The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision — Planned Parenthood v. Casey — that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”Deliberations on controversial cases have in the past been fluid. Justices can and sometimes do change their votes as draft opinions circulate and major decisions can be subject to multiple drafts and vote-trading, sometimes until just days before a decision is unveiled. The court’s holding will not be final until it is published, likely in the next two months.The immediate impact of the ruling as drafted in February would be to end a half-century guarantee of federal constitutional protection of abortion rights and allow each state to decide whether to restrict or ban abortion. It’s unclear if there have been subsequent changes to the draft.No draft decision in the modern history of the court has been disclosed publicly while a case was still pending. The unprecedented revelation is bound to intensify the debate over what was already the most controversial case on the docket this term.The draft opinion offers an extraordinary window into the justices’ deliberations in one of the most consequential cases before the court in the last five decades. Some court-watchers predicted that the conservative majority would slice away at abortion rights without flatly overturning a 49-year-old precedent. POLITICO received a copy of the draft opinion from a person familiar with the court’s proceedings in the Mississippi case along with other details supporting the authenticity of the document. The draft opinion runs 98 pages, including a 31-page appendix of historical state abortion laws. The document is replete with citations to previous court decisions, books and other authorities, and includes 118 footnotes. The appearances and timing of this draft are consistent with court practice.The disclosure of Alito’s draft majority opinion — a rare breach of Supreme Court secrecy and tradition around its deliberations — comes as all sides in the abortion debate are girding for the ruling. Speculation about the looming decision has been intense since the December oral arguments indicated a majority was inclined to support the Mississippi law.Under long-standing court procedures, justices hold preliminary votes on cases shortly after argument and assign a member of the majority to write a draft of the court’s opinion. The draft is often amended in consultation with other justices, and in some cases the justices change their votes altogether, creating the possibility that the current alignment on Dobbs v. Jackson Women’s Health Organization could change.The chief justice typically assigns majority opinions when he is in the majority. When he is not, that decision is typically made by the most senior justice in the majority.‘Exceptionally weak’A George W. Bush appointee who joined the court in 2006, Alito argues that the 1973 abortion rights ruling was an ill-conceived and deeply flawed decision that invented a right mentioned nowhere in the Constitution and unwisely sought to wrench the contentious issue away from the political branches of government.Alito’s draft ruling would overturn a decision by the New Orleans-based 5th Circuit Court of Appeals that found the Mississippi law ran afoul of Supreme Court precedent by seeking to effectively ban abortions before viability.Roe’s “survey of history ranged from the constitutionally irrelevant to the plainly incorrect,” Alito continues, adding that its reasoning was “exceptionally weak,” and that the original decision has had “damaging consequences.”“The inescapable conclusion is that a right to abortion is not deeply rooted in the Nation’s history and traditions,” Alito writes.Alito approvingly quotes a broad range of critics of the Roe decision. He also points to liberal icons such as the late Justice Ruth Bader Ginsburg and Harvard Law Professor Laurence Tribe, who at certain points in their careers took issue with the reasoning in Roe or its impact on the political process.Alito’s skewering of Roe and the endorsement of at least four other justices for that unsparing critique is also a measure of the court’s rightward turn in recent decades. Roe was decided 7-2 in 1973, with five Republican appointees joining two justices nominated by Democratic presidents.The overturning of Roe would almost immediately lead to stricter limits on abortion access in large swaths of the South and Midwest, with about half of the states set to immediately impose broad abortion bans. We now overrule those decisions and return that authority to the people and their elected representatives.”The draft contains the type of caustic rhetorical flourishes Alito is known for and that has caused Roberts, his fellow Bush appointee, some discomfort in the past.At times, Alito’s draft opinion takes an almost mocking tone as it skewers the majority opinion in Roe, written by Justice Harry Blackmun, a Richard Nixon appointee who died in 1999.