Palestinian victims describe being used as shields by Hamas
Members of a Gaza family whose farm was turned into a "fortress" by Hamas fighters have reported that they were helpless to stop Hamas from using them as human shields. They described how for years Hamas has used their property and homes as shields for military installations from which to launch rockets into Israel, dig tunnels and store arms. According to the victims, those who tried to object were shot in the legs by Hamas.

If history is an indication, it may be a very long time before anything gets built on land in Gush Etzion that was declared state land last week. Another declaration by the government over a decade ago has been winding its way through the court system, and it was only on Sunday that the High Court rejected arguments by Arab groups that the declaration was illegal.Sunday's case revolved around the legal status of Givat Eitam, a parcel of some 1,700 dunams (170 hectares or 420 acres) of land that is within area belonging to the Efrat local council, but outside the security fence. The state declared the parcel to be state land in August 2004, after it was first set inside the municipal boundaries of the city in 1999, with the local authority carefully checking its legal status. Local Arab farmers sued, claiming that the land belonged to them.The case has been wending its way through the courts for the past decade, and one of the results of the lawsuit was an order by the High Court to move part of the security fence in Efrat in 2011. As such, 400 dunams of the land were now inside the fence, while 1,300 are still outside – and on Sunday, the court said that the Efrat local council and the state were in the right, and that the land could remain with the status of state land.However, the saga is not yet finished: The court “suggested” in its decision that the state and the Arab farmers return to arbitration to discuss the fate of some of the land that has been planted by them – illegally, it turns out, since the state was justified in declaring the parcel state land. Two weeks after the IDF's counter-terror operation Protective Edge in Gaza was halted by a ceasefire, a senior diplomatic source says that Hamas has renewed its production of rockets and the smuggling from Egypt, and is rebuilding its attack tunnels.The terror group is smuggling in materials for restoring its rocket array, says the senior source. “Hamas did not wait a single moment after the last round of fighting, and began its rearmament in anticipation of another round [of fighting].”The senior diplomatic source is quoted throughout Israeli media.Hamas appears to be “daring” Israel to take action against it, even as indirect talks between Israel and Hamas are about to start, with the purpose of reaching a long term “arrangement.” It is not known, at this stage, whether Israel intends to take action against the rearming and the renewed tunnel digging.Disarming Gaza is very unlikely, Foreign Minister Avigdor Liberman said Sunday. Unfortunately, Israel was waging a military action against an adversary that was waging a political campaign and thus adopted the wrong tactics and measured progress by the wrong metrics.Continuing rocket fire and refusing a permanent and stable cease-fire will drag Gaza into a war that Hamas -- not Israel, contrary to its perception -- cannot endure.From Israel's perspective, the primary focus of Gaza "incursion" code-named "Operation Protective Edge" was to destroy tunnel infrastructure, rocket and launching pads for missiles, but not to topple Hamas.Israeli Prime Minister Benjamin Netanyahu's tactics of "hammering out to halt attrition" rather than heading straight for a clear-cut victory will not deter Hamas from attacking Israel. While a "limited ground strike in the first stage" continued to reach and demolish the sources of Hamas’s rocket and mortar attacks, it remains unclear whether the Netanyahu government's tactic will work in the long term.In light of the successful targeted killings of senior Hamas military commanders using pinpointed military intelligence, an ultimatum should also be put in place for an "immediate, unconditional surrender" of Hamas, which is highly unlikely.Perhaps, it is about time for the Israel Defense Forces (IDF) to take out the fundamentalist Palestinian movement's command and operation centers "without hesitancy or restraint" particularly those under Shifa hospital- a stronghold under which most of Hamas' leadership has apparently been hiding.Given the ongoing proxy conflicts in the Middle East and existential threats endured for so long by the Jewish people, Israel's survival in the past depended on strategic and tactical responses to multi-front conventional wars.However, since its founding in 1948, the main security threats to the state of Israel shifted from major multi-front conventional wars to asymmetric forms of warfare with Hamas in Gaza, Judea and Samaria ('West Bank'), Hezbollah across the border in Lebanon, the mullah-led regime in Iran and the surging threat from Islamic State of Iraq and the Levant (ISIL), a new moniker for al Qaeda splinter terror groups.Overall, the inherent asymmetry and "lack of strategic depth" in a largely hostile, high-threat regional environment make Israel militarily vulnerable.And yet, despite a strong self-defense capability, Israel's military strategies emphasized a combination of prevention, preemption, and deterrence as illustrated in the Six-Day War (1967), Lebanon conflicts and against Iraq's Osirak reactor (1981) and Syria's al-Kibar nuclear facility (2007) built with North Korean technology and assistance .In its counterterrorism application [against Hamas], the goal of deterrence is the same: identify vulnerable parts of an enemy’s chain of command, operational cells and support network, and take steps that would put them at risk to alter their behavior in your favor. If you can deter even one link in the chain of a terrorist network, you have an opportunity to halt the entire network.Adapting cold war deterrence against nihilistic goals of Hamas terrorism would seem unlikely if not impossible.In this type of asymmetric warfare, as in the conventional dimension, in which Hamas and Islamic Jihad operate from densely populated areas using human shields, whatever Israel does to minimize civilian casualties is rendered useless and insignificant. Members of a Gaza family whose farm was turned into a "fortress" by Hamas fighters have reported that they were helpless to stop Hamas from using them as human shields. They described how for years Hamas has used their property and homes as shields for military installations from which to launch rockets into Israel, dig tunnels and store arms. According to the victims, those who tried to object were shot in the legs by Hamas.

If history is an indication, it may be a very long time before anything gets built on land in Gush Etzion that was declared state land last week. Another declaration by the government over a decade ago has been winding its way through the court system, and it was only on Sunday that the High Court rejected arguments by Arab groups that the declaration was illegal.Sunday's case revolved around the legal status of Givat Eitam, a parcel of some 1,700 dunams (170 hectares or 420 acres) of land that is within area belonging to the Efrat local council, but outside the security fence. The state declared the parcel to be state land in August 2004, after it was first set inside the municipal boundaries of the city in 1999, with the local authority carefully checking its legal status. Local Arab farmers sued, claiming that the land belonged to them.The case has been wending its way through the courts for the past decade, and one of the results of the lawsuit was an order by the High Court to move part of the security fence in Efrat in 2011. As such, 400 dunams of the land were now inside the fence, while 1,300 are still outside – and on Sunday, the court said that the Efrat local council and the state were in the right, and that the land could remain with the status of state land.However, the saga is not yet finished: The court “suggested” in its decision that the state and the Arab farmers return to arbitration to discuss the fate of some of the land that has been planted by them – illegally, it turns out, since the state was justified in declaring the parcel state land. According to attorneys for the Arab farmers, the fact that some of the land is now being tilled by them obviates the “state land” declaration.Last week, in the aftermath of the abduction and murder to Gilad Sha’ar, Eyal Yifrah and Naftali Frenkel, the state declared 4,000 dunams (roughly 4,000,000 square meters) of land in Gush Etzion as state land. Those opposed to the decision have about a month to contest it.

Just as we severely hurt the Hamas terror infrastructure we will not hesitate to strike Hamas again, and you Haniyeh will not be immune.""It's no secret that I thought the ground offensive should have been expanded," she continued, "but I'm sure that our prime minister will succeed in bringing security to the residents of the south, and will change the rules of the game.”In his sermon on Friday, Haniyeh also declared that Hamas is not willing to discuss the possibility of demilitarizing weapons from its "military wing," the Al-Qassam Brigades, or other terrorist organizations operating in Gaza." Two weeks after the IDF's counter-terror operation Protective Edge in Gaza was halted by a ceasefire, a senior diplomatic source says that Hamas has renewed its production of rockets and the smuggling from Egypt, and is rebuilding its attack tunnels.The terror group is smuggling in materials for restoring its rocket array, says the senior source. “Hamas did not wait a single moment after the last round of fighting, and began its rearmament in anticipation of another round [of fighting].”The senior diplomatic source is quoted throughout Israeli media.Hamas appears to be “daring” Israel to take action against it, even as indirect talks between Israel and Hamas are about to start, with the purpose of reaching a long term “arrangement.” It is not known, at this stage, whether Israel intends to take action against the rearming and the renewed tunnel digging.Disarming Gaza is very unlikely, Foreign Minister Avigdor Liberman said Sunday. If you can deter even one link in the chain of a terrorist network, you have an opportunity to halt the entire network.Adapting cold war deterrence against nihilistic goals of Hamas terrorism would seem unlikely if not impossible.In this type of asymmetric warfare, as in the conventional dimension, in which Hamas and Islamic Jihad operate from densely populated areas using human shields, whatever Israel does to minimize civilian casualties is rendered useless and insignificant. As a result, Israel received a great deal of absurd international condemnation for the deaths of Palestinians being used as 'human shields' and for Israel's use of “disproportionate force.”Dr. Yehuda David, who recently ran for Israeli president and took part in the ongoing Gaza operation , said "the IDF has technology to end the Operation in hours; I don't understand why the political echelon doesn't use those means.""Hamas can be completely liquidated - without endangering IDF soldiers in a complicated ground entry and close-quarters urban warfare".David's appraisal of the dangers of a ground entry contrasted with the commander of the IAF special reconnaissance Flying Camel Squadron, who said that having to abort airstrikes due to civilian presence often "sabotaged" the operation. It has been argued that the hesitancy to wage all-out-war has caused IDF deaths.In addition to secret