JERUSALEM – Israelis celebrated the Jewish New Year Friday evening, grateful for the recent calm spell in the region but skeptical that the coming year would see the achievement of ever-elusive peace.The Jewish New Year, or Rosh Hashana, coincides this year with Eid al-Fitr, a Muslim feast marking the end of the fasting month of Ramadan.Capping a year that saw Israel battle Hamas militants in a bloody three-week long war in Gaza, followed by elections that brought a more hawkish government to power, Israelis remained doubtful that an end to the Israeli-Palestinian conflict was in sight.We hope that this year will be better, that it will be quiet, that there will be peace, but I don't believe it will happen,said Yosef Cohen, a 40-year-old merchant at Jerusalem's Mahane Yehuda open-air market.How many years have we been talking about it?

The New Year holiday itself is a time for festive meals, which traditionally include fish, wine and an apple dipped in honey to symbolize a sweet new year.Israelis flocked to markets on the eve of the holiday to stock up on goods, greeting one another with blessings of a happy new year.
The high holiday season, which includes the weeklong Sukkoth, or Feast of the Tabernacles, at the beginning of October, provides a time-out from Israel's pressing problems. People generally take off work and spend more time with family during this period.Israel's military closed off the West Bank on Friday until midnight Sunday, barring Palestinians from entering Israel, a routine measure during Jewish holidays to deter possible attacks by Palestinian militants.Authorities said an exception would be made for men over the age of 50 and women over 45 seeking to enter Jerusalem to pray at the Al Aqsa mosque — Islam's third holiest shrine — on the fourth and final Friday of Ramadan.However, witnesses at the Qalandia crossing between the West Bank and Jerusalem said hundreds of Palestinians seeking entry to the city were turned away by Israeli troops.Elsewhere along the Israel-West bank divide, Israeli and Palestinian security forces have been cooperating for the first time in time in years, often seen conversing and easing the passage of Palestinians from side to side.Muslims in the West Bank and Gaza Strip will begin Sunday the Eid al-Fitr, a three-day holiday marking the end of Ramadan and commemorating the revelation of the first verses of the Quran to the Prophet Muhammad.In Gaza City ahead of the festival, the old market was packed with street merchants hawking their wares and families shopping for jeans, shoes, scarves, sweets and salted fish, traditionally eaten at this time.The holiday atmosphere was strained in Gaza, which has been under an Israeli-Egyptian blockade for two years and is still reeling from January's bloodshed.

RAMALLAH, West Bank – The United States' top Mideast envoy failed to bridge wide gaps between Israelis and Palestinians as he ended his most intensive attempt yet on Friday, raising questions over President Barack Obama's efforts to revive peacemaking.The deadlock could scuttle hopes for a meeting between Obama, Israeli Prime Minister Benjamin Netanyahu and Palestinian President Mahmoud Abbas next week in New York, on the sidelines of the U.N. General Assembly.The key disputes are over Israeli settlement expansion and whether peace talks should begin where they left off under Netanyahu's predecessors.Israel has balked at a U.S. demand that it freeze settlement construction in the West Bank and east Jerusalem, war-won territory the Palestinians want for their state. Under a U.S.-sponsored plan from 2003, Israel is required to freeze all such construction.Instead, Netanyahu wants to continue building about 3,000 housing units, while offering to curtail other construction for a period of several months. Nearly half a million Israelis have moved to the West Bank and east Jerusalem since Israel captured the territories in the 1967 Mideast War, and Palestinians fear the growing settlements will make a viable state impossible.Abbas insists on a freeze, his chief negotiator, Saeb Erekat, said after the Palestinian president met Friday with the U.S. envoy, George Mitchell.We once again reiterated that there are no middle ground solutions for settlements. A settlement freeze is a settlement freeze,Erekat said.
The Palestinians also demand that negotiations resume on the same terms as previous rounds, led by Netanyahu's predecessor, Ehud Olmert. This would include Israel's willingness to discuss all so-called core issues, including a partition of Jerusalem. Netanyahu has said Jerusalem is off-limits in negotiations, and his proposed settlement slowdown does not include the city.Over four days, Mitchell met twice with Abbas and four times with Netanyahu, including twice on Friday before Mitchell left the region.A senior Israeli official said that wide gaps remained, but would not comment on the content of the meetings. The official spoke on condition of anonymity, in line with Israeli briefing regulations.It appears unlikely, however, that Netanyahu would change his mind about settlement expansion. In recent days, his government announced bids for hundreds more homes in the West Bank and east Jerusalem, and his hardline government rests on the support of Jewish settlers and their political allies.U.S. Secretary of State Hillary Rodham Clinton said the administration would keep pushing for a peace deal.I guarantee you that President Obama and I are very patient and very determined,she said in a speech to the Brookings Institution, a Washington think tank.We know that this is not an easy road for anyone to travel.However, she also indicated that the administration would not try to impose a solution.We are going to do all we can to pursuade, cajole, encourage the parties themselves to make that agreement. The United States cannot make it. The Arab nations cannot make it. It is up to the Palestinians and Israelis, she said.And to that end, we expect both sides, not just one side, but both sides to be actively engaged and willing to work towards that resolution.
In the meantime, a meeting between Obama, Abbas and Netanyahu in New York next week appears to be a long shot.The senior Israeli official said that for now, Netanyahu is set to fly to New York late Wednesday and deliver a speech the following day. If a trilateral session were to be arranged, the prime minister could leave for the U.S. earlier, the official said, adding that a Netanyahu-Obama meeting was not on the agenda.Abbas, meanwhile, is conflicted about whether to meet with Netanyahu as a courtesy to Obama, said senior Palestinian officials who spoke on condition of anonymity because of the private nature of the deliberations.Several senior aides urged Abbas not to sit down with Netanyahu without having set the terms for negotiations, arguing that otherwise it would be seen as a sign of weakness and hurt his standing at home. Abbas is locked in a power struggle with the Islamic militant group Hamas, which overran the Gaza Strip in 2007, leaving him only in control of the West Bank. Hamas has used lack of progress in negotiations to try to discredit Abbas. In the Gaza town of Beit Lahia, Hamas legislator Mushir al-Masri told a rally Friday that negotiations are a waste of time.The choice of negotiations has proven a failure, and it's time that Palestinian negotiators abandon this worthless and destructive tool and go back to holy war and resistance,al-Masri told a crowd. In other developments, the World Bank warned in a report Friday that donor countries will have to keep giving large amounts of aid to the Abbas government, unless Israel eases access of Palestinian goods to Israeli and world markets.Senior representatives of the donor countries meet next week as part of the General Assembly and review their aid program to the Palestinians.Donor countries have given billions of dollars to the Palestinians since 1993, including $1.8 billion in 2008 and an expected $1.1 billion in 2009. However, the economy has been held back by Israeli restrictions on Palestinian trade and movement, imposed after the outbreak of Israeli-Palestinian fighting in 2000.In recent months, Israel has eased some restrictions inside the West Bank, prompting modest economic growth. However, the West Bank and Gaza remain cut off from each other, and West Bank exports are hampered by slow movement at Israeli crossings.The Abbas government is still short of money, the bank said, citing a $400 million financing gap for this year.

CAIRO (Reuters) – Failure to agree a settlement freeze inhibits the resumption of peace negotiations with Israel, Palestinian Authority President Mahmoud Abbas told Egypt's Hosni Mubarak on Saturday, according to state media.Abbas visited Cairo days after U.S. envoy George Mitchell and less than a week after Israeli Prime Minister Benjamin Netanyahu stopped by to brief Mubarak and other Egyptian officials on efforts to resume stalled peace talks.Mitchell returned to Washington on Friday with little to show for his shuttle diplomacy between Jerusalem and Arab capitals.Israel has blamed Abbas for the impasse, saying Palestinian negotiators showed no flexibility while Israel did.Netanyahu, whose right-wing cabinet includes strong pro-settler elements, had offered a nine-month freeze on building in the West Bank -- longer than the six months Israel previously indicated it would consider, but less than the year-long pause Mitchell had sought.Abbas has said he would not agree to renewed negotiations with Israel unless it agreed to a total freeze on settlement expansion and stressed that the United States must push Israel to comply with the 2003 road map call for a cessation of all settlement-building.
An Abbas spokesman said the Cairo meeting -- which lasted an hour and a half -- was called to coordinate Arab and Palestinian positions ahead of the United Nations General Assembly, which starts in New York on Tuesday.The participants, which included Egypt's foreign minister and intelligence chief and the Palestinian Authority's chief negotiator, also discussed intra-Palestinian developments, Egypt's state-run news agency MENA said.Negotiations could not resume because Israel would not consider including Jerusalem in any settlement freeze, nor would it stop building in settlements to accommodate natural growth, MENA quoted Abbas as saying.
Some 300,000 Israelis live in settlements in the occupied West Bank, and another 200,000 live in Arab East Jerusalem, areas home to around 2.5 million Palestinians seeking independent statehood. MIAMI – Marty is weakening in the Pacific off the coast of Mexico and is now a tropical depression.The National Hurricane Center says Marty's maximum sustained winds decreased to near 35 mph (55 kph) on Saturday morning. The system is expected to continue to lose strength and should become a remnant low in a day or so.Marty is centered about 445 miles (715 kilometers) west of the southern tip of Mexico's Baja California peninsula. The system is moving west-northwest near 9 mph (15 kph).

BEIJING (AFP) – Nine people died and nine others were missing after Typhoon Koppu slammed into south China, causing torrential rain, mudslides and an oil spill, the government and state media said Thursday.All nine missing had been swept by flash floods, while the other nine had been killed by typhoon-triggered mud-rock flows, landslides, house collapses and flooding, the official Xinhua news agency reported.
Four of the those killed in southern Guangdong province -- a father and son, and two migrant workers -- were buried by a torrent of mud, Xinhua reported.More than 100,000residents had to be evacuated and direct economic losses totalled two billion yuan (300 million dollars), the civil affairs ministry said in a statement.Houses in parts of Guangdong were destroyed by landslides, and a Panama-registered cargo ship ran aground in Zhuhai city's harbour near Macau, spilling 50 tonnes of fuel oil into the sea, Xinhua said.The report, citing provincial maritime authorities, said the spill had been contained.Koppu is the 15th typhoon to hit China this year. Before reaching the mainland, it ripped through Hong Kong, forcing financial markets to shut down for the morning trading session on Tuesday.

BALI, Indonesia – A strong earthquake shook the popular Indonesian resort island of Bali early Saturday, injuring at least seven people and sending panicked tourists and residents fleeing out of homes and hotels.No tsunami warning was issued and there were no immediate reports of major damage.The magnitude 5.8 quake hit just after 6 a.m. local time (2300 GMT) 45 miles (75 kilometers) south of Denpasar, the island's capital, the U.S. Geological Survey said. Indonesia's Meteorological and Geophysics Agency put the quake at a more powerful 6.4 magnitude.Seven people were treated for head injuries and broken bones at Sanglah Hospital in Denpasar, said Dr. Ken Wirasandi, adding that women and children had run from their homes screaming when the ground began to rattle.I was frightened because it was strong,said Ernst Raynaldo, a tourist from the Netherlands who was staying at the Kuta beach strip.I ran out immediately as I saw many others rushing into the swimming pool,which was the closest open space.
The Bali quake comes just two weeks after a larger tremor on the main Indonesian island of Java killed of left missing nearly 100 people and ruined thousands of homes.Indonesia, a vast archipelago, straddles continental plates and is prone to seismic activity along what is known as the Pacific Ring of Fire. A huge quake off western Indonesia caused a powerful tsunami in December 2004 that killed about 230,000 people in a dozen countries, half of them in Aceh province.

