High Court freezes controversial outpost legalization law-Following petitions, legislation allowing retroactive land legalization in West Bank delayed for two months until government responds-By Stuart Winer and Jacob Magid August 17, 2017, 12:21 pm-THE TIMES OF ISRAEL
The High Court of Justice on Thursday postponed for two months the implementation of a controversial law that legalizes wildcat West Bank outposts constructed on private Palestinian land in certain restricted cases. The legality of the highly contentious Regulation Law was challenged in the High Court by left-wing NGO’s Peace Now, Yesh Din and Association for Civil Rights in Israel on behalf of 27 Palestinian local councils and 13 Israeli civil society organizations. The court’s interim order gives the government two months to respond to the challenge, freezing the bill in the meantime. The law allows the Israeli government to expropriate private Palestinian land where illegal outpost homes have been built ex post facto, provided that the outposts were built in good faith or had government support. In return, the legislation states, the Palestinian landowners will be compensated financially or with other land.Analysts say the law will pave the way for the government to recognize some 4,000 illegally built Israeli homes. The passage of the bill, originally meant to save the since-razed outpost of Amona, was roundly condemned by activists and political figures in Israel and abroad. With Thursday’s High Court interim decision to freeze the legislation, no additional land will be expropriated even if it fits the above conditions. At the same time, outposts found to have been built in good faith or with government backing will not be demolished until a final decision is made.Jewish Home MK Shuli Mualem-Refaeli, who co-sponsored the legislation said in a Thursday statement that the court had over-stepped its authority.“Once again, we see how the High Court of Justice tramples on the separation of powers,” she said.“The fight against Jewish settlement in Judea and Samaria, and against Israel’s existence, is being fought through terror and incitement, but through the abuse of Israel’s justice system as well,” she said, referring to the West Bank by its Biblical names. In its own statement, the pro-settlement NGO Regavim said the court decision “set a severe and dangerous precedent.” The group called on the Knesset to enact legislation that would “balance” lawmakers authority with that of the judicial branch. In the months leading up to the February 6 Knesset vote on the Regulation Law, Attorney General Avichai Mandelblit warned the legislation bypassed standard land regulation procedures in the West Bank and that it legalized Israeli settlements built on private Palestinian land in breach of local and international law.Mandelblit also cautioned that the legislation openly curtailed property rights of Palestinians in the West Bank in a way that contravenes the protections granted to occupied populations under the Fourth Geneva Convention. When the Knesset passed the law anyway, Mandelblit officially notified the High Court that he would not defend the legislation if it was challenged.Harel Arnon, an attorney in private practice, replaced Mandelblit to represent the state in petitions against the law. In May, Haaretz revealed that Arnon’s own home in the Elazar settlement is being built illegally on land that had been designated strictly for military purposes.
Abbas congratulates North Korea’s Kim amid nuclear tensions-Minister Naftali Bennett slams the PA president, saying it follows Palestinian support for Hitler and Saddam Hussein-By Dov Lieber and AP August 15, 2017, 7:05 pm-THE TIMES OF ISRAEL
Palestinian Authority President Mahmoud Abbas on Tuesday congratulated North Korean Leader Kim Jong-Un on the occasion of his country’s “Liberation day,” amid a high-stakes nuclear standoff between Pyongyang and Washington.“The Korean people offered the most precious sacrifices for their freedom and dignity,” Abbas said in a telegram to Kim, the PA’s official news outlet, Wafa, reported. The US and Korea have locked horns over the hermit nation’s nuclear and missile programs, with US President Donald Trump also ratcheting up the rhetoric and promising Pyongyang “fire and fury.”Israeli Education Minister Naftali Bennett slammed Abbas for his comments, saying it showed the Palestinians were bereft of any moral compass.“First Hitler, then S. Hussein, now Kim Jong-un. If you want to take a moral stand, check who the Palestinians support and do the opposite,” Bennett tweeted.First Hitler, then S. Hussein, now Kim Jong-un.If you want to take a moral stand, check who the Palestinians support and do the opposite.— Naftali Bennett בנט (@naftalibennett) August 15, 2017-Abbas expressed his appreciation for North Korea’s “firm solidarity in support of the rights [of the Palestinian] people and its just struggle to end the occupation and establish our independent state with East Jerusalem as its capital.”The PA president also expressed wishes for Kim’s “health and happiness,” for North Korean “prosperity” and for the “historic relationship between Palestine and North Korea to further develop.”In a separate statement, Abbas congratulated the leader of South Korea, Moon Jae-in, for his nation’s own Liberation Day.He wished prosperity for the South Koreans and a development of ties with the Palestinians.Earlier Tuesday, Kim signaled he would not launch missiles near Guam, amid sky-high friction with the US.During an inspection of the North Korean army’s Strategic Forces, which handles the missile program, Kim praised the military for drawing up a “close and careful plan” and said he would watch the “foolish and stupid conduct of the Yankees” a little more before deciding whether to order the missile test, the North’s state-run Korean Central News Agency says.Kim said North Korea would conduct the launches if the “Yankees persist in their extremely dangerous reckless actions on the Korean Peninsula and its vicinity,” and that the United States should “think reasonably and judge properly” to avoid shaming itself, the news agency said. While Palestinian relations with Pyongyang have been minimal, at least at the public level, the Hamas terror group in Gaza has praised North Korea for its harsh rhetoric against Israel. In April, Hamas thanked Kim for his support of the Palestinian cause, after the latter slammed Israel for insulting its leadership.
