Privacy Battles: OnStar Says GM May Record Car's Use, Even if You Cancel Service

OnStar, the service started by General Motors to support drivers through a cell phone system in their cars, has now told customers it may collect information on their movements and driving habits -- even if they no longer subscribe to the service. The notice went out quietly; the response has been anything but. OnStar installs cellular systems in vehicles which, if you pay for a service plan (starting at $18.95 a month), can give you driving directions, open the car doors if you lock yourself out, even track your car and alert local police if you are in an accident and your airbags inflate. Sound useful to you? It has more than five million customers. But then the company sent users a routine email updating its terms of service. Buried in some legal language was this line: Unless the Data Connection in your Vehicle is deactivated, information about your Vehicle may continue to be collected even if you do not have a Plan.A few lines later: We may ... share the information we collect with law enforcement or other public safety officials, credit card processors and/or third parties we contract with who conduct joint marketing initiatives with OnStar.In other words, OnStar was reserving the right to collect and share information on your driving habits -- even if you decided the service was a gimmick and ended your subscription.

Serious Concern About Privacy

OnStar went into apology mode.

Not a whole lot has changed, said Adam Denison, a spokesman for OnStar, in a conversation with ABC News. If people call in to cancel their service, we will inform them we will maintain the cellular connection, but they can disconnect at any time.Might the company sell the data to others, such as insurance companies? No, we're not doing it now, nor do we have any plans to do so, said Denison.What if a government agency were to call, asking for data on a driver's behavior? If a state highway department would call,he said,we could share data anonymously.So the police can't ask to see if I've ever driven 20 mph over the speed limit? Denison sent a statement from Joanne Finnorn, the firm's vice president for subscriber services:We are always very specific about with whom we share customers' personal information, and how they will use it,said Finnorn. We have never sold any personally identifiable information to any third party.It concluded, We apologize for creating any confusion about our Terms and Conditions. We want to make sure we are as clear with our customers as possible, but it's apparent that we have failed to do this.

Despite the company's assurances, this is another thorny case in which people have been monitored by a large company -- in this case, one that can tell where and how fast they drive -- and it may be possible for law enforcement agencies or others to subpoena them to get it.

Want Police Tracking You? How About Marketers?

Interconnected cars are a good thing, but a society with constant surveillance is not a good thing, said Justin Brookman, director of the consumer privacy project at the Center for Democracy & Technology in Washington.Brock Meeks, a colleague of Brookman's, pointed out that police can conceivably subpoena OnStar data without asking a judge's permission. They can track someone, he said, without having to show any suspicion of wrongdoing.Legal cases have gone back and forth on whether that should be allowed. The Supreme Court has agreed to hear a case, United States v. Jones, that could help settle whether police may use GPS to track people without a warrant approved by a judge.There's another part of this. Brookman said marketers in the future might be very interested in OnStar's data. If you regularly drive past a particular store, would you want the store sending you advertisements? What if those promotions are for lingerie or expensive cars? How would you feel if your spouse saw them? Franken and Coons said,We believe that OnStar's actions underscore the urgent need for prompt congressional action to enact privacy laws that protect private, sensitive information like location.One major factor that protects consumers, though, is consumer anger, said Brookman.It's not just consumers who are worried about privacy, he said.Companies are concerned that people will be freaked out and stop trusting their products.

That apparently includes OnStar.

Are American pastors free to share their political views from the pulpit? The answer to this question is complex. While some issues can certainly be discussed, there are also government-sanctioned limitations on partisan preaching (especially if churches expect to keep their tax-exempt status).A regulation added to the IRS code back in 1954 has muddied the waters for pastors, creating a scenario in which some leaders are too fearful of federal consequences to exercise their right to free speech from the pulpit.With pastors unsure of just how far they can take their partisan comments about specific candidates, some religious leaders find themselves purposefully avoiding the subject — a result that has potentially led to a decline in church education on issues of great social and political importance.As faith influences an individual’s take on social and political issues, one wonders why religious leaders face restrictions on speech that is so intertwined with personal religious beliefs.