BEIJING – Officials say a strong earthquake has shaken western China but there are no reports of injuries or serious damage.The U.S. Geological Survey says the magnitude-5.4 quake struck at 4:54 p.m. Saturday in the region bordering Sichuan and Gansu provinces. It says it was centered 30 miles (50 kilometers) northwest of Guangyuan in Sichuan province at a depth of 6.2 miles (10 kilometers).China's official Xinhua News Agency says Chinese seismologists measured the quake at magnitude 5.1 and that no casualties or damage were reported.A magnitude-7.9 quake in Sichuan province last year left almost 90,000 people dead or missing.

CDC: First swine flu vaccines may be nasal spray By MIKE STOBBE, AP Medical Writer – Fri Sep 18, 5:28 pm ET
ATLANTA – The first doses of swine flu vaccine may all be the nasal spray version, government health officials said Friday.The government has said a trickle of vaccine will be available in early October, but on Friday they defined the size of that trickle — an estimated 3.4 million doses.Currently it looks like all of them will be a nasal spray vaccine that is approved only for healthy people ages 2 to 49, said Dr. Jay Butler, an official with the Centers for Disease Control and Prevention.The nasal spray, called FluMist, is not recommended for some of the people most in danger of severe swine flu complications. That includes pregnant women, children younger than 2, and people with asthma and other chronic respiratory diseases.
However, it's possible that some vaccine shots will become available by the first week of October as well, said Butler, chief of the CDC's swine flu vaccine task force.Flu shots are made of killed influenza virus, while FluMist is a live but weakened strain. The nasal spray is only approved in the United States, and is made by the Maryland-based MedImmune, an AstraZeneca PLC subsidiary. Four other companies are making flu shots for the U.S.The initial vaccine doses will go to up to 90,000 sites, including schools and clinics, across the U.S. State health departments will determine which offices and clinics get the shots, and whether health care workers or others get the first doses, Butler said at a CDC press conference Friday.The government has ordered 195 million doses and may order more if there's enough demand. Butler said it's good news that the flow of vaccines will start soon.When we open the faucet, there won't be a puff of smoke. There will be vaccine,he said.
FluMist was designed with kids in mind, and the company's research suggests it is more effective in youngsters than a shot in the arm against seasonal flu.Studies in adults have found that shots are more effective. Some researchers think that's because adults have had longer exposure to flu viruses and flu vaccines and their immune systems don't respond as dramatically to the live-virus vaccine.
Dr. Daniel Jernigan, deputy director of the CDC's influenza division, said there's not that much difference in effectiveness between age groups.Either is better than nothing,he added.One dose of vaccine should be enough for adults and older children, whether it's a shot or a spray. However, two doses probably will be needed for children younger than 10, CDC officials said.Typically fewer than 100 million Americans get a flu vaccine every year, and it's unclear whether swine flu will prompt more demand. A recent Associated Press-GfK poll found 57 percent of people said they were likely to get it.Twenty-one states are now reporting widespread cases of swine flu, CDC officials said Friday.The CDC says swine flu hasn't proven to be more dangerous than seasonal so far, but it tends hit to younger people harder than traditional flu.Because seasonal flu causes an estimated 200,000 hospitalizations and 36,000 deaths, that's still a serious health threat, officials said.On the Net:

WASHINGTON - The head of the FCC plans to propose new rules that would prohibit Internet service providers from interfering with the free flow of information and certain applications over their networks, according to reports published Saturday.
The reports said the Federal Communications Commission chairman, Julius Genachowski, will announce the proposed rules in a speech Monday at the Brookings Institution, a Washington think tank.The proposals would uphold a pledge Barack Obama made during the presidential campaign to support Internet neutrality and would bar Internet service providers such as Verizon Communications Inc., Comcast Corp. or AT&T Inc., from slowing or blocking certain services or content flowing through their vast networks.Without strict rules ensuring Net neutrality, consumer watchdogs fear the communications companies could interfere with the transmission of content, such as TV shows delivered over the Internet, that compete with services the ISPs offer, like cable television.Internet providers have opposed regulations that would inhibit the way they control their networks, arguing they need to be able to make sure applications that consume a lot of bandwidth don't slow Internet access to other users.The proposed new rules were reported by The Washington Post, The New York Times and The Wall Street Journal.We are concerned about the unintended consequences that Net neutrality regulation would have on investments from the very industry that's helping to drive the U.S. economy,Chris Guttman-McCabe, a vice president at CTIA, a wireless trade group, told the Post.The FCC began wading into the issue even before Genachowski became FCC chairman. UNITED NATIONS – Iran, Israel and the five nuclear powers that are permanent Security Council members are part of a global network to detect signs of testing of a new atomic bomb, a positive sign of cooperation in the bid to halt the spread of such weapons, the head of the Nuclear Test Ban Treaty organization said Friday.The monitoring network has not been widely reported nor have its participants, including Iran, which the West believes is pursuing nuclear weapons, and Israel, which is widely believed to possess a nuclear arsenal but won't say as much.Tibor Toth said at a news conference that a system to detect and verify atomic blasts that was started in 2000 now has 270 monitoring facilities and expects to increase the number to 340.The stations rely on four technologies: seismic, sensing the shock waves of an underground blast; hydroacoustic, listening for underwater explosions; infrasound, picking up the low-frequency sound of an atmospheric test; and radionuclide detection, sampling the air for a test's radioactive byproducts.The data is transmitted to the Vienna headquarters of the Comprehensive Test Ban Treaty Organization and relayed to its signatory nations, including the U.S., which signed the pact in 1996, only for the Senate to reject it three years later.Toth called the verification system an important step to address concerns of nuclear and non-nuclear states, and noted that it monitored North Korea's nuclear tests in 2006 and 2009 very well.
Toth spoke to reporters ahead of a high-level meeting on Sept. 24-25 on the sidelines of the U.N. CAIRO – The holy month of Ramadan has brought out Egypt's cultural split personality, twisting Egyptians into knots over whether their society is secular, Muslim or a muddled mix.Two furious debates have been raging through the season in the Arab world's most populous nation. On one hand, rumors that police arrested Egyptians violating the daily Ramadan fast raised dire warnings from secularists that a Taliban-like rule by Islamic law is taking over.On the other, Ramadan TV talk shows on state-sponsored television featuring racily dressed female hosts discussing intimate sex secrets with celebrities have sparked outrage from conservatives, denouncing what they call the decadence that is sweeping the nation.So is Egypt being taken over by sinners or saints? Egyptians have always been a boisterous combination — priding themselves on their piety, while determined to have a good time.Ramadan, the final day of which is Saturday in most of the Islamic world, shows the contradictions. Egyptians widely adhere to the dawn-to-dusk fast, in which the faithful abstain from food, drink, smoking and sex from dawn until dusk. After sunset, while some pray into the night, many Egyptians party with large meals and a heavy dose of TV entertainment produced specially for the month.
But the confusion comes from the government as well. It has often promoted strict Islamic principles in an attempt to co-opt conservatives and undercut extremists whom the state has been battling for decades. But it also increasingly dominated by businessmen who this year are more heavily than ever promoting Western-style secular culture.There is no explicit law in Egypt to punish those not abiding by the fast, nor are there religious police to enforce Islamic rules as in Saudi Arabia. Many restaurants still serve during the day, and coffee shops can be seen with their doors cracked open, patrons hidden inside sipping tea or smoking water pipes.But independent newspapers reported this month that police arrested more than 150 people for openly violating the fast.Most of the reports have been unconfirmed. At home, Ahmadinejad is facing strong opposition which erupted into unrest following his disputed re-election in June.Friday, Iranian security forces clashed with supporters of opposition leader Mirhossein Mousavi and arrested at least 10 of them during annual anti-Israel rallies in Tehran.Thousands of supporters of Mousavi, wearing green wristbands or shawls, were among crowds marching in the Qods Day rallies.The state news agency IRNA said Mousavi and reformist cleric Mehdi Karoubi, both defeated candidates in June, had been forced to leave the rallies after being attacked by angry people.Reformist former president Mohammad Khatami took part in the rally, but was attacked by hardliners and had to leave after his robe was ripped and his turban fell to the ground, an ally of Khatami who accompanied him told Reuters.The June vote, which was followed by huge opposition protests, plunged Iran into its worst political crisis in three decades and revealed deepening rifts within its ruling elites.Opposition leaders say the poll was rigged to secure Ahmadinejad's re-election. BEIRUT, Lebanon — Tens of thousands of protesters chanted and carried banners through the heart of Tehran and other Iranian cities on Friday, hijacking a government-organized anti-Israel march and injecting new life into the country’s opposition movement.The protests, held in defiance of warnings from the clerical and military elite, served as a public embarrassment to President Mahmoud Ahmadinejad, who had hoped to showcase national unity just two weeks before he is set to meet Western leaders for talks on Iran’s nuclear program. He used the annual rally for Jerusalem Day, also known as Quds Day, to deliver a fiery anti-Israeli speech in which he called the Holocaust a lie and impugned the West again for its criticisms of Iran’s disputed June 12 presidential election.But his efforts to recapture the stage were largely drowned out by a tumultuous day of street rallies, in which the three main opposition leaders marched with their followers for the first time in months. Flouting the official government message of support for Palestinian militants, they chanted,No to Gaza and Lebanon, I will give my life for Iran.Coming a day after President Obama announced a revised missile defense system that aims to check Iran’s military ambitions, the rallies underscored the continuing vitality of the domestic opposition movement, which has rejected the election as fraudulent and fiercely criticized the violence that followed it.In a striking contrast with earlier rallies, the police often stood on the sidelines as protesters faced off against huge crowds of government supporters — many of them bused in from outside the cities — and chain-wielding Basij militia members. There were reports of arrests in Tehran and the southern city of Shiraz, but no shootings or deaths, with the police apparently showing greater restraint than during earlier protests.

