BRUSSELS, Today, 09:11-The Eurogroup has emerged as a key body in the EU's evolving economic governance, playing a major role in the current dispute with Greece over further bailout money, yet it is democratically accountable to no one.Legally-speaking the monthly forum for eurozone finance ministers has a narrow remit: It is not an EU institution and it cannot adopt legally binding decisions.But the scale of the economic and financial crisis of the recent years and the resulting swathe of laws to try and ensure such a crisis never happens have turned it into a de facto player in EU's fledgling economic governance system.Its role was enhanced by the so-called six-pack of laws - which strengthens the rules underpinning the euro - and then further by the two-pack - which bolsters economic surveillance in the single currency states. Its meetings see discussions on draft national budgets and bailout programmes and are attended by the euro commissioner and the European Central Bank.The latest manifestation of its power is the ongoing battle between Greece and its lenders over what reforms Athens has to carry out in order to get a much-needed pay-out of bailout money.The money will only be released once the Eurogroup gives the green light.Yet its decisions have no legal effect - something the EU court spelt out recently in response to an attempt to overturn the Cyprus bailout and its conditions, including an unprecedented raiding of savers' accounts.Rene Repasi, a professor at Leiden University, notes the transparency vacuum in which the Eurogroup operates."There is a no legal obligation of the Eurogroup to inform the public or other institutions about its activities. There are no transparency rules for the Eurogroup. There are no minutes of its meetings."Speaking to MEPs in the constitutional affairs committee on Tuesday (5 May), Repasi also pointed out that Jeroen Dijsselbloem, the Eurogroup president, is "not obliged" to appear in front of any parliamentary body nor does he have to worry about any "consequences" if the Eurogroup makes a bad decision.Daniela Schwarzer from the German Marshall Fund said the "parliamentary component lags behind" in Eurozone decision-making.She noted that empowering national parliaments is not necessarily the solution, pointing to the fact that the German parliament has become a "de facto veto player" in all substantial decisions following a series of rulings by the country's constitutional court."If you look at it from a trans-European perspective you may ask yourself how legitimate it is to have such veto players in national contexts."Taking a wider look at accountability in eurozone governance, Schwarzer notes that 'democratic legitimacy' can mean different things to different member states.In Greece, it centers on the fact that while the government has changed - a radical left party was elected to power in January - it appears not possible to change policy.But in Germany there is irritation that euro "rules that are there to be applied are not being applied in the way that is anticipated".
How much economic governance?
Meanwhile, economist Daniel Gros, from the CEPS thinktank, raised some fundamental questions about the nature of economic governance.He said economic policy co-ordination "makes sense" when there is a crisis, but questioned how much it is needed if there is no crisis.“Let’s take the famous structural reforms. Very often it is said – ‘Germany, please reform your services so that your productivity in services increases. Then there will be more investment and demand and other countries will benefit'.”But, said Gros, the exact opposite argument could also be made. Services reform could make Germany more competitive and result in it importing less from other countries “so the others could lose”.He said such examples illustrative the “practical problems you face when you think of running an economic policy for the entire area".Gros cautioned against an overly prescriptive economic governance policy outside times of crisis."One should be very careful in not overloading mechanisms for economic governance by trying to achieve too much coordination on things that we, in Brussels, think are perhaps good and useful but for which we cannot really be certain about the strong spillover effects."

May, 12:55-In the 1990s, Europeans still used a telephone-based modem (which made a distinct sound when 'dialling up') to connect to the World Wide Web, the user-friendly part of the Internet. With seemingly infinite possibilities, some may have felt this new digital world – or ‘Cyberspace’ – would forever mean the end of national borders.Indeed, on 8 February 1996, an American named John Perry Barlow wrote a A Declaration of the Independence of Cyberspace. He published it online while attending the World Economic Forum in Switzerland.“Governments of the Industrial World, you weary giants of flesh and steel, I come from Cyberspace, the new home of Mind. On behalf of the future, I ask you of the past to leave us alone. You are not welcome among us. You have no sovereignty where we gather”, the text said in its preamble.Later on, the author told the world's governments that “Cyberspace does not lie within your borders”.Almost 20 years later, we know Barlow was wrong.Even for internet citizens, or netizens, whose physical bodies live somewhere in the nearly border-free European Union, there are still many barriers in Cyberspace.The European Commission on Wednesday (6 May) will present a strategy paper that will set out which online limitations the EU wants to lift.So what online borders do European netizens still face?
