The jury in the Shafia trial has spent a long first day of deliberations without coming to a verdict.There were no questions either from the seven women and four men who started deliberating at 9 a.m. yesterday and ended at 8 p.m. with regular coffee and meal breaks.The jurors have been sequestered since 4:30 p.m. Friday afternoon, and went back to their hotel at about 6 p.m.They are deliberating the fate of Mohammad Shafia, 59, his second wife Tooba Mohammad Yahya, 42, and their son Hamed Shafia, 21, who have pleaded not guilty to four counts of first degree murder of four female family members.The Montreal couple and their son are accused of killing the couple's teen daughters and the husband's first wife.

Brussels keen to redirect €82bn for jobs and growth

BRUSSELS - The EU commission wants to redirect €82bn worth of structural funds to projects aimed at boosting employment and growth, particularly in bailed-out countries, measures seen as both vague and inadequate by critics.Anticipating a demand from Monday's EU summit to redeploy as yet unspent structural funds for employment-related projects, the EU commission on Friday (27 January) announced its intention to work with member states on redistributing €82 billion.Speaking at a press conference with the Belgian premier, commission chief Jose Manuel Barroso said: What we can do is to redeploy structural funds, as long as member states agree, because this is always a partnership between the commission and member states.
He gave the example of Italy, whose recently appointed technocrat government asked for a reprogramming of funds to the tune of €3.1bn for education, broadband and railway investments in the country's poorer southern regions.Now we would like to do the same with programme countries where there is high youth unemployment,Barroso said.
A similar programme has been agreed with Greece as well, where projects worth €11.5bn should help build motorways, schools and energy efficiency in housing, commission spokesman Ton Van Lierop told this website. The task force of EU commission experts deployed to the country last year with the aim of assisting the government with its structural reforms required by the EU and IMF will help in implementing these new priorities, he added.In Romania and Bulgaria, the EU's newest members and where structural funds go largely unspent year by year, the governments have accepted to have EU experts help them with the drafting and checking of the EU's notoriously bureaucratic project requirements.But experts are sceptical that this new strategy will have any impact on the forecast recession in most member states.It's not enough money to really make a difference. If it was €82bn for research or in fiscal deductions for small and medium enterprises, maybe it would, says Diego Valiante, an economist with the Centre for European Policy Studies, a Brussels-based think tank.Instead of doing more of the same - letting member states select all sorts of bridges to nowhere and other irrelevant projects, the EU commission should link structural funds with labour market reforms needed in most member states, he said.But Valiante also conceded that under the current budget - which ends in 2013 - there is little room for manoeuvre for both the commission and member states.This one is finished, we will have to wait for the next multi-annual budget to revamp the rules,he said.

BRUSSELS - The European Commission has noted that there is a lot of oil around inside reserves in EU countries even if Iran makes good on threats to stop deliveries next week.Petrol pumps - even in Greece - will not dry up over night if Iran makes good on its threat (Photo: Antonio)Iranian MPs are due to discuss on Sunday (29 January) whether to immediately stop shipping an estimated 600,000 barrels of crude oil a day to member states in reaction to recent EU sanctions.The Union on Monday said it would stop buying Iranian oil in July unless it falls in with UN demands on its nuclear programme.Greece - which last year bought some 35 percent of its oil from Iran - is in the most delicate situation because the financial crisis has made other suppliers wary of giving it credit.The Greek foreign ministry is keeping quiet on the Iranian threat. But Athens in recent weeks exacted promises from fellow EU countries that they would stick by its side in the event of a disruption before it gave its nod to the anti-Iran sanctions.Greece itself has around 31 million barrels in its rainy-day stock according to the latest figures of the Paris-based International Energy Agency (IEA) - enough to meet over 90 days of consumption without importing or producing a single drop.
Germany has 283 million barrels, enough for over 100 days of consumption. France, which pushed Greece to adopt the anti-Iran sanctions in the first place, is sitting on 160 million barrels, also enough for 90 days.European Commission spokeswoman Marlene Holzner told EUobserver on Friday:If you take all the reserves of all the member states together, it means there is a lot of oil around and if they decide to put it into the market, they can do it.She added: Yes, it [an immediate Iranian stoppage] would have an impact, but it's not the case that from one day to another one of our members would have no oil at all.For her part, EU foreign relations spokeswoman Maja Kocjancic said consultations between member states to make sure disruption scenarios do not leave anybody high and dry have been going on for quite some time.Oil markets on Friday stayed calm, with prices going up less than $1 per barrel.The market reaction was similar to Monday's, when prices went up by just over $1 after Iran repeated threats to block the Strait of Hormuz, a maritime conduit for Saudi oil exports.Western analysts do not believe Iran would risk a military confrontation with the US, which keeps two aircraft carriers nearby.

Barak called for further harsher sanctions against Iranian banks and its oil industry so that we all know soon enough if the Iranians are willing to give up their nuclear weapons program.Barak’s comments come after earlier this week, the European Union slapped an embargo on Iranian oil. The sanctions would introduce a gradual ban on buying Iranian oil and petrochemicals, and that EU members would have to halt imports completely by July 1, 2012.Hours later, the U.S. Treasury announced sanctions against Iran’s Bank Tejarat, the third largest bank in the Islamic Republic.Bank Tejarat is accused of aiding Iranian programs to acquire weapons of mass destruction, including moving tens of millions of dollars to help a state-run agency acquire uranium.

Israel presented this week, for the first time, its principles regarding the borders of a future Palestinian state. The borders were presented during Wednesday’s meeting in Jordan between attorney Yitzchak Molcho and the Palestinian Authority’s chief negotiator Saeb Erekat.One of the principles presented by Molcho is that, in a final settlement, most of the Israeli residents of Judea and Samaria will remain in Israeli territory, and the border will be drawn in such a way that most PA Arabs who currently reside in Judea and Samaria will be part of the Palestinian state.The borders presented by Molcho are similar to the route of the separation fence, which was constructed in such a way that most of the major settlement blocs remained on the western side of the fence. This includes Gush Etzion, Ma’aleh Adumim, Beitar Illit, Kiryat Sefer and Alfei Menashe. Israel insists that Ariel also be included as part of Israeli territory in a permanent status agreement with the PA.Molcho presented Israel’s position on borders orally and did not present Erekat with an official document on the matter. He presented a series of general principles, without displaying maps or indicating what percentages of territories Israel would be willing to give up as part of a permanent agreement. Having Israel present its position on borders was a central PA demand to continue talks in Amman under the auspices of King Abdullah, but in the past the PA has consistently rejected having the border be determined based the separation fence.
Presenting the principles on borders marks the first time the current Netanyahu government has agreed to discuss the territorial issue. However, analysts said on Thursday that it is likely a tactical move designed to put pressure on the PA and not give the entity an excuse to end talks by using the argument that Israel would not discuss the issue of borders.Wednesday marked the final exploratory meeting between Israel and the PA, and it ended with no progress. Erekat and Molcho made little headway in their fifth meeting, the last before the January 26 deadline set by the Quartet of peacekeeping nations to break the impasse and relaunch direct talks for a final status agreement between the two sides.Prior to the meeting, the PA-based Ma’an news agency reported that the PA refused to continue talks with Israel after the deadline.Erekat – a member of the Fatah terror faction's Central committee -- used a previous meeting to negotiate the release of all PA terrorist prisoners currently incarcerated in Israeli jails, rather than to focus his efforts on discussing the core issues relating to Israel-PA statehood.Among the issues Erekat raised at the last meeting was advocating for the release of Hamas legislator Aziz Dweik, who had been recently arrested by Israeli security forces.