In the capital, the police and huge crowds of government supporters blocked most protesters from approaching Mr. Ahmadinejad as he arrived in a bulletproof car at Tehran University to deliver a speech before the formal Friday Prayer sermon. But as he began his remarks, chants of Resign! Resign! could be heard, according to witnesses cited on opposition Web sites.Mr. Ahmadinejad said that confrontation with Israel was a national and religious duty and that the Holocaust was a lie that was used as a pretext for the country’s creation in 1948. Although he has called the Holocaust a myth in the past, provoking angry reactions in the West, he has rarely if ever used the word lie in public speeches.The White House responded sharply to the remarks about the Holocaust.We’ve heard that type of rhetoric before, the president’s press secretary, Robert Gibbs, told reporters.Obviously, we condemn what he said.The United States ambassador to the United Nations, Susan E. Rice, said Friday that Mr. Obama would not meet with Mr. Ahmadinejad next week when world leaders gather in New York for the United Nations General Assembly meeting. Mr. Obama, in a major national security reversal, scuttled his predecessor’s missile-shield plan to focus instead on protecting Israel and Europe against short- and medium-range Iranian missiles. Mr. Ahmadinejad made no mention of that in his speech, nor has his government responded.Both the revised missile plan and Mr. Ahmadinejad’s anti-Israel rhetoric are likely to elevate the tensions surrounding his visit to the United Nations.As Jerusalem Day approached, a number of conservative figures, including Iran’s supreme leader, Ayatollah Ali Khamenei, warned that the day should not become an occasion for domestic discontent. On Thursday, the Revolutionary Guards issued an especially fierce statement, declaring that all protesters would be treated as Israeli spies.
But the government appears to have treated Friday’s protests with relative leniency. Although tear gas was fired at some crowds in central Tehran — it was not clear by whom — there was no renewal of the fierce crackdown that took place in June and July.Although the marchers celebrating Jerusalem Day generally outnumbered the protesters, there were parts of the city where the opposite was true. MOSCOW – Russia said Saturday it will scrap a plan to deploy missiles near Poland since Washington has dumped a planned missile shield in Eastern Europe. It also harshly criticized Iran's president for new comments denying the Holocaust.Neither move, however, represented ceding any significant ground. A plan to place Iskander missiles close to the Polish border was merely a threat. And while the Kremlin has previously criticized Tehran for questioning the reality of the Holocaust, Russian leaders have refused to back Western push for tougher sanctions against Iran.It still remains unclear whether Moscow will make any significant concessions on Iran and other issues in response to President Barack Obama's move to scrap the Bush-era plan for U.S. missile defense in Poland and the Czech Republic.Russia's Deputy Defense Minister Vladimir Popovkin told Ekho Moskvy radio Saturday that Obama's move has made the deployment of Iskander short-range missiles in the Kaliningrad region unnecessary.He described Obama's move as victory of reason over ambitions.Naturally, we will cancel countermeasures which Russia has planned in response, one of which was the deployment of Iskander missiles in the Kaliningrad region,Popovkin said.Popovkin's statement was the most explicit declaration yet of Russia's intention to scrap the plan after Obama's decision, which was announced Thursday.

Bush to deploy 10 missile interceptors in Poland and a related radar in the Czech Republic and said if the project went ahead it would respond by deploying the Iskander missiles in its westernmost Baltic Sea region.
Obama's decision to scrap the plan was based largely on a new U.S. intelligence assessment that Iran's effort to build a nuclear-capable long-range missile would take three to five years longer than originally thought, U.S. officials said. The new U.S. missile-defense plan would rely on a network of sensors and interceptor missiles based at sea, on land and in the air as a bulwark against Iranian short- and medium-range missiles.Medvedev hailed Obama's decision as a responsible move, but Russian officials have given no indication yet that Moscow could make concessions in other areas, including Iran. MOSCOW – Russia has been negotiating the possible purchase of a military ship built in France, a Russian deputy defense minister said Saturday.Vladimir Popovkin said it's too early to say whether an agreement for buying a Mistral-class helicopter carrier can be reached, but he said it could mark an important step in modernizing the Russian navy.If a deal goes through, it would be the first foreign ship Russia's navy has bought in decades, and the first-ever from a NATO nation.Popovkin told Ekho Moskvy radio Saturday that along with the ship Russia was seeking to acquire technologies that would help raise the level of domestic shipbuilding industries.We are discussing the ship's purchase and, at the same time, we are talking about having facilities to produce such ships in Russia,he said.Officials at the French Defense Ministry would not comment Saturday about the possible sale. French media have reported in recent weeks that Russia is interested in a Mistral-class carrier, and that the Russians are studying different options.Popovkin said French technologies could help Russia build its own aircraft carriers. He said Russian shipbuilders strongly oppose the purchase.

The failures left a newly built nuclear submarine weaponless and raised doubts about Russia's ability to complete the development of the missile which Russian leaders already had billed as the bulwark of the nation's strategic nuclear forces.Popovkin insisted the Bulava's design was fine and blamed its failed tests on manufacturing flaws, resulting from post-Soviet industrial degradation.The Bulava failures were rooted not in design flaws, but technological faults, such as violations of technological norms and the use of substandard metals,Popovkin said. He added that a team of independent experts has been created to analyze the failures and tests will only resume after it makes its conclusions.He said that Russia lacks some categories of modern weapons, such as intelligence drones. NEW YORK – Regulators shut down two banking units of Irwin Financial Corp. Friday, marking the 93rd and 94th failures this year of federally insured banks.The Federal Deposit Insurance Corp. was appointed receiver of Louisville, Ky.-based Irwin Union Bank FSB and Columbus, Ind.-based Irwin Union Bank and Trust Co.As of Aug. 31, Irwin Bank FSB had $493 million in assets and $441 million in deposits, while Irwin Union Bank and Trust had $2.7 billion in assets and $2.1 billion in deposits.The FDIC said Friday both bank's deposits will be assumed by First Financial Bank in Hamilton, Ohio.First Financial also agreed to purchase essentially all of the two banks' assets. The FDIC and First Financial Bank reached a loss-share agreement covering about $2.5 billion of the two banks' combined assets.The 27 combined branches of Irwin Union Bank FSB and Irwin Union Bank and Trust will be reopened during their normal business hours beginning Saturday as branches of First Financial Bank.
The FDIC estimates the failure of the two banks will cost its insurance fund about $850 million.Hundreds more banks are expected to fail in the next few years largely because of souring loans for commercial real estate. The number of banks on the FDIC's confidential problem list jumped to 416 at the end of June from 305 in the first quarter. That's the highest number since June 1994, during the savings-and-loan crisis.Last month, Guaranty Bank became the second-largest U.S. bank to fail this year after the big Texas lender was shut down and most of its operations sold at a loss of billions of dollars for the government to a major Spanish bank. The failure, the 10th-largest in U.S. history, is expected to cost the insurance fund an estimated $3 billion.The sale of most of Austin-based Guaranty's operations to the U.S. division of Banco Bilbao Vizcaya Argentaria SA, Spain's No. 2 bank, marked the first time a foreign bank has bought a failed American bank during the current financial crisis.The insurance fund has been so depleted by the epidemic of collapsing financial institutions that some analysts have warned it could sink into the red by the end of this year. The fund fell 20 percent to $10.4 billion at the end of June, the FDIC reported earlier this month.That's its lowest point since 1992, at the height of the S&L crisis. The agency estimates bank failures will cost the fund around $70 billion through 2013.
Chairman Sheila Bair said Friday the FDIC would consider tapping a line of credit with the Treasury Department. The FDIC's fund has slipped to 0.22 percent of insured deposits, below a congressionally mandated minimum of 1.15 percent.The FDIC board will meet at the end of the month, when it is expected discuss several options to replenish the fund. Aside from tapping the Treasury credit line, the FDIC could assess fees on banks in advance or again increase the fees banks must pay.Congress in May more than tripled the amount the FDIC could borrow from the Treasury if needed to restore the insurance fund, to $100 billion from $30 billion.

WASHINGTON (Reuters) – A majority of Republicans in the U.S. Senate on Friday called on the Obama administration to let the authority to tap a $700 billion financial bailout fund expire at the end of the year as scheduled.In a letter to U.S. Treasury Secretary Timothy Geithner, 39 of the Senate's 40 Republicans and one Democrat said an extension of the Troubled Asset Relief Program (TARP) was not necessary.While we understand that our economy is still recovering, we believe it can function without added TARP funding,the letter said. Additionally, the cost to the taxpayer if TARP authority was extended could be substantial.Geithner last week told a congressionally appointed panel overseeing the bailout fund that no decision had been made on whether to seek approval to extend the bailout program past its scheduled expiry at the end of the year.Congress approved the $700 billion fund in October last year as the financial crisis deepened after the collapse of investment bank Lehman Brothers.The fund has been used to strengthen the capital positions of hundreds of banks, to prop up insurer American International Group and U.S. automakers, and to encourage mortgage servicers to modify loans for homeowners facing foreclosure.

WASHINGTON (Reuters) – President Barack Obama vowed on Saturday to work with fellow G20 leaders next week to close gaps in financial regulations and insisted reckless schemes that yield fat executive bonuses could no longer be tolerated.Five days before hosting a summit of the Group of 20 nations in Pittsburgh, Obama said steps taken since they last met in April in London had produced real progress toward breaking the back of the global economic crisis.But Obama, in his weekly radio and Internet address, insisted that stopping the bleeding isn't nearly enough.We know we still have a lot to do, in conjunction with nations around the world, to strengthen the rules governing financial markets and ensure that we never again find ourselves in the precarious situation we found ourselves in just one year ago,he said.
Financial market reform will be a central issue at the summit of leading developed and developing nations but progress in Congress on Obama's regulatory agenda has been slow.Seeking to show other countries his administration is serious about tackling U.S. weaknesses and excesses blamed for setting off the global crisis, he said,As the world's largest economy, we must lead, not just by word, but by example.
European G20 members have taken the lead in calling for some restraint on the bonus culture of banking, insisting it must be treated as a key item at Pittsburgh, and the issue seemed to be moving higher on the U.S. agenda as well.Larry Summers, Obama's top economic adviser, said the way that pay for bankers is set must be recalibrated to ensure that the risky behavior that helped fuel the worst banking crisis since the Depression of the 1930s is not swiftly repeated.