Buy a book, a magazine, a comic book, a record, a CD, a DVD, or any other material carrier of (legal) entertainment or information anywhere in the EU. Except for the physical labour of carrying them, you’ll have no problem taking it to another member state.But cultural works which are acquired online – often referred to as 'content' – are less easily 'transported' across EU borders than you might expect.Those EU citizens that have a subscription to a video or music streaming service, often find that they cannot access all or any of the content while visiting another country.Public broadcasters like the BBC do not allow internet users outside of the UK to watch content on their service iPlayer, citing rights agreements.According to a draft version of the commission strategy paper, seen by this website, less than 4 percent of all video-on-demand content in the EU is available cross-border.Some consumers - including some EU bureaucrats working in Brussels, far from home - use circumventing technologies to trick the content provider into thinking their computer is geographically located in their home country, but they probably would feel more confident using a less covert method.
Not selling to foreigners
When connecting to an internet service, a computer or smartphone usually reveals its location. Based on the location, web-shops or content providers from EU countries sometimes refuse to sell, or offer a different price, depending on your location.The extent of such unjustified geo-blocking is difficult to calculate.But the draft paper notes that almost three-quarters of complaints about “geographical discrimination faced by consumers relate to online cross-border purchases”.As the responsible digital commissioner, Andrus Ansip recently said: “I am ready to pay, but they are not accepting my money.”The issue of geographical discrimination is actually two separate issues: for physical goods and for digital content.With regards to physical goods, shops often say delivery costs are too high. With digital content, copyright is cited.
’Mom! I did something illegal!’When one of Caroline De Cock's children used some music as background to a digital creation and uploaded it on a social medium, she received her first copyright infringement notice.

Can you use online material in class, and distribute it to your students digitally? Data, in the broadest sense of the word, is used on a daily basis by millions of Europeans. But there is great legal uncertainty as to what is allowed. Rules on when it is okay to use copyright-protected material are not uniformly implemented across the EU.Remixing content from the internet is a popular pastime among the generation of Europeans born since John Perry Barlow's declaration, but it is unclear when it is legal and when it is not.

A bookseller has a dispute with a book publisher and decides to stop selling two of its titles. Not only that, but the bookseller breaks into the houses of everyone who bought those books, removes them from the respective bookcase or nightstand, and refunds the consumer.One of the books, ironically, is 1984 by the English writer George Orwell, a dystopian novel about totalitarianism and censorship.Such an event is difficult to imagine in the physical world, yet this is exactly what happened in 2009, when Amazon removed all digital copies of Orwell's 1984 and Animal Farm from e-readers.While many of today's best-known online firms have romantic stories of origin, which take place in student dorms or garages, the most-used internet services are now in the hand of large corporations which hold considerable clout.With companies like Google holding market shares of over 90 percent, the relation between customer and company has become asymmetrical.According to digital activist and author Cory Doctorow, that is because the copyright rules that applied to the physical world, where copying was a physical and laborious act rarely performed by private citizens, were transferred straight to the digital world.“The entertainment industry insisted, and for some reason politicians went along with it, that the industrial rules governing entertainment will henceforth govern the entire information society”, said Doctorow at a recent event in the European Parliament.“If you have to read a contract, in order to read a book, something is wrong”, he added.