The fear and uncertainty that some faith leaders experience is driven by the aforementioned ban on political campaign activity that was instituted on both charities and churches, alike, nearly 60 years ago. It was back in 1954 that Congress approved of what has become known as the Johnson Amendment. The provision, which still stands today, explicitly prohibits 501(c)(3) organizations (churches and charities) from engaging in campaign activity.Rather than declining in prevalence over time, this regulation has been strengthened. The last change was made to it back in 1987, when the amendment’s language was tightened to clarify that the restrictions should also cover statements and stances that stand against candidates (previously it was interpreted to only stand for statements that supported specific candidates). The IRS describes a 501(c)(3) as a group:which does not participate in, or intervene in (including the publishing or distributing of statements), any political campaign on behalf of (or in opposition to) any candidate for public office.Since religious leaders — be they liberal or conservative — are legally restricted in recommending or railing against specific political candidates, silence, for some, has likely been the response. This has created an environment under which some leaders feel that they cannot remain true to their personal beliefs and convictions.

The Speak Up campaign (launched by the Alliance Defense Fund) addresses this important issue, while working to protect and promote the rights of American churches. In addition to making faith leaders aware of their constitutional right to free speech, the movement encourages pastors to stop self-censoring and to start making their political voices heard.Below, see a trailer that comprehensively explains Speak Up in some pastors’ own words:To combat these restrictions, which critics believe severely impede the free speech of pastors and faith leaders, alike, the ADF also launched the Pulpit Initiative and Pulpit Freedom Sunday back in 2008. The project, designed to restore pastors’ rights to speak openly about any and all issues addressed in the Bible, described the historical restrictions on faith leaders as follows:Historically, churches have emphatically, and with great passion, spoken Scriptural truth from the pulpit about government and culture. Historians have stated that America owes its independence in great degree to the moral force of the pulpit. [...]All that changed in 1954 with the passage of the Johnson amendment which restricted the right of churches and pastors to speak Scriptural truth about candidates for office.The Pulpit Initiative is urging pastors to come together to challenge this free speech-altering restriction. And proponents of the movement aren’t shy. While they don’t want to turn churches into political mechanisms, they do want to see the Johnson Amendment declared unconstitutional. In their view, the IRS should have no right to censor what a pastor preaches about, be it political or not. The Speak Up web site has more:

ADF is actively seeking to represent churches or pastors who are under investigation by the IRS for violating the Johnson Amendment by preaching biblical Truth in a way that expresses support for – or opposition to – political candidates. ADF represents all of its clients free of charge.But in addition to legal help, pastors can also join in on Pulpit Freedom Sunday, an annual event the coalition has launched to encourage pastors to preach sermons that to examine candidates’ stances. Aside from exploring candidate opinion, churches are encouraged to look at what Scripture says about each issue. Then, they will make specific recommendations about whether or not the congregation should vote for or against specific candidates.Following the event, each pastor lets the IRS know about his or her sermon. The hope is that making the government aware of the code violation will spark an audit. Then, the constitutionality of the Johnson Amendment can be hashed out once and for all.In 2008, only 33 pastors participated; this expanded to 80 faith leaders in 2009 and then nearly 100 in 2010. With the movement rapidly growing, even more leaders are poised to take part in this year’s Pulpit Freedom Sunday on October 2, 2011.

Prime Minister Binyamin Netanyahu slammed his Turkish counterpart Monday evening for scandalous remarks during the United Nations General Assembly.Netanyahu accused Turkish Prime Minister Recep Tayyip Erdogan of outright incitement for statements made to CNN regarding the Nazi Holocaust of the Jews and accusing Israel of killing hundreds of thousands of Palestinians.Erdogan claimed in the broadcast interview Sunday, They [Israel] say that Palestine is bombing and disturbing the people of Israel, and many Israelis have been killed. I would like to see accurate statistics of how many Israelis have been killed by the bombs thrown by Palestinians or with the rockets that were launched by them, 10, 20, 100, 200 … how many? Please document it. Let us know.But on the other hand, he continued,we know that hundreds of thousands of Palestinians were killed. Only as a result of the Gaza attack, thousands of people were killed. These are very clear remarks. The Israeli people are only resorting back to the issue of genocide in history.Erdogan attacked Israel during his speech to the international body last Thursday as well, urging the United Nations to act quickly and heal this wound.He advocated for agreeing to the demands of the Palestinian Authority to recognize it as a new country in all areas restored to Israel in the 1967 Six Day War, including much of the Israeli capital – and including Judaism's holiest sites, the Western Wall and the Temple Mount.

