SUIT FILED AGAINST OBAMA'S COMPULSORY HEALTH CARE BILL

On May 12, 2010, the U.S. Citizens Association and five individual plaintiff members of that association (Nathan R. Glick, Christopher Barr, Shane K. Ellison, James Grapek, and Eileen Dannemann) filed an historic suit in the United States District Court for the Northern District of Ohio, challenging the Patient Protection and Affordable Care Act (Pub. L. No. 111-148, H.R. 3590), as amended by the Health Care and Education Reconciliation Act (Pub. L. No. 111-152, H.R. 4872) (what the public knows as Obamacare). The suit is unlike every other filed to date against Obamacare. It is filed on behalf of individuals who do not have health insurance and do not want it. The U.S. Citizens Association plaintiffs present a direct challenge to the most significant aspect of Obamacare, the mandate that every American obtain health insurance.
By 2014, every American who volitionally elects not to buy health insurance will be forced to buy qualified private plans under Obamacare or suffer a tax penalty. Millions of Americans do not have health insurance of their own free will, not because they cannot afford it but because they choose not to expend their money on it. Their reasons are many. Some prefer alternative medicine that is not covered by health insurance. Others wish to place the thousands of dollars that would otherwise have to be spent on health insurance in savings or investments. Still others wish to devote that money for the acquisition of goods or services other than health insurance. In the end, this suit is about those Americans’ freedom of choice. Can the government constitutionally compel an American citizen to spend his or her after tax dollars to purchase a single product, health insurance, against that citizen’s will? The plaintiffs in this suit contend that their liberty right under the Fifth Amendment, their right to privacy protected by the First, Third, Fourth, Fifth, and Ninth Amendments, and their freedom of association protected by the First Amendment forbid that compulsion.
I must disclose a personal bias. I am lead counsel for these plaintiffs. The suit is critical not just for them but for all Americans who value freedom. If it succeeds, key elements in the defense of a Constitution of liberty will be upheld. If it fails, there will be no precedential barrier in place to prevent the federal government from placing additional mandates on private expenditure of after tax dollars.If the government may constitutionally compel you to buy health insurance with your after tax dollars on the simple public interest argument that all Americans must needs be insured because all must be able to pay for health care, what can stop the government from imposing other mandates on your after tax dollars based on comparable public interest arguments? For example, many members of Congress think fossil fuels evil and wish the pollution they create would disappear. What is to stop Congress from requiring every American who owns a car that runs on fossil fuels to purchase a replacement electric car by a date certain? Why not pass legislation requiring every American located in a region where sunshine is prevalent to purchase solar panels for electric heating in place of power plant generated electricity? Why not pass legislation requiring every American to purchase a set amount of foods per capita deemed by the Food and Drug Administration to be health enhancing? Surely there is a public interest in reducing air pollution, reducing reliance on electricity provided by public utilities, and improving the quality of foods consumed in the American diet.
The mandate imposed by Obamacare is designed to force the nation to favor one industry sector, the insurance industry. It operates on the supposition that insurance is an essential public good. Political decision makers might likewise deem low interest loans an essential public good and mandate that we place a certain amount of our income in government qualified savings accounts to help keep interest rates down. They might deem low cost day care an essential public good and mandate that all pay for private day care services, whether they have children or not, to ensure that daycare is affordable for parents in need. If the Constitution permits the federal government to impose mandates on use of after tax dollars to support one industry that political decisionmakers think wise, here health insurance, there is no end to the mandates that can be placed on the expenditure of private resources.
There is at least one undeniable problem with mandates of this sort: they sacrifice individual freedom of choice. They violate the Constitution’s taxing provisions by usurping control of money that is not taxed. The right to direct how your after tax dollars are spent is indispensable to human liberty in a free enterprise economy. Suddenly not only does government assert jurisdiction over the dollars you pay in taxes, but it also presumes to control your after tax dollars, placing public mandates on your private resources to achieve an ever illusive (and ever changing) public good (or, at least, what those in political power deem good). This system operates on the offensive assumption that political decision makers know better than you do what is in your own best interest. On that supposition, those political decision makers will dictate how you spend the very resources on which you depend to be free and independent. The First Amendment protects your freedom to associate. Under Obamacare, that freedom to associate is taken from you. You must associate with a qualified health insurance plan even if you would prefer not to, with precious few exceptions. The Fifth Amendment protects your right to liberty. The Supreme Court has recognized the liberty right to include the freedom to refuse unwanted medical treatment. Inherent in such refusal is the refusal to pay for unwanted treatment. The Obamacare mandate violates that freedom. It is fundamental because the freedom to refuse medical treatment would be rendered nugatory if that freedom to refuse did not include a freedom to refuse paying for unwanted care.