technology and targeted assassinations of Hamas military wing commanders, Israel can rout Hamas through massive flooding of the underground city in Gaza, just exactly what Egypt has done to permanently destroy all smuggling tunnels near its border crossings between Egypt and Gaza.If Israel wants quiet for years to come it needs to unequivocally liquidate Iran's proxy, Hamas at any cost. Ramallah (Palestinian Territories) (AFP) - Palestinian president Mahmud Abbas has threatened to break off a unity agreement with Hamas if the Islamist movement does not allow the government to operate properly in the Gaza Strip.And prime minister Rami Hamdallah told AFP a dispute with Hamas over the payment of salaries to thousands of its employees had become the main issue from preventing his government of national unity from operating inside Gaza.Abbas's accusation that Hamas was effectively running a parallel administration in Gaza drew an angry reaction from the Islamist movement, which denounced his allegations as "baseless."But it raised fresh questions over the future of a fragile intra-Palestinian unity deal aimed at ending seven years of rival administrations in the West Bank and Gaza."We will not accept the situation with Hamas continuing as it is at the moment," Abbas said in remarks published by official Palestinian news agency WAFA."We won't accept a partnership with them if the situation continues like this in Gaza, where there is a shadow government... running the territory," he said."The national consensus government cannot do anything on the ground," he charged.Later on Sunday, Abbas appeared on the verge of another public attack on Hamas in the opening of his address to the Arab League in Cairo.Just 30 seconds into his speech, which referenced Hamas's forcible takeover of Gaza in 2007, Abbas was handed a note and abruptly stopped speaking as an official quickly ordered journalists out of the room.The very public dispute erupted some two weeks after the end of a major 50-day confrontation between Israel and Hamas militants in Gaza, which killed more than 2,100 Palestinians and 72 in Israel.In Gaza, spokesman Sami Abu Zuhri said Abbas's allegations that Hamas was hampering the operations of the national consensus government were"unjustified." Throughout the conflict, Hamas and Fatah put up a united front, working side-by-side to further indirect truce talks with Israel in Cairo, which resulted in an open-ended ceasefire that took effect on August 26.But as the guns fell silent, their long-held divisions again came to the fore.Under the terms of April agreement, Hamas agreed to work with its rivals in Abbas's Fatah movement to form an interim consensus government of technocrats which would work towards long-delayed national elections.The deal sought to end years of bitter and sometimes bloody rivalry between Hamas and Fatah, which dominates the West Bank-based Palestinian Authority.The new cabinet took office on June 2, with Gaza's Hamas government officially stepping down the same day.Despite the handover, Hamas has remained the de facto power in Gaza, with moves to implement the provisions of the unity deal put on hold in the face of the deadly offensive that Israel launched on July 8."This unity government should control both the West Bank and the Gaza Strip but there are many things blocking its work," the prime minister told AFP in an interview.First and foremost among the problems was the matter of salaries, which had left him caught between a rock and a hard place, he said.On the one hand, the international community had threatened a suspension of aid if the wages were paid to employees of a group blacklisted as a "terror organisation" while on the other, Hamdallah himself had received "threats" if he were to visit Gaza without first resolving the salary crisis.Since signing the agreement in April, Hamas has demanded the new government take responsibility for paying its 45,000 employees, 27,000 of whom are civil servants."Putting Hamas employees on the government payroll is the main problem which is preventing the government from working in the Gaza Strip," said Hamdallah."The government and the banks operating in the Palestinian territories were warned that if they make these payments to former Hamas government employees in Gaza then the government and the people will be boycotted," he said."If this happens, the Palestinian banking system will face a huge problem that will threaten the Palestinian situation in general."The Palestinians are heavily dependent on international aid with a boycott likely to have a devastating financial impact on its financial viability.Hamdallah said an unidentified "third party" was working to solve the crisis by delivering the payments, with "positive indications" it would be resolved soon.Qatar has agreed to cover the costs of the former Hamas employees, although the money has yet to be transferred.
