Britain’s’ Labour Party suffered heavy losses in council elections in Jewish areas following widespread criticism of leader Jeremy Corbyn and his perceived failure to deal with anti-Semitism within his party.Labour, whose leadership many British Jews believe is ignoring or encouraging the proliferation of anti-Semitism in its ranks, failed in Thursday’s elections to win from the Conservatives control of the council of Barnet, which is a northern borough of London where 14 percent of the population is Jewish. The council represents areas such as Golders Green, Hendon and Edgware.Labour has never controlled Barnet Council since the borough’s creation as a municipal unit in 1964, but in West Hendon, which is an area of Barnet, and which the party had held for nearly 40 years, all three Labour candidates lost to Conservative rivals.Barry Rawlings, Labour leader in Barnet, admitted the losses were because his party had not dealt with anti-Semitism properly. “It wasn’t because they disagreed with our manifesto, but because they felt the Labour Party has failed to deal with anti-Semitism at a national level. Opinion-Ratifying CETA after 'Achmea scandal' is anti-European By Laura Gintalaite and Layla Hughes-MAY 4,18-EUOBSERVER

BRUSSELS, Today, 11:50-Keeping the European project alive requires EU members to abide by the principle of loyalty to European institutions.With the Achmea decision, any EU country that ratifies the EU-Canada Comprehensive Economic and Trade Agreement (CETA) before the decision of the European Court of Justice on CETA's investment provisions compliance with the European treaties, will be breaking the principle of loyalty to European Union institutions.Although few people in Europe have heard about the ECJ's 'Achmea ruling', the case will have far-reaching consequences and it is important for member states to understand the implications of the case quickly, especially those states that are considering ratifying CETA.In 2008, Achmea, a Dutch financial insurance company, using its privilege as a foreign investor under the Slovakia-Netherlands Bilateral Investment Treaty (BIT), succeeded in winning an arbitration award that required Slovakia to pay for the costs to the company from the health insurance reform.Slovakia challenged the award in a German court, which asked the ECJ to give its opinion as to whether the BIT was compatible with EU law.The fundamental problem with investor-state arbitration, in the court's view, is that they "remove from the jurisdiction of their own courts, and hence from the system of judicial remedies which [EU law] requires them to establish in the fields covered by EU law, disputes which may concern the application or interpretation of EU law".The ECJ decided that because arbitration tribunals set up through investor-state dispute settlement are not part of the EU judicial system, because such tribunals may resolve disputes that relate to the application or interpretation of EU law, and because the awards of the tribunal are not subject to review by member state courts, the decisions of these tribunals are not compatible with EU law.The immediate effect of the ECJ decision was that the people of Slovakia will not have to pay €22m to Achmea simply because their government decided that health insurance should not be for profit.But more broadly, this monumental decision casts a shadow on the legality of investor protection clauses in Europe's many free trade agreements, including CETA, currently in national ratification phase.Belgium had already requested the ECJ to determine whether the investment provisions in CETA are in compliance with the EU Treaties, but the court's reasoning in Achmea strongly suggests that the answer will be no.As an earlier decision by the ECJ clarified, the general duty of loyalty resulting from the Treaty of the EU is that member states have an obligation to "have recourse to the [Union] judicial system and to respect the court's exclusive jurisdiction, which is a fundamental feature of that system."As part of this duty of loyalty, member states are under a legal obligation not to ratify agreements that are contrary to EU law.As professor of European law at the University of Amsterdam and director of the Amsterdam Centre for European Law and Governance Christina Eckes puts, "In the light of the foreseeable risk that CJEU declares the CETA investment chapter to be capable of undermining the autonomy of the EU legal order, member states are required by the principle of EU loyalty to halt ratification."The Lithuanian Parliament ratified CETA last week, becoming the second country (after Sweden) to do so after Achmea scandal, and thus endangering European principles.Lithuania's decision to ratify CETA before the ECJ's decision not only violated the state's duty of loyalty to the EU, but is also contrary to the pro-European nature of Lithuania, whose institutions typically embraced EU law wholeheartedly.In support of their loyalty to the EU, other countries should not proceed with ratifying CETA until the ECJ has reached its ruling.In order to save the European project, a respect to EU law must be shown.Layla Hughes is Senior Attorney at the Center for International Environmental Law, Laura Gintalaite is a freelance trade campaigner.

