A senior Muslim official in Jerusalem said Wednesday that worshipers would not return to the Temple Mount until Israel removes the new railings and cameras it installed after a deadly terror attack there, prolonging a crisis that Israel hoped it had resolved by making concessions at the site.Ikrema Sabri, head of the Supreme Islamic Committee, said that even after Israel removed metal detectors and cameras from the site, more steps were required to restore calm. He said mass prayer protests would continue until the gates of the compound were opened, metal railings and an iron bridge removed and all cameras taken down.He said a lawyer working on behalf of the Muslim administration of the holy site would be in touch with Israeli police about it.“We will not enter the mosque until these things are implemented,” he told The Associated Press. “Now we are awaiting the response of the police.”Israel’s security cabinet announced Monday that in place of the metal detectors it would employ non-intrusive “advanced technologies,” reportedly smart cameras that can detect hidden objects. A special Knesset committee on Wednesday kicked off its first debate on the contested Jewish nation-state bill, in a heated meeting that saw ministers and coalition lawmakers vowing to “make history” and opposition members warning the proposal could tip Israel into “apartheid” or “fascist” territory.The at-times-stormy meeting saw three opposition MKs — the Joint (Arab) List’s Ahmad Tibi and Osama Saadi and Meretz’s Ilan Gilon — removed for disruptions. Prime Minister Benjamin Netanyahu, who was slated to attend, backed out minutes before it began due to security consultations.From the coalition, Justice Minister Ayelet Shaked defended the bill — approved in its preliminary reading on May 10 — which would for the first time enshrine Israel’s Jewish character in its constitutional Basic Laws.Israel’s national identity is mentioned in a number of the country’s laws, but the 11 existing Basic Laws deal mostly with state institutions and the state’s democratic character. The nation-state bill, proponents say, would put Jewish values and democratic values on equal footing. Critics, however, say the bill effectively discriminates against Israel’s Arab and other minority communities.Some 120 countries have their anthems, 136 have references to the flag, and 170 have a national language anchored in their respective constitutions, Shaked said. Both parties have said they would support the version of the bill formulated by Likud MK Benny Begin, which is simply a paragraph-long affirmation that Israel is the homeland of the Jewish people.According to the language of Dichter’s bill, which forms the basis of the current discussions, the law is needed “to protect the status of Israel as the nation-state of the Jewish people in order to anchor in Israel’s Basic Laws the values of the State of Israel as a Jewish and democratic state, in the spirit of the Declaration of Independence.”According to the proposal, while every individual has the right “to preserve his culture, heritage, language and identity,” the right to realize self-determination “is unique to the Jewish people.” In another controversial clause, Arabic is changed from an official language to one with “special status,” which would ensure its speakers the “right to language-accessible state services.”Dichter, a former chief of the Shin Bet security agency, has lamented the “disinformation” about the bill, denying the bill downgrades the status of Arabic in Israel as an official language. He also dismissed claims the law compromises the rights of Israel’s Arab minority, saying it merely anchors Israel’s Jewish status while protecting the rights of other groups.Another clause that has been the subject of scrutiny is one that appears to suggest the High Court of Justice favor Israel’s Jewish character over its democratic one. The Court of Justice of the European Union on Wednesday decided to keep Hamas on the EU blacklist of terrorist organizations.The court thus surprisingly disqualified a 2014 ruling by a lower EU court that said Hamas should be removed from the list on procedural grounds, a move that sparked vehement protests from the Israeli government at the time.EU Ambassador to Israel Lars Faaborg-Andersen welcomed the decision.“The current listing of Hamas remains in force and the European Union continues to consider Hamas a terrorist organization,” he told The Times of Israel on Wednesday morning, minutes after the court issued its ruling. All restrictive measures against the group — an asset freeze and a ban against soliciting or mobilizing funds — remain in force, he added.Even if the court had decided differently, its ruling would have only applied to the Hamas’s status between 2010 and 2014 and would not have affected its current status, he stressed.In 2010, Hamas appealed its placement on the union’s list of terrorist organizations. Four years later, the EU’s General Court ruled in the group’s favor, arguing that insufficient evidence had been presented to merit the blacklisting. Hamas had been placed on the list based “not on acts examined and confirmed in decisions of competent authorities but on factual imputations derived from the press and the internet,” the court ruled in December 2014.The EU Council immediately appealed that decision. Wednesday’s ruling by the Luxembourg-based EU Court of Justice ruled in the Council’s favor.“We welcome the fact that the ECJ has upheld the EU Council’s appeal and set aside the judgment of the General Court concerning the listing of Hamas from 2010 to 2014. But such “national decisions” were only required for a group’s initial listing, not for their subsequent retention on the list, the court ruled. Hamas had been on the EU’s list of terrorist organizations since it was created in 2001.“The Court of Justice therefore sets aside the 2014 judgment of the General Court. It refers the case back to the General Court so that the latter may examine the facts and arguments on which it did not rule in its 2014 judgment. Since the General Court’s judgment has been set aside, the Council measures by which Hamas’ funds continue to be frozen are to remain in force for the time being.”In 2014, the General Court had also ruled that the Sri Lankan Tamil Tigers group be removed from the EU terror blacklist. He said mass prayer protests would continue until the gates of the compound were opened, metal railings and an iron bridge removed and all cameras taken down.He said a lawyer working on behalf of the Muslim administration of the holy site would be in touch with Israeli police about it.“We will not enter the mosque until these things are implemented,” he told The Associated Press. “Now we are awaiting the response of the police.”Israel’s security cabinet announced Monday that in place of the metal detectors it would employ non-intrusive “advanced technologies,” reportedly smart cameras that can detect hidden objects. A special Knesset committee on Wednesday kicked off its first debate on the contested Jewish nation-state bill, in a heated meeting that saw ministers and coalition lawmakers vowing to “make history” and opposition members warning the proposal could tip Israel into “apartheid” or “fascist” territory.The at-times-stormy meeting saw three opposition MKs — the Joint (Arab) List’s Ahmad Tibi and Osama Saadi and Meretz’s Ilan Gilon — removed for disruptions. The Court of Justice of the European Union on Wednesday decided to keep Hamas on the EU blacklist of terrorist organizations.The court thus surprisingly disqualified a 2014 ruling by a lower EU court that said Hamas should be removed from the list on procedural grounds, a move that sparked vehement protests from the Israeli government at the time.EU Ambassador to Israel Lars Faaborg-Andersen welcomed the decision.“The current listing of Hamas remains in force and the European Union continues to consider Hamas a terrorist organization,” he told The Times of Israel on Wednesday morning, minutes after the court issued its ruling. All restrictive measures against the group — an asset freeze and a ban against soliciting or mobilizing funds — remain in force, he added.Even if the court had decided differently, its ruling would have only applied to the Hamas’s status between 2010 and 2014 and would not have affected its current status, he stressed.In 2010, Hamas appealed its placement on the union’s list of terrorist organizations. Four years later, the EU’s General Court ruled in the group’s favor, arguing that insufficient evidence had been presented to merit the blacklisting. Hamas had been placed on the list based “not on acts examined and confirmed in decisions of competent authorities but on factual imputations derived from the press and the internet,” the court ruled in December 2014.The EU Council immediately appealed that decision. But such “national decisions” were only required for a group’s initial listing, not for their subsequent retention on the list, the court ruled. Hamas had been on the EU’s list of terrorist organizations since it was created in 2001.“The Court of Justice therefore sets aside the 2014 judgment of the General Court. It refers the case back to the General Court so that the latter may examine the facts and arguments on which it did not rule in its 2014 judgment.
