Tax havens give EU commissioner the runaround

BRUSSELS - The EU commissioner trying to stop tax cheats from hiding money in Switzerland is puzzled why Austria and Luxembourg are standing in his way.Algirdas Semeta told EUobserver that bank secrecy makes it impossible to say how much potential tax income is being lost even as EU countries cut wages and public services amid the financial crisis. But it is likely to be big bucks: Switzerland currently hands over €330 million a year in tax payments to EU countries, while its banks manage €1.5 trillion of private wealth.If it goes through, Semeta's bill - the so-called amended savings tax directive - would dynamite the status quo.It would expand the definition of interest payments, making it hard to hide behind complex financial products. It would bring in a paying agent upon receipt rule, obliging trust funds and other shady structures to say who really owns what. And it would lead to automatic exchange of information on how much people have stashed away in Switzerland, as well as Andorra, Liechtenstein and San Marino.So far, Austria and Luxembourg have stopped the Danish EU presidency from holding talks on the law.They declined to tell EUobserver why. They tell Semeta it is because other EU countries - including Germany, Greece and the UK - are working on bilateral tax deals with Switzerland which are softer than the EU bill and which would make Swiss banks more competitive than Austrian and Luxembourgish ones in terms of hiding loot.
Semeta says Germany and the UK have promised him to change the bilateral pacts in order to tackle the problem.He believes the real reason is linked to the long history and traditions of banking secrecy in Austria and Luxembourg.Taking into account the current economic situation it is very timely to find an additional source of revenue ... For instance, there are significant amounts of [Greek] savings which are put in Swiss banks and Greece deserves to collect those taxes. Sometimes, I do not understand why we were unable to reach this agreement already at the beginning of the crisis,he said.It remains to be seen if Germany and the UK will live up to their word, however.Their finance ministries declined to give details of what they are actually changing in their Swiss pacts. Martin Kotthaus, a German spokesman said only that it concerns a a rather technical provision - a comment which does not sound like the large-scale carving out of softeners spoken of by Semeta.Germany has also asked the Danish EU presidency not to start talks on Semeta's bill just yet.It says the German parliament should first ratify the tweaked version of its Swiss deal in order to give confidence to Austria and Luxembourg - a continuation of the merry-go-round in which EU countries blame each other for delays.
Meanwhile, when Denmark in July hands over the EU chairmanship to Cyprus, the dossier will fall into the lap of a country which is itself a tax haven, as well as a favoured destination for money launderers.

For its part, Switzerland - which will also have to get on board if Semeta's law is to have any meaning and which risks losing business to the Bahamas, Hong Kong and Singapore - is not making encouraging noises.Mario Tour, a spokesman for the Swiss finance ministry, told this website: We do not want to have undeclared or criminal money in Switzerland.But when asked why it drew up the loophole-riddled bilateral pacts with Germany and the UK in the first place, he said: We think they're quite an effective way to tax outside income.When asked what he thinks about automatic exchange of information, he answered: It gives you so much data that it is difficult to handle. With such an amount of data, it's difficult to find people who don't pay their taxes ... We want to deliver tax money, not data.Tour noted that people do not believe him when he says Switzerland will expose cheats by itself.That's one of our difficulties - to prove that we really mean it. People say: The Swiss have always been cheats, so this is just a drive to hide money.Maybe it's understandable. But we will put [our promises] into force,he added.

BRUSSELS - The European Commission outlined a new set of rules on Monday (12 March) that could make it easier for law enforcement to freeze and confiscate criminal assets.In a Europe caught in the grips of tough austerity measures and an economic crisis, crime and its payouts are soaring.Drugs, prostitution, small arms smuggling and all sorts of illicit activities generate hundreds of billions of euros every year. Drugs alone put an estimated €100 billion per year into the pockets of criminals.We need to hit criminals where it hurts, by going after the money, and we have to get their profits back in to the legal economy, especially in these times of crisis, said EU home affairs commissioner Cecilia Malmstrom.Extraordinarily wealthy criminals disperse their assets overseas or across Europe. Mansions, fast cars, hotels, restaurants and some businesses belong to a world that has so far proven elusive for national authorities and the police to clamp down on.The United Kingdom was only able to seize £125 million of criminal revenue, out of an estimated £15 billion generated in 2006. Germany managed to take back €113 million in 2009, out of some €903 million.The wealth and the profit margins far outweigh the risks for many of Europe’s criminal organisations. Profits generated by mafia families in Italy and their assets are thought to run to €150 billion each year.
Malmstrom says the crime robs Europe of valuable tax revenues that could be used to invest in education and health care.We need to find those who drain our common resources. That means following the money trail to the criminals with the same determination all across Europe making sure there is no safe-haven for organized crime, she says.Crime affects economic growth by distorting markets and shutting out legal investments. Dirty money is reinvested in legal activities that distort competition with legitimate businesses already struggling to survive in a slowing economy.The commission’s proposals for a directive aim to simplify existing rules and close the gaps currently exploited by criminals.For example, criminals may have assets not directly linked to a crime but which clearly resulted from criminal activities. Others transfer assets to someone not involved in the crime.In other cases, assets are difficult to seize if the criminal in question is deceased. But in 2010, the Italian authorities managed to confiscate 136 apartments, 11 warehouses, 75 land estates, eight shops, two villas, and 51 garages from a single businessman who had died from unknown causes.The police suspected he was directly involved with the mafia. Altogether, his assets totaled around €700 million. His family was unable to explain how he had obtained the property.Under the Commission's proposals, all such activities and practices would be curtailed. Member states would also be required to manage frozen or confiscated assets so they do not lose economic value. They would also have to regularly collect data on confiscation and asset recovery.
Spain gets controversial let-off on budget deficit