Trump decries monument removals, ‘history ripped apart’-US president continues with combative tweets, attacks fellow Republicans following racially charged Charlottesville rally-By Julie Bykowicz and Jonathan Lemire August 17, 2017, 6:03 pm-THE TIMES OF ISRAEL
WASHINGTON (AP) — US President Donald Trump bitingly decried the rising movement to pull down monuments to Confederate icons Thursday, declaring the nation is seeing “the history and culture of our great country being ripped apart.”Trump’s new remarks came even as the White house tried to manage his increasing isolation and the continued fallout from his combative comments on last weekend’s racially charged violence in Charlottesville, Virginia. He also tore into fellow Republicans who have criticized his statements on race and politics, fanning the controversy toward a full-fledged national conflagration.Pressured by advisers, the president had taken a step back from the dispute on Monday, two days after he had enraged many by declining to single out the white supremacists and neo-Nazis whose demonstration against the removal of a Robert E. Lee statue had led to violence and the death of a counter-protester in Charlottesville. He returned to his combative stance on Wednesday — insisting anew that “both sides” were to blame. And then in a burst of tweets on Thursday he renewed his criticism of efforts to remove memorials and tributes to the Civil War Confederacy.Sad to see the history and culture of our great country being ripped apart with the removal of our beautiful statues and monuments. You…..— Donald J. Trump (@realDonaldTrump) August 17, 2017-“You can’t change history, but you can learn from it,” he tweeted. “Robert E. Lee. Stonewall Jackson — who’s next, Washington, Jefferson? Trump (@realDonaldTrump) August 17, 2017-He wasn’t talking about beauty in earlier tweets, lashing at GOP Senators Lindsey Graham of South Carolina and Jeff Flake of Arizona. He accused “publicity-seeking” Graham of falsely stating his position on the demonstrators, called Flake “toxic” and praised a Flake primary election opponent.Graham said Wednesday that Trump “took a step backward by again suggesting there is moral equivalency” between the marching white supremacists and the people who had been demonstrating against them. And Flake has been increasingly critical of Trump in recent weeks.Publicity seeking Lindsey Graham falsely stated that I said there is moral equivalency between the KKK, neo-Nazis & white supremacists……— Donald J. Trump (@realDonaldTrump) August 17, 2017-Other Republicans, including the most powerful in Congress, have been making strong statements on Charlottesville and racism, but few have been mentioning Trump himself. The Senate’s top Republican, Majority Leader Mitch McConnell, condemned “hate and bigotry.” House Speaker Paul Ryan charged that “White supremacy is repulsive.” But neither criticized the president’s insistence that there were “very fine people on both sides” of the violent weekend clash in Virginia. The nuanced statements reflect the party establishment’s delicate dance. Few top Republican officeholders want to defend the president in the midst of an escalating political crisis, yet they are unwilling to declare all-out opposition to him and risk alienating his loyalists. In another major sign of discontent within the Republican Party, Trump abruptly abolished two of his White House business councils Wednesday as corporate chiefs began resigning in protest of his racial statements.Rather than putting pressure on the businesspeople of the Manufacturing Council & Strategy & Policy Forum, I am ending both. Thank you all!— Donald J. Trump (@realDonaldTrump) August 16, 2017-“Rather than putting pressure on the businesspeople of the Manufacturing Council & Strategy & Policy Forum, I am ending both. Thank you all!” Trump tweeted from New York. His action came after one of the panels had already agreed to disband earlier in the day.The White House is trying to deal with the repercussions from Trump’s defiant remarks on the Virginia tragedy. Advisers hunkered down, offering no public defense while privately expressing frustration with his comments. But Trump himself, staying at his golf club in New Jersey, was increasing rather than slowing his tweet-a-thon.On Wednesday, he had told associates he was pleased with how his combative press conference had gone a day earlier, saying he believed he had effectively stood up to the media, according to three people familiar with the conversations who demanded anonymity because they were not authorized to speak publicly about them.Business leaders felt differently.Denise Morrison, chief executive of Campbell Soup, declared she was leaving Trump’s manufacturing council, saying, “The president should have been — and still needs to be — unambiguous” in denouncing white supremacists.