BRUSSELS, Today, 12:28-The EU’s top court ruled on Tuesday (16 May) that the EU-Singapore trade deal needs the ratification of member states, making future trade deals more difficult to conclude.The decision could make a post-Brexit trade deal easier if the UK and EU leave out investments, or deal with them in a separate agreement.The European Court of Justice (ECJ) in its ruling said that the 2013 free trade agreement with Singapore cannot be concluded by EU ratification alone in its current form, as it has elements that do not fall under the exclusive powers of the EU.Trade is an exclusive competence of the EU - set out in the Treaties - therefore this means that the European Commission usually has full say over trade deals with non-EU countries.However, the court argued that two provisions in the EU-Singapore agreement - non-direct foreign investment and dispute settlement between investors and countries - do not fall under the EU's exclusive competence. Therefore, national and regional parliaments will also need to approve it.The dispute settlement mechanism set up by the deal "removes disputes from the jurisdiction of the courts of the member states, [and] cannot be established without the member states’ consent," the Luxembourg-based court said in a press release.In its decision, however, the court has narrowed the competences it shares with the EU member states.In her non-binding opinion last December, the court’s advocate general, Eleanor Sharpston, had gone much further.Sharpston had also included trade and public procurement in transport services, intellectual property rights, and labour and environmental standards among shared competences.All in all, this means that the Singapore trade deal will have to go through a tortuous ratification process.The EU commission, which had asked the ECJ to clarify the matter, could also decide to split the deal into two parts: one with full EU competencies, with the other being subject to the approval of member states.-UK trade deal-The ruling could also have an impact on any future post-Brexit deal.The decision means that - unless the UK and the EU want to include an investment dispute settlement system or non-direct foreign investment in the post-Brexit trade deal - it will not need to go through the lengthy process of being ratified by some 38 national and regional parliaments.UK prime minister Theresa May was keen to avoid a long ratification process, which could have taken years to reach completion and created instability.May wants to wrap up the trade deal within the two-year period provided for exit negotiations from the EU - a timetable deemed unrealistic in Brussels.The Luxembourg-based court, loathed in London, might have actually made it easier for the UK prime minister to complete a trade deal if they leave out investments, or deal with them in a separate agreement.The European Council can also provisionally apply free trade agreements - which include competences shared with member states - without a legal time limit.But there are still no guarantees that May and her government can reach such an agreement within the two-year negotiating process.-Clearer, more difficult-While the ruling provides much-needed clarity on the EU's shared and exclusive competences, it will make future trade deals far more laborious.In this particular case with Singapore, the European Commission and the European Parliament had asked for clarification from the court because the deal is seen as a blueprint for more complex free trade agreements in the future.The commission had argued that it had the right to sign and conclude the agreement, seeing the area of trade as its exclusive competence.Member states said some parts of the deal fall under shared competences with the EU, and some should be the sole decision of national authorities.The court said the EU has exclusive competence on access to the EU single market for goods and services, including all transport services, public procurement, protection of direct foreign investments, provisions concerning intellectual property rights and sustainable development, anti-dumping rules, and dispute settlements (except for investments).-Canada conundrum-Putting the investment courts in the spotlight could spell trouble for other trade deals such as Ceta, the trade agreement reached with Canada.The Ceta deal also went through a drawn-out process of talks at the regional, national and EU level, leaving many EU officials frustrated.Last October, the government of the Belgian region of Wallonia almost torpedoed the deal when it presented last minute demands for changes, including criticisms on the investor dispute settlement system.The European Commission welcomed the ECJ ruling on Tuesday, saying it will carefully assess it and "engage with the European Parliament and Member States on the way forward."After the ruling, MEP Bernd Lange, chairman of the trade committee at the European Parliament, said the decision widened the EU’s competences on trade rules.“[The] EU institutions must now respond swiftly to ensure that the EU’s credibility and strength in trade policy and negotiations are not hampered,” he said.

