vatican city-Must financial transparency involve the unification of all relevant powers under the dicastery headed by Cardinal George Pell? This is a question many in the Vatican are asking in light of the observations made by the Pontifical Council for Legislative Texts with regards to the draft statute of the new economic dicastery headed by the Australian cardinal. These observations were presented at a number of meetings held last week and Vatican Insider is in a position to describe them.

The Consistory’s unexpected “lesson”

The long and articulate proposal presented to cardinals by the Australian cardinal and Prefect of the Secretariat for the Economy and especially his two right-hand men, Jean-Baptiste de Franssu and Joseph Zahra, at the Consistory last Friday, certainly had an effect. The presentation was entirely in English, all statements were illustrated by slides containing graphics and text. The two lay speakers made frequent reference to the work carried out by COSEA (the Commission for Reference on the Economic-Administrative Structure of the Holy See), which they had been members of before it was dissolved last year: they explained how, in their new roles, they are putting into practice what they themselves had decided when the reference commission was still up and running. Zahra and de Franssu were not initially expected to attend the Consistory. Pell decided that they should be there at the last minute.

Fox Napier’s cutting remarks and Pell’s interviews

The Consistory presentation – which illustrated what has been done to reform the Vatican financial system ­– was followed by three interviews given by Pell. The first was with The Boston Globe, the second with Corriere della Sera and the third with La Croix. In these interviews, Pell, who is also known as the “superminister” or “tsar” of the Vatican economy, expressed pride at the results achieved, the discovery of millions of euros that did not initially appear in the consolidated balance sheets. He also mentioned internal “opposition”. A key member of the Council for the Economy, Wilfrid Fox Napier, had also spoken about opposition, the day before the economic reforms were presented at the Consistory. Having mentioned the Propaganda Fide congregation among those who had showed resistance to reform, the South African cardinal made a significant and deliberate cutting remark directed at the Pontifical Council for Legislative Texts, which he claimed had overstepped the mark and acted “outside of its duties”. Pell has continued to uphold these views over the past few days in the Vatican.

Public statements and the reality

Vatican Insider has learnt from a number of sources that the reality is far more complex than that presented by the cardinal Prefect of the Economy and his men in their statements. It must not be forgotten that last December Pell directly attacked the Secretariat of State regarding the management of funds not included in the balance sheets, funds which all Popes know about from the moment of their election. The way in which the media tends to portray Pell and his closest collaborators Zahra and de Franssu as the only men fighting for transparency in the face of a non transparent and resistant Curia seems simplistic to say the least considering the emerging facts. It is hard to believe that every objection to the assignment of new powers to the economic “superdicastery” is the sign of a wish to backtrack on reform goals and the transparency process. Writing for Italian finance newspaper Il Sole 24 Ore, Vaticanista Carlo Marroni recently noted that there is an “excessive focus on the new superdicastery (Pell’s, Ed.) in which all powers over finances would be concentrated … the Vatican is also pushing for checks and balances”.

Critical observations regarding the statutes

Pell presented the Secretariat for the Economy’s new statutes during the course of the C9 meeting at the beginning of last week. On that occasion, the Australian cardinal was asked to take into consideration the observations made by the Pontifical Council for Legislative Texts headed by cardinal Francesco Coccopalmerio. Heated arguments ensued. One of the main objections was in regard to the proposal to bring the task of overseeing the management of a large portion of movable assets and immovable property (currently administered by APSA) and the task of managing these assets under one single dicastery. Pell strongly opposed this objection despite the fact it was in tune with the “four eyes” principle (the two eyes that oversee the management of assets, quite different from the two that manage assets), which IOR president De Franssu had insisted upon during the presentation in the Consistory. Other observations made by the Pontifical Council for Legislative Texts were to do with the need to reinforce the independence of the Revisor figure further by nominating three revisors instead of one. But this proposal was also rejected by Cardinal Pell who is intent on wanting to bring monitoring and management tasks under the umbrella of his dicastery.