BRUSSELS - Eurozone finance ministers on Monday (12 March) agreed to a looser deficit target for Spain this year, but insisted that the fourth largest euro economy gets back on track by 2013, a first test for eurozone's tougher budget rules.
Entering the meeting I did not expect a decision on the 2012 budget for Spain, but now we have a common decision that the front-loaded effort this year should be of 0.5 percent of GDP, Eurogroup chief Jean-Claude Juncker said during a press conference at the end of the eurozone finance ministers' meeting.The figure is an important concession for the Spanish government, who earlier this month announced it would overshoot an agreed deficit target (4.4%) by 1.4 percent of GDP this year.
Unpredicted recession and unemployment above 20 percent, as well as a higher deficit unveiled after the previous government left office in 2011 were all used as justification by Spanish finance minister Luis de Guindos - who first had a one-on-one meeting with the German finance chief.We took some time with the Spanish minister to talk face to face about the budget situation. Spain made big progress, markets have acknowledged that. It is still on a tough road, but it is the right one,German minister Wolfgang Schauble said Monday as he went into the meeting with De Guindos.Some seven hours later, all 17 eurozone ministers agreed that Spain could be given a laxer deficit target this year, provided it returns to the three-percent deficit rule in 2013.We are highly concerned by the high unemployment and increasing poverty, but we agreed Spain will stick to the 3 percent target in 2013, which is more important than the avenues chosen in 2012, Juncker explained.Economics commissioner Olli Rehn also sought to pre-empt accusations that the EU's tougher budget rules - in place since December - are being softened for a large country while Hungary, in similar deficit trouble, is set to be sanctioned.The stability and growth pact is not stupid, it focuses on structural sustainability of public finances, Rehn said during the press conference alluding to Hungarian Prime Minister Viktor Orban's comments about the possible aid freeze being stupid.Rehn explained that Hungary was meant to bring its budget back on track by 2011, while Spain's deadline is 2013.It is crucial that Spain has committed itself to meet the three-percent target next year. There was a large slippage last year, which is very regrettable and which has had a weight on this year's budget consolidation efforts, Rehn added.

BRUSSELS - Finance ministers are on Tuesday expected to approve the freezing of €495 million in funds for Hungary if Budapest fails to bring down its deficit in the coming six months. - the first such move under the EU's strengthened budget rules.A large majority of member states is said to favour the two formal proposals: One giving Hungary a six-month deadline for sufficient corrective measures slashing budget spending by 0.5 percent of the country's gross domestic product, the other setting a funding freeze from 1 January 2013 if the deadline is not met.According to a commission draft proposal tabled to finance ministers on 6 March and seen by this website, the Hungarian authorities should put an end to the present excessive deficit situation by 2012. The paper sets 13 September as a deadline to take effective action and to specify the measures that will be necessary to progress towards ensuring a durable correction of the excessive deficit.If Budapest's actions are not deemed sustainable enough or if the deadline is not met, Hungary will be the first EU country to be sanctioned for excessive deficits under the strengthened budgetary discipline rules capping deficits at three percent of GDP.Official figures show that Budapest is running a budget surplus this year, but the commission has deemed that one-off measures, such as the nationalisation of a private pension fund, are not enough to keep the deficit down. According to the latest Eurobarometer, seen by MTI news agency on Sunday, two-thirds of Hungarians did not travel for their holidays last year due to financial restraints.

A new paper to be published in Ethics, Policy & Environment argues that serious consideration should be given to mass drugging the population to make them more environmentally conscious while also proposing that babies should be genetically engineered to be smaller in order to reduce their carbon footprints.In an interview with The Atlantic the lead author of the paper, New York University bioethics professor S. Matthew Liao, argues that humans need to be be subjected to biomedical modifications in order to help combat climate change.Followed to their logical conclusion, Liao’s proposals outstrip anything Aldous Huxley wrote about in Brave New World, a 1932 dystopian novel about a future scientific dictatorship that seeks to drug, genetically manipulate, and medically induce humanity into complete slavish subservience.Expressing regret that carbon taxes will do nothing to reduce carbon emissions, Liao suggests other methods, including pharmacologically induced meat intolerance where people would take drugs which would trigger extreme nausea or wear patches that would “stimulate the immune system to reject common bovine proteins.
In order to reduce an individual’s carbon footprint and make sure they consume less, Liao suggests that a policy similar but more flexible to China’s one child policy be introduced, where parents can choose between having one large child, two medium sized children or three small children.This would be accomplished by preimplantation genetic diagnosis, where embryos would be implanted based on height, or by using drugs that reduce or increase the expression of paternal or maternal genes in order to affect birth height.Asked if genetic manipulation of babies is ethical or fair, Liao responds by citing the need to address climate change as the more pressing moral concern.Liao subsequently suggests that drugging the public could positively influence their will to donate money to charities like Oxfam, which support the global warming agenda, by means of pharmacological enhancement of empathy and altruism.For example, I might know that I ought to send a check to Oxfam, but because of a weakness of will I might never write that check. But if we increase my empathetic capacities with drugs, then maybe I might overcome my weakness of will and write that check, says Liao.Of course, by the same token drugs could be used to make someone more inclined to do anything. The foundation of the international food industry, monopolized by large corporations that hold zero regard for your health, is cracking. As more and more individuals begin to realize that they are eating their way to disease through the consumption of these products, they become outraged at the companies peddling their latest toxic food product. The result? Companies are now being forced to either answer to the consumer demands (removing the toxic substances from the food supply and adapting legitimate environmental manufacturing practices) , or lose their customers.Increasingly, we see this happening on a larger scale. Major companies like Campbell’s have begun abandoning bisphenol A (BPA), the cancer-linked chemical found in can linings and plastic containers. The change comes after even the FDA was forced to re-evaluate the safety of BPA, potentially issuing a ban by the end of this month. Linked to cancer, diabetes, and much more, consumers have become fully aware of the dangers that BPA presents — and they aren’t handing over their hard-earned dollars to companies that refuse to remove BPA from their products.
On a larger scale, corporations are also being forced to remove high-fructose corn syrup. Well known for its health effects even throughout the general public, not only does high-fructose corn syrup breed obesity and cancer, but it is even known to contain mercury. Consumers are now refusing to eat anything that contains this ingredient, and for good reason. Even Michelle Obama has gone public in stating that she refuses to feed her own children products that contain high-fructose corn syrup. It is due to this that food titans like Sara Lee and Kraft have begun removing the ingredient from their products to avoid losing a large number of sales.Activism and education is making legitimate changes in the way that the world eats and thinks.
While it is a major victory that these companies are phasing out these ingredients, it is only the beginning of the mass rejuvination of the food supply that needs to take place in order for consumers to experience optimum health. BPA and high-fructose corn syrup alone are creating biological devastation, but what about aspartame, MSG, genetically modified ingredients, trans fat, and other harmful additives? These harmful substances can be removed as well; it simply requires the same activism and education that is resulting in the removal of BPA and high-fructose corn syrup.Spread the word. It will not only change the health of your close friends and family, but the entire globe. Removing just a few toxic ingredients can prevent countless unnecessary deaths as a result of disease development.

