EU heritage label scheme to drop Switzerland

EUOBSERVER / BRUSSELS – The EU commission on Tuesday (9 March) proposed to widen an existing European heritage label for sites related to the bloc's common history to all 27 member states.The European heritage label will help increase public awareness of our common yet diverse cultural heritage and stimulate cultural tourism, EU culture commissioner Androulla Vassiliou said at a press conference.An independent panel of experts will select each year one site from a maximum of two proposals from each member country. The personnel and promotion costs will be little below €1 million a year, Ms Vassiliou said, adding that the potential economic benefits from the resulting cultural tourism will be much bigger.She explained that the proposal would build on an existing scheme set up in 2006 by 17 EU countries and which have already awarded the label to 62 sites ranging from the historic Polish shipyard in Gdansk, where the anti-Communist Solidarnosc movement emerged, to the house where Robert Schuman was born, the French statesman who is considered one of the founding fathers of what later became the European Union. The list, largely full of archeological and religious monuments, also includes the Portuguese national archives for being the first European depository of a death penalty abolition law.

Austria, Denmark, Finland, Ireland, Luxembourg and the UK are not participating in the scheme at this stage, but may opt to do so later.The existing scheme also includes Switzerland, a non-EU member participating in the bloc's common economic and border-free area. It was last year awarded the European heritage label for three of its cultural and historic sites.Since the new label will be an EU-only initiative, Bern will no longer be part of future selections. But Ms Vassiliou stressed that the existing sites will not be stripped of their heritage label. The commission will review all existing sites every six years and check if they respect the rules, which still need to be outlined.We were invited to join this inter-governmental initiative and are happy to continue participation for these three sites. What is important for us is that the label is not removed, Oliver Gerber, Switzerland's culture envoy to the EU told this website. Bern is now analysing the commission proposal and its future implications, he added.One of the sites is St Peter's cathedral in Geneva, the home church of the 16-century reformist Jean Calvin, one of the central figures in Europe's protestant era, along Germany's Martin Luther. The mountain pass of Gotthard, linking Germany to Italy, has also been awarded the European heritage label for being an emblem of European mobility. The hospice overseeing the pass is also included in the label, for having played various roles in the continent's long history of armed conflicts. Last century, the hospice was one of the main bastions of defence against the Nazis. The third Swiss site included in the list is the 11th century castle of La Sarraz, which hosted the first international conference on modern architecture back in 1928.

Utah has become the third state to adopt a law exempting guns and ammunition made, sold and used in the state from massive federal regulations under the Bureau of Alcohol, Tobacco, Firearms and Explosives, and supporters say about 30 more states have some sort of plan for their own exemptions in the works.Officials in Utah say they expect a lawsuit over their direct challenge to Washington if the federal government succeeds in its current case against Montana's law. Gary Marbut of the Montana Shooting Sports Association, who has spearheaded the Montana law, now describes himself as a sort of godfather to the national campaign. He confirmed Montana, Tennessee and Utah have enacted such laws. Wyoming and South Dakota, they have passed legislation and it's on their governors' desks,he said.We learned today Oklahoma's House has passed a plan over to the Senate. Idaho's House has just passed it along. Alaska's has passed the House and is in the Senate Judiciary committee, he said. In Montana, officials filed suit against U.S. Attorney General Eric Holder and others seeking a court order that the federal government stay out of the way of Montana's management of its own firearms within state borders. In a recent filing, the federal government demanded dismissal of the action, explaining it can regulate in-state commerce under the Constitution's Commerce clause. As WND reported, the action was filed by the Second Amendment Foundation and the Montana Shooting Sports Association in U.S. District Court in Missoula, Mont., to validate the principles and terms of the Montana Firearms Freedom Act, which took effect Oct. 3. Marbut argues that the federal government was created by the states to serve the states and the people, and it is time for the states to begin drawing boundaries for the federal government and its agencies. The government's latest filing in the case demands its dismissal, citing a lacking of standing for the plaintiffs and the court's lack of jurisdiction, as well as the Constitution's Commerce Clause. The government filing argues,The Supreme Court and Ninth Circuit have repeatedly held that even purely intrastate activities, such as those the MFFA purports to exempt from federal law, do affect interstate commerce and thus are within Congress' power to regulate. As a result, even if plaintiffs had standing and jurisdiction existed, plaintiffs' amended complaint fails to state a claim and must be dismissed.

The Commerce Clause, however, can be interpreted to have been amended by the 10th Amendment, which is part of the Bill of Rights, adopted subsequent to the U.S. Constitution, Marbut explains. His organization said, The Commerce Clause was amended – by the 10th Amendment. It is a bedrock principle of jurisprudence that for any conflict between provisions of a co-equal body of law, the most recently enacted must be given deference as the most recent expression of the enacting authority. This principle is ancient. Without this principle, laws could not be amended or repealed.For example, U.S. courts repeatedly affirmed slavery before it ultimately was rejected.There's no question that the components of the Bill of Rights have authority: Just look at the 1st Amendment, Marbut explained. The federal government had written gun dealers in Montana as well as in Tennessee when it adopted its own version of the same law that warned against following the state laws. Carroll, the assistant director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, told dealers the Tennessee Firearms Freedom Act, adopted, purports to exempt personal firearms, firearms accessories, and ammunition manufactured in the state, and which remain in the state, from most federal firearms laws and regulations.The exemption is not right, the federal agency letter contends.