Former IDF Chief of Staff Gabi Ashkenazi warned, Thursday, that Israel could not afford to cut its defense budget and should prepare itself for war.In comparison to 10 years ago, the possibility of a conflict is not something that we just need to talk about,Ashkenazi said during a lecture at the Institute for National Security Studies in Tel Aviv.We never saw it coming. It happened on my watch, so it must be said. But if it's any consolation, Egypt never saw it coming either,Ashkenazi said of the so-called Arab Spring protests that have no turned into an Islamic winter in elections throughout the Arab world.The Middle East's plates are shifting. What the Egyptian army didn't know, I couldn't have known. (Egypt's) leaders did not know either,he said, adding the ultimate strategic picture was still changing.Ashkenazi told attendees that confronting Iran's nuclear ambitions required a multi-disciplinary approach that included covert, economic, and potentially military action.In my opinion, the strategy vis-à-vis Iran should be to do whatever is possible under the radar coupled with painful and crippling sanctions. Brussels keen to redirect €82bn for jobs and growth

BRUSSELS - The EU commission wants to redirect €82bn worth of structural funds to projects aimed at boosting employment and growth, particularly in bailed-out countries, measures seen as both vague and inadequate by critics.Anticipating a demand from Monday's EU summit to redeploy as yet unspent structural funds for employment-related projects, the EU commission on Friday (27 January) announced its intention to work with member states on redistributing €82 billion.Speaking at a press conference with the Belgian premier, commission chief Jose Manuel Barroso said: What we can do is to redeploy structural funds, as long as member states agree, because this is always a partnership between the commission and member states.
He gave the example of Italy, whose recently appointed technocrat government asked for a reprogramming of funds to the tune of €3.1bn for education, broadband and railway investments in the country's poorer southern regions.Now we would like to do the same with programme countries where there is high youth unemployment,Barroso said.
A similar programme has been agreed with Greece as well, where projects worth €11.5bn should help build motorways, schools and energy efficiency in housing, commission spokesman Ton Van Lierop told this website. The task force of EU commission experts deployed to the country last year with the aim of assisting the government with its structural reforms required by the EU and IMF will help in implementing these new priorities, he added.In Romania and Bulgaria, the EU's newest members and where structural funds go largely unspent year by year, the governments have accepted to have EU experts help them with the drafting and checking of the EU's notoriously bureaucratic project requirements.But experts are sceptical that this new strategy will have any impact on the forecast recession in most member states.It's not enough money to really make a difference. If it was €82bn for research or in fiscal deductions for small and medium enterprises, maybe it would, says Diego Valiante, an economist with the Centre for European Policy Studies, a Brussels-based think tank.Instead of doing more of the same - letting member states select all sorts of bridges to nowhere and other irrelevant projects, the EU commission should link structural funds with labour market reforms needed in most member states, he said.But Valiante also conceded that under the current budget - which ends in 2013 - there is little room for manoeuvre for both the commission and member states.This one is finished, we will have to wait for the next multi-annual budget to revamp the rules,he said.

BRUSSELS - The European Commission has noted that there is a lot of oil around inside reserves in EU countries even if Iran makes good on threats to stop deliveries next week.Petrol pumps - even in Greece - will not dry up over night if Iran makes good on its threat (Photo: Antonio)Iranian MPs are due to discuss on Sunday (29 January) whether to immediately stop shipping an estimated 600,000 barrels of crude oil a day to member states in reaction to recent EU sanctions.The Union on Monday said it would stop buying Iranian oil in July unless it falls in with UN demands on its nuclear programme.Greece - which last year bought some 35 percent of its oil from Iran - is in the most delicate situation because the financial crisis has made other suppliers wary of giving it credit.The Greek foreign ministry is keeping quiet on the Iranian threat. But Athens in recent weeks exacted promises from fellow EU countries that they would stick by its side in the event of a disruption before it gave its nod to the anti-Iran sanctions.Greece itself has around 31 million barrels in its rainy-day stock according to the latest figures of the Paris-based International Energy Agency (IEA) - enough to meet over 90 days of consumption without importing or producing a single drop.
Germany has 283 million barrels, enough for over 100 days of consumption. France, which pushed Greece to adopt the anti-Iran sanctions in the first place, is sitting on 160 million barrels, also enough for 90 days.European Commission spokeswoman Marlene Holzner told EUobserver on Friday:If you take all the reserves of all the member states together, it means there is a lot of oil around and if they decide to put it into the market, they can do it.She added: Yes, it [an immediate Iranian stoppage] would have an impact, but it's not the case that from one day to another one of our members would have no oil at all.For her part, EU foreign relations spokeswoman Maja Kocjancic said consultations between member states to make sure disruption scenarios do not leave anybody high and dry have been going on for quite some time.Oil markets on Friday stayed calm, with prices going up less than $1 per barrel.The market reaction was similar to Monday's, when prices went up by just over $1 after Iran repeated threats to block the Strait of Hormuz, a maritime conduit for Saudi oil exports.Western analysts do not believe Iran would risk a military confrontation with the US, which keeps two aircraft carriers nearby.

Israel presented this week, for the first time, its principles regarding the borders of a future Palestinian state. The borders were presented during Wednesday’s meeting in Jordan between attorney Yitzchak Molcho and the Palestinian Authority’s chief negotiator Saeb Erekat.One of the principles presented by Molcho is that, in a final settlement, most of the Israeli residents of Judea and Samaria will remain in Israeli territory, and the border will be drawn in such a way that most PA Arabs who currently reside in Judea and Samaria will be part of the Palestinian state.The borders presented by Molcho are similar to the route of the separation fence, which was constructed in such a way that most of the major settlement blocs remained on the western side of the fence. This includes Gush Etzion, Ma’aleh Adumim, Beitar Illit, Kiryat Sefer and Alfei Menashe. Israel insists that Ariel also be included as part of Israeli territory in a permanent status agreement with the PA.Molcho presented Israel’s position on borders orally and did not present Erekat with an official document on the matter. He presented a series of general principles, without displaying maps or indicating what percentages of territories Israel would be willing to give up as part of a permanent agreement. Having Israel present its position on borders was a central PA demand to continue talks in Amman under the auspices of King Abdullah, but in the past the PA has consistently rejected having the border be determined based the separation fence.
Presenting the principles on borders marks the first time the current Netanyahu government has agreed to discuss the territorial issue. However, analysts said on Thursday that it is likely a tactical move designed to put pressure on the PA and not give the entity an excuse to end talks by using the argument that Israel would not discuss the issue of borders.Wednesday marked the final exploratory meeting between Israel and the PA, and it ended with no progress. Erekat and Molcho made little headway in their fifth meeting, the last before the January 26 deadline set by the Quartet of peacekeeping nations to break the impasse and relaunch direct talks for a final status agreement between the two sides.Prior to the meeting, the PA-based Ma’an news agency reported that the PA refused to continue talks with Israel after the deadline.Erekat – a member of the Fatah terror faction's Central committee -- used a previous meeting to negotiate the release of all PA terrorist prisoners currently incarcerated in Israeli jails, rather than to focus his efforts on discussing the core issues relating to Israel-PA statehood.Among the issues Erekat raised at the last meeting was advocating for the release of Hamas legislator Aziz Dweik, who had been recently arrested by Israeli security forces.