#CEODenise resigns from president’s manufacturing jobs initiative https://t.co/3R62gBOemD pic.twitter.com/B2FAmcCNyF— Campbell Soup Co (@CampbellSoupCo) August 16, 2017-CEOs had begun tendering their resignations from White House panels after Trump’s initial comments following the Saturday violence. The first to step down, Kenneth Frazier of Merck, drew a Twitter tongue-lashing from the president. Later, Trump called those who were leaving “grandstanders” and insisted many others were eager to take their places.Members of the Strategy and Policy group, led by Blackstone CEO Stephen Schwarzman, concluded after a 45-minute conference call in the morning that they would end the council and announce their decision in a statement, according to two people familiar with the discussions. They insisted on anonymity to discuss private conversations. In a subsequent call with Trump, the president agreed it was the right course of action. He tweeted before they could announce the decision they’d reached — making it appear it was his choice.Publicly criticizing the president and resigning from his councils is a significant step for big-name corporate leaders. Though the policy influence of such advisory groups is sometimes questionable, simply meeting with Trump with TV cameras going is valuable face-time for the executives — and for the president.

They were speaking directly to the force and the American people.”Dunford said the intent was “to the force, to make it clear that that kind of racism and bigotry is not going to stand inside the force. And to the American people, to remind them of the values for which we stand in the US military, which are reflective of what I believe to be the values of the United States.”The tweets come amid ongoing criticism of the Trump White House for what critics say was US President Donald Trump’s equivocating in his condemnation of white supremacists who marched Friday and Saturday in Charlottesville.— AP and Times of Israel staff-15:54-Belgium orders trial for terror suspect Abdeslam over shootoutBelgium orders Paris terror suspect Salah Abdeslam to stand trial over a shootout in Brussels last year with Belgian and French police officers who had been tracking Europe’s most wanted man for four months.Abdeslam, who has ties to Islamic State and is the sole surviving alleged assailant in the November 2015 Paris massacre, was arrested three days after the shootout on March 15 last year in which several officers were wounded.Judges on Thursday order Abdeslam, 27, and his alleged accomplice Sofiane Ayari, 24, to stand trial in Brussels criminal court, the federal prosecutor’s office says. The two will be tried for “attempted murder on several police officers in a terrorist context” and “carrying banned weapons in a terrorist context,” the office says in a statement.A French woman police officer and Belgian colleagues were wounded at the Forest neighborhood apartment in which an Algerian Islamist suspect was killed. After finding Abdeslam’s fingerprints in the apartment, they arrested him and Ayari during a raid on March 18, 2016 in the gritty Brussels immigrant neighbourhood of Molenbeek, shooting Abdeslam in the leg.Investigators suspect that Abdeslam’s arrest precipitated the attacks in Brussels four days later by suicide bombers linked to him as they feared they, too, would be captured before they could carry out their plot.— AFP-15:40-3 construction workers killed, 2 seriously hurt in 4 accidents within 5 hours-Three construction workers are killed in the space of five hours today at three separate building sites.A 25-year-old man is killed when a steel beam on which several workers were sitting collapses and falls on him in a site on Silver Street in the northern city of Nahariya.A second worker, a 29-year-old man, is hospitalized in serious condition.Earlier in the day, a 40-year-old man was killed when he fell from a high floor in a construction site in Rosh Ha’ayin, while another 40-year-old was hit by a truck he was directing at a building site north of Tel Aviv.Another construction worker is seriously hurt after being electrocuted at a building site in Beitar Illit southwest of Jerusalem.