WASHINGTON – The government ran up the largest monthly deficit in history in February, keeping the flood of red ink on track to top last year's record for the full year.The Treasury Department said Wednesday that the February deficit totaled $220.9 billion, 14 percent higher than the previous record set in February of last year.The deficit through the first five months of this budget year totals $651.6 billion, 10.5 percent higher than a year ago.The Obama administration is projecting that the deficit for the 2010 budget year will hit an all-time high of $1.56 trillion, surpassing last year's $1.4 trillion total. The administration is forecasting that the deficit will remain above $1 trillion in 2011, giving the country thrree straight years of $1 trillion-plus deficits.The administration says the huge deficits are necessary to get the country out of the deepest recession since the 1930s. But Republicans have attacked the stimulus spending as wasteful and a failure at the primary objective of lowering unemployment.The administration defends the economic stimulus bill that Congress passed in February 2009 with a pricetag at the time of $787 billion as the right medicine to get the economy back on its feet. President Barack Obama has said even more is needed to battle an unemployment rate that remained stuck in February at 9.7 percent.The White House says that job creation will remain a top priority, hoping to convince voters that Obama did not spend too much time during his first year in office trying to get Congress to pass health care reform.

The government's monthly budget report showed the record $220.9 billion deficit for February reflected outlays of $328.4 billion and revenues of $107.5 billion. The February receipts marked the first time that revenues are up compared with the same month a year ago since April 2008. Revenues had fallen for 21 straight months as the recession cut into both individual and corporate income tax payments.Deficits normally shoot up in February because it is a month when the government makes large refund payments to individuals and corporations as part of the tax filing process. Those payments were boosted this year by various tax credits that were expanded or added as part of the government's stimulus efforts including the "Making Work Pay" tax credit and the first-time home buyers tax credit.Through the first five months of the budget year, government revenues totaled $800.5 billion, down 7 percent from a year ago, while outlays totaled $1.45 trillion, up a slight 0.1 percent from a year ago.The deficit of $651.6 billion through February is up by 10.5 percent from the $589.8 billion deficit run up during the first five months of the 2009 budget year. The government's budget year begins on Oct. 1.The budget that Obama sent to Congress in February projects that the deficits over the next decade will total $8.53 trillion. But the Congressional Budget Office last week put the 10-year total even higher at $9.8 trillion. Part of the reason for the $1.2 trillion difference is that the CBO is projecting slower economic growth and thus less tax revenues than the administration over the next decade.The administration has maintained that the country must run large budget deficits until the economy has begun to grow at a sustainable pace that is bringing the unemployment rate down. Only then, the administration says, should the government focus on getting control of the deficits.

Obama has created by executive order an 18-member fiscal reform commission that has been charged with coming up with a plan to shrink the deficit to 3 percent of the economy within five years. The plan is scheduled to be unveiled in December, after the midterm congressional elections.With the economy so weak, the interest rates that the government has to finance the flood of red ink have remained low. However, economists are worried that the favorable outlook on interest rates could change quickly if investors, including foreign investors, start to worry about the government's commitment to restraining future deficits. China is the largest foreign holder of U.S. Treasury securities.Through the first five months of this budget year, net interest payments totaled $86.5 billion, up 15.3 percent from a year ago.

In its report last week, the CBO predicted that the government debt held by investors would climb from $7.5 trillion at the end of last year to $20.3 trillion in 2020. CBO forecast that interest payments would more than quadruple from a projected $209 billion this year to $916 billion annually by the end of the decade.

WASHINGTON – The nation's top health official challenged insurers on Wednesday to join President Barack Obama's push to overhaul the medical system, arguing that if the effort fails it will hurt them as well as other Americans.Obama is to speak Wednesday in suburban St. Louis and then travel to northeastern Ohio on Monday, his third health care event in a week. His speech comes as congressional Democrats stand on the brink of delivering the president a dramatic success with passage of his massive overhaul legislation — or a colossal failure if they can't get it done.As part of the administration's campaign, Health and Human Services Secretary Kathleen Sebelius sketched out a stark choice for insurers: oppose reform and eventually lose customers, or work with the White House to improve the legislation.She told insurers in a speech that if the overhaul fails, premiums will continue to rise and employers will cancel coverage. She said the industry may make money initially, but this kind of short-term thinking won't work in the long run for the American people or our health care system. It won't work for you.Sebelius called on insurers to take the millions they might spend on attack ads and give Americans relief from rising double-digit premium increases.Groups that oppose the legislation are stepping up their criticism, with the U.S. Chamber of Commerce announcing a coordinated campaign to spend as much as $10 million on ads, starting Wednesday, saying, Stop this health care bill we can't afford.

