Orly Taitz has posted on her website an order from Judge Michael Malihi denying the request of an attorney representing Barack Hussein Obama to dismiss three ballot challenges filed respectively by Taitz, Atty. Van Irion, and Atty. J. Mark Hatfield on behalf of Georgia registered voters and others.Taitz represents four presidential candidates and a Georgia voter, David Farra; Irion represents David Welden, a Georgia voter; and Hatfield represents Carl Swensson and Kevin Richard Powell, both Georgia voters.The Post & Email published an article on January 2, 2012 regarding Taitz’s ballot challenge in Georgia as well as in other states.Also on January 2, 2012, The Post & Email spoke with Atty. Van Irion, who described his ballot challenge on behalf of David Welden. Irion had stated that a hearing was scheduled for January 26, 2012, and we have contacted him to inquire as to whether or not that hearing will take place given today’s order from Judge Malihi.

In his order, Malihi wrote, in part:The Georgia Election Code (the Code) mandates that [e]very candidate for federal and state office who is certified by the state executive committee of a political party or who files a notice of candidacy shall meet the constitutional and statutory qualifications for holding the office being sought.O.C.G.A. § 21-2-5(a).The Post & Email had published another Georgia voter’s petition asking that a special grand jury be convened to investigate the non-response of Secretary of State Brian Kemp to the voter’s previous FOIA request and formal letter inquiring as to the information Kemp relied upon in 2008 to place Obama’s name on the ballot. The voter cited the same statute as Malihi in contending that registered voters have a right to challenge candidates’ qualifications for any office. The voter, Millard Blanchard, claimed that Kemp had broken the law by failing to remove Obama’s name from the 2012 presidential ballot.

Judge Malihi appeared to support Blanchard’s claim in his decision:Both the Secretary of State and the electors of Georgia are granted the authority under the Code to challenge the qualifications of a candidate. The challenge procedures are defined in Code Section 21-2-5(b), which authorizes any elector who is eligible to vote for a candidate to challenge the qualifications of the candidate by filing a written complaint with the Secretary of State within two weeks after the deadline for qualifying. O.C.G.A. § 21-2-5(b).A former secretary of state, Karen Handel, utilized the law when she disqualified someone from his candidacy for local office.
Of the new development, Taitz stated on her website, I still can’t believe this…Judge Malihi, Deputy Chief judge of the Administrative court in GA, ruled, that Obama’s motion to dismiss is denied. He will have to stand trial and prove his eligibility for office…Now judge Malihi is sending a message: nobody is above the law.Questions have swirled since 2008 regarding Obama’s constitutional eligibility for the office of president. While he claims a birth in Hawaii, many experts deemed the long-form birth certificate issued on April 27, 2011 a forgery. Obama also claims having been born to a foreign father who never held U.S. citizenship, thereby raising the issue of whether or not he meets the criterion of natural born Citizen as stated in Article II, Section 1, clause 5 of the U.S. Constitution.

The Post & Email is aware of at least one researcher who has stated that Obama falsified his entire background and that he was actually born in New York City to two U.S.-citizen parents but sent to live in Indonesia as a toddler. Trowbridge has asked Obama to step forth in integrity.Today in Concord, NH, several state legislators held a press conference to inform the public about what they believe could have been election fraud committed in 2008 by Barack Hussein Obama if he was not constitutionally eligible to seek the office of president. They have also objected to the denial by the New Hampshire Supreme Court to review a decision by the state Ballot Law Commission to include Obama’s name on the ballot for the 2012 election. The Commission as well as the Secretary of State’s office claimed they were not responsible for vetting candidates, but in both 2011 and 2008, the Assistant Secretary of State had disqualified one candidate, respectively, for failing to meet constitutional eligibility requirements for the presidency.In 2010, a candidate for U.S. Congress from Texas was disqualified by the Secretary of State for apparently having a party affiliation as he was planning to run as an Independent.A challenges to Obama’s eligibility has also been filed in New York, and a website with national scope has been established to assist voters to do so in each of the 50 states.