BRUSSELS, Today, 08:58-The EU’s trade chief has unveiled plans to set up a global court to decide on disputes between investors and governments in a bid to defuse one of the main controversies in the ongoing EU-US trade talks.A "concept paper" published on Tuesday (May 5), drafted for trade commissioner Cecilia Malmstrom, stated that the EU should “pursue the creation of one permanent court,” to rule on so-called investor state dispute settlement (ISDS).The EU executive is keen to make clear that investor protection rules offer no guarantees to businesses that the legal regime in which they invested will remain the same. It also wants to include an article in the transatlantic trade and investment partnership (TTIP) stating that governments are free to pursue public policy objectives without fear of being sued.Meanwhile, it also calls on arbitration panels to be more like the traditional court system, with permanent litigators and tenured judges ruling on cases.The EU proposal is similar to that advocated by Germany’s economy minister Sigmar Gabriel, one of the strongest critics of ISDS.Gabriel has called for a public trade and investment court to replace the current system of private arbitration, and to enable appeals against arbitration rulings.Speaking at a hearing with MEPs in March, Malmstrom commented that, in the future, governments should be expected to nominate “a limited list of trustworthy arbiters who would decide on all TTIP investment cases”.A multilateral court would “be a more efficient use of resources and have more legitimacy,” she added.In a blog post on Tuesday, Malmstrom described the ‘traditional ISDS system’ as being “not fit for purpose in the 21st century”.“Our new approach ensures that a state can never be forced to change legislation, only to pay fair compensation in cases where the investor is deemed to have been treated unfairly,” she added.Malmstrom will present her proposals to MEPs on the International Trade committee on Wednesday and to trade ministers the following day. May, 18:25-Plans for more money and boats to expand the EU’s surveillance mission Triton in the Mediterranean have yet to be realised as migrants continue to attempt to make the perilous sea journey.EU leaders late last month announced plans at an emergency summit to “rapidly reinforce” Triton and its smaller Poseidon mission after around 1,700 people drowned.The proposal includes tripling Triton’s monthly budget to some €9 million per month so that it can lease extra military vessels and other assets pledged by member states.The money will be siphoned from the EU budget but is currently mired in technocratic procedures.“The commission is hoping to present an amending budget to the European Parliament and the Council by mid-May to get it adopted swiftly thereafter," EU commission spokesperson for migration Natasha Bertaud told reporters in Brussels on Monday (4 May).The statement follows dramatic rescue efforts led by the Italian coastguard over the weekend that saved thousands at sea. Initial figures of 5,800 have now been revised to 6,771 survivors, reports the Associated Press.The Triton mission is currently not mandated to carry out search and rescue operations but can help when it comes across a boat in distress.Flying under the EU mission flag, the French vessel, Commandant Birot, participated in the weekend rescue mission and plucked 217 migrants from three boats.The EU-led mission is technically limited to a 30 nautical mile range along the Italian coast although discussions on expanding its operational scope are taking place between the EU’s border agency, Frontex, which coordinates the sea missions, and Italy, Greece, and Malta.Bertaud said Frontex and Italy are meeting on Thursday “so we would expect for the operational plan to be finalised between them shortly thereafter.”She also dismissed any notion that the EU could imitate Australia’s asylum mission, which includes offshoring people to nearby islands to process their asylum requests.“The Australian model can never be a model for us,” said Bertaud.Mean while, on Tuesday the EU’s foreign policy branch EEAS will present member states with an ideas paper on controversial plans to crack down on smugglers. The plan includes destroying boats used by traffickers to send people across the Mediterranean.An EU official said foreign ministers are then set to meet on 18 May to discuss the paper.Ministers will also be looking at expanding the EU's military operation in Niger to also "cover border control and other efforts to stem illegal migration" noted a contact.The mission has a staff of around 100 people from 11 member states. First launched in 2012, it is set to end next July.