“Roe expressed the ‘feel[ing]’ that the Fourteenth Amendment was the provision that did the work, but its message seemed to be that the abortion right could be found somewhere in the Constitution and that specifying its exact location was not of paramount importance,” Alito writes.Alito declares that one of the central tenets of Roe, the “viability” distinction between fetuses not capable of living outside the womb and those which can, “makes no sense.”supreme court-How rare is a Supreme Court breach? The phrase was also contained in an opinion Kavanaugh wrote as part of a 2020 ruling that jury convictions in criminal cases must be unanimous.In that opinion, Kavanaugh labeled two well-known Supreme Court decisions “egregiously wrong when decided”: the 1944 ruling upholding the detention of Japanese Americans during World War II, Korematsu v. But the comparison underscores the conservative justices’ belief that Roe is so flawed that the justices should disregard their usual hesitations about overturning precedent and wholeheartedly renounce it.Alito’s draft opinion ventures even further into this racially sensitive territory by observing in a footnote that some early proponents of abortion rights also had unsavory views in favor of eugenics.“Some such supporters have been motivated by a desire to suppress the size of the African American population,” Alito writes. “It is beyond dispute that Roe has had that demographic effect. A highly disproportionate percentage of aborted fetuses are black.”Alito writes that by raising the point he isn’t casting aspersions on anyone. “For our part, we do not question the motives of either those who have supported and those who have opposed laws restricting abortion,” he writes.Alito also addresses concern about the impact the decision could have on public discourse. “We cannot allow our decisions to be affected by any extraneous influences such as concern about the public’s reaction to our work,” Alito writes. “We do not pretend to know how our political system or society will respond to today’s decision overruling Roe and Casey. And even if we could foresee what will happen, we would have no authority to let that knowledge influence our decision.”In the main opinion in the 1992 Casey decision, Justices Sandra Day O’Connor, Anthony Kennedy and Davis Souter warned that the court would pay a “terrible price” for overruling Roe, despite criticism of the decision from some in the public and the legal community.“While it has engendered disapproval, it has not been unworkable,” the three justices wrote then. “An entire generation has come of age free to assume Roe‘s concept of liberty in defining the capacity of women to act in society, and to make reproductive decisions; no erosion of principle going to liberty or personal autonomy has left Roe‘s central holding a doctrinal remnant.”When Dobbs was argued in December, Roberts seemed out of sync with the other conservative justices, as he has been in a number of cases including one challenging the Affordable Care Act.At the argument session last fall, Roberts seemed to be searching for a way to uphold Mississippi’s 15-week ban without completely abandoning the Roe framework.“Viability, it seems to me, doesn’t have anything to do with choice. But, if it really is an issue about choice, why is 15 weeks not enough time?” Roberts asked during the arguments. “The thing that is at issue before us today is 15 weeks.”-Nods to conservative colleagues-While Alito’s draft opinion doesn’t cater much to Roberts’ views, portions of it seem intended to address the specific interests of other justices. One passage argues that social attitudes toward out-of-wedlock pregnancies “have changed drastically” since the 1970s and that increased demand for adoption makes abortion less necessary.Those points dovetail with issues that Barrett — a Trump appointee and the court’s newest member — raised at the December arguments. She suggested laws allowing people to surrender newborn babies on a no-questions-asked basis mean carrying a pregnancy to term doesn’t oblige one to engage in child rearing.“Why don’t the safe haven laws take care of that problem?” asked Barrett, who adopted two of her seven children.Much of Alito’s draft is devoted to arguing that widespread criminalization of abortion during the 19th and early 20th century belies the notion that a right to abortion is implied in the Constitution.The conservative justice attached to his draft a 31-page appendix listing laws passed to criminalize abortion during that period. Alito claims “an unbroken tradition of prohibiting abortion on pain of criminal punishment…from the earliest days of the common law until 1973.”“Until the latter part of the 20th century, there was no support in American law for a constitutional right to obtain an abortion. Zero. None. No state constitutional provision had recognized such a right,” Alito adds.Alito’s draft argues that rights protected by the Constitution but not explicitly mentioned in it — so-called unenumerated rights — must be strongly rooted in U.S. history and tradition. That form of analysis seems at odds with several of the court’s recent decisions, including many of its rulings backing gay rights.