EU blocks German take-over of US stock exchange

BRUSSELS - The European Commission has blocked a merger between Deutsche Boerse and the New York Stock Exchange, the two largest players in trading of derivatives - a financial product said to have helped cause the 2008 financial crisis.The merger would have led to the worsening of conditions for companies trying to access financial instruments and would have harmed the European economy as a whole ... In the end, we had no alternative but to prohibit the merger,EU anti-trust commissioner Joaquin Almunia told press in Brussels on Wednesday (1 February).The decision came as a surprise after EU single market commissioner Michel Barnier earlier voiced reservations on blocking the deal. But Almunia said it was taken by the full college of 27 commissioners without a vote.Derivatives are complex financial products which bet on the performance of underlying loans, mortgages or other financial transactions. Lack of regulation and transparency in the sector is widely seen as a cause of the financial crisis three years ago.Almunia explained the two stock exchange operators - Eurex-DB and Liffe-NYSE - are the biggest competitors on the market, covering over 90 percent of trading in derivatives of European underlyings. The German company would have effectively taken over the New York-based one, as it would have held 60 percent of the new company after the merger.

The main concession the commission had asked for was for the companies to sell either Deutsche Boerse's Eurex or NYSE Euronext's Liffe. But the companies refused either option.For its part, the German firm reacted furiously to Almunia's annuoncement.This is a dark day for Europe and its future competitiveness on global financial markets ... The EU Commission's decision is totally out of touch with reality and is based on a narrow definition of the markets which does not take into account the global nature of the competition on the derivatives markets,Deutsche Boerse said in a statement.But its employees voiced relief because the merger was likely to cause redundancies in Frankfurt. The head of the Deutsche Boerse employee council, Irmgard Busch, told Spiegel magazine she was happy that this mega-project failed.The story is not over yet, with Deutsche Boerse expected to shortly make a bid for the London stock exchange.We'll see more of this in the coming years. Derivatives law stuck

Meanwhile, a long-awaited EU law - obliging all derivatives trades to be checked by clearing houses and registered in data bases under national and EU supervision - has hit an impasse.The bill is stuck on a single issue - the mediation powers of the European Markets and Securities Authority (Esma), a newly created EU body based in Paris.EU finance ministers last week agreed that Esma can intervene in disputes on the registration and authorisation of clearing houses when a two thirds majority of national regulators ask for it. MEPs say this makes no sense, because a two-third majority is anyway needed to approve or reject any decision.If they can't agree to it anyway, then why do they have to reach the same majority to ask for mediation? It should be just one country asking for mediation,a parliamentary source told this website.The Danish EU presidency is seeking a compromise deal in the coming week.It is unlikely that Britain will agree to the MEP's request however, as it has already made concessions. The UK moved from from a three-quarter to a two-third majority on mediation and accepted that Esma's decisions should be binding.

Ukraine says death toll from cold weather at 43

KIEV, Ukraine (AP) — Ukrainian officials say the death toll from a severe cold spell that has hit Eastern Europe has risen to 43 people, most of them homeless.The Emergency Situations Ministry said Wednesday that 28 people were found dead on the streets, eight died in hospitals and seven in their homes. Over 720 others were hospitalized with hypothermia and frostbite.Temperatures dropped to minus 30 C (minus 22 F) in some regions, prompting authorities to close schools and nurseries. The cold spell also caused power outages and blocked traffic.Authorities have deployed over 1,730 heating shelters across the country where the homeless people can get warm and eat.

Deaths mount as Russia resists UN drive on Syria

Fresh bloodshed swept Syria on Wednesday as the West and Arab League kept up their push for quick UN action to stop the regime's killing machine, but holdout Russia vowed to veto any unacceptable proposal.Wrangling at the United Nations came as fierce clashes across Syria killed 59 people, mostly civilians, the Syrian Observatory for Human Rights said.In New York, Western diplomats were to try again to persuade Russia to back a tough UN Security Council resolution condemning the violence, diplomats told AFP.We can hope that Russia has understood the message but for now there is no notable progress,one said, while noting some slight signs of flexibility from Moscow.US Secretary of State Hillary Clinton said Security Council members had to decide whether to side with the Syrian people or a brutal dictatorship.Every member of the council has to make a decision: Whose side are you on? she told reporters in response to a question about Russian opposition to an Arab- and Western-backed resolution condemning President Bashar al-Assad.Are you on the side of the Syrian people? Are you on the side of the Arab League? the chief US diplomat asked.Or are you on the side of a brutal dictatorial regime? Each country will have to be mulling that over and making a decision.Earlier on Wednesday, Russian Deputy Foreign Minister Gennady Gatilov appeared to snuff out hopes of a quick vote.