BRUSSELS, Today, 09:11-The Eurogroup has emerged as a key body in the EU's evolving economic governance, playing a major role in the current dispute with Greece over further bailout money, yet it is democratically accountable to no one.Legally-speaking the monthly forum for eurozone finance ministers has a narrow remit: It is not an EU institution and it cannot adopt legally binding decisions.But the scale of the economic and financial crisis of the recent years and the resulting swathe of laws to try and ensure such a crisis never happens have turned it into a de facto player in EU's fledgling economic governance system.Its role was enhanced by the so-called six-pack of laws - which strengthens the rules underpinning the euro - and then further by the two-pack - which bolsters economic surveillance in the single currency states. Its meetings see discussions on draft national budgets and bailout programmes and are attended by the euro commissioner and the European Central Bank.The latest manifestation of its power is the ongoing battle between Greece and its lenders over what reforms Athens has to carry out in order to get a much-needed pay-out of bailout money.The money will only be released once the Eurogroup gives the green light.Yet its decisions have no legal effect - something the EU court spelt out recently in response to an attempt to overturn the Cyprus bailout and its conditions, including an unprecedented raiding of savers' accounts.Rene Repasi, a professor at Leiden University, notes the transparency vacuum in which the Eurogroup operates."There is a no legal obligation of the Eurogroup to inform the public or other institutions about its activities. There are no transparency rules for the Eurogroup. There are no minutes of its meetings."Speaking to MEPs in the constitutional affairs committee on Tuesday (5 May), Repasi also pointed out that Jeroen Dijsselbloem, the Eurogroup president, is "not obliged" to appear in front of any parliamentary body nor does he have to worry about any "consequences" if the Eurogroup makes a bad decision.Daniela Schwarzer from the German Marshall Fund said the "parliamentary component lags behind" in Eurozone decision-making.She noted that empowering national parliaments is not necessarily the solution, pointing to the fact that the German parliament has become a "de facto veto player" in all substantial decisions following a series of rulings by the country's constitutional court."If you look at it from a trans-European perspective you may ask yourself how legitimate it is to have such veto players in national contexts."Taking a wider look at accountability in eurozone governance, Schwarzer notes that 'democratic legitimacy' can mean different things to different member states.In Greece, it centers on the fact that while the government has changed - a radical left party was elected to power in January - it appears not possible to change policy.But in Germany there is irritation that euro "rules that are there to be applied are not being applied in the way that is anticipated".
How much economic governance?
Meanwhile, economist Daniel Gros, from the CEPS thinktank, raised some fundamental questions about the nature of economic governance.He said economic policy co-ordination "makes sense" when there is a crisis, but questioned how much it is needed if there is no crisis.“Let’s take the famous structural reforms. Very often it is said – ‘Germany, please reform your services so that your productivity in services increases. Then there will be more investment and demand and other countries will benefit'.”But, said Gros, the exact opposite argument could also be made. Services reform could make Germany more competitive and result in it importing less from other countries “so the others could lose”.He said such examples illustrative the “practical problems you face when you think of running an economic policy for the entire area".Gros cautioned against an overly prescriptive economic governance policy outside times of crisis."One should be very careful in not overloading mechanisms for economic governance by trying to achieve too much coordination on things that we, in Brussels, think are perhaps good and useful but for which we cannot really be certain about the strong spillover effects."

May, 12:55-In the 1990s, Europeans still used a telephone-based modem (which made a distinct sound when 'dialling up') to connect to the World Wide Web, the user-friendly part of the Internet. With seemingly infinite possibilities, some may have felt this new digital world – or ‘Cyberspace’ – would forever mean the end of national borders.Indeed, on 8 February 1996, an American named John Perry Barlow wrote a A Declaration of the Independence of Cyberspace. He published it online while attending the World Economic Forum in Switzerland.“Governments of the Industrial World, you weary giants of flesh and steel, I come from Cyberspace, the new home of Mind. On behalf of the future, I ask you of the past to leave us alone. You are not welcome among us. You have no sovereignty where we gather”, the text said in its preamble.Later on, the author told the world's governments that “Cyberspace does not lie within your borders”.Almost 20 years later, we know Barlow was wrong.Even for internet citizens, or netizens, whose physical bodies live somewhere in the nearly border-free European Union, there are still many barriers in Cyberspace.The European Commission on Wednesday (6 May) will present a strategy paper that will set out which online limitations the EU wants to lift.So what online borders do European netizens still face?
Buy a book, a magazine, a comic book, a record, a CD, a DVD, or any other material carrier of (legal) entertainment or information anywhere in the EU. Except for the physical labour of carrying them, you’ll have no problem taking it to another member state.But cultural works which are acquired online – often referred to as 'content' – are less easily 'transported' across EU borders than you might expect.Those EU citizens that have a subscription to a video or music streaming service, often find that they cannot access all or any of the content while visiting another country.Public broadcasters like the BBC do not allow internet users outside of the UK to watch content on their service iPlayer, citing rights agreements.According to a draft version of the commission strategy paper, seen by this website, less than 4 percent of all video-on-demand content in the EU is available cross-border.Some consumers - including some EU bureaucrats working in Brussels, far from home - use circumventing technologies to trick the content provider into thinking their computer is geographically located in their home country, but they probably would feel more confident using a less covert method.
