The Department of Justice will ask a federal court to uphold the secrecy that surrounds the working relationship between Google and the National Security Agency in a hearing that is scheduled for next week.Privacy watchdog group The Electronic Privacy Information Center (EPIC) is returning to court once again in an effort to disclose more information regarding the widely publicized partnership between the spy agency and the search engine giant.EPIC is suing to obtain documents that detail the relationship, and will appeal against the NSA’s so-called Glomar response, claiming it could neither confirm nor deny the existence of any information about its relations with Google, because such a response would reveal information about NSA’s functions and activities.The NSA’s response stated that the agency works with a broad range of commercial partners and research associations in order to oversee the security of important information systems, but did not provide any further detail.The issue rose to prominencein January 2010 following a highly sophisticated and targeted cyber attack on the corporate infrastructure of Google and some twenty other large US companies.The attack was blamed on the Chinese government, prompting Google to embrace a collaboration with the federal agency in charge of global electronic surveillance.Anonymous sources informed The Washington Post at the time that the alliance is being designed to allow the two organizations to share critical information, adding that the agreement will not allow the NSA access to users’ search details or e-mails.

The DOJ is backing NSA’s Glomar response, as The Legal Times reports:DOJ’s legal team said that acknowledging whether NSA and Google formed a partnership from a cyber attack would illuminate whether the government considered the alleged attack to be of consequence for critical U.S. government information systems.DOJ said media reports about the alleged Google partnership with NSA do not constitute official acknowledgement.If NSA determines that certain security vulnerabilities or malicious attacks pose a threat to U.S. government information systems, NSA may take action, DOJ Civil Division lawyers wrote in a brief.In its own opening brief, EPIC argues that records the NSA holds on the subject are not exempt from public disclosure under FOIA request.Communications from Google to the NSA do not implicate the agency’s functions and activities, and are therefore not exempt from disclosure. the brief states.Further, some records responsive to EPIC’s FOIA Request concern NSA activities that may fall outside the scope of the agency’s authority. These records are not exempt from disclosure. it continues.EPIC believes that any burgeoning partnership between Google and the government spy force responsible for warrantless monitoring of Americans’ phone calls and e-mails in the wake of 9/11 raises significant privacy concerns.Google provides cloud-based services to consumers, not critical infrastructure services to the government, EPIC attorney Marc Rotenberg said, noting that the group’s records request does not seek documents about NSA’s role to secure government computer networks.A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit will preside over the hearing, scheduled for March 20.

Google’s partnership with the intelligence network is not new. As we reported in late 2006, An ex-CIA agent Robert David Steele has claimed sources told him that CIA seed money helped get the company off the ground.Speaking to the Alex Jones Show, Steele elaborated on previous revelations by making it known that the CIA helped bankroll Google at its very inception. Steele named Google’s CIA point man as Dr. Rick Steinheiser, of the Office of Research and Development.I think Google took money from the CIA when it was poor and it was starting up and unfortunately our system right now floods money into spying and other illegal and largely unethical activities, and it doesn’t fund what I call the open source world, said Steele, citing trusted individuals as his sources for the claim.They’ve been together for quite a while, added Steele.The NSA’s involvement with Google should be treated as highly suspect, given the agency’s track record and its blatant disregard for the Fourth Amendment.A set of documents obtained by the Electronic Frontier Foundation (EFF) in June 2007 revealed that US telco AT&T allowed the NSA to set up a secret room in its offices to monitor internet traffic.The discovering prompted a lawyer for an AT&T engineer to allege that within two weeks of taking office, the Bush administration was planning a comprehensive effort of spying on Americans That is BEFORE 9/11, before the nation was embroiled in the freedom stripping exercise commonly known as the war on terror had even begun.In late 2007, reports circulated that the NSA had increasing control over SSL, now called Transport Layer Security, the cryptographic protocol that provides secure communications on the internet for web browsing, e-mail, instant messaging, and other data transfers.In 2008, Google denied that it had any role in the NSA’s terrorist surveillance program, after first refusing to say if they have provided users private data to the federal government under the warrantless wiretapping initiative.However, it is clear where Google’s interests lie given that the company is supplying the software, hardware and tech support to US intelligence agencies in the process of creating a vast closed source database for global spy networks to share information.The government supply arm of Google has also reportedly entered into a number of other contracts, details of which it says it cannot share.Google’s approach to privacy also came under scrutiny more recently when it was discovered that the company was essentially vacuuming up WiFi network data as it gathered images for its Streetview program.Google insisted that the practice was a mistake, even though information published in January 2010 revealed that the data collection program was a very deliberate effort to assemble as much information as possible about U.S. residential and business WiFi networks.

Pilots reported bystanders who passed near the terrorists during the strike were injured in the strike.The IDF spokesperson's office said the incident was proof positive terrorists are using civilians as human shields.This incident demonstrates that terrorist groups in Gaza use human shields and fire rockets from densely populated areas, the statement added.

The rocket fire was met with Israeli airstrikes against terror targets in Gaza.Earlier on Monday evening Kol Yisrael cited the Al-Arabiya television network in reporting that the terror organizations have reached an agreement regarding a ceasefire. However, at that time there were no further details nor was there a confirmation by other sources. Kol Yisrael quoted a spokesman for the Islamic Jihad who said that the organization did not agree to any ceasefire and that one cannot be discussed as long as Israeli airstrikes in Gaza continue.Meanwhile, Egypt’s ambassador to the Palestinian Authority, Yasser Othman, said that he believes that a ceasefire in Gaza will be reached within 48 hours, despite Israel's refusal to stop the attacks on terror bases in Gaza.

Kol Yisrael cited Othman’s interview with the Bethlehem-based Ma’an news agency, in which he said Egypt was determined to bring about calm in the region.Meanwhile on Monday evening, the IDF eliminated two terrorists as they prepared to fire a rocket into Israel from Gaza. The strike was the second in five hours targeting a rocket launching crew in Gaza.Previously, IDF forces killed two terrorists seeking to launch a rocket from the vicinity of a school in northern Gaza. Pilots reported bystanders who passed near the terrorists during the strike were injured in the strike.The IDF spokesperson's office said the incident was proof positive terrorists are using civilians as human shields.IDF Spokesman Brig.-Gen. Yoav Mordechai told Army Radio on Monday the IDF is ready for a major ground incursion into Gaza.The IDF is prepared for any development, including a situation where we are forced to launch a ground operation, Mordechai said.We have everything we need and are ready to step it up if needed. There are many measures that we haven’t employed yet.

BRUSSELS - Finland's foreign minister has said EU countries are more divided on foreign policy now than before the Lisbon Treaty came along.Erkki Tuomioja made the remarks after informal talks with his EU counterparts in Copenhagen on Friday (9 March) and Saturday.The real problem is with member states and their willingness to work together - this should be a basic pre-condition when we start a discussion on this or that subject, there should be no red lines ... [But] the commitment to this is actually less than it was five years ago. The Lisbon Treaty has given us a new instrument, but this is a matter of political will, he told EUobserver by phone from the Danish capital.He gave as an example the UK's opposition to opening a joint command centre in Brussels for EU military operations. The UK is reluctant to go ahead with this but everybody else wants to, so we should move forward,he noted.The Lisbon Treaty in 2009 called for the creation of the European External Action Service (EEAS) and a new EU foreign policy chief, a post later filled by British politician Catherine Ashton.Tuomioja said nobody criticised Ashton at the Copenhagen event despite ups and downs in her first two years in the job. But he added: We don't speak as openly to each other as we should, even behind closed doors.In one sign of internal EU politicking, the Financial Times on Friday reported that France and the UK in December had talked about giving Ashton's job to France's EU commissioner Michel Barnier.British minister William Hague in Copenhagen told a number of his peers the report was rubbish.But Ashton's staff believe the newspaper was led on by some mischief maker in London.A diplomat from another EU country told this website: It's not the first time this kind of thing has happened before a Gymnich [an informal EU foreign ministers' meeting] ... He added that Ashton should listen more to small EU countries because they are her natural allies, while big member states do not want the EEAS to be too powerful.We don't want to have the feeling that only Paris, Berlin and London are being consulted,he said.Going back to Tuomioja's point, the contact noted that Slovenia is still blocking an EU asset freeze on Belarus oligarch Yuri Chizh in order to protect a contract between Chizh companies and Slovenian firm Riko Group: Euro 150 million is not nothing for a country like Slovenia these days.For her part, Ashton in a pre-Gymnich letter to ministers - seen by EUobserver - set out some ideas on how the EEAS should react to the EU's financial crisis.She said it should focus on core issues - the Middle East Peace Process, Iran, relations with Arab Spring and post-Soviet neighbours, Sahel, Somalia and the Western Balkans. She noted she might make cuts in her Brussels-based operations for the sake of giving extra resources to foreign delegations where I believe they add more value.She also mooted the idea of creating Europe Houses - grouping together EEAS embassies with member states' embassies and consulates in the same buildings in foreign capitals in order to save money while enhancing overall EU visibility.Syria dominated the post-Gymnich press conference.Ashton and her host, Danish foreign minister Villy Sovndal, welcomed recent defections by high-level officials as a sign that President Bashar Assad's regime is crumbling. Euro ministers to approve 2nd Greek bail-out

BRUSSELS - Eurozone finance ministers are meeting in Brussels on Monday (12 March) to give their final approval to the second Greek bail-out. But Spain's deficit problem is likely to weigh heavily on the talks.In a conference last Friday, the so-called Eurogroup ministers approved the release of around half of the €130 billion bail-out, which is to help fund a massive bond-swap between Greece and private debt-holders.The private sector involvement was deemed successful as over 85 percent of private and state-owned banks, investment funds and pension funds agreed to change their old Greek bonds for new ones at a net loss of over 70 percent.By triggering collective action clauses on reluctant bondholders, Athens forced an even higher participation rate of over 95 percent. The move was deemed a credit event by finance associations, meaning that default insurances to the tune of €2.4 billion have now to be paid out and ratings agencies have placed Greece in restricted default territory - just one notch higher than outright bankruptcy.Indicating that the forced losses were part of the plan, Eurogroup chief Jean-Claude Juncker said the necessary conditions are in place for the final approval on the bail-out, however. He also said the Washington-based International Monetary Fund (IMF) would contribute substantially to the new rescue package.The IMF is expected to put some €28 billion on the table, its chief Christine Lagarde indicated on Friday, with a final approval by the lender's board due on Wednesday. Some €10 billion of it is not fresh money, however, but is to be rolled over from Greece's first bail-out, agreed in 2010 and as yet not paid out in full.

With general elections later this month and with voters angered by the harsh austerity measures linked to the bail-outs, Greece's troubles are unlikely to be over.EU economics commissioner Olli Rehn last week called the second bail-out a unique opportunity not to be missed and said he now expects Greek authorities to maintain their strong commitment to the economic adjustment programme and to rigorously and timely implement the policy package.Similar warnings came from IMF chief Lagarde. Restoring competitiveness and a sustainable fiscal position will require Greece to undertake sustained and deep structural reforms over a prolonged period,she said.In a report presented to the Eurogroup last week, her staff warned that failure to stick to the agreed targets would put up financing costs for Athens by another €15 billion. Meanwhile, the possibility for a third Greek bail-out has not been ruled out by either German finance minister Wolfgang Schauble or by Eurogroup chief Juncker.The latest data released on Friday showed the Greek economy shrank by a worse-than-expected 7.5 percent in the fourth quarter of 2011. Overall, the Greek economy contracted by 6.9 percent last year, instead of the 5.5 percent projections eurozone financiers had counted on.Lagarde, a former French finance minister, also urged her ex-colleagues to boost the eurozone's bail-out funds - a move so far resisted by Germany. The most likely scenario for the Eurogroup to approve - but not on Monday - is for the €250 billion left over from the temporary European Financial Stability Facility to be added rather than subtracted from the €500-billion-strong permanent European Stability Facility due to come into force in July.

Spanish troubles

Ministers on Monday are also expected to look at Spain's worsening economic figures - the first major test for the EU's strengthened deficit rules.Just minutes after signing a German-inspired treaty on fiscal discipline, Prime Minister Mariano Rajoy earlier this month announced that his country would not be able to cut its public deficit to 4.4 percent of gross domestic product as agreed with the EU commission, but would aim for 5.8 percent instead.High unemployment rates and recession make it difficult for the newly elected Prime Minister to stick to targets drawn up last year, when the economy was still expected to grow. The EU commission has sent experts to Madrid to look at the latest macro-economic data and compare it with the deficit targets, before ruling if Spain needs to pay fines or if it can agree to extra leeway.The Netherlands has also announced it will overshoot its deficit targets but has indicated that, unlike Madrid, it will not seek flexibility.

Sarkozy threatens to end EU passport-free travel

BRUSSELS - French President Nicolas Sarkozy has threatened to pull France out of the EU's borderless Schengen agreement unless action is taken to reduce the number of illegal immigrants.Speaking at an election rally on Sunday (11 March), Sarkozy said some EU member states are too lax with their borders, enabling unwanted migrants to enter France and causing a heavy burden on its social welfare system.At a time of economic crisis, if Europe doesn't pick those who can enter its borders, it won't be able to finance its welfare state any longer. We need a common discipline in border controls ... We can't leave the management of migration flows to technocrats and tribunals, he told around 50,000 supporters at an event in the Paris suburbs ahead of the first round of voting on 22 April.Schengen lets people travel without passport checks in its 25 participating states, including 22 EU countries plus Iceland, Liechtenstein, Norway and Switzerland and is seen as a landmark achievement in EU integration.The Schengen Agreement can no longer respond to the seriousness of the situation. It must be revised. There is a need to implement a structural reform that we have implemented for the euro, Sarkozy said.The anti-immigration rhetoric is widely seen as an attempt to woo those who may be thinking of voting for the far-right. Last week, the President said he would halve the number of immigrants arriving in the country if he is re-elected.

Migrants to cause implosion

His speech was warmly received, with flag-waving crowds chanting his name as he spoke of saving France from an implosion caused by migrants.Eurostat, the EU's statistical office, estimates that around 3.8 million non-French nationals currently live in the country.France also has one of Europe's largest Muslim populations. But some second and third generation French nationals of Maghreb origin find themselves marginalised and cut off from a society that is becoming increasingly hostile towards their faith.The death of two teenagers of Maghreb origin set off three weeks of riots in 2005 in the Paris suburbs, where youth unemployment reportedly hovers at 40 percent.Sarkozy noted at the rally that France was the first country to ban the niqab and the burqa to give back to women control of their destiny.The prohibition came into effect last April, at the same time that France and Italy threatened to close their borders to Arab Spring refugees from Tunisia.

The French leader also took a swipe at globalisation, saying that Europe should adopt a Buy European Act which would require governments to favour European-made products in public contracts.I want a Europe that protects its citizens. Ashton to spend €15mn on private security firms

BRUSSELS - Catherine Ashton's External Action Service (EEAS) is to spend €15 million on private security firms this year as part of broader efforts to protect diplomats overseas.The money is to cover fully integrated security services at its outposts in Beirut, Benghazi, Islamabad, Jerusalem, Kabul, Port-au-Prince, Riyadh, Sanaa and Tripoli.It will spend €35 million more on hiring day-to-day security guards for the rest of its 136 foreign delegations. Some other places are also classed as risky (diplomats are asked not to take families to Baghdad and Monrovia), but do not qualify for the fully integrated treatment.The Afghanistan mission is currently protected by armed ex-military types, including former Nepalese Gurkhas, supplied by London-based firm Page Group. When the EU ambassador leaves his compound, he travels in a convoy of three cars with seven bodyguards. Last year, someone took a pot shot at his window while he was briefing staff. In 2010, he was nearly hit by a rocket at a tribal congress.Budapest-based security firm Argus takes care of embassies in Haiti, Lebanon, Libya, Saudi Arabia and Yemen. London-based company Control Risks looks after Israel and another British firm, Saladin, does Pakistan.The EU foreign corps last year put Argus and Page Group, as well as French company Geos, Canadian firm GardaWorld and British company G4S on a special shortlist. The listing means that if a new job comes up, the EEAS can hire one of them in a decision which takes just two weeks, instead of a year or so, as with a normal EU tender.The set-up means Saladin and Control Risks could be on their way out as old contracts expire. But Control Risks in January opened a mini-office in Brussels to develop relationships with clients in Belgium and Luxembourg, including EU institutions.

Private security companies got a bad name in 2007 when US firm Blackwater machine-gunned 17 Iraqi civilians and got off with an out-of-court pay-off to victims' families.An EEAS contact told EUobserver that national laws - whether, say, Libyan or Yemeni - govern contractors' use of violence. He noted that a company's track record is a factor in getting EU work and that to [his] knowledge no EU private security guard has ever fired his weapon in the line of duty.Not all the EU-linked companies have squeaky clean histories, however.Afghan police in January arrested two GardaWorld men driving a car full of AK-47s with filed-off serial numbers. British police last year detained three G4S people after an Angolan man died in their custody in Heathrow airport.Meanwhile, the men behind Saladin reportedly smuggled guns to anti-Soviet rebels in Afghanistan in the 1970s and to anti-Communist rebels in Nicaragua in the 1980s.Ashton's €15-million-a-year special security budget is tiny compared to what member states shell out. According to foreign office figures provided to EUobserver, the UK between mid-2006 and mid-2010 spent €196 million on private security in Iraq alone.The EEAS last year also hired three experts from EU countries to beef up security.Frans Potuyt, a former Dutch ambassador to Kazakhstan and head of security at the Dutch foreign ministry, now runs the EEAS' security department. Mike Croll, a former security director at the British foreign office, looks after overseas missions, while Attila Lajos, a former Hungarian intelligence officer, looks after its headquarters in Brussels.The EEAS contact said it also has counter-intelligence people with the appropriate background on its payroll. If we felt the need to sweep a diplomat's residence for bugs, we have ways to do this internally or with the help of member states' services, he added.The head of security at its Kiev and Moscow embassies, for instance - an Italian national - is said to have good contacts with Ukrainian ex-intelligence officers who now work as private eyes or dabble in organised crime.

Stick em up

As for G4S, the company already supplies more than 1,500 security guards for the EEAS, European Commission, EU Council and European Parliament buildings in the EU capital.The firm's parliament contract is up for renewal at a time when its reputation is under a question mark - a bank, a canteen and a post office inside parliament were each robbed in the past three years with no one caught.A parliament official said G4S is not to blame because the building has so many escape routes and because insiders helped perpetrators to smuggle in guns or replicas and to evade CCTV. The contact noted that little has been done to improve things - such as splitting inside space into separate secure zones - since the last robbery, however.
The real issue is if you have an armed attack and the guy is free to run around inside and maybe three or four floors away you have a hearing with [French leader] Sarkozy and the two of them meet - that would be a huge incident,he said.