Attempts are being made to find a text that is acceptable to all sides and would help find a political solution for the situation in Syria. Therefore there is going to be no vote in the next days,he told Interfax news agency.But French Foreign Minister Alain Juppe said in Paris Russia had a less negative attitude towards a Security Council resolution and later acknowledged that a vote could take place perhaps next week.For the first time, the attitude of Russia and the BRICS (China, India and South Africa on the Security Council) is less negative,Juppe told MPs.The draft resolution, introduced by Morocco, calls for the formation of a unity government leading to transparent and free elections.It stresses that there will be no foreign military intervention in Syria as there was in Libya, which helped to topple Moamer Kadhafi.In Rabat, Foreign Minister Youssef Amrani said that Morocco, the only Arab country currently on the Security Council, was committed with all our partners to achieving a consensus on this resolution.On Tuesday, Qatari Prime Minister Sheikh Hamad bin Jassim Al-Thani told the Council that bloodshed continued as the Assad regime cracked down on its opponents and that the killing machine is still at work.Russia, a long-standing Assad ally and one of his top arms suppliers, has declared that the UN body does not have the authority to impose a resolution that calls for regime change in Syria, a position supported by China.If the text is unacceptable then we will vote against,Russia's UN envoy Vitaly Churkin was quoted as saying by the RIA Novosti news agency.

Russia would not approve a text it viewed as incorrect and that would lead to a deepening of the conflict,he said.The Britain-based Observatory said Wednesday's heaviest toll was in Damascus province, where 24 civilians were killed.Fifteen soldiers were reported killed in the central city of Homs and six army deserters in Damascus itself.There were also reports of fierce fighting between the army and dissidents in Damascus, Homs and Idlib provinces.Al-Watan newspaper listed dozens of deaths in clashes in Homs and elsewhere in central Syria over the past two days.It said 37 rebels were killed in the Homs district, four soldiers in Bab Dreib and 15 rebels and two members of the security forces in clashes in Rastan, another central town.Against that background, the rebel Free Syrian Army's Turkey-based commander Colonel Riyadh al-Asaad told AFP that half of the country was now effectively a no-go zone for the security forces.Activists said the unrest had killed nearly 200 people over the previous three days, while France said 6,000 people have lost their lives since the beginning of the uprising nearly 11 months ago.The French figure comes after UN human rights chief Navi Pillay said last week that her organisation had stopped counting the dead because it is too difficult to get information.In January, UN data showed more than 5,400 people killed in Syria since the uprising began in mid-March.

Analysts warn that the conflict, between a guerrilla movement backed by growing numbers of army deserters and a regime increasingly bent on repression, has largely eclipsed the peaceful protests seen at the start of the uprising.The Syrian opposition, meanwhile, called for two days of demonstrations across the country from Thursday to mark the 30th anniversary of the 1982 Hama massacre.The regime of Hafez al-Assad, the late father of the current president, squashed an Islamist revolt in the central city that year, killing tens of thousands of civilians.

Egypt's war on democracy threatens U.S.-ties

CAIRO (Reuters) - Arriving in Egypt last year, Julie Hughes had hoped to help write history by aiding the country's new generation of politicians and civil society groups to build a democratic future.Instead, the American director of the National Democratic Institute is under investigation by authorities for funding irregularities at her U.S.-based group and is banned from leaving Egypt, a measure that prompted other activists to seek refuge this week in the U.S. embassy in Cairo.
Her hope for change, inspired by the fall of Hosni Mubarak at the hands of hundreds of thousands of protesting Egyptians, was punctured on December 29 when her offices were raided in connection with an investigation by Egypt's new military rulers.The work of NDI, which is loosely linked to the U.S. Democratic Party, had fallen prey to what Egyptian pro-democracy campaigners say is a war between remnants of Mubarak's inner circle and a rapidly developing civil society.It's a war, some campaigners say, that is more vicious than the one they fought under Mubarak, and it could further sour relations between Cairo and Washington, putting $1.3 billion of annual U.S. military aid in jeopardy.But for the authorities, it is a matter of law; the non-governmental organizations broke it by receiving foreign funding without government approval.For Hughes, the first casualty has been NDI's work with Egypt's budding new political class. That is more than a little heartbreaking for us, Hughes told Reuters at her Cairo home.