Various amendments to the Constitution have been deemed bases for assertion of a right to privacy. Central to that right is the protection of health information from unwanted eyes. The Obamacare mandate violates the right of privacy because it forces individuals not insured to obtain health insurance and, by so doing, divulge to insurers their health status (including all physical and mental health information). It thereby forces individuals to reveal to private companies (and to the government) confidences against their will.In addition to these rights violations, Obamacare operates on the supposition that there is no limit to the extension of the commerce clause when it comes to health care. If correct in that supposition, the Constitution not only condones after tax mandates on expenditure of private resources but also permits those mandates to be imposed on individuals who have no substantial effect on or relationship with health insurance and health insurance markets. The individuals subject to Obamacare mandates in this suit are being regulated because of their choice not to be insured, not because they have involved themselves with health insurance or health insurance markets. Thus, as applied to them, Obamacare obliterates every limit on the extension of the commerce clause.Our freedom of choice is often expressed in economic terms. Our freedom to travel depends on the liberty to expend money necessary to pay for a preferred mode of transportation. Our freedom to invest in new business enterprises depends on the liberty to risk our own capital in a venture that may or may not succeed. Our freedom to purchase goods or services depends on the liberty to choose among those available the one or ones we think right for us.Freedom of choice includes the freedom not to choose. The right of dissent, a time honored right meant to be protected against coercive government, cannot coexist with law that compels all to use their own resources to uphold and promote state preferred industries. Sovereignty is accepted as absolute uncontested authority. This definition of the concept of sovereignty emerged along with the nation-state. The nation-state hasn’t always existed. Everyone tends to see the circumstances of their own times as the static normality of history. And contrary to the endless lectures of History teachers tied to politically correct text books and standardized tests, History is not static it’s dynamic, it changes every day. The concept of the nation-state emerged in the sixteenth century evolving from countries as the private property of monarchs, and however hard to envision the nation-state will someday be replaced by something else.If that’s what sovereignty is who has it? In England it’s vested in Parliament. In China it’s vested in the Central Committee of the Communist Party. But in America sovereignty isn’t vested in any one place, which means there really isn’t any. No sovereignty? How can that be? Since sovereignty is an absolute, it either exists or it doesn’t and it’s a misapplied concept when striving to understand the American government.This does not mean that the United States is not a sovereign nation. The Federal Government represents the United Sates on the world stage. To the other countries of the world the Federal Government is the sovereign power with which they must deal. However, domestically we face a different situation. In some areas the Federal Government is sovereign, in some areas the States are sovereign, and in some areas the people are sovereign. Since sovereignty by definition is an absolutist concept and not one of degrees, either something is sovereign or it is not. In the United States there is no one legitimate source or center of sovereignty. The revolutionary theory the Framers advanced into practice is that several centers of power prevents the formation of an authority vortex swallowing all legitimate authority and paralyzing decision making, thus establishing the world’s first viable system of disassociated sovereignty.
Under the Articles of Confederation, which preceded the Constitution as the foundational document and framework of organization of the United States, stated categorically in Article II, Each state retains its sovereignty, freedom, and independence.Nowhere in the Constitution is this retention of inherent sovereignty surrendered. The so-called sovereignty clause found in Article Six of the Constitution obviously gives precedence to the laws and treaties made by the Federal government it does not however expressly say anywhere in the document that the States surrendered or forfeited their inherent sovereignty. If it had it never would’ve been ratified. As expressly stated in the 10th Amendment neither the States nor the people surrendered their sovereignty to the Federal Government they delegated it. There is a difference between these two actions. To surrender is to give entirely and irrevocably to another while delegation is a temporary action based upon continued agreement between the parties involved.Another strong argument can be made that since all governments are the products of a social contract between those who govern and those governed sovereignty ultimately resides in the people and governments are therefore merely agents of the people’s will. According to this line of thought all governments wield delegated powers and can have no more power in and of themselves than the moon has light without the sun.
Amendment is the only legitimate process for change under the Constitution. If the design calls for a decentralized diffused sovereignty in an asymmetrical system how was change achieved from that to the current system of highly centralized power and control? Was it by amendment or practice? Is it possible for an illegitimate practice to become a legitimate tradition? Is it possible for an illegitimate tradition to set a legitimate precedent? All of these historically based academic discussions aside and for all intents and purposes the argument about who is sovereign was forever settled by Abraham Lincoln.When the South attempted to succeed, an action not prohibited by the Constitution they were beat back into submission to the Federal Government. Debate over. Question answered. The Federal Government is supreme. However, though this is the reality of our circumstance since the Civil War this is a reality imposed through the use of military force not to be confounded with the original condition based upon the voluntary agreement between the people, the states and the national government in Constitution. For years this question of who is sovereign has see-sawed back and forth. Today the Progressives and their two headed government party seek to make the exaltation of the central government permanent. If this stands unchallenged America has devolved from the defused model established under the Constitution to a centralized version reminiscent of its original absolutist definition. If this new normal is enshrined as reality it will become increasingly obvious as States strive to assert their rights and people seek to preserve their freedom. For if the central government is now absolutely sovereign it will eventually crush all rivals. If the people are sovereign in time they’ll find their voice, reassert their power, re-establish the federal system, and return to the social contract as ratified in the Constitution.

NEW YORK – A London-based commodities trader claims a major New York bank is conducting serious manipulation of the silver and gold futures markets. The practice has continued even after federal regulators have been warned of the impropriety, Andrew Maguire, a metals trader at the London Bullion Market Association, told WND.
