application of the Act.