REFUGE

A handful of Americans, including a son of a member of President Barack Obama's cabinet, are sheltering behind the fortress-like walls of the U.S. embassy for protection.All employees of U.S.-based non-governmental organizations (NGOs) that have loose links to America's two leading political parties, they say they have been accused of running groups that were not properly licensed in Egypt and receiving foreign funding illegally.A judicial source said on Wednesday the travel ban had been extended to three more Americans, taking the total to 17 U.S. citizens out of a total of 28 foreigners who have been prevented from leaving Egypt. The source expected the release of the probe's results next week.The government has yet to confirm the specific charges, leaving the activists guessing as to what the punishment could be.The groups work on everything from educating voters to advising politicians on how to build a successful coalition.Hughes sums up the euphoria with which many activists arrived in Egypt.It's an honor to be right here now at this point in history: to see history being rewritten and being remade and people grabbing hold of their political future and helping them participate in the democratic transition, she told Reuters.NDI has trained around 14,000 Egyptians in advocacy, voter education and election monitoring since April 1 last year and has brought speakers including former leaders of Poland and Chile, countries with an experience of democratic transitions.But the investigation shows how far Egypt has to go before such organizations can operate as freely as they do in much of the world, highlighting what Egyptian activists describe as the persistence of the Mubarak-era mentality - one of fear of allowing too much debate.Egyptians have also been targeted by the investigation. They accuse the military rulers of trying to row back on democratic reforms by silencing their number.

It is one of the frontlines of the revolution,said Nasser Amin, head of an Egyptian-run organization working to advance judicial independence, which is also being investigated over its legal status.It is the counter revolution that is attacking us.Egyptian activists said the fact that the investigation has been spearheaded by a government minister who served under Mubarak showed it was being pursued in his image.But Faiza Abu el-Naga, minister of international cooperation, who has survived repeated cabinet reshuffles before and after Mubarak was driven out, has said the investigation is simply a matter of law.The rights groups that are being investigated received funds from abroad without government knowledge and in violation of the law,she told a news conference on the subject.Some political analysts said the steps were being orchestrated by the ruling generals to try to secure leverage over Washington while rallying support around anti-American sentiment and undermining the reputation of their most vocal critics in the Egyptian-led NGO community.But the generals will be careful not to lose the $1.3 billion in aid they get yearly in return for Egypt becoming the first Arab state to sign a peace treaty with Israel in 1979.Congress has approved this year's payout, but it has also set conditions, including requiring that Secretary of State Hillary Clinton certify the Egyptian government is supporting the transition.For now, Pentagon officials said the alliance with Egypt was still on solid ground.

There are going to be differences of opinion. There were before the popular revolution there ... Part of what makes a relationship a relationship is the ability to continue to discuss and try to find a way to move forward even beyond the differences you might share,Pentagon spokesman Captain John Kirby said in Washington.
On a visit to Cairo, Michael Posner, the U.S. State Department's top human rights official, urged Egypt to resolve the NGO issue. And it will almost certainly be discussed in Washington, where an Egyptian military team is visiting.

TOO MUCH FOREIGN MONEY

Some Egyptian media have said American money poured into NGOs last year, proving there was a plot to subvert the course of change in Egypt.The U.S. ambassador to Cairo had spoken of close to $40 million invested in organizations including NDI and the International Republican Institute, an NGO affiliated with the Republican Party which is also under investigation.Hafez Abou Saeda, chairman of the Egyptian Organisation for Human Rights, said the state's aim was to sway public opinion against the pro-democracy movement.It is using this card to influence domestic opinion: to give the impression that the whole revolution is a foreign product,he told Reuters.Abu Saeda's organization has faced no formal accusations in the current investigation, though he said his bank accounts were examined by investigators as part of the probe.The case has a sense of deja vu for him. He was jailed in 1998, accused of receiving foreign funds to write a report in which he documented cases of torture by the security forces.Instead of putting the officers on trial, they arrested me and put me on trial and said I had received foreign funds to distort the image of the country,said Abu Saeda.It's always the issue of foreign funding that is used to defame the rights movement in Egypt,he said, adding that his organization gets most of its funds from the European Union.

OLD REGIME REMAINS

The restrictions placed on NGOs over the years have encouraged many to register their organizations in other ways.The Arab Center for the Independence of the Judiciary and the Legal Profession, the organization led by Amin, has been registered as a not-for-profit company since it was set up in 1997.All of a sudden they have discovered that we have been working for 15 years without an (NGO) license,he said from his organization's office overlooking the Nile, describing being questioned for seven hours on Monday over the group's legal status and funding.
His 11th-floor office was among those raided on December 29 by investigators who confiscated documents and computers. Staff were still using their own laptops on Tuesday because the equipment had yet to be returned.Amin said it was the return of the old days. The two judges investigating the case against his organization had formerly worked for Egypt's State Security Prosecution, part of a widely-hated security agency that was formally dissolved last year.The members of state security are still there in the apparatus,he said.A year after the revolution, the old regime has started to regain its strength.(Additional reporting by Ahmed Tolba in Cairo and Andrew Quinn in Washington; Editing Edmund Blair and Elizabeth Piper)