Last November, Maguire brought allegations before the U.S. Commodity Futures Trading Commission, or CFTC, in Washington that gold and silver traders at JPMorgan Chase have conspired to manipulate global precious metals markets. He charged the manipulation amounts to hundreds of millions of dollars, if not billions, in institutional trading profit for the bank and personal profit for the traders. It's like robbing a bank, Maguire told WND. America's wealth is being intentionally killed off. Find out how to protect your own right now! Maguire charged that JPMorgan Chase gold and silver traders have coordinated massive purchases of short contracts betting that the price of gold or silver will go down. The purchases, he said, are part of a strategy aimed at forcing the price of gold and silver to drop dramatically at the expense of holders of long positions owning gold or silver. This is a very small community that engages in metals trading – only a handful of traders at major institutions like JPMorgan Chase,Maguire said.The traders involved in market manipulation trigger their signals in advance so that local traders like me can jump on board to create a major market movement,he said.
WND has obtained a series of e-mails Maguire exchanged with Eliud Ramirez, the head of CFTC's enforcement unit. A copy was sent to CFTC Commissioner Bart Chilton. Maguire specified his allegations in the e-mail and predicted major market moves he believed would occur as a result of trader manipulations instigated at JPMorgan Chase. In a Feb. 3 e-mail, Maguire predicted to the CFTC that traders were ready to initiate a wave of short selling designed to reduce dramatically the price of gold and of silver. An examination of the price charts for gold and silver show both metals suffered price declines after Maquire's Feb. 3 e-mail, exactly as he predicted.As the market manipulation was in progress, Maguire sent additional e-mails to Ramirez at the CFTC. It is undoubtedly the concentrated short who has walked silver down since Wednesday, putting large blocks in the way of bids, Maguire e-mailed Ramirez Feb. 5. This is clear manipulation as the long holders who have been liquidated are matched by new short selling as open interest is rising during the decline.Then, again later that day, Maguire e-mailed Ramirez: A final e-mail to confirm that the silver manipulation was a great success and played out EXACTLY to plan as predicted yesterday. How would this be possible if the silver market was not in full control of the parties we discussed in our phone interview?

Disturbing audio has emerged of White House information czar Cass Sunstein, who in a previous white paper called for banning conspiracy theories, demanding that websites be mandated by law to link to opposing information or that pop ups containing government propaganda be forcibly included on political blogs.In an audio excerpt of an interview which was posted on the Breitbart.tv website today, Sunstein discusses how conservative websites should provide links to liberal websites and vice versa or even how political blogs should be made to include pop ups that show a quick argument for a competing view.Sunstein said that if this system couldn’t be implemented voluntarily, Congress should hold hearings about mandates, which would legally force people to dilute their own free speech. The Harvard Professor also said that blogs should be forced to list a random draw of 25 popular websites, such as CNN.com.The best would be for this to be done voluntarily, said Sunstein,But the word voluntary is a little complicated and people sometimes don’t do what’s best for our society,he added (emphasis mine).The idea would be to have a legal mandate as the last resort….an ultimate weapon designed to encourage people to do better, Sunstein concluded.

Ludicrously, the Harvard Professor even characterized as false and dangerous the idea that exposure to sunlight is healthy, despite the fact that top medical experts agree prolonged exposure to sunlight reduces the risk of developing certain cancers.
Essentially, Sunstein wants it to be written into law that the government can dictate the very nature of reality to Americans and that their opinions can only be voiced at best when accompanied by mandatory federal propaganda or at worst that Americans can be silenced entirely by federal decree.This callous disregard for the First Amendment represents a fundamental threat the very fabric of the country and is even more alarming considering the position of Obama’s Supreme Court nominee Elena Kagan with regard to free speech. During the Citizens United vs. FEC case, Kagan’s office argued that the government can ban books and political pamphlets. In separate writings, Kagan argued that the government could disappear free speech it deemed to be offensive.

NEW ORLEANS, Louisiana (AFP) – BP said Monday that about 20 percent of the oil gushing into the Gulf of Mexico is being swallowed up by its insertion tube system, no longer feeding a giant slick off Louisiana.But the British energy giant's first concrete success in almost a month of efforts to tackle the spill risked being overshadowed by fears that huge underwater plumes of crude could be starving the waters of oxygen.BP is burying its head in the sand on these underwater threats, said Democratic congressman Ed Markey.These huge plumes of oil are like hidden mushroom clouds that indicate a larger spill than originally thought and portend more dangerous long-term fallout for the Gulf of Mexico's wildlife and economy.A research vessel located last week massive plumes up to 10 miles (16 kilometers) long, three miles wide and 300 feet thick that suggested a far greater impact on the marine environment than previously thought.Normally, in a shallow spill, everything pretty much shoots up to the surface and the impacts are primarily to surface organisms like turtles, dolphins, whales and birds,explained Doctor Paul Montagna.