BRUSSELS - Tens of thousands of Hungarians on Monday (2 January) went on the streets of Budapest in protest against controversial constitutional changes enacted one day earlier by centre-right Prime Minister Viktor Orban, with former dissidents accusing him of dictatorship.According to the organisers of the rally, up to 100,000 people marched outside the opera house in central Budapest where Orban and other politicians celebrated the new constitution.Protesters chanted slogans denouncing Orban's dictatorship, holding up boards saying Enough! and Orbanistan as dignitaries arrived for the event.Viktor Orban and his servants turned Hungary from a promising place to the darkest spot in Europe,Socialist MP Tibor Szanyi said according to AFP.

Earlier that day, in a statement entitled The decline of democracy - the rise of dictatorship, 13 former Communist dissidents, a group to which Orban once belonged, accused him of removing checks and balances and pursuing a systematic policy of closing autonomous institutions.The letter also urged the EU not to sit back and watch as [Hungary] is being held hostage by an outdated, provincial tyrant,and to make a stand against him.Thanks to his super-majority in the Hungarian parliament, Orban last year passed a series of constitutional changes which critics say will limit media freedom and judicial independence. He also passed a banking law which has drawn the ire of the EU, the International Monetary Fund and the European Central Bank for putting the Hungarian central bank under Fidesz party control.The constitution now references God, defines marriage as a union between man and woman and life as beginning at conception, sparking criticism from international organisations and EU members.In Orban's view, the new legal text marks the end of the country’s transition to democracy from Communism - as he explained in an interview with the Magyar Nemzet newspaper on 24 December.Foreign journalists are right when describing what happens in Hungary not just as simple governance, but a regime change,he told the newspaper.They say this in a disparaging way but I think this is a compliment. We Hungarians have failed for over a hundred years to show western Europe our own virtues.For his part, Mark Palmer, a former US ambassador in Budapest during the country's last years of Communism until 1990, told the main opposition newspaper Nepszabadsag that Hungary's ejection from the European Union is now no longer unthinkable.The country won’t be tolerated if it no longer counts as a democracy.The former diplomat's outrage at Orban's constitutional reforms comes one week before an attempt in Washington to resume informal talks between the Hungarian government and the International Monetary Fund for a loan to prop its ailing economy.

An initial round of talks broke off last month because Fidesz approved a law curbing the independence of the central bank.Orban defied two letters from EU commission chief Jose Manuel Barroso and approved the bill. His country's credit rating was also downgraded to junk by Standard & Poor's and Moody's.

While not news to Zero Hedge readers who knew about the final debt settlement of US debt about 10 days ahead of schedule, it is now official: according to the US Treasury, America has closed the books on 2011 with debt at an all time record $15,222,940,045,451.09. And, as was observed here first in all of the press, US debt to GDP is now officially over 100%, or 100.3% to be specific, a fact which the US government decided to delay exposing until the very end of the calendar year. We wonder, rhetorically, just how prominent of a talking point this historic event will be in any upcoming GOP primary debates. And yes, technically this number is greater than the debt ceiling but it excludes various accounting gimmicks. When accounting for those, the US has a debt ceiling buffer of... $14 billion, or one third the size of a typical bond auction.

Jan. 3 (Bloomberg) -- Governments of the world's leading economies have more than $7.6 trillion of debt maturing this year, with most facing a rise in borrowing costs. The amount needing to be refinanced increases to more than $8 trillion when interest payments are included. Linda Yueh reports on Bloomberg Television's First Look with Caroline Hyde.Governments of the world’s leading economies have more than $7.6 trillion of debt maturing this year, with most facing a rise in borrowing costs.Led by Japan’s $3 trillion and the U.S.’s $2.8 trillion, the amount coming due for the Group of Seven nations and Brazil, Russia, India and China is up from $7.4 trillion at this time last year, according to data compiled by Bloomberg. Ten-year bond yields will be higher by year-end for at least seven of the countries, forecasts show.Investors may demand higher compensation to lend to countries that struggle to finance increasing debt burdens as the global economy slows, surveys show. The International Monetary Fund cut its forecast for growth this year to 4 percent from a prior estimate of 4.5 percent as Europe’s debt crisis spreads, the U.S. struggles to reduce a budget deficit exceeding $1 trillion and China’s property market cools.The weight of supply may be a concern,Stuart Thomson, a money manager in Glasgow at Ignis Asset Management Ltd., which oversees $121 billion, said in a Dec. 28 telephone interview. “Rather than the start of the year being the problem, it’s the middle part of the year that becomes the problem. That’s when we see the slowdown in the global economy having its biggest impact.