Not selling to foreigners
When connecting to an internet service, a computer or smartphone usually reveals its location. Based on the location, web-shops or content providers from EU countries sometimes refuse to sell, or offer a different price, depending on your location.The extent of such unjustified geo-blocking is difficult to calculate.But the draft paper notes that almost three-quarters of complaints about “geographical discrimination faced by consumers relate to online cross-border purchases”.As the responsible digital commissioner, Andrus Ansip recently said: “I am ready to pay, but they are not accepting my money.”The issue of geographical discrimination is actually two separate issues: for physical goods and for digital content.With regards to physical goods, shops often say delivery costs are too high. With digital content, copyright is cited.
’Mom! I did something illegal!’When one of Caroline De Cock's children used some music as background to a digital creation and uploaded it on a social medium, she received her first copyright infringement notice.
“Mom! I did something illegal!”, De Cock, a Belgian lobbyist, was told by her eight-year old daughter.She told an audience at an event organised by the European Policy Centre, a think tank in Brussels, that it’s more easy to explain the concept of privacy to her daughter than the current copyright framework.“One principle is very clear to children: creators should be rewarded. But copyright puzzles children.”For instance, can you publish altered photos as jokes on social media? Or creating animated video-clips as part of a contribution to internet culture? Can you use online material in class, and distribute it to your students digitally? Data, in the broadest sense of the word, is used on a daily basis by millions of Europeans. But there is great legal uncertainty as to what is allowed. Rules on when it is okay to use copyright-protected material are not uniformly implemented across the EU.Remixing content from the internet is a popular pastime among the generation of Europeans born since John Perry Barlow's declaration, but it is unclear when it is legal and when it is not.
US corporations as custodians of European culture?
A bookseller has a dispute with a book publisher and decides to stop selling two of its titles. Not only that, but the bookseller breaks into the houses of everyone who bought those books, removes them from the respective bookcase or nightstand, and refunds the consumer.One of the books, ironically, is 1984 by the English writer George Orwell, a dystopian novel about totalitarianism and censorship.Such an event is difficult to imagine in the physical world, yet this is exactly what happened in 2009, when Amazon removed all digital copies of Orwell's 1984 and Animal Farm from e-readers.While many of today's best-known online firms have romantic stories of origin, which take place in student dorms or garages, the most-used internet services are now in the hand of large corporations which hold considerable clout.With companies like Google holding market shares of over 90 percent, the relation between customer and company has become asymmetrical.According to digital activist and author Cory Doctorow, that is because the copyright rules that applied to the physical world, where copying was a physical and laborious act rarely performed by private citizens, were transferred straight to the digital world.“The entertainment industry insisted, and for some reason politicians went along with it, that the industrial rules governing entertainment will henceforth govern the entire information society”, said Doctorow at a recent event in the European Parliament.“If you have to read a contract, in order to read a book, something is wrong”, he added.
One in five Europeans can't read this article
Meanwhile, according to the EU commission, 20 percent of EU citizens have never used the internet.And while the EU average for access to broadband internet with a download speed of 30 megabits per second is 62 percent, that figure is much lower for rural areas. Only 18 percent of rural areas in the EU have 30Mbps broadband.The commission is expected to announce new measures to close this gap, the so-called digital divide.