Former IDF Chief of Staff Gabi Ashkenazi warned, Thursday, that Israel could not afford to cut its defense budget and should prepare itself for war.In comparison to 10 years ago, the possibility of a conflict is not something that we just need to talk about,Ashkenazi said during a lecture at the Institute for National Security Studies in Tel Aviv.We never saw it coming. It happened on my watch, so it must be said. But if it's any consolation, Egypt never saw it coming either,Ashkenazi said of the so-called Arab Spring protests that have no turned into an Islamic winter in elections throughout the Arab world.The Middle East's plates are shifting. What the Egyptian army didn't know, I couldn't have known. (Egypt's) leaders did not know either,he said, adding the ultimate strategic picture was still changing.Ashkenazi told attendees that confronting Iran's nuclear ambitions required a multi-disciplinary approach that included covert, economic, and potentially military action.In my opinion, the strategy vis-à-vis Iran should be to do whatever is possible under the radar coupled with painful and crippling sanctions. The NDAA, National Defense Authorization Act, and the Enemy Expatriation Act are recent efforts to build a legal – if entirely unconstitutional – foundation for the police state and its semi-secret network of gulags and rendition camps under the auspices of FEMA.Prior to the NDAA, the government established important precedents through the Patriot Act and the Military Commissions Act, the latter a direct effort to nullify habeas corpus and allow the government to disappear suspected citizens.

President Barack Obama was accused by prosecution lawyers of being in contempt of court after failing to show up for a birther hearing in Georgia that seeks to establish whether he is eligible to appear on the state ballot in November.As we reported earlier this month, so-called birthers,those who claim there is evidence to suggest Obama was not born in the United States, hailed a judges decision to hear the case as a potential roadblock to Obama even being permitted to run for a second term in the White House.Lawyers for area residents mounting birther challenges told Deputy Chief Judge Michael Malihi that Obama should be found in contempt of court for not appearing when under subpoena to do so. But Malihi did not indicate he would recommend that and cut off one lawyer when he criticized Obama for not attending the hearing,reports the Atlanta-Journal Constitution.It shows not just a contempt for this court, but contempt for the judicial branch,lawyer Van Irion told Malihi.
Earlier this week, Obama’s lawyer, Michael Jablonski, requested that Secretary of State Brian Kemp suspend the hearing, claiming it was not a legitimate issue and insisting he and his client would boycott the hearing. However, Kemp fired back, warning that the hearing was necessary under Georgia law and that Obama and Jablonski’s failure to participate would be at your own peril.Attendants packed the Georgia courtroom yesterday for the trial brought by residents who affirm that Obama was born in Kenya, making him ineligible to be US President.The birther argument was addressed by the White House in an unprecedented acknowledgement of the controversy surrounding the issue last year when a document purporting to be Obama’s birth certificate was released to coincide with the publication of bestselling author Jerome Corsi’s book, Where’s the Birth Certificate? Corsi and other skeptics were unconvinced by the move however, claiming that the document is a forgery created using modern computer techniques and has numerous discrepancies with a genuine 1961 birth certificate created by a typewriter.Corsi has also presented evidence that the supposed social security number contained on the document was never issued to Obama and in fact belonged to an individual in Connecticut.One time Republican presidential candidate Donald Trump repeatedly raised questions surrounding Obama’s background during the spring of 2011 before going cold on the issue, a move Corsi claimed was an organized political stunt to neutralize the issue.The judge in Georgia is expected to make a final ruling on the case after February 5, by which time attorneys are required to file their briefs.

BRUSSELS - The European Commission and 22 EU member states have signed up to a controversial trade agreement in a move marked by cyber attacks and street protests.
Cyprus, Estonia, Germany, the Netherlands and Slovakia were the only EU countries not to put pen to paper at the signing ceremony in Tokyo on Thursday (26 January) of the so-called Anti-Counterfeiting Trade Agreement (Acta).The European Commission told EUobserver the hold-up is purely procedural and that they will come on board shortly.The international treaty was created in behind-closed-doors talks between EU countries and select other World Trade Organisation members over the past five years to enforce intellectual property rights on both digital and physical products.The commission says the EU loses some €8 billion every year from counterfeit items which flood its markets and that Acta will protect jobs.It will become EU law after it is ratified by the European Parliament and member states.The treaty arouses strong emotions among pro-free-speech campaigners, who say it gives authorities too much power, going beyond the equally controversial US Stop Online Piracy Act (Sopa).In signs of a new crackdown on internet freedoms, the US' Federal Bureau of Investigation in recent days flexed its muscles over online file-sharing website Megaupload.Dutch police acting on US requests arrested one of its founding members and a similar sting operation took place on the other side of the world in New Zealand.

BRUSSELS - With just weeks until to go until the EU dips its toe into the unpredictable world of participatory democracy, internet giants are warning the European Commission it had better be prepared for scrutiny by a critical and highly-wired public.On 1 April, over 10 years since EU leaders publicly declared that they need to make the union more democratic, a system giving citizens the chance to shape European debate and potentially its legislation will go live.The so-called Citizens Initiative requires the European Commission to consider legislating in an area on the back of at least 1 million signatures from a minimum of seven (or one quarter) of member states.This new right will open a new chapter in the democratic life of the EU. Not only will it provide a direct gateway for citizens to make their voices heard in Brussels, it will also encourage real cross-border debates about EU issues,said EU commission vice-president Maros Sefcovic at a conference launching the initiative website on Thursday (26 January).Danish Europe minister Nicolai Wammen indicated the most important aspect of the new tool will be that citizens will have the chance to set the agenda,noting that getting a conversation going about an issue means already being half way there.With the Arab Spring showcasing the power of social networks such as Facebook to spread news and ideas, some at the conference suggested the Citizens Initiative will see the fairly disparate protests against unemployment and austerity measures in various member states become a single, widely-supported petition.
For her part, Facebook's policy chief in Brussels, Erika Mann says that humans love to have a connection and to live in a better world and that this all connects to the political world.Simon Hampton, European public policy director at internet search company Google, believes it is likely to be a game-changer for the way the commission interacts with citizens.The internet-powered citizen expects to be listened to. They want to be part of the conversation,he said. He added that the new tool puts the commission under scrutiny too.In a recent example in the US, the White House reconsidered a new anti-piracy law after thousands of people voiced concern about free speech on the internet and popular websites, such as Wikipedia, blacked out their homepage in protest.Some social network sites say they will be natural allies of the European initiative.Giuseppe de Martino, secretary general of video-sharing website Dailymotion, said his company could be a video platform that uses images to explain the initiative.Further down the line, successful initiatives are likely to be taken up by European political parties which will next year begin thinking about their campaigns for the 2014 European elections.But the first few months are likely to see a period of experimentation by both sides - citizens seeing how it works and the European Commission seeing how to respond.Critics have warned the initiative could be hijacked by one-horse issues pushed by a particular interest group.But the commission says this will be countered by the threshold of member states and signatures required. It also has several get-out clauses - initiatives cannot be called for actions which lie outside its powers or which are abusive, frivolous or vexatious.They are also prohibited from being contrary to EU values.The success of the EU's foray into participatory democracy is likely to depend on how fairly citizens think the commission applies these criteria.
US envoy talks down fears on internet snooping

