Apr, 14:03-Last week, the former Catalan president, Carles Puigdemont, was remanded in custody by a court in Germany pending a decision on whether to extradite him to Spain to face charges of rebellion, sedition and misuse of public funds in relation to the referendum and subsequent declaration of independence in Catalonia.Puigdemont's extradition is being sought via a European Arrest Warrant, the EU's flagship crime-fighting measure, a fast-track extradition regime through which an arrest warrant issued in one EU country is given effect in another.Anyone who cares about justice in the EU should be wary of the situation facing Puigdemont today.How he came to be arrested and detained in Germany says much about the future of the "area of freedom, security and justice" established in the EU in the 1997 Treaty of Amsterdam.The European area of freedom, security and justice grew out of the need to guarantee the 'four freedoms' of Europe: the freedom of movement of goods, capital, services and people within the EU.In order to protect citizens and safeguard their freedoms, the need arose to break down barriers and disparities between EU member states with regard to internal security, the fight against crime, and the rights guaranteed to people moving from one country to another.At heart, the concept is that people should not be able to escape justice by simply moving across European borders; but equally they should expect their rights to be similarly respected no matter where in Europe they are.Puigdemont's arrest in Germany under a European Arrest Warrant challenges those principles to their very core.This was not the first time that a European Arrest Warrant had been issued by Spain for Puigdemont.Puigdemont was arrested in Belgium on an near-identical European Arrest Warrant in November.-Belgian impasse-The case spent weeks in litigation before the Belgian courts, with his lawyers arguing that his human rights, including his right to a fair trial, would be violated if he were surrendered to Spain, that the crimes that he was being accused of had no corresponding basis in Belgian law (a necessary pre-condition to extradition), and that the arrest warrant was merely another tool being used by the Spanish authorities to crack down on people advocating for the independence of Catalonia.The Belgian courts were not given the chance to rule on these issues, however.Once it became clear that the Belgian courts were not going to blindly execute the arrest warrant, the Spanish Supreme Court ordered it withdrawn.The decision was based in large part on the Spanish court's reluctance to have Belgian courts looking into the situation in Spain or perhaps worse, deciding to refuse the request.In essence, the court did not want the Belgian courts to look through Spain's dirty laundry.And they got their wish: the Belgian courts did not rule on Puigdemont's arguments, he was released and settled down into a house and life in the Brussels suburbs.On 23 March, however, a new European Arrest Warrant was issued by Spain related to Puigdemont and others based on the very same charges.Puigdemont was in Finland at the time. According to reports, upon learning of the new arrest warrant, he immediately sought to return home to Belgium.But he was being followed by the Spanish intelligence service during his drive back home.Upon his crossing from Denmark into Germany – a country which has crimes similar to those he has been accused of in Spain – the intelligence agents reportedly alerted the German authorities to his presence in the country and he was arrested there.Quite why Puigdemont was not arrested in Finland or Denmark on his way back to Belgium, or indeed left to return home to Belgium to reopen the proceedings there, is unknown.But given the reasons for the withdrawal of the original arrest warrant, the timing of its re-issuance, and the reported presence and proactive approach of the Spanish intelligence service, the impression that is left is that arrest in Germany, a country through which Puigdemont was merely transiting, was a strategic choice.There are no rules within the European Arrest Warrant system preventing countries from strategically withdrawing and then reissuing arrest warrants at more convenient times, in more convenient places.But perhaps there should be.Puigdemont's case sets a dangerous precedent that runs directly contrary to the goal of the European area of freedom, justice and security that EU citizens should expect to be treated equally throughout the Union.Gaming the European Arrest Warrant? It creates the possibility that the European Arrest Warrant can be used as a threat, preventing EU citizens exercising their rights of freedom of movement, issued wherever extradition is most likely, but withdrawn if the court does not appear to be finding in the government's favour, thus preventing the subject's rights from being protected and enforced by a court of law.With the rise of governments across Europe that are increasingly hostile to independent voices – notably in Poland and Hungary where an independent judiciary and civil society are under attack respectively – the prospect of a European Arrest Warrant system that can be gamed for political or strategic purposes like this should be avoided at all costs.Since its founding, we at Fair Trials have been advocating for fairer cross-border criminal justice cooperation mechanisms.We are firmly of the belief that such mechanisms must respect human rights, be free of politicisation and subject to the rule of law in order to be efficient and effective.We have long argued that improved human rights safeguards are needed in the European Arrest Warrant system in order to increase the level of trust that the countries of the EU have in each other's criminal justice systems and, thus, to ease the process of extradition.Such considerations are at the very heart of the European area of freedom, security and justice for which Puigdemont's case marks a worrying new chapter.Ralph Bunche is the Europe director of Fair Trials, a global justice watchdog.

