The general counsel of the National Security Agency testified to a Senate hearing yesterday that he believes the agency has the authority to track Americans via cell phones.There are certain circumstances where that authority may exist, said Matthew Olsen the current nominee to head up the National Counterterrorism Center.Olsen made the comments to the Senate Select Committee on Intelligence as Sen. Ron Wyden (D., Ore.) repeatedly asked if the government has the authority to use cell site data to track the location of Americans inside the country.Olsen added that the reason his answer was not definitive was that it is a very complicated question, assuring the committee that the NSA would provide more information in a future memo.Sen. Wyden recently wrote (full letter below) to the Director of National Intelligence demanding to know whether the CIA and the NSA have the authority to collect the geolocation information of American citizens for intelligence purposes.If yes, please explain the specific statutory basis for this authority, the letter, co signed by Sen. Mark Udall (D., Colo.) states.The Senators also requested information on how many Americans have been monitored under authority granted by 2008 legislation amending the Foreign Intelligence Surveillance Act. Have any apparently law-abiding Americans had their communications collected by the government? the letter asks.Two months ago Wyden expressed concern that the law relating to surveillance is unclear. The law is being secretly interpreted by the executive branch Wyden noted.Along with Congressman Jason Chaffetz (R., Utah), Wyden has introduced a joint bill that would force any government agency to secure a search warrant and show probable cause before tracking the location of any American.

The issue of cell phone tracking blew up earlier this year when it was revealed that computer researchers discovered a hidden file that allows Apple to track the location of iPhone and iPad users. Google’s collection of location from cellphones has also been open to question.As we have previously highlighted, however, since October 2001, the FCC has mandated that all wireless carriers track the location of their users down to within 50 feet.Under the 1996 Telecommunications Act, the FCC mandated that by October 1, 2001 a quarter of all new cellphones be equipped with GPS functionality that would allow authorities to track the location of users. By the end of 2002, this became a mandatory requirement of allnew cellphones.As Geek.com reported back in October 2001, Because cellphone calls to 911 (estimated at around 140,000 per year) do not give the 911 operator location information, the FCC mandated that wireless companies be able to locate 67 percent of callers to 911 within 50 meters that elect the handset solution while those using network technology must be able to locate the caller within 100 meters.” Wireless companies must also have one-quarter of the new cellphones they offer equipped to provide that location information by the end of the year, and all new cellphones so equipped by the end of next year.As a PC World article written in August 2001, two months before the first phase of the new FCC rules were enacted, asked, The FCC requires cell phone companies to track you, in order to find you when you call 911–but what about your privacy? Cell phone tracking was propelled by the Federal Communications Commission, which adopted enhanced 911 rules to cover wireless services. For E911′s first phase, cellular carriers must be able to pinpoint, to the nearest cell tower, the location of someone calling 911. For Phase II, carriers must be able to pinpoint a 911 caller’s location to within 50 to 300 meters,states the article.

We believe that the debate over these initiatives will be better informed if Congress and the public are provided with more unclassified information about how these initiatives will affect current intelligence authorities and activities.The FISA Amendments Act of 2008 significantly modified the US government’s surveillance authorities with regard to individuals believed to be located outside the United States. These new authorities are currently scheduled to expire in late 2012, and Congress could begin considering possible extensions or revisions to these authorities later this year. Since any thorough consideration will require an understanding of how the FISA Amendments Act has been interpreted and implemented, we ask that you provide unclassified answers to the following questions:

• In a December 2007 Statement of Administration Policy on the FISA Amendments Act, the Office of Management and Budget said that it would likely be impossible to count the number of people located in the United States whose communications were reviewed by the government pursuant to the FISA Amendments Act. Is this still the case? If so, is it possible to estimate this number with any accuracy?

• Official documents released in 2010 noted that there have been multiple incidents in which intelligence agency personnel have failed to comply with the FISA Amendments Act, and that Certain types of compliance incidents continue[d] to occur. Please elaborate on these compliance incidents to the extent possible, and explain why you believe that they have continued to recur.

