This article is the first in a series exploring the "status quo" on Jerusalem's Temple Mount.Though "maintaining the status quo" on the Temple Mount seems to be a universal goal, no one is quite sure what it is. Those who believe it means that Jews must not pray there should take note that the late Rabbi Shlomo Goren, Chief Rabbi of the IDF and later of Israel, wrote that Jews prayed there for "hundreds of years" up until three centuries ago.When Israeli, American and other diplomats and statesmen speak of maintaining the status quo, they generally mean that Muslims must be allowed free entry for worship or leisure, while Jews must continue to be restricted in their access. Jews, according to this definition of the "status quo," must be prevented from entering in large groups, or at other than several specified daily hours – and from praying at the site altogether.Prime Minister Binyamin Netanyahu and other Cabinet ministers have repeatedly stated of late that there will be no change in the status quo. They have made this clear to Jordan’s King Abdullah, the European Union's new foreign policy chief Federica Mogherini, and others.However, this "status quo" under which Jews do not pray on the Temple Mount actually came into effect only relatively recently. As recently noted by Rabbi Eliezer Melamed in BeSheva, Rabbi Goren, who blew a shofar at the site upon its liberation during the Six Day War in 1967, wrote in his work "The Temple Mount" that "Jewish prayer at the Western Wall began only in the 16th century; prior to that, Jews prayed for centuries on the Temple Mount."Rabbi Goren, a Temple Mount expert, notes that, based on the renowned Radbaz – the 16th century Rabbi David Ben Shlomo Ibn Zimra, whose rulings form the basis of much of accepted Halakhah – and others, "it is clear that after the Amoraim and Geonim [i.e., after the year 1038], the general custom followed the opinion that there was no reason to forbid entry to the Holy Site in its destruction, as the Meiri writes… This is true even when there was no Red Heifer for purification… This practice cannot be attributed to lack of knowledge; it is not reasonable to assume that Jews prayed for centuries at the site of the Holy Temple without anyone mentioning that this involves a grave prohibition, punishable by karet."Of course, the custom gradually changed. The Muslims banned the Jews from entering the holy site, and their "holiest site" gradually came to be the Western Wall – which was actually just a supporting wall of the Temple Mount. "When the Medrash states that the Divine Presence never left the Western Wall," Rabbi Goren writes, "it does not refer to this wall, but rather to the western wall of the Temple courtyard or of the sanctuary."Rabbi Goren writes that he himself was "bound up in chords of love for the [present-day] Western Wall, where I used to pray every Sabbath and holiday," and that this prevented him from acting immediately after the Six Day War to institute Jewish entry to the Temple Mount. However, "the voice of our cry [in Psalms], 'Who will ascend to the mountain of G-d?', aroused me to take strength and clarify the matter of visiting the Temple Mount." This he did by assigning the IDF's Engineering Corps to map out the exact measurements of the Mount, and consulting Rabbinic and other texts to clarify the precise location of the Holy of Holies and other forbidden areas.Rabbi Goren attempted to arrange prayer services on the Temple Mount, but was stopped from doing so by then-Defense Minister Moshe Dayan.In any event, the "status quo" in previous centuries included Jewish prayer on the Temple Mount. After 1967, a new "status quo" was instituted – one that barely resembles the situation of today. More on this in Part II of this series.

It is very popular to demand nowadays that Israel "maintain the status quo" on the Temple Mount – but barely anyone can say exactly what that "status quo" is. In fact, the rules instituted for prayer rights on the Mount immediately after the Six Day War barely resemble those in place today.It must be stated at the outset that after the Six Day War, control of the Temple Mount was granted to the Muslim Waqf by none other than then-Defense Minister Moshe Dayan. A very controversial personality in modern Israeli history, Dayan was credited with much of the responsibility for Israel's miraculous victory at the time – and was blamed for much of what happened during the Yom Kippur War six years later.Rabbi Eliezer Melamed, Rabbi of the town of Har Brachah and Dean of its Yeshiva, wrote this week in B'Sheva, "For years, it has been known that there were two sides to Moshe Dayan; darkness and light served together. On the one hand, he was a true Israeli war hero, and on the other hand, he was an adulterer and a thief [of archaeological artifacts – HF]. Apparently, the latter traits tipped the scales against him. [After 1967] he began to lose his public stature; his name will be remembered in infamy."

After Dayan had the Israeli flag removed from the Temple Mount after the Six Day War, he put in place the following arrangements (based on a list compiled by Jerusalem expert and historian Nadav Shragai):

1. The Waqf, a Jordanian-Muslim religious body, would continue to manage the site.

2. Jews would be permitted to visit the Temple Mount, but forbidden to pray there.

3. Israel's police would maintain law and order in the sacred compound.

4. Israeli sovereignty and law would be applied to the Temple Mount, as to the other parts of Jerusalem.

Shortly afterwards, it was also decided that Jews and other non-Muslims would enter the Mount only via the Mughrabi Gate, located at the center of the Western Wall. It also later became prohibited to unfurl any flag on the Mount."In retrospect," Shragai sums up, echoing the sentiments of many Jews around the country and the world, "the concession Dayan made in the name of the Jewish People was indeed immense, colossal, almost inconceivable. The Jewish State entrusted its holiest place to a competing religion – the Muslim religion, for which the place is only the third in holiness, and gave up the right to pray there."At that time, Jewish protest against the regulations was minimal, for the Jewish public was excited at the prospect of being able to pray at the Western Wall – a supporting wall of the Temple Mount. In addition, virtually all rabbis ruled in accordance with long-standing tradition - and long-standing ignorance of the exact locations of the Halakhically-forbidden areas on the Mount - that entry to the Temple Mount was forbidden.Today, over 40 years later, the above "status quo" is no longer in effect. For one thing, religious Jews now clamor to be allowed in – as the boundaries of the permitted locations have become well-known. In addition, they fear the loss of Israeli sovereignty there, and are convinced that their frequent visits to the site will prevent this.Under the original arrangements, Jews were freely allowed to visit the Mount – but today, such visits are often restricted. They may ascend to the holy site only five days a week, for three hours in the morning and one in the afternoon. Even these few hours are often removed from the Jewish itinerary when Arab incitement and unrest portends violence in the area.Religious Jews may visit only in small groups; visitors are often forced to wait for hours until those in front of them in line have completed their visits. Even then, they frequently are not allowed in.In addition, the prohibition on raising flags on the Temple Mount is enforced only in the case of Israeli flags, but not when Hamas or Palestinian Authority flags are unfurled.When Knesset Members and other public figures such as Temple Mount activist Yehuda Glick (still recovering from the critical wounds he suffered in a near-fatal Palestinian assassination attempt) call for Jewish prayer rights at Judaism's holiest site, they are often accused of trying to change the "status quo." Israel will never agree to limit its construction activity in Jerusalem, Foreign Minister Avigdor Liberman said on Sunday."We won't accept any limitation on building in Jewish areas of Jerusalem," he said at a news conference with his German counterpart Frank-Walter Steinmeier, insisting that Israel would never accept construction in the city's eastern sector as "settlement building.""It must be clear to everyone that Israel will never accept a definition of construction in Jewish neighborhoods in Jerusalem as 'settlement activity,' because there is a broad consensus in Israel where Jews agree -  left, right and center - [on this], and it hopes that the European Union will take this into account," Liberman added, saying the concept is a "distortion of reality.""We do not accept any restrictions on construction in Jewish neighborhoods in Jerusalem and there will be no compromise about it," he continued. "Anyone who thinks that the Israeli government is about to give in and limit construction in Jerusalem is wrong, we will defend our independence and sovereignty."Liberman's comments surface after a hailstorm of criticism from UN, EU, and US officials over Jewish building in the capital.Over the past several weeks, Prime Minister Binyamin Netanyahu gave instructions for the building of about 660 homes in Ramat Shlomo and about 400 more in Har Homa as well as approving 2,610 building tenders from 2012 to be approved for full construction.The EU has been particularly vehement in its criticism of the construction, saying that building Jewish homes would see 'a return to violence' and threatening Israel multiple times to further its agenda in the Middle East, dangling unprecedented aid packages to both Jerusalem and Ramallah if a two-state solution is implemented.Despite this, it has denied threatening Israel - or promoting the Boycott, Divestment, and Sanctions movement - on multiple occasions.

German Foreign Minister Frank-Walter Steinmeier in talks in Ramallah on Saturday hailed the recent easing of Israeli-Palestinian tensions in Jerusalem, for which he credited the intervention by his US counterpart."We welcome the meetings in Amman... which led to an improvement in the situation, especially around the mosques compound," he said, quoted by the Palestinian news agency WAFA.On Friday, Israel lifted restrictions on Muslims praying at the Al-Aqsa mosque on Jerusalem's Temple Mount, a day after US Secretary of State John Kerry held talks in the Jordanian capital and announced an agreement on steps to reduce tensions.The mosque compound, the holiest site in Judaism, has been the focus of months of unrest in Jerusalem.Palestinians have upped their violent opposition to an increasingly vocal campaign by Jewish activists for the right to pray at the site, where under current rules on Muslims are allowed to pray - despite it being the holiest site for Jews.Islamists have been regularly clashing with Israeli police on the Mount and escalated a campaign of harassment against Jewish visitors, who are already under severe restrictions due to Muslim pressure. The violence reached a peak with the attempted murder of prominent Jewish Temple Mount activist Yehuda Glick last month.The violence prompted Kerry to meet the two sides in neighboring Jordan on Thursday, after which he announced that "confidence-building measures" had been agreed.Steinmeier, who held talks in Ramallah with Palestinian Authority leader Mahmoud Abbas and is to meet Israeli leaders on Sunday, said a return to the negotiating table was the only way forward."At present, there is no room or the necessary conditions for a resumption of negotiations, and the main thing for now is to ease tensions," he said.But "there is no alternative to negotiations to reach a two-state solution... a Palestinian state living in peace and security alongside Israel."Steinmeier's visit came as the Palestinians marked the 26th anniversary of a symbolic declaration of independence by the Palestine Liberation Organisation (PLO) terrorist group, which at the time met in exile in Algiers.AFP contributed to this report.