BRUSSELS, Today, 09:24-The UK has blocked legal preparations for an EU military headquarters in the run-up to Brexit and national elections.Boris Johnson, its foreign minister, took the step at a meeting in Brussels on Monday (15 May) citing disagreements over “language”.“There’s a discussion still going on about some of the language there”, he said. “If they want to come together [on joint defence plans] … then, you know, we’re not going to stand in their way. BRUSSELS, Today, 09:27-A mafia gang in southern Italy has allegedly been stealing millions of euros intended for refugees, in a scam that involved a Catholic charity.Police on Monday (15 May) arrested some 68 people, including a local Catholic priest, for siphoning off €32 million, reportedly of EU funds, over the past decade."Some €32 million went straight into the clan's pocket," said assistant prosecutor Vincenzo Luberto.The money was intended to support arriving refugees at Cara "Sant'Anna", one of Italy's largest reception centres in Isola di Capo Rizzuto, Calabria.Sant'Anna centre can hold up to 1,500 migrants at a time, with reports emerging that many were left hungry - as the staff did not cook enough meals.L'Espresso magazine, which had published an investigation into the centre two years ago, found that managers were making money by starving the migrants."If the organisation was supposed to provide 500 meals, it provided 300 and the rest went hungry," said prosecutor Nicola Gratteri.An inspection in 2013 had also found that the centre was illegally hosting some 70 unaccompanied minors in aircraft hangars that had only two toilets.Police in Catanzaro in a statement said that the arrested were "accused of mafia association, extortion, carrying illegal weapons, fraud, embezzlement to the detriment of the state, (and) theft."The mafia is said to have inflated the numbers of people at the centre in an effort to pocket state money for so-called "ghost migrants".An Italian prosecutor alleged that a local priest, Edoardo Scordio, who was also detained in the sting operation, had pocketed some €132,000 this year alone for "spiritual services".The centre was run by the Catholic Misericordia association, which helped secure lucrative contracts to provide catering and other services to the centre.Police described Misericordia as "a cash withdrawal machine for the mafia."Misericordia also handles a migrant facility on the Italian island of Lampedusa. May, 09:29-Italy and Germany are reportedly seeking an EU mission to stabilise Libya's 5,000km southern border with neighbouring countries and curb migration.German newspaper Welt am Sonntag reported on Sunday (14 May) that the German interior minister, Thomas de Maiziere, and his Italian counterpart, Marco Minniti, want the mission set up between Libya and Niger.The ministers sent a joint-letter last week to the European Commission, saying that an EU mission at the border between the two nations was needed "as soon as possible.""The first months of this year have shown that our efforts up to this point have been insufficient. We must prevent hundreds of thousands of people who are in the hands of smugglers from risking their lives in Libya and the Mediterranean," the letter states.The letter, also seen by the French news agency AFP, says greater development and local support is needed for people living along the border. It also calls for "technical and financial support" to Libyan authorities.Abdulsalam Kajman, the vice president of the UN and EU-backed government seated in Tripoli, had also told Italy's Corriere della Sera newspaper on Sunday that Libya was willing to launch patrols with the help of other countries."If we don't resolve southern Libya's problems, we will not resolve the migrant issue," he said.Kajman added that Italy was prepared to help train a new patrol guard for the task.The plans are part of a broader effort to prevent people from leaving Libya on boats towards the EU and crack down on migrant smugglers.The exodus from the coast has increased by over 44 percent - when compared to the same period last year - with some 45,000 people having disembarked between January and mid-May so far.Another 1,200 have died in the attempt, according to figures provided by the Geneva-based International Organisation for Migration (IOM).The proposals come amidst another large rescue effort over the weekend. Some 484 people were plucked from boats in the Mediterranean on Saturday.The EU is already training the Libyan coast guard to rescue people inside the territory.But the plan has generated controversy given that those rescued are sent to any number of militia-run detention facilities within the country.-Human warehouses-"They are called detention centres, temporary reception centres, but actually they are human warehouses," Annemarie Loof, Doctors without Borders (MSF) programme manager for Libya, told MEPs in late April.Loof, who has visited the facilities, says some of the people being detained are sold into slavery and forced into prostitution."They are sold, you can sponsor a migrant if you wish, which means you pay a certain sum of money and take somebody home."Earlier this year, the EU had announced a €200 million package to financed projects around north Africa - geared towards migration in Libya.The EU commission says around €90 million will go to step up the protection of migrants and reinforce migration management in Libya.The money will be funnelled through organisations such as the IOM and United Nations refugee agency (UNHCR), among others.