The Department of Justice will ask a federal court to uphold the secrecy that surrounds the working relationship between Google and the National Security Agency in a hearing that is scheduled for next week.Privacy watchdog group The Electronic Privacy Information Center (EPIC) is returning to court once again in an effort to disclose more information regarding the widely publicized partnership between the spy agency and the search engine giant.EPIC is suing to obtain documents that detail the relationship, and will appeal against the NSA’s so-called Glomar response, claiming it could neither confirm nor deny the existence of any information about its relations with Google, because such a response would reveal information about NSA’s functions and activities.The NSA’s response stated that the agency works with a broad range of commercial partners and research associations in order to oversee the security of important information systems, but did not provide any further detail.The issue rose to prominencein January 2010 following a highly sophisticated and targeted cyber attack on the corporate infrastructure of Google and some twenty other large US companies.The attack was blamed on the Chinese government, prompting Google to embrace a collaboration with the federal agency in charge of global electronic surveillance.Anonymous sources informed The Washington Post at the time that the alliance is being designed to allow the two organizations to share critical information, adding that the agreement will not allow the NSA access to users’ search details or e-mails.
The DOJ is backing NSA’s Glomar response, as The Legal Times reports:DOJ’s legal team said that acknowledging whether NSA and Google formed a partnership from a cyber attack would illuminate whether the government considered the alleged attack to be of consequence for critical U.S. government information systems.DOJ said media reports about the alleged Google partnership with NSA do not constitute official acknowledgement.If NSA determines that certain security vulnerabilities or malicious attacks pose a threat to U.S. government information systems, NSA may take action, DOJ Civil Division lawyers wrote in a brief.In its own opening brief, EPIC argues that records the NSA holds on the subject are not exempt from public disclosure under FOIA request.Communications from Google to the NSA do not implicate the agency’s functions and activities, and are therefore not exempt from disclosure. the brief states.Further, some records responsive to EPIC’s FOIA Request concern NSA activities that may fall outside the scope of the agency’s authority. Google’s partnership with the intelligence network is not new. As we reported in late 2006, An ex-CIA agent Robert David Steele has claimed sources told him that CIA seed money helped get the company off the ground.Speaking to the Alex Jones Show, Steele elaborated on previous revelations by making it known that the CIA helped bankroll Google at its very inception. Egypt has brokered a ceasefire between Israel and the Gaza-based terror groups. The ceasefire has gone into effect as of 1:00 a.m. (Israel time) Monday morning, according to a report on Kol Yisrael radio. Similar reports on Saturday and Sunday night turned out to be false.The ceasefire comes following four days in which more than 200 rockets and missiles were fired from Gaza into southern Israel. The rocket fire was met with Israeli airstrikes against terror targets in Gaza.Earlier on Monday evening Kol Yisrael cited the Al-Arabiya television network in reporting that the terror organizations have reached an agreement regarding a ceasefire. However, at that time there were no further details nor was there a confirmation by other sources. BRUSSELS - Finland's foreign minister has said EU countries are more divided on foreign policy now than before the Lisbon Treaty came along.Erkki Tuomioja made the remarks after informal talks with his EU counterparts in Copenhagen on Friday (9 March) and Saturday.The real problem is with member states and their willingness to work together - this should be a basic pre-condition when we start a discussion on this or that subject, there should be no red lines ... [But] the commitment to this is actually less than it was five years ago. The Lisbon Treaty has given us a new instrument, but this is a matter of political will, he told EUobserver by phone from the Danish capital.He gave as an example the UK's opposition to opening a joint command centre in Brussels for EU military operations. The UK is reluctant to go ahead with this but everybody else wants to, so we should move forward,he noted.The Lisbon Treaty in 2009 called for the creation of the European External Action Service (EEAS) and a new EU foreign policy chief, a post later filled by British politician Catherine Ashton.Tuomioja said nobody criticised Ashton at the Copenhagen event despite ups and downs in her first two years in the job. Euro ministers to approve 2nd Greek bail-out