Karen Ignagni, the insurance industry's top lobbyist, said the companies don't believe the legislation will reduce costs. The industry is preparing a list of cost control ideas for Obama.But Sebelius' speech calmed the war of words between the administration and insurers — at least temporarily.I am certainly not here to vilify the hard working employees of insurance companies ... or blame insurance companies for all the problems in our system, she said.Ignagni, who has accused the White House of waging a campaign of vilification, told reporters afterward she appreciated the gesture.We think now could be the beginning of a change, and we could move from vilification to problem solving,she said.Leaders in the House and Senate are awaiting a final cost analysis from the Congressional Budget Office in the next day or so that will allow them to start counting votes — and twisting arms — in earnest. In the House, in particular, getting the needed majority will be touch and go.

The two-step congressional approach now being pursued calls for the House to approve a Senate-passed bill from last year, despite House Democrats' opposition to several of its provisions. Waste and fraud are pervasive problems for Medicare and Medicaid, the giant government health insurance programs for seniors and low-income people. Improper payments totaled an estimated $54 billion in 2009. They range from simple errors such as duplicate billing to elaborate schemes operated by fraudsters peddling everything from wheelchairs to hospice care. The bounty hunters in this case would be private auditors armed with sophisticated computer programs to scan Medicare and Medicaid billing data for patterns of bogus claims. UN report: Much of Somalia's food aid diverted By EDITH M. LEDERER, Associated Press Writer – MAR 10,10

UNITED NATIONS – Up to half the food aid intended for the millions of hungry people in Somalia is being diverted to corrupt contractors, radical Islamic militants and local U.N. workers, according to a U.N. Security Council report.The report blames the problem on improper food distribution by the U.N. World Food Program in the African nation, which has been plagued by fighting and humanitarian suffering for nearly two decades, according to a U.N. diplomat. The diplomat spoke on condition of anonymity because the report has not yet been released.It calls on U.N. Secretary-General Ban Ki-moon to authorize an independent investigation of the Rome-based food agency's operation in Somalia.Because of the instability in Somalia, transporters must truck bags of food through roadblocks manned by a bewildering array of militias, insurgents and bandits. Kidnappings and executions are common and the insecurity makes it difficult for senior U.N. officials to travel to the country to check on procedures. Investigators could end up relying on the same people they are probing to provide protection.The U.N. diplomat told The Associated Press that "a significant diversion" of food delivered by the U.N. food program is going to cartels that were selling it illegally, according to the report by the panel of experts monitoring U.N. sanctions against Somalia.

The findings were first reported by The New York Times on Tuesday.

Although WFP contracts are supposed to be subject to open tender and competitive bidding, in practice the system offers little or no scope for genuine competition, the diplomat quoted the report as saying.The transportation contracts, with a budget of $200 million, constitute the single most important source of revenue in Somalia, the diplomat quoted the report as saying.Preliminary investigations by the monitoring group indicate the existence of a de facto cartel characterized by irregular procedures in the awarding of contracts by the WFP Somalia Country Office, discriminatory practices, and preferential treatment,the report was quoted as saying.

On account of their contracts with WFP, these men have become some of the wealthiest in Somalia,it was quoted as saying.Some 3.7 million people in Somalia — nearly half of the population — need aid. Earlier this year, the country's main extremist Islamic group said it would prohibit WFP from distributing food in areas under its control because it says the food undercuts farmers selling recently harvested crops.
The group, al-Shabab, also accused the agency of handing out food unfit for human consumption and of secretly supporting apostates,or those who have renounced Islam.
According to the report, al-Shabab controls 95 percent of WFP's areas of operation, the diplomat said.It said Somalis with WFP contracts are not only diverting aid but sharing in the proceeds.Approximately 30 percent of the food goes to the distributors or implementing partners,between 5 and 10 percent goes to the armed group in control of the area, and 10 percent to the ground transporter, the diplomat quoted the report as saying.The rest — about 50 percent of the food aid — is distributed to the needy population, the report was quoted as saying.World Food Program spokesman Greg Barrow said the agency planned no comment until it had time to study the report.A Nairobi-based spokesman for WFP had said previously that internal investigations showed between 2 percent and 10 percent of aid was being sold. Glenn Beck Felled by Eric Massa's Performance By MICHAEL SCHERER / WASHINGTON – Wed Mar 10, 1:35 am ET-TIME

In the course of his remarkable rise from cable sideshow to Fox News superstar, Glenn Beck has never really faced a serious challenge. To a man and woman, his opponents only made him stronger, strengthening his every-guy-against-the-world image and putting some meat on the bones of his near paranoid ravings about dark forces aligning against liberty, and himself. When cornered, he only became more vulnerable, more tearful and, at least to his fervent followers, more likable.But on Tuesday night, Beck faced a foe unlike any other, a pasty, disgraced former one-term Democratic Congressman from New York, Eric Massa, who had resigned only hours earlier amid an ethics inquiry into allegations he had groped and sexually harassed some of his male employees over the years. Massa, who has maintained that his main reason for not running for re-election in the fall is a recurrence of non-Hodgkin's lymphoma, arrived in the Fox studios with an X-ray of his own chest and a photo album of pictures from his Navy service that, he announced, looks like an orgy in Caligula.I'm going to show you a lot more than tickle fights,Massa told Beck, leaving the host, for a precious moment, speechless. Massa had come on Fox to out-Beck Glenn Beck. Armed with the very same weapons - a deep sense of victimhood, outrage at the powers that be and remarkable personal candor - the representative delivered a dizzying confessional. He admitted to sexless groping and tickling of his staff, sending inappropriate text messages and otherwise failing to behave like a Congressman should, all as he made his case that his fellow Democrats had really gone after him because of his previous no vote on health care reform.I can't fight this. I can't fight cancer,Massa announced, in a classic stream of consciousness ramble.I can't fight the White House. I can't fight the Democratic Party.