• Have any apparently law-abiding Americans had their communications collected by the government pursuant to the FISA Amendments Act?

• Are any significant interpretations of the FISA Amendments Act currently classified?

Turning to another area of surveillance law, recent advances in geolocation technology have made it increasingly easy to secretly track the movements and whereabouts of individual Americans on an ongoing, 24/7 basis. Law enforcement agencies have relied on a variety of different methods to conduct this sort of electronic surveillance, including the acquisition of cell phone mobility data from communications companies as well as the use of tracking devices covertly installed by the law enforcement agencies themselves.Unfortunately, the law has not kept up with these advances in technology. As a result, courts in different jurisdictions have issued diverse, conflicting rulings about the evidence and procedures required for the government to surreptitiously track an individual’s movements using a mobile electronic device. Congress is now considering multiple legislative proposals that would attempt to establish clear rules for this sort of surveillance and will need to determine at some point whether it is necessary to update the laws that apply to intelligence investigations as well as the laws that apply to law enforcement investigations.While there is a substantial amount of public information available regarding different interpretations of this area of the law (including the executive branch’s interpretation and the interpretations of various courts) all of these interpretations apply to law enforcement authorities, not intelligence authorities. Clearly Congress needs to also understand how intelligence authorities are being interpreted as it begins to consider legislation on this issue. For this reason, we request that you also provide unclassified answers to the following questions:

• Do government agencies have the authority to collect the geolocation information of American citizens for intelligence purposes?

• If yes, please explain the specific statutory basis for this authority. And to the extent that this statutory basis imposes any procedural requirements, such as judicial review or approval by particular officials, please describe these requirements.

• If no, please explain the statutory basis for this prohibition.

The manuscript describes Breivik’s mentor as an Englishman he identifies as Richard. Breivik mentions a 2002 London meeting where a group of fellow extremists gathered to reform the Knights Templar Europe, a military group whose purpose was to seize political and military control of western European countries and implement a cultural conservative political agenda, according to The Guardian.The manuscript attributed to Breivik describes the meeting attendants as business or political leaders, some with families, most Christian conservatives, but also some agnostics and even atheists.It claims participants came from across Europe and that his contact with them was arranged by a Serbian crusader commander.The alleged connection to the English Defense League was claimed after it was revealed that Breivik visited London last year and met with them.Stephen Lennon of the EDL told the media that his group is not connected to Breivik and the corporate media is cherry-picking what they want to fit their agenda and demonizing our organization.

While publicly fearmongering about a new great depression, the sun failing to rise, and the sky falling if the debt ceiling is not hiked, the Obama administration has been secretly telling big banks that there’s no chance of a default, echoing how the 2008 bailout was sold on hyped threats and intimidation of lawmakers.The rhetoric was heightened yesterday when White House Communications Director Dan Pfeiffer warned that the GOP’s inability to compromise could potentially put us towards a depression, adding, we are seven days away from an unprecedented financial event in this country’s history.Treasury Secretary Tim Geithner, who has been busy hyping the inevitability of a default for weeks, again told news shows Sunday that the government would be unable to pay its bills if an agreement is not reached, a talking point that has been enthusiastically parroted by President Obama.However, that tone doesn’t quite match with what the Obama administration is simultaneously telling top executives at major U.S. banks, assuring them that such an event won’t happen.In a series of phone calls, administration officials have told bankers that the administration will not allow a default to happen even if the debt cap isn’t raised by the August 2 date Treasury Secretary Tim Geithner says the government will run out of money to pay all its bills, including obligations to bond holders, reports Fox Business.Once again, while striking fear into lawmakers and the American public by stoking fearmongering about the inevitability of a catastrophic collapse, the administration is fully aware that the system, maintained as it is by a fraudulent debt-based fiat money system, can always be kept artificially inflated for that bit longer.Indeed, the doomsday rhetoric is likely to be nothing more than a ploy to increase the administration’s bargaining power and its bid to seize the power of the purse from Congress. We saw an almost identical tactic used during the 2008 bailout debate, which was eventually rammed through on the back of bellicose threats about martial law and economic armageddon.

