A majority of Palestinians oppose renewed dialogue between the Ramallah-based Palestinian leadership and US President Donald Trump’s administration, according to a public opinion poll published on Wednesday. Sixty-two percent of Palestinians are against a resumption of dialogue, while 27% are in favor, the survey found.Since Trump recognized Jerusalem as Israel’s capital and initiated the relocation of the US Embassy in Israel to the city last December, PA President Mahmoud Abbas and several top Palestinian officials have refused to meet White House officials, including US Vice President Mike Pence, and other American government personnel.However, senior Palestinian security officials including Ziad Hab a-Rih, the head of PA Preventative Security, and Majid Faraj, the chief of the PA General Intelligence Services, have recently held meetings with CIA officials, according to two Palestinian sources who spoke to The Times of Israel.The publication of the poll’s results comes days after the US cut all its funding to the United Nations Relief and Works Agency, the UN body tasked with aiding Palestinian refugees, and more than $200 million in other aid for projects in the West Bank and Gaza.The Palestinian Center for Policy and Survey Research (PCPSR) conducted the poll, which surveyed 1,270 Palestinians in 127 randomly selected locations between September 5 and 8.Fifty percent of Palestinians believe that if the US presents a peace plan to resolve the conflict with Israel, the Palestinian leadership should dismiss it out of hand because “it must be bad for the Palestinians,” 31% favor reviewing the substance of the American plan before rejecting or accepting it, the poll also found.Only 14% of Palestinians said that if the US were to put forward a plan, their leadership should accept it “because it will certainly be better than the status quo,” according to the survey.US officials, including Jason Greenblatt — Trump’s special representative for international negotiations — have said that they have been working on a plan to resolve the Israeli-Palestinian conflict.When pollsters asked which party is responsible for the worsening conditions in the Gaza Strip, 43% of Palestinians said the PA, 24% answered Hamas, 8% responded Egypt and 17% stated “others.”The PA annually allocates hundreds of millions of dollars to Gaza, but for more than the past year and a half it has cut some of its budget for the Strip in an attempt to pressure Hamas to cede control of the coastal territory. Hamas took over Gaza in 2007 after ousting the Fatah-dominated PA. Israel and Egypt control the land and sea crossings between Gaza and the outside world and maintain a blockade that they say is meant to prevent Hamas — a terror group bent on destroying Israel — from expanding its military capabilities.Moreover, 62% of Palestinians said they want Abbas to resign, while 32% prefer that he stay in office, the poll also found, figures that are reminiscent of a PCPSR poll conducted in late June and early July.In addition to PA president, Abbas, 83, also holds the titles of PLO chairman and Fatah chief.In presidential elections with only Abbas and Hamas politburo chief Ismail Haniyeh on the ballot, 47% said the would vote for the former and 45% for the latter. Israel for the first time is among a handful of major global exporters that are strictly enforcing a worldwide pact against foreign bribery, a report published Wednesday by watchdog Transparency International found.TI charged that 22 countries — accounting for 39.6 percent of global exports — practice “little or no enforcement” of the Organisation for Economic Co-operation and Development’s (OECD) 1997 Anti-Bribery Convention, which requires signatories to criminalize bribery of foreign public officials.The list of slackers includes non-signatories like China and India, but also members of the pact such as Mexico, Japan or Finland.That compares to just seven countries, weighing in at 27% of global exports — the United States, Germany, the UK, Italy, Switzerland, Norway and Israel — classed as “active” enforcers of the agreement, the highest rating.Since TI’s last report in 2015, eight countries improved their level of enforcement, with Israel shooting from the lowest to the highest bracket as it successfully concluded its first-ever foreign bribery case and opened a slew of new ones.In December 2016, the Tel Aviv Magistrate’s Court charged Israeli security company NIP Global of bribing a government official in Lesotho, and levied a fine of NIS 4.5 million ($1.15 million) on the firm.State prosecutor Jonathan Tadmor at the time said the first-ever ruling against an Israeli company operating abroad sent a message that the country was dedicated to “fight[ing] against economic delinquency and the phenomenon of corruption worldwide.”Later that year, Israel arrested diamond-mining magnate Beny Steinmetz on suspicion of money laundering and bribing public officials in Africa, but he was later released. Authorities in the US, Switzerland, Guinea and Israel suspected that Steinmetz bribed the president of Guinea and his wife for metal mining licenses that generated hundreds of millions of dollars in profits for his company, BSGR Resources.In 2018, the Israel Police opened investigations into two Israeli companies operating in Africa over suspicions that they had bribed local government officials to advance business interests.Police’s Lahav 433 anti-corruption unit and the Israel Tax Authority are also investigating senior officials from Israel Shipyards who are suspected of bribing a Nigerian public servant to ensure the shipbuilder won defense tenders worth tens of millions of dollars.Lahav 433 is also investigating construction company Shikun & Binui, whose senior executives are suspected of having paid millions of dollars to African government officials to advance their construction projects there.The Transparency International report also found that four countries slid back in the classification, while China — rated for the first time — entered at the lowest level.“The convention’s fundamental goal of creating a corruption-free level playing field is still far from being achieved, due to insufficient enforcement,” the authors wrote.As the world’s doughtiest exporter at 10.8% of the global total, they singled out China as a country with “special responsibility.”“China’s performance regarding international anti-corruption standards influences attitudes and behavior in other major exporting countries,” the authors wrote.AFP contributed to this report.