Beck, who is used to controlling the gravitational force of victimhood around him, kept interrupting to point out that he was a bigger target of even greater forces than Massa.I have two unauthorized biographies coming out against me in the spring, Beck said at one point. Minutes later, Beck went even further.Do you realize my family is at stake? he said.You've got a little scandal with your children in college. I've got one for all time now, because I am not going to resign. I'm not going to back down. I have come to a place where I believe at some point the system will destroy me.But Beck could not compete with the oddity of the sympathy card Massa kept pulling. He appeared frustrated that Massa wasn't revealing any more sinister plots afoot in the nation's capital, and he got visibly annoyed when Massa tried to take some measure of responsibility for his actions and attempted to walk back some of his more heated rhetoric against White House chief of staff Rahm Emanuel. And to make things worse, when Massa turned from discussing his own woes to the machinations of Washington, he offered ideas that have no place in Fox News's tightly regulated framework. Massa suggested that Beck and other Americans demand campaign finance reform to curb the corruption on Capitol Hill. Beck, who has called such proposals a huge mistake,put his hand over his mouth, as if he were holding back an upset stomach. Massa, who has opposed the Obama health reform because it is not liberal enough, told Beck that he should stop calling people names like socialist and communist.You can be a progressive and be a fiscal conservative,Massa then explained, as Beck lost control of his own program.

In the past Beck's opponents, as serious people who operate by the regular order of public debate, have played it straight and posed little challenge. When the White House came after him, he produced a bit of videotape that painted its communications director as an agent of Chairman Mao. (She wasn't.) When a liberal group, Color of Change, sparked an ad boycott of his show, he organized a public campaign that pressured the group's co-founder, Van Jones, to resign from government service. (He did.) Beck even battled Bill O'Reilly, the network's reigning king of self-importance, to a sort of schoolyard draw in regular sparring matches on their respective shows.But in Massa, Beck found a sort of liberal doppelgÄnger, a mesmerizing train wreck of a man who was impossible to undercut in the classic fashion. To many conservative allies of Beck, it probably didn't come as too much of a surprise. In recent days, prominent Republicans like Bill Kristol had expressly warned Beck and others about coming to Massa's defense just because he was alleging dirty tricks by the Obama White House.We shouldn't get into the business of being pro-Massa just because we are antihealth care,Kristol said Monday on Fox. The ruling talk-radio king, Rush Limbaugh, spent much of Tuesday making clear that he would not be tied to Massa, after spending much of Monday praising Massa's revelations about Democratic Party politics.Anybody who embraces this guy is in big trouble,Limbaugh said.The Massa controversy came as the Republicans have been grappling with the question of just how far to go in attacking Obama and Democrats. Many conservatives were critical of a cartoonish, ugly line of attack the Republican National Committee pushed in a campaign memo, and Liz Cheney was scolded for suggesting that lawyers who had represented terror detainees shouldn't be allowed to occupy high-ranking positions at the Justice Department.

But Beck, who thrives on publicity stunts and controversy, could not resist engaging with Massa. On Tuesday morning, during his radio show, Beck compared the Democrat to both a mobster wanting to testify against John Gotti and a potential Soviet spy wanting to cross over to our side.The conservative blogger Michelle Malkin called into the show to tell Beck he was making a mistake. This guy deserves 60 minutes of our time, really? Malkin asked. Beck would not budge. But as those 60 minutes came to an end Tuesday afternoon, the rabble-rouser seemed to recognize that he had fallen into a trap. The Beck big top has room for only one carnival barker at a time. I think I have wasted your time,Beck said, staring into the camera at an audience he once spent weeks telling about fanciful FEMA prison camps.I think this is the first time I have wasted an hour of your time.