“We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision....” Justice Samuel Alito in an initial draft majority opinion-Liberal justices seem likely to take issue with Alito’s assertion in the draft opinion that overturning Roe would not jeopardize other rights the courts have grounded in privacy, such as the right to contraception, to engage in private consensual sexual activity and to marry someone of the same sex.“We emphasize that our decision concerns the constitutional right to abortion and no other right,” Alito writes. “Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion.”Alito’s draft opinion rejects the idea that abortion bans reflect the subjugation of women in American society. “Women are not without electoral or political power,” he writes. “The percentage of women who register to vote and cast ballots is consistently higher than the percentage of men who do so.”The Supreme Court remains one of Washington’s most secretive institutions, priding itself on protecting the confidentiality of its internal deliberations.“At the Supreme Court, those who know don’t talk, and those who talk don’t know,” Ginsburg was fond of saying.That tight-lipped reputation has eroded somewhat in recent decades due to a series of books by law clerks, law professors and investigative journalists. Some of these authors clearly had access to draft opinions such as the one obtained by POLITICO, but their books emerged well after the cases in question were resolved.The justices held their final arguments of the current term on Wednesday. The court has set a series of sessions over the next two months to release rulings in its still-unresolved cases, including the Mississippi abortion case.

CBC-Police assuage council's fears about Rolling Thunder rally-Wed, April 27, 2022, 12:28 p.m

Ottawa's acting police chief and the city's head of emergency services assured council Wednesday they'll do what they can to keep an impending weekend motorcycle rally from turning into another long-term occupation.Unlike the Freedom Convoy, which arrived in the city in late January and stayed for weeks, "Rolling Thunder Ottawa" isn't specifically promoting a petition for changing COVID-19 rules.Rather, the rally has aligned itself with groups with various motives, including a veterans' group aimed at restoring "fundamental rights and freedoms" and a non-profit dedicated to the "end of all tyrannical bills and legislation."They plan to hold a Friday evening demonstration on Parliament Hill, a Saturday morning service at the National War Memorial, another Saturday afternoon Hill demonstration and a Sunday church service in Vanier.Ottawa police have already announced vehicles involved in the demonstration won't be permitted inside an exclusionary zone around Parliament Hill and the ByWard Market. Normal residential and business traffic — both vehicle and pedestrian — will be allowed.Speaking inside council chambers Wednesday, acting police chief Steve Bell said residents would see a large police presence, with officers from Ottawa police, other municipal forces, the Ontario Provincial Police and RCMP out on neighbourhood streets.Police are planning for more than 500 motorcycles on the streets, Bell said. A "heavy" contingent of officers would monitor the Saturday afternoon ride, he said, with tow trucks and physical barriers available should they be needed.Any display of swastikas or other hateful symbols during the weekend would lead to charges, Bell said."I want to be clear with both organizers and participants: you will be held accountable for your actions before, during and after events," he said.According to a statement posted on their website, Rolling Thunder Ottawa does not "support blockades, obstruction of police performing their duties, damage to property, or hate and vitriol directed to the residents of Ottawa."Trying to find 'least intrusive' route-Several city councillors close to the downtown expressed concerns about maps being floated on social media, suggesting the rally might descend on residential streets in their wards."[They've] laid down areas on Sunnyside, laid down areas on Hopewell — where there's a large school with 900 students and a community centre. I'm seeing laid-down areas at the RA Centre as well as through Old Ottawa East and on to Bronson," said Capital ward Coun. Shawn Menard."What is the plan for the protection of residential areas when this is occurring?"We can work to find the least intrusive, least offensive way for our community — and the safest way — to actually move those bikes through the city. - Acting police chief Steve Bell-Police are still talking with city staff about adding to the existing exclusionary zone, Bell said."There are bikes attending our city this weekend. And we absolutely have no ability to prevent that from happening," said the acting chief, replying to a question from