Opinion-Securing 'rule of law' with economic power By Israel Butler-APR 3,18-EUOBSERVER

BRUSSELS, Today, 10:10-Negotiations on the next seven-year spending plan give the EU the chance to harness its economic power to protect the rule of law.Faced with a smaller EU budget after Brexit, some capitals have argued that governments that violate the rule of law should lose their entitlement to EU financial support, in particular access to 'structural funds'.Some insist that making receipt of these funds conditional on respect for the rule of law is neither feasible nor desirable.I disagree.It is legally sound, fair and can benefit the public. And in contrast to the slow and uncertain process behind Article 7, which for Hungary is gently meandering its way through the European Parliament and for Poland seems to have fallen down the back of the Council's sofa, conditionality can lead to swift and tangible consequences.According to the Treaty on European Union, the EU's "aim is to promote peace, its values and the well-being of its peoples." Every policy, law and power of the EU is supposed to serve this goal.Financing governments that undermine the rule of law, like those in Poland and Hungary runs against the core goals of the EU.Some argue that economic sanctions are inherently discriminatory because they will be felt much more acutely by less prosperous countries in central and eastern Europe.The argument is akin to saying that police should never run after suspects because it's not fair on criminals with short legs.EU funds can already be cut off as a sanction on governments when they fail to comply with EU public spending limits, or when they violate rules on how they should spend EU funds.The relevant laws require the EU to take the given country's economic situation into account to ensure that sanctions aren't disproportionately harsh.The fact that richer countries can resist economic sanctions more easily is surely reason to expand the toolbox rather than throw away the hammer. Different countries have different pressure points.Countries with a genuinely free press will be more sensitive to international political pressure.Countries with an independent judiciary will be more sensitive to legal challenges.And less prosperous countries with neither will be more sensitive to economic sanctions.-Civil liberty-Some have argued that conditioning funds on respect for the rule of law is unworkable because the notion can't be measured. This simply isn't true.At its core the rule of law is a requirement that individuals should have access to impartial, independent and effective courts to protect their freedoms.This is a very old civil liberty with a very precise legal definition built on sixty years of case law from European and international courts.EU rules on structural funds already contain requirements for governments to set up bodies according to certain criteria to administer and monitor how those funds are spent.The EU can simply add another requirement, that as a backup to these bodies, individuals must have prompt access to an effective remedy before an independent national court.Technically, this is already part of EU law, following a case by the EU's Court of Justice, but the commission department responsible for structural funds (the directorate general for regional and urban policy) hasn't been enforcing it.Commission officials are already equipped with guidelines to help them decide when governments have broken the rules and when funds should be cut. A requirement for independent courts can simply be slotted into existing procedures, with one proviso.The commission currently relies on national authorities to self-report about compliance. To make the new requirement effective, that practice has to change, and the commission has to independently check the health of national courts.-Stoking scepticism-Some have argued that conditionality could backfire by harming the general public and allowing targeted governments to stoke euroscepticism.This is only a realistic danger if the EU wields the tool clumsily.The commission could be given discretion to take over the selection and management of projects from national authorities, rather than cutting off funds completely, in cases where stopping funds would have a direct negative impact on the public.Management could then be handed over to an executive agency - the commission has power to set up such bodies to administer EU funding programmes for fixed periods of time.This would allow the EU to do some awareness-raising of its own and advertise that funding for the public benefit is coming from Brussels, and also minimise the risk of funding being misused through government corruption or cronyism.Authoritarian populists continue enjoy increasing electoral success across the EU and to pursue policies that undermine the rule of law.As they grow in strength, the EU's room for manoeuvre will become more limited. Current negotiations on the multi-annual financial framework may be the last opportunity for the EU to use its economic muscle to preserve its values.Israel Butler is head of advocacy at Civil Liberties Union for Europe.

Toronto police are withdrawing their application to march in the city's Pride parade, the force's chief announced Tuesday after event organizers said the presence of uniformed officers would make members of the LGBTQ community feel unsafe.Chief Mark Saunders said he hopes the move "will be received as a concrete example" of the fact that he is listening closely to the community's concerns."I am committed thoroughly to building a better, stronger relationship between us," Saunders said in a statement. "Much more work is needed, of course. But hopefully this moment moves us forward in an important way."Pride Toronto and other community groups had posted a letter online Monday night asking police to withdraw their application, saying the force should work instead on better communication with the LGBTQ community.Olivia Nuamah, Pride Toronto's executive director, said the force's handling of several high-profile deaths connected to the city's gay village, including the disappearances of six men allegedly murdered by an accused serial killer, have shaken community relations with police."In asking them to (withdraw), instead of spending that time planning their participation in the parade, what (we hope police) would do is spend that time planning how to better consult with the LGBTQ community about what it thinks it needs to keep itself safe," Nuamah said in an interview before Saunders announced his decision.Several LGBTQ groups have said police did not seriously consider community fears that a serial killer was targeting men in the gay village. Relations were further strained when