World's top scientists to review climate panel By JOHN HEILPRIN and SETH BORENSTEIN, Associated Press Writers – MAR 10,10

UNITED NATIONS – At a tumultuous time in U.N.-led climate negotiations, one of the world's most credible scientific groups agreed Wednesday to plug the recent cracks in the authoritative reports of the United Nations' Nobel Prize-winning global warming panel.We enter this process with no preconceived conclusions, said Robbert Dijkgraaf, a Dutch mathematical physicist who co-chairs the group, the InterAcademy Council of 15 nations' national academies of science.U.N. Secretary-General Ban Ki-moon asserted there were a very small number of errors in the 3,000 pages of the beleaguered U.N. Intergovernmental Panel on Climate Change's last major synthesis of climate data in 2007.But those errors, which include projections of retreats in Himalayan glaciers, have put public confidence in the panel's work at risk, and have been seized on by climate skeptics opposed to the U.N.-led efforts to conclude a legal international agreement on global warming this year.The nonbinding Copenhagen accord brokered by President Barack Obama in the final hours of the December climate change summit in the Danish capital has the support of major polluters and ecomomies such as the U.S., China and India. But it fell well short of its original ambition of a legally binding treaty controlling the world's emissions of carbon dioxide and other gases blamed for global warming.

Dijkgraaf, told reporters that his Netherlands-based group, which agreed to the U.N.'s request to review the panel's work, will definitely not go over all the data, the vast amount of data in climate science,but will instead look at focus on how the panel does its job, in light of the unsettling errors that have surfaced recently.
The group will pick a panel of experts, no easy task since the bulk of climate experts already participate in the U.N. panel, and wrap up its independent review by the end of August, said Dijkgraaf, also president of the Royal Netherlands Academy of Arts and Sciences.Among the questions are whether the climate panel should use non-peer reviewed literature, how governments review IPCC material, and even how the IPCC communicates with the public.No errors surfaced in the earlier and most well-known of the reports, which said the physics of a warming atmosphere and rising seas is man-made and incontrovertible. But there have been several mistakes discovered in the second of the four climate research reports produced in 2007, mainly owing to the use of government reports or even advocacy group reports instead of peer-reviewed research.For example, in the Asian chapter, five errors in a single entry on glaciers in Himalayas say those glaciers would disappear by 2035 — hundreds of years earlier than other information suggests — with no research backing it up. A sentence in the chapter on Europe says 55 percent of the Netherlands is below sea level, when it's really about half that amount.

And a section in the Africa chapter that talks about northern African agriculture says climate change and normal variability could reduce crop yields. But it gets oversimplified in later summaries so that lower projected crop yields are blamed solely on climate change.Ban said the mistakes in the IPCC reports, found in recent months, don't undercut the broad consensus on global warning.Nothing that has been alleged or revealed in the media recently alters the fundamental scientific consensus on climate change,the secretary-general said.Nor does it diminish the unique importance of the IPCC's work.He did not respond to a question about how the errors might be affecting the U.N.-led negotiations.The errors have shaken the credibility of climate scientists and given skeptics of global warming ammunition.

Longtime climate skeptic John Christy of the University of Alabama said he wasn't familiar with the InterAcademy Council, but he cheered the outside review.I hope people like me have input, otherwise its just the usual members of the establishment defending to themselves what's been done,said Christy, a researcher.The review will involve a mix of outside experts and climate scientists who have worked with the IPCC before but are far enough removed to be truly independent,Dijkgraaf told The Associated Press in a telephone interview. The idea is to have expertise and insight into how IPCC works without including current leaders, he said. The full panel needs gravitas and I think scientific stature,Dijkgraaf said. The members of the panel haven't been chosen, but they likely will be 10 scientists. The evaluation group will be chosen when the InterAcademy's board meets on March 22, Dijkgraaf said. The InterAcademy has done science reviews before for the United Nations. The IPCC was formed in 1989 by the United Nations and the World Meteorological Organization to study global warming and its causes and effects. Prominent mainstream climate scientist Kevin Trenberth at the National Center for Atmospheric Research said climate science has become a political hot potato.He said the reviewers should not just look at the IPCC but the standards of its critics. CDC uses shopper-card data to trace salmonella By DAVID MERCER, Associated Press Writer – MAR 10,10

CHAMPAIGN, Ill. – As they scrambled recently to trace the source of a salmonella outbreak that has sickened hundreds around the country, investigators from the Centers for Disease Control and Prevention successfully used a new tool for the first time — the shopper cards that millions of Americans swipe every time they buy groceries.With permission from the patients, investigators followed the trail of grocery purchases to a Rhode Island company that makes salami, then zeroed in on the pepper used to season the meat.Never before had the CDC successfully mined the mountain of data that supermarket chains compile.It was really exciting. It was a break in the investigation for sure,CDC epidemiologist Casey Barton Behravesh said.

At least 245 people in 44 states have been sickened in the outbreak. That includes 30in California, 19 in Illinois, 18 in New York and 17 in Washington state.The victims included Raymond Cirimele, a 55-year-old Chicago man. He said no one asked for his shopper-card data, but he would have provided it if someone had.I don't have any secrets, so I'm not worried about it,he said.It's kind of like the whole airport security and all that. I'd rather fly on a safe plane.Shopper cards have been around for more than a decade, offering customers discounts in exchange for letting supermarkets track their buying habits. The cards are used to build customer loyalty and help stores market their products.The first case in this salmonella outbreak was reported last summer, and by November, CDC investigators were examining a multistate cluster of cases.Through interviews and questionnaires, investigators suspected some kind of Italian meat was the culprit, but people couldn't remember what brand they bought, Behravesh said.So the CDC asked supermarkets for certain buying information on seven victims in Washington state, focusing on suspect products rather than everything the customers had bought, Behravesh said. We didn't care about the brand of toilet paper people were buying,she said.Of those seven people, five had bought Italian meats made by the Rhode Island company, Danielle International Inc., Behravesh said.Further investigation — including the use of data from other victims' shopper cards — pointed to salami made by Danielle and, more specifically, the imported pepper it was coated in. That came from two spice suppliers in New York and New Jersey. All three companies have since recalled some products.The CDC would not say how many patients gave access to their accounts or were asked to do so, but Behravesh said most agreed.Most of the time when a person gets really sick with a food-borne pathogen, they're very happy to talk with us and try to help out with the investigation,she said.