Edmonton's Pride festival has rejected an application by Alberta's Opposition United Conservative Party to participate in its parade.The Edmonton Pride Festival Society says the party did not meet criteria that include connecting with the community, having policies and values that include the community and being sincere in an application."When the committee reviewed the application of the United Conservative Party, they found it did not meet expectations," the society said in a release Thursday.It said the party didn't include any actions it would take to support the LGBTQ community."Compared to other applications, the content was sparse," the society said. "It did not include any details as to how they would be supportive of the community, only that they say they will."In its application, which the party posted on Twitter, the United Conservatives said they believe in equality for all."It is important that Albertans understand that the United Conservative Party, as the official Opposition, is an inclusive and welcoming organization," said the application. "Beyond that, it is important to us to be a part of this vibrant and joyful celebration of Edmonton's LGBTQ2S+ community and to clearly demonstrate our support."Party leader Jason Kenney and his caucus declined to comment on the Pride decision. They called it a party matter and referred questions to the party.The United Conservative Party's executive director Janice Harrington said the application speaks for itself.Kris Wells, assistant professor in the education faculty at the University of Alberta, said he's not surprised that the application was rejected."Being in a Pride parade is a privilege not a right," he said. It shows ducking, diving, hiding from what your real agenda is."That shows a tremendous level of political cowardice."Deputy Premier Sarah Hoffman told the house it was cruel irony that the United Conservative members come to work every day surrounded by security in the legislature but would not vote to extend a modicum of the same protection to women exercising their medical rights."We're asking for them to have some safety, some protection and some dignity," said Hoffman.The bill would create 50 metre zones, tied to hefty fines, around abortion clinics to keep away those who would harass clinic patients and staff.Alberta's two main abortion clinics, in Edmonton and Calgary, already have civil restraining orders in place, but clinic officials say the protesters ignore them.The bill was voted on twice Thursday.About eight to 10 members were present on the UCP side to listen to debate in the morning and afternoon, but all left the chamber when the votes were called.The first vote was on a motion by Independent MLA Derek Fildebrandt, a former UCP member, who was turfed from caucus in a disagreement with Kenney.Fildebrandt said that while the abuse at the clinics is intolerable, the bill should be pulled and overhauled to broaden the no-abuse zone to other public venues as well.The NDP defeated the motion, but just before the vote Fildebrandt, scanning the sea of empty chairs to his right, elicited laughs from the NDP when he shouted across the aisle, "We should pass (the amendment) just to screw with them (the UCP)!"When the bill was voted on at second reading, Fildebrandt was the lone dissenter.After shouting "Nay" to the bill, he again scanned the void on his side of the chamber and then playfully announced himself as "Leader of the Opposition" to more laughs and desk-thumping.The Alberta Party, the Liberals and Independent PC member Richard Starke also voted for the bill in second reading, with more debate still to come.Alberta Party house leader Greg Clark said, "They (the UCP) are not doing their job as MLAs. If they want to vote against Bill 9 they should have the guts to do that. Prime Minister Justin Trudeau said Thursday recreational cannabis use will be legal by summer, despite calls from some senators to put off legalization by up to a year to allow for further consultation with Indigenous communities.Speaking to reporters alongside the Portuguese prime minister today, Trudeau said it should come as no surprise that the Liberal government is determined to enact its marijuana policy in its first mandate given the pre-election pledge the party made to dismantle prohibition."We have been working with our partners across the country to make this happen and we are going to be moving forward this summer on the legalization of cannabis," he said."Obviously, as I've said many times, this is not an event, this is a process, and we will continue to work with our partners in the municipalities, in provinces and Indigenous leadership in communities to make sure we're doing this right and moving forward in a responsible way."The Senate's Aboriginal peoples committee suggested Bill C-45, the legislation that will do away with criminal sanctions on adult cannabis possession, should be amended to allow for a delay in implementation of up to a year.Indigenous communities need more time, Senate told-The committee said the government should take the extra time to make certain "culturally sensitive" materials are available to warn Indigenous peoples about the risks of consuming cannabis, and to negotiate a revenue-sharing deal with First Nations governments to ensure they get a cut of the millions of dollars expected to be collected in excise taxes on the drug.The senators also recommended the federal government set aside 20 per cent of all licenses for cannabis producers for Indigenous peoples so they can pursue business ventures.Manny Jules, chief commissioner of the First Nations Tax Commission, urged senators to amend the bill to, among other things, give Indigenous communities the resources to develop cannabis-related laws and regulations on-reserve, fund campaigns to educate young people about the dangers of the drug and bolster First Nations police forces.The Senate committee, chaired by Liberal Saskatchewan Sen. Lillian Dyck, made those recommendations after hearing from a number of Indigenous representatives who said federal consultation with their communities on the bill has been woefully inadequate.The government has said the task force created by the government to study the issue before the introduction of legislation met with Indigenous peoples and heard their concerns.The 148-page Bill C-45 is silent on the role Indigenous communities will play under the new legal framework for cannabis. In fact, the word "Aboriginal" is mentioned only once in the "definitions" section of the bill.Chiefs gathered at special meeting of the Assembly of First Nations (AFN) this week also passed a resolution demanding the government give First Nations governments the authority they need to levy excise taxes on cannabis grown and sold on reserves. The First Nations Fiscal Management Act (FNFMA) would have to be amended to allow for such powers.Home cultivation challenged-The call for a delay comes as other stakeholders are raising the alarm about the plan to allow Canadians to grow up to four cannabis plants in their homes.The Canadian Real Estate Association (CREA) warned this week that allowing such small grow-ops to flourish could cause home prices to drop — or make some properties uninsurable because financial institutions are reluctant to protect properties once used for these purposes because of the possibility of structural damage.The country's police services say they also fear home-growing could lead to more property crime.As a result, two provinces — Quebec and Manitoba — have said they will ban home cultivation, despite the federal legislation.Trudeau said today he expects all provinces to follow the federal law as it's written — a signal to Quebec and Manitoba that the federal government might not stand for limits on the law's scope."The decision and the ways we have chosen to move forward are based on months, if not years, of consultations with experts and looking at best practices around the world and looking at the best way to eliminate criminal elements," Trudeau said in French."The decision on home cultivation of up to four plants was based on logic and evidence and it's one that we will continue to establish as part of the federal framework."Appearing before a Senate committee in March, Justice Minister Jody Wilson-Raybould said Ottawa would not challenge provincial laws on home cultivation, but the federal government could not stop individuals from taking the matter into their own hands."If that is the case, they would go to court and there would be discussions about the conflict of laws, if there is a conflict of laws between the provincial and the federal law. And if there is a conflict, then the federal law will prevail," Wilson-Raybould said.The Senate's social affairs committee is considering the amendment suggested by the Aboriginal peoples committee, and other recommendations made by four other Red Chamber committees studying the historic legislation.The Senate's leaders have agreed to have a third reading vote on or before June 7. If the Senate amends the bill, the House of Commons would then have to accept those changes before they take effect.The federal government has said that once the bill is passed, full legalization would follow eight to 12 weeks after to allow provinces to get their own systems up and running.