Saunders told a newspaper in Feburary that "nobody'' came to officers with information in 2012, when police launched an ultimately unsuccessful investigation into men missing from the area."Pride was born out of protest. It actually was born out of resistance to police," Nuamah said. "That's the context in which the community feels shaken, and it comes together to show strength and unity."Individual officers will still be allowed to participate in the parade if they leave their uniforms, cruisers and guns at home, as those are police symbols that make the LGBTQ community feel unsafe, Nuamah added.Police presence at the parade emerged as a contentious issue in 2016 — that year's march was interrupted by the local chapter of Black Lives Matter, which said it opposed uniformed officers being in the parade because their presence could discourage marginalized communities from participating.The issue was thrust under the spotlight again in January last year, when Pride Toronto adopted a list of demands issued by Black Lives Matter that included banning police floats from the parade. The following month, Saunders announced the force would not be participating in 2017's event.On Tuesday, the chief said he had hoped to see uniformed officers invited back to march in the 2018 parade, but said he understands that insisting they be allowed to participate could set back progress made with the community."I strongly believe that we should be working toward a time when this issue is no longer a point of controversy and where the participation of our members in the Pride Parade is accepted and welcomed," he said. "The Toronto Police Service will work hard over the course of the next year toward that end."Mike McCormack, the president of the union that represents Toronto police officers, said he thinks Saunders made the wrong move."We don't think this fosters a conversation or a narrative that's positive. We think that this type of action drives a wedge deeper in the community and policing, and it's disappointing to our members," he said.But Alok Mukherjee, the former chair of the Toronto Police Services Board and a visiting professor of criminology at Ryerson University, said he feels Saunders made the right call."It's important to understand the depth of feeling that exists right now in the LGBTQ community generally, but particularly the racialized members of that community," he said."There's a perception that the work that was done before in terms of building relationships between police and the LGBTQ community did not pay adequate attention to the fact that it's not a homogenous group."Given those feelings, Mukherjee said, it's important that police try to diffuse tensions and build a better relationship with all community members.Meanwhile, Toronto's mayor said he was "heartened" that police and community groups seemed to be communicating."I'm optimistic that's going to bear fruit going forward and be a better, longer lasting, more meaningful answer to this than if we'd just been able to say that police are back in the parade," John Tory said.Ontario Premier Kathleen Wynne said she, too, was hopeful that police would improve relations with the LGBTQ community."I truly hope that there can be a good discussion between Pride and the police services so that that relationship can be healed," she said. Impatient for wall, Trump wants US military to secure border-[The Canadian Press]-YAHOONEWS-April 3, 2018
WASHINGTON — Frustrated by slow action on a major campaign promise, President Donald Trump said Tuesday he wants to use the military to secure the U.S.-Mexico border until his promised border wall is built.Trump told reporters he's been discussing the idea with Defence Secretary Jim Mattis."We're going to be doing things militarily. Until we can have a wall and proper security, we're going to be guarding our border with the military," Trump said, calling the move a "big step."It wasn't immediately clear exactly how the proposal would work or what kind of troops Trump wanted to deploy. But the White House later said Trump wanted to mobilize the National Guard.Federal law prohibits the use of active-duty service members for law enforcement inside the U.S., unless specifically authorized by Congress. But over the past 12 years, presidents have twice sent National Guard troops to the border to bolster security and assist with surveillance and other support. The White House counsel's office has been working on the idea for several weeks, according to a senior official who spoke on condition of anonymity to discuss internal plans.Trump has been annoyed by the lack of progress on building what was the signature promise of his campaign: a "big, beautiful wall" along the Mexican border. He's previously suggested using the Pentagon's budget to pay for building the wall, arguing it is a national security priority, despite strict rules that prohibit spending that's not authorized by Congress.At the Pentagon, officials struggled throughout the day to answer questions about the plan, including rudimentary details on whether it would involve National Guard members.But the administration appeared to be considering a model similar to a 2006 operation in which President George W. Bush deployed National Guard troops to the southern border.Under Operation Jump Start, 6,000 National Guard troops were sent to assist the border patrol with non-law enforcement duties while additional border agents were hired and trained. Over two years, about 29,000 National Guard forces participated, as forces rotated in and out. The Guard members were used for surveillance, communications, administrative support, intelligence, analysis and the installation of border security infrastructure.In addition, President Barack Obama sent about 1,200 National Guard troops to the U.S.