BRUSSELS - A senior US official has tried to dispel the notion that post-9/11 America abuses internet privacy, as EU lawmakers and civil liberties activists look to the future of web policing.The state department's top official on international communications, Philip Verveer, who in his past work as a lawyer in the private sector also helped put together some of the US' biggest pieces of media legislation, led the mission to the EU capital on Thursday (26 January).He told press that US authorities adhere to stricter rules than some EU member states when attempting to access information stored on the cloud - the emerging market of online data storage and services provided by companies.Cloud data can belong to an individual from one country, be stored on a server in another country, which belongs to a company located in a third country and is managed by a sub-contractor from a fourth place. People who use Google Docs, for instance, typically do not know where their files are actually stored or who manages them.Despite the complexities of cloud computing, the US officials said it is already covered by EU and US bilateral frameworks on data protection dating back to 2001.We think there are serious misunderstandings about the availability to data by US law enforcement on the cloud,Verveer noted.
Verveer and a fellow official from the US mission to the EU, Stewart Robinson, said the so-called Patriot Act comes in for undue criticism.Passed less than two months after 9/11, NGOs such as the American Civil Liberties Union have said it gives authorities too much leeway on monitoring internet traffic and private emails in the name of national security.The US officials on Thursday said independent judges have to give law enforcement agents special permission to access anybody's email or private records in safeguards equivalent to those in EU countries.The Patriot Act is really not an issue at all and yet it surfaces a lot ... BRUSSELS - German Chancellor Angela Merkel has said transferring more powers to EU institutions rather than increasing the size of the eurozone's future bail-out fund is the way to overcome the euro crisis.We have said right from the start that we want to stand up for the euro, but what we don't want is a situation where we are forced to promise something that we will not be able to fulfil, Merkel said Wednesday (25 January) in the opening speech of the World Economic Forum, an informal gathering of leaders and business magnates held every year in Davos, a Swiss mountain resort.Merkel resisted calls made by the International Monetary Fund and the Italian Prime Minister to increase contributions to the European Stability Mechanism, set to come into force in July with a firepower of €500 billion and aimed at lowering the borrowing costs of large euro-economies such as Italy and Spain.
Some say that it has to be double the size, then if that’s not big enough, others will say it has to be three times as big,she said.If Germany, as the representative of all European countries, promises something that can’t be kept in the event of a harsh attack by the markets, then Europe would have a wide-open flank.Instead, her solution is more integration, by transferring more powers from a national level to EU institutions such as the European Court of Justice, so that the continent is turned into a Europe that works.We have taken some steps closer to a fiscal union, but we can get faster, gain speed and become more decisive,she added, in reference to the inter-governmental treaty on fiscal discipline currently being negotiated among 26 member states, except Britain.She made similar remarks in an interview published earlier that day in five major newspapers from different EU countries, including The Guardian:We will only be able to strengthen our common currency if we co-ordinate our policies more closely and are prepared to gradually give up more powers to the EU. That means giving our [European] institutions more monitoring rights – and more bite.Merkel also warned in that same interview that amid all the billions in financial assistance and rescue packages, we Germans also need to watch that we don't run out of steam. After all, our capacities aren't infinite, and overstretching ourselves wouldn't help us or the EU as a whole.She is expected, however, to budge on the issue in March, when EU leaders meet to discuss potentially increasing the fund. In the past, she had also steadfastly ruled out any further contributions to bail-outs or the establishment of the permanent ESM, only to give in after painful negotiations - a tactic which has been criticised both at home and abroad.

DAVOS, Switzerland (AP) — Israeli Defense Minister Ehud Barak said Friday the world must quickly stop Iran from reaching the point where even a surgical military strike could not block it from obtaining nuclear weapons.Amid fears that Israel is nearing a decision to attack Iran's nuclear program, Barak said tougher international sanctions are needed against Tehran's oil and banks so that we all will know early enough whether the Iranians are ready to give up their nuclear weapons program.Iran insists its atomic program is aimed only at producing energy and research, but it has refused to consider giving up its ability to enrich uranium.The United Nations has imposed four rounds of sanctions against Iran, but veto-wielding Russia and China say they see no need for additional punitive measures. That has left the U.S. and the European Union to try to pressure other countries to follow their lead and impose even tougher sanctions.
We are determined to prevent Iran from turning nuclear. And even the American president and opinion leaders have said that no option should be removed from the table and Iran should be blocked from turning nuclear,Barak told reporters during the annual meeting of the World Economic Forum.It seems to us to be urgent, because the Iranians are deliberately drifting into what we call an immunity zone where practically no surgical operation could block them,he said.But while Barak called it a challenge for the whole world to prevent a nuclear-armed Iran, he stopped short of confirming any action that could further stoke Washington's concern about a possible Israeli military strike.Iran has accused Israel of masterminding the killing of Iranian scientists involved in the nuclear program, but Barak declined to comment on that.Earlier, he told a panel discussion that a stable world order is incompatible with a nuclear-armed Iran because countries such as Saudi Arabia, Turkey and Egypt will all want the bomb.This will be the end of any nonproliferation regime, Barak said. The major powers in the region will all feel compelled to turn nuclear.
Separately, U.N. Secretary General Ban Ki-Moon urged a resumption of dialogue between Western powers and Iran on the nuclear issue.He said Friday that Tehran must comply with Security Council resolutions and prove conclusively that its nuclear program is not directed at making arms.The onus is on Iran,Ban said at a press conference.They have to prove themselves that their nuclear development program is genuinely for peaceful purposes, which they have not done yet.Ban expressed concern about the most recent report of the International Atomic Energy Agency, which strongly suggested Iran's nuclear program has a military purpose.On Thursday, President Mahmoud Ahmadinejad said Iran is ready to revive talks with the U.S. and other world powers but suggested that Tehran's foes will have to make compromises to prevent negotiations from again collapsing in stalemate.Iran says it won't give up its right to enrich uranium and produce nuclear fuel, but it has offered to allow IAEA inspectors to visit its nuclear sites to ensure that the program won't be weaponized.IAEA chief Yukiya Amano said at a Davos session that we do not have that much confidence if Iran has declared everything and its best information indicates that Iran has engaged in activities relevant to nuclear explosive devices.For now they do not have the capacity to manufacture the fuel,he said.But in the future, we don't know.Amano added that an IAEA mission would be sent Saturday to address this issue.If the enrichment to higher levels is in a declared facility, we can find it very quickly,he said.The problem is we do not know if these are all the declared facilities.Richard Haass, a former top U.S. diplomat who heads the Council on Foreign Relations, said international law justifies a pre-emptive strike only to stave off an imminent attack.The real question is can Iran assure us what it is not doing? he said.Israeli defense officials said Friday that new European sanctions on Iran could constrain Israel. They said any Israeli strike against Iranian nuclear facilities may lack international legitimacy while the world waits to see the effects of the new measures.
The officials spoke Friday on condition of anonymity because they weren't authorized to discuss sensitive military matters.Much of the West agrees with Israel that Iran, despite its denials, is developing nuclear weapons technology. But the United States clearly worries that a military attack could backfire, by dividing international opposition to Iran — and send oil prices skyrocketing.Israel has attacked nuclear sites in foreign countries before. In 1981, Israeli warplanes destroyed an unfinished Iraqi nuclear reactor. In 2007, Israeli aircraft destroyed a site in Syria that the U.N. nuclear watchdog deemed to be a secretly built nuclear reactor.
But Israel is unlikely to strike without coordinating with the Americans, who maintain forces on aircraft carriers and military bases in the Gulf.In spite of his tough words to Iran, Ban said that dialogue among the three-plus-three — Germany, France and Britain plus Russia, China and the United States — is the path forward.