Rideau-Vanier Coun. Mathieu Fleury about concerns the bikers could flood Rideau Street and Montreal Road."What we can do is we can work to find the least intrusive, least offensive way for our community — and the safest way — to actually move those bikes through the city."As for the Saturday ride, Bell told council it would roll through "a portion of the city" before exiting along Nicholas Street to Highway 417.He told reporters after the meeting the official route would likely be released Thursday or Friday.Transit should run normally-The City of Ottawa, meanwhile, has said it will have bylaw officers out enforcing the rules during the weekend.Those include expanded parking restrictions, a Tuesday news release said, and any vehicles found in no-stopping zones will be ticketed and/or towed.Staff are still finalizing traffic management plans, said general manager of emergency and protective services Kim Ayotte. OTTAWA — The Ottawa police services board has approved the appointment of up to 831 RCMP officers to help municipal police, who are promising a heavy presence in the capital and zero tolerance for hate this weekend.Ottawa police asked the board to approve the expedited appointment of "up to 200" additional officers as they prepare for a second convoy, this time involving hundreds of motorcycles instead of trucks.As many as 631 RCMP members who were appointed to help end the downtown blockade in February could also be reappointed as needed.The Ottawa Police Service says it's asking for those appointments to expire on July 4 "in anticipation of additional events and demonstrations." They typically last five years.Interim police chief Steve Bell told Ottawa city councillors earlier on Wednesday that his force has no intention of letting the “Rolling Thunder Convoy” turn into another illegal occupation, and that officers will act quickly when they see any wrongdoing.“Threatening or intimidating behaviours will be addressed with all appropriate enforcement action,” Bell said.“Investigative teams, including our hate crime unit, are in place focused on gathering evidence and laying charges where appropriate. The display of symbols of hate like swastikas will result in charges.”The chief also sought to reassure residents still shaken by the “Freedom Convoy,” in which hundreds of protesters occupied the downtown core for three weeks to protest COVID-19 restrictions and demand the Liberal government resign.The occupation disrupted traffic, forced businesses to close, and sparked complaints of intimidation, harassment and hateful conduct. Relentless honking of air horns from big rigs disturbed residents for days. Police chief Peter Sloly resigned after many criticized police for not taking a harder line with the protesters.The demonstration, which also disrupted several border crossings with the United States, ended after the federal Liberal government invoked the Emergencies Act, and police moved in to detain and arrest dozens of people.In a message directed to Ottawa residents, Bell said the police won't "allow for unsafe or unlawful conditions that could lead to another protest."“We’ve heard your concerns,” he said. “We know that you are still healing from the disruption and criminality."The Rolling Thunder group has not been clear about the cause they’re rallying for, except to say that they will be in Ottawa to “peacefully celebrate our freedom.”The website for “Rolling Thunder Ottawa” said it is partnered with the groups Veterans for Freedom and Freedom Fighters Canada, both of which appear to have links to the Freedom Convoy.Veterans for Freedom describes itself on its website as a group made up of Canadian veterans working to “restore fundamental freedoms for all Canadians” and “uphold Canadian laws.”The members of that group’s steering committee all have ties to the earlier protests, including one who was among the convoy’s spokespeople. Others appeared in YouTube videos supporting convoy demonstrators.Freedom Fighters Canada’s website says it is an organization “demanding the end of all government mandates” and the end of “tyrannical legislation.” Some of its organizers also attended or supported the earlier protests publicly.Bell told councillors that police are in touch with the Rolling Thunder organizers, who expect more than 500 motorcycles to arrive in the city. Fences were installed but later torn down by demonstrators.Several councillors representing areas around the downtown core raised concerns about reports convoy participants plan to set up in or ride through different neighbourhoods, and asked what police plan to do about it.There were also concerns about the ride interfering with a major bicycle fundraiser for the Children’s Hospital of Eastern Ontario, which is scheduled for Saturday.Bell indicated police would be keeping close tabs on the Rolling Thunder convoy during its ride through the city, backed up with tow trucks and physical barriers. SABHA, Jordan (AP) — Efforts to restore damaged but once fertile land in Jordan’s desert is