-Mexico border in 2010 to beef up efforts to battle drug smuggling and illegal immigration.Texas has also deployed military forces to its 800-mile (1, 290-kilometre ) border with Mexico. Statistics show 36,695 arrests of people trying to cross the southwest border in February 2018, up from 23,555 in the same month of the previous year.At last week's meeting, Trump "directed a vigorous administrative strategy to confront this threat and protect America's national security," said Sanders. Tuesday's briefing was a follow-up to discuss the plans.Trump has also been under pressure from conservative backers, including commentator Ann Coulter, who has accused Trump of betraying his base for not delivering on the wall.Trump appeared to take credit Tuesday for halting a caravan of about 1,100 migrants, many from Honduras, who had been marching along roadsides and train tracks in the southern Mexican state of Oaxaca."I said (to Mexican officials), 'I hope you're going to tell that caravan not to get up to the border.' WASHINGTON — President Donald Trump said Tuesday that he expects to decide "very quickly" whether to remove U.S. troops from war-torn Syria, saying their primary mission was to defeat the Islamic State group and "we've almost completed that task."A decision by Trump to withdraw from Syria would conflict with the views of his top advisers.In fact, as Trump addressed reporters at the White House, high-ranking U.S. officials spoke elsewhere in Washington about the need to stay in Iraq and Syria to finish off the militant group, which once controlled large swaths of territory in both countries, and keep it from rising up again.At a news conference with the presidents of the Baltic nations, Trump was asked whether he still favoured pulling U.S. troops out of Syria."As far as Syria is concerned, our primary mission in terms of that was getting rid of ISIS," Trump answered, using an acronym for the Islamic State group. "We've completed that task and we'll be making a decision very quickly, in co-ordination with others in the area, as to what we will do."The mission is "very costly for our country and it helps other countries a helluva lot more than it helps us," Trump said."I want to get out. I want to bring our troops back home. I want to start rebuilding our nation," he said during the appearance with his counterparts from Estonia, Latvia and Lithuania. Trump also noted that the Baltic states are partners with the U.S. in the anti-IS coalition and "we will not rest until ISIS is gone."A senior Syrian Kurdish official said Trump's comments came at an "inappropriate time" as Islamic State militants re-emerge in eastern Syria and amid threats from Turkey.Ilham Ahmed, a senior Kurdish official in Syria's Raqqa province, said such a decision would clear the way for "total chaos in Syria," endangering areas newly liberated from the IS group and empowering Turkey to move in on towns controlled by the Kurdish-led Syrian Democratic Forces, backed by the U.S.-led coalition.The main IS holdout in Syria is in the eastern province of Deir el-Zour, where momentum by the U.S.-backed Syrian Democratic Forces has stalled in recent weeks as many Kurdish members of the group have shifted west to the Afrin area to fight Turkish forces. "There is a military role in this, certainly in the stabilization phase."Trump was expected to discuss Syria at a meeting later Tuesday with his national security team. MATIAS ROMERO, Mexico — The caravan of Central American migrants that angered U.S. President Donald Trump was sidelined at a sports field in southern Mexico with no means of reaching the border even as Trump tweeted another threat to Mexico Tuesday."The big Caravan of People from Honduras, now coming across Mexico and heading to our "Weak Laws" Border, had better be stopped before it gets there," Trump wrote. "Cash cow NAFTA is in play, as is foreign aid to Honduras and the countries that allow this to happen."The caravan that once numbered 1,150 or more people actually halted days ago in the town of Matias Romero in the southern state of Oaxaca, where participants slept out in the open. After days of walking along roadsides and train tracks, the organizers now plan to try to get buses to take participants to the final event, an immigrants' rights conference in the central state of Puebla later this week.Bogged down by logistical problems, large numbers of children and fears about people getting sick, the caravan was always meant to draw attention to the plight of migrants and was never equipped to march all the way to the U.S. border."The idea was never for this group of people to reach the border. It was more to achieve a sensible and clear solution" to migrants' need to leave their countries, said Irineo Mujica, director of Pueblo Sin Fronteras, the activist group behind the annual symbolic event.With conditions bad in Honduras following that country's hotly disputed November presidential elections, unexpectedly large numbers of people showed for this year's march."We have never seen a march of this size. It is unmanageable," Mujica said.On Tuesday, the group — mostly Hondurans — spread out on blankets in walkways between buildings, on playing fields and on grassy spots between swing sets. Young children kicked soccer balls through the dust and climbed on resting parents, killing time. Adults gathered around the few power outlets to charge cellphones. ANKARA, Turkey (AFP) — Iran, Russia and Turkey have teamed up to forge a strong if brittle tripartite alliance aimed at holding ascendancy in Syria, taking advantage of the West’s reluctance to engage militarily in the country.The presidents of the three countries, long seen as regional rivals rather than strategic allies, will meet Wednesday in Ankara for their second three-way summit on Syria in a striking demonstration of unity.This meeting, which follows the first tripartite summit between Turkish President Recep Tayyip Erdogan, Vladimir Putin of Russia, and Iran’s Hassan Rouhani in Sochi last November, comes with Turkey seeking a louder voice after launching an offensive against Kurdish militia inside Syria.US President Donald Trump has signaled that Washington will be withdrawing “very soon” from Syria, in a move that would cement the influence of Ankara, Moscow, and Tehran, who have all committed military forces to the ground.Sinan Ulgen, chairman of the Istanbul-based Centre for Economics and Foreign Policy Studies think-tank, said the three countries had now become the true masters on the ground in Syria.Ulgen told AFP that the three have “been the regional powers that were willing to invest military resources to influence the outcome of the conflict.”The three countries last year launched a parallel peace process to the UN-backed talks in Geneva. The talks, based in Astana, have convened multiple times albeit without finding any breakthrough.“The Astana process is a vehicle through which Turkey, Russia, and Iran, are looking to manage the war and secure their various interests,” said Elizabeth Teoman, a Turkey analyst at the Washington-based Institute for the Study of War (ISW).Russia has substantial air power in Syria while Iran has a strong presence on the ground, partly through militia groups which include foreign fighters.But Erdogan has increased Turkey’s influence by launching in January an offensive to capture territory from the Kurdish People’s Protection Units (YPG) militia.The offensive has already succeeded in capturing the former YPG bastion of Afrin and Erdogan has repeatedly threatened to advance the push further east.“Erdogan is a weaker partner in terms of ground forces and control over airspace. Analysis-What we know and don’t about Friday’s Gaza protests-Following the mass march and violence in which the IDF killed 16 people, the battle shifts to public opinion: Were they unarmed protesters or dangerous terrorists?-By Judah Ari Gross-APR 3,18-TOI