As Senator James Inhofe revealed, then Treasury Secretary Hank Paulson told members of Congress the crisis would be far worse than the great depression if Congress didn’t authorize the bill to buy out toxic debt, a proposal which he abandoned the day after he got the money,added Inhofe, referring to how immediately after it was approved, Paulson announced that the bailout money would not be used to buy up toxic debt but would instead be injected directly into banks like Goldman Sachs, of which he was a former CEO.Lawmakers were strong-armed into passing the bailout after being threatened that they would be responsible for a financial holocaust, a crisis of unimaginable proportions. Nearly three years later, we’re hearing the same rhetoric.
As former Treasury Secretary Paul Craig Roberts has outlined, the whole debate over raising the debt ceiling is largely a punch and judy puppet show. As top global ratings agencies have confirmed, the U.S. is already technically in default because it has deliberately depreciated the dollar against other currencies as a means of artificially keeping its head above water.Labeling the whole process political theater, Roberts warns that the outcome of the debacle could be Congress losing the power of the purse, which is enshrined in the constitution.The consequences would be that the power of the purse would transfer from Congress to the President. It would be the end of the power of Congress. Congress, Republicans and Democrats alike, have already given away to the President Congress’ Constitutional right to decide whether the country goes to war. Now Congress would lose its power over debt, taxes, and the budget itself,writes Roberts.Given the fact that lawmakers like Republican Senator Mitch McConnell have openly advocated the idea of handing such powers over to the President in the name of solving the debt problem, a proposal Senate Majority Leader Harry Reid has said he will seriously consider, many in Washington would see this fallout as a useful way of expanding the power of the executive branch.

EUOBSERVER / COMPETA - The US has quietly imposed a visa ban on Russian officials believed to have played a part in the murder of lawyer Sergey Magnitsky, posing questions about EU handling of the affair.A state department memo confirms that most or all of the 60 officials implicated in the Magnitsky conspiracy have been red-flagged in the Consular Lookout and Support System (CLASS), a namecheck database used to give or decline visas.The non-public memo, dated 22 July, says: [US secretary of state Hilary] Clinton has applied existing laws and authorities to implement the visa limitations on multiple individuals associated with the wrongful death of Sergey Magnitsky.It adds:Individuals included on the list ... are already flagged in the visa adjudication (known as CLASS) system used by visa officers.The list includes judges, interior ministry officials and secret service personnel said to have embezzled hundreds of millions of euros of Russian tax money and then murdered Magnitsky when he exposed the scam.Two top names are Olga Stepanova, the 48-year-old head of the Moscow tax authority, and Viktor Voronin, the 53-year-old chief of the Russian secret service's (FSB's) economic espionage unit.The US normally imposes sanctions with some fanfare, as with Libya and Syria. But the Magnitsky move was kept quiet in order not to create a diplomatic row.The memo was sent to senators working on a bill which could give Congress new powers to request travel bans and asset freezes on foreign human rights abusers. The memo noted that the so-called Magnitsky bill could provoke a retaliation.

It says: Senior Russian government officials have warned us that they will respond asymmetrically if this legislation passes. Their argument is that we cannot expect them to be our partner in supporting sanctions against countries like Iran, North Korea, and Libya, and sanction them at the same time. Russian officials have said that other areas of bilateral co-operation, including on transit to Afghanistan, could be jeopardised if this legislation passes.Heidi Hautala, Finland's minister for international development and until recently the European Parliament's top deputy on human rights, told this website that EU capitals should follow Washington's lead.It's a very smart solution because it targets the real perpetrators and not the whole country, she said.The time has come for new [EU] targeted sanctions on the American model - it could also be a low-key solution, put in place by one of the Schengen countries.Under the rules of the EU's passport-free Schengen zone - which covers 22 EU countries plus Iceland, Norway and Switzerland - if any one Schengen state red-flags a name all 25 must refuse that person a visa.