Project V.A.M

The project carried forth by Pell and his close collaborators Zahra and de Franssu involves the creation of a unified Vatican Asset Management to decide on investments and get the most out of Vatican assets. The details of the project are still unknown to most of the Curia. What is known, however, is that despite it being intended as a separate body, the new entity would still be under the aegis of the Secretariat for the Economy. No one in the Vatican is in any doubt as to the need to improve some aspects of asset management, seeing the failures and waste witnessed in the past. What is striking is that Pell and Fox Napier describe the technical-juridical objections presented by the Pontifical Council for Legislative Texts as “opposition” or as acting “outside” of its duties, calling into question the review work carried out, especially when the Pope had entrusted the dicastery with this task. So it is not about backtracking from the path toward transparency as these new key figures suggest, but rather guaranteeing the real application of the “four eyes” principle. Pell therefore decided to reject the work of the legislative texts council and so did the Council for the Economy, which adopted the same position as the Australian cardinal. The Pope has the final say on the statutes and is currently studying them. In the meantime, he is following both issues relating to the new economic bodies and the governance of the IOR closely.

vatican city-After an hour of handshakes, embraces and blessings, the newly created Uruguayan cardinal Fernando Sturla Berhouet took off the cardinal’s biretta which Francis had imposed on him just a few hours before. It is hot in the audience hall which has been turned into a sitting room for the new cardinals’ reception and the Salesian cardinal relieves himself of the headpiece which he has not yet had time to get used to. AA few minutes go by and a young Uruguayan priest, Gonzalo Aemilius - whom Jorge Mario Bergoglio knew in the days when he was Archbishop of Buenos Aires – places a cup of freshly brewed Argentinean mate tea in his hand. The cardinal smiles as he drinks it - “what a relief!”- before embracing the priest he has known for a long time. Just a few metres away, Soane Patita Paini Mafi, the newly created cardinal from Tonga, the first cardinal these islands have ever had, is surrounded by faithful and relatives who have formed a chorus and are singing a traditional song at the top of their voices.There is about 30 of them and they are wearing a traditional oversized white shirt with necklaces made of red stones. They stand out because hanging from their necks is a photo taken about 20 years or so ago of the new cardinal surrounded, in shirtsleeves, by a large number of brothers and sisters. Tunes by famous Cape Verdean singer Cesaria Evora can be heard further down the corridor: a group of women from Cape Verde sit elegantly and sing as faithful and friends of Cardinal Arlindo Gomes Furtado come and go to greet him. What one witnessed during the courtesy visits, once called “visite di calore” (“visits of warmth”), that followed Francis’ second Consistory presided over by the Pope in St. Peter’s Basilica this morning, was a global south in action.As usual, cardinals have been split between two rooms, most of them are seated in the various spaces of the Paul VI Hall, a small group of five cardinals is seated in the frescoed rooms of the Apostolic Palace. Among them is Dominique Mamberti, the only Curia member, former “foreign affairs minister” to the Holy See and now Prefect of the Supreme Tribunal of the Apostolic Signatura: “This time round I am the only Curia member,” he told journalists. “The Holy Father wanted to illustrate his desire for a Cardinals’ College that is representative of the entire Catholic Church.” Before the crowds begin to gather, the former Vatican Secretary of State, Cardinal Tarcisio Bertone, goes to greet him. The newly created cardinals who are over the age of 80 are sat in the halls of the Apostolic Palace, where there are unusually few cardinals to be seen. The cardinals in question are: Luigi de Magistris, whom Bertone bent down to greet so as not to make the elderly cardinal stand up; the former German Nuncio Karl-Josed Rauber and the Argentinean Luis Hector Villalba (Julio Duarte Langa had to cancel his trip to Rome at the last minute due to health reasons).There is much more movement in the audience hall and adjacent rooms. The queue to see the two Italian cardinals, Francesco Montenegro (lots of African faces can be seen popping out in the midst of the crowd) and Edoardo Menichelli appears endless. A small group of faithful greet Thai cardinal Francis Xavier Kriengsak Kovithavanij, Myanmar cardinal Charles Maung Bo, New Zealand’s  John Atcherley Dew and José Luis Lacunza Maestrojuan of Panama.  The Patriarch of Lisbon, Manuel José Macario do Nascimento Celmente sends round a colourful little card which simply has his name, “d. Manuel Clemente”, written on it  (not all cardinals do so, the most simple one was the Argentinean cardinal Villalba’s, while the Mexican cardinal Suarez Inda has the most fancy one).The Ethiopian Berhaneyesus Demerew Souraphiel is surrounded by fellow countrymen who are singing and waving the Ethiopian flag around. The Vietnamese cardinal Pierre Nguyen Van Nhon stands some distance away from his seat as there are so many people that have come to greet him. Then there is the Cuban cardinal Jaima Ortega Alamino: “things are going very well, we didn’t think so much progress would be made,” he said answering journalists’ questions about the turning point in relations between the US and Cuba. He speaks for a while to the new “foreign affairs minister” Mgr. Paul Richard Gallagher. The Mexican archbishop Alberto Suarez Inda, who ministers in one of the most violent parts of the country, explains that the situation is “difficult” but that one must not give in to “pessimistic” thinking. The timid looking Archbishop of Valladolid, Ricardo Blazquez Perez, is surrounded by faithful, just a short distance away from Cardinal Antonio Rouco Varela, his predecessor at the helm of the Spanish Episcopal Conference who cordially shakes the hands of faithful who come by to greet him. Among the crowd of faithful of different nationalities, ambassadors, real Romans, one can make out the face of Opus Dei prelate Mgr. Javier Echevarria and the leader of the neocatechumenals Kiko Arguello. Mgrs. Becciu and Wells, the deputy Secretary of State with his right hand man, pass by. The Patriarch of Jerusalem, Fouad Twal stops to speak to journalists. He is delighted about the news of the canonization of the new Palestinian saints : “The Holy Land is not all war, violence and walls, but also holiness,” he said.