After joining his National Union party's Tekuma faction with Jewish Home's Knesset list in the last elections, Building Minister Uri Ariel has not so subtly criticized Jewish Home Chairman Naftali Bennett of "selling out" values for mandates.In a meeting with around 60 heads of Torah seed group communities from around the country in Ramle together with Tekuma director general Ofir Soffer, Ariel discussed the negotiations between his group and Jewish Home after Bennett presented a unity deal last week to join Tekuma to his party."We have to clearly define what are our principles that we won't give up on," said Ariel. "I'm in favor of growing and being a large party that will lead the state but the question is what's the price."Ariel continued "does the goal sanctify the means? Is the goal to be big whatever the cost, even at the cost of conceding on our principles? The answer for me is a decisive no."The criticism comes after Jewish Home made a controversial move to more actively target secular and Druze constituencies in what some warn is an abandoning of religious Zionist values.The minister leveled sharp criticism at Bennett's party, saying "Jewish Home has a desire to go to the (political) center, and less so to be strong on issues of religion and state, and we think that even if that adds mandates there's a limit to that. You don't have to compromise to achieve more mandates. It cannot be that we won't have red lines."

Reserved seats? Or political spin?

One of the key points of the unity deal Bennett presented, which raised ire among the secular branch of Jewish Home, was that it would give the Tekuma chairperson - namely Ariel - a reserved spot as number two on the party's Knesset list."It's more than corrupt to say that they're reserving the number two spot for someone," Ariel said critically. "Doing so is to blind people. They're just handing out promises. No one wants it and no one asked for it."Indicating a potential rejection of the unity deal, at least in its proposed form, Ariel added "Jewish Home will choose its representatives however it wants. And the National Union will choose its representatives in its way."The talk of reserved seats comes as Jewish Home sources claimed on Monday that Tekuma representatives demanded in unity talks that the faction be guaranteed six of the first 15 spots on the combined Knesset list.In response Tekuma denounced the claims, saying "we suggest not letting yourself be held captive by false and hollow leaks. The National Union is holding negotiations cleanly and will not be dragged into the ugly slander game."

"They're trying to make us be forgotten"

Jewish Home is set to hold primaries likely sometime in the coming month, something which Ariel also criticized noting "primaries are a corrupt thing. It's a corrupt process where everyone has to praise themselves and in parallel explain why the rest aren't as good. ...Today more than half of the parties in the Knesset don't use primaries, and it really isn't a sanctified process."Speaking on unity with Jewish Home, he added "there are those who want to stretch out the time and not really reach unity. There's an intentional stretching out of time. That's not conjecture, I say it from information.""They say let's drag out time and then the public won't remember what the National Union is. Currently the Jewish Home isn't standing by agreements with us. That's not a mistake. It's a tactic," charged Ariel.While saying unity is his goal, Ariel warned "we are preparing to stand on our own. We are a party that wants to live and we have a clear ideology that you all know. So that the unity will succeed the National Union needs to be strong and we will make sure it is."

While China's tendency to separate economic ties and political positions means it has been growing relations with Israel even as the EU threatens sanctions, the same is true in other cases - such as Iran, where China reportedly is to double its investment.Iranian deputy minister for energy Esmail Mahsouli was quoted in the Iranian Mehr News Agency saying China raised its quota on Iranian infrastructure projects from $25 billion to $52 billion, reports BBC.Those raises in funding will particularly focus on water, electricity, oil and gas projects according to the Iranian minister.The talk of Chinese financing comes as the US and Europe continue to maintain sanctions on the Islamic regime over its nuclear program, which is currently being discussed in Vienna talks ahead of a November 24 deadline.The cash-strapped nation has been turning to China, Russia and Turkey to circumvent the sanctions.Meanwhile the US has been showing an increasingly less firm position on Iran as nuclear talks approach their conclusion, with US President Barack Obama being revealed last month to have sent a secret letter to Iranian Supreme Leader Ayatollah Khamenei urging a nuclear deal and cooperation against Islamic State (ISIS) terrorists.American officials have likewise revealed that the US is softening its position on Iran, as well as on the state's terror proxies Hamas and Hezbollah, even as Iran continues to threaten destruction against Israel.Dr. Emily Landau, head of the Arms Control and Regional Security Program at the Institute for National Security Studies, told Arutz Sheva last week that there are signs the US is anxious to gain Iran's cooperation against ISIS - even at the cost of allowing the Islamic regime to have nuclear weapons.Prime Minister Binyamin Netanyahu on Sunday warned ISIS and Iran should both be dealt with firmly, stating "we want them both to lose. The last thing we want is to have any one of them get weapons of mass destruction."