BRUSSELS, Today, 12:28-The EU’s top court ruled on Tuesday (16 May) that the EU-Singapore trade deal needs the ratification of member states, making future trade deals more difficult to conclude.The decision could make a post-Brexit trade deal easier if the UK and EU leave out investments, or deal with them in a separate agreement.The European Court of Justice (ECJ) in its ruling said that the 2013 free trade agreement with Singapore cannot be concluded by EU ratification alone in its current form, as it has elements that do not fall under the exclusive powers of the EU.Trade is an exclusive competence of the EU - set out in the Treaties - therefore this means that the European Commission usually has full say over trade deals with non-EU countries.However, the court argued that two provisions in the EU-Singapore agreement - non-direct foreign investment and dispute settlement between investors and countries - do not fall under the EU's exclusive competence. Therefore, national and regional parliaments will also need to approve it.The dispute settlement mechanism set up by the deal "removes disputes from the jurisdiction of the courts of the member states, [and] cannot be established without the member states’ consent," the Luxembourg-based court said in a press release.In its decision, however, the court has narrowed the competences it shares with the EU member states.In her non-binding opinion last December, the court’s advocate general, Eleanor Sharpston, had gone much further.Sharpston had also included trade and public procurement in transport services, intellectual property rights, and labour and environmental standards among shared competences.All in all, this means that the Singapore trade deal will have to go through a tortuous ratification process.The EU commission, which had asked the ECJ to clarify the matter, could also decide to split the deal into two parts: one with full EU competencies, with the other being subject to the approval of member states.-UK trade deal-The ruling could also have an impact on any future post-Brexit deal.The decision means that - unless the UK and the EU want to include an investment dispute settlement system or non-direct foreign investment in the post-Brexit trade deal - it will not need to go through the lengthy process of being ratified by some 38 national and regional parliaments.UK prime minister Theresa May was keen to avoid a long ratification process, which could have taken years to reach completion and created instability.May wants to wrap up the trade deal within the two-year period provided for exit negotiations from the EU - a timetable deemed unrealistic in Brussels.The Luxembourg-based court, loathed in London, might have actually made it easier for the UK prime minister to complete a trade deal if they leave out investments, or deal with them in a separate agreement.The European Council can also provisionally apply free trade agreements - which include competences shared with member states - without a legal time limit.But there are still no guarantees that May and her government can reach such an agreement within the two-year negotiating process.-Clearer, more difficult-While the ruling provides much-needed clarity on the EU's shared and exclusive competences, it will make future trade deals far more laborious.In this particular case with Singapore, the European Commission and the European Parliament had asked for clarification from the court because the deal is seen as a blueprint for more complex free trade agreements in the future.The commission had argued that it had the right to sign and conclude the agreement, seeing the area of trade as its exclusive competence.Member states said some parts of the deal fall under shared competences with the EU, and some should be the sole decision of national authorities.The court said the EU has exclusive competence on access to the EU single market for goods and services, including all transport services, public procurement, protection of direct foreign investments, provisions concerning intellectual property rights and sustainable development, anti-dumping rules, and dispute settlements (except for investments).-Canada conundrum-Putting the investment courts in the spotlight could spell trouble for other trade deals such as Ceta, the trade agreement reached with Canada.The Ceta deal also went through a drawn-out process of talks at the regional, national and EU level, leaving many EU officials frustrated.Last October, the government of the Belgian region of Wallonia almost torpedoed the deal when it presented last minute demands for changes, including criticisms on the investor dispute settlement system.The European Commission welcomed the ECJ ruling on Tuesday, saying it will carefully assess it and "engage with the European Parliament and Member States on the way forward."After the ruling, MEP Bernd Lange, chairman of the trade committee at the European Parliament, said the decision widened the EU’s competences on trade rules.“[The] EU institutions must now respond swiftly to ensure that the EU’s credibility and strength in trade policy and negotiations are not hampered,” he said.