ATHENS (Reuters) - Greece's prime minister will call the country's political leaders in the next few days to seek backing for more austerity after the International Monetary Fund warned this was key to securing the new bailout Athens needs to avoid a messy default.With a long-delayed deal with private sector creditors to cut Greece's debt mountain by 100 billion euros nearly wrapped up, the government is now racing to complete talks on the 130-billion euro ($170.18 billion) bailout by the end of the week.To do so, Athens must first persuade the European Union and the IMF - which have grown increasingly exasperated with its repeated failures to meet deficit and reform targets - that it will implement long-delayed reforms and slash spending further.Bankers said the bond swap deal, which will mean real losses of about 70 percent for Greek bond holders, is essentially done. But the second bailout and any official sector participation must be agreed before announcing a deal as all elements are interlinked.The PSI (private sector participation) deal has been done but we are waiting for the second bailout to come together and no announcements should be expected before Monday, said a senior Greek banker close to the negotiations. The coupon is under 4 percent.ECB action to further reduce the burden is seen as imperative and is proving a sticking point.The Insitute of International Finance, which represents banks and insurers in the debt swap talks, said constructive discussions continued and that it hoped various elements of the Greek rescue package would come together in the coming days.The prospect of elections as early as April complicates the talks with lenders, with political leaders in Prime Minister Lucas Papademos's coalition eager to distance themselves from any cuts that herald more pain for ordinary Greeks.

Antonis Samaras, whose conservative party shares power in the coalition, has rejected any further austerity, saying it risked plunging Greece even deeper into recession. Several lawmakers from all three major parties have said the same.This worries Greece's lenders, who want to make sure Athens will deliver this time.

We need assurances that whoever is in power after the election and reasonably wishes to make some changes in economic policy will make sure they are in line with the targets and the basic framework of the agreement,Poul Thomsen, the head of the IMF's mission for Greece, told daily Kathimerini on Wednesday.Government spokesman Pantelis Kapsis said Papademos would convene the conservative, socialist and far-right leaders in the coming days to ask them to back any deal but gave no date.
The meeting of the political leaders is crucial,Kapsis told reporters. In order to have a final deal, we first need to have a meeting of political leaders.

WAGE CUTS

Thomsen, who is in Athens to negotiate the new bailout together with a troika of senior EU and ECB officials, said the minimum wage level may have to be lowered and holiday bonuses cut to make Greece's firms more competitive. Athens may also have to fire civil servants, he said in the interview, though the bulk of savings in the public sector payroll will come from retirements.These demands are hotly contested in Greece. Labor unions have rejected cutting the minimum wage and slashing holiday bonuses and are seeking, together with employers, other ways to cut labor costs.It's all down to whether the Greeks manage to convince the troika that they will implement the necessary austerity measures,said a source close to the negotiations.
Thomsen also called for a new policy mix, which could help get political parties on board.We will have to slow down a little as far as fiscal adjustment is concerned and move faster - much faster - with implementing reforms,he said, adding that there are limits to what society can take.

RECESSION

More reforms and slower deficit reduction would be a policy shift compared with the country's first 110-billion euro bailout, which relied heavily on tax increases and less on spending cuts and which some economists blame for social unrest and the country's worst post-war recession.Greece has been dragged deeper into recession since it was first rescued by the EU and IMF in May 2010.The economy is set to contract by at least 3 percent this year, while Greece's lenders projected it would grow by 1.1 percent when they drafted the first bailout. Athens blames the deeper-than-expected recession for its failure to meet deficit targets while the lenders point to the delays on reforms.In a sign of Greece's economic struggles, manufacturing remained in deep recession in January with a record drop in production and a sharp decline in new orders leading to more job losses, a survey showed on Wednesday. Production fell at a record pace as new order volumes and work backlogs continued to decline sharply, the Markit survey showed.Some analysts said Thomsen's suggested policy switch would not work unless Greece's lenders, including the IMF, increase their aid for Greece above the 130 billion euro mark.It makes sense to put the emphasis on structural reforms and less on deficit reduction but this strategy will mean that Greece needs extra support and, at the moment, I don't see anybody willing to do that,said Christoph Weil, a Frankfurt-based economist at Commerzbank.