The Israeli prime minister said bluntly that the incitement voiced by the Turkish prime minister was mendacious and scandalous, adding, These are outrageous charges against Israel that have nothing to do with the facts.The Holocaust was the worst crime in history perpetrated against our people. The prime minister added that Israel has lost thousands of its citizens to Palestinian terrorism.Although Erdogan's ire began several years ago with Israel's counter terrorism mini-war against the Hamas rulers of Gaza, he recently downgraded the country's long-standing diplomatic ties with the Jewish State to their lowest level in decades.

Those who are in power in Israel must understand that true security comes with a genuine peace. There is nothing that can replace peace.Erdogan referred to his country’s diplomatic row with Israel over the 2010 flotilla and once again demanded that Israel apologize for the deaths of nine Turkish nationals on the Mavi Marmara.Israel must apologize, pay compensation, and remove the blockade on Gaza, Erodgan was quoted as saying, making it clear once again that these are his terms for normalizing relations with Israel.He emphasized, however, that Turkey has no problem with the Israeli people.

Turkey downgraded its relations with Israel earlier this month, after the UN’s Palmer Report on the flotilla concluded that Israel faces a real threat to its security from militant groups in Gaza and determined that Israel’s naval blockade on the region was imposed as a legitimate security measure.Israel has reiterated that it has no intention of apologizing for the deaths of the nine IHH terrorists who died when IDF soldiers boarded the Mavi Marmara and were attacked by the so-called peace activists on board.

Turkey has officially denied involvement in gathering a list of 174 names of Israeli personnel – mostly navy commandos – involved in the May 2010 clash on the Mavi Marmara flotilla vessel.Istanbul Deputy Public Prosecutor Ates Hasan Sozen denied in a statement to the Turkish newspaper Today's Zaman asking the National Intelligence Organization (MIT) to identify IDF soldiers and commanders involved in the raid. Sozen said the list was prepared by the IHH organization that owned the Mavi Marmara, and had been allegedly prepared using a Facebook search.No state institution had such a request, nor does it have any information on this, he said. The prosecutor conducting the investigation has given no such order. He added that IHH lawyer Ugur Yildirim submitted the list Monday morning, the same day the list was published in a Turkish daily.The report published earlier in the day in the Turkish Sabah daily newspaper said the MIT had gathered information on the identities of the IDF commandos involved in killing nine Turkish terror activists on the vessel.

According to the report, the Istanbul Chief Prosecutor's Office had written to Israel demanding the full names and residential addresses of the military and government officials who gave the orders to attack the Mavi Marmara, and those who carried out those orders. Israel refused to comply, the newspaper reported, hence the prosecutor's request to MIT.Almost all of the soldiers who took part in the killing of nine Turks and the wounding of 30 others have been identified, the paper claimed.Legal steps have already been taken to protect those who were involved in the operation, according to the IDF.The Mavi Marmara was one of six ships allegedly intent on bringing humanitarian aid to Gaza. The Free Gaza movement used the sea for the operation as a means to breaking Israel's blockade of the region. It was later found that the Mavi Mamarma was carrying no humanitarian aid whatsoever, and many of its passengers were armed and looking to initiate a confrontation. The flotilla ignored repeated calls by Israel's navy to change course and head to Ashdod port, where their aid supplies would be debarked, inspected and transferred to Gaza through an overland route. Instead, IDF commandos were forced to board the vessels to ensure they did not reach Gaza -- and on the Mavi Marmara, the soldiers were viciously attacked by terror activists with deadly weapons.The United Nations' Palmer Report concluded in its findings earlier this month that Israel's blockade of Gaza is legal and appropriate given the constant efforts by the region's ruling Hamas terrorist organization, and others, to smuggle in arms and ordnance with which to attack Israeli citizens.