The expert from the Harte Research Institute for Gulf of Mexico Studies at Texas A&M University-Corpus Christi said deepwater spills were a relatively new phenomenon that posed greater risks due to these plumes.What happens is we're dealing with a different kind of situation than the past because under this really cold, high pressure environment the oil is getting dispersed through the water column, he told AFP.What that means is that basically life in the entire water column is now being exposed. The dispersants themselves are toxic as well. We have organisms being exposed to a lot of toxic materials.Response crews have so far used some 560,000 gallons of controversial chemical dispersants, spraying them onto surface oil and also directly into the leak in a bid to break up the oil.After almost a month of coming under increasing fire for failing to stem an estimated 5,000 barrels, or 210,000 gallons, of oil spewing into the Gulf every day, BP enjoyed its first taste of success at the weekend, albeit limited.A tube with a four-inch diameter was inserted by robotic submarines into the main leak and connected via a mile-long pipe to the Discoverer Enterprise, a drill ship on the surface which can process the oil and residual gases safely.BP said the short length of tube, 5,000 feet (1,500 meters) down on the seabed, had sucked up about 1,000 barrels of oil in its first day of operations and that it hoped to increase the rate as the week progressed.
The system allows for injections of methanol to stop gas hydrates forming, but engineers warned that if they try to increase the rate too quickly and too much seawater got in, the tube could become clogged with ice-like crystals.There's still oil coming out,BP chief operating officer Doug Suttles told CNN. But what we hope to do over the next 24 hours is continue to... increase the rate coming out of that insertion tube and capture more and more of the flow.US President Barack Obama administration seemed unimpressed, however, saying BP's efforts, even if they manage to slow the leak, would not permanently stop the underwater geyser.This technique is not a solution to the problem, and it is not yet clear how successful it may be, said Homeland Security Secretary Janet Napolitano and Interior Secretary Ken Salazar.
Significant breakthrough or not, with dozens of lawsuits pending and a permanent fix still a while off, the development is unlikely to alleviate much of the pressure on BP. Congressional hearings have revealed multiple warning signs that were overlooked before the April 20 blast on the BP-leased Deepwater Horizon rig. The indicators of things being wrong included a key pressure test that failed during final operations to seal the well being drilled about 50 miles (80 kilometers) offshore. Two days later the rig sank and the blowout preventer -- a giant valve designed to shut off the flow of oil -- failed.Engineers are mulling several different options to seal the main leak which has spewed out an estimated five million gallons so far. First could be a junk shot maneuver to jam up the blowout preventer with golf balls, tires, rope and other debris, followed by a top kill to permanently seal the well by injecting heavy drilling mud and then cement. Meanwhile, stricken communities along the southern Gulf coast have already seen their livelihoods hit by a fishing ban, as sheen washes up on islands off Louisiana, Alabama and Mississippi.

NEW ORLEANS – BP said Monday it was siphoning some of the oil spewing into the Gulf of Mexico, but worries escalated about the ooze reaching a major ocean current that could carry it through the Florida Keys and up the East Coast.BP PLC chief operating officer Doug Suttles said Monday on NBC's "Today" that a mile-long tube was funneling a little more than 42,000 gallons of crude a day from a blown-out well into a tanker ship.That would be about a fifth of the 210,000 gallons the company and the U.S. Coast Guard have estimated are gushing out each day, though scientists who have studied video of the leak say it could be much bigger and even BP acknowledges there's no way to know for sure how much oil there is.In the nearly a month since an oil rig called the Deepwater Horizon exploded off the coast of Louisiana, killing 11 workers, BP has made several failed attempts to stop the leak, trying in vain to activate emergency valves and lowering a 100-ton container that got clogged with icy crystals.Chemicals being sprayed underwater are helping to disperse the oil and keep it from washing ashore in great quantities. But millions of gallons are already in the Gulf, and researchers said that in recent days they have discovered miles-long underwater plumes of oil that could poison and suffocate sea life across the food chain, with damage that could endure for a decade or more.
Tar balls have been sporadically washing up on beaches in several states, including Mississippi, where at least 60 have been found.Engineers finally got the contraption to siphon the oil working Sunday after several setbacks. BP PLC engineers remotely guiding robot submersibles had worked since Friday to place the tube into a 21-inch pipe nearly a mile below the sea.Crews will slowly increase how much the tube is collecting over the next few days. They need to move slowly because they don't want too much frigid seawater entering the pipe, which could combine with gases to form the same ice-like crystals that doomed the previous containment effort. As engineers worked to get a better handle on the spill, a researcher told The Associated Press that computer models show the oil may have already seeped into a powerful water stream known as the loop current, which could propel it into the Atlantic Ocean. A boat is being sent later this week to collect samples and learn more.This can't be passed off as it's not going to be a problem,said William Hogarth, dean of the University of South Florida's College of Marine Science.This is a very sensitive area. We are concerned with what happens in the Florida Keys.Hogarth said a computer model shows oil has already entered the loop current, while a second shows the oil is 3 miles from it — still dangerously close. The models are based on weather, ocean current and spill data from the U.S. Navy and the National Oceanic and Atmospheric Administration, among other sources.Hogarth said it's still too early to know what specific amounts of oil will make it to Florida, or what damage it might do to the sensitive Keys or beaches on Florida's Atlantic coast. He said claims by BP that the oil would be less damaging to the Keys after traveling over hundreds of miles from the spill site were not mollifying.