BRUSSELS, Today, 08:58-The EU’s trade chief has unveiled plans to set up a global court to decide on disputes between investors and governments in a bid to defuse one of the main controversies in the ongoing EU-US trade talks.A "concept paper" published on Tuesday (May 5), drafted for trade commissioner Cecilia Malmstrom, stated that the EU should “pursue the creation of one permanent court,” to rule on so-called investor state dispute settlement (ISDS).The EU executive is keen to make clear that investor protection rules offer no guarantees to businesses that the legal regime in which they invested will remain the same. It also wants to include an article in the transatlantic trade and investment partnership (TTIP) stating that governments are free to pursue public policy objectives without fear of being sued.Meanwhile, it also calls on arbitration panels to be more like the traditional court system, with permanent litigators and tenured judges ruling on cases.The EU proposal is similar to that advocated by Germany’s economy minister Sigmar Gabriel, one of the strongest critics of ISDS.Gabriel has called for a public trade and investment court to replace the current system of private arbitration, and to enable appeals against arbitration rulings.Speaking at a hearing with MEPs in March, Malmstrom commented that, in the future, governments should be expected to nominate “a limited list of trustworthy arbiters who would decide on all TTIP investment cases”.A multilateral court would “be a more efficient use of resources and have more legitimacy,” she added.In a blog post on Tuesday, Malmstrom described the ‘traditional ISDS system’ as being “not fit for purpose in the 21st century”.“Our new approach ensures that a state can never be forced to change legislation, only to pay fair compensation in cases where the investor is deemed to have been treated unfairly,” she added.Malmstrom will present her proposals to MEPs on the International Trade committee on Wednesday and to trade ministers the following day. If approved, they could form the basis of negotiations with the US.ISDS has become one of the most hotly-disputed elements in the EU-US trade talks, which have now completed their ninth round. Critics of the process say that arbitrations are carried out in secret by trade lawyers, and that it allows companies to sue governments that pass social protection legislation that could harm their investments.Campaigners frequently point to a ongoing case brought by tobacco giant Philip Morris against the Australian government over new legislation requiring plain packaging for cigarettes sold in the country.Following rising concern about the regime, the commission opened the three-month online consultation last March and suspended discussions on ISDS with US trade officials.In January, the commission published a 140-page report from the consultation, to which 97 percent of submissions were opposed to the inclusion of ISDS.However, EU governments are parties to around 1,400 of the 3,000 international investment agreements that are currently in force across the world, and the commission is under pressure from the US government to include investor protection in any agreement.

BRUSSELS, 4. May, 18:25-Plans for more money and boats to expand the EU’s surveillance mission Triton in the Mediterranean have yet to be realised as migrants continue to attempt to make the perilous sea journey.EU leaders late last month announced plans at an emergency summit to “rapidly reinforce” Triton and its smaller Poseidon mission after around 1,700 people drowned.The proposal includes tripling Triton’s monthly budget to some €9 million per month so that it can lease extra military vessels and other assets pledged by member states.The money will be siphoned from the EU budget but is currently mired in technocratic procedures.“The commission is hoping to present an amending budget to the European Parliament and the Council by mid-May to get it adopted swiftly thereafter," EU commission spokesperson for migration Natasha Bertaud told reporters in Brussels on Monday (4 May).The statement follows dramatic rescue efforts led by the Italian coastguard over the weekend that saved thousands at sea. Initial figures of 5,800 have now been revised to 6,771 survivors, reports the Associated Press.The Triton mission is currently not mandated to carry out search and rescue operations but can help when it comes across a boat in distress.Flying under the EU mission flag, the French vessel, Commandant Birot, participated in the weekend rescue mission and plucked 217 migrants from three boats.The EU-led mission is technically limited to a 30 nautical mile range along the Italian coast although discussions on expanding its operational scope are taking place between the EU’s border agency, Frontex, which coordinates the sea missions, and Italy, Greece, and Malta.Bertaud said Frontex and Italy are meeting on Thursday “so we would expect for the operational plan to be finalised between them shortly thereafter.”She also dismissed any notion that the EU could imitate Australia’s asylum mission, which includes offshoring people to nearby islands to process their asylum requests.“The Australian model can never be a model for us,” said Bertaud.Mean while, on Tuesday the EU’s foreign policy branch EEAS will present member states with an ideas paper on controversial plans to crack down on smugglers. The plan includes destroying boats used by traffickers to send people across the Mediterranean.An EU official said foreign ministers are then set to meet on 18 May to discuss the paper.Ministers will also be looking at expanding the EU's military operation in Niger to also "cover border control and other efforts to stem illegal migration" noted a contact.The mission has a staff of around 100 people from 11 member states. First launched in 2012, it is set to end next July.