BRUSSELS - Eurozone finance ministers are meeting in Brussels on Monday (12 March) to give their final approval to the second Greek bail-out. But Spain's deficit problem is likely to weigh heavily on the talks.In a conference last Friday, the so-called Eurogroup ministers approved the release of around half of the €130 billion bail-out, which is to help fund a massive bond-swap between Greece and private debt-holders.The private sector involvement was deemed successful as over 85 percent of private and state-owned banks, investment funds and pension funds agreed to change their old Greek bonds for new ones at a net loss of over 70 percent.By triggering collective action clauses on reluctant bondholders, Athens forced an even higher participation rate of over 95 percent. The move was deemed a credit event by finance associations, meaning that default insurances to the tune of €2.4 billion have now to be paid out and ratings agencies have placed Greece in restricted default territory - just one notch higher than outright bankruptcy.Indicating that the forced losses were part of the plan, Eurogroup chief Jean-Claude Juncker said the necessary conditions are in place for the final approval on the bail-out, however. He also said the Washington-based International Monetary Fund (IMF) would contribute substantially to the new rescue package.The IMF is expected to put some €28 billion on the table, its chief Christine Lagarde indicated on Friday, with a final approval by the lender's board due on Wednesday. Some €10 billion of it is not fresh money, however, but is to be rolled over from Greece's first bail-out, agreed in 2010 and as yet not paid out in full.
With general elections later this month and with voters angered by the harsh austerity measures linked to the bail-outs, Greece's troubles are unlikely to be over.EU economics commissioner Olli Rehn last week called the second bail-out a unique opportunity not to be missed and said he now expects Greek authorities to maintain their strong commitment to the economic adjustment programme and to rigorously and timely implement the policy package.Similar warnings came from IMF chief Lagarde. Restoring competitiveness and a sustainable fiscal position will require Greece to undertake sustained and deep structural reforms over a prolonged period,she said.In a report presented to the Eurogroup last week, her staff warned that failure to stick to the agreed targets would put up financing costs for Athens by another €15 billion. Meanwhile, the possibility for a third Greek bail-out has not been ruled out by either German finance minister Wolfgang Schauble or by Eurogroup chief Juncker.The latest data released on Friday showed the Greek economy shrank by a worse-than-expected 7.5 percent in the fourth quarter of 2011. Overall, the Greek economy contracted by 6.9 percent last year, instead of the 5.5 percent projections eurozone financiers had counted on.Lagarde, a former French finance minister, also urged her ex-colleagues to boost the eurozone's bail-out funds - a move so far resisted by Germany. The most likely scenario for the Eurogroup to approve - but not on Monday - is for the €250 billion left over from the temporary European Financial Stability Facility to be added rather than subtracted from the €500-billion-strong permanent European Stability Facility due to come into force in July.
Spanish troubles
Ministers on Monday are also expected to look at Spain's worsening economic figures - the first major test for the EU's strengthened deficit rules.Just minutes after signing a German-inspired treaty on fiscal discipline, Prime Minister Mariano Rajoy earlier this month announced that his country would not be able to cut its public deficit to 4.4 percent of gross domestic product as agreed with the EU commission, but would aim for 5.8 percent instead.High unemployment rates and recession make it difficult for the newly elected Prime Minister to stick to targets drawn up last year, when the economy was still expected to grow. The EU commission has sent experts to Madrid to look at the latest macro-economic data and compare it with the deficit targets, before ruling if Spain needs to pay fines or if it can agree to extra leeway.The Netherlands has also announced it will overshoot its deficit targets but has indicated that, unlike Madrid, it will not seek flexibility.
Sarkozy threatens to end EU passport-free travel

BRUSSELS - French President Nicolas Sarkozy has threatened to pull France out of the EU's borderless Schengen agreement unless action is taken to reduce the number of illegal immigrants.Speaking at an election rally on Sunday (11 March), Sarkozy said some EU member states are too lax with their borders, enabling unwanted migrants to enter France and causing a heavy burden on its social welfare system.At a time of economic crisis, if Europe doesn't pick those who can enter its borders, it won't be able to finance its welfare state any longer. We need a common discipline in border controls ... We can't leave the management of migration flows to technocrats and tribunals, he told around 50,000 supporters at an event in the Paris suburbs ahead of the first round of voting on 22 April.Schengen lets people travel without passport checks in its 25 participating states, including 22 EU countries plus Iceland, Liechtenstein, Norway and Switzerland and is seen as a landmark achievement in EU integration.The Schengen Agreement can no longer respond to the seriousness of the situation. It must be revised. There is a need to implement a structural reform that we have implemented for the euro, Sarkozy said.The anti-immigration rhetoric is widely seen as an attempt to woo those who may be thinking of voting for the far-right. Last week, the President said he would halve the number of immigrants arriving in the country if he is re-elected.
Migrants to cause implosion
His speech was warmly received, with flag-waving crowds chanting his name as he spoke of saving France from an implosion caused by migrants.Eurostat, the EU's statistical office, estimates that around 3.8 million non-French nationals currently live in the country.France also has one of Europe's largest Muslim populations. But some second and third generation French nationals of Maghreb origin find themselves marginalised and cut off from a society that is becoming increasingly hostile towards their faith.The death of two teenagers of Maghreb origin set off three weeks of riots in 2005 in the Paris suburbs, where youth unemployment reportedly hovers at 40 percent.Sarkozy noted at the rally that France was the first country to ban the niqab and the burqa to give back to women control of their destiny.The prohibition came into effect last April, at the same time that France and Italy threatened to close their borders to Arab Spring refugees from Tunisia.