BRUSSELS (AP) — European Union lawmakers voted on Wednesday to launch action against the Hungarian government of Prime Minister Viktor Orban for allegedly undermining the bloc’s democratic values and rule of law. Hungary called the vote fraudulent and vowed to challenge it.The lawmakers voted 448-197 in favor of a report recommending the launch of a so-called Article 7 procedure, which could lead to the suspension of Hungary’s European Union voting rights.It was the first time in EU history that the European Parliament had initiated and approved such a motion, which needed a two-thirds majority to pass and was approved by 69.4 percent of the lawmakers.For years, Orban had been able to deflect much of the international condemnation thrown his way. Critics say that Hungary’s electoral system is disproportionate; media freedoms and judicial independence are dwindling; asylum-seekers and refugees are mistreated and there are limits placed on non-governmental organizations.Hungarian Foreign Minister Peter Szijjarto, echoing Orban’s longtime position, called the Wednesday’s vote “petty revenge” against Hungary for its tough anti-migration policies.He also claimed that the vote involved “massive fraud” since abstentions weren’t counted into the final tally, which made it easier to reach the needed majority.There were 48 abstentions, so the 448 in favor exceeded the two-thirds needed only because it was based on 645 votes. If the abstentions were counted into the final tally, there would have been a total 693 votes, so the 448 in favor wouldn’t have reached two-thirds.Szijjarto said Hungary was considering legal options to appeal the result because of the way the vote was tallied.But Judith Sargentini, who presented the report prepared by the European Parliament’s Committee on Civil Liberties, Justice and Home Affairs, welcomed the outcome.“Viktor Orban’s government has been leading the charge against European values by silencing independent media, replacing critical judges, and putting academia on a leash,” Sargentini said. “The Hungarian people deserve better. They deserve freedom of speech, non-discrimination, tolerance, justice and equality, all of which are enshrined in the European treaties.”“This is a historic result for Hungarian citizens and for European citizens everywhere, that the European Parliament has voted by a large majority to stand up for the values we all hold dear,” Sargentini said.The move saw some members of the European People’s Party bloc — of which Orban’s Fidesz movement is a member — vote against their ally in Budapest.Even EPP leader Mandred Weber, who earlier was supportive of Orban and is seeking to become the European Commission president next year, said he had voted for triggering Article 7.“I have always been in favor of building bridges and I want to continue to do so, but yesterday (Tuesday) I didn’t see any readiness from the Hungarian PM to make a move towards his EU partners and address our concerns,” Manfred tweeted.While Weber had called on Orban to show a willingness to compromise on some of the most high-profile issues — like an agreement being delayed by the Hungarian government for the Central European University, founded by George Soros, Orban’s ideological opponent, to remain in Budapest and recent laws criminalizing the work of civic groups working with asylum-seekers and refugees — Orban remained steadfast that his policies wouldn’t change.“I have nothing to compromise about since the questions they objected to were decided by the Hungarian people,” Orban said Tuesday in Strasbourg, France, after the debate in the European Parliament on the report on Hungary. “There is nothing to talk about.”Orban, who was re-elected in April to his third consecutive term in office, fourth overall also said Tuesday that he expected lawmakers to approve the motion with the support of some EPP lawmakers.“The order has arrived from Berlin and they will vote accordingly,” Orban said, in reference to German Chancellor Angela Merkel, whose governing Christian Democratic Union is the largest party in the EPP.Orban has insisted that all of the criticism against his government is based on Hungary’s tough anti-immigration policies, which include fences built in 2015 on Hungary’s southern borders with Serbian and Croatia to divert the flow of migrants and very restrictive asylum rules. He has also expressed his desire to remain within the EPP, which he said was “deeply divided” on the issue of migration.

The European Commission is to propose new laws giving internet companies only one hour after it is reported to remove extremist content or face fines, its president said Wednesday.Google, Facebook, Twitter and other companies were warned in March that if they didn’t speed up their removal of such content they would face legislation forcing them to do so, but regulators have not seen enough progress being made, Commission President Jean-Claude Juncker said in his annual state of the union speech.He said that the Commission will propose that any content which incites or encourages terrorism must be removed within an hour. Companies that repeatedly fail to comply may be fined up to four percent of their annual global turnover.The proposed legislation still requires backing from the member nations of the European Union and from the European Parliament.Juncker also said he wants internet firms to be more transparent, and provide annual reports showing their efforts to tackle extremism.Israel has long accused Facebook of facilitating Palestinian incitement against Israelis, especially following a wave of hundreds of attacks that began in October 2015, which security services said was fueled by online incitement.Earlier this year, Israel almost passed the so-called Facebook bill, which would allow the state to seek court orders to force the social media giant to remove certain content based on police recommendations. However it was pulled at the last moment due to its overreaching language, which would have led to one of the strictest censorship policies in the world.The government had said the bill would only be invoked in cases of suspected incitement, where there is a real possibility that the material in question endangers the public or national security.Additionally, in April, families of five Americans murdered or injured in recent Palestinian terror attacks in Israel filed a billion-dollar lawsuit against Facebook for failing to ban the Gaza-based terror group Hamas from using its social media platform.“Facebook has knowingly provided material support and resources to Hamas in the form of Facebook’s online social media network platform and communication services,” a press release issued by the plaintiffs said. “Hamas has used and relied on Facebook’s online social network platform and communications services as among its most important tools to facilitate and carry out its terrorist activity.”Facebook has in the past dismissed an Israeli government claim that Facebook founder Mark Zuckerberg had “some of the blood” of an Israeli terror victim on his hands, because the platform did not censor Palestinian incitement and hate speech.In a 2016 Hebrew-language statement, the company asserted that it works “on a regular basis with security organizations and policy makers throughout the world, including in Israel, in order to ensure that people know how to use Facebook safely.“There is no room on our platform for content that encourages violence, direct threats, terror or verbal abuse. We have an array of clear-cut community guidelines meant to help people understand what is permitted on Facebook, and we call on people to make use of our reporting tools if they come across content that they believe violates these guidelines, so that we can evaluate each incident and take swift action,” Facebook said.

Doug Ford's use of notwithstanding clause sparks fears it will embolden others to invoke it-[CBC]-YAHOONEWS-September 13, 2018

When Pierre Trudeau's cabinet met to debate the inclusion of the notwithstanding clause in the Constitution nearly 40 years ago, there was a significant minority who argued that political leaders would always be tempted to use it. But "the optimists" in the room thought it would be used rarely yet judiciously — that premiers would be constrained by their reluctance to overturn fundamental rights, according to the former prime minister's principal secretary. "And by and large, that has occurred. Until Ford," said Tom Axworthy, who advised Trudeau during the Constitution consultations. Now Axworthy fears that Ontario Premier Doug Ford's promise to invoke the clause — for the first time in the province — may put more pressure on other governments to use it.  "The worry is now, with Ontario announcing this, that this will embolden, if not premiers, lots of other activists on lots of other issues who don't like this [or that] particular court ruling … they'll start saying: 'Let's use the notwithstanding clause. Doug Ford did," he said.-'Legitimate concern'-It's a fear shared by constitutional expert Wayne MacKay, professor emeritus of law at Dalhousie University. In an era of of populist politicians, using the notwithstanding clause may no longer be considered politically dangerous, MacKay said. "[It's] maybe going to be seen as a politically good thing to do — that maybe you're not going to, as traditionally viewed, lose votes by setting aside the charter," he said. "I think it is a legitimate concern, because of the odd times in which we live in, in terms of people like Trump and others, who are able to appeal to a certain segment of the population that aren't necessarily very rights-focused." Ford announced Monday that he would take the rare step of invoking Section 33 of the Canadian Charter of Rights and Freedoms after an Ontario Superior Court judge ruled that his provincial government's legislation to cut the number of Toronto city councillors was unconstitutional.  Section 33 — known as the notwithstanding clause — allows for premiers or prime ministers to override rulings on legislation that judges have determined would violate sections of the charter for a five-year period. Pierre Trudeau opposed the clause, but reluctantly acquiesced to its inclusion in order to get a deal on the Constitution Act of 1982, which wrested control of Canada's Constitution from Britain.Used 15 times before-Political leaders have generally been reluctant to use the notwithstanding clause, which is viewed by many as politically toxic. It's been invoked more than 15 times, and mostly in Quebec, which included it in every piece of legislation from 1982 to 1985 as form of political protest. "The perception is that when you invoke the notwithstanding clause, you've decided to prioritize political expediency over rights," said Vanessa MacDonnell, a constitutional law expert and associate professor at the University of Ottawa. "That's the dominant feeling people have, which is why it really hasn't been used much. So it's exceptional that Ford has said that he intends to use it." The convention has been that it only be used "on the most important possible issues imaginable after a very fair process of debate," said Axworthy, a distinguished fellow at the Munk School of Global Affairs and chair of Public Policy at Massey College.Some premiers, such as Alberta's Ralph Klein, have been tempted to use the clause on social issues such as same-sex marriage, he said, but no one has carried through. "I could not have foreseen it being imposed, in my worst nightmares, over an issue like the size of a council for Toronto," Axworthy said. MacKay, who isn't opposed to the use of the clause, agreed that it was meant for issues such as the War Measures Act, language, or those of political and cultural significance. "I can't imagine in the complex, lengthy constitutional negotiations that there was a single person who thought, 'Gee, maybe they'll want to change the number of city councillors. So let's have this clause just in case.'"Fears unfounded-But Emmett Macfarlane, an associate professor of political science at the University of Waterloo, who also specializes in the charter, said the clause has already been used in ways not anticipated by its framers — including Quebec's early, pre-emptive implementation of it before challenges had come up in court. And despite Ford's pledge to invoke the clause, Macfarlane said he expects politicians will continue to be shy about using it "precisely because of the backlash we've seen."  The topic has generated mostly "the sky is falling" media coverage, he said, meaning the average voter will likely have a negative view of its implementation. "The dominant narrative with the notwithstanding clause is that it overrides rights — that's not going to make it popular. So I'd be surprised if we saw the floodgates open outside of Ontario," he said. MacDonnell said there hasn't been enough time to process the public reaction to Ford's actions and whether he will take a political hit. "I would be shocked if we saw the proliferation of the notwithstanding clause by other governments as a result of this. I think Ford's an outlier," she said.  But if Ford, as he suggested Monday, begins using the clause routinely, it could "shift the expectations a little bit and that opens the door to its use by others," MacDonnell said.

Court gives anti-abortion group another shot at placing ads on Metro Vancouver transit-[CBC]-YAHOONEWS-September 13, 2018

B.C.'s highest court has ordered TransLink to reconsider its decision to deny advertising space to an anti-abortion group that wanted to post graphic ads including images of fetuses on Metro Vancouver buses. The transit authority turned down the Canadian Centre for Bio-Ethical Reform's proposed ads proclaiming "Abortion kills children" in 2015, a decision that was upheld in B.C. Supreme Court last year. But on Tuesday, a panel of three justices at the B.C. Court of Appeal overturned that decision, saying the TransLink official who rejected the ad did not provide a good enough explanation for why he did so. "In denying the CCBR's advertisement request, [the official] did not acknowledge the CCBR's right to freedom of expression, let alone explain how the denial represents a proportionate balance with TransLink's objectives," Justice David Frankel wrote in the unanimous appeal court judgment. Frankel said the request to purchase advertising space should be remitted to TransLink for reconsideration.-Ads in 'questionable taste'-The proposed ads from the Calgary-based group purported to show images of fetuses at seven and 16 weeks' gestation, along with the website address, "endthekilling.ca." Lamar Transit Advertising, which manages ads for TransLink, has said it originally turned down the request for space because of a policy barring materials that are "of questionable taste or in any way offensive." TransLink also consulted Advertising Standards Canada, which said it had concerns about the accuracy of the ads, particularly the suggestion that abortion kills actual children and the false implication that most abortions are performed after 16 weeks, according to court documents. During court hearings on the matter, the transit authority argued that the ads might cause psychological harm to women and children. But when TransLink's then-director of customer engagement and marketing, John Beaudoin, emailed CCBR with the final refusal, he "provided no insight whatsoever into why he found the CCBR's advertisement unacceptable," Frankel wrote. The appeal court also rejected a cross-appeal from TransLink, asking the judges to consider an affidavit rejected by the B.C. Supreme Court from Dr. Wendy V. Norman, a family physician and professor at UBC's Faculty of Medicine. Norman reviewed the proposed ads and said the images of fetuses were not accurate, according to the appeal court justice. She wrote that the photo labelled as seven weeks' gestation "appears to be a fanciful amalgam" and the 16-week image falsely included eyelashes, eyebrow hair, eyelids that open and "pudginess" — features more typical for a fetus at 26-40 weeks. Frankel wrote that it was out of the appeal court's jurisdiction to consider TransLink's appeal.