WASHINGTON (Reuters) – The Federal Reserve plans new rules on bank pay to curb the type of excessive risk-taking that sparked the global financial crisis and triggered international demands for action.Public outrage at the stratospheric compensation of some bankers has boiled up to the level of the Group of 20 nations, whose leaders meet next week in Pittsburgh.The United States, under pressure to act on pay at the G20 from France and Germany, has already said it aims to curb the culture of excessive risk-taking at the root of the crisis.A Fed source said on Friday that guidelines would be proposed in the next few weeks and would apply to any employee able to take risks that could imperil an institution, not just the executives who have been the main target of popular ire.The rules will be aimed at all firms the Fed regulates and be enforceable under its existing powers, said the source, who requested anonymity. The Fed oversees more than 5,000 bank holding companies and over 800 smaller state-chartered banks.Massive losses inflicted by risky subprime mortgage bets destroyed some of the oldest names in U.S. finance and intensified a recession that has cost millions of jobs, putting both the banks and the regulators under scrutiny.The Financial Stability Board, which answers to the G20 and will issue guidelines at the September 24-25 summit, said on Tuesday that poorly capitalized banks should not be allowed to pay large bonuses.
MULTIPLE TRACKS
The Obama administration has already appointed a pay czar to oversee executive compensation at firms getting taxpayer aid, and has indicated it will take further steps.Properly designed compensation practices constitute an important measure in ensuring safety and soundness in our system,White House adviser Lawrence Summers said on Friday.Industry officials said many financial firms had already reined in pay practices and warned a heavy-handed approach by the Fed could be harmful.What we're worried about is if they place undue restrictions on the sales people because that could weaken the company itself,said Scott Talbott, senior vice president for government affairs for the Financial Services Roundtable, the industry's lobbying group.Some analysts said Washington was bowing to populist pressure.I think that talking about curbing Wall Street pay is emotional and not rational,said Tom Sowanick, co-president and chief investment officer of Omnivest Group LLC.The Fed's proposal would take a two-pronged approach. A top tier of the largest banks, numbering around 24, would get particularly close scrutiny, while all other lenders under the Fed's supervision would receive less-intensive treatment.Larger firms would also be subject to a review that would compare their practices against rivals, and would be required to submit their pay policies to the Fed for its approval.This would put the burden on the big firms to modify existing compensation practices, while leaving them with flexibility to customize compensation to best fit their needs.Practices at smaller banks would be reviewed as part of existing regular bank exams, the Fed source said.
PLACING THE FOCUS ON THE LONG RUN
Goldman Sachs, which set aside $11.3 billion in the first half of the year toward employee bonuses but which has also spoken out against excessive pay at firms that lost money, said excessive risk-taking should not be rewarded. We think it entirely appropriate that people are rewarded for performance, but compensation should correlate directly with the performance of the firm,said Goldman Sachs spokesman Lucas van Praag.The Fed board has yet to vote on the proposal, but the timeline for the guidelines should advance in weeks, not months, the source said.The proposed rules would then face a period of public comment before they could be made final. But the Fed plans to launch the review process for the large firms as soon as the proposal goes out, the source said.The guidelines would not apply a one-size-fits-all prescription to cap pay at any specific level, the source added. WASHINGTON – Asian leaders gathering at next week's economic summit in Pittsburgh will be demanding a greater voice in the way global financial institutions make crucial decisions. Likewise, the world's established powers will have some demands of their own for the rising Asian nations.The Western countries who traditionally have wielded power at the World Bank, the International Monetary Fund and the United Nations will want Asia to cut greenhouse gases blamed for dangerous climate change and to slash barriers that prevent free trade.China, with its powerful economy and diplomatic and military strength, will be a leading player at the summit. The other Asian-Pacific G-20 nations — Japan, India, South Korea, Australia and Indonesia — believe their growing importance deserves a bigger say in the world's financial decision-making. The G-20, which represents 80 percent of the world's economic output, is where they will make their case.Broadly, they're looking for more input on how the world runs,said Brad Glosserman, executive director of the Pacific Forum CSIS think tank.It remains to be seen how successful Asian countries will be at getting their points across at a gathering that features 20 leading rich and developing nations, all with competing national interests and often with little in common.Asia has done well, comparatively, during the world economic crisis. But the region has been criticized for protecting its trade and agricultural industries from competition. At the Pittsburgh conference next Thursday and Friday, the West will want Asia to help jump-start stalled world trade liberalization talks, to increase imports and to reduce large trade surpluses.Gary Hufbauer, a senior fellow at the Peterson Institute for International Economics, said major questions will be:What are you doing to stimulate your economy? — and some of them are doing quite a bit — and What more can you do?
Asia will also face questions over climate change. Many argue that if Asia does not make cuts to emissions, progress will stall. Pittsburgh marks one of the last chances world leaders will have to generate momentum before a U.N. conference in December in Copenhagen, Denmark. Countries hope to forge a new agreement to replace the 1997 Kyoto Protocol, which expires in 2012.Already some leaders worry that disputes among industrialized and developing nations over cuts to emissions threaten to ruin a deal in Copenhagen. Asia is seen as the key to any progress.Japan also could make a splash on climate change. The Democratic Party of Japan, which won last month's national elections, has made bold promises to reduce the country's greenhouse emissions. The new government will be closely watched to see if it is more assertive than previous administrations, which tended to echo U.S. views.Fast-developing India is seen as key not only in the climate discussions but in world trade talks as well.India, along with Brazil, Russia and China, is hoping Pittsburgh will lead to an agreement on proposed new targets to shift voting power in both the IMF and the World Bank to developing countries.In Australia, Prime Minister Kevin Rudd will seek international support for his plan to spend his country deep into debt to keep its economy buoyant. He has pointed to worsening unemployment data and declining retail spending in recent months as evidence that government spending remains critical to future growth.In Indonesia, President Susilo Bambang Yudhoyono, will be eager to show that newfound stability in the predominantly Muslim nation of 235 million will continue.South Korea plans to urge advanced nations to extend greater help to poorer countries in their efforts to overcome the economic crisis.
Han Duk-soo, South Korea's ambassador to the United States, said Thursday that his country wants to host a G-20 summit next year. South Korea, he said in Washington, can bridge the divide between rich and poor countries, having gone, in a matter of decades, from a country devastated by war to one with a vibrant, thriving economy.

OTTAWA (Reuters) – Canadian banks may be required to defer some executive bonuses, Finance Minister Jim Flaherty said on Friday, as he outlined new rules aimed at discouraging excessive risk-taking and preventing future financial crises.Flaherty told reporters that Canadian regulators were in the process of implementing guidelines laid out earlier this year by the Financial Stability Board (FSB) -- made up of G20 central bankers, regulators and finance ministry officials.One of the major things is to spread out bonuses so that bonuses are not paid for short-term profit, which was one of the issues that led to the crisis in the past year, he said.
That's our position.It was not immediately clear whether Canada would make the bonus deferrals obligatory or voluntary.Next week's G20 summit in Pittsburgh is set to focus on tougher financial regulations. European Union leaders agreed on Thursday to seek curbs on bankers' bonuses at the meeting. Canada has been opposed to an absolute cap on bankers' pay.Flaherty said Ottawa was looking forward to another report by the FSB due in coming days, and would study its recommendations on financial regulation.Even though Canadian banks have been famously solid throughout the financial crisis -- and bonuses are not a contentious issue domestically because banks have not had bailouts -- Flaherty said he was committed to fulfilling whatever new global standards emerge.There's always a risk of being complacent. We learn from Bruno Waterfield that the EU is spending £280 million on building a new palace for its president and staff – ready for when theconstitutional Lisbon treaty is ratified.Named the Résidence Palace (pictured) after an existing Art Deco building which it replaces, that building in 1940 was used as the headquarters of the German army during the Nazi occupation of Belgium. This is a complete coincidence, and totally irrelevant. But it is kind of appropriate.Meanwhile, as the colleagues lavish money on their grandiose palaces (at our expense), having recently spent £185 million refurbishing the Berlayermonster, poor old Betty is scraping around for the £44 million needed to pay for the huge backlog of repairs to our royal palaces.Strangely enough, our contribution to the two latest EU follies is about £60 million – give or take – which would be more than enough to restore Betty's palaces to their former pristine glory, with some change left over. Instead, she is having to sell off chunks of the estate, starting with the old stables in the Royal Mews, in the grounds of Hampton Court.These are expected to fetch £2m, which is chump-change compared with the total amount needed. At least it is a start. But it is a more than adequate reflection of our times that our national heritage is falling into disrepair, with bits having to be flogged off to keep the rest going while our money is pouring into the coffers of the colleagues.On this, of course, there should be national outrage, and a very difficult decision to make ... who to shoot first, our own government or the colleagues in Brussels (even if both would be preferable, but you have to prioritise).But nothing will be said. We will go on paying and, eventually, new broom Dave will take over. And, guess what! We'll go on paying. We really are going to have to shoot them, you know.

Czech senators to file Lisbon Treaty complaint on Sept 29

PRAGUE — A group of Czech right-wing senators will file a new constitutional complaint against the European Union's reforming Lisbon Treaty this month, causing diplomatic fears of a new delay of several months.We are asking for an assessment of the treaty's compliance with the constitutional order,said senator Jiri Oberfalzer, a senator for the Czech Civic Democrats.The complaint, to be filed on September 29, may further delay the already lengthy ratification of the text, aimed at streamlining decision-making in the 27-nation bloc.Parts of the treaty already came under the Czech constitutional court's scrutiny last year, following a similar complaint from senators, but the court then ruled the treaty was in line with the constitution.We will now complain about dozens of provisions (of the text), Oberfalzer told AFP, in the latest threat to the treaty.However Oberfalzer remained realistic:I am not expecting the court to declare the treaty invalid,he said.But I think we could do the same thing as the German constitutional court, which has defined the conditions under which the Treaty of Lisbon could be aligned with the German constitution and suspend the ratification process until this is done,he said.
Talk of further delays to the treaty, which has already been rejected once by Irish voters, caused consternation among European leaders at an EU summit in Brussels on Thursday where Czech Prime Minister Jan Fischer informed his European counterparts that a delay could be possible.There was an explanation from the Czech prime minister and I said clearly that the if the Irish say yes then there is no question of us remaining in this artistic flux with a Europe which won't have the institutions it deserves,said French President Nicolas Sarkozy.They were saying (at the summit) that there's going to be a constitutional tribunal that might delay the process for weeks,one diplomat told AFP.That delay could be up to six months, according to some diplomats, presenting a political coup to eurosceptic Czech President Vaclav Klaus, who must formally sign and ratify the treaty on behalf of his country.Klaus said he will wait for the top Czech court ruling on the complaint from senators.A lengthy delay would also cause anxiety because British opposition leader David Cameron who has promised to hold a referendum on the treaty if it has not been fully ratified by all 27 EU nations by the time he comes to power.His Conservative party are firm favourites to win a British general election which Prime Minister Gordon Brown must call by next June at the latest, and will probably do so sooner.Ireland, the only nation constitutionally bound to put the Lisbon Treaty to public vote, will hold a second referendum next month, with latest opinion polls suggesting the yes camp will win this time round.The Czech Republic, Germany and Poland have also still to complete the ratification process.The treaty is needed as soon as possible in part so that a new European Commission can be named, as the treaty will change the make up of the EU's executive arm.The Lisbon reform treaty cleared one major hurdle in Germany on Friday where the upper house rubber-stamped the laws paving the way to its ratification following months of political wrangling and heated debate.

1. It establishes a legally new European Union in the constitutional form of a supranational European State.
2. It empowers this new European Union to act as a State vis-a-vis other States and its own citizens.
3. It makes us all citizens of this new European Union.
4. To hide the enormity of the change, the same name – European Union – will be kept while the Lisbon Treaty changes fundamentally the legal and constitutional nature of the Union.
5. It creates a Union Parliament for the Union's new citizens.
6. It creates a Cabinet Government of the new Union.
7. It creates a new Union political President.
8. It creates a civil rights code for the new Union's citizens.
9. It makes national Parliaments subordinate to the new Union.

1. The Lisbon Treaty establishes a legally quite new European Union. This is a Union in the constitutional form of a supranational European State:
The Treaty gives this new Union a State Constitution which is identical in its legal effects to the EU Constitution that French and Dutch voters rejected in their 2005 referendums.It does this by amending the two existing basic European Treaties, the Treaty on European Union (TEU) and the Treaty Establishing the European Community (TEC). The former retains its name, while the latter is renamed the Treaty on the Functioning of the Union (TFU). These two amended Treaties become the de facto Constitution of the new Union which they constitute or establish, although they are not called a Constitution. The EU has thus been given a Constitution indirectly rather than in direct form, as had been proposed in the Treaty which the peoples of France and Holland rejected in 2005.The provision of the Lisbon Treaty that The Union shall replace and succeed the European Community (Art.1.3, amended TEU) makes absolutely clear that the post-Lisbon Union will be quite a new entity, as the European Community of which our countries are all currently members ceases to exist.

It is not even a legal or corporate entity in its own right, for it does not have legal personality. The name European Union at present is a descriptive term for all the relations between its 27 Member States.At present these relations cover both the European Community area where supranational European law is operative, and the intergovernmental areas of foreign policy and justice and home affairs where Member States cooperate with one another on the basis of keeping their sovereignty and where European laws do not apply.The Lisbon Treaty changes this situation by creating a constitutionally and legally quite new EU, while retaining the same name, the Union. Unlike the present European Union, this legally new EU will be separate from and superior to its Member States, just as the USA is separate from and superior to California or New York, or Federal Germany to Bavaria or Brandenburg. This new European Union can sign treaties with other States in all areas of its competence and conduct itself as a State in the international community of States. It can speak at the United Nations on agreed foreign policy positions of its Member States, just as in the days of the Soviet Union the USSR had a UN seat while Russia, Ukraine and Byelorussia had UN seats also.
The Lisbon Treaty also gives the EU a political President, a Foreign Minister – to be called a High Representative – a diplomatic corps and a Public Prosecutor. The new EU will accede to the European Convention on Human Rights, as all other European States have already done, including those outside the EU.The Treaty also sets out the principle of the primacy of the laws of the new Union over the laws of its Member States (Declaration 27). The new EU makes the majority of laws for its Member States each year and under the Lisbon Treaty the new Union, which will replace the European Community, gets further power to make laws or take decisions by qualified majority vote in relation to some 68 new policy areas or matters where Member States currently have a veto.
3. The Treaty makes us all real citizens of this new European Union for the first time, instead of our being notional or honorary European citizens as at present:
A State must have citizens and one can only be a citizen of a State.Citizenship of the European Union at present is stated to complement national citizenship, the latter being clearly primary, not least because the present EU is not a State. It is not even a corporate entity that can have individuals as members, not to mind citizens.By transforming the legal character of the Union, the Lisbon Treaty transforms the meaning of Union citizenship. Article.17b.1 TEC/TFU replace the word complement in the sentence Citizenship of the Union shall complement national citizenship, so that the new sentence reads: Citizenship of the Union shall be in addition to national citizenship.This gives the 500 million inhabitants of the present EU Member States a real separate citizenship from citizenship of their national States for the first time. It gives a treble citizenship to citizens of Bavaria and Brandenburg within a Federal State like Germany. The rights and duties attaching to this citizenship of the new Union are be superior to those attaching to citizenship of one's own national State in any case of conflict between the two, because of the superiority of EU law over national law and constitutions.As most States only recognise that one can have a single citizenship, henceforth it is one's Union citizenship which will be regarded by other countries as primary and superior to one's national citizenship.Although we will be given rights as EU citizens, we should not forget that as real citizens of the new European Union we also owe it the normal citizens' duty of obedience to its laws and loyalty to its authority, which will be a higher authority than that of our national States and constitutions.Member States retain their national constitutions, but they are subordinate to the new Union Constitution. As such they will no longer be constitutions of sovereign States, just as the various local states of the USA retain their constitutions although they are subordinate to the Federal US Constitution.
4. To hide the enormity of the change, the same name – European Union – will be kept while the Lisbon Treaty changes fundamentally the legal and constitutional nature of the Union. By this means the importance of the proposed change is kept hidden from the people:
The change in the constitutional nature of both the Union and its Member States will be made in three legal steps that are set out in the Treaty:
(a) It establishes a European Union with an entire legal personality and independent corporate existence in all Union areas for the first time, so that it can function as a State vis-a-vis other States and in relation to its own citizens (Art.32, amended TEU);
(b) This new European Union replaces the existing European Community and takes over all of its powers and institutions. It takes over as well the intergovernmental powers over foreign policy and crime, justice and home affairs which at present are outside the scope of European law, leaving only the Common Foreign and Security Policy outside the scope of its supranational power (Art.11.1, amended TEU).It thereby gives a unified constitutional structure to the new Union which it will constitute or establish. The European Community disappears and all spheres of public policy will come within the scope of supranational EU law-making either actually or potentially, as in any constitutionally unified State. (One says potentially because further inter-State treaties would be required to transfer the minority of law-making powers still remaining with the Member States to the new Union in the future, or to shift powers back from the supranational level to the Member States – something that has never happened up to now. Supranational legislative acts would not yet be adopted in the sphere of Common Foreign and Security Policy and new treaties would be needed to change that. However the Commission, a key supranational body, will through the High Representative/Foreign Minister gain the right of initiative in the foreign policy field, so that even in the light of Art.11.1 TEU a de facto supranationality will be attained here);
(c) It makes us all real citizens of the new Federal Union which the Treaty establishes, with all the implications of that for downgrading our present personal status as citizens of sovereign nation States and superseding it by citizenship of a supranational European Federation.
5. It creates a Union Parliament for the Union's new citizens:
The Lisbon Treaty/EU Constitution makes Members of the European Parliament, who at present are representatives of the peoples of the Member States, into representatives of the Union's citizens (Art.9a, amended TEU). This illustrates the constitutional shift the Treaty makes from the present European Union of national States and peoples to the new Federal Union of European citizens and their national states – the latter henceforth reduced constitutionally and politically to provincial or regional status.
6. It creates a Cabinet Government of the new Union:
The Treaty turns the European Council, the quarterly summit meetings of Member State Heads of State or Government, into an institution of the new Union, so that its acts and failures to act will, like all other Union institutions, be subject to legal review by the EU Court of Justice.Legally speaking these summit meetings of the European Council will no longer be intergovernmental gatherings of Prime Ministers and Presidents outside supranational European structures. As part of the new EU´s institutional framework, they will instead be constitutionally required to promote the Union's values, advance its objectives, serve its interests and ensure the consistency, effectiveness and continuity of its policies and actions.(Art. 9 amended TEU). They will also define the general political direction and priorities thereof (Art.9b).The European Council thus becomes in effect the Cabinet Government of the new Federal EU, and its individual members will be primarily obliged to represent the Union to their Member States rather than their Member States to the Union.
7. It creates a new Union political President:
The federalist character of the European Council summit meetings in the proposed new Union structure is further underlined by the provision which gives the European Council a permanent political President for up to five years (two and a half years renewable once) (Art.9b).There is no gathering of Heads of State or Government in any other international context which maintains the same chairman or president for several years while individual national prime ministers and prime ministers come and go.The federal character of the new President is emphasised also by the Treaty provision which forbids that person from holding any national office and which lays down that he/she shall ensure the external representation of the Union.
8. It creates a civil rights code for the new Union's citizens:
All States have codes setting out the rights of their citizens. The EU Charter of Fundamental Rights will be that. It will be made legally binding by the new Treaty and will be an essential part of the new Union's constitutional structure (Art.6, amended TEU).The Charter is stated to be binding on the Union's own institutions and on Member States in implementing Union law. This limitation to EU law and to the EU institutions is unrealistic however, because
(a) the principles of primacy and uniformity of Union law mean that Member States will not only be bound by the Fundamental Rights Charter when implementing EU law, but also through the interpretation and application of their national laws in conformity with Union laws (v. ECJ judgements in the Factortame, Simmenthal and other law cases); and because
(b) the Charter sets out fundamental rights in areas in which the Union has currently no competence, e.g. outlawing the death penalty, asserting citizens' rights in criminal proceedings and various other areas.
This gives a new and extensive human and civil rights jurisdiction to the EU Court of Justice and makes that Court the final body to decide what people's rights are in the vast area covered by European law, as against national Supreme Courts and the Court of Human Rights in Strasbourg – the latter Court serving all other European States, not just the EU members – which are our final fundamental rights Courts today.The EU Commission can be expected in time to propose European laws to ensure the uniform implementation and guarantee of the rights provisions of the Charter throughout the Member States, even in areas which are basically outside the scope of Union competence. American constitutional history provides ample evidence of the radical federalising potential of the fundamental rights jurisdiction of the US Supreme Court.
9. It makes national Parliaments subordinate to the new Union:
The Treaty underlines the subordinate role of National Parliaments in the constitutional structure of the new Union by stating that National Parliaments shall contribute actively to the good functioning of the Union by various means set out in Article 8c, amended TEU. The imperative shall implies an obligation on National Parliaments to further the interests of the new Union.National Parliaments have in any case already lost most of their law-making powers to the EC/EU. The citizens who elect them have lost their powers to decide these laws too.The provision of the Treaty that if one-third of the National Parliaments object to a Commission proposal, the Commission must reconsider it but not necessarily abandon it, is small compensation for the loss of democracy involved by the loss of 68 vetoes by National Parliaments as a result of other changes proposed by the Lisbon Treaty.
10. It gives the new Union self-empowerment powers:
These are shown by:
(a) the enlarged scope of the Flexibility Clause (Art.308 TEC/TFU), whereby if the Treaty does not provide the necessary powers to enable the new Union attain its very wide objectives, the Council may take appropriate measures by unanimity. The Lisbon Treaty extends this provision from the area of operation of the common market to all of the new Union's policies directed at attaining its much wider objectives. The Flexibility Clause has been widely used to extend EU law-making over the years;
(b) the proposed Simplified Treaty Revision Procedure which permits the Prime Ministers and Presidents on the European Council to shift Union decision-taking from unanimity to qualified majority voting in the Treaty on the Functioning of the Union (Art.33.6, amended TEU), where the population size of certain Member States is likely to be decisive; and
(c) the several ratchet-clauses or passerelles which would allow the European Council to switch from unanimity to majority voting in certain specified areas such as judicial cooperation in civil matters (Art.69d.3.2), in criminal matters (Art.69f.2), in relation to the EU Public Prosecutor (69i.4), and in a number of other areas.
Conclusion:
It is hard to think of any major function of a State which the new European Union will not have once the Lisbon Treaty is ratified. The main one seems to be the power to make its Member States go to war against their will. The Treaty does provide that the EU may go to war while individual Member States may constructively abstain.The obligation on the Union to provide itself with the means necessary to attain its objectives and carry through its policies (Art. TEC/TFU 269 a), which means raising its own resources to finance them, may be regarded as conferring on it wide taxation and revenue-raising powers, although these will require unanimity to exercise. Currently public expenditure and the tax measures needed to finance it remain overwhelmingly at national state level. This is because such social services as health, education, social security and public housing, as well as defence, policing and public transport – the government functions which cost most money – are still mainly at this level.However the new European Union will have its own government, with a legislative, executive and judicial arm, its own political President, its own citizens and citizenship, its own human and civil rights code, its own currency, economic policy and revenue, its own international treaty-making powers, foreign policy, foreign minister, diplomatic corps and United Nations voice, its own crime and justice code and Public Prosecutor. It already possesses such normal State symbols as its own flag, anthem, motto and annual official holiday.
As regards the State authority of the new Union, it is embodied in the Union' s own executive, legislative and judicial institutions: the European Council, Council of Ministers, Commission, Parliament and Court of Justice. It is also embodied in the Member States and their authorities as they implement and apply EU law and interpret and apply national law in conformity with Union law. Member States will be constitutionally required to do this under the Lisbon Treaty. Thus EU State authorities as represented for example by soldiers and policemen in EU uniforms on our streets are not needed as such.Allowing for the special features of each case, all the classical Federal States which have been formed on the basis of power being surrendered by lower constituent states to a higher Federal authority have developed in a gradual way, just as has happened in the case of the European Union. Nineteenth century Germany, the USA, Canada and Australia are classical examples. Indeed the EU has accumulated its powers much more rapidly than some of these Federal States – in the short historical time-span of some sixty years.The key difference between these classical Federations and the new European Union is that the former, once their people had settled, share a common language, history, culture and national solidarity that gave them a democratic basis and made their State authority popularly legitimate and acceptable. All stable States are founded on such communities where people speak a common language and mutually identify with one another as one people – a We. In the EU however there is no European people or demos, except statistically. The Lisbon Treaty is an attempt to construct a highly centralised European Federation artificially, from the top down, out of Europe's many nations, peoples and States, without their free consent and knowledge.
If there were to be a European Federation that is democratic and acceptable, the minimum constitutional requirement for it would be that its laws would be initiated and approved by the directly elected representatives of the people either in the European Parliament or the National Parliaments. Unfortunately, neither the Lisbon Treaty nor the EU Constitution it establishes contain any such proposal.By giving a Constitution indirectly rather than directly to the new European Union which it will establish, the Lisbon Treaty sets in place what Belgian Prime Minister Guy Verhofstadt has called the capstone of a European Federal State. For the Euro-federalist political elites who have been driving this process over decades this is the culmination of what started nearly 60 years ago when the 1950 Schuman Declaration, which is commemorated annually on 9 May, Europe Day, proclaimed the European Coal and Steel Community to be the first step in the federation of Europe.
The peoples of Europe do not want this kind of highly centralized Federal European Union whose most striking feature is that it is run virtually entirely by committees of politicians, bureaucrats and judges, none of whom are directly elected by the people. The Constitutional Treaty setting it up has already been rejected by the French and the Dutch in 2005. As French President Nicolas Sarkozy has admitted, the Prime Ministers and Presidents have agreed among themselves on no account to have referendums on the Renamed Constitutional Treaty, for that would be rejected everywhere again.Only the Irish are enabled to have their say on it because of the constitutional case taken before the Supreme Court by the late Raymond Crotty. That action by that great Irishman stopped the State's politicians of that time from ratifying a previous European Treaty, the Single European Act, in an unconstitutional manner.

Broadly speaking, the world is run at the outset of the 21st Century by the United States and China together in uneasy condominium. This is the surprising reality of our era. The pattern is unlikely to change much until India takes its full place, perhaps in 40 years.The baton passed from Europe’s tired hands at London’s G20 summit in April, where the only meeting that mattered was the tete-a-tete between Barack Obama and Hu Jintao. The two Pacific superpowers are meshed together by their dollar-yuan currency and de facto debt union, and by their Strategic Economic Dialogue. Let’s just call it G2 for short. China’s return to great power status is well known, but some may be surprised to learn that America’s share of global GDP has scarcely changed in 30 years, falling slightly to 20 per cent depending how you measure it.Greater Europe has slipped relentlessly. The Western part is still rich, but counts ever less in world affairs as ageing takes it toll. The United Nations expects America to add 100 million people by 2050: Germany will contract from 82 million to 70 million. Italy will shrink. Eastern Europe faces implosion. This is not fertile demography for hi-tech invention.What is at risk in the medium to long run is nothing less than the sustainability of the society Europe has built and the viability of its civilisation,admitted an internal EU report by former Dutch premier Wim Kok in 2004. Nothing has changed since.
The Great Recession of 2008-2009 may have humiliated Anglo-Saxon capitalism but the German and Italian economies have shrunk by almost twice as much as the US from peak to trough. As will become clear, they also lack the labour market springs of quick recovery. The Bundesbank fears it will take until 2013 for Germany to regain its former output. Will Italy ever do so? Europe’s triumphalism a year ago was badly misjudged. A new report by the Brussels think tank Breugel says the EU itself may be the biggest casualty since the traumatic events have led to revival of the nation state – each defending its own industry bec et ongles, each pressuring its banks to come home. Berlin even created a €115 billion German Fund, and EU competition rules be damned.The G20 has emerged as the forum that counts. EU big shot states prefer to play on that stage. EU summits in Brussels have slipped to backwater status.The crisis risks calling into question the very legitimacy of the European Union. Confidence in the effectiveness of the EU economic policy system has been severely hurt by the crisis.it said.Breugel fears the return of mass unemployment, a depression-deep crisis in parts of Eastern Europe, and a bond crisis as spendthrift states struggle to roll over public debts. It was too polite to name Italy and Greece but both are – or will be – caught in debt compound traps.How far it seems from the heady optimism a decade ago when EU leaders launched the euro and talked of Europe’s rise to economic hegemony by 2010.
By then they were endowing the EU with the apparatus of full-blown state. A foreign office (High Rep), with its own intelligence cell and military staff with nine generals and 57 colonels; a Euro-army (rapid reaction force), backed by 100,000 troops, 400 aircraft, and 100 ships to project power across the globe; a proto-FBI (Europol); a satellite system (Galileo); they even created a Directorate of Justice and Home Affairs… Home Affairs? They launched a Philadelphia Convention to draft Europe’s Constitution – the Treaty to end all Treaties – which I had the task of covering. Launched at Laeken, allegedly to bring Europe closer to the citizens after a spate of anti-EU riots and No votes, it was hijacked by insiders hell bent on forging a Super-Etat, in perpetuity.Few in Europe’s talking shops had a serious thought then for China, let alone India, or Vietnam. The world was seen in bipolar, almost Manichean terms: Europe against America, a friendly rivalry like those poisonous football matches between Celtic and Rangers, or Barcelona and Madrid.As Europe subsides into its new role as a museum piece, Britons who are instinctively Euro-sceptic or simply have more natural affinity with the English-speaking world – or indeed, like my 19-year-old son, with China – can justifiably ask how far this country should contort itself to take part in the EU project.For years we believed – or were scared into believing – that the strategic and economic price of jumping off the integrationist conveyor belt would be too high. It may be time to turn this argument on its head. How worthwhile is it to remain a member of an inward-looking club when the locus of creative dynamism is elsewhere?
This has become a piquant question as Brussels seizes on the banking crisis to extend control over the City and our finance industry, worth 8 per cent of GDP and generating £50 billion a year surplus on the current account.Simon Tilford from the Centre for European Reform says British Euro-sceptics like to have their cake and eat it: Euro-sceptics appear to believe that a Britain outside the EU would remain part of the single market, but that it would be freed from the need to abide by EU regulation. In short, Britain could enjoy all the benefits of access to the single market but none of the costs. This is incoherent. A retreat would achieve nothing but impotence.Mr Tilford is right. There is a lack of rigour and often a defeatist assumption that Britain never gets its way in Europe, never has allies, and is forever at the mercy of Franco-German villainy.It looks otherwise to French and German journalists in Brussels. But then, each of Europe’s fractious tribes thinks that somebody else is in charge. That is the elemental flaw in the project. Psychologists call this an ownership problem. The owners are the 28,000 fonctionaires on high-paid EU tenure.Paris has reason to gripe. English has displaced French as the lingua franca, with all the subtle advantages that brings. British and Irish officials are ubiquitous in the upper reaches of the directorates that count most: Competition, Single Market, Trade. The last two secretary-generals of the Commission have been Irish, a far cry from Emile Noel, who ran it as a replica of the French civil service for 30 years. It is why the Commission became for a while an engine of free market reform.Let us be honest: UK withdrawal would be traumatic, altering the political chemistry of Europe in unpredictable ways. While it is possible that a cluster of like-minded states on the Atlantic and Nordic rim would eventually retreat with us into a free-trade bloc, it would be rash statecraft to bet on it.
Those that tend to align with Britain inside the EU as a counterweight to Rhineland domination – Scandinavians, Dutch, Balts, Slavs, and Spain (on-off) – would have to trim, tucking in obediently behind Paris and Berlin.Britain would risk creating the sort of monolithic Habsburg Europe we wish to avoid, violating the balancing principle of our diplomacy in Europe since Elizabeth I. One wonders how that shrewd, equivocating, steely queen would have played the EU.Yet to accept that exit would be a high-risk gamble does not settle the argument. Ultra-federalists might scream, hurl abuse, and attempt to shut Perfidious Albion from EU markets, but the Dutch, Danes, Swedes and others would want to heal the rift.If Brussels pushed too hard for Carthaginian terms, it would risk setting off unstable combustion in the residual EU. As Breugel says, the legitimacy of the EU is already badly eroded.This great question might have been left unresolved, finessed by English pragmatism, had the EU not taken a dangerously authoritarian course by ramming through the European Constitution – renamed Lisbon – after it had been rejected by voters in France and Holland in 2005, and would have been rejected by half Europe had the fiasco continued. This manoeuvre is altogether different from the euro-creep tactics of EU father Jean Monnet, who handled democratic sensibilities with greater care.Clearly it never occurred to those behind this heavy-handed move – Angela Merkel and Nicolas Sarkozy – that Irish voters would then reject the text in the one country allowed to vote. Perhaps the Irish can be cajoled in their weakened state into voting Yes next month. But a delicate line has been crossed. The EU project is usurping power, even if the forms of parliamentary ratification have been preserved.
Critics call the Lisbon Treaty a federalist blueprint. That muddies the issue. It in fact concentrates power in a unitary state, giving the European Court jurisdiction for the first time over the whole gamut of EU affairs (all three pillars, in EU jargon – the Community pillar, the common foreign and security policy pillar and the pillar devoted to police and judicial cooperation in criminal matters). It will adjudicate over the Charter of Rights. Euro-judges will have power to reshape British society by court ruling if they so wish, just as the activist Warren Court reshaped America.By creating a full-time EU president and by giving Euro-MPs the power of the purse, it mimics nationhood. Yet it should be obvious that Europe cannot ape the institutions of the historic nation states in this way. Shifting power from London, Madrid, or Copenhagen to the EU core does not transfer democratic accountability: it breaks the lines of accountability. Strasbourg’s Babel house has no unifying language or political culture. It answers to no coherent demos, and cannot do so because none exists at a European level. Italians read Italian newspapers about Italian politics, just as we read British newspapers about British politics. It is surreal that this should be happening when the EU is in crisis.We are confronted by a venture that is using anti-democratic means to establish an anti-democratic power structure, to no useful end for the people of these isles. It fair to say that this breaches the Burkean principle of settled practice, dear to readers of The Daily Telegraph. Since this unwelcome revolution is being forced upon us, perhaps it is time to end the long taboo and ask whether we must inevitably go along with it.- From Prophecy News Watch.

The Labour architect of the EU's Lisbon Treaty has warned it puts the future of democracy in Britain at stake. Former health minister Gisela Stuart said the treaty breached the fundamental democratic principle that voters can get rid of those in power. Just weeks before the Irish are asked to vote again on the measure, she said it would also allow the EU to launch future power grabs completely unchecked.Miss Stuart is a pro-European who sat on the committee which drew up the original EU Constitution, later repackaged as the Lisbon Treaty. She said it would leave a huge democratic deficit if passed, leaving the EU's leaders accountable to no one.
She said there would be no more treaties, no more referendums anywhere on EU integration.The treaty contains a ratchet clause, meaning that national vetoes can be scrapped one by one without the need for summits or referendums.Voters will also have no power to choose or remove a new allpowerful EU president, who will be selected by EU leaders.Tony Blair is current favourite for the post.Miss Stuart said:My basic test of democracy is: can I get rid of them? By casting a vote, you can change the people who are in control of you.Lisbon does not give you, as a citizen, the means to control the executive or the politicians who decide on your behalf, and that's the hurdle it falls on.The nature of democracy is really at stake.
Miss Stuart's comments will increase controversy ahead of the crunch Irish vote on October2.Voters there threw the ratification process into chaos when they rejected it last year.Miss Stuart's comments will embarrass Labour, which broke a promise to hold a referendum on the EU Constitution.

In January, a bill was introduced in Congress that would authorize the Department of Homeland Security to set up a network camp facilities to be used to intern U.S. citizens in the event of a national emergency. The National Emergency Centers Act or HR 645 mandates the establishment of national emergency centers to be located on military installations for the purpose of to providing temporary housing, medical, and humanitarian assistance to individuals and families dislocated due to an emergency or major disaster,according to the bill.FEMA, of course, is part of the DHS, so we are mixing apples and oranges here. It’s all part of the emergent federal police state, designed to wrangle the real enemy of the government — the American people.

An alleged terror plot, exposed after raids in the suburbs of New York this week, may have been targeting a major transportation centre in the city like a railroad or subway station. Backpacks, computers and maps were found during the searches conducted by the FBI, and field tests turned up positive for explosives allegedly found in raids in the New York borough Queens, a media report said. Investigators said that there was planning and preparation for an attack, very likely in the New York area such as a large railroad or subway station, essentially where airport-style screening is absent.The suspects were real-deal terrorists operating and planning an attack in America, CNN quoted sources as saying. They added that an unprecedented level of resources is being devoted to the investigation, including the placement of a hostage rescue team in New York for possible raids. 24-year-old Colorado resident Najibullah Zazi, at the centre of the week-long probe, met FBI agents yesterday in Denver for a second day, as his lawyer disputed a report that bomb-making plans were found on the man's computer.
The Denver area is the next area of investigation after Zazi became the centre of the probe, the report said. Federal agents searched the home of Zazi besides searching the nearby residence of his aunt, Rabia Zazi, early this week. A law enforcement official told CNN that diagrams showing how to make bombs were found on the computer that Zazi had with him when he was stopped in New York during a recent visit, but his lawyer Arthur Folsom dismissed the allegation.The Associated Press has reported that an FBI-New York Police Department task force suspected that Zazi may be involved in an alleged plot involving homemade hydrogen peroxide-based explosives. In interviews to the media, Zazi denied any terrorist involvement. Agents of the Joint Terrorism Task Force executed search warrants at Zazi's apartment near East Smoky Hill Road and E-470 and at the nearby home of Zazi's aunt and uncle on Wednesday.There is no word today regarding what, if anything, investigators recovered in those searches.The FBI today declined to provide full details giving a legal basis for their searches of Zazi's home and the home of his aunt and uncle. But they had a proper affidavit, said Wright, the FBI spokeswoman in Denver.There has to be one - since we had a search warrant. But it is not publicly available,Wright said.Folsom said he has not yet seen all of the legal paperwork from Wednesday's searches.I haven't been shown the supporting affidavit for the warrant. The warrant looks legitimate,he said.Zazi was born in Afghanistan and moved to Pakistan when he was 7, Folsom said. As a teenager, he moved to New York City, where his family had settled. He operated a coffee cart in Manhattan before moving to Denver earlier this year. Zazi has a wife in Pakistan, and he said he visited her several months ago.Federal officials stepped up their investigation after Zazi rented a car Sept. 9 in Colorado and drove to New York City. He said he was traveling there to deal with an issue related to the coffee cart, which his family still owns. While he was there, police stopped him on a bridge leading into the city and searched the rental car. According to law enforcement sources with knowledge of the investigation, the Colorado searches were part of a probe that began with Zazi and led to New York.Zazi has driven limousines for First ABC Transportation in suburban Aurora, near Denver International Airport, for about six months, according to a worker who answered the phone at the company.The man, who identified himself only as Joe,said he was startled to hear Zazi was under investigation. San Francisco - Najibullah Zazi met for the second time with Federal Bureau of Investigations (FBI) officers in Denver Thursday to answer more questions regarding a terrorism probe that stretches from Queens, N.Y., to Aurora, Colo., and has been called the most sensitive investigation of its kind since 9/11.Mr. Zazi, an Afghan native who works as an airport shuttle driver in Colorado, has become the subject of interest in a case that law enforcement sources have said may involve an US-based terrorist cell with possible links to Al Qaeda.Officials told the Associated Press (AP) that the group is suspected of aiming to develop hydrogen peroxide-based bombs, the same types of explosives the London bombers used in July 2005 attack that killed 56 people.The government issued an alert to law enforcement Monday to be on the lookout for anyone buying large quantities of chemicals that could be used to make explosives. Also, on Thursday, agents in Denver went to Home Depot stores in an effort to track any recent purchases of similar chemicals.US terrorism experts and government officials have been saying since 9/11 that another attack was likely. While several terrorism-related arrests have been made in the US over the past eight years, nothing matches the reach of what officials allege in this still-unraveling case.
Zazi has maintained his innocence. His lawyer has said Zazi, who is reportedly eligible to apply for US citizenship next month, never met with Al Qaeda and has no ties to terrorism.It appears that a federal antiterrorism task force has been following Zazi for some time. He was stopped by authorities before entering New York City and federal agents searched three of his acquaintances' apartments in Queens.National Public Radio (NPR) reports that agents expected to find bomb components — chemicals or timers or fuses. Instead, they turned up a frightened Muslim family and a bomb-making manual. The key suspect they hoped to grab had already left.Agents confiscated backpacks, computers, and cellphones from the apartment that are now being analyzed.Zazi says he was driving to New York to check on a coffee cart that his family owns. The New York Times spoke with the coffee cart vendor who appears to have confirmed that story.This week, agents searched Zazi's Colorado apartment. Agents clad in white clean suits and others using dogs executed search warrants at Zazi's apartment and at the nearby home of his aunt and uncle. Preparations for the High Holy Days have taken on a new urgency this year at Congregation Derech Emunoh, once one of the city’s largest synagogues, but for the last seven years reduced to conducting services in a run-down double-wide trailer hard by the Atlantic Ocean on the Rockaway peninsula in Queens.As in many other synagogues, members are setting up additional seating — in Derech Emunoh’s case, beyond the usual 20 or so mismatched chairs and sagging sofa — for Rosh Hashana and Yom Kippur services. They are clearing the dirt parking area and walkway of debris, weeds and trash where the trailer sits, in a desolate construction site for one of the largest residential development projects under way in New York City.
But the leaders of Derech Emunoh, an Orthodox congregation, are also scrambling to find a new home, since the developer of the $1 billion project — Arverne by the Sea, which is eventually expected to include 2,300 houses and condominiums on 117 acres — has ordered the synagogue to vacate the trailer right after Yom Kippur, on Sept. 28, to make way for the bulldozers and backhoes. Once an architectural gem that drew 800 people on Saturday mornings, Derech Emunoh — Hebrew for path of faith — has made its hard-luck home in the trailer since a fire in 2002 destroyed its building. Members had long hoped that the redevelopment of the Arverne neighborhood, once a seaside getaway, would be their salvation, bringing an infusion of Jewish newcomers. If the explosion went off in Penn Station, the source said, it would affect transportation of Amtrak's northeast corridor between Boston and Washington, LIRR service and New York City subway service.