sprouting hope for one of the world’s most water-scarce nations, as a land assessment report Wednesday warned of the growing scale of global degradation.Local organizations believe projects that reintroduce native plants and implement smart water harvesting systems will cushion the impacts of climate change and desertification, which are only set to worsen, according to the United Nations report.The UN desertification agency says 40% of land globally is currently degraded, blaming unsustainable land and water management, poor agricultural practices, mining, urbanization and infrastructure development for the land’s deterioration.Mira Haddad, from the International Center for Agricultural Research in the Dry Areas said several other factors, including “overexploitation of vegetation cover, overgrazing, and… new land practices” as well as climate change are also contributing to land degradation in Jordan.But environmentalists are already pursuing options to ward off further damage. One of the efforts, run by the Watershed and Development Initiative, is introducing four native plants to 10,000 acres (41 square kilometers) of desert in the Sabha reserve, roughly 56 miles (90 kilometers) east of the Jordanian capital Amman.“We’re working on the water, we’re working on the green cover and we’re working also with the habitats of the creatures, from insects to animals and all living parts of that ecosystem,” Deyala Tarawneh, a WADI founding member, said. “The success rate of these plants is 85%, which is considered a very high percentage, and they only need to be watered once, which is also reducing the amount of water needed for the irrigation of the green areas.”But despite the success of WADI’s planting initiative, land restoration in Jordan is still facing several challenges: the number of land unit areas available for restoration is lacking, and the willingness of local communities to leave the land for at least one or two rainy seasons without grazing is also hindering efforts, said ICARDA’s Haddad.Jordan is one of several countries already grappling with the effects of degradation, with more than 2.3 billion people currently living in water-stressed countries, according to the UN report. It warned that more food supply disruptions, forced migration and greater pressure on species survival are also expected as climate change intensifies and poor land management practices continue. By 2030, it warns that 700 million people could be displaced by drought.“The situation we have right now is unhealthy and certainly not acceptable,” Ibrahim Thiaw, the executive secretary of the UN desertification agency, told The Associated Press. “The more you degrade land the more you emit carbon and the more you contribute to climate change.”The report calls for financial support to bolster conservation and restoration in developing countries. It says the expansion of protected areas and conservation hotspots, better water management, smart agriculture, and the rewilding of biodiversity can be boosted by appropriate funding.If these kinds of measures are implemented on a wider scale, the UN agency’s restoration scenario predicts reduced biodiversity loss and improved soil health, with the benefits particularly felt in North and sub-Saharan Africa, the Middle East, and Latin America.But it also notes that inaction would lead to 16 million square kilometers (6 million square miles) — nearly the size of the entire South American continent — of land degradation by 2050.The report also recommends scaling up land rights for Indigenous peoples and local communities, urging farmers to draw on ample lessons about land restoration, crop adaptation and livestock from established customs and traditional knowledge.“We welcome new allies to this battle, including economic actors who are increasingly interested in avoiding climate risk, but we must make clear that we will not be used for greenwashing,” José Gregorio Diaz Mirabal, the leader of the Congress of Indigenous Organizations of the Amazon Basin, said in a statement. “Partnering with Indigenous peoples requires embracing transformative change.”The UN’s Thiaw agreed that support for restoration projects should be ramped up.“The message from the report is that do not take land degradation as a fatality. It can be addressed, and it is the cheapest solution to the climate crisis and biodiversity loss. It is possible to do it by 2050, which is just one generation,” Thiaw said. “It does not require high tech nor a Ph.D. to undertake. Land restoration is accessible and democratic.”Several countries, like Jordan, are already addressing their own land issues, from drought preparedness programs in Mexico, the USA and Brazil, to the 11-country Great Green Wall in Africa aimed at restoring 100 million hectares (390,000 square miles) of degraded landscapes along the Sahel.“Land restoration is a win for the environment, economy, society, and for biodiversity,” said Thiaw. “What we are calling for now is the acceleration of such programs.”