VATICAN CITY (Reuters) - Pope Francis will meet on Thursday with U.S. Catholic Church leaders who want to discuss the fallout from a scandal involving a former American cardinal and demands from an archbishop that the pontiff step down.Cardinal Daniel DiNardo, president of the U.S. Conference of Catholic Bishops (USCCB), asked for the meeting after Archbishop Carlo Maria Vigano last month accused the pope of knowing for years about sexual misconduct by former Cardinal Theodore McCarrick and of doing nothing about it.The Vatican said in a statement the pope would meet on Thursday with DiNardo, Cardinal Sean Patrick O'Malley of Boston, and two USCCB officials.In the 11-page statement published on Aug. 26, Vigano, the former Vatican ambassador to Washington, launched an unprecedented broadside by a Church insider against the pope and a long list of Vatican and U.S. Church officials.DiNardo has said Vigano's accusations "deserve answers that are conclusive and based on evidence".The accusations shook the U.S. Church, following a damning Grand Jury report in the state of Pennsylvania that found that 301 priests in the state had sexually abused minors over the past 70 years.Di Nardo has called for the Vatican to help with an investigation into how McCarrick could have risen steadily through the ranks of the U.S. Church although many people knew that he had engaged for years in sexual misconduct with adult male seminarians.(Reporting by Philip Pullella, Editing by Angus MacSwan)

HOUSTON (Reuters) - A tropical storm may form off the Texas Gulf Coast by Friday, bringing heavy rains to areas already drenched in the past few weeks, U.S. government and private forecasters said on Tuesday.The U.S. National Hurricane Center said a tropical wave on the north coast of the Yucatan Peninsula of Mexico had a 70 percent chance of becoming a tropical cyclone within five days.The United States is already bracing for Hurricane Florence, a major Category 4 hurricane expected to make landfall on the U.S. East Coast on Friday, bringing high winds and days of heavy rains.Over 45 percent of U.S. oil refining capacity is located along the Gulf Coast from Corpus Christi, Texas, to Pascagoula, Mississippi, along with 51 percent of the nation's natural gas processing capacity, according to the U.S. Energy Information Administration.Satellite images show a disorganized but developing system, said Dan Kottlowski, lead hurricane forecaster for Accuweather Inc. A Palestinian man who killed an Israeli woman when he hit her with his car on a West Bank road was indicted Wednesday for a hit-and-run, ruling out speculations of a terror motive in the incident.The death of Hava Roizen last month was initially reported as a possible car-ramming attack, though police said at the time that it was more likely to have been an accident.The indictment against Kamal Kadari, 60, was filed at the IDF’s Samaria Military Court, charging him with negligent homicide and abandoning the scene of an accident, the Kan public radio broadcaster reported.Kadari, who turned himself in to the Palestinian Authority police after the incident, remains in PA custody.The charges were based on a police assessment of the incident that found that Roizen had crossed the road at a point where there was no crosswalk.Kadari, who had five passengers in his car at the time, did not notice the Israeli woman in the road, the report said.Roizen was struck by the vehicle on Route 60, near the Havat Gilad outpost in the northern West Bank. She was declared dead by the Magen David Adom ambulance service after paramedics were unable to resuscitate her.Kadari fled the scene and was later spotted near the Palestinian village of Jit, where he gave himself up to PA police.A senior PA official told The Times of Israel last month that Kadari insisted what happened had been an accident and not an attack. The official added that he would remain in the custody of the PA police and would be dealt with by the PA judicial system.Israeli authorities file charges against Palestinians accused of harming Israelis even if the suspects are still in PA police custody.Roizen was a resident of the small ultra-Orthodox settlement of Emmanuel.