It is a little hard to know, given that what is deemed a safe level of radiation is determined by politics … rather than science. For example, current safety standards are based on the ridiculous assumption thateveryone exposed is a healthy man in his 20s – and that radioactive particles ingested into the body cause no more damage than radiation hitting the outside of the body.And one of the main advisors to the Japanese government on Fukushima announced:If you smile, the radiation will not affect you.In the real world, however, even low doses of radiation can cause cancer. Moreover, small particles of radiation – called internal emitters – which get inside the body are much more dangerous than general exposures to radiation. See this and this. And radiation affects small children much more than full-grown adults.Indeed, instead of doing much to try to protect their citizens from Fukushima, Japan, the U.S. and the EU all just raised the radiation levels they deem safe.Nuclear expert Arnie Gundersen says that high-level friends in the State Department told him that Hillary Clinton signed a pact with her counterpart in Japan agreeing that the U.S. will continue buying seafood from Japan, despite that food not being tested for radioactive materials.
And the Department of Energy is trying to replace the scientifically accepted model of the dangers of low dose radiation based on voodoo science. Specifically, DOE’s Lawrence Berkeley Labs used a mutant line of human cells in a petri dish which was able to repair damage from low doses of radiation, and extrapolated to the unsupported conclusion that everyone is immune to low doses of radiation:In reality, not only is there overwhelming evidence that low doses of radiation can cause cancer, but there is some evidence that low doses can – in certain circumstances cause more damage than higher doses.As I pointed out in April:The Bulletin of Atomic Scientists reported that one of the best-known scientists of the 20th century – Dr. John Gofman – also believed that chronic low level radiation is more dangerous than acute exposure to high doses. Sports stadiums have historically served as impromptu prisons for military dictatorships.The government has conducted a number of beta tests over the years in preparation for mass arrests and ultimately extraordinary renditions to black site torture dungeons.In addition to an alarming number of high profile military exercises, the government has worked in tandem with local police during events such as the the Republican and Democrat national conventions and periodic gatherings of the globalist elite in Pittsburgh and elsewhere. During the events, they have beta tested and honed their ability to arrest large numbers of people and hold them in squalid detention centers.

Legal Precedents and Police State Preparations
The NDAA, National Defense Authorization Act, and the Enemy Expatriation Act are recent efforts to build a legal – if entirely unconstitutional – foundation for the police state and its semi-secret network of gulags and rendition camps under the auspices of FEMA.Prior to the NDAA, the government established important precedents through the Patriot Act and the Military Commissions Act, the latter a direct effort to nullify habeas corpus and allow the government to disappear suspected citizens.
The Constitution-busting Patriot Act emerged from the hysteria following the attacks of September 11, 2001, and spawned a raft of proposed anti-terror legislation, including The Universal National Service Act of 2003 and Patriot Act II, an earlier effort to trash habeas corpus. The legislation was paraded before the American people under the guise of fighting phantom terrorists, but as a large number of legal experts, civil libertarians and commentators have noted, it is designed for the American people, not al-Qaeda miscreants.The National Emergency Centers Act or HR 645 was established to provide a legal context for the camps covered above. The bill mandates that six separate facilities be established in different Federal Emergency Management Agency Regions (FEMA) throughout the country. KBR’s call for FEMA camp service bids arrived soon after the NDAA was passed in the Senate.Contingency plans to suspend the Constitution and abduct enemies of the state go back to at least the 1980s. But Malihi did not indicate he would recommend that and cut off one lawyer when he criticized Obama for not attending the hearing,reports the Atlanta-Journal Constitution.It shows not just a contempt for this court, but contempt for the judicial branch,lawyer Van Irion told Malihi.

Corsi and other skeptics were unconvinced by the move however, claiming that the document is a forgery created using modern computer techniques and has numerous discrepancies with a genuine 1961 birth certificate created by a typewriter.Corsi has also presented evidence that the supposed social security number contained on the document was never issued to Obama and in fact belonged to an individual in Connecticut.One time Republican presidential candidate Donald Trump repeatedly raised questions surrounding Obama’s background during the spring of 2011 before going cold on the issue, a move Corsi claimed was an organized political stunt to neutralize the issue.The judge in Georgia is expected to make a final ruling on the case after February 5, by which time attorneys are required to file their briefs.

BRUSSELS - The European Commission and 22 EU member states have signed up to a controversial trade agreement in a move marked by cyber attacks and street protests.
Cyprus, Estonia, Germany, the Netherlands and Slovakia were the only EU countries not to put pen to paper at the signing ceremony in Tokyo on Thursday (26 January) of the so-called Anti-Counterfeiting Trade Agreement (Acta).The European Commission told EUobserver the hold-up is purely procedural and that they will come on board shortly.The international treaty was created in behind-closed-doors talks between EU countries and select other World Trade Organisation members over the past five years to enforce intellectual property rights on both digital and physical products.The commission says the EU loses some €8 billion every year from counterfeit items which flood its markets and that Acta will protect jobs.It will become EU law after it is ratified by the European Parliament and member states.The treaty arouses strong emotions among pro-free-speech campaigners, who say it gives authorities too much power, going beyond the equally controversial US Stop Online Piracy Act (Sopa).In signs of a new crackdown on internet freedoms, the US' Federal Bureau of Investigation in recent days flexed its muscles over online file-sharing website Megaupload.Dutch police acting on US requests arrested one of its founding members and a similar sting operation took place on the other side of the world in New Zealand.
Acta critics believe signatories will not only gang up with internet providers against undesirable internet users but could also exploit it to undermine access to generic medicine in developing countries.The Tokyo events saw notable protests in the EU capital and in Poland.The European Parliament's website was taken off line on Thursday as hackers bombarded it with a 300,000 hit-a-second denial of service attack. BRUSSELS - With just weeks until to go until the EU dips its toe into the unpredictable world of participatory democracy, internet giants are warning the European Commission it had better be prepared for scrutiny by a critical and highly-wired public.On 1 April, over 10 years since EU leaders publicly declared that they need to make the union more democratic, a system giving citizens the chance to shape European debate and potentially its legislation will go live.The so-called Citizens Initiative requires the European Commission to consider legislating in an area on the back of at least 1 million signatures from a minimum of seven (or one quarter) of member states.This new right will open a new chapter in the democratic life of the EU. Not only will it provide a direct gateway for citizens to make their voices heard in Brussels, it will also encourage real cross-border debates about EU issues,said EU commission vice-president Maros Sefcovic at a conference launching the initiative website on Thursday (26 January).Danish Europe minister Nicolai Wammen indicated the most important aspect of the new tool will be that citizens will have the chance to set the agenda,noting that getting a conversation going about an issue means already being half way there.With the Arab Spring showcasing the power of social networks such as Facebook to spread news and ideas, some at the conference suggested the Citizens Initiative will see the fairly disparate protests against unemployment and austerity measures in various member states become a single, widely-supported petition.