Competition for Buyers

The amount needing to be refinanced rises to more than $8 trillion when interest payments are included. Coming after a year in which Standard & Poor’s cut the U.S.’s rating to AA+ from AAA and put 15 European nations on notice for possible downgrades, the competition to find buyers is heating up.It is a big number and obviously because many governments are still in a deficit situation the debt continues to accumulate and that’s one of the biggest problems, Elwin de Groot, an economist at Rabobank Nederland in Utrecht, Netherlands, part of the world’s biggest agricultural lender, said in an interview on Dec. 27.While most of the world’s biggest debtors had little trouble financing their debt load in 2011, with Bank of America Merrill Lynch’s Global Sovereign Broad Market Plus Index gaining 6.1 percent, the most since 2008, that may change.Italy auctioned 7 billion euros ($9.14 billion) of debt on Dec. 29, less than the 8.5 billion euros targeted. With an economy sinking into its fourth recession since 2001, Prime Minister Mario Monti’s government must refinance about $428 billion of securities coming due this year, the third-most, with another $70 billion in interest payments, data compiled by Bloomberg show.

Rising Costs

Borrowing costs for G-7 nations will rise as much as 39 percent from 2011, based on forecasts of 10-year government bond yields by economists and strategists surveyed by Bloomberg in separate surveys. China’s 10-year yields may remain little changed, while India’s are projected to fall to 8.02 percent from 8.36 percent. The survey doesn’t include estimates for Russia and Brazil.After Italy, France has the most amount of debt coming due, at $367 billion, followed by Germany at $285 billion. Canada has $221 billion, while Brazil has $169 billion, the U.K. has $165 billion, China (PRCH) has $121 billion and India $57 billion. Russia has the least maturing, or $13 billion.Rising borrowing costs forced Greece, Portugal and Ireland to seek bailouts from the European Union and IMF. Italy’s 10- year yields exceeded 7 percent last month, a level that preceded the request for aid from those three nations.
Bad Combination.The buyer base for peripheral Europe has obviously shrunk at the same time that the supply coming to the market is increasing, which is not a good combination,said Michael Riddell, a London-based fund manager at M&G Investments, which oversees about $323 billion.The two biggest debtors, Japan and the U.S., have shown little trouble attracting demand.Japan benefits by having a surplus in its current account, which is the broadest measure of trade and means that the nation doesn’t need to rely on foreign investors to finance its budget deficits. The U.S. benefits from the dollar’s role as the world’s primary reserve currency.Japan’s 10-year bond yields, at less than 1 percent, are the second-lowest in the world, after Switzerland, even though its debt is about twice the size of its economy.

The U.S. attracted $3.04 for each dollar of the $2.135 trillion in notes and bonds sold last year, the most since the government began releasing the data in 1992. The U.S. drew an all-time high bid-to-cover ratio of 9.07 for $30 billion of four-week bills it auctioned on Dec. 20 even though they pay zero percent interest.

Tougher Year

With yields on 10-year Treasuries (USGG10YR) below 2 percent, an increasing number of investors see little chance for U.S. bonds to repeat last year’s gains of 9.79 percent. The U.S pays an average interest rate of about 2.18 percent on its outstanding debt, down from 2.51 percent in 2009, Bloomberg data show.Given how well they have done, we don’t think they’re any longer a very good hedge, Eric Pellicciaro, head of global rates investment at New York-based BlackRock Inc., which manages $1.14 trillion in fixed-income assets, said in a Dec. 16 telephone interview.
The median estimate of 70 economists and strategists is for Treasury 10-year note yields to rise to 2.60 percent by year-end from 1.95 percent at 11:27 a.m. New York time. In Japan, the forecast for the nation’s benchmark note yield is 1.35 percent, while it’s expected to rise to 2.50 percent in Germany, from 1.90 percent today.