Ashton to spend €15mn on private security firms

BRUSSELS - Catherine Ashton's External Action Service (EEAS) is to spend €15 million on private security firms this year as part of broader efforts to protect diplomats overseas.The money is to cover fully integrated security services at its outposts in Beirut, Benghazi, Islamabad, Jerusalem, Kabul, Port-au-Prince, Riyadh, Sanaa and Tripoli.It will spend €35 million more on hiring day-to-day security guards for the rest of its 136 foreign delegations. Some other places are also classed as risky (diplomats are asked not to take families to Baghdad and Monrovia), but do not qualify for the fully integrated treatment.The Afghanistan mission is currently protected by armed ex-military types, including former Nepalese Gurkhas, supplied by London-based firm Page Group. When the EU ambassador leaves his compound, he travels in a convoy of three cars with seven bodyguards. Last year, someone took a pot shot at his window while he was briefing staff. In 2010, he was nearly hit by a rocket at a tribal congress.Budapest-based security firm Argus takes care of embassies in Haiti, Lebanon, Libya, Saudi Arabia and Yemen. London-based company Control Risks looks after Israel and another British firm, Saladin, does Pakistan.The EU foreign corps last year put Argus and Page Group, as well as French company Geos, Canadian firm GardaWorld and British company G4S on a special shortlist. The listing means that if a new job comes up, the EEAS can hire one of them in a decision which takes just two weeks, instead of a year or so, as with a normal EU tender.The set-up means Saladin and Control Risks could be on their way out as old contracts expire. But Control Risks in January opened a mini-office in Brussels to develop relationships with clients in Belgium and Luxembourg, including EU institutions.
Private security companies got a bad name in 2007 when US firm Blackwater machine-gunned 17 Iraqi civilians and got off with an out-of-court pay-off to victims' families.An EEAS contact told EUobserver that national laws - whether, say, Libyan or Yemeni - govern contractors' use of violence. He noted that a company's track record is a factor in getting EU work and that to [his] knowledge no EU private security guard has ever fired his weapon in the line of duty.Not all the EU-linked companies have squeaky clean histories, however.Afghan police in January arrested two GardaWorld men driving a car full of AK-47s with filed-off serial numbers. British police last year detained three G4S people after an Angolan man died in their custody in Heathrow airport.Meanwhile, the men behind Saladin reportedly smuggled guns to anti-Soviet rebels in Afghanistan in the 1970s and to anti-Communist rebels in Nicaragua in the 1980s.Ashton's €15-million-a-year special security budget is tiny compared to what member states shell out. According to foreign office figures provided to EUobserver, the UK between mid-2006 and mid-2010 spent €196 million on private security in Iraq alone.The EEAS last year also hired three experts from EU countries to beef up security.Frans Potuyt, a former Dutch ambassador to Kazakhstan and head of security at the Dutch foreign ministry, now runs the EEAS' security department. Mike Croll, a former security director at the British foreign office, looks after overseas missions, while Attila Lajos, a former Hungarian intelligence officer, looks after its headquarters in Brussels.The EEAS contact said it also has counter-intelligence people with the appropriate background on its payroll. If we felt the need to sweep a diplomat's residence for bugs, we have ways to do this internally or with the help of member states' services, he added.The head of security at its Kiev and Moscow embassies, for instance - an Italian national - is said to have good contacts with Ukrainian ex-intelligence officers who now work as private eyes or dabble in organised crime.
Stick em up
As for G4S, the company already supplies more than 1,500 security guards for the EEAS, European Commission, EU Council and European Parliament buildings in the EU capital.The firm's parliament contract is up for renewal at a time when its reputation is under a question mark - a bank, a canteen and a post office inside parliament were each robbed in the past three years with no one caught.A parliament official said G4S is not to blame because the building has so many escape routes and because insiders helped perpetrators to smuggle in guns or replicas and to evade CCTV. The contact noted that little has been done to improve things - such as splitting inside space into separate secure zones - since the last robbery, however.
The real issue is if you have an armed attack and the guy is free to run around inside and maybe three or four floors away you have a hearing with [French leader] Sarkozy and the two of them meet - that would be a huge incident,he said.
The Department of Justice will ask a federal court to uphold the secrecy that surrounds the working relationship between Google and the National Security Agency in a hearing that is scheduled for next week.Privacy watchdog group The Electronic Privacy Information Center (EPIC) is returning to court once again in an effort to disclose more information regarding the widely publicized partnership between the spy agency and the search engine giant.EPIC is suing to obtain documents that detail the relationship, and will appeal against the NSA’s so-called Glomar response, claiming it could neither confirm nor deny the existence of any information about its relations with Google, because such a response would reveal information about NSA’s functions and activities.The NSA’s response stated that the agency works with a broad range of commercial partners and research associations in order to oversee the security of important information systems, but did not provide any further detail.The issue rose to prominencein January 2010 following a highly sophisticated and targeted cyber attack on the corporate infrastructure of Google and some twenty other large US companies.The attack was blamed on the Chinese government, prompting Google to embrace a collaboration with the federal agency in charge of global electronic surveillance.Anonymous sources informed The Washington Post at the time that the alliance is being designed to allow the two organizations to share critical information, adding that the agreement will not allow the NSA access to users’ search details or e-mails.
The DOJ is backing NSA’s Glomar response, as The Legal Times reports:DOJ’s legal team said that acknowledging whether NSA and Google formed a partnership from a cyber attack would illuminate whether the government considered the alleged attack to be of consequence for critical U.S. government information systems.DOJ said media reports about the alleged Google partnership with NSA do not constitute official acknowledgement.If NSA determines that certain security vulnerabilities or malicious attacks pose a threat to U.S. government information systems, NSA may take action, DOJ Civil Division lawyers wrote in a brief.In its own opening brief, EPIC argues that records the NSA holds on the subject are not exempt from public disclosure under FOIA request.Communications from Google to the NSA do not implicate the agency’s functions and activities, and are therefore not exempt from disclosure. the brief states.Further, some records responsive to EPIC’s FOIA Request concern NSA activities that may fall outside the scope of the agency’s authority. These records are not exempt from disclosure. it continues.EPIC believes that any burgeoning partnership between Google and the government spy force responsible for warrantless monitoring of Americans’ phone calls and e-mails in the wake of 9/11 raises significant privacy concerns.Google provides cloud-based services to consumers, not critical infrastructure services to the government, EPIC attorney Marc Rotenberg said, noting that the group’s records request does not seek documents about NSA’s role to secure government computer networks.A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit will preside over the hearing, scheduled for March 20.
Google’s partnership with the intelligence network is not new. As we reported in late 2006, An ex-CIA agent Robert David Steele has claimed sources told him that CIA seed money helped get the company off the ground.Speaking to the Alex Jones Show, Steele elaborated on previous revelations by making it known that the CIA helped bankroll Google at its very inception. The Obama administration previously has rejected the need for Congressional approval for sending soldiers into another country.Asked by Alabama Republican Sen. If Obama works with the United Nations and NATO against Syria and does not seek authorization from Congress for the use of the U.S. military, he may face impeachment, according to a resolution introduced by Republican Representative Walter B. Jones Jr.Expressing the sense of congress that the use of offensive military force by a president without prior and clear authorization of an Act of Congress constitutes an impeachable high crime and misdemeanor under Article II, Section 4 of the Constitution, the resolution states.Jones introduced his resolution after Obama’s Defense Secretary Leon Panetta and Joint Chiefs of Staff Chairman Gen. Martin Dempsey told Senator Jeff Sessions during a Senate Armed Services Committee hearing last week that they would seek international permission to attack Syria. Sources indicate 600 to 1,500 fighters from the Islamic Fighting Group in Libya, now known as al-Qaeda in Libya, are working with the FSA to topple the Assad regime. Egypt has brokered a ceasefire between Israel and the Gaza-based terror groups. The ceasefire has gone into effect as of 1:00 a.m. (Israel time) Monday morning, according to a report on Kol Yisrael radio. Similar reports on Saturday and Sunday night turned out to be false.The ceasefire comes following four days in which more than 200 rockets and missiles were fired from Gaza into southern Israel. The rocket fire was met with Israeli airstrikes against terror targets in Gaza.Earlier on Monday evening Kol Yisrael cited the Al-Arabiya television network in reporting that the terror organizations have reached an agreement regarding a ceasefire. However, at that time there were no further details nor was there a confirmation by other sources. Kol Yisrael quoted a spokesman for the Islamic Jihad who said that the organization did not agree to any ceasefire and that one cannot be discussed as long as Israeli airstrikes in Gaza continue.Meanwhile, Egypt’s ambassador to the Palestinian Authority, Yasser Othman, said that he believes that a ceasefire in Gaza will be reached within 48 hours, despite Israel's refusal to stop the attacks on terror bases in Gaza.

BRUSSELS - Finland's foreign minister has said EU countries are more divided on foreign policy now than before the Lisbon Treaty came along.Erkki Tuomioja made the remarks after informal talks with his EU counterparts in Copenhagen on Friday (9 March) and Saturday.The real problem is with member states and their willingness to work together - this should be a basic pre-condition when we start a discussion on this or that subject, there should be no red lines ... [But] the commitment to this is actually less than it was five years ago. The Lisbon Treaty has given us a new instrument, but this is a matter of political will, he told EUobserver by phone from the Danish capital.He gave as an example the UK's opposition to opening a joint command centre in Brussels for EU military operations. The UK is reluctant to go ahead with this but everybody else wants to, so we should move forward,he noted.The Lisbon Treaty in 2009 called for the creation of the European External Action Service (EEAS) and a new EU foreign policy chief, a post later filled by British politician Catherine Ashton.Tuomioja said nobody criticised Ashton at the Copenhagen event despite ups and downs in her first two years in the job. BRUSSELS - Eurozone finance ministers are meeting in Brussels on Monday (12 March) to give their final approval to the second Greek bail-out. But Spain's deficit problem is likely to weigh heavily on the talks.In a conference last Friday, the so-called Eurogroup ministers approved the release of around half of the €130 billion bail-out, which is to help fund a massive bond-swap between Greece and private debt-holders.The private sector involvement was deemed successful as over 85 percent of private and state-owned banks, investment funds and pension funds agreed to change their old Greek bonds for new ones at a net loss of over 70 percent.By triggering collective action clauses on reluctant bondholders, Athens forced an even higher participation rate of over 95 percent. The move was deemed a credit event by finance associations, meaning that default insurances to the tune of €2.4 billion have now to be paid out and ratings agencies have placed Greece in restricted default territory - just one notch higher than outright bankruptcy.Indicating that the forced losses were part of the plan, Eurogroup chief Jean-Claude Juncker said the necessary conditions are in place for the final approval on the bail-out, however. He also said the Washington-based International Monetary Fund (IMF) would contribute substantially to the new rescue package.The IMF is expected to put some €28 billion on the table, its chief Christine Lagarde indicated on Friday, with a final approval by the lender's board due on Wednesday. Some €10 billion of it is not fresh money, however, but is to be rolled over from Greece's first bail-out, agreed in 2010 and as yet not paid out in full.
With general elections later this month and with voters angered by the harsh austerity measures linked to the bail-outs, Greece's troubles are unlikely to be over.EU economics commissioner Olli Rehn last week called the second bail-out a unique opportunity not to be missed and said he now expects Greek authorities to maintain their strong commitment to the economic adjustment programme and to rigorously and timely implement the policy package.Similar warnings came from IMF chief Lagarde. Restoring competitiveness and a sustainable fiscal position will require Greece to undertake sustained and deep structural reforms over a prolonged period,she said.In a report presented to the Eurogroup last week, her staff warned that failure to stick to the agreed targets would put up financing costs for Athens by another €15 billion. Meanwhile, the possibility for a third Greek bail-out has not been ruled out by either German finance minister Wolfgang Schauble or by Eurogroup chief Juncker.The latest data released on Friday showed the Greek economy shrank by a worse-than-expected 7.5 percent in the fourth quarter of 2011. Overall, the Greek economy contracted by 6.9 percent last year, instead of the 5.5 percent projections eurozone financiers had counted on.Lagarde, a former French finance minister, also urged her ex-colleagues to boost the eurozone's bail-out funds - a move so far resisted by Germany. The most likely scenario for the Eurogroup to approve - but not on Monday - is for the €250 billion left over from the temporary European Financial Stability Facility to be added rather than subtracted from the €500-billion-strong permanent European Stability Facility due to come into force in July.

We need a common discipline in border controls ... We can't leave the management of migration flows to technocrats and tribunals, he told around 50,000 supporters at an event in the Paris suburbs ahead of the first round of voting on 22 April.Schengen lets people travel without passport checks in its 25 participating states, including 22 EU countries plus Iceland, Liechtenstein, Norway and Switzerland and is seen as a landmark achievement in EU integration.The Schengen Agreement can no longer respond to the seriousness of the situation. It must be revised. Ashton to spend €15mn on private security firms

BRUSSELS - Catherine Ashton's External Action Service (EEAS) is to spend €15 million on private security firms this year as part of broader efforts to protect diplomats overseas.The money is to cover fully integrated security services at its outposts in Beirut, Benghazi, Islamabad, Jerusalem, Kabul, Port-au-Prince, Riyadh, Sanaa and Tripoli.It will spend €35 million more on hiring day-to-day security guards for the rest of its 136 foreign delegations. Some other places are also classed as risky (diplomats are asked not to take families to Baghdad and Monrovia), but do not qualify for the fully integrated treatment.The Afghanistan mission is currently protected by armed ex-military types, including former Nepalese Gurkhas, supplied by London-based firm Page Group. When the EU ambassador leaves his compound, he travels in a convoy of three cars with seven bodyguards. Last year, someone took a pot shot at his window while he was briefing staff. In 2010, he was nearly hit by a rocket at a tribal congress.Budapest-based security firm Argus takes care of embassies in Haiti, Lebanon, Libya, Saudi Arabia and Yemen. London-based company Control Risks looks after Israel and another British firm, Saladin, does Pakistan.The EU foreign corps last year put Argus and Page Group, as well as French company Geos, Canadian firm GardaWorld and British company G4S on a special shortlist. The listing means that if a new job comes up, the EEAS can hire one of them in a decision which takes just two weeks, instead of a year or so, as with a normal EU tender.The set-up means Saladin and Control Risks could be on their way out as old contracts expire. But Control Risks in January opened a mini-office in Brussels to develop relationships with clients in Belgium and Luxembourg, including EU institutions.
Private security companies got a bad name in 2007 when US firm Blackwater machine-gunned 17 Iraqi civilians and got off with an out-of-court pay-off to victims' families.An EEAS contact told EUobserver that national laws - whether, say, Libyan or Yemeni - govern contractors' use of violence. He noted that a company's track record is a factor in getting EU work and that to [his] knowledge no EU private security guard has ever fired his weapon in the line of duty.Not all the EU-linked companies have squeaky clean histories, however.Afghan police in January arrested two GardaWorld men driving a car full of AK-47s with filed-off serial numbers. British police last year detained three G4S people after an Angolan man died in their custody in Heathrow airport.Meanwhile, the men behind Saladin reportedly smuggled guns to anti-Soviet rebels in Afghanistan in the 1970s and to anti-Communist rebels in Nicaragua in the 1980s.Ashton's €15-million-a-year special security budget is tiny compared to what member states shell out. Mike Croll, a former security director at the British foreign office, looks after overseas missions, while Attila Lajos, a former Hungarian intelligence officer, looks after its headquarters in Brussels.The EEAS contact said it also has counter-intelligence people with the appropriate background on its payroll. If we felt the need to sweep a diplomat's residence for bugs, we have ways to do this internally or with the help of member states' services, he added.The head of security at its Kiev and Moscow embassies, for instance - an Italian national - is said to have good contacts with Ukrainian ex-intelligence officers who now work as private eyes or dabble in organised crime.

As for G4S, the company already supplies more than 1,500 security guards for the EEAS, European Commission, EU Council and European Parliament buildings in the EU capital.The firm's parliament contract is up for renewal at a time when its reputation is under a question mark - a bank, a canteen and a post office inside parliament were each robbed in the past three years with no one caught.A parliament official said G4S is not to blame because the building has so many escape routes and because insiders helped perpetrators to smuggle in guns or replicas and to evade CCTV. The contact noted that little has been done to improve things - such as splitting inside space into separate secure zones - since the last robbery, however.
The real issue is if you have an armed attack and the guy is free to run around inside and maybe three or four floors away you have a hearing with [French leader] Sarkozy and the two of them meet - that would be a huge incident,he said.

To borrow a phrase from Barack Obama, Russia and China have the Assad regime's back and have vetoed UN resolutions that would pressure the Syrian ruler to step down. This has angered many Arab leaders who would like to see Assad's back and a different government installed in Damascus.Russia and China have not yet changed their policy, but they are at least making an effort to persuade the Arab regimes of their good intentions, attempting to avoid the prediction made by Foreign Secretary William Hague that they will pay a price in the Arab world for their support of Assad.Russian Foreign Minister Sergei Lavrov met with the Arab League, which is incensed over the Russian veto at the UN that had thwarted an Arab League peace plan.
Lavrov denied Western accusations, such as those by French Foreign Minister Alain Juppe, who alleged that Russia was digging in its heels due to major economic interests in Syria, including arms sales or simply in revenge for what happened in Libya. Russia explained that Lavrov was acting out of nobler motives.We are not protecting any regimes..We are protecting international law … We are not looking for a special prize or geopolitical interest here.It was more important, he said, to stop the violence and provide humanitarian assistance then to impute blame. The Russian news agency RIA Novosti claimed that Lavrov and the Arab League had cobbled together a plan calling for all sides to end the violence, monitoring the situation in Syria, humanitarian aid to all Syrians, support for UN special envoy, the former UN Secretary General Kofi Annan and abstention from external interference in Syrian domestic affairs.This account clashes with reports that Lavrov was criticized by Qatari Foreign Minister Jassem Al Thani, who claimed that the Arabs would not settle for just a cease-fire after Assad's systematic killing of Syrians.In any case Annan left Syria without any deal.China also unveiled a peace plan calling for an immediate end to violence and dialogue between the Assad regime and the opposition. The Quartet for Middle East Peace – the European Union, Russia, United Nations, and United States – will meet on Monday in an attempt to revive the stalled peace negotiations between Israel and the Palestinian Authority.According to a report in the Moscow-based RIA Novosti news agency, the meeting will be held in New York and will be attended by Russian Foreign Minister Sergei Lavrov.The report said that U.S. Secretary of State Hillary Clinton will also be in attendance. European Union foreign policy chief Catherine Ashton and the Quartet’s special envoy to the Middle East, former British premier Tony Blair, will participate via a video link.The last meeting of the Quartet took place in September 2011 in the UN headquarters, RIA Novosti noted. During that meeting, which took place after the PA submitted its unilateral statehood bid to the UN, the Quartet suggested a timetable which will allegedly bring forth a peace agreement by the end of 2012.Jordan recently hosted a series of exploratory meetings between representatives of Israel and the PA, based on the Quartet’s proposal, but the PA refused to continue discussions after five meetings.Currently, the peace process remains frozen as Abbas continues to impose preconditions on negotiations.Last week it was reported that Jordan’s Foreign Minister, Nasser Judeh, is set to deliver a letter in which the government of Israel and Palestinian Authority detail their conditions for peace talks to resume.The letter repeats the PA’s previous demands, which are seen by Israeli officials as an excuse to forestall talks. Some 200 rockets have been fired at Israel's southern communities by Gaza terror groups since Friday. Israeli retaliatory strikes have killed 23 Gazans.Speaking to a Likud faction meeting, the prime minister said of anyone planning to harm Israeli citizens, We'll hit them.He claimed Israel's current air campaign combined with its technological edge and national resilience would allow the IDF to expand its operations as needed.His comments were taken to signal that he was in no hurry to mount a ground incursion in Gaza aimed at rooting out the terror infrastructure in the Hamas-run coastal enclave.Earlier Monday, Defense Minsiter Ehud Barak warned that if the rocket fire escalates, Israel will continue air strikes against terrorist targets.