BP had previously said the tube, if successful, was expected to collect most of the oil gushing from the well. Officials still hope to collect most of it when the tube is working at full capacity.Once it reaches the tanker, the oil is being separated from the natural gas and sea water. The natural gas is being burned off, while the crude is being sent to oil terminals.Two setbacks over the weekend illustrate how delicate the effort is. Early Sunday, hours before a steady connection was made, engineers were able to suck a small amount of oil to the tanker, but the tube was dislodged. The previous day, equipment used to insert the tube into the gushing pipe at the ocean floor had to be hauled to the surface for readjustment.The first chance to choke off the flow for good should come in about a week. Engineers plan to shoot heavy mud into the crippled blowout preventer on top of the well, then permanently entomb the leak in concrete. If that doesn't work, crews also can shoot golf balls and knotted rope into the nooks and crannies of the device to plug it, Wells said.
The final choice to end the leak is a relief well, but it is more than two months from completion.Top officials in President Barack Obama's administration cautioned that the tube is not a solution.We will not rest until BP permanently seals the wellhead, the spill is cleaned up, and the communities and natural resources of the Gulf Coast are restored and made whole,Secretary of Homeland Security Janet Napolitano and Secretary of the Interior Ken Salazar said in a joint statement.
Meanwhile, scientists warned of the effects of the oil that has already leaked into the Gulf.Researchers have found more underwater plumes of oil than they can count from the well, said Samantha Joye, a professor of marine sciences at the University of Georgia.The discovery of these plumes argues that a lot more oil and gas is coming out of that well every day, and I think everybody has gotten that fact except BP,she said. The hazards of the plume are twofold. Joye said the oil itself can prove toxic to fish, while vast amounts of oxygen are also being sucked from the water by microbes that eat oil. TEHRAN, Iran – Iran agreed Monday to a key big power demand, saying it was ready to ship much of its low-enriched uranium abroad — but immediately rolled out a new obstacle to compromise on its nuclear program by insisting it would continue enriching to higher levels.Tehran's decision to agree to export a large amount of its low-enriched uranium to Turkey after refusing to let it leave the country for more than half a year appeared to be an attempt to stave off a new set of looming U.N. sanctions — a doubtful endeavor, judging by initial reactions from Western nations spearheading attempts to deal with Iran's nuclear defiance.Britain's government said it was awaiting confirmation of the reports on Iran's deal, reached together with Turkey and Brazil, but insisted it remains committed to new sanctions against Tehran.Our position on Iran is unchanged at the present time, Steve Field, Prime Minister David Cameron's spokesman, told reporters.Iran has an obligation to reassure the international community, and until it does so, we will continue to work with our international partners on a sanctions resolution in the United Nations Security Council.In Washington, a U.S official also suggested that Iran's move was too little, too late.Iran will still have to take additional steps to assure the international community of its peaceful intentions, including complying with five U.N. Despite such Western reaction, Iran's move might give it a diplomatic victory by weakening growing resolve by Russia and China to support a fourth set of Security Council sanctions. Moscow and Beijing were responsible for watering down the language of previous anti-Iran sanctions but in recent months appeared to swing behind the U.S., Britain and France — the three other veto-wielding Security Council members — in their push for new U.N. penalties.Russian President Dmitry Medvedev cautiously welcomed the agreement but added that the deal may fail to fully satisfy the international community.As far as I understand from some Iranian official statements, it will continue such work. In that case, the international community's concerns could remain,he said during a trip to Ukraine.Additionally the deal moves Turkey and Brazil — two emerging regional powers and influential elected Security Council members — closer to Tehran, which has played up American dominance in world affairs in its efforts to woo key emerging nations suspicious of aspects of U.S. foreign policy.

Turkey hopes that this process will be supported by world countries without any setbacks,he told reporters in Baku, Azerbaijan. There would be no question of sanctions if all countries support this process.When tentatively agreed on seven months ago, the deal committing Iran to export most of its low-enriched stock was hailed by the West because it would have delayed Iran's ability to make a nuclear warheads by stripping it of the material it needs to make nuclear warheads.The proposal put forward now would see Iran ship out about 2,600 pounds, or 1,200 kilograms of low-enriched uranium — the same amount as under the tentative October agreement negotiated by the U.S., Russia, France and Iran and endorsed by the Vienna-based International Atomic Energy Agency.In October, exporting that much would have left Iran with less than the 1,000 kilograms, or 2,200 pounds, of material needed to make enough weapons grade uranium for a bomb. Since then, however, Iran has churned out enough additional low-enriched material to leave it with enough to make such a weapon even if it sends the originally agreed on amount abroad.In March, the IAEA said Iran's stockpile stood at around 2,100 kilograms. It has likely grown since then to an estimated 2,300 kilograms — about 5,000 pounds, or more than twice the commonly accepted amount needed to produce enough material for one bomb, according to David Albright of the Washington-based Institute for Science and International Security, which has tracked Iran for signs of covert proliferation.