Greece's lenders have demanded it make extra spending cuts worth about 1 percent of GDP - or just above 2 billion euros - this year, including big cuts in defense and health spending. Thomsen said he was optimistic a deal would be done in days.Greek bank shares jumped after both the finance minister and Thomsen indicated that banks would escape nationalization when they are recapitalized.($1 = 0.7639 euros)

MEXICO CITY (AP) — A missionary couple from Texas were slain in their home outside the violence-plagued northern industrial city of Monterey, the U.S. Embassy and their family said Wednesday.The embassy identified the couple as John and Wanda Casias.Valerie Alirez, the eldest child of John Casias, told The Associated Press from her home in Greeley, Colorado, that one of her brothers found her father and stepmother Tuesday dead in their home in Santiago, Nuevo Leon.The family was originally from Amarillo, Texas, but relatives said John and Wanda Casias moved to Mexico in the late 1970s or early 1980s and made it their home.John Casias was a Baptist preacher and the couple ran the First Fundamentalist Independent Baptist Church in Santiago, Alirez said.Her brother, Shawn Casias, who lives in Monterrey, said he went to his parents' home around 4 p.m. Tuesday to pick up a trailer. After he had hooked up the trailer outside he went into the home to say goodbye. He said he found Wanda Casias lying on the floor with an electrical cord around her neck and a gash from a blunt object on her head.Missing from the house were a couple of computers, a plasma television and a safe that had been chiseled out of the wall.

The couple's Chevrolet Suburban was also missing, and Casias said he initially thought his father had been kidnapped.But about four or five hours later, he said, a forensic investigator informed him that his father's body had been found in a storage room of a small building on the property. His father also had an electrical cord around his neck.Casias said a sister-in-law in Dallas had spoken to their mother around 11 a.m. Tuesday and everything was fine. So he believes there was about a five-hour window when the killings could have occurred before he showed up.
He said the killers did not take everything they could have, leaving two of the three TV sets. He said perhaps they were warned that he was coming, because anyone watching the winding road approaching the home could have alerted them.They're scum. They're not sophisticated,he said.Speaking from his parents' home, Casias said the house was burglarized two years ago when the couple were on one of their periodic visits to the United States to talk at churches about their work in Mexico.We're convinced that it's somebody he knew,Casias said of the killers. He said authorities had some leads based on people seen around the home.John Casias was 76. He had recently priced a knee replacement because he couldn't walk more than 100 yards (100 meters) without having to sit down, Shawn Casias said. Wanda Casias was 67.Casias said his parents held services and prayer meetings at a church about 3 miles (5 kilometers) from their home.

Following the announcement that a third US aircraft carrier, the USS Enterprise, would be heading to patrol waters near the Strait of Hormuz in March, it has also been revealed that the nuclear submarine USS Annapolis and the destroyer USS Momsen are also likely to heading towards the Persian Gulf in the build up to a possible attack on Iran.Two ships of the US Navy, the nuclear submarine USS Annapolis and the destroyer USS Momsen have passed through the Suez Canal into the Red Sea. Although their destination is confidential, they are now getting dangerously close to the Persian Gulf, reports RT, citing Interfax News Agency.With the likely destination of the two ships being the U.S. Fifth Fleet area of operations, they will be joined next month by the USS Enterprise, the third aircraft carrier to be stationed in the region along with the USS Vinson and the USS Abraham Lincoln. The US also has a 15,000-men force deployed in Kuwait comprising of an expeditionary marine battalion and an amphibious landing group. British and French warships are also acting as escorts to the US aircraft carriers.

What all this means is that the United States will have a massive naval presence just off Iranian waters to coincide with rhetoric concerning an attack reaching a crescendo. Earlier today a prominent bipartisan think tank, ostensibly a front for the US military-industrial complex, called on the Obama administration to increase pressure on Iran by sending even more naval firepower to the tense region.The US is currently conducting its biggest naval exercises in over a decade. The Bold Alligator joint Navy and Marine Corps exercise, taking place off the coast of Virginia and North Carolina, is clearly geared towards simulating a naval conflict with Iranian forces despite official claims to the contrary.Navy and Marine forces involved with the exercise will work scenarios involving mine warfare, countering small boat attacks and other irregular threats and fighting in shallow coastal waters, (Command chief Adm. John) Harvey pointed out. Those threats, among others, are the hallmarks of Iranian naval forces, reports AOL News.Iran’s repeated threats to close the Strait of Hormuz, a key oil choke point, have led many to speculate that the trigger for a military assault aimed at destroying Iran’s nuclear enrichment facilities could happen in the waters of the Persian Gulf.Tehran is set to conduct more naval exercises in the Strait later this month. Experts estimate that around 1,000 mines would be required to block the 55km wide passage and that Iran’s Revolutionary Guards have already stockpiled 2,000 mines for that very purpose.