Three days after the deadliest day in the Gaza Strip since the 2014 war between Israel and Hamas, significant questions — factual, legal, and moral — abound, regarding what happened on both sides of the security fence.What exactly were the 16 Palestinians who were killed — and the many more who were injured — doing when they were shot by IDF troops on Friday? Did their actions warrant the use of lethal force? How else could the IDF have responded to the protests? Tens of thousands of Palestinians took part in the demonstrations along the Gaza fence, marking “Land Day,” a commemoration of the expropriation of Arab land in the Galilee by the Israeli government on March 30, 1976, and subsequent protests in which six Arab Israelis were killed.It was the start of a six-week “March of Return,” which will end in mid-May with both “Nakba Day,” marking the displacement of Arabs after Israel’s creation, and the transfer of the US Embassy from Tel Aviv to Jerusalem, a move that has infuriated Palestinian leaders.The March of Return is an annual event, but this year’s protest in Gaza got significant support from the Hamas terror group that rules the Strip. In addition to the civilians organizing the protest, who maintained that it would be peaceful, there were figures like Khaled al-Batsh, a senior figure in the Iran-backed Palestinian Islamic Jihad terrorist group, adding to the complex nature of the protest — part legitimate, part nefarious.On Sunday, the Hamas-run Gaza health ministry reported that 15 people were killed from Israeli gunfire during the protests and 1,479 were injured, more than half from live fire and the rest from Israel’s less-lethal riot dispersal measures. One of those injured died of his wounds on Monday morning, bringing the tally to 16 fatalities.IDF spokesperson Brig. Gen. Ronen Manelis rejected the Gaza ministry’s figures of people injured by live fire, saying the true figure was dramatically lower.“There were not hundreds of people injured by gunshots. The overwhelming majority were wounded by riot dispersal means,” he said.Among the dead were two men who, armed with AK-47 assault rifles and hand grenades, opened fire on Israeli soldiers and attempted to breach the security fence in the northern Gaza Strip, before they were shot by IDF infantrymen and a tank, according to the army. The military later provided video footage of the attack from its surveillance cameras along the fence, as well as photographs of the weapons.Manelis directly blamed the failed attack on Hamas leaders Ismail Haniyeh and Yahya Sinwar. “There’s no way a terror attack is going to take place without Haniyeh and Sinwar’s approval,” Manelis told reporters on Monday.According to the IDF, the other Palestinians killed were shot in accordance with its rules of engagement, but it has provided little evidence of what exactly happened.Manelis said that in the course of Friday, the IDF documented three attempts to place improvised explosive devices along the fence and five attempts to break through the fence with wire cutters, as well as multiple cases of people throwing burning tires at the fence. He refused to detail what each of the people shot was suspected of doing and rejected calls for external investigations.“We don’t need to answer to the world about every bullet that’s fired,” he said.Some video evidence has called into question the army’s claims that everyone shot represented a clear threat, notably in the case of Abd el-Fatah Abd a-Nabi, who appeared to have been targeted while running a significant distance from the fence, holding a tire.Manelis would not discuss the specifics of that case, but noted that the video in question was edited and did not show the period immediately before a-Nabi was shot.He said that in the army’s view, considering the number of people who took part and the violent nature of the actions on the border, the number of fatalities was “very reasonable.”Of the 16 killed, 11 appeared to have been affiliated with terror organizations, he noted, mostly Hamas, but also Fatah’s Al-Aqsa Martyrs Brigades, Islamic Jihad, and a salafist group. This army’s identification of these operatives is largely supported by acknowledgements by the terrorist organizations themselves, and by photographs of the men either in uniform or receiving military-style funerals, although some could not be immediately substantiated.Asked about the videos that appeared to show people being shot while relatively far away from the fence, the spokesperson said the army was investigating every shooting from Friday. “Some things look bad on film, and it’s possible there were mistakes,” he said.Defense Minister Avigdor Liberman similarly rebuffed calls for external inquiries on Saturday.Following Friday’s protests, countries around the world expressed concern over the number of people killed.UN Secretary-General Antonio Guterres called for “those concerned to refrain from any act that could lead to further casualties.” France called on Israel to show restraint. And Kuwait tried to get the United Nations to condemn Israel for its military response, but failed after the United States vetoed the proposed resolution.Manelis took considerable umbrage at the view that Israel was to blame for Friday’s violence and put the responsibility on Hamas, which helped organize the protest.“Israel didn’t initiate this. We didn’t want it to happen,” he said.During the demonstrations, an estimated 30,000 Palestinians took part at six main locations east of major cities and towns along the coastal enclave. Most of the participants stayed several hundred meters back from the security fence separating Gaza from Israel. Photographs and footage from that area showed people dancing and families enjoying barbecues.But a portion of the protesters, most of them young men and some young women, came closer to the security fence — within a few dozen meters — lighting fires or using slingshots to hurl rocks at Israeli troops on the other side.A smaller number went right up to the fence. Footage released by the military and some videos circulating on social media showed mostly young men throwing Molotov cocktails or burning tires at the metal barrier.According to Manelis, terror groups also tried to take advantage of the chaos to plant improvised explosive devices along the fence in three cases. The military provided no visual evidence of this.During the protest, Israeli troops used tear gas — fired from both handheld grenade launchers and by specially designed drones — as well as rubber bullets and live fire against the Palestinian rioters.The military maintains that, in accordance with its rules of engagement, live fire was only used against those who represented a direct threat to the Israeli soldiers or to the security fence.One of the issues in assessing the army’s actions on Friday is in the amount of information that is unknown or disputed, from the number of people shot to what exactly each of them was doing at the time, said Eliav Lieblich, a senior lecturer at Tel Aviv University’s faculty of law.Without that information, it is difficult to accurately determine if those shot indeed represented a threat, as the IDF claims, or not.This is a problem not only when investigating the 16 reported fatalities, but also the many others who were hit by live bullets, according to Lieblich, who co-wrote a legal brief on the potential difficulties with the army’s tactics.Another graphic video from a far smaller demonstration on Sunday appeared to show a Palestinian teenager being shot in the head as he stood near a pile of burning tires, but did not seem to be presenting a clear threat to either IDF soldiers or the security fence.“When you have 800 people reportedly injured by live fire, it makes you think about the rules of engagement,” Lieblich said over the phone.Manelis said the army would be conducting its own internal investigations, as it does with any case that results in a death outside of a strict combat setting.In the lead-up to Friday’s protest, the military made it clear that its most immediate concern was a massive rush toward Israeli territory by thousands or tens of thousands of Gazans, along the lines of what happened along the Lebanese and Syrian borders in June 2011, when mobs broke through perimeter fences into Israel and several Lebanese and Syrian nationals were killed in the ensuing bedlam, some by Israeli troops and others by the Lebanese military.On Monday, the spokesperson said that was exactly what the army was preparing for.“Haniyeh had said, ‘We will cut the fence and go to Jerusalem,'” Manelis noted.His refrain throughout his phone call with reporters was “Imagine what could have happened.”A mass inrush did not occur.Perhaps the massive breach was never a credible threat and only talk by the Hamas leader, designed to frighten Israeli citizens and put the military on edge. But Manelis maintained that it was a real danger, averted “only because of how Israel acted” on Friday.“We prevented a catastrophe,” he said.Asked how the army would respond if masses of Palestinians did indeed move to break through the fence and march on nearby Israeli communities, Manelis said the army had practiced responding to such scenarios, but that he would “rather not think about that,” as the results would surely be bloody.A breach of the fence or attempts to damage it do not in and of themselves amount to an action that warrants lethal force, according to Lieblich.The army’s implication that an attack on the security fence could lead to mobs of people rushing into Israel, which could spell “catastrophe,” does not hold water as a legal argument, Lieblich said. “You don’t know for a fact what is going to happen next,” he said.Lieblich stressed, however, that this pertains only to the attempts to sabotage or break through the fence; not to any attempts to plant explosives or attack troops with rocks and firebombs, which much more clearly represent a threat to life.Manelis, for his part, said that “‘life threatening’ is a subjective issue.”Identifying terrorist operatives-One of the more irregular things to come out this weekend was a list of the names, ages, hometowns, pictures and terrorist affiliations of 10 of the 16 fatalities that was published by the IDF on Saturday night. (Israel did not identify an 11th suspected terrorist operative, though Islamic Jihad publicly claimed him as a member.)-The army included a-Nabi in its list of Hamas members. In a poster, Hamas referred to him as a “martyred mujahadeen,” a term it generally reserves for its fallen fighters. His family has denied that he was affiliated with the organization.Usually, even long after the identities of terrorists are publicized in the media or released by the Shin Bet security service, the army generally refrains from referring to them by name, instead referring to them in official communiques as “the terrorist who killed X” or “the terrorist who committed this or that car-ramming/stabbing/shooting.”The army was able to release the information on the Gaza fatalities within a day due in some part to its improved camera equipment on the border, but mostly because of the wealth of open-source information on social media, something that was not as available in the past.The army’s unusual move of releasing the identities appears to have been an attempt to strengthen the message that Israeli officials have been spreading for weeks: This was not a peaceful civilian protest, but one orchestrated by terrorist groups for their own purposes.“A demonstration doesn’t include people burning tires and shooting,” Manelis said.What else could have been done? While the IDF may be able to legally justify its use of lethal force, that does not mean that it was necessary in every case.“My impression is that we, to a certain extent, may have been too quick to fire at a demonstration that I’m not sure endangered our soldiers and that I’m not sure would have trampled the fence and seen masses getting into Israel,” former IDF general Giora Eiland told The Times of Israel on Monday.The army used a relatively limited array of less-lethal riot dispersal measures on Friday, mostly just tear gas and rubber bullets.The army’s rules of engagement for live fire also led to a large number of dead Palestinians. Even if the army sees this as “reasonable,” it has led some to ask whether the IDF would do better to change those protocols.Commentators have also questioned why the army did not rely on other riot dispersal tools it has at its disposal, like the noxious “skunk” spray that smells like rotting flesh and sewage, or bring in additional forces from the Border Police, who are meant to be better trained at responding to riots.Others have suggested the use of less-lethal riot dispersal weapons from other countries, like the American defense contractor Raytheon’s Active Denial System, which fires energy similar to microwaves at demonstrators, warming the water on the skin until they are forced back because of the painful heat.According to Manelis, however, the army has no plans to fundamentally change its methods if the protests planned for this coming Friday take place as scheduled in Gaza.“We will use the same forces, the same equipment and the same tactics,” he said.