US envoy talks down fears on internet snooping

BRUSSELS - A senior US official has tried to dispel the notion that post-9/11 America abuses internet privacy, as EU lawmakers and civil liberties activists look to the future of web policing.The state department's top official on international communications, Philip Verveer, who in his past work as a lawyer in the private sector also helped put together some of the US' biggest pieces of media legislation, led the mission to the EU capital on Thursday (26 January).He told press that US authorities adhere to stricter rules than some EU member states when attempting to access information stored on the cloud - the emerging market of online data storage and services provided by companies.Cloud data can belong to an individual from one country, be stored on a server in another country, which belongs to a company located in a third country and is managed by a sub-contractor from a fourth place. People who use Google Docs, for instance, typically do not know where their files are actually stored or who manages them.Despite the complexities of cloud computing, the US officials said it is already covered by EU and US bilateral frameworks on data protection dating back to 2001.We think there are serious misunderstandings about the availability to data by US law enforcement on the cloud,Verveer noted.
Verveer and a fellow official from the US mission to the EU, Stewart Robinson, said the so-called Patriot Act comes in for undue criticism.Passed less than two months after 9/11, NGOs such as the American Civil Liberties Union have said it gives authorities too much leeway on monitoring internet traffic and private emails in the name of national security.The US officials on Thursday said independent judges have to give law enforcement agents special permission to access anybody's email or private records in safeguards equivalent to those in EU countries.The Patriot Act is really not an issue at all and yet it surfaces a lot ... BRUSSELS - German Chancellor Angela Merkel has said transferring more powers to EU institutions rather than increasing the size of the eurozone's future bail-out fund is the way to overcome the euro crisis.We have said right from the start that we want to stand up for the euro, but what we don't want is a situation where we are forced to promise something that we will not be able to fulfil, Merkel said Wednesday (25 January) in the opening speech of the World Economic Forum, an informal gathering of leaders and business magnates held every year in Davos, a Swiss mountain resort.Merkel resisted calls made by the International Monetary Fund and the Italian Prime Minister to increase contributions to the European Stability Mechanism, set to come into force in July with a firepower of €500 billion and aimed at lowering the borrowing costs of large euro-economies such as Italy and Spain.
Some say that it has to be double the size, then if that’s not big enough, others will say it has to be three times as big,she said.If Germany, as the representative of all European countries, promises something that can’t be kept in the event of a harsh attack by the markets, then Europe would have a wide-open flank.Instead, her solution is more integration, by transferring more powers from a national level to EU institutions such as the European Court of Justice, so that the continent is turned into a Europe that works.We have taken some steps closer to a fiscal union, but we can get faster, gain speed and become more decisive,she added, in reference to the inter-governmental treaty on fiscal discipline currently being negotiated among 26 member states, except Britain.She made similar remarks in an interview published earlier that day in five major newspapers from different EU countries, including The Guardian:We will only be able to strengthen our common currency if we co-ordinate our policies more closely and are prepared to gradually give up more powers to the EU. The point of the fiscal compact, after all, is to make it possible to check on those commitments. That means giving our [European] institutions more monitoring rights – and more bite.Merkel also warned in that same interview that amid all the billions in financial assistance and rescue packages, we Germans also need to watch that we don't run out of steam. After all, our capacities aren't infinite, and overstretching ourselves wouldn't help us or the EU as a whole.She is expected, however, to budge on the issue in March, when EU leaders meet to discuss potentially increasing the fund. In the past, she had also steadfastly ruled out any further contributions to bail-outs or the establishment of the permanent ESM, only to give in after painful negotiations - a tactic which has been criticised both at home and abroad.

DAVOS, Switzerland (AP) — Israeli Defense Minister Ehud Barak said Friday the world must quickly stop Iran from reaching the point where even a surgical military strike could not block it from obtaining nuclear weapons.Amid fears that Israel is nearing a decision to attack Iran's nuclear program, Barak said tougher international sanctions are needed against Tehran's oil and banks so that we all will know early enough whether the Iranians are ready to give up their nuclear weapons program.Iran insists its atomic program is aimed only at producing energy and research, but it has refused to consider giving up its ability to enrich uranium.The United Nations has imposed four rounds of sanctions against Iran, but veto-wielding Russia and China say they see no need for additional punitive measures. That has left the U.S. and the European Union to try to pressure other countries to follow their lead and impose even tougher sanctions.
We are determined to prevent Iran from turning nuclear. And even the American president and opinion leaders have said that no option should be removed from the table and Iran should be blocked from turning nuclear,Barak told reporters during the annual meeting of the World Economic Forum.It seems to us to be urgent, because the Iranians are deliberately drifting into what we call an immunity zone where practically no surgical operation could block them,he said.But while Barak called it a challenge for the whole world to prevent a nuclear-armed Iran, he stopped short of confirming any action that could further stoke Washington's concern about a possible Israeli military strike.Iran has accused Israel of masterminding the killing of Iranian scientists involved in the nuclear program, but Barak declined to comment on that.Earlier, he told a panel discussion that a stable world order is incompatible with a nuclear-armed Iran because countries such as Saudi Arabia, Turkey and Egypt will all want the bomb.This will be the end of any nonproliferation regime, Barak said. The major powers in the region will all feel compelled to turn nuclear.
Separately, U.N. Secretary General Ban Ki-Moon urged a resumption of dialogue between Western powers and Iran on the nuclear issue.He said Friday that Tehran must comply with Security Council resolutions and prove conclusively that its nuclear program is not directed at making arms.The onus is on Iran,Ban said at a press conference.They have to prove themselves that their nuclear development program is genuinely for peaceful purposes, which they have not done yet.Ban expressed concern about the most recent report of the International Atomic Energy Agency, which strongly suggested Iran's nuclear program has a military purpose.On Thursday, President Mahmoud Ahmadinejad said Iran is ready to revive talks with the U.S. and other world powers but suggested that Tehran's foes will have to make compromises to prevent negotiations from again collapsing in stalemate.Iran says it won't give up its right to enrich uranium and produce nuclear fuel, but it has offered to allow IAEA inspectors to visit its nuclear sites to ensure that the program won't be weaponized.IAEA chief Yukiya Amano said at a Davos session that we do not have that much confidence if Iran has declared everything and its best information indicates that Iran has engaged in activities relevant to nuclear explosive devices.For now they do not have the capacity to manufacture the fuel,he said.But in the future, we don't know.Amano added that an IAEA mission would be sent Saturday to address this issue.If the enrichment to higher levels is in a declared facility, we can find it very quickly,he said.The problem is we do not know if these are all the declared facilities.Richard Haass, a former top U.S. diplomat who heads the Council on Foreign Relations, said international law justifies a pre-emptive strike only to stave off an imminent attack.The real question is can Iran assure us what it is not doing? he said.Israeli defense officials said Friday that new European sanctions on Iran could constrain Israel. They said any Israeli strike against Iranian nuclear facilities may lack international legitimacy while the world waits to see the effects of the new measures.
The officials spoke Friday on condition of anonymity because they weren't authorized to discuss sensitive military matters.Much of the West agrees with Israel that Iran, despite its denials, is developing nuclear weapons technology. But the United States clearly worries that a military attack could backfire, by dividing international opposition to Iran — and send oil prices skyrocketing.Israel has attacked nuclear sites in foreign countries before. In 1981, Israeli warplanes destroyed an unfinished Iraqi nuclear reactor. In 2007, Israeli aircraft destroyed a site in Syria that the U.N. nuclear watchdog deemed to be a secretly built nuclear reactor.
But Israel is unlikely to strike without coordinating with the Americans, who maintain forces on aircraft carriers and military bases in the Gulf.In spite of his tough words to Iran, Ban said that dialogue among the three-plus-three — Germany, France and Britain plus Russia, China and the United States — is the path forward.