Some privacy advocates, though, are troubled.Longtime shopper-card critic Katherine Albrecht, director of a group called Consumers Against Supermarket Privacy Invasion and Numbering, said she worries that the practice could lead to a switch from a voluntary system to mandatory use of such cards.That sends chills down my spine, she said. Some state and local health agencies have used shopper cards to trace cases of food poisoning. Before this outbreak, the CDC had tried it a few times, too, but without success, Behravesh said. Some supermarkets have also used shopper-card information to notify customers by letter or automated telephone call that a product they bought has been recalled. Health authorities trying to trace the source of a food-poisoning outbreak typically ask victims what they bought and what they ate. But without receipts or other hard evidence, they often find themselves at the mercy of people's memories. Several large supermarket chains did not respond to requests for comment on health investigators' use of shopper cards, but Costco — where Cirimele bought meat that was later recalled — said it provided data to the CDC once customers gave their OK. In this instance, we actually worked very closely with the CDC,said Christine Summers, the Issaquah, Wash., chain's director of food safety.They ask,Did this member purchase products A, B or C in this time frame? and we tell them, Yes, they did or No, they didn't.Supermarkets generally will supply information to health authorities if customers consent, said Jill Hollingsworth, vice president of food safety at the Food Marketing Institute, a trade group for groceries in the U.S.

Bruce Chassy, a food safety professor at the University of Illinois at Urbana-Champaign, said he is intrigued by the new means of tracing food-poisoning cases. He noted it can be extremely difficult to get to the bottom of outbreaks caused by relatively minor ingredients. Cantaloupes and eggs are easy, he said.The fact that it's only an ingredient in products in other things, that makes it really hard to track.J. Officials initially said more than 500 people, mostly women and children, were killed when members of the mainly Muslim Fulani ethnic group butchered their victims from the Christian Berom clan in three villages.But the state police commissioner Ikechukwu Aduba gave a breakdown of the list of people killed Wednesday and said the final toll was 109.This figure is authentic and undisputed, he said, adding that the larger figure quoted by other officials was fabricated. Aduba revealed that 49 people were to be charged with homicide and conspiracy and had already confessed to being on a revenge mission. Another 150 suspected Berom were arrested in Mangu town, 60 kilometres (40 miles) south of Jos for unlawful assembly and possession of firearms. They took the law into their own hands and mobilised to protect their communities against any possible attacks,Aduba said. Residents have said the killings on Sunday were part of a spiralling feud between the Fulani, who are nomadic herders, and Berom, who are farmers, which had been sparked by the theft of cattle. Meanwhile, Jang late Wednesday declared three days of fasting in the state to cry to God for forgiveness and peace. The fasting period begins on Thursday.

He always saw the woman in me and accepted me how I was, she said, "but we couldn't have sex in a complete way until now.Gonzalez can't get married, however, as she is still waiting for permission to change the name on her government ID card. Until then, she also cannot work in another wedding venue, though she would like to, or go back to school because her name no longer fits the woman she has become.

It's a problem that Cuban Olivia Lam knows all too well. She was born Alfonso Manuel but has been waiting for sex-change surgery for two years. While her name has not been changed, authorities allowed her to take a new picture for her ID card — one where she is dressed as a woman. The picture is me, even if the name is not, said Lam, a gregarious 43-year-old who waves her arms when she talks, making her ever-present hoop earrings dance on her earlobes. Both women say they think the delay in getting ID cards is because of the slow Cuban bureaucracy and not any kind of government resistance. Lam, who works as a hairdresser out of her two-room apartment, first began cross-dressing at 21. Though she has been formally classified as transsexual since 2008, she has no way of knowing when — or if — approval for sex-change surgery will come. And though the government now accepts her, Lam acknowledged that getting her own family to has not been easy. I don't think any parent wants their son to be different,she said,but they understand that you're not like this because you want to be.

Mozambique to evacuate 130,000 from flood plain

MAPUTO (AFP) – Around 130,000 people are to be evacuated in flood-prone Mozambique because of rising waters in three main rivers, state media said on Wednesday.

Government declared a red alert for regions along the mighty Zambezi River, Africa's fourth-longest which originates in Angola, as well as the smaller Pungwe and Buzi rivers, Noticias newspaper said.The red alert imposes an evacuation order for the area.Around 130,000 people were identified in areas of risk in three basins in the central region, namely the Zambezi, Pungwe and Buzi rivers, Noticias said.Our main concern right now is to save human lives. In any case, the situation is under control,said Joao Ribeiro, director general of the National Disaster Management Institute.Emergency centres have been created where tents, mosquito nets, medicine and food would be available.Seasonal rains across southern Africa send water levels rising every year around this time, especially on the Zambezi which brings to Mozambique run-off from a long swathe of the continent as it runs toward the Indian Ocean.Mozambique is a frequent victim of flooding during its rainy season. Deadly floods in 2000 and 2007 forced tens of thousands from their homes.So far two flood deaths have been reported this year.

TORONTO (Reuters) – The Canadian dollar hit its highest level in almost five months against the U.S. dollar on Wednesday, helped by firm oil prices, the prospect of rising Canadian rates and speculation it will return to parity with the greenback.
The currency reached as high as C$1.0216 to the U.S. dollar, or 97.89 U.S. cents, but quickly retreated as oil prices turned lower. Oil, which held above $81 a barrel, headed lower around noon.The euro was also volatile, traders said, which contributed to the Canadian dollar's hasty retreat.At 12:47 p.m. (1747 GMT), the Canadian dollar was at C$1.0260 to the U.S. dollar, or 97.47 U.S. cents, compared with C$1.0264 to the U.S. dollar, or 97.43 U.S. cents, at Tuesday's close.While the currency poked through the C$1.0225 level, its highest since October, the challenge remains whether the unit closes around these levels to signal a sustained move.

Market players are next eyeing the C$1.0207 level, the highest level reached in October, and could set up the currency for a run toward parity with the greenback.It would be more bullish for Canada if we got a close below C$1.0225, but just the fact that we got a lower low (in U.S. dollar terms) today is bullish, said David Bradley, director of foreign exchange trading at Scotia Capital.It's still our view that we are going to see this below parity by the end of the year. I think it's going to be a slow grind. SEOUL, South Korea – North Korea has recently created an army division in charge of newly developed intermediate-range missiles capable of striking U.S. forces in Japan and Guam, a South Korean news agency said Tuesday.The report came as North Korea stepped up its war rhetoric against the U.S. and South Korea after the allies started their annual drills aimed at improving their defense capabilities.The North's People's Army recently launched a division supervising operational deployment of missiles with a range of more than 1,860 miles (3,000 kilometers) that it had developed in recent years, Yonhap news agency reported, citing an unidentified South Korean government source.The missiles could pose a threat to U.S. forces in Japan, Guam and other Pacific areas where they would be redeployed in time of emergency on the Korean peninsula, Yonhap said.The report, however, didn't provide further details such as how many missiles the new division possesses and where they are positioned.South Korea's Defense Ministry said Tuesday it couldn't confirm the Yonhap report. However, a ministry document published last year showed that the North deployed a new type of medium-range missile believed to be the same as one it displayed during a military parade in 2007.

If confirmed, the division's launch could suggest that the North has succeeded in developing more medium-range missiles since 2007 and it needed a bigger unit to manage them, said Ohm Tae-am of the state-run Korea Institute for Defense Analyses in Seoul.The division's creation would also mean the North has a unit whose primary role is to prevent the U.S. from redeploying its troops in the Pacific to the Korean peninsula in the event of a conflict, said Baek Seung-joo of the same institute.North Korea's missile program and nuclear weapons development program are major regional security concerns.The North conducted a long-range rocket test in April in violation of a U.N. Security Council resolution that prohibits the country from engaging in any ballistic missile-related activities. MEPs demand more transparency on Acta talks

MEPs have called on the European Commission to increase transparency around ongoing negotiations for an Anti-Counterfeiting Trade Agreement (Acta), or risk legal action in the European Court of Justice. The parliamentary resolution, passed by 663 to 13 votes in favour in Strasbourg on Wednesday (10 March), also calls on the commission to refuse to support internet cut-off as a penalty for online copyright infringement.
In the statement, Euro deputies demanded to be fully informed at all stages of the negotiations,and asked the commission to "conduct an impact assessment of the implementation of Acta with regard to fundamental rights and data protection.With talks launched in 2008 and due to be completed this year, Acta supporters say the multilateral agreement is a necessary measure to combat the growing trade in counterfeited goods and piracy.Critics point to the highly secretive nature of the talks and say participant governments are engaging in what has come to be known as 'policy-laundering' - agreeing to tough laws through the international treaty process that otherwise would prove too politically unpopular to pass in national assemblies.