Iraq signs deal to buy 18 F-16 warplanes

BAGHDAD (Reuters) - Iraq has signed a contract to buy 18 Lockheed Martin F-16 warplanes to bolster its air force, an adviser to Prime Minister Nuri al-Maliki said on Monday.The value of the deal was not immediately known, but a senior U.S. military official said recently the offer on the table for the Iraqi government was valued at roughly $3 billion.Iraqi and U.S. military officials have said strengthening its air force is one of Baghdad's top priorities as U.S. troops prepare to leave by December 31, more than eight years after the invasion that ousted Saddam Hussein.The contract was signed ... and a part of the contract cost was sent to the bank account of the company, said Maliki's media adviser, Ali al-Moussawi.Lockheed said in a statement it looked forward to a partnership with Baghdad and was pleased with the confidence Iraq places in our products. It declined to comment on the specifics of the deal, referring questions to the Iraqi and U.S. governments.The Pentagon said it was aware of news reports that Iraq had signed the agreement but did not immediately confirm and referred questions to Baghdad.Iraq has long sought a combat jet for its rebuilt air force. The government delayed a planned purchase of F-16s in February to divert a $900 million down payment to its national food ration program to help quell street protests.

Maliki said on July 30 Iraq would buy 36 F-16s, double the number it had originally planned, to shore up its weak air defenses. The OPEC producer has found itself flush with cash this year, reaping windfall profits as world oil prices have remained above budget projections.The two sides have been negotiating for the F-16 Block 52 export model with sophisticated avionics and weapons in a deal that included maintenance and training, a U.S. military official said.Iraq is relying on the U.S. military for air support as it rebuilds its forces and battles a stubborn Islamist insurgency. Washington and Baghdad are discussing whether to keep some U.S. troops or military trainers in Iraq beyond the year-end deadline for U.S. departure.Iraq's two airborne defense units, the Air Force and Army Aviation Command, have only 158 aircraft, including 89 helicopters and 69 airplanes, and about 7,500 personnel, according to U.S. figures.At present, it has three Cessna Caravan propeller planes equipped with Hellfire missiles but no combat jets, a U.S. military official said.

The commander of the U.S. European Command (EUCOM), Admiral James Stavridis, departed Israel on Monday following a two-day work visit as a guest of the Chief of the General Staff, Lieutenant General Benny Gantz.During the course of his visit, Admiral Stavridis conducted work meetings with senior officers and toured a number of facilities throughout the country, including a site of an Iron Dome battery which protects Israeli citizens from rockets and missiles fired by the enemy.EUCOM, the United States Combatant Command responsible for nearly all of Europe, parts of Asia and the Middle East, and the Atlantic and Arctic Ocean, also heads many aspects of the military cooperation between Israel and the United States. One specific example of this cooperation is active missile defense.Israel and the United States plan to hold a joint large scale missile defense exercise next year to improve operational coordination of their defense systems.The exercise is scheduled to take place in early 2012 and will be one of the most extensive and complex drills ever conducted.
This was Admiral Stavridis’ third visit to Israel and his first in the current year. The visit took place as part of the annual schedule of joint training and learning between EUCOM and the IDF.