The EU has broken its taboo on referring to Russian forces in east Ukraine in its official documents.It said in its Official Journal on Monday (16 February) that Russian deputy defence minister Anatoly Antonov is being added to its blacklist because he is “involved in supporting the deployment of Russian troops in Ukraine”.It listed first deputy defence minister Arkady Bakhin for the same reason.It also listed Andrei Kartapolov, a senior Russian military commander, for being “involved in shaping and implementing the military campaign of the Russian forces in Ukraine”.The text in the legal gazette was signed off by EU foreign relations chief Federica Mogherini, who has, until now, with the exception of Russia-annexed Crimea, studiously avoided any reference to Russian armed forces being active in Ukraine.The last time EU foreign ministers published a formal statement on the conflict, on 29 January, they also used circumlocutions, speaking of: “evidence of continued and growing support given to the separatists by Russia, which underlines Russia's responsibility”.They added that “foreign armed groups” should leave Ukrainian territory.Individual EU officials, such as Council chief Donald Tusk, have been more hawkish in off-the-cuff remarks.Ukraine, the US, and Nato have been speaking of Russian forces in Ukraine since last July. Nato and the US have also declassified and published satellite pictures to back up their statements.The US ambassador to Ukraine, Geoffrey Pyatt, posted more images online last weekend, saying they show "Russian military, not separatist, systems”.But the erstwhile EU taboo went higher than minister level.When French, German, Russian, and Ukrainian leaders agreed a ceasefire plan in Minsk last Thursday, they also bowed to Russia’s claim its soldiers aren’t in Ukraine, by calling for withdrawal of “foreign armed formations”.When leaders of the G7 wealthy nations the following day published a statement urging Russia to comply with the Minsk accord, they too spoke of “Russian-backed separatist militias”.For her part, Mogherini’s spokeswoman, Maja Kocijancic, told EUobserver the language in the Official Journal is not an accident.She noted it reflects “mounting evidence, underlining Russia’s responsibility” for the conflict, as discussed by foreign ministers on 29 January.One piece of evidence is a classified report on Russian activity in Ukraine compiled by Mogherini’s intelligence-sharing branch, IntCen, and circulated to capitals ahead of the 29 January meeting.An EU diplomat, who asked not to be named, noted: "This new form of Russian warfare - using tanks and soldiers without insignia - is something we haven't seen before. We're still trying to work out how to respond to it".A second EU diplomat added: “It [the latest Official Journal text] is a clear and understandable message against Russian propaganda and all the lies about non-Russian engagement in the military conflict”.Russia’s claim it isn’t involved in east Ukraine is central to its propaganda message: that the conflict is a “civil war” between Ukrainian nationalists and ethnic Russian “separatists”.But the 16 February Official Journal, which also listed nine entities, highlighted the manufactured nature of the “separatism”.Most of the entities are battalions of Russia’s irregular fighters in Ukraine.But one of them is “Novorossiya”, a Russian “public movement” named after the Kremlin concept that east and south-east Ukraine, or “New Russia”, belong to Russia on ancestral grounds.The Official Journal noted that Novorossiya is run by Igor Strelkov, who is already on an EU blacklist for organising the initial insurgency in Donetsk, east Ukraine, last March.The EU gazette says he is a “Russian officer … identified as a staff member of the Main Intelligence Directorate of the General Staff of the Armed Forces of the Russian Federation (GRU)”.