MOSCOW, Russia (AFP) — Russian Foreign Minister Sergei Lavrov on Monday suggested Britain could be behind the poisoning of a former double agent that has triggered an unprecedented wave of tit-for-tat expulsions of diplomats.More than 150 Russian diplomats have been ordered out of the US, EU members, NATO countries and other nations as punishment for the March attack on Sergei Skripal and his daughter Yulia in the English city of Salisbury which Britain has blamed on Moscow.The counterclaims from Moscow came as the last Russian diplomats were leaving the countries where they were posted.Four Russian diplomats expelled from Germany arrived back in Moscow on the weekend, Russia’s embassy in Berlin said, ahead of a Monday deadline imposed on Moscow.A Russian diplomat also left Macedonia along with family members earlier Monday.The Kremlin has vehemently denied the accusations that it was behind the nerve agent attack and ordered Britain and its allies to recall some of their envoys from Russia.On Monday, Moscow’s top diplomat Lavrov told a news conference that the Skripal attack “could be in the interests of the British government which found itself in an uncomfortable situation having failed to fulfill promises to its electorate about the conditions for Brexit.”He reiterated that Moscow had no reason to poison Skripal — whom it convicted of treason and handed over in a 2010 spy swap — on the eve of a presidential election in March and months before Russia hosts the World Cup.Lavrov suggested that the poisoning of the Skripals “could also be in the interests of the British special forces who are known for their abilities to act with a license to kill.”At the same time, he denied the attack’s “sophistication” meant it was likely to have been approved by the Russian leadership, as CNN cited a source briefed on the investigation as saying.“If I understand correctly, sophisticated attacks usually lead to instant death,” Lavrov said.Britain has called it “highly likely” that Russia was responsible for the attack using a nerve agent developed in the USSR.Lavrov also accused Britain, the US and its allies of “casting off all decency” and “resorting to lies and disinformation.”He insisted that “serious experts and “leaders of a whole number of countries” were questioning Britain’s account of the crime.“How far we all go” did not depend on Russia, he said, adding Moscow would follow “the principle of reciprocity.”Britain has dismissed the various, often contradictory, theories, that Russia has put forward, with even the Foreign Office publicly mocking them on social media.Lavrov complained that the British authorities have still not given consular access to “our citizens,” and that the situation had not changed despite Yulia Skripal’s improved condition.He said he hoped Sergei Skripal would also get better.Moscow has sought to punish Britain for calling on allies to expel Russian diplomats, saying Saturday London must reduce its diplomatic presence in the country by more than 50 more diplomats, to achieve “parity” with Russia’s diplomatic staff in Britain.Russia had earlier expelled 23 British diplomats and last week told envoys from 23 other countries that some of their staff must go home.Separately, a top Kremlin aide said Monday that US President Donald Trump proposed a White House summit when he called President Vladimir Putin last month, prior to the expulsion of Russian diplomats from the US.In Washington, officials dismissed the statement from Putin’s top foreign policy aide, Yury Ushakov.A senior US administration official said “it’s obviously in their interest” to publicise the summit invitation as Putin’s risks deeper international isolation after the Skripal attack.White House Press Secretary Sarah Sanders said the two leaders had discussed a bilateral meeting “at a number of potential venues, including the White House.”On March 20, Trump called Putin to congratulate him on his re-election, and the US leader told reporters afterwards that the two would “probably get together in the not-too-distant future.”Both the US official and Ushakov said that planning for the meeting had not yet begun.Ushakov expressed the hope that Russia and the United States could return to “constructive and serious dialogue.”After the phone call, Washington expelled 60 Russian diplomats and shut down a Russian consulate in Seattle.Moscow responded by sending home 60 US diplomats and closing Washington’s consulate in Saint Petersburg.Washington has, however, said Russia was free to apply to accredit more diplomats to replace those expelled.

