The US Supreme Court decision Monday not to register US citizens who were born in Jerusalem as having been born in Israel could have future ramifications for other matters involving Israel, according to Attorney Nitzana Darshan-Leitner, head of lawfare NGO Shurat Hadin.Besides the matter decided by the court, the central political issue at hand, Darshan-Leitner told Arutz Sheva Tuesday, is who decides things when it comes to foreign affairs – Congress or the State Department. “There is always tension between the legislative and executive branches,” she explained, “and in this case, the State Department was victorious.”"This question could come up in other matters, such as American financing for the Palestinian Authority, which currently stands at about 600 million dollars,” she opined. "Congress decided to limit the transfer of funds to the PA from the State Department, so that may only be transferred if there is certainty that they do not go toward terrorism. The State Department has been ignoring Congress, and when the matter reaches the courts, there will again be a debate over who decides foreign policy, the legislators or the State Department.” As for the court's decision itself, Darshan-Leitner said that it truly damages every single Israeli person: “This is a disappointment. WASHINGTON (AP) — Siding with the White House in a foreign-policy power struggle with Congress, the Supreme Court ruled Monday that Americans born in the disputed city of Jerusalem can't list Israel as their birthplace on passports.In a 6-3 ruling, the court said Congress overstepped its bounds when it approved the passport law in 2002. The case mixed a dispute between Congress and the president with the thorny politics of the volatile Middle East.The ruling ended a 12-year-old lawsuit by a Jerusalem-born American, Menachem Zivotofsky, and his U.S.-citizen parents.The law the court struck down Monday would have forced the State Department to alter its long-standing policy of not listing Israel as the birthplace for Jerusalem-born Americans. The policy is part of the government's refusal to recognize any nation's sovereignty over Jerusalem until Israelis and Palestinians resolve its status through negotiations.Justice Anthony Kennedy said in his majority opinion that the president has the exclusive power to recognize foreign nations, and that determining what a passport says is part of that power."Put simply, the nation must have a single policy regarding which governments are legitimate in the eyes of the United States and which are not," Kennedy wrote. "Recognition is a topic on which the nation must speak with one voice. That voice must be the president's."Justice Antonin Scalia challenged Kennedy's analysis in a vigorous dissent that Scalia summarized from the bench. "Who says so?" Scalia said. In a move that is becoming all too typical of the U.S. President Barack Obama and his policies towards Israel the President enacted a waiver, preventing the move of the United States Embassy to Jerusalem for at least another six months.The move which goes against Congressional legislation mandating that the US moves its embassy to Israel’s capital, successive administrations going all the way back to the Clinton regime, have postponed the implementation of the legislation. Each by citing “National Security concerns”. Thus the past three presidents, spanning more than 16 years, have continuously pushed off this piece of legislature. Jerusalem is not recognized internationally as the capital of Israel, even after the annexation of the eastern half of the city. Today, no country houses their embassy in the capital. Up until 2006 there were countries who did, however the last two, Costa Rica and El Salvador, moved their embassies to Tel Aviv in 2006.Do you agree the Jewish people have a Biblical right to Jerusalem? The US Supreme Court decision Monday not to register US citizens who were born in Jerusalem as having been born in Israel could have future ramifications for other matters involving Israel, according to Attorney Nitzana Darshan-Leitner, head of lawfare NGO Shurat Hadin.Besides the matter decided by the court, the central political issue at hand, Darshan-Leitner told Arutz Sheva Tuesday, is who decides things when it comes to foreign affairs – Congress or the State Department. “There is always tension between the legislative and executive branches,” she explained, “and in this case, the State Department was victorious.”"This question could come up in other matters, such as American financing for the Palestinian Authority, which currently stands at about 600 million dollars,” she opined. "Congress decided to limit the transfer of funds to the PA from the State Department, so that may only be transferred if there is certainty that they do not go toward terrorism. The State Department has been ignoring Congress, and when the matter reaches the courts, there will again be a debate over who decides foreign policy, the legislators or the State Department.” As for the court's decision itself, Darshan-Leitner said that it truly damages every single Israeli person: “This is a disappointment. While it is true that this is a decision that relates to the internal regime in the US, and which delimits the boundaries of the executive branch's discretion, and who decides foreign policy, one cannot ignore the actual decision, which de facto does not recognize Jerusalem as the capital of Israel – and this is a real kick in the face of every Israeli citizen, that such a great friend of Israel's does not recognize its rights.”Arutz Sheva notes that all three Jewish justices - Stephen G. Three are Jewish."The trial was held for many years, and we had a real hope that it would end differently," Ari told Arutz Sheva."We expected the courts in the United States to be about more than politics," he fired. "Perhaps the result shows that that assumption is not correct, but we thought that the legal system is unrelated to the political system [there]."Does he believe that the issue can be resolved in the near future? Israel has been fighting the Iran nuclear deal due to the great danger it poses, but senior Western officials have revealed it is also doing so because once a deal is reached, the European Union (EU) and UN are planning a diplomatic offensive targeting the Jewish state.The political assault is meant to force Israel into returning to yet more peace talks with the Palestinian Authority (PA) and making dangerous concessions in the process - and reportedly the EU already has a list of sanctions ready to force Israel to bend.A senior Western diplomat told Ma'ariv in a report published Tuesday that "a diplomatic attack against Israel is expected soon that will surprise even the pessimists in Jerusalem.""In the (UN) Security Council, in western capitals and at EU headquarters, they are just waiting for the Iran deal to be signed and for it to be approved by the American Congress," warned the diplomatic source.It appears that the waiting period will likely expire in September, at which time a UN General Assembly will open in tandem with the first shots of the diplomatic barrage against Israel.Diplomatic sources familiar with Western European positions vis-a-vis Israel said the EU already has a list ready, itemizing sanctions against Israel in the fields of trade, agriculture, science and culture.That list is to be translated into an economic assault - unless Israel presents a new set of concessions it is willing to make for a new round of peace talks, after the last set of talks was torpedoed by the PA signing a unity deal with the Hamas terrorist organization."Senior officials in Jerusalem are aware of the existence of sanctions documents at EU headquarters, some of which have even fallen into their hands," one diplomatic source revealed to Ma'ariv.The source added that US President Barack Obama's threat made in an Israeli interview this month, according to which he may cut US support for Israel at the UN, specifically was referring to "the sanctions file" against Israel which is currently biding its time at the EU headquarters.The US is reportedly weighing its responses, as the current Israeli government does not appear to be likely to launch a new series of peace talks after the massive failure of the last round, and the PA's unilateral moves in the international arena in breach of the 1993 Oslo Accords that founded it."The make-up of the government is such that no faction or minister will stand up to the lack of an initiative from Prime Minister (Binyamin) Netanyahu," a diplomat from New York told Ma'ariv. "The coming months will be difficult for Israel. This time Israel will pay a heavy price for continued stagnation. This time, it is also uncertain if Uncle Sam will succeed in saving Israel, and maybe he won't want to do so."