An alleged terror plot, exposed after raids in the suburbs of New York this week, may have been targeting a major transportation centre in the city like a railroad or subway station. Backpacks, computers and maps were found during the searches conducted by the FBI, and field tests turned up positive for explosives allegedly found in raids in the New York borough Queens, a media report said. Investigators said that there was planning and preparation for an attack, very likely in the New York area such as a large railroad or subway station, essentially where airport-style screening is absent.The suspects were real-deal terrorists operating and planning an attack in America, CNN quoted sources as saying. They added that an unprecedented level of resources is being devoted to the investigation, including the placement of a hostage rescue team in New York for possible raids. 24-year-old Colorado resident Najibullah Zazi, at the centre of the week-long probe, met FBI agents yesterday in Denver for a second day, as his lawyer disputed a report that bomb-making plans were found on the man's computer.
The Denver area is the next area of investigation after Zazi became the centre of the probe, the report said. Federal agents searched the home of Zazi besides searching the nearby residence of his aunt, Rabia Zazi, early this week. A law enforcement official told CNN that diagrams showing how to make bombs were found on the computer that Zazi had with him when he was stopped in New York during a recent visit, but his lawyer Arthur Folsom dismissed the allegation.The Associated Press has reported that an FBI-New York Police Department task force suspected that Zazi may be involved in an alleged plot involving homemade hydrogen peroxide-based explosives. In interviews to the media, Zazi denied any terrorist involvement. The official did not provide more specific details.CBS News reported this afternoon that, according to one source who gets high level intelligence briefings, law enforcement has record of a number of conversations between Zazi and a known al-Qaeda operative in Pakistan.In the conversations there also is a reference to a wedding which U.S. law enforcement believes is a code word for an attack, finding no evidence of a real planned wedding, CBS reported.That source said law enforcement felt Zazi's recent trip to New York was sudden and Zazi told at least one person not to tell anyone he was going.The source also told CBS that the formula for the explosive TATP was found in his computer when they seized his car.
Agents of the Joint Terrorism Task Force executed search warrants at Zazi's apartment near East Smoky Hill Road and E-470 and at the nearby home of Zazi's aunt and uncle on Wednesday.There is no word today regarding what, if anything, investigators recovered in those searches.The FBI today declined to provide full details giving a legal basis for their searches of Zazi's home and the home of his aunt and uncle. But they had a proper affidavit, said Wright, the FBI spokeswoman in Denver.There has to be one - since we had a search warrant. But it is not publicly available,Wright said.Folsom said he has not yet seen all of the legal paperwork from Wednesday's searches.I haven't been shown the supporting affidavit for the warrant. The warrant looks legitimate,he said.Zazi was born in Afghanistan and moved to Pakistan when he was 7, Folsom said. As a teenager, he moved to New York City, where his family had settled. He operated a coffee cart in Manhattan before moving to Denver earlier this year. Zazi has a wife in Pakistan, and he said he visited her several months ago.Federal officials stepped up their investigation after Zazi rented a car Sept. 9 in Colorado and drove to New York City. He said he was traveling there to deal with an issue related to the coffee cart, which his family still owns. While he was there, police stopped him on a bridge leading into the city and searched the rental car. San Francisco - Najibullah Zazi met for the second time with Federal Bureau of Investigations (FBI) officers in Denver Thursday to answer more questions regarding a terrorism probe that stretches from Queens, N.Y., to Aurora, Colo., and has been called the most sensitive investigation of its kind since 9/11.Mr. Zazi, an Afghan native who works as an airport shuttle driver in Colorado, has become the subject of interest in a case that law enforcement sources have said may involve an US-based terrorist cell with possible links to Al Qaeda.Officials told the Associated Press (AP) that the group is suspected of aiming to develop hydrogen peroxide-based bombs, the same types of explosives the London bombers used in July 2005 attack that killed 56 people.The government issued an alert to law enforcement Monday to be on the lookout for anyone buying large quantities of chemicals that could be used to make explosives. Also, on Thursday, agents in Denver went to Home Depot stores in an effort to track any recent purchases of similar chemicals.US terrorism experts and government officials have been saying since 9/11 that another attack was likely. While several terrorism-related arrests have been made in the US over the past eight years, nothing matches the reach of what officials allege in this still-unraveling case.
Zazi has maintained his innocence. His lawyer has said Zazi, who is reportedly eligible to apply for US citizenship next month, never met with Al Qaeda and has no ties to terrorism.It appears that a federal antiterrorism task force has been following Zazi for some time. That investigation turned public after Zazi traveled from Colorado to New York in a rental car just before Sept. 11. He was stopped by authorities before entering New York City and federal agents searched three of his acquaintances' apartments in Queens.National Public Radio (NPR) reports that agents expected to find bomb components — chemicals or timers or fuses. Instead, they turned up a frightened Muslim family and a bomb-making manual. The key suspect they hoped to grab had already left.Agents confiscated backpacks, computers, and cellphones from the apartment that are now being analyzed.Zazi says he was driving to New York to check on a coffee cart that his family owns. The New York Times spoke with the coffee cart vendor who appears to have confirmed that story.This week, agents searched Zazi's Colorado apartment. Agents clad in white clean suits and others using dogs executed search warrants at Zazi's apartment and at the nearby home of his aunt and uncle. Preparations for the High Holy Days have taken on a new urgency this year at Congregation Derech Emunoh, once one of the city’s largest synagogues, but for the last seven years reduced to conducting services in a run-down double-wide trailer hard by the Atlantic Ocean on the Rockaway peninsula in Queens.As in many other synagogues, members are setting up additional seating — in Derech Emunoh’s case, beyond the usual 20 or so mismatched chairs and sagging sofa — for Rosh Hashana and Yom Kippur services. They are clearing the dirt parking area and walkway of debris, weeds and trash where the trailer sits, in a desolate construction site for one of the largest residential development projects under way in New York City.
But the leaders of Derech Emunoh, an Orthodox congregation, are also scrambling to find a new home, since the developer of the $1 billion project — Arverne by the Sea, which is eventually expected to include 2,300 houses and condominiums on 117 acres — has ordered the synagogue to vacate the trailer right after Yom Kippur, on Sept. 28, to make way for the bulldozers and backhoes. Once an architectural gem that drew 800 people on Saturday mornings, Derech Emunoh — Hebrew for path of faith — has made its hard-luck home in the trailer since a fire in 2002 destroyed its building. Members had long hoped that the redevelopment of the Arverne neighborhood, once a seaside getaway, would be their salvation, bringing an infusion of Jewish newcomers. An internal memo obtained by The Associated Press says the FBI has received a plausible but unsubstantiated report that Al Qaeda terrorists in late September may have discussed attacking the subway system.Uniformed officers, including this NYPD Counter Terrorism Squad members and Amtrak cops with M-16s, flooded Penn Station Wednesday after the FBI said it had received a plausible but unsubstantiated report that Al Qaeda operatives discussed a plan two months ago to bomb New York City's mass transit system.The report said: These discussions reportedly involved the use of suicide bombers or explosives placed on subway/passenger rail systems.Sources told CBS station WCBS-TV in New York the plot involved the Long Island Rail Road. If the explosion went off in Penn Station, the source said, it would affect transportation of Amtrak's northeast corridor between Boston and Washington, LIRR service and New York City subway service.

4 Again I will build thee, and thou shalt be built, O virgin of Israel: thou shalt again be adorned with thy tabrets, and shalt go forth in the dances of them that make merry.
5 Thou shalt yet plant vines upon the mountains of Samaria: the planters shall plant, and shall eat them as common things.
6 For there shall be a day, that the watchmen upon the mount Ephraim shall cry, Arise ye, and let us go up to Zion unto the LORD our God.
7 For thus saith the LORD; Sing with gladness for Jacob, and shout among the chief of the nations: publish ye, praise ye, and say, O LORD, save thy people, the remnant of Israel.
8 Behold, I will bring them from the north country, and gather them from the coasts of the earth, and with them the blind and the lame, the woman with child and her that travaileth with child together: a great company shall return thither.
9 They shall come with weeping, and with supplications will I lead them: I will cause them to walk by the rivers of waters in a straight way, wherein they shall not stumble: for I am a father to Israel, and Ephraim is my firstborn.
10 Hear the word of the LORD, O ye nations, and declare it in the isles afar off, and say, He that scattered Israel will gather him, and keep him, as a shepherd doth his flock.
11 For the LORD hath redeemed Jacob, and ransomed him from the hand of him that was stronger than he.
12 Therefore they shall come and sing in the height of Zion, and shall flow together to the goodness of the LORD, for wheat, and for wine, and for oil, and for the young of the flock and of the herd: and their soul shall be as a watered garden; and they shall not sorrow any more at all.
13 Then shall the virgin rejoice in the dance, both young men and old together: for I will turn their mourning into joy, and will comfort them, and make them rejoice from their sorrow.
14 And I will satiate the soul of the priests with fatness, and my people shall be satisfied with my goodness, saith the LORD.
15 Thus saith the LORD; A voice was heard in Ramah, lamentation, and bitter weeping; Rahel weeping for her children refused to be comforted for her children, because they were not.
16 Thus saith the LORD; Refrain thy voice from weeping, and thine eyes from tears: for thy work shall be rewarded, saith the LORD; and they shall come again from the land of the enemy.
17 And there is hope in thine end, saith the LORD, that thy children shall come again to their own border.
18 I have surely heard Ephraim bemoaning himself thus; Thou hast chastised me, and I was chastised, as a bullock unaccustomed to the yoke: turn thou me, and I shall be turned; for thou art the LORD my God.
19 Surely after that I was turned, I repented; and after that I was instructed, I smote upon my thigh: I was ashamed, yea, even confounded, because I did bear the reproach of my youth.
20 Is Ephraim my dear son? is he a pleasant child? for since I spake against him, I do earnestly remember him still: therefore my bowels are troubled for him; I will surely have mercy upon him, saith the LORD.

8 And the second angel sounded, and as it were a great mountain burning with fire was cast into the sea: and the third part of the sea became blood;
9 And the third part of the creatures which were in the sea, and had life, died; and the third part of the ships were destroyed.
10 And the third angel sounded, and there fell a great star from heaven, burning as it were a lamp, and it fell upon the third part of the rivers, and upon the fountains of waters;
11 And the name of the star is called Wormwood: and the third part of the waters became wormwood; and many men died of the waters, because they were made bitter.
12 And the fourth angel sounded, and the third part of the sun was smitten, and the third part of the moon, and the third part of the stars; so as the third part of them was darkened, and the day shone not for a third part of it, and the night likewise.
13 And I beheld, and heard an angel flying through the midst of heaven, saying with a loud voice, Woe, woe, woe, to the inhabiters of the earth by reason of the other voices of the trumpet of the three angels,which are yet to sound!
REVELATION 9:1-21
1 And the fifth angel sounded, and I saw a star fall from heaven unto the earth: and to him was given the key of the bottomless pit.
2 And he opened the bottomless pit; and there arose a smoke out of the pit, as the smoke of a great furnace; and the sun and the air were darkened by reason of the smoke of the pit.
3 And there came out of the smoke locusts upon the earth: and unto them was given power, as the scorpions of the earth have power.
4 And it was commanded them that they should not hurt the grass of the earth, neither any green thing, neither any tree; but only those men which have not the seal of God in their foreheads.
5 And to them it was given that they should not kill them, but that they should be tormented five months: and their torment was as the torment of a scorpion, when he striketh a man.
6 And in those days shall men seek death, and shall not find it; and shall desire to die, and death shall flee from them.
7 And the shapes of the locusts were like unto horses prepared unto battle; and on their heads were as it were crowns like gold, and their faces were as the faces of men.
8 And they had hair as the hair of women, and their teeth were as the teeth of lions.
9 And they had breastplates, as it were breastplates of iron; and the sound of their wings was as the sound of chariots of many horses running to battle.
10 And they had tails like unto scorpions, and there were stings in their tails: and their power was to hurt men five months.
11 And they had a king over them, which is the angel of the bottomless pit, whose name in the Hebrew tongue is Abaddon, but in the Greek tongue hath his name Apollyon.
12 One woe is past; and, behold, there come two woes more hereafter.
13 And the sixth angel sounded, and I heard a voice from the four horns of the golden altar which is before God,
14 Saying to the sixth angel which had the trumpet, Loose the four angels which are bound in the great river Euphrates.
15 And the four angels were loosed, which were prepared for an hour, and a day, and a month, and a year, for to slay the third part of men.
16 And the number of the army of the horsemen were two hundred thousand thousand: and I heard the number of them.
17 And thus I saw the horses in the vision, and them that sat on them, having breastplates of fire, and of jacinth, and brimstone: and the heads of the horses were as the heads of lions; and out of their mouths issued fire and smoke and brimstone.
18 By these three was the third part of men killed, by the fire, and by the smoke, and by the brimstone, which issued out of their mouths.
19 For their power is in their mouth, and in their tails: for their tails were like unto serpents, and had heads, and with them they do hurt.
20 And the rest of the men which were not killed by these plagues yet repented not of the works of their hands, that they should not worship devils, and idols of gold, and silver, and brass, and stone, and of wood: which neither can see, nor hear, nor walk:
21 Neither repented they of their murders, nor of their sorceries, nor of their fornication, nor of their thefts.
