The winning candidate will require the unanimous support of all 27 EU member states when the position is discussed, possibly as early as this week at the EU summit in Brussels.Poland set out its strong preference for a quiet consensus-builder who will not try to aggrandise the post.The president of the European Council, apart from chairing sessions, should concentrate on ensuring the continuity of its works and on building consensus among representatives of member states,the Polish document reads.His or her authority should not be extended through non-treaty measures.As the largest former eastern bloc country, its clear view may also have an impact on others in the region. Although he is yet to publicly declare himself for the job, Mr Blair is thought to be keen to take on the role which would make him a figurehead for the EU around the world and well as a £247,000 a year salary, a £37,000 housing allowance and other perks.

Belgium, the Netherlands and Luxembourg have made clear that they want a chairman type president, a low-key figure who will not eclipse the role of smaller countries. They favour either the former Belgian prime minister, Guy Verhofstadt, or the Dutch prime minister, Jan Peter Balkenende.Also hostile to a powerful presidential figure - apparently ruling out Mr Blair - are Austria and Sweden. A senior source at Sweden's permanent representation to the EU said Fredrik Reinfeldt, the country's prime minister, is thought to favour a technocrat, fearing that a big hitter like Blair would cause utter confusion between the EU's different presidencies.Franz Fischler, Austria's former EU commissioner, said: Blair would want to assert himself against the commission and that, naturally, would create conflict with the other presidencies.Spain and Portugal are expected to endorse the credentials of Felipe Gonzalez, a former Spanish prime minister. A well-placed Spanish official in Brussels said: Blair comes with too much baggage whereas Gonzalez would be far more of a consensus-seeker. He has the negotiating skills necessary for the post.
Germany's chancellor, Angela Merkell, acknowledges Mr Blair's merits but favours Jean-Claude Juncker, of Luxembourg, while Nicolas Sarkozy, the French president, has expressed doubts because of Britain's absence from the single currency. Silvio Berlusconi, the Italian prime minister, is the only EU leader to have unambiguously backed the former Labour leader.In his interview, Mr Byrant said the time for arguing over the Lisbon Treaty had passed. He said the Tories, who continue to oppose the document, were living in cloud cuckoo land" on the issue, and accused Mr Cameron of lying by promising the British people a referendum on the treaty.The moment has passed for that. We have got 26 countries that have ratified the treaty now. The Tory position is inept, they haven't thought it through, and there is a fundamental deception at the heart of what they are saying. I think your readers will end up feeling deceived by Cameron over the question of a referendum. I would lay a very big wager that they will be very disappointed if there was a Cameron government because they wouldn't end up having a referendum.He said Mr Cameron's pledge that he will not let matters rest there was deliberately ambiguous, covering the fact that he would not be able to renegotiate. Either he's incompetent and he doesn't know this, or he knows and he's downright fibbing. He has got to come clean.

But the ASEAN summit was also marred by controversy over human rights.Abhisit Vejjajiva, the prime minister of host nation Thailand, said the leaders listened carefully and attentively to the plans set out by the Australian and Japanese premiers, but would not rush to any decision.What we emphasized was that it wasn’t all that important to decide on some kind of rigid structure at the moment, but to be aware that the regional architecture would continue to evolve,Abhisit said in his closing statement.
He said there would be a meeting in Australia in December to discuss Rudd’s plan and that the idea of an East Asian Community was moving forward in parallel with plans for a free trade area in the region.

More flexible

Rudd’s plan includes the direct involvement of the United States. The Japanese leader’s proposal, however, is more flexible, while still maintaining