BRUSSELS, Today, 09:24-The UK has blocked legal preparations for an EU military headquarters in the run-up to Brexit and national elections.Boris Johnson, its foreign minister, took the step at a meeting in Brussels on Monday (15 May) citing disagreements over “language”.“There’s a discussion still going on about some of the language there”, he said. “If they want to come together [on joint defence plans] … then, you know, we’re not going to stand in their way. We’re just working on some of the language to make sure that we get it totally right”.The new HQ is to be an office inside the EU foreign service in Brussels that would take charge of EU military training missions, such as the ones in Mali or Somalia, which are currently run out of command centres in member states.The other 27 EU members had wanted to adopt a legal mandate for it on Monday which described it as an “operational” body, but the UK has said that would be a step too far toward the creation of an EU army that would duplicate Nato.Michael Roth, Germany’s EU affairs minister, said after listening to Johnson that he did not hear “a relevant argument” against going ahead.He also noted that the UK had already agreed, in March, to create the HQ. “The decision has already been taken in principle”, he said, according to Germany’s DPA news agency.Federica Mogherini, the EU foreign policy chief, said she hoped the HQ could still be put in place by the end of June.Echoing Roth, she said she told Johnson “very clearly” that it was the UK’s “responsibility” to allow the plan to go ahead after having agreed to it in March.“If you take a political decision then it’s your responsibility to allow this to become reality”, she said.Diplomats linked Johnson’s decision to Brexit and to the upcoming British election on 8 June in which his Conservative Party is trying to win votes by being “bloody difficult” with the EU."It is unfortunate that essential European security and defence projects have become hostage to domestic political moves," one EU diplomat told the Reuters news agency.Another one said: “If this issue is to be delayed until after the British elections in June and then approved, well OK”.But Polish foreign minister Witold Waszczykowski warned that events in the wider world “won’t wait until we agree with the UK on our divorce terms”.EU defence ministers will return to the topic in greater detail in Brussels on Thursday.The joint defence plans include a €500-million-a-year fund for research into drones and cyber defence technology.The fund is to be paid out of the EU budget, with the European Commission to unveil details in June.The plans also include joint arms procurement and making EU “battlegroups” more ready to intervene in conflicts in Africa and the Middle East.“A European army is not a project for the near future”, Commission head Jean-Claude Juncker told Salzburger Nachrichten, an Austrian newspaper, on Saturday.“It is, however, a project that would give additional weight to the European foreign and security policy. BRUSSELS, Today, 09:27-A mafia gang in southern Italy has allegedly been stealing millions of euros intended for refugees, in a scam that involved a Catholic charity.Police on Monday (15 May) arrested some 68 people, including a local Catholic priest, for siphoning off €32 million, reportedly of EU funds, over the past decade."Some €32 million went straight into the clan's pocket," said assistant prosecutor Vincenzo Luberto.The money was intended to support arriving refugees at Cara "Sant'Anna", one of Italy's largest reception centres in Isola di Capo Rizzuto, Calabria.Sant'Anna centre can hold up to 1,500 migrants at a time, with reports emerging that many were left hungry - as the staff did not cook enough meals.L'Espresso magazine, which had published an investigation into the centre two years ago, found that managers were making money by starving the migrants."If the organisation was supposed to provide 500 meals, it provided 300 and the rest went hungry," said prosecutor Nicola Gratteri.An inspection in 2013 had also found that the centre was illegally hosting some 70 unaccompanied minors in aircraft hangars that had only two toilets.Police in Catanzaro in a statement said that the arrested were "accused of mafia association, extortion, carrying illegal weapons, fraud, embezzlement to the