EUOBSERVER / BRUSSELS - Spanish Prime Minister Jose Luis Rodriguez Zapatero on Monday (25 July) called for a common EU response to fight xenophobia, echoing similar remarks by German chancellor Merkel and home affairs commissioner Malmstrom in the wake of the Norway killings.This is something extremely serious that requires a response, a European response, a shared response to defend freedom, to defend democracy, calling on people to rise up and fight radicalism, to respond against xenophobia,Zapatero said in a press conference in London after meeting his British counterpart.The Spanish leader, whose country went through the trauma of terrorist bombings in 2004, said that the twin attacks carried out by the self-confessed killer Anders Behring Breivik is one of the most worrying and serious events that we have ever seen take place on European soil.Where we have seen this upsurge or rebirth of xenophobic ideas, when we have seen that happening in our old democratic Europe, then we have to react quickly. We can't let time go by and let that carry on,Zapatero added.The 32-year old Breivik confessed to have carried out the bombing in central Oslo claiming the lives of at least eight people and the shooting spree on a nearby island where he machine-gunned 68 persons, mostly teenagers. In a court hearing behind close doors, he argued this was necessary in order to save Norway and Europe from Marxist and Muslim colonisation, the judge on his case said Monday.

Breivik has admitted to the actions, but denies criminal responsibility for them, with his lawyer saying that he has a completely different perception of reality than other people. Two psychiatrists have been assigned to assess his mental health.The judge decided to put him in solitary confinement for four weeks, with no access to newspapers or letters, in order to prevent him from having the media platform he wanted to have to propagate his xenophobic ideas.If convicted of terrorism, he faces the maximum sentence in Norway - 21 years in prison which can be prolonged indefinitely every five years if he poses a serious threat to society.The UK authorities are looking into the alleged links with British right-wing groups, as outlined in his 1500-page manifesto posted online a few days before the attacks.But according to Norwegian police sources quoted by Reuters, the attacks appear to have been carried out without accomplices.German chancellor Angela Merkel, herself identified as a target in Breivik's killing manual, on Sunday also urged an increase in efforts to fight xenophobia. This hatred [of foreigners] is our common enemy, she said.And home affairs commissioner Cecilia Malmstrom, herself from Norway's neighbouring Sweden, also a country hit by a terrorist attack last year, said that Breivik's manifesto is a product of a very disturbed man, but unfortunately we recognise some of these sentiments in Europe today.I have many times expressed my concern over xenophobic parties who build their unfortunately quite successful rhetoric on negative opinions on Islam and other so called threats against society. This creates a very negative environment, and sadly there are too few leaders today who stand up for diversity and for the importance of having open, democratic, and tolerant societies where everybody is welcome,she said in a post on her personal blog.

EUOBSERVER / BRUSSELS - Just days after leaders made what they termed an historic agreement in a bid to draw a line under the eurozone debt crisis, the markets indicated there is still concern about the fundamentals of the deal.Spain and Italy's funding costs rose on Monday (25 July) to levels higher than when the first details of the deal became apparent during last week's emergency summit of EU leaders in Brussels.According to the Wall Street Journal, Spain's debt on Monday afternoon was being traded at a yield of 6 percent, or 3.24 percentage points above the rate on German bonds, seen as a safe investment. Italy's debt was being traded at a yield of 5.5 percent.During Thursday's summit, the borrowing costs for Spain were 5.7 percent and 5.2 percent for Italy, down from the highs at the beginning of last week of 6.3 percent and 5.8 percent respectively.EU leaders hammered out an agreement on a second €109bn bailout for Greece as well as loosened the rules for the use of the eurozone rescue fund, giving it a more preemptive role.However, once the smoke cleared around the general relief that leaders had managed to forge a deal, the details raised further questions.Chief among the concerns is that although the rescue fund was made more flexible, its funds were not increased. The €440bn in the pot are not sufficient for bailing out Italy and Spain, the single currency area's third and fourth largest economies.Meanwhile, there are still big question marks over aspects of the Greek agreement. Its success will depend on whether Athens is able to raise the €28bn over three years from a privatisation drive - sceptics say it won't.