This parliament will not sit back silently while the fundamental rights of millions of citizens are being negotiated away behind closed doors, said the vice-president of the European Parliament, Greek centre-left MEP Stavros Lambrinidis.We oppose any 'legislation laundering' on an international level of what would be very difficult to get through most national legislatures or the European Parliament,he added. Public suspicions that civil liberties could be breached by the potentially far-reaching agreement, that aims to enforce international standards for intellectual property rights, have been nurtured by a steady stream of media leaks about the ongoing negotiations.Last month, the European Data Protection Supervisor (EDPS), Peter Hustinx, raised fears that the Acta legal framework could result in large scale monitoring of internet users and the international imposition of 'three strikes' laws, such as that recently passed in France, which cuts off internet access of people accused of illegal downloading.Speaking in parliament on Tuesday, trade commissioner Karel de Gucht tried to reassure MEPs by saying he understands their concerns and is doing his best to remedy them. The Belgian politician is keenly aware that under the EU's new rulebook - the Lisbon Treaty - parliament now has to give its approval to the final agreement, adding substantially more weight to the resolution's requests. Euro deputies made it clear however that they are not against Acta per se. Christian Engstrom, the Swedish Pirate Party MEP, said in his latest blog post that parliament wants the agreement to be about combating goods counterfeiting (i.e., fake Rolexes and hand bags etc). It should not be about restricting our fundamental civil liberties.The next round of Acta talks are due to take place next month. The participants are the USA, the EU, Switzerland and Japan, Australia, Canada, Jordan, Mexico, Morocco, New Zealand, Republic of Korea, Singapore and United Arab Emirates.China, the main sources of the world's counterfeit goods, is not involved.

Majority of Brussels lobby firms avoid registry

EUOBSERVER / BRUSSELS - Over 60 percent of Brussels-based lobbying consultancies have yet to sign up to the European Commission's lobby register, almost two years after it was first launched.According to a fresh survey of the commission's initiative by the Alliance for Lobbying Transparency and Ethics Regulation (Alter-EU) to be published on Thursday (11 March), of the 286 lobbying consultancies known to provide such services in the European capital, only 112, or 39.2 percent have signed up to the registry.Frustrated with the various definitions of who is and who is not a lobbyist, Alter-EU restricted themselves to investigating just those firms which are explicitly lobbyist outfits, excluding from their survey trade associations, think tanks, law firms and individuals.Among their number, which range from big multinational players down to the more boutique-type outfits, are Grayling, the Brunswick Group, Cabinet DN and FD Blueprint. These consultancies mainly work on behalf of other large firms and industry umbrella groups, promoting such parties' interests in EU policy making.At the same time, of the 174 consultancies missing from the commission's register, 104 do have lobbyists accredited at the European Parliament, meaning that their staff have access badges to the parliament buildings.

Companies have no shortage of tricks to pursue their clients' interests in the EU capital while avoiding the spotlight.You can hire a PR firm, which in turn hires a law firm to do the work in Brussels and you stay off the radar, one executive at a leading Brussels-based PR firm said. Erik Wesselius, a spokesman for the pro-transparency NGO - which itself lobbies, but on the issue of lobbying itself - said: [These] lobby firms active in Brussels do not bother to register and are not transparent about their lobbying activities. Genuine transparency can only be secured when registration becomes de facto mandatory, by linking physical access to disclosure requirements.The commission's register is voluntary, although the European Parliament passed a resolution in May 2008 that called for a mandatory register of all actors lobbying the EU institutions.A commission-parliament committee working to construct a joint register for the two institutions is expected to resume talks later this month.In a recent newspaper opinion piece, British Liberal MEP Diane Wallis, who has been actively involved with the register process, suggested MEPs should politely decline meeting lobbyists who do not register.

He went on to say that it was as curious as the appointment of the unqualified Catherine Ashton to be the EU's foreign policy chief: But an EU Arctic policy is perhaps not so bizarre as the appointment of the supremely unqualified Baroness Ashton, the Sarah Palin of the ex-student left, as High Representative. At the hearings it was clear that the High Representative has forgotten nothing and has learnt nothing.The chair of the debate, Liberal MEP Diana Wallis, cut him off in mid-speech.I am sorry but I don't think we should listen to personal comments like that in chamber. We will not have personal comments of that nature, she said.Lord Dartmouth later said he would be writing to European Parliament president Jerzy Buzek to complain about the incident.Ukip has always said that this is not a proper parliament as it is wholly intolerant of dissent. Today's events have proved that,he said.British media reported that he had been asked to leave the chamber by Ms Wallis, but the MEP denied asking for him to be removed, although she added it was getting to that stage.Parliamentary ushers moved to escort him from the chamber after he reacted angrily to having his microphone cut off.

Ms Wallis also said his freedom of speech rights had not been breached.We absolutely have free speech in the parliament. He could have said everything and anything he liked about the Arctic. But personal insults are just not appropriate.The incident, which a UKip spokesperson called preposterous, marks the second time that a Ukip euro-deputy has gone beyond the bounds of what parliament authorities consider appropriate discourse in its chamber.Two weeks ago Nigel Farage caused anger when he insulted EU president Herman Van Rompuy by saying he had the charisma of a damp rag and the appearance of a low-grade bank clerk.He was later fined €3,000 for refusing to apologise. At the time Mr Buzek said he would defend free speech but not personal insults. The parliament's internal rules say:Members' conduct shall be characterised by mutual respect ...[and] respect the dignity of parliament.The widely-reported incident gave Mr Farage a moment of fame in the UK, ultimately securing him a place on two flagship news programmes on the BBC.However, Mr Van Rompuy says he also benefitted from the exchange.