From the West's point of view, that destroys much of the incentive for the agreement — and Iran's decision to continue its program to enrich to near 20 percent poses an even greater hurdle than the increase in its low-enriched stockpile. The original U.N. proposal called for the Iranian uranium stockpile to be sent to Russia to be further enriched to 20 percent, then turned into fuel rods to power a Tehran medical research reactor in Tehran that produces isotopes for cancer treatment. The material returned to Iran as fuel rods cannot be processed beyond its lower, safer levels. But after its failure to change the original terms of the fuel swap deal, Iran declared it would make its own research reactor fuel and began enriching to 20 percent four months ago. That rang international alarm bells because — although substantially below weapons grade — that material could be turned into the fissile core of nuclear warheads much more quickly than Tehran's larger stockpile of 3.5 percent, low-enriched uranium.The Iranian government on Monday said it would continue to do so, even if all sides agreed to its export offer.Of course, enrichment of uranium to 20 percent will continue inside Iran, Foreign Ministry spokesman Ramin Mehmanparast told the official news agency IRNA. Because agreement on a fuel swap, which would give Tehran the fuel rods for its research reactor, would negate Tehran's stated rationale to enrich to near 20 percent, its decision to continue no matter is bound to feed international suspicions.
There is no apparent civilian use for this material, the British Foreign Office said, adding that the decision to continue higher enrichment underlines Iran's disregard for efforts to engage it in serious negotiation.The U.S. official said Iran had no justification for continuing to enrich to near 20 percent. Iran, which claims its nuclear program is peaceful, had long insisted that any swap take place on domestic soil and only after it was given fuel rods. Alternately it said it was only ready to ship out its uranium in smaller amounts. Monday's deal was announced after talks between Brazil's president, Luiz Inacio Lula da Silva, Erdogan, the Turkish prime minister, and Iranian President Mahmoud Ahmadinejad in Tehran. If Iran does not receive the fuel rods within a year, Turkey will be required to quickly and unconditionally return the uranium to Iran, according to a joint declaration by the three nations. Iran feared that under the initial U.N. deal, if a swap fell through, its uranium stock could be seized permanently. Erdogan said that once Iran received the fuel rods, Turkey will hand the Iranian low-enriched uranium to whatever country provided the fuel. Still the agreement signed among the three countries did not specify that — an omission that could open the path to a possible claim by Iran.
The United Nations has already imposed three rounds of financial sanctions on Iran for its refusal to suspend uranium enrichment. The process is key to concerns over its program, because it can produce either low-enriched uranium needed to fuel a nuclear reactor or the highly enriched uranium needed to build a warhead. Iran first reached out to Turkey and Brazil in its efforts to avoid tougher U.N. sanctions for its refusal to stop enriching uranium altogether. Monday's deal was signed by the foreign ministers of the three countries. Mehmanparast said a letter will be sent to the IAEA within a week to pave the way for a final agreement.Should they be ready, an agreement will be signed between us and the group, he said, referring to the U.S., France, Russia and the IAEA.A month later, the uranium would be sent to Turkey, where it would be stored under IAEA and Iranian supervision, Mehmanparast said.Jahn reported from Vienna. No, it’s not just another beauty pageant.Donald Trump, Muslims (who mostly support Islamic terrorist groups, like Hezbollah, which features many of Fakih’s close relatives as top officials), and even Barack Obama will exploit this as propaganda for Islam. One of its auxiliary members won the Miss USA title without having to do a thing to denounce them and their bloody murder of hundreds of Americans, including the trampling/torture murder of Navy Diver Robert Dean Stethem aboard TWA flight 847, the 25th anniversary of which is next month.Dhimmi Donald Trump simply didn’t have the guts to demand that Fakih denounce the Islamic group Hezbollah, whose martyrs and top terrorists are Fakih family members. It doesn’t matter to the Donald that this is the terrorist group that murdered more Americans than any other after Al-Qaeda, and probably more, when you count its joint ventures with Hezbollah. Trump made a bigger deal with Miss California USA and her bimbo activities, when–hellooooo–it’s a bimbo contest. Now, Hezbollah has the chief USA bimbo. And they’ll use it.
I don’t just wonder if this whole contest is rigged. I have a feeling that it is. Clearly, there is affirmative action for Muslim women in beauty pageants and other such contests.We know that political correctness and bending over backward (and forward) to all things Islam, are the rules of the day. I had a bad feeling they’d pick her to try to pander to the Islamic world some more because–ya know–the collective American nose isn’t yet brown enough from ass-kissing Islamic butt all around the world . . . at least according to the conventional wisdom of idiots. The Islamic world is especially laughing that a sequined gay man dressed like the world’s ugliest cross-dresser, Johnny Weir, helped make a woman from their intolerant world, Miss USA. If they could, they’d still rip him to shreds and sever his penis, the way they torture their Israeli and even their own fellow Islamic victims.Tonight, they celebrated and laughed at us from within at Dearbornistan’s Hezbollah restaurant, La Pita, where workers openly sing Hezbollah war songs and anti-Semitic ditties in the kitchen. It was the site of Fakih’s victory party, where falafel, and hummus, and hate were all on the menu, as they usually are there and throughout Fakih’s community.