American and Canadian authorities have virtually stopped monitoring airborne radiation.Neither American nor Canadian authorities are testing fish for radioactivity.Does that mean that we don’t have to worry about radiation from Fukushima? It is a little hard to know, given that what is deemed a safe level of radiation is determined by politics … rather than science. For example, current safety standards are based on the ridiculous assumption thateveryone exposed is a healthy man in his 20s – and that radioactive particles ingested into the body cause no more damage than radiation hitting the outside of the body.And one of the main advisors to the Japanese government on Fukushima announced:If you smile, the radiation will not affect you.In the real world, however, even low doses of radiation can cause cancer. Moreover, small particles of radiation – called internal emitters – which get inside the body are much more dangerous than general exposures to radiation. See this and this. And radiation affects small children much more than full-grown adults.Indeed, instead of doing much to try to protect their citizens from Fukushima, Japan, the U.S. and the EU all just raised the radiation levels they deem safe.Nuclear expert Arnie Gundersen says that high-level friends in the State Department told him that Hillary Clinton signed a pact with her counterpart in Japan agreeing that the U.S. will continue buying seafood from Japan, despite that food not being tested for radioactive materials.
And the Department of Energy is trying to replace the scientifically accepted model of the dangers of low dose radiation based on voodoo science. Specifically, DOE’s Lawrence Berkeley Labs used a mutant line of human cells in a petri dish which was able to repair damage from low doses of radiation, and extrapolated to the unsupported conclusion that everyone is immune to low doses of radiation:In reality, not only is there overwhelming evidence that low doses of radiation can cause cancer, but there is some evidence that low doses can – in certain circumstances cause more damage than higher doses.As I pointed out in April:The Bulletin of Atomic Scientists reported that one of the best-known scientists of the 20th century – Dr. John Gofman – also believed that chronic low level radiation is more dangerous than acute exposure to high doses. Am I worried that Google is about to link up every little bit of information it has gleaned about me from its various websites, so that it can bombard me with suggestions and adverts based on things I have already – willingly – tapped into their rather handy search engine, their hugely useful video clip site or my secondary email account? No, I am not worried. Not in the least.Anybody who is upset at the thought of an advert for cheap flights, for a new face cream or for a charming hotel in Tuscany popping up, as if unbidden, on their computer, has a very simple choice. They should simply foreswear the evil internet, just log off and while they are at it, why not go up to the attic where they might well have left their last dog-eared copy of the Yellow Pages.Privacy advocates have been grumbling for years about the sinister motives of the internet behemoths, of which the chief villain is, of course, Google. The blunder has exposed O2 users to unwanted calls and spam messages. It highlights the vulnerability of so much of the technology we take for granted and shows us just how easily cyber security and data protection can be breached.We have a right to demand more vigilance from these companies but by the same token, perhaps we need to be a little more attentive ourselves? For individuals of my generation and older, the frightening speed of the internet, its global reach and its sheer power can seem risky, threatening and perilous. It is no surprise that we feel vulnerable at the thought of – inadvertently - disclosing so many personal details.For the kids, digital natives born since 1980, who have no concept of a pre-internet world, it seems normal, natural and they have no reservations whatsoever about posting all manner of personal information on whatever forum. India is the first buyer of Iranian oil to agree to pay for its purchases in gold instead of the US dollar, DEBKAfile’s intelligence and Iranian sources report exclusively. Those sources expect China to follow suit. India and China take about one million barrels per day, or 40 percent of Iran’s total exports of 2.5 million bpd. Both are superpowers in terms of gold assets.By trading in gold, New Delhi and Beijing enable Tehran to bypass the upcoming freeze on its central bank’s assets and the oil embargo which the European Union’s foreign ministers agreed to impose Monday, Jan. 23. The EU currently buys around 20 percent of Iran’s oil exports.
The vast sums involved in these transactions are expected, furthermore, to boost the price of gold and depress the value of the dollar on world markets.
Iran’s second largest customer after China, India purchases around $12 billion a year’s worth of Iranian crude, or about 12 percent of its consumption. Delhi is to execute its transactions, according to our sources, through two state-owned banks: the Calcutta-based UCO Bank, whose board of directors is made up of Indian government and Reserve Bank of India representatives; and Halk Bankasi (Peoples Bank), Turkey’s seventh largest bank which is owned by the government.
An Indian delegation visited Tehran last week to discuss payment options in view of the new sanctions. The two sides were reported to have agreed that payment for the oil purchased would be partly in yen and partly in rupees. The switch to gold was kept dark.India thus joins China in opting out of the US-led European sanctions against Iran’s international oil and financial business. Turkey announced publicly last week that it would not adhere to any sanctions against Iran’s nuclear program unless they were imposed by the United Nations Security Council.The EU decision of Monday banned the signing of new oil contracts with Iran at once, while phasing out existing transactions by July 1, 2012, when the European embargo, like the measure enforced by the United States, becomes total. The European foreign ministers also approved a freeze on the assets of the Central Bank of Iran which handles all the country’s oil transactions.However, the damage those sanctions cause the Iranian economy will be substantially cushioned by the oil deals to be channeled through Turkish and Indian state banks. China for its part has declared its opposition to sanctions against Iran.
DEBKAfile’s intelligence sources disclose that Tehran has set up alternative financial mechanisms with China and Russia for getting paid for its oil in currencies other than US dollars. Both Beijing and Moscow are keeping the workings of those mechanisms top secret.

Months before the debate about Internet censorship raged as SOPA and PIPA dominated the concerns of web users, President Obama signed an international treaty that would allow companies in China or any other country in the world to demand ISPs remove web content in the US with no legal oversight whatsoever.The Anti-Counterfeiting Trade Agreement was signed by Obama on October 1 2011, yet is currently the subject of a White House petition demanding Senators be forced to ratify the treaty. The White House has circumvented the necessity to have the treaty confirmed by lawmakers by presenting it an as executive agreement, although legal scholars have highlighted the dubious nature of this characterization.The hacktivist group Anonymous attacked and took offline the Federal Trade Commission’s website yesterday in protest against the treaty, which was also the subject of demonstrations across major cities in Poland, a country set to sign the agreement today.Under the provisions of ACTA, copyright holders will be granted sweeping direct powers to demand ISPs remove material from the Internet on a whim. Whereas ISPs normally are only forced to remove content after a court order, all legal oversight will be abolished, a precedent that will apply globally, rendering the treaty worse in its potential scope for abuse than SOPA or PIPA.
A country known for its enforcement of harsh Internet censorship policies like China could demand under the treaty that an ISP in the United States remove content or terminate a website on its server altogether. As we have seen from the enforcement of similar copyright policies in the US, websites are sometimes targeted for no justifiable reason.The groups pushing the treaty also want to empower copyright holders with the ability to demand that users who violate intellectual property rights (with no legal process) have their Internet connections terminated, a punishment that could only ever be properly enforced by the creation of an individual Internet ID card for every web user, a system that is already in the works.The same industry rightsholder groups that support the creation of ACTA have also called for mandatory network-level filtering by Internet Service Providers and for Internet Service Providers to terminate citizens’ Internet connection on repeat allegation of copyright infringement (the Three Strikes /Graduated Response) so there is reason to believe that ACTA will seek to increase intermediary liability and require these things of Internet Service Providers,reports the Electronic Frontier Foundation.The treaty will also mandate that ISPs disclose personal user information to the copyright holder, while providing authorities across the globe with broader powers to search laptops and Internet-capable devices at border checkpoints.In presenting ACTA as an international agreement rather than a treaty, the Obama administration managed to circumvent the legislative process and avoid having to get Senate approval, a method questioned by Senator Wyden.
That said, even if Obama has declared ACTA an executive agreement (while those in Europe insist that it’s a binding treaty), there is a very real Constitutional question here: can it actually be an executive agreement? asks TechDirt. The law is clear that the only things that can be covered by executive agreements are things that involve items that are solely under the President’s mandate. That is, you can’t sign an executive agreement that impacts the things Congress has control over. But here’s the thing: intellectual property, in Article 1, Section 8 of the Constitution, is an issue given to Congress, not the President. Thus, there’s a pretty strong argument that the president legally cannot sign any intellectual property agreements as an executive agreement and, instead, must submit them to the Senate.26 European Union member states along with the EU itself are set to sign the treaty at a ceremony today in Tokyo. Federal officials are also looking at whether Google is running afoul of antitrust rules by using its dominance in online searches to favor its other business lines.
Claudia Farrell, a spokeswoman for the FTC, declined to comment on any interaction between Google and regulators on its new privacy changes.