Israel on Sunday appealed to the United Nations Security Council, asking it to condemn the continued rocket fire at Israel’s southern communities.According to a report on Channel 2 News, Israel's deputy ambassador to the UN, Haim Waxman, sent a formal complaint letter to UN Secretary General Ban Ki-moon and the Security Council, demanding that the Council condemn the constant firing of rockets and act in every possible way against it.The constant firing dramatically affects the daily lives of more than one million Israeli citizens, Waxman was quoted by Channel 2 as having written in the letter. Many people have suffered from shock and tens of thousands of children remained at home so we can ensure their safety. Israel’s citizens are living under threat and danger.Waxman’s letter comes after terrorists fired more than 50 missiles at southern Israel on Sunday. Several of them were intercepted by the Iron Dome system, which automatically weeds out missiles that are aimed at open areas, but is not foolproof.One of the missiles from Gaza struck the courtyard of an empty school in Be’er Sheva. Another rocket damaged 15 houses. The city’s order to close all schools saved possible mass casualties.

This has angered many Arab leaders who would like to see Assad's back and a different government installed in Damascus.Russia and China have not yet changed their policy, but they are at least making an effort to persuade the Arab regimes of their good intentions, attempting to avoid the prediction made by Foreign Secretary William Hague that they will pay a price in the Arab world for their support of Assad.Russian Foreign Minister Sergei Lavrov met with the Arab League, which is incensed over the Russian veto at the UN that had thwarted an Arab League peace plan.
Lavrov denied Western accusations, such as those by French Foreign Minister Alain Juppe, who alleged that Russia was digging in its heels due to major economic interests in Syria, including arms sales or simply in revenge for what happened in Libya. Russia explained that Lavrov was acting out of nobler motives.We are not protecting any regimes..We are protecting international law … We are not looking for a special prize or geopolitical interest here.It was more important, he said, to stop the violence and provide humanitarian assistance then to impute blame. BEIRUT - Syrian activists said Monday that pro-government gunmen have killed at least 16 people — including children — in a rebel stronghold recaptured by the government in the embattled central city of Homs.The state media in Damascus, which often ignores claims by activists, confirmed killings in Homs but blamed armed terrorists as it frequently calls those behind the uprising.Fresh from stamping out rebel centres of resistance in Homs, government forces are pressing on with new offensives in other parts of central and northern Syria. The reports of the killings add to concerns that the hundreds of civilian deaths caused by the fighting will be compounded by reprisals against opposition supporters in the recaptured towns and neighbourhoods.They will add to the pressure on U.N. Security Council members who are meeting to decide what to do next to stop the violence, as the international community's current ongoing effort — a peacemaking mission by U.N. envoy Kofi Annan — falters with both government and opposition refusing to talk to one another.The Britain-based Syrian Observatory for Human Rights said at least 16 people were killed Sunday night while the Local Coordination Committees said 45 were murdered. Homs is the Syrian city hardest hit by violence since the uprising against President Bashar Assad's regime began in March last year. Damascus blames them on armed groups but the opposition says they are caused by government shelling.In the northeastern city of Qamishli, hundreds of Kurds marched to mark the eighth anniversary of clashes between Syrian Kurds and security forces that began in the city then spread to the nearby cities of Hasaka and Aleppo. The 2004 violence left 25 killed and 100 wounded.
Kurds — the largest ethnic minority in Syria — make up 15 per cent of the country's 23 million people and have long complained of neglect and discrimination. However, since the uprising began they have not taken a major role in anti-Assad activities.
The gathering in Qamishli observed a moment of silence to protest the killings of civilians in Homs, said Osso, who spoke from the area.

The Quartet for Middle East Peace – the European Union, Russia, United Nations, and United States – will meet on Monday in an attempt to revive the stalled peace negotiations between Israel and the Palestinian Authority.According to a report in the Moscow-based RIA Novosti news agency, the meeting will be held in New York and will be attended by Russian Foreign Minister Sergei Lavrov.The report said that U.S. Secretary of State Hillary Clinton will also be in attendance. European Union foreign policy chief Catherine Ashton and the Quartet’s special envoy to the Middle East, former British premier Tony Blair, will participate via a video link.The last meeting of the Quartet took place in September 2011 in the UN headquarters, RIA Novosti noted. During that meeting, which took place after the PA submitted its unilateral statehood bid to the UN, the Quartet suggested a timetable which will allegedly bring forth a peace agreement by the end of 2012.Jordan recently hosted a series of exploratory meetings between representatives of Israel and the PA, based on the Quartet’s proposal, but the PA refused to continue discussions after five meetings.Currently, the peace process remains frozen as Abbas continues to impose preconditions on negotiations.Last week it was reported that Jordan’s Foreign Minister, Nasser Judeh, is set to deliver a letter in which the government of Israel and Palestinian Authority detail their conditions for peace talks to resume.The letter repeats the PA’s previous demands, which are seen by Israeli officials as an excuse to forestall talks. These include a demand that Israel accept the indefensible pre-1967 lines as a basis for future borders, release terrorists who were imprisoned before 1994, and halt settlement construction in the disputed territories.The PA is also threatening to cancel all agreements signed after 2000 if Israel does not agree to their demands before peace talks.Last week, PA leaders clarified during a meeting with Judeh they will not resume peace talks with Israel, unless Israel freezes construction in Judea and Samaria.