I wonder how much influence Miss USA’s Islamic sponsor Farouk Shami–the racist 9/11 Truther and Palestinian terrorism supporter whose Farouk Systems helped pay for the pageant and broadcast–had on this win. A lot, I’d bet, especially since Fakih tweeted gushingly about hanging out with him. He probably urged Trump and the judges to make sure his fellow Muslima won. After all, it makes no difference that she’s a Shi’ite and he’s a Sunni. She had the support of Sunni terrorists like Imad Hamad, who helped fund her bid. And, as anyone who knows anything about the Islamic world knows, they’ll happily put their internecine Shi’ite-Sunni war on hold, if it means helping Islam in its propaganda war and fight to take over the West.In her answer to a dumb question about insurance covering birth control, Fakih gave an even dumber answer. But it was a feminist, big government, anti-business, politically correct answer. And because she’s a Muslim, Fakih got away with her utterly conceited statement in a video profile: When people meet me, they see a very beautiful, very smart, very funny person.Hey, don’t be so modest. We gotta beat that fake notion of Islamic modesty that really doesn’t exist in the real world.
I knew the classy Miss Oklahoma USA, Elizabeth Woolard–who gave a good and somewhat educated answer about Arizona’s immigration law (watch the video, above)–would lose, the minute she said she supported the Arizona law. After all, the right answer was to say how unAmerican and oppressive this law is and how great these illegal aliens are for doing the work that some Americans just won’t do (like kidnapping, rape, stealing jobs, and driving down wages). It doesn’t matter that the question–uttered by judge Oscar Nunez–was incorrect, since his premise was that the law allows authorities to check the immigration status of anyone they think is here illegally (That’s not what the law allows at all). Since she said the right thing for America and Arizona, not the politically correct answer to win Miss USA, she lost.Oh, and she wasn’t a Lebanese Muslim Hezbollah supporter with relatives who are top terrorists and martyrs in the group. If you don’t have relatives that have died killing some Jews and relatives who’ve murdered hundreds of Americans, you really don’t deserve to be Miss USA.

Oil prices continue to dramatically spiral downward. A decline in U.S. pump prices apparently will be more drawn out.Oil fell below $70 Monday for the first time since February due to concerns about the European economy and weakness in the euro. The price has dropped nearly 20 percent since hitting an 18-month high of $87.15 a barrel during trading on May 3.The decline is expected to soon reduce consumers' gasoline bill. But so far, the cost of a gallon of gas has fallen just 2 percent nationwide since peaking earlier this month at $2.929 per gallon. That pace should pick up heading into the Memorial Day weekend and the summer driving season.Prices in many markets in the U.S. will be $2.75 per gallon or lower by next week, said Tom Kloza of the Oil Price Information Service.It's a bit of a Decoration Day present for consumers, but also for petroleum marketers, and even refiners, Kloza said.
Kloza said the only losers from lower crude prices will be oil producers, but they still will make plenty of money at current prices.Gasoline prices fell 0.5 cents overnight to a national average of $2.867 per gallon, according to auto club AAA, Wright Express and OPIS. Prices have dropped 4.1 cents in the past week and 6.2 cents since peaking May 6 at their highest point since October 2008. Price remain 55.9 cents higher than a year ago, but the gap is narrowing.The Energy Information Administration will release its weekly survey of gasoline prices later Monday.Oil prices have tumbled in the past two weeks on the European debt crisis and as supplies of oil continue to grow. The debt crisis has weakened the euro, which hit a four-year low against the dollar Monday.Because oil is priced in dollars, it becomes more expensive for investors holding other currencies.On Monday, benchmark crude for June delivery dropped $1.85 to $69.76 a barrel on the New York Mercantile Exchange, the first time it has been below $70 in four months. That followed a plunge in the June contract of $2.79, almost 4 percent, to $71.61 on Friday.The oil spill in the Gulf of Mexico has done nothing to slow the drop in crude prices and, so far, has not interfered with tankers carrying imported crude to Gulf ports or those taking refined products from there to other parts of the country. BRUSSELS – Germany is pushing the other countries that use the euro to swiftly cut budget deficits as the only way Europe's battered currency union can restore confidence and climb out of a debt crisis that threatens to wreck it.German Finance Minister Wolfgang Schaeuble told reporters Monday at a meeting of finance officials from the 16 eurozone countries that getting their deficits down was the only task that everyone has to fulfill for himself and for the common good.Germany, Europe's largest economy, is providing the largest chunk of a euro110 billion bailout for Greece and a euro750 billion ($1 trillion) rescue package for other euro nations. German voters and politicians have bridled at bailing out freespending governments.
Chancellor Angela Merkel has already demanded — and won — promises of harsh cutbacks from near-bankrupt Greece in return. And Germany wants other vulnerable countries, such as Portugal, to slash spending to make sure that they won't require a bailout funded by other euro members.The euro traded near four-year lows Monday at $1.2328 amid warnings from European leaders that the loan backstop announced last week to prop up troubled eurozone economies would not be enough to defuse market worries over the regions's ballooning debt.The fund, agreed with the International Monetary Fund, initially calmed markets when it was announced last week. But that euphoria has worn off because of doubts that European governments can reduce swelling debt levels — despite promises from Spain and Portugal to step up debt-cutting efforts.
Eurozone finance ministers are holding their first talks on suggestions put forward by the EU executive to toughen the fundamental rules that govern their 11-year-old currency. It says countries should oversee each others' economies — and review budgets together before they are approved by national parliaments — to prevent governments spending their way into trouble and calling for a bailout, as Greece is doing.Ireland has the biggest deficit in the eurozone at 14.3 percent of gross domestic product, although it has won more market confidence by making quick cutbacks. Greece follows at 13.6 percent, Spain at 11.2 percent, and Portugal at 9.4 percent. LONDON – Three of Europe's busiest airports reopened Monday afternoon after a dense volcanic ash cloud from Iceland dissipated and a no-fly zone was lifted. Up to 1,000 flights in Europe were affected by the closures.Flights were landing and taking off from London's Heathrow and Gatwick airports and Amsterdam's Schiphol Airport, but all three warned travelers it would take time for airlines to clear the backlog of delayed flights and to contact their airlines before going to the airport.
Eurocontrol, the continent's air traffic control agency, said 28,000 flights were expected Monday in Europe, about 1,000 less than normal, mainly due to the disruptions in Britain and the Netherlands.Icelandic civil protection official Agust Gunnar Gylfason said the ash cloud was traveling to the north, forcing airports in Keflavik and Reykjavik to close. He said seismic activity at the volcano was unchanged.All British, Scottish and Irish airspace was open at least until early Tuesday, but airspace over the North Sea was still restricted, affecting some helicopter operations.British Airways chief executive Willie Walsh — facing a fresh wave of strikes by cabin crews on Tuesday — called the latest airspace closures a gross overreaction to a very minor risk.I am very concerned that we have decisions on opening and closing of airports based on a theoretical model, he said.There was no evidence of ash in the skies over London today yet Heathrow was closed.Aviation officials have defended the decision to impose the no-fly zone, saying airline representatives and engine manufacturers last week had agreed to find a way to ensure planes could fly safely in the volcanic ash.
Britain's transportation minister, Philip Hammond, said aircraft manufacturers were examining evidence to see what inspection regimes they can put in place that would allow safe flying through a somewhat higher threshold of ash.If we can do that, the likelihood of volcanic ash disrupting flights will obviously diminish,he said.
Germany sent up two test flights Sunday to measure the ash cloud, but there was no word yet on the results of those tests. Still, Germany said Monday the latest ash cloud should not affect its airports.At this time, the concentration of ash above German air space is so low that there are no reductions in air traffic, German Air Traffic Controllers said.Ash can clog jet engines. The April 14 eruption at Iceland's Eyjafjallajokul volcano forced most countries in northern Europe to shut their airspace between April 15-20, grounding more than 100,000 flights and an estimated 10 million travelers worldwide. The shutdown cost airlines more than $2 billion.Last week, the European air safety agency proposed drastically narrowing the continent's no-fly zone because of volcanic ash to one similar to that used in the U.S. The proposal still must be approved.Eurostar added four extra trains Monday — an additional 3,500 seats — between London and Paris to help travelers cope.

PIEDRAS NEGRAS, Mexico – Four young men have been found decapitated in northern Mexico.Durango state police say the heads were found on the hood of a pickup truck left in a shopping center parking lot in the city of Gomez Palacio late Saturday.A Durango state police officer spoke on condition of anonymity because he is not allowed to discuss the case. He says the bodies were found in the truck bed.A message on the windshield allegedly signed by the Zetas gang said the victims were involved in an attack at a bar in the neighboring city of Torreon that killed eight people earlier Saturday.The officer said Sunday that relatives told authorities the four men killed, ages 18 to 20, were university students in Gomez Palacio.

Slug-eating dare sparks Australia health alarm

SYDNEY (AFP) – Australian health authorities Thursday warned people against eating raw slugs after a man who reportedly ingested one as a dare became critically ill with a rare form of meningitis.New South Wales health officials issued the warning following media reports that a 21-year-old man had been hospitalised with rat lung worm meningitis after a prank in which he swallowed a garden slug.Normally found in Asia and the Pacific islands, the parasite was carried by snails and slugs which had eaten the faeces of infected rodents, and cases in Australia were rare, said communicable diseases chief Jeremy McAnulty.In the past, this sometimes has happened after a person has been dared to eat a slug or snail, McAnulty said in a public health alert.You should not eat raw slugs or snails and other animals, and ensure that you wash your hands after touching them.Most infected people would only suffer mild, short-lived symptoms, but McAnulty said some could fall seriously ill.Even if infected, most people recover fully without treatment. However, it can sometimes cause severe meningitis,he said.Because humans were not the natural host of the parasite, McAnulty said it eventually died without treatment and could not be passed from person to person.