MOSCOW (Reuters) - Russian Prime Minister Vladimir Putin is close to a decision to bid for the presidency in an election next year because he has doubts about his protege, President Dmitry Medvedev, senior political sources say.Putin ruled as president from 2000 to 2008 before handing over to Medvedev to comply with a constitutional ban on a third consecutive term. He will be free to run in the March presidential election.Putin, 58, and Medvedev, 45, have repeatedly refused to say which of them will run but as Russia's paramount leader, officials and diplomats say the decision is Putin's.I think Putin is going to run, that he has already decided to, said a highly placed source who spoke on condition of anonymity because of the delicacy of the political situation.The source said Putin had been troubled by the perception that his protege, whom he has known for more than two decades, did not have sufficient support among the political and business elite or the electorate to ensure stability if he pushed ahead with plans for political reform.Putin has much more support from the people than Medvedev. Medvedev has overestimated his weight inside the system, he said.Another highly placed source who declined to be identified said: Putin wants to return, really wants to return.The source said an attempt by Medvedev to assert his authority in recent months had unsettled Putin, but the two leaders communicated well on a regular basis.

A third source also said Putin was thinking of running and that if he became president he could appoint a reformist prime minister, an apparent attempt to dispel fears that his return would usher in a period of stagnation two decades after the fall of the Soviet Union in 1991.Investors see few differences between the two leaders' policies but many say privately that Medvedev would be more likely to carry out reforms than Putin.Medvedev's spokeswoman, Natalya Timakova, dismissed talk of any discord between them.I do not quite understand where these rumors come from because the president and the prime minister communicate not only on formal issues, but informally too, Timakova said.A senior Kremlin source said it was up to the people, not the elite, who ruled Russia.The discussion should be not about support within the elite but about who has more support from the people, the Kremlin source said. Hizbullah leader Hasan Nasrallah warned Israel on Tuesday against any attempt to encroach on Lebanon’s territorial waters, The Beirut Daily Star reported.In a video speech he gave as part of a rally marking the fifth anniversary of the 2006 Second Lebanon War, Nasrallah stressed that his group was better equipped and ready to confront any act of aggression by Israel than at any time before.Whoever harms our future oil facilities has their own [facilities] and consequently will face the same damage,Nasrallah warned, adding, They know that Lebanon is capable of such damage.
He added,As long as Lebanon considers [the disputed area] the 850 square kilometer zone as part of its territorial waters, then the resistance considers it Lebanese and therefore it is no longer disputed but an area that is encroached upon.Lebanon has a diplomatic opportunity to gain it back through demarcating its maritime borders and we warn Israel not to attempt to steal this area or Lebanon’s resources from its territorial waters ... It is necessary to warn Israel,Nasrallah said.Israel and Lebanon have been at odds over a disputed maritime border between the two countries. The Israeli Cabinet recently approved a marine economic zone proposal after Lebanon presented maps to the United Nations, marking maritime borders that would include part of the giant Leviathan and Tamar fields. The United Nations previously has refused to take responsibility for marking the maritime borders.

Israeli firms discovered the two gas fields, which also are believed to hold large commercially viable oil deposits, two years ago. Lebanon later claimed the discoveries are in its territory, and it recently has announced that a Norwegian company will start a seismic research offshore.Lebanese Minister of Energy and Water Joubran Bassil said after Israel defined the maritime border that it is playing with fire by violating Lebanon’s maritime border and oil rights.He added, Obviously we will prevent any violation. However, in case of violations, Israel will not be the only damaged part, but also large companies that cooperate with it. We, in Lebanon, respect the rights of others, and we don’t want to violate the rights of others, but at the same time, we do not want someone to attack us. Slow Philippine storm leaves 25 dead, 31 missing