detriment of the state, (and) theft."The mafia is said to have inflated the numbers of people at the centre in an effort to pocket state money for so-called "ghost migrants".An Italian prosecutor alleged that a local priest, Edoardo Scordio, who was also detained in the sting operation, had pocketed some €132,000 this year alone for "spiritual services".The centre was run by the Catholic Misericordia association, which helped secure lucrative contracts to provide catering and other services to the centre.Police described Misericordia as "a cash withdrawal machine for the mafia."Misericordia also handles a migrant facility on the Italian island of Lampedusa. The Arena clan behind the scam is part of the notorious Calabria-based 'Ndrangheta mafia.Europol, the EU police agency, in a 2013 threat assessment said that the 'Ndrangheta syndicate operates at a global level and is also found in Belgium, France, Germany, the Netherlands and Spain.The vast majority of people leaving north Africa to seek asylum in Europe end up in Italy.The UN refugee agency (UNHCR) says over 45,000 people have so far landed in Italy this year, out of a total of 53,000 arriving at sea.A separate police crackdown in Rome in 2014 revealed a similar mafia scam.

May, 09:29-Italy and Germany are reportedly seeking an EU mission to stabilise Libya's 5,000km southern border with neighbouring countries and curb migration.German newspaper Welt am Sonntag reported on Sunday (14 May) that the German interior minister, Thomas de Maiziere, and his Italian counterpart, Marco Minniti, want the mission set up between Libya and Niger.The ministers sent a joint-letter last week to the European Commission, saying that an EU mission at the border between the two nations was needed "as soon as possible.""The first months of this year have shown that our efforts up to this point have been insufficient. We must prevent hundreds of thousands of people who are in the hands of smugglers from risking their lives in Libya and the Mediterranean," the letter states.The letter, also seen by the French news agency AFP, says greater development and local support is needed for people living along the border. It also calls for "technical and financial support" to Libyan authorities.Abdulsalam Kajman, the vice president of the UN and EU-backed government seated in Tripoli, had also told Italy's Corriere della Sera newspaper on Sunday that Libya was willing to launch patrols with the help of other countries."If we don't resolve southern Libya's problems, we will not resolve the migrant issue," he said.Kajman added that Italy was prepared to help train a new patrol guard for the task.The plans are part of a broader effort to prevent people from leaving Libya on boats towards the EU and crack down on migrant smugglers.The exodus from the coast has increased by over 44 percent - when compared to the same period last year - with some 45,000 people having disembarked between January and mid-May so far.Another 1,200 have died in the attempt, according to figures provided by the Geneva-based International Organisation for Migration (IOM).The proposals come amidst another large rescue effort over the weekend. Some 484 people were plucked from boats in the Mediterranean on Saturday.The EU is already training the Libyan coast guard to rescue people inside the territory.But the plan has generated controversy given that those rescued are sent to any number of militia-run detention facilities within the country.-Human warehouses-"They are called detention centres, temporary reception centres, but actually they are human warehouses," Annemarie Loof, Doctors without Borders (MSF) programme manager for Libya, told MEPs in late April.Loof, who has visited the facilities, says some of the people being detained are sold into slavery and forced into prostitution."They are sold, you can sponsor a migrant if you wish, which means you pay a certain sum of money and take somebody home."Earlier this year, the EU had announced a €200 million package to financed projects around north Africa - geared towards migration in Libya.The EU commission says around €90 million will go to step up the protection of migrants and reinforce migration management in Libya.The money will be funnelled through organisations such as the IOM and United Nations refugee agency (UNHCR), among others.