The very people who have been charged with protecting the Greek parliament and politicians from furious crowds and who have even been criticised by Amnesty International for their heavy-handedness, the Greek police, have themselves now begun to protest EU-IMF austerity.On Monday, police from the Special Guards unit climbed Mount Lycabettus, the highest point in Athens, to hang a giant black banner underneath the hill’s famous Chapel of St. George saying Pay day, day of mourning.
Some 50 striking police officers protected the banner from police who remained in service and who had been sent to tear the banner down.Troops of police have also protested outside European Commission offices in the capital and the German and French embassies, with a banner reading: Troikans Out! and another from the Pan-Hellenic Federation of Police Officers declaring in English: Greeks do not negotiate our national dignity.We will not become escorts for drug-addict politicians to get their latest dose,said another in reference the police operation in June providing protection from mass protests for MPs to be able enter parliament to pass austerity measures. The Greek term for a tranche of a loan and for a dose of drugs is the same word.The officers complain of cuts in wages and forced unpaid leave. Monday was a scheduled pay-day, but some wages are being withheld as part of a special solidarity tax imposed on public sector workers.

They have said they intend to massively participate alongside other civil servant protests. Further police protests are scheduled for Tuesday evening near the parliament.An angry declaration on the police union website from warned of an escalation of our struggle and that the security forces would not uncritically accept the directives from emanating from the IMF, the European Union and the powerful countries.We refuse to accept government conditions for occupiers of our land.The police demonstrations came amid further industrial action by transport workers on Monday, with Athens metro, tram and suburban rail halted for 24 hours. A public-sector strike has been announced for 5 October while an all-sector general strike is to be held on 19 October.On Sunday, riot police used tear gas to clear thousands of protestors from Syntagma Square in front of the Greek parliament. The Greek government in June was criticised by Amnesty International for its excessive use of tear gas against protestors.The same day, some 50 students stormed state television offices aiming to broadcast a message protesting reforms to universities, cuts that have kicked of a series of sit-ins at post-secondary institutions across the country.There has been an occupation at the state television channel NET and we are dealing with it, government spokesman Elias Mossialos said. The station refused the students’ demand and transmitted a travel documentary instead of the seven o’clock news.

Separately, the European Commission on Monday said that troika inspectors would still not be arriving in Athens to continue their review of the implementation of the austerity demanded by international lenders.No date has been set, said economy spokesman Amadeu Altafaj-Tardio. An EU official later said however that the commission is pretty confident [that they can return this week].[The troika] are finalising discussions with Greece, then we can move forward,said the official.
However, any decision on the release of the latest, €8 billion tranche of bail-out cash for the country will not be made even during a meeting of eurozone finance ministers in Luxembourg on 3 October.The troika mission must first return to Athens, produce a compliance assessment, which must then be considered by other eurozone states before the funds can be handed over.It will be a tight schedule, as the country is set to run out of money to pay civil servants and pensioners by the middle of next month.Greek police protest EU-IMF austerity

There is life after the Commission

At least 39 percent of Commissioners become representatives of some private interests after leaving the European Commission. They join a company or an interest group association or establish a consulting business of their own.This is the result of a study The Private Interest Representation by former EU Commissioners', scrutinizing the activities of the 92 Commissioners who have retired from the Commission since 1982.*

The ex-Commissioners use the knowledge and network they have acquired during their term of office. They cash in on the human capital that they have accumulated at the expense of the taxpayers.The prospect of afterlife, however, may affect their decisions and voting behaviour while they are still at the Commission. It may induce them to be more accommodating towards interest groups. This is why the Commission has adopted a Code of Conduct prescribing a cooling-off period during which its retiring members are not supposed to lobby in their former policy field.

Portfolio and nationality

Indeed, as the study shows, the probability that the ex-Commissioners become lobbyists depends significantly on their former policy brief. It is 100 percent if they have been responsible for competition policy, 89 percent for the internal market, 67 percent for economics and finance and 57 percent for agriculture, energy or industry. It is zero for ex-Commissioners who have been in charge of research, education, administrative affairs, health or multilinguism.The Commissioner's home country also matters. Commissioners from Portugal, Austria, Bulgaria and Malta have the highest propensity to lobby, those from Scandinavia the lowest. The UK comes tenth with a probability of 44 percent.Another factor is education. Among the ex-Commissioners who have a law degree, 48 percent become lobbyists. This compares with 35 percent for economists and 33 percent for the rest. However, the lawyers are more willing to sign the Commission's register of lobbyists. They seem to consider it more natural to defend special interests.Commissioners nominated by left wing governments are significantly less likely to represent private interests after they have stepped down. This may be due to their preferences, or they may be less useful as lobbyists. There is no significant difference between conservatives, liberals and independents.