MANILA, Philippines – Heavy rains and floods battered the northeastern Philippines for a third day Wednesday, swamping homes of about a half million people and raising the death toll to at least 25 with 31 others missing.Waist-deep floodwaters swamped the houses of nearly half of the population of eastern Albay province after Tropical Storm Nock-ten set off pounding rains since Monday and sent residents to seek shelter in churches and village halls, said Gov. Joey Salceda.Regional civil defense chief Rafaelito Alejandro said floodwaters in Albay started to subside by noon Wednesday after the storm made landfall in Aurora, about 230 miles (370 kilometers) to the north. It packed maximum winds of 59 miles (95 kilometers) per hour and gusts of up to 75 mph (120 kph).Alejandro said at least 20 people died in the Bicol region, which includes Albay. Eight of those were buried in landslides in Albay's Polangui township and in nearby Camarines Norte province.Other fatalities included a mother who was bitten by a poisonous snake that was swept into her home by a flashflood near the Albay provincial capital of Legazpi.National civil defense administrator Benito Ramos said two others drowned in Cavite province just south of Manila and one each in the provinces of Quezon, Marinduque and Iloilo.Most of the missing are poor fishermen who ventured out to sea despite the stormy weather.

A fishing boat with 32 men on board capsized in rough waters off central Masbate province early Wednesday. Ten fishermen were rescued but the coast guard has not found the others, bringing the number of missing in the storm to 31, Ramos said.The storm weakened slightly after hitting land, said forecaster Sonny Pajarilla. It is expected to blow out of the country to the South China Sea by Thursday after cutting through the heart of Luzon Island.Authorities cut off electricity to most of the region to prevent electrocutions, Ramos said.One of the victims during the power outage was Salceda's mother, who fell on her head after slipping in the dark bathroom, Alejandro said, adding that she wasn't counted as a storm fatality.Power was restored in Legazpi and most of the other provincial urban centers later Wednesday. Rains, mudslides kill 32, cause havoc in SKorea

SEOUL, South Korea – Walls of mud barreling down a hill buried 10 college students sleeping in a resort cabin and flash floods submerged the streets and subway stations in Seoul, killing at least 32 people Wednesday in South Korea's heaviest rains this year.The students were engulfed by a landslide in Chuncheon, about 68 miles (110 kilometers) northeast of Seoul, said fire marshal Byun In-soo. A married couple and a convenience store owner also died.Witnesses interviewed on television said the landslide sounded like a massive explosion or a freight train. They described people screaming as buildings were carried away by rivers of mud.About 670 firefighters, soldiers, police and others rushed to rescue those trapped and extract the dead from the mud and wreckage in Chuncheon, where 24 others were injured and several buildings destroyed.In southern Seoul, 16 people died when mud crashed through homes at the foot of a mountain, the National Emergency Management Agency said. Three others also died after a stream just south of the capital flooded, and 10 people were reported missing throughout the country, the agency said in a statement.Fast-moving mudwaters filled the streets in Seoul on Wednesday, sending residents scrambling to the roofs of their partially submerged cars.Water filled some subway stations and spewed from sewers. TV images showed people in one flooded subway station using shovels, brooms and a wooden board in an effort to keep more rain from coming in.

Footage showed officials rescuing hikers stranded on mountainsides. People plodded down streets covered with knee-deep water, many barefoot, their pants rolled up. TSA introduces new technology to protect privacy

WASHINGTON – The Transportation Security Administration says it's installing new technology in some U.S. airports so when a traveler goes through checkpoint security, a generic outline of a person's body will be shown instead of the image of a naked body.The agency says the change is intended to protect travelers' privacy rights while securing commercial air travel. It will be used in 40 airports, including in Chicago, Dallas, Detroit, Miami and Newark.The new software is designed to recognize items on the passenger that could pose a security threat.The agency plans to eventually use this technology for more machines at more airports.The whole body imaging machines have sparked outrage among passengers and privacy advocates because they reveal images of naked bodies.On the Web:
