BRUSSELS - European Union leaders have endorsed a series of rules tightening budget surveillance and institutionalising limits on public spending - the fiscal compact that the European Central Bank (ECB) has demanded before it can more aggressively purchase Italian and Spanish debt.We agreed today on a new fiscal compact and on significantly stronger coordination of economic policies in areas of common interest,reads a statement by the premiers and presidents of countries that use the euro and contained in a wider draft concluding document from all 27 EU leaders and seen by EUobserver.Last week, speaking before the European Parliament, ECB chief Mario Draghi had hinted that the central bank could begin to intervene more robustly in the market if a fiscal compact was reached at the EU summit.All EU leaders, including from states that do not employ the single currency such as the UK and Denmark, said that they have endorsed the decisions taken by the euro area.But employing language stressing the unity of the bloc as a whole, they said: The European Council is determined to preserve the integrity of the EU and the coherence between the euro area and the EU as a whole.States outside not using the single currency have been worried that as deeper integration proceeds apace in the eurozone, decisions affecting all 27 countries will be agreed by the smaller grouping and delivered as faits accomplis to the wider EU.Key to a new legal framework governing the compact will be a golden rule enforcing balanced budgets that must be inscribed in domestic constitutions or at an equivalent level.

Governments will be deemed to have achieved balanced budgets so long as deficits do not exceed 0.5 percent of GDP and the rules will have to include automatic correction mechanisms.The European Court of Justice would be tasked with ensuring that this golden rule is transposed into national law, a watering down of previous proposals by Berlin.For those countries that breach existing EU rules forbidding deficits exceeding three percent of GDP, there would now be automatic consequences unless a qualified majority of states decided otherwise.The eurozone leaders also endorsed new rules proposed by the European Commission on 23 November that give the EU executive far-reaching new powers over domestic fiscal policy decision-making.
Under the proposals, almost all fiscal policy-making would be taken out of the hands of national assemblies and delivered up to European civil servants.Governments in member states that use the single currency would be obliged to submit their budgets to both the commission and the eurogroup of states for vetting - before they are submitted to their own national parliaments.

If the commission does not like what it sees, it can demand changes to the budget, as well as other mid-term plans a government may have for its economy.Those countries that have exceeded EU rules on the size of their debt and deficit would also be subject to tighter monitoring by Brussels and would have to submit regular reports on how they are progressing in trying to correct the situation.The commission would be able to issue recommendations for how this should be done.All eurozone states would also be forced to create independent fiscal councils - bodies of experts unaccountable to parliaments - who would issue budgetary and economic forecasts. A country's budget would in turn have to be based on the reports of these fiscal councils.For countries in deeper troubles and facing serious financial difficulties, Brussels could send teams of inspectors - akin to the Troika monitors sent to member states that have received bail-outs.The overseers could be sent to any state that the commission decides, even if the county has not requested any international assistance.The commission would also be given the power to recommend to the Council of Ministers, representing the member states, that a country should take a bail-out.For the longer term, we will continue to work on how to further deepen fiscal integration, the eurozone leaders say in the draft statement.This will imply more intrusive control of the national budgetary stance by the EU, they continue.Additionally, the draft statement mentions the possibility of moving towards common debt issuance in the longer term and in a staged and criteria-based process, a reference to the establishment of so-called eurobonds, long opposed by Berlin.EU Council President Herman Van Rompuy is to produce a report on such further moves in March next year, a document that is also to tackle the thorny question of relations between the euro-area and the broader EU.

BRUSSELS - EU leaders are discussing an increase of Europe's contribution to the International Monetary Fund by €150 billion, which in turn could be used to rescue troubled euro-countries.Germany does not want the future fund to run in parallel with the current one (Photo: Stephanie Jones)Central banks in the 17 states of the eurozone may increase their contribution to the IMF by a total of €150 billion, a senior EU official told reporters in Brussels under condition of anonymity. Another €50 billion may come from other non-eurozone countries, the source added.Half the sum would go to troubled eurozone countries while the other €100 billion would be made available to rescue programmes all around the world.The IMF solution is intended circumvent opposition from Germany and the European Central Bank to the latter intervening directly to assist countries such as Italy and Spain, the third and fourth largest economies in the euro area.Speaking to reporters on his way into the meeting, Swedish Prime Minister Fredrik Reinfeldt said his country - a non-euro member - is absolutely in favour of the IMF solution, because markets have huge confidence in the well-established financial institution. It should be part of the solution, alongside the eurozone rescue mechanisms (EFSF/ESM),he added.Danish leader Helle Thorning-Schmidt told EUobserver that her country, which also lies outside the single currency, will contribute 40 billion kroner, or €5.3 billion, to the IMF as well. She said her government had already told the national central bank to be ready. For us it is a gesture. We want to show we take our responsibility seriously, the prime minister said.

Leaders at the two-day summit are also trying to overcome German resistance to lifting a €500 billion cap on lending from the existing and future bail-out funds for the eurozone. Berlin has agreed to advancing by one year the bigger and permanent bail-out fund (ESM), which should have come into being mid-2013, but is adamantly opposed to the fund being awarded a banking licence. We think that would be going in a completely wrong direction,one senior German official told media on Wednesday.The official confirmed that talks on how to boost the IMF's lending power were ongoing, but dampened expectations that a deal would be reached over the weekend.The legal wrangling about about a possible EU treaty change demanded by Germany on deficit sanctions and rules have somewhat overshadowed ongoing talks on how best to use bail-out mechanisms and the IMF in saving the euro.Efforts to boost the current bail-out fund, the European Financial Stability Facility, a €440 billion patchwork of loan guarantees as the German official put it, flopped last month after EU leaders failed to attract the hoped-for scale of investment from countries such China and Brazil.The permanent fund (ESM), agreed upon last year when it became clear that the EFSF was insufficient, is still pending ratification in all 17 eurozone countries - a process leaders hope to fast-track.But the Slovak experience, with its government collapsing earlier this year over the ratification of the law just enabling the ESM to be set up, indicates what hurdles still lay ahead.

ECB cuts rates, defies expectations

As EU leaders headed into a crunch summit, the European Central Bank cut interest rates and introduced a range of measures to aid Europe’s troubled banking system, but defied hopes that the institution would aggressively expand its government bond-buying programme.The ECB unveiled a quarter-point cut to its rate, down to one percent.As banks have increasingly been closed off from funding from each other and other sources, the sector has become addicted to liquidity provided by the central bank. However, fears have grown that they may be reaching the limit of what they can provide as collateral.Responding to the problem, the ECB has now relaxed what it will accept as collateral against loans to banks.In another move intended to ease the pressure on the sector, the ECB reduced the ratio of deposits the banks must park with national central banks from two percent to one percent.However, the bank made no moves to boost its purchase of government debt in Italy and Spain, a development bank chief Mario Draghi hinted at last week when speaking the European Parliament.Separately, the European Banking Authority announced the results of a fresh round of stress tests of the continent’s financial institutions, declaring that some 30 banks across 12 countries out of 71 tested, must recapitalise themselves to the tune of €114.7 billion by next June.Spanish banks - hit by the worst funding shortfalls - must fill gaps totalling €26.2 billion, followed by Italian banks, which must plug a hole of €15.4 billion.In Germany meanwhile, banks face a gap of €13.1 billion, a substantial increase on the €5 billion shortfall the EBA estimated in October.

BRUSSELS - The Franco-German powerhouse at the heart of the EU has proposed a series of sweeping changes to the bloc's institutional set-up in an effort to bring an end to the eurozone crisis that has laid low European economies and threatened the survival of the Union.German Chancellor Angela Merkel and French President Nicolas Sarkosy in a joint letter to EU Council President Herman van Rompuy delivered on the details of what they agreed last week must be altered in the eurozone.The current crisis has clearly demonstrated the shortcomings of the architecture of EMU [European Monetary Union]. We must address these deficiencies,the two write.We believe that we need to strengthen the architecture of the economic and monetary union by going beyond the necessary measures that are urgently needed for the immediate settlement of the crisis, they continue.These measures should be taken without delay. We believe that this is essential for the credibility and confidence in the future of economic and monetary union.The two are looking to a treaty change to achieve the reconstruction of the single currency area, to be agreed on Thursday (8 December) at an EU summit in Brussels and approved as soon as March next year.

If it is not possible for all 27 EU member states to agree on the changes, they warn that the 17 members of the eurozone must forge ahead without them.The core of the proposals would see a new framework of tough rules on fiscal policy that would enforce a limit to national budget deficits of three percent as a proportion of gross domestic product.This maximum would be backed up by automatic penalties that could be imposed on eurozone states.Such budget limits should in turn be inscribed in national legislation - a golden rule - setting in stone balanced budgets.The two leaders also said they wanted to see regular eurozone summits at least twice a year, and monthly for as long as the crisis lasts.The duo want to see the implementation of the bloc's permanent rescue fund, the European Stability Mechanism brought forward to 2012 - a year earlier than originally planned.And, in a move that is already being opposed by some smaller member states, Merkel and Sarkozy also want to see management of the bail-out funds streamlined by moving from unanimity to majority-based approval of decisions.Both also make clear that private-sector involvement in rescues will be strictly limited to Greece and that no such write-downs would occur with any other states whose solvency is in question.
Rounding out the changes to the bloc's set-up, France and Germany want to see a convergence of labour-market regulation and a harmonisation of the corporate tax base.The pair also backed the introduction of a financial transactions tax across Europe.

Montenegro and Serbia fail to get EU candidate status

BRUSSELS - Leaders are to grant Serbia EU candidate status in March 2012 provided it steps up talks with Kosovo, while Montenegro's membership talks will start in June pending a crackdown on corruption and crime.EU enlargement is slowing down as the bloc struggles with the economic crisis (Photo: European Commission)With a view to granting Serbia the status of candidate country by March 2012, EU leaders ask for more progress in talks with Kosovo, according to draft conclusions seen by EUobserver.Serbia had hoped to be given candidate status at this EU summit after earlier this year handing over top war crimes suspects to The Hague and last week agreeing to joint customs and immigrations checks with Kosovo.But Germany - backed by Austria, Denmark, Finland and the UK - said the Kosovo deal was too little, too late after Kosovar Serbs injured Austrian and German Nato soldiers with live ammunition and rocks last week.The three other if-s attached in the EU draft conclusions - implementation in good faith of the customs deal, inclusive regional co-operation and allowing EU police and Nato troops to execute their mandate in north Kosovo - indicate that even the March date is not set in stone.It won't happen if they start shooting German troops again, one senior EU official told this website on condition of anonymity.

The March date is important because Serbian President Boris Tadic - the EU's biggest ally in Belgrade - faces parliamentary elections in May.For his part, Nato chief Anders Fogh Rasmussen earlier this week said Serbia should get status this year.But a senior Nato official at the same press breifing in Brussels said people do not buy Serbia's line that it does not control the north Kosovo militants.We welcome President Tadic's call on the Serbs to remove the blockade and we want to see that happening. Serbia still has links in this part of the world, we would appreciate its help to restore freedom of movement,the official said.Meanwhile, Montenegro - which split from Serbia in 2006 but, unlike Kosovo, is recognised by Belgrade as an independent country - will start EU membership talks in June 2012, the draft conclusions said.The EU leaders noted it still has work to do on tackling organised crime and corruption.A special report by the European Commission in the first half of 2012 will also looking at how the new country protects fundamental rights and guarantees the independence of its judiciary.

Stop criticising Merkel, Danish PM says

BRUSSELS - With Denmark taking over the EU presidency in January PM Helle Thorning-Schmidt has said she will fight to make sure that fellow non-eurozone countries are involved in all discussions concerning the internal market, as the eurozone crisis drives a potentially major wedge between those in and outside the single currency.I have no problems understanding that the 17 need to discuss certain things themselves. I think that is natural. But when we are discussing things that concern the internal market, we should all 27 be around the table, she told EUobserver ahead of a key summit of EU leaders.She added that she would have huge difficulty understanding if the 10 non-euro states were excluded from general issue debates.

Thorning-Schmidt's comments come as a Franco-German paper, feeding discussions in the summit, suggests that eurozone countries should meet once a month during the crisis to discuss competitiveness and growth issues - topics that non-euro states believe pertain to the EU club as a whole.The split between the Ins and the Outs, as they are colloquially known, has deepened alongside the eurozone crisis.While single currency countries, led by France and Germany, are pressing ahead with tightening economic governance rules, non-euro countries are worried that they will have no control over decisions that could potentially affect the single market.The rift has seen the non-euro states conduct their own meetings in parallel to eurozone meetings.
It is very important in a time of crisis that we stick to the 27 member states, our common method, our acquis [EU laws] - all the things that we have built up over the years,said Thorning-Schmidt.The Danish premier refused to criticise Berlin’s leadership in the crisis, despite the fact that Germany’s approach has raised hackles in some quarters both on substance and style.Anyone who criticises Chancellor Merkel for taking too much responsibility would have to see the opposite situation where Germany did not take that kind of responsibility, she said.With most member states considered reluctant to open the EU treaty to enshrine tighter budgetary surveillance, Thorning-Schmidt gave unequivocal backing to the idea.We can accept treaty change. We want to discuss with our partners what kind of treaty change is needed.She also indicated she supported a full-blown negotiation process, involving MEPs and MPs, so long as it is limited in time and scope.The reason why we involve the European Parliament is because we want to have a widespread European debate about these treaty changes.

Any treaty change would not see Denmark attempt to change its policy on the euro, however. We have an opt out on the euro and we are not intending to put that to the vote, she said.Highlighting the constructive role that non-eurozone countries can play, Thorning-Schmidt said Denmark's central bank would be stumping up €5.3 billion to the EU's contribution to the International Monetary Fund.For us, this is a gesture as well. We want to show that we are taking our responsibility seriously. I come here today with not only our backing of our central bank being involved but also a positive attitude towards treaty change.Aware that treaty talk can take over EU discussion to the exclusion of everything else, Thorning-Schmidt pledged to keep the Danish presidency focused on more concrete policy issues too.We will deal with the crisis, but we will also try and take some solid decisions for Europe,she said, referring particularly to Copenhagen's focus on green growth.

OUTSTANDING!! I just left my neighbors house. Devon is with the National Guard for this area. He just got home from a EDRE (emergency deployment readiness exercise) at the armory. He said that during the exercise 3 companies of infantry were polled by questionare about the drill and it’s purpose. One of the questions was, will you as a member of the Nat. Guard use lethal force against the American public if ordered to do so? One of the men stepped forward and refused to take the poll and explained that it was a moral judgement on his part and that he could not do so. He then placed his weapon on the ground and fell in behind the formation. Devon said it was like a waterfall, Every member layed their weapons on the deck and fell in beside the one lone specialist. This included ALL NCO’s, STAFF NCO’s and SENIOR NCO’s. The only people left in front of the original formation was 3 Capt’s. 2 Lt’s and the BN Commander who was so upset he started having chest pains from yelling and screaming about court martials and disbandment of the unit into other units. Devon is a Mstr.Sgt and he went with his troops and told them that he could not be prouder of any of them. He was floating while he was telling me this. Maybe we have more than just hope on our side. I just heard from Devon. He was TX’d by his Plt LDR and advised that the Specialist Who first layed down his weapon is being held in county jail by the Bn CMDR, awaiting a hearing under the UCMJ. Devon couldn’t get any more info than that. I don’t want to post the mans name until we have more information. I am so upset by this that I am having chest pains. How can they do this to one soldier and not them all. I will let you know how things go. Think I might go lay down for a bit. SEMPER FI.Gary Greene-That is great, sort of, to hear. NOTE FROM STEWART RHODES:Again, this is unconfirmed, and we are working on confirming it. Please keep that in mind. But this is certainly the kind of mass, whole-unit stand-down that may well become necessary, especially in light of the treason of the US Senate, which voted 93-7 to authorize military detention and trial of U.S. citizens — claiming the power to apply the laws of war to the American people in the same way as they are used on a conquered, enemy population, like Iraq or Afghanistan. While National Guard units can, and have been used for riot control without violating their oath, we suspect that this survey was asking them about whether they would do something far worse than just keep the peace during riots. We will do our best to get to the bottom of this, and provide all details once confirmed.If accurate, this is reminiscent of the stand-down during Katrina by SSGT Joshua May’s Utah National Guard Unit, where the whole unit let their commander know, in a peremptory refusal, that they would not participate in any gun confiscation:

Corzine, the former Goldman Sach’s CEO, New Jersey governor, and boss of MF Global days before it went toes up and made off with $1.2 billion in customer money, is expected to say little or nothing and take the Fifth.Corzine has retained Andrew Levander, a hired high-powered white-collar criminal defense lawyer, the New York Post reported yesterday. Sources told the newspaper Levander advised Corzine not to tell his side of the story during the House grilling today.The former MF Global boss has apologized to customers swindled out of money.The MF Global implosion is the largest since the 2008 bankruptcy of Lehman Brothers, in part triggered by $6 billion in gambling on European sovereign debt.I simply do not know where the money is, or why the accounts have not been reconciled to date, he declared in a written statement. He said he was not sure if there were operational errors at MF Global or elsewhere, or whether banks and counterparties have held onto funds that should rightfully have been returned to MF Global.According to the Associated Press, Corzine will tell Congress he inherited a firm doomed by the risks his predecessors took. Since his resignation from MF Global, Corzine will argue, he hasn’t had access to certain information he might need to reconstruct the events that occurred during the chaotic days and the last hours leading up to the bankruptcy filing.

According to Gerald Celente and others swindled by MF Global, Corzine should be arrested, jailed, and put on trial like any other accused felon.Celente insists that Corzine is not in jail because he is busy holding 35 thousand dollars a plate dinners for Obama fund raisers… he was slated to be the new US treasury secretary after the brilliant Timothy Geithner left if Obama wins the next term.Earlier this year, Corzine was rumored as a possible replacement for the embattled Timothy Geithner at the Treasury.As Luke Matthews notes, it is not likely Corzine will ever see the inside of a prison cell. He is well connected politically and it is not likely the House or Senate will play hardball with him. Most of the recipients of $111,500 in contributions from Corzine and his relatives since he lost the 2009 election were national committees or U.S. Senate candidates in other states, including $1,000 to Sen. Amy Klobuchar, a Minnesota Democrat who voted to give the Senate Agriculture Committee the authority to subpoena Corzine.

BRUSSELS - Eurozone countries will have to give up on normal democracy and the European Central Bank (ECB) will have to print money if the euro is to survive, Turkey's ambassador to the EU has said on the eve of the EU summit.Noting that EU leaders are going in the right direction by proposing central control over national budgets in return for help from the ECB, Selim Kuneralp told EUobserver in an interview on Wednesday (7 December) that traditional democratic structures have no future in post-crisis Europe.In an election campaign, you have one party that says I'm going to reduce taxes and invest in this or that, to build nuclear power plants or spend money on renewable energy, build more schools and better hospitals. And the other party says I'm going to do everything this guy is promising, but more. So you have a race on who is going to spend more. But if you have this kind of mechanism [of central control] they won't be able to do it.That means you would have such a loss of sovereignty as to make election campaigns meaningless,he added.I don't see any other option - either you have a single currency with fiscal union or you don't have a single currency at all.With Germany in the driving seat on EU reforms, Kuneralp said German society has set a good example over the past 10 years by keeping wages low and making sure banks lend responsibly: They've been good boys. They've been Germans ... They are responsible people. In Greece, you can go to the bank and borrow money to go on holiday. In Germany you can only borrow money for some productive purpose.He noted that if EU institutions are in future to police national spending, they will have to do a better job than in the past, however.

Looking back to the Greek statistics fiasco in 2010, when Athens admitted to lying for years about debt and GDP, Kuneralp said EU officials must share the blame: When I talk to people in the commission, they say Well, you know, the Greeks lied and that was it. Well, they may have lied, but your job was to find them out. The commission were not doing their job properly and you need a mechanism that makes sure they do their job properly and expose liars and fiddlers.He added that Germany will have to drop its opposition to letting the ECB create money to prop up eurozone debt.Kuneralp pointed out that the US and the UK have done better than euro countries in the crisis by adding zeros to central bank reserves - $1.4 trillion in the case of the US, the equivalent of Turkey's GNP for two years.The Americans have added zeros to their ledgers and it has had no visible impact on inflation ... The lesson is that you can do it, he said. In the end, the Germans will have to move in the direction of more flexibilty and allow some buyback or some other instrument that is a euphemism for printing money ... You have to reduce your debt by having a little bit more inflation - you print your way out of this conundrum.The ambassador noted that while Turkish banks have almost no exposure to bad eurozone debt, the Turkish economy is at grave risk if the euro goes down - 50 percent of Turkish trade is with the Union, 80 percent of foreign investment and 70 percent of its tourist income also come from the bloc.We are not rejoicing. There's no schadenfreude. We're not saying: Oh well. IMF unlikely to play major role in eurozone rescue

BRUSSELS - Hopes that the International Monetary Fund will ride in on a white horse to save Europe are likely to be dashed, as key players on its board believe that while the Washington-based lender should play some role, the eurozone has enough resources to solve the crisis itself.IMF boss Lagarde is refusing to comment on eurozone issues in her public appearances (Photo: International Monetary Fund)US Treasury secretary Timothy Geithner said after a meeting with German finance minister Wolfgang Schaeuble in Frankfurt on Tuesday (6 December) that IMF will continue to be helpful but that the central role lies with the European Central Bank.

Of course it has a role to play,said the finance chief of the largest contributor to the IMF in brief comments to the press.The IMF exists in some ways for this purpose, he continued, but referred only those activities the fund has long been playing in the euro crisis.The IMF can play a very helpful role in terms of not just providing advice and design of reform programmes, but also to provide an independent objective public assessment of the progress countries are making in meeting those basic commitments.Reports from across the Atlantic suggest that the fund may be willing to chip in some extra financing but that the eurozone itself should be deploying its own resources.It is understood that the Americans, who contribute just under 18 percent of the IMF’s resources, have in recent weeks become more open to greater participation in any rescue, but still insist that substantial role for the IMF should be viewed strictly as a last resort.Heading into an election year, the Democrats do not want to be saddled with the accusation of committing still more public funds to bail-outs, but this time of other countries.Subsequently in Berlin, Geithner dismissed reports of the US Federal Reserve loaning $100 billion to the IMF in order to buttress eurozone economies,I would say the reports I've read in the press about what the Fed can do are not accurate,Geithner said.Additionally, it is understood that the UK, believing there to be sufficient funds in the eurozone to save the single currency, does not favour the use of IMF resources to top up the eurozone’s bail-out funds at a time when the likes of China have balked at bilateral involvement in these vehicles.There is no opposition in London however to calling on IMF monies for participation in potential bail-outs of more eurozone countries, but on a similar scale to the level of participation by the fund in the rescues of Greece, Ireland and Portugal.

Discussions amongst the world’s leading economies about deployment of IMF firepower were launched in early November, and European finance ministers considered the idea last week in Brussels.We ... agreed to rapidly explore an increase of the resources of the IMF through bilateral loans, following the mandate from the G20 Cannes summit, so that the IMF could adequately match the new firepower of the EFSF and co-operate even more closely, eurogroup chairman Jean-Claude Juncker told reporters after a meeting of eurozone finance ministers on 29 November.IMF boss Christine Lagarde is closely involved in discussions on the various crisis response options, although she is refusing to take questions on the eurozone crisis in her public appearances.Alongside a potential boost to the EU’s own firewall - likely via a convergence of both the existing, temporary eurozone rescue fund, the European Financial Stability Facility, and the permanent fund, the European Stability Mechanism, a combined sum amounting to some €940 billion, the IMF could then establish an additional war-chest or contribute to the eurozone pool.The very existence of this war-chest would be intended to send a message to investors that the world will not let eurozone countries go bankrupt.The problem is that the IMF, whose own resources amount to an available €290 billion, currently does not have the cash for such an exercise. Rome must roll over €300 billion next year and Madrid some €110 billion.So a boost to the IMF’s resources would first be required. One option would see the central banks of EU states or their governments themselves lend to the IMF, which could then deliver the cash back to troubled eurozone lands.

The advantage to this circuitous route of financing peripheral EU states would be that the strict conditionality the IMF could impose from outside.Moreover, if EU states were willing to stump up their own cash, they would be more likely to convince other countries to chip in.Brazilian officials have said in recent days that they are in the process of cobbling together just such a package finance.
Another option would be to access IMF special drawing rights, a sort of overdraft facility that all members of the fund can call upon that allows them to borrow from other member-countries’ foreign currency reserves.However, this would also need to be expanded sufficiently to address the scale of the eurozone threat - covering not just Italy and Spain, but also other potential costs resulting from bank bail-outs and countries in existing rescue programmes that could require additional assistance.
Once before, in 2009, at the London G20 summit, world leaders agreed to expand IMF SDRs to $250 billion.

BRUSSELS - The European Union may be able to winkle out of the fraught process of a full treaty change via a clever legal trick, EU Council President Herman van Rompuy has suggested.According to a two-page report from the Belgian EU chief submitted to national capitals on Tuesday (6 December), by amending a protocol attached to the Lisbon Treaty rather than changing the treaty itself, the lengthy and politically uncertain path of referendums and ratification by national parliaments can be avoided entirely.Instead, so long as EU leaders unanimously back a redrafting of a single protocol, the changes can be achieved almost instantly, following consultations with the European Central Bank and the European Parliament, both of which would be formalities.The article (Art. 126) in the treaty that deals with excessive deficits is fleshed out in a protocol attached to the legal text of the document but which remains separate from the treaty itself.This article also gives the premiers and presidents the ability to change the attached protocol without having to go through the normal procedures associated with a treaty change.The EU rulebook normally requires that ahead of any treaty change, a full intergovernmental convention be convened, involving national governments and the European Parliament, which last week issued a demand that any treaty change pushing through advanced economic integration be accompanied by deepening democratic controls at the EU level.

Some states, such as Ireland, would likely have to hold referendums over any further transfer of powers to the EU.Dublin is still smarting from an unexpected defeat in its 2007 referendum on the Lisbon Treaty, a defeat that was overturned the following year after the country was forced to re-run the referendum.The Irish government is convinced that another such referendum would be lost decisively in the current economic-political climate and at a time when the country has in effect abandoned sovereignty over fiscal policy to the EU and the IMF.Polls put opposition to a fresh treaty change on 48 percent in the country against 27 percent in favour.Whether Van Rompuy's trick will be sufficient to avoid triggering a referendum in the country remains an open question, depending on the scale of transfer of existing powers.

Some of the changes envisaged dovetail with those outlined in the past few days by France and Germany that push for deeper economic integration in the eurozone.Under the plan, the European Commission would be given the power to impose austerity directly on bail-out nations. Those states that flouted debt and deficit rules potentially could have their voting rights in the Council suspended.Member states would also introduce golden rules requiring balanced budgets into national legislation.The eurozone's rescue fund would be awarded a bank licence in order to borrow from the ECB and labour laws, while pension systems and other social protections would steadily be harmonised.Meanwhile, UK Prime Minister David Cameron has said that he will veto any new treaty if he does not win protections for the City of London, the British financial district.As long as we get those, then [a] treaty can go ahead. If we can't get those, it won't,he told the Press Association newswire in an interview.

BRUSSELS - The Franco-German powerhouse at the heart of the EU has proposed a series of sweeping changes to the bloc's institutional set-up in an effort to bring an end to the eurozone crisis that has laid low European economies and threatened the survival of the Union.German Chancellor Angela Merkel and French President Nicolas Sarkosy in a joint letter to EU Council President Herman van Rompuy delivered on the details of what they agreed last week must be altered in the eurozone.The current crisis has clearly demonstrated the shortcomings of the architecture of EMU [European Monetary Union]. We must address these deficiencies, the two write.We believe that we need to strengthen the architecture of the economic and monetary union by going beyond the necessary measures that are urgently needed for the immediate settlement of the crisis, they continue.These measures should be taken without delay. We believe that this is essential for the credibility and confidence in the future of economic and monetary union.The two are looking to a treaty change to achieve the reconstruction of the single currency area, to be agreed on Thursday (8 December) at an EU summit in Brussels and approved as soon as March next year.If it is not possible for all 27 EU member states to agree on the changes, they warn that the 17 members of the eurozone must forge ahead without them.The core of the proposals would see a new framework of tough rules on fiscal policy that would enforce a limit to national budget deficits of three percent as a proportion of gross domestic product.

This maximum would be backed up by automatic penalties that could be imposed on eurozone states.Such budget limits should in turn be inscribed in national legislation - a golden rule - setting in stone balanced budgets.The two leaders also said they wanted to see regular eurozone summits at least twice a year, and monthly for as long as the crisis lasts.The duo want to see the implementation of the bloc's permanent rescue fund, the European Stability Mechanism brought forward to 2012 - a year earlier than originally planned.And, in a move that is already being opposed by some smaller member states, Merkel and Sarkozy also want to see management of the bail-out funds streamlined by moving from unanimity to majority-based approval of decisions.Both also make clear that private-sector involvement in rescues will be strictly limited to Greece and that no such write-downs would occur with any other states whose solvency is in question.Rounding out the changes to the bloc's set-up, France and Germany want to see a convergence of labour-market regulation and a harmonisation of the corporate tax base.The pair also backed the introduction of a financial transactions tax across Europe.