Average retirement age i 58

Age also plays a role. The younger the Commissioner is at the time of leaving the Commission, the larger the probability is that he or she will become a lobbyist. This was to be expected because the older ex-Commissioners are more likely to stop working altogether.However, a lengthy office term is shown to raise the probability of becoming a private interest representative. On average, Commissioners retire at the age of 58, after six years of office.The share of ex-Commissioners turning lobbyists does not follow a trend. It rose in 1993-99 but it fell thereafter. The increase in the 1990s may have been due to the fact that the Single European Act (1987) and the Treaty of Maastricht (1993) introduced qualified majority decisions on many types of regulations. This meant that interest groups could capture the Council more easily. The subsequent decline may have been caused by the Commission's Code of Conduct (1999) or by the Eastern enlargement (2004). Eastern Europeans may be less used to lobbying in Brussels.

Cooling-off period extended

The Commission has just extended the cooling-off period for retiring Commissioners from 12 to 18 months. However, ex-Commissioners may obtain up to 65 percent of their former salary for three years after leaving, if their income from work stays within specified limits. These times ought to be brought in line.Moreover, the cooling-off period applies only to lobbying within the ex-Commissioner's former policy brief. Yet the Commission decides collectively. Each Commissioner is entitled to vote on all decisions taken by the Commission. The prospect of becoming a lobbyist may also affect his vote on issues outside his policy brief. The cooling-off period ought to cover all policy fields in which the Commission is active.Finally, rules should not be set by those who later are to abide by them. If the rules are determined by the Commissioners, they are likely to be biased in their favour. They will not sufficiently restrict the scope for post-Commission lobbying.As a result, Commissioners give too much support to special interest groups, both before and after retiring from the Commission. The Code of Conduct for former Commissioners ought to be legislated by the Council and the European Parliament or be incorporated in the European Treaties.

Typhoon lashes Philippines, 1 dead, thousands flee

MANILA, Philippines (AP) — A powerful typhoon slammed the northern Philippines Tuesday, unleashing floods, cutting power and halting work in the capital, Manila, where residents waded in waist-deep waters and strong winds toppled trees.
Authorities ordered more than 100,000 people to shelter from rains and wind gusts of up to 106 miles (170 kilometers) per hour. At least one person — a baby — drowned and four fishermen were reported missing.Typhoon Nesat made landfall before dawn over eastern mountainous Isabela and Aurora provinces which face the Pacific Ocean, packing sustained winds of 87 mph (140 kph), the government weather bureau said.

With its immense 400-mile (650-kilometer) cloud band, the typhoon threatened to foul weather across the entire main Luzon Island as it moves across the Philippines toward the South China Sea late Wednesday or early Thursday and then heads toward southern China.Heavy downpours and winds prompted the closure of government offices, schools and universities in the capital, while scores of domestic flights were canceled and inter-island ferries grounded, stranding thousands. The Philippine Stock Exchange and U.S. Embassy were also closed Tuesday.A year-old baby drowned in the central island province of Cataduanes after falling into a river, the government disaster agency reported. Four fishermen were missing while more than 50 others were rescued along eastern shores after their boats overturned in choppy seas. Not 1967, 1947


London's Daily Telegraph has the text of Moderate Palestinian President Mahmoud Abbas Abu Mazen's letter to UN Secretary General Ban Ki-Moon requesting statehood. Not only are the words 1967 borders not mentioned; it also doesn't mention the 1949 armistice lines. Instead, Abu Bluff wants to go back to the 1947 partition plan, which was rejected on the spot by the Arabs because it allowed a Jewish state at all.

I warned back in July that this was where it was headed. Here's a map to give you an idea of what 1947 would mean (Israel liberated much more territory in the War of Independence).Israel would be the blue parts on the map. It would mean no Jerusalem and no airport. Even more indefensible borders than the 1949 armistice lines. The Palestinians ignore Security Council Resolution 242, which requires that Israel be left with defensible borders and says nothing about a Palestinian state.And Israel's mendacious opposition calls this a window of opportunity?

When the Palestinians presented their bid for statehood at the UN Friday, most news outlets suggested Palestinian Authority President Mahmoud Abbas was aiming for a state based on 1967 borders covering only the West Bank, Gaza and East Jerusalem.A closer look at the actual letter he presented to UN Secretary General Ban Ki-Moon applying for UN membership reveals the Palestinians are aiming for far more territory.As reprinted in the Telegraph, Abbas’s letter reads:This application for membership is being submitted on the Palestinian people’s natural, legal and historic rights and based on United Nations General Assembly resolution 181 (II) of 29 November 1947 as well as the Declaration of Independence of the State of Palestine of 15 November 1988 and the acknowledgement by the General Assembly of this declaration in resolution 43/177 of 15 December 1988.Lots of dates are cited here. Let’s take a closer look. Abbas says his people’s rights are based on the 1947 UN Resolution. That year refers to the UN Partition Plan, the same plan all Arab states rejected and the Jews accepted for their homeland, after which those Arab neighbors declared war on Israel.

These maps from GBTV reveal the land allotted to the Jewish State under the 1947 Partition Plan was in fact much smaller than that afforded under 1967 borders.
Though President Obama has endorsed Palestinian demands — stated until now — that their future state be based on 1967 borders, Israel says borders should be based on the outcome of negotiations. If Abbas’s proposal is accepted by the UN Security Council, gone from Israel is Jerusalem its capital and home to the sites most sacred to Jews and Christians. Also gone: Ben Gurion Airport just outside Tel Aviv, the country’s only major international airport.The blog Israel Matzav explains the significance:It would mean no Jerusalem and no airport. Even more indefensible borders than the 1949 armistice lines. The Palestinians ignore Security Council Resolution 242, which requires that Israel be left with defensible borders and says nothing about a Palestinian state.There are other alarming suggestions the Palestinians are not being upfront in stating their intentions regarding the size of the state they aim for.One of the sticking points in restarting negotiations with Israel is the Palestinians’ continued opposition to recognizing Israel as a Jewish State. In fact, last week a round of talks aimed at restarting peace negotiations broke up over Abbas’ refusal to recognize Israel as a Jewish State.Secondly, the Palestine Liberation Organization’s current logo on its UN Observer Mission website suggests it wants the entire state of Israel incorporated into its future state – not just the West Bank and Gaza. One indication they are not came over the weekend, when Mahmoud Abbas said he wants to bust open part of the Oslo Agreements with the Israelis called the Paris Agreement and renegotiate. On his plane as he was traveling from New York back to Ramallah, Abbas told journalists:We want to reopen the Paris Agreement and make changes to it…The agreement is not fair and there are restrictions on Palestinians that prevent our economy from growing and prospering. The Paris Agreement does not give us the opportunity to develop our economy and our country.Right now the ball is in the court of UN Security Council (UNSC) members. It will be interesting to see how each votes. Since losing its capital city and main airport as well as other strategic assets would be a non-starter for Israel, the votes on these 1947 borders will reveal if UNSC members are sincere in their desire for peace in the Middle East, if they recognize Israel’s right to security (and honoring UNSC Resolution 242), or if they are paying lip service to the Palestinians.

UNITED NATIONS (Reuters) - The Palestinians' initiative to seek U.N. recognition as a state, which goes to the Security Council on Monday, faces an uphill struggle to secure the nine votes needed for approval.Without those votes in the 15-member body, the United States will be spared the embarrassment of having to veto the application, which would be a further blow to its floundering efforts to secure Middle East peace.As the formal discussions start, diplomats say the Palestinians have only six certain votes on the council -- China, Russia, Brazil, Lebanon, India and South Africa.Those nations, except Lebanon, make up the BRICS bloc of emerging powers whose economic and diplomatic clout has grown as trade becomes more globalised and the United States and Europe fight prospects of another recession.

But diplomats say the BRICS countries seem to have made no attempt to use their considerable weight, often on show in financial and trade matters, to force the Palestinian issue. They have essentially taken the same approach as always.If a vote was held today, the Palestinians wouldn't have enough votes to carry the day and the Americans wouldn't even need to use their veto, a Western diplomat told Reuters.The Palestinian observer to the United Nations, Riyad Mansour, told reporters nine council members are among the 131 U.N. member states that have recognized the state of Palestine and he hoped that they would vote positively.But he acknowledged that council members will face tremendous pressure in the coming weeks to vote against the Palestinian U.N. bid.Still, diplomats say Washington remains isolated on the council because of its staunch support for Israel, which the majority of U.N. member states believe has worked hard to sabotage peace talks with the Palestinians.In February, Washington vetoed what was widely seen as an anodyne resolution condemning Israeli settlement activity, even though its language was largely consistent with statements of the Obama administration, which has urged the Israelis to resume a moratorium on new settlements.When Israel ended the moratorium a year ago, the Palestinians withdrew from moribund peace talks.

ISOLATION

Highlighting its isolation on the Security Council, Washington cast the sole vote against the settlements resolution. The other 14 members -- including Washington's European allies such as Britain and France -- opposed the United States and Israel and voted for the resolution.The Europeans agree with Washington that the Palestinian U.N. bid is unwise and are inclined to oppose it. But the Europeans and Americans are far apart on the Middle East issue and diplomats say Washington remains as isolated as ever.Palestinian President Mahmoud Abbas set the clock ticking on Friday when he delivered a U.N. membership application for a Palestinian state in the West Bank and Gaza Strip. The capital would be East Jerusalem, land Israel captured in the 1967 war that it launched out of fear Arabs were poised to attack.The council will take up the Palestinian membership application on Monday in closed-door consultations, but no immediate action is expected, diplomats say.Normally the council would take no more than 35 days to review and assess a membership application. In July, the application of South Sudan, the 193rd U.N. member and the most recent country to join the world body, was approved in a matter of days and given to the General Assembly, which confirmed it.Western diplomats on the Security Council say that will not be the case with the Palestinian application. The United States and Israel vehemently oppose the move and say it can only undermine efforts to relaunch stalled peace talks.

The 35-day limit can easily be waived, Western diplomats say. Slowing down the process, they say, would be helpful as it would buy time for the United States, the European Union, Russia and the United Nations -- the Quartet -- to put pressure on both sides to get back to the negotiating table.But Abbas told reporters during the trip back to Ramallah that he expected the council to make a decision in weeks not months.Palestinian Foreign Minister Riyad al-Malki has acknowledged his delegation lacks sufficient support at the moment to get a resolution on Palestinian statehood and U.N. membership through the council.To pass, resolutions need nine votes in favour and no vetoes from the five permanent council members -- Britain, China, France, Russia and the United States.We're working towards it (securing nine votes) and I think we'll manage it,Malki said.Malki has named Gabon, Nigeria and Bosnia as key rotating council members he hopes to win over to the Palestinians' side. During last week's U.N. General Assembly session, the three swing states did not divulge whether they would vote in favour of Palestinian U.N. membership.Gabon President Ali Bongo told the assembly he supported the existence of a Palestinian state that lives peacefully side by side with Israel. Bosnian President Zeljko Komsic voiced similar views. Nigerian President Goodluck Jonathan did not mention the Palestinians in his speech.Mansour said the Palestinians would be sending high-level delegations to Bosnia, Gabon and Nigeria in the coming weeks.Portugal's prime minister, Pedro Passos Coelho, whose country is also on the council, indicated Lisbon would favour an option whereby the Palestinians would apply to the General Assembly for upgraded U.N. observer state status -- less than full membership but indirect recognition of statehood.(Editing by John O'Callaghan and Cynthia Osterman)