Central Banks

Central banks are bolstering demand by either keeping interest rates at record lows or reducing them, and by purchasing bonds in a policy know as quantitative easing.
The Federal Reserve has said it will keep its target rate for overnight loans between banks between zero and 0.25 percent through mid-2013, and is now selling $400 billion of its short- term Treasuries and reinvesting the proceeds into longer-term government debt in a program traders dubbed Operation Twist.The Bank of Japan has kept its key rate at or below 0.5 percent since 1995, and expanded the asset-purchase program last year to 20 trillion yen ($260 billion). The Bank of England kept its main rate at a record low 0.5 percent last month, and left its asset-buying target at 275 billion pounds ($431 billion).The European Central Bank reduced its main refinancing rate twice last quarter, to 1 percent from 1.5 percent. It followed those moves by allotting 489 billion euros of three-year loans to euro-region lenders. That exceeded the median estimate of 293 billion euros in a Bloomberg News survey of economists. The central bank will offer a second three-year loan on Feb. 28.

Flush With Liquidity

The money from the ECB may be used by banks to buy government bonds, according to Fabrizio Fiorini, the chief investment officer at Aletti Gestielle SGR SpA in Milan.
The market is now flush with liquidity after measures taken by central banks, particularly the ECB, and that’s great news for risky assets,Fiorini said in a telephone interview on Dec. 20. The market will have no problem taking down supply from countries like Spain and Italy in the first quarter. In fact, they should be able to raise money at lower borrowing costs than what we saw in recent months.Italy’s sale last week included 2.5 billion euros of 5 percent bonds due in March 2022, which yielded 6.98 percent. That was down from 7.56 percent at an auction Nov. 29. It sold 9 billion euros of bills on Dec. 28 at a rate of 3.251 percent, compared with 6.504 percent at the previous auction on Nov. 25.

Phony War

Investors should be most worried about the period after the ECB’s second three-year longer-term refinancing operation scheduled in February, according to Ignis’s Thomson.The amount of liquidity that has been supplied by central banks, with more to come from the ECB in February, suggests the first couple of months will be a sort of phony war as far as the supply is concerned,Thomson said.The ECB has bought about 212 billion euros of government bonds since starting a program in May 2010 to contain borrowing costs for Greece, Portugal and Ireland. It began buying Spanish and Italian debt in August, according to people familiar with the trades, who declined to be identified because they weren’t authorized to speak publicly about the transactions.There’s a lot of talk that the ECB might have to give more direct support to the governments,Frances Hudson, who helps manage about $242 billion as a global strategist at Standard Life Investments in Edinburgh, said in a Dec. 22 telephone interview.Following is a table of bond and bill redemptions and interest payments in 2012 for the Group of Seven countries, Brazil, China, India and Russia, in dollars, using data calculated by Bloomberg as of Dec. 29:

Google is wrestling with a thorny conundrum: should it block its own Chrome browser from its search index for between a month and a year for breaking its own rules on paid links, after a mixup by some bloggers for a video advertising scheme? The problem has arisen after Google paid Unruly Media, an international media agency, to get a number of paid bloggers to promote a video for its Chrome browser featuring a US flour company.But while the bloggers did the job they had been asked to, and put up the video, some went beyond what Unruly Media – and Google – had expected them to, and included links to places where you could download the Chrome browser. Crucially, though, they didn't use the nofollow text that Google mandates for paid links. That, strictly, took them over the line on paid links.Update: a company called Essence Digital has now said that it acted as an intermediary between Google and Unruly Media. In a post on Google+, it said:

We want to be perfectly clear here: Google never approved a sponsored-post campaign. They only agreed to buy online video ads. Google have consistently avoided paid postings to promote their products, because in their view these kind of promotions are not transparent or in the best interests of users. In this case, Google were subjected to this activity through media that encouraged bloggers to create what appeared to be paid posts, were often of poor quality and out of line with Google standards. We apologize to Google who clearly didn't authorize this.The sponsored blogposts (such as this one, though it does not link to Chrome) were first noticed by Aaron Wall at SEO Book. He commented: You can say they didn't require the links, that the links were incidental, that leaving nofollow off was an accident, etc ... but does Google presume the same level of innocence when torching webmasters? They certainly did not to the bloggers who reviewed K-Mart [who were removed from the search ranking] and the Google reconsideration request form states: In general, sites that directly profit from traffic (e.g. search engine optimisers, affiliate programmes, etc) may need to provide more evidence of good faith before a site will be reconsidered.At Search Engine Land, Danny Sullivan wrote: Potentially, all this means that Google will have to ban the Google Chrome download page over paid links. That would suck for Google, since it's busy running ads for Google Chrome, which will in turn prompt people to search for it. Right now, the page appears at the top of results for searches on google chrome.Andrew Girdwood, who has worked in the past with Unruly Media, said: My hunch is that individual bloggers have written editorials for their sponsored video (which is just a CPA [cost per action] ad [where bloggers would get paid any time somebody watches the ad] – like so many others, just like any affiliate deal) and put a link naturally into that text … I doubt these posts were about links.Scott Button, the chief executive of Unruly Media, told the Guardian: A blogger, who we didn't ask to link to a Google Chrome page, linked to a Google Chrome page, and did so without using the nofollow attribute. Obviously they shouldn't do this in the context of a blog post that embeds one of our sponsored videos. As soon as we found out about it, we got it fixed. To be clear, we're not in the business of getting bloggers to write about products or link to advertisers' websites. We distrubute branded video content, and we pay bloggers (and big websites and app developers) when their audiences watch the videos. That's what Google paid us to do, and that's our business. The SEM [search engine marketing] angle is basically a red herring - it doesn't bear any relation to our business nor any relation to the objectives of the Google Chrome campaign.

Button declined to say how much bloggers are paid per viewing. Unruly Media runs about a thousand social video campaigns annually from nine offices, Button said. It's a grown up business and growing very fast, but this is still small beer in relation to the $500bn plus that brands spend on media each year.But just as concerning for a number of observers was the content of the posts preceding the video: Wall called it low-quality filler pablum content that the Panda update was alleged to discourage, while Sullivan commented: That's perhaps the bigger problem with this campaign, much more disturbing to me. Google's paying to produce a lot of garbage.But that garbage appeared to be having benefits, based on Sullivan's searching: the Telecommutingmommies post linked above ranked second, when he looked, in a search for google chrome benefits. When the Guardian tried the same search on Tuesday evening, the same post also ranked second.That, says Sullivan, pollutes the results: Imagine you're someone trying to understand the benefits to using Google Chrome versus other browsers. Out of 21m possible matches, two of Google's sponsored garbage posts make it into the top 10 results.Even worse, he says, is that the video which caused all the trouble doesn't actually mention Chrome at all. You may have seen on television already. It has nothing to do even with how Chrome actually helped the Vermont flour producer featured, King Arthur Flour, succeed … Since King Arthur Flour has been online since at least December 2006, I'm willing to bet it got its start through the Internet Explorer browser. It sure wasn't Chrome, which didn't exist at the time.In a statement, Google said: Google never agreed to anything more than online ads. Don't think that means Terrell Suggs' mouth will be taking it easy.The linebacker took a mostly unprovoked shot at Tim Tebow during a Tuesday appearance on ESPN's First Take.With all due respect we don't need God on our sidelines,Suggs said. Once again God had to save Tim Tebow and the Denver Broncos. He couldn't even give them two drives? Seven to three? [Referring to the score Denver lost by on Sunday.]Technically, it was the San Diego Chargers that saved Tebow and the Broncos. Without the Bolts' win over Oakland, Tebow would be sitting in a pew Sunday instead of the locker room. Is Suggs trying to say that Norv Turner is some sort of deity? Never mind that. For now, let's point out that ripping on Tebow is the equivalent of shooting a dead fish in a small barrel. Pick a better target, T-Sizzle.It also bears noting that while Baltimore and Denver could meet up in the divisional playoffs, it would take a Cincinnati upset of Houston (possible) and a Broncos victory over Pittsburgh (nope) for it to happen. In all likelihood, Suggs won't be blitzing Tebow anytime soon.And that right there is why you spend four years hitting the books at Ball So Hard University. Where else would you learn that true artists don't need to be playing against an opponent to engage in some trash talking?