EU to spend billions more on Arab revolutions

BRUSSELS - The European Commission aims to plough an extra €6.2 billion into EU neighbouring countries over the coming years, with the bulk of new resources to go to Arab revolutionaries.Neighbourhood commissioner Stefan Fuele and development commissioner Andris Pieblags unveiled the numbers at a briefing in the EU capital on Wednesday (7 December).

They said Brussels is to spend €61.8 billion in total on foreign policy in the 2014 to 2020 period. The figure includes €23.2 billion on third-world aid, €14.1 billion on helping EU accession candidates such as Turkey and €18.1 billion on promoting reforms in the ring of 16 neighbouring countries stretching from Morocco to Belarus that are not on track to join the bloc.If agreed by MEPs and member states, the new €18.1 billion budget line represents a big jump from the €12 billion neighbourhood fund covering the past seven years.Fuele called the shake-up A direct answer to the revolutionary movements to the south of the European Union ... to ensure the success of the transformation process and to improve social and economic development.The precise country-by-country split among the 16 remains to be worked out. BRUSSELS - US ratings agency Standard & Poor's (S&P) has warned it might lower the grade of all six triple-A eurozone countries if the upcoming EU summit does not deliver.The Wall-Street-based firm said on Monday (5 December) that a bad summit would hit the ratings of 15 eurozone economies, excluding Cyprus and Greece which already have rock-bottom levels. Five of the top-rated countries - Austria, Finland, Germany, Luxembourg and the Netherlands - might be cut by one notch, while France might go down by two.It lambasted the EU's handling of the crisis so far as slow and reluctant ... defensive and piecemeal.It noted the summit must deliver a greater pooling of fiscal resources and obligations as well as enhanced mutual budgetary oversight in order to give the European Central Bank the confidence to buy more weak bonds.It added that leaders must put forward growth ideas to stave off recession.A reform process based on a pillar of fiscal austerity alone risks becoming self-defeating ... eroding the revenue side of national budgets,it said.The S&P bombshell came shortly after France and Germany agreed to change the EU Treaty to enforce fiscal discipline.Berlin and Paris reacted to S&P with a communique saying they reaffirm that the proposals they made jointly today will reinforce the governance of the euro area in order to foster stability, competitiveness and growth.

BRUSSELS - German Chancellor Angela Merkel and French President Nicolas Sarkozy have endorsed an awkward compromise on the wielding of sanctions by the EU's top court against allegedly fiscally wayward governments.In what at first glance looks like a victory for the French leader, the pair made it very clear after their meeting in Paris on Monday (5 December) that the European Court of Justice cannot annul a national budget.However, the two leaders - which Brussels wags have collapsed into the portmanteau Merkozy for their choreographed efforts to steer the Union - did say the top court could assess whether national budgets have obeyed golden rules, namely new laws or constitutional constraints forbidding excessive deficits and debts.

Heading into the meeting, the Elysee had made it known that the favoured Merkel option, giving the ECJ the automatic power to impose sanctions on fiscal miscreants, was a step too far in terms of a transfer of national sovereignty to an unelected body.Berlin meanwhile believes that only a full 'fiscal union' - with budget discipline taken out of the hands of politicians - will be sufficient to calm the markets. The most automatic of options would involve the ECJ being the enforcer behind a new, economic super-commissioner who would supervise national budget-making processes.Monday's fudge allows Sarkozy to claim a victory for France, while under pressure ahead of presidential elections in 2012 both from the Socialist Party and a resurgent far right not to dilute national sovereignty.Merkel for her part still gets most of her way, with the court given most of the powers she was seeking.Such moves would require a change to the EU treaties, and indeed, the Franco-German duo also said that they back a new treaty, but said that while they would prefer to achieve one at the level of all 27 member states, they are willing to accept one amongst just the 17 states that use the single currency.Both routes are perilous.At the level of the full 27, changing the EU treaties will be an arduous and long process for which the markets likely do not have patience.However, at this level, the powers of sanction against excessive deficits would be more powerful, as they could be wielded by the commission and, potentially, the ECJ.At the level of the 17, the passage of such a treaty could be much faster, but new eurozone-level institutions that could impose sanctions would likely have to be constructed.

Either way, EU power-brokers would be faced with the likely resistance of citizens. After the debacle of the defeat of the European Constitutional Treaty at the hands of voters in France and the Netherlands, leaders agreed to never again put such decisions to the people. However, Ireland’s constitution requires such a plebiscite.
Having barely pushed through a second vote on the Lisbon Treaty in 2009 in the country, political elites on the island are loth to try their luck a third time, particularly when anger at the EU over the imposition of austerity on the country and supervision of ministries by the men and women from the EU-ECB-IMF troika.

Euro-bonds

Merkel appears to have won a much more clear-cut victory over the question of euro-bonds - the sharing of the issuance of government debt amongst the 17 eurozone states.Sarkozy, a known supporter of the idea, capitulated to Berlin's firm opposition, saying: Euro-bonds are in no way a solution to the crisis.While both the German government and the Frankfurt-based ECB have consistently opposed the idea of the central bank massively expanding its programme of the purchase of peripheral eurozone debt, last week, newly minted ECB chief Mario Draghi hinted that such a move could occur so long as a fiscal compact was put in place first.With France conceding on the question of automatic sanctions and a role for the ECJ, Berlin and Frankfurt are now in principle free to sign off on such central bank intervention.

One idea on the table would see the ECB lend funds to the International Monetary Fund, which in turn would pass on the funds to eurozone states. In this way, the ECB gets around rules that prevent the bank from acting as a lender of last resort and delivering support to governments directly.

US comes to town

Meanwhile, in an expression of the terror gripping Washington that the EU may not get its act together in the coming days, on Tuesday, US Treasury secretary Timothy Geithner travels to Germany, France and Italy for chats with the leaders of the three countries.The leaders of Europe’s right-wing parties, who dominate the capitals of Europe, then on Wednesday hold a pow-wow in Marseilles, offering another occasion for consideration of the way forward for Europe.Then on Thursday, ahead of a two-day EU summit beginning in the evening in Brussels, the ECB will hold its monthly meeting, where the world will be watching to see if the Franco-German plan is sufficient to convince it to open the taps.

He described the trend as something between a trickle and a flood.Richard Cookson, chief investment officer at Citigroup's private banking arm, which caters to clients worth more than $25 million, told the news agency he had seen clients shifting out of euros.In the UK, which is outside the eurozone, London estate agents have reportedly seen an increased interest in the city's high end residential property market from European cash buyers.In Belgium, Thierry Martiny, a spokesman for Dexia Bank told this website: Both in number and in amount [of money], we notice a limited increase in fixed-term savings accounts in Norwegian kroner.Separately, Portuguese financial daily O Diario Economico on Monday confirmed the trend, reporting that over the last couple of weeks many Portuguese have opened up savings accounts in foreign currencies.There has been an important increase in openings of accounts in a foreign currency, especially in dollars, Swedish kronor, Norwegian kroner, and Swiss francs,said Joao Queiroz of GoBulling, an online trader. It is a phenomenon that has been visible for at least the last two months.The newspaper noted an increased number of bank accounts being opened up abroad.The price per ounce of gold also rose nearly four percent last week - its sharpest rise in more than a month. David Woo, the global head of rates and currencies at the Bank of America, told investors on Friday they should buy gold rather than the euro for fear of the currency losing more of its value.The European Central Bank will be buying more government debt and doing quantitative easing [pumping more euros in the market], so buy gold against the euro, he told Bloomberg.

BRUSSELS - EU ministers on Monday (5 December) failed to agree on the seat and the funding of a unified patent court, with Paris, London and Munich fighting for the headquarters.A compromise package drafted by the Polish EU presidency got the support on most of the issues, except the seat of the main litigation court for the upcoming EU patent - with Britain and Germany refusing to cede it to France, as envisaged by the presidency, one EU diplomat told this website.The court seat could bring millions of euros in revenues to the country hosting it, as it would attract a flurry of legal offices and other related businesses.Under the non-contentious parts of the deal, Luxembourg would get the appeals court, Slovenia and Portugal two mediation and arbitration centres and Hungary a training facility.An agreement on the vital elements of the patent package substantially advanced by the Polish presidency may reduce the cost of obtaining the protection of inventions in the EU by as much as 80 percent, Polish economy minister Waldemar Pawlak said at a press conference late Monday night.He insisted that the court seat is the only outstanding issue to be resolved in the coming weeks, in order for a final agreement to be signed on 22 December in Warsaw.

EU states have been fighting for over 30 years over a single patent scheme. The dossier was blocked for a long time due to a Spanish and Italian veto on the three official languages of the scheme - English, German and French. Both Rome and Madrid insisted that their languages also be included, despite the EU commission warning that the translation costs for five languages would make the patent too expensive.

A legal breakthrough arrived in 2009 with the entry into force of the Lisbon Treaty, which allowed the other 25 member states to go ahead with the scheme under the so-called enhanced co-operation mechanism.With the appointment of former internal market commissioner Mario Monti as Prime Minister of Italy, EUobserver understands that Rome is also ready to join the scheme.Monti was a strong promoter of the single patent project during his mandate in Brussels. Occupy London demonstrators have been listed as domestic terrorists by the City of London Police, who characterized them in the same context as Al-Qaeda, the Colombian FARC and Belarusian terrorists who bombed the Minsk underground.

The City of London Police force was facing criticism last night after including the Occupy London demonstration in a letter warning businesses about potential terrorist threats, reports the Independent.Police admitted the leaflet, entitled, Terrorism/Extremism Update, was produced by them but claimed it was poorly worded.
Activism is not a crime and the desire to participate in democratic decision-making should not be a cause for concern for the police in any free society, said an Occupy London representative.Previous advertising campaigns by other law enforcement bodies in London educated the public that behavior such as paying with cash, keeping curtains closed, or minding your own business were all signs of potential terrorism.