No, I am not worried. The blunder has exposed O2 users to unwanted calls and spam messages. It highlights the vulnerability of so much of the technology we take for granted and shows us just how easily cyber security and data protection can be breached.We have a right to demand more vigilance from these companies but by the same token, perhaps we need to be a little more attentive ourselves? For individuals of my generation and older, the frightening speed of the internet, its global reach and its sheer power can seem risky, threatening and perilous. It is no surprise that we feel vulnerable at the thought of – inadvertently - disclosing so many personal details.For the kids, digital natives born since 1980, who have no concept of a pre-internet world, it seems normal, natural and they have no reservations whatsoever about posting all manner of personal information on whatever forum. India is the first buyer of Iranian oil to agree to pay for its purchases in gold instead of the US dollar, DEBKAfile’s intelligence and Iranian sources report exclusively. Those sources expect China to follow suit. India and China take about one million barrels per day, or 40 percent of Iran’s total exports of 2.5 million bpd. Both are superpowers in terms of gold assets.By trading in gold, New Delhi and Beijing enable Tehran to bypass the upcoming freeze on its central bank’s assets and the oil embargo which the European Union’s foreign ministers agreed to impose Monday, Jan. 23. The EU currently buys around 20 percent of Iran’s oil exports.
The vast sums involved in these transactions are expected, furthermore, to boost the price of gold and depress the value of the dollar on world markets.
Iran’s second largest customer after China, India purchases around $12 billion a year’s worth of Iranian crude, or about 12 percent of its consumption. Delhi is to execute its transactions, according to our sources, through two state-owned banks: the Calcutta-based UCO Bank, whose board of directors is made up of Indian government and Reserve Bank of India representatives; and Halk Bankasi (Peoples Bank), Turkey’s seventh largest bank which is owned by the government.
An Indian delegation visited Tehran last week to discuss payment options in view of the new sanctions. The two sides were reported to have agreed that payment for the oil purchased would be partly in yen and partly in rupees. The switch to gold was kept dark.India thus joins China in opting out of the US-led European sanctions against Iran’s international oil and financial business. Turkey announced publicly last week that it would not adhere to any sanctions against Iran’s nuclear program unless they were imposed by the United Nations Security Council.The EU decision of Monday banned the signing of new oil contracts with Iran at once, while phasing out existing transactions by July 1, 2012, when the European embargo, like the measure enforced by the United States, becomes total. The European foreign ministers also approved a freeze on the assets of the Central Bank of Iran which handles all the country’s oil transactions.However, the damage those sanctions cause the Iranian economy will be substantially cushioned by the oil deals to be channeled through Turkish and Indian state banks. China for its part has declared its opposition to sanctions against Iran.
DEBKAfile’s intelligence sources disclose that Tehran has set up alternative financial mechanisms with China and Russia for getting paid for its oil in currencies other than US dollars. Both Beijing and Moscow are keeping the workings of those mechanisms top secret.

Months before the debate about Internet censorship raged as SOPA and PIPA dominated the concerns of web users, President Obama signed an international treaty that would allow companies in China or any other country in the world to demand ISPs remove web content in the US with no legal oversight whatsoever.The Anti-Counterfeiting Trade Agreement was signed by Obama on October 1 2011, yet is currently the subject of a White House petition demanding Senators be forced to ratify the treaty. The White House has circumvented the necessity to have the treaty confirmed by lawmakers by presenting it an as executive agreement, although legal scholars have highlighted the dubious nature of this characterization.The hacktivist group Anonymous attacked and took offline the Federal Trade Commission’s website yesterday in protest against the treaty, which was also the subject of demonstrations across major cities in Poland, a country set to sign the agreement today.Under the provisions of ACTA, copyright holders will be granted sweeping direct powers to demand ISPs remove material from the Internet on a whim. Whereas ISPs normally are only forced to remove content after a court order, all legal oversight will be abolished, a precedent that will apply globally, rendering the treaty worse in its potential scope for abuse than SOPA or PIPA.
A country known for its enforcement of harsh Internet censorship policies like China could demand under the treaty that an ISP in the United States remove content or terminate a website on its server altogether. As we have seen from the enforcement of similar copyright policies in the US, websites are sometimes targeted for no justifiable reason.The groups pushing the treaty also want to empower copyright holders with the ability to demand that users who violate intellectual property rights (with no legal process) have their Internet connections terminated, a punishment that could only ever be properly enforced by the creation of an individual Internet ID card for every web user, a system that is already in the works.The same industry rightsholder groups that support the creation of ACTA have also called for mandatory network-level filtering by Internet Service Providers and for Internet Service Providers to terminate citizens’ Internet connection on repeat allegation of copyright infringement (the Three Strikes /Graduated Response) so there is reason to believe that ACTA will seek to increase intermediary liability and require these things of Internet Service Providers,reports the Electronic Frontier Foundation.The treaty will also mandate that ISPs disclose personal user information to the copyright holder, while providing authorities across the globe with broader powers to search laptops and Internet-capable devices at border checkpoints.In presenting ACTA as an international agreement rather than a treaty, the Obama administration managed to circumvent the legislative process and avoid having to get Senate approval, a method questioned by Senator Wyden.
That said, even if Obama has declared ACTA an executive agreement (while those in Europe insist that it’s a binding treaty), there is a very real Constitutional question here: can it actually be an executive agreement? asks TechDirt. The law is clear that the only things that can be covered by executive agreements are things that involve items that are solely under the President’s mandate. That is, you can’t sign an executive agreement that impacts the things Congress has control over. But here’s the thing: intellectual property, in Article 1, Section 8 of the Constitution, is an issue given to Congress, not the President. Thus, there’s a pretty strong argument that the president legally cannot sign any intellectual property agreements as an executive agreement and, instead, must submit them to the Senate.26 European Union member states along with the EU itself are set to sign the treaty at a ceremony today in Tokyo. Other countries wishing to sign the agreement have until May 2013 to do so.Critics are urging those concerned about Obama’s decision to sign the document with no legislative oversight to demand the Senate be forced to ratify the treaty.