Battle rages for town where Ukraine rebels reject ceasefire-Reuters-By Anton Zverev -FEB 15,15-YAHOONEWS

VUHLEHIRSK, Ukraine (Reuters) - Pro-Russian rebels pounded encircled Ukrainian government forces on Monday and Kiev said it would not pull back heavy guns while a truce was being violated, leaving a European-brokered peace deal on the verge of collapse.The European Union kept pressure on Russia and the rebels by announcing a new list of separatists and Russians targeted with sanctions, to which Moscow promised an "adequate" response.The United States said it was "gravely concerned" by the fighting in and around the town of Debaltseve in eastern Ukraine after a ceasefire agreement that came into force on Sunday and said it was closely monitoring reports of a new column of Russian military equipment moving toward the region."These aggressive actions and statements by the Russia-backed separatists threaten the most recent ceasefire," U.S. State Department spokeswoman Jen Psaki said in a statement. "We call on Russia and the separatists it backs to halt all attacks immediately."Fighting subsided in many parts of eastern Ukraine under a ceasefire deal reached last week in marathon talks involving the leaders of France, Germany, Russia and Ukraine.But the truce appears to have been stillborn in Debaltseve, where the most intensive fighting has taken place in recent weeks."The situation is fragile," said German Chancellor Angela Merkel, the driving force behind the deal reached on Thursday after all-night talks in the Belarussian capital Minsk."It was always clear that much remains to be done. And I have always said that there are no guarantees that what we are trying to do succeeds. It will be an extremely difficult path," she told reporters in Berlin.Merkel, along with the leaders of France and Ukraine, expressed concern about continued fighting in Debaltseve and said observers from the Organization for Security and Cooperation in Europe (OSCE) must have "free access" for their work in eastern Ukraine. Rebels said soon after the ceasefire came into effect they had no intention of observing it at Debaltseve, where they have been advancing since January and now have a Ukrainian unit all but encircled.Washington says the rebel operation around the town, which sits on a strategic railway hub, is being assisted by the Russian armed forces, which Moscow denies.The U.S. State Department spokeswoman called on Russia and the separatists to engage with the OSCE to facilitate the cease fire.The OSCE said on Sunday that the rebels had refused to allow its monitors to reach Debaltseve after the ceasefire took effect.Reuters reporters near the front said Debaltseve was being relentlessly bombarded with artillery. At least six tanks as well as armoured personnel carriers and artillery could be seen in woods near Vuhlehirsk, 10 km (six miles) west of Debaltseve, which the rebels captured a week ago.Military trucks headed along the main road in the direction of the town to regular bursts of shelling and the firing of Grad rockets and machine guns."You can hear there is no ceasefire," said a rebel fighter with a black ski mask who gave his name as Scorpion, his nom de guerre, and blamed the fighting on Kiev's forces. "Debaltseve is our land. And we will take Debaltseve."

STALEMATE OVER WITHDRAWAL OF BIG GUNS

A rebel commander, Eduard Basurin, said Ukrainian troops had violated the ceasefire 27 times in the past 24 hours.Kiev said its forces had been shelled more than 100 times in eastern Ukraine since the truce took effect, five of its servicemen had been killed and 25 wounded, and that it could not carry out an agreement to pull back big guns in such conditions."The pre-condition for withdrawal of heavy weapons is fulfilling Point One of the Minsk agreements - the ceasefire. One hundred and twelve attacks are not an indicator of a ceasefire," said a Kiev military spokesman, Andriy Lysenko.A rebel leader, Denis Pushilin, responded by saying his forces were "only ready for a mutual withdrawal of equipment."In another complication likely to set back hopes of peace, he and another separatist leader said the rebels would pull out of the Minsk agreements if Kiev made any further moves to abandon Ukraine's neutral status -- also a red line for Moscow, which fears Ukraine might seek to join the NATO alliance.The separatists offered the Ukrainian forces a safe corridor out of Debaltseve if they gave up their weapons but a military spokesman for Kiev, Vladislav Seleznyov, ruled this out."There are the Minsk agreements, according to which Debaltseve is ours. We will not leave," he said.

ONLY A GLIMMER OF HOPE

Fighting began in east Ukraine after the overthrow of a Moscow-backed president in Ukraine last February and Russia's annexation of the Crimea peninsula a month later.The West says Putin, who has called parts of Ukraine "New Russia," has sent troops and weapons to back the rebels. Moscow denies this and accuses the West of waging a proxy war in Ukraine to seek "regime change" in Russia.Hopes that Thursday's deal will end a conflict that has killed more than 5,000 people have been dampened by the collapse of an earlier truce when rebels advanced last month.Western countries say they reserve the option of expanding economic sanctions on Moscow over the crisis, hoping a growing financial crisis in Russia will persuade Putin to use his influence with the rebels to stop the fighting. A meeting of eurozone finance ministers ended early on Monday (16 February), with Greece refusing to sign off to a six-month bailout extension, in what appears to be a clash both on semantics and conditions.Eurogroup chief Jeroen Dijsselbloem, who chaired the meeting, said there had been a "slight sense of disappointment" in the room as no agreement could be reached.He spoke of a "general feeling" and the "preferred option" that the only solution was for Greece to ask for an extension of its bailout programme which ends on 28 February.Within this extension - six-months, according to the draft prepared by Dijsselbloem's services - Greece would have enough time to negotiate the way forward with its creditors and would also have enough "flexibility" on the reforms it needs to implement, provided it sticks to the commitments attached to it.Dijsselbloem said he "didn't really mind" if the extension was called a "bridging programme" - a term used by Athens - so long as there was a common understanding of what the conditions are."I wish it was just a debate about words. The reason why we still talk about an extension is that in the rules and regulations of the [bailout funds] EFSF and ESM, this is how it's called. But it is also a bridge arrangement for the next six months," Dijsselbloem said.He said there was only time until end of this week, given that several national parliaments need to approve an extension before the current programme runs out.For his part, EU economics commissioner Pierre Moscovici, who earlier in the day presented a separate paper the Greek government was willing to sign up to, said there had been a lot of talk about "phraseology."

(Reuters) - A CSX Corp train hauling North Dakota crude derailed in West Virginia on Monday, setting a number of cars ablaze, destroying a house and forcing the evacuation of two towns in the second significant oil-train incident in three days.One or two of the cars plunged into the Kanawha River, and “a couple are burning," said Robert Jelacic, night shift manager of the West Virginia Department of Homeland Security and Emergency Management. There were no injuries or deaths, he said.CSX said the train was hauling 109 cars from North Dakota to the coastal town of Yorktown, Virginia, where midstream firm Plains All American Pipelines runs an oil depot. It said one person was being treated for potential fume inhalation. West Virginia State Police First Sergeant Greg Duckworth, who was at the crash site, told Reuters that nine or 10 of the cars had exploded at intervals of about every half hour. A similar sequence has occurred in a handful of other derailments over the past year and a half, with the fire from one tank heating up gases in the next nearest car, causing it to ignite.“It’s a real mess down here," Duckworth said. The latest incident came just two days after a Canadian National Railways train from Alberta's oil sands derailed in a wooded area of northern Ontario. CN said 29 of 100 cars were involved and seven caught fire. No injuries were reported, but the cars were still on fire on Monday.A boom in oil shipments by rail and a spate of derailments across North America have put heightened focus on rail safety. "And of course you get more infectious as you get closer to actually blossoming in the disease.""There is some risk to those who were unimmunized at Acquire the Fire, and that's why we're reaching out today to make sure that people get on top of their immunization," she said.Organizers with Acquire the Fire say roughly 1,000 people were present for the 27-hour event, described on the company's website as "the weekend that changes your teen's life forever." TOKYO (Reuters) - A strong earthquake with a magnitude of 6.9 struck off northeastern Japan on Tuesday, the U.S. Geological Survey said, and small waves were reported along the northern coast after Japan issued a tsunami warning.Japanese broadcaster NHK said small waves of between 10 cm and 20 cm (4-8 inches) reached the coast off Iwate prefecture, some 600 km (370 miles) from Tokyo. NHK said thousands of residents in the area were ordered to evacuate.There were no immediate reports of damage or injuries."We are using the emergency broadcast to advise people to keep away from the sea ... the quake was pretty strong and lasted a long time so I thought there would be a tsunami warning," Kozo Hirano, an Otsuchi Town official in Iwate, told NHK.Live video from ports on the Iwate coast showed small waves lapping on the shore. Towns along the northeastern coast of Japan had been levelled in a devastating tsunami in March 2011.Tuesday's quake was measured at a depth of about 10 km (6 miles). The Pacific Tsunami Warning Center in Hawaii said there was no danger of a Pacific-wide tsunami but the Japan Meteorological Agency issued a tsunami advisory for Iwate prefecture after the quake.Tohoku Electric Power Co, which operates the Onagawa and Higashidori nuclear plants in nearby Miyagi and Aomori prefectures, said it saw no irregularities at the facilities after the quake.All 48 of Japan's nuclear reactors remain offline after a March 2011 earthquake and tsunami, which triggered the Fukushima nuclear disaster in northeastern Japan.A spokesman for Tokyo Electric Power Co, the operator of Fukushima Daiichi and Fukushima Daini nuclear plants, said there were no irregularities at the plants.