The New Israel Fund on Monday night railed against Prime Minister Benjamin Netanyahu for his “pathetic, shameful” accusations that the left-wing organization put pressure on Rwanda to reject the Israeli government’s proposed resettlement of African migrants in the country.“In recent weeks, amid enormous pressure on Rwanda by the New Israel Fund and sources in the European Union, Rwanda has withdrawn from the agreement and refused to accept infiltrators from Israel that were forcibly deported,” the prime minister wrote in a Facebook post on Monday evening, after a chaotic day in which he announced a deal with the UN refugee agency on the African asylum seekers, and then, hours later, suspended the agreement.Netanyahu was referring to earlier government plans to deport tens of thousands of African migrants in Israel illegally, most of them from Eritrea and Sudan, to Rwanda and Uganda.“Prime Minister Benjamin Netanyahu has once again resorted to lies about the New Israel Fund in order to score cheap political points. Israel will cancel plans to expel asylum seekers to third-party countries in Africa after reaching an “unprecedented” deal with the United Nations, the Prime Minister’s Office announced Monday.According to the agreement, the United Nations High Commissioner for Refugees  will work to find homes in Western countries for at least 16,250 of the asylum seekers in Israel, while Israel will agree to give temporary status to the remainder — also estimated at around 16,250. The US, Canada, Sweden, Italy and Germany were reported to be among the countries to take in the migrants.The PMO said most of those who will stay would have remained in Israel in any event.The new deal is to be phased in over the next five years in three stages, though the PMO did not specify the details.The new plan, under the auspices of the United Nations, will replace the previous plan, which had been due to go into effect Sunday, which was to expel the migrants to unnamed third-party countries, believed to be Rwanda and Uganda — although both have denied involvement in the plan.The earlier deportation policy, which offered each migrant $3,500 and a plane ticket, had been condemned by Israeli activists and the United Nations as chaotic, poorly executed, and unsafe. Asylum seekers previously deported to Uganda and Rwanda have told the Times of Israel they faced serious danger and even imprisonment after arriving in Africa without proper documents.The Supreme Court froze the deportations in mid-March in response to a petition.The PMO said that the new plan had been approved by the attorney general and was in keeping with international law and practice.At the same time the PMO announced a special committee, headed by former Kadima MK Avigdor Yitzhaki, to improve the quality of life in south Tel Aviv, where many of the asylum seekers live.In addition, as part of the deal, the government will focus on providing occupational guidance, vocational training and other assistance to the migrants to help them integrate into Israel. It will also work to disperse them around the country, so that they will not be concentrated in a single area.Human rights activists in Israel and major US Jewish organizations had long urged the Israeli government not to go ahead with its plan to force the migrants to choose between jail and deportation.

Saudi Crown Prince Mohammed bin Salman, in an interview published Monday,  recognized Israel’s right to exist and extolled the prospect of future diplomatic relations between his kingdom and the Jewish state.In an extensive interview with The Atlantic’s Jeffrey Goldberg, Prince Mohammed laid out his vision for the future of the Middle East, including the possibility of cooperation with Israel.Asked whether he believes “the Jewish people have a right to a nation-state in at least part of their ancestral homeland,” he replied: “I believe that each people, anywhere, has a right to live in their peaceful nation. I believe the Palestinians and the Israelis have the right to have their own land.”However, in keeping with the terms of his kingdom’s regional peace proposal, the Saudi crown prince added that an agreement with the Palestinians was a prerequisite to formal relations. “But we have to have a peace agreement to assure the stability for everyone and to have normal relations,” he said.Did he have “no religious-based objection to the existence of Israel?” he was further asked. To which the crown prince replied: “We have religious concerns about the fate of the holy mosque in Jerusalem and about the rights of the Palestinian people. This is what we have. We don’t have any objection against any other people.”Asked about anti-Semitism in Saudi Arabia, he said: “Our country doesn’t have a problem with Jews. Our Prophet Muhammad married a Jewish woman. Not just a friend — he married her. Our prophet, his neighbors were Jewish. You will find a lot of Jews in Saudi Arabia coming from America, coming from Europe. There are no problems between Christian and Muslims and Jews. We have problems like you would find anywhere in the world, among some people. Sixty percent of the Iranian economy is controlled by the Revolutionary Guard. The economic benefits of the Iran nuclear deal are not going to the people.“They took $150 billion after the deal — can you please name one housing project they built with this money? One park? One industrial zone? Can you name for me the highway that they built? I advise them — please show us something that you’re building a highway with $150 billion,” he said. “For Saudi Arabia, there is a 0.1 percent chance that this deal would work to change the country. For President Obama it was 50 percent. But even if there’s a 50 percent chance that it would work, we can’t risk it. The other 50 percent is war. We have to go to a scenario where there is no war.”In a major Saudi shakeup last year, Prince Mohammed pushed aside his older and more experienced cousin to become first in line to his father’s throne, setting himself up to control Saudi policy for decades to come.The Saudis are working aggressively to change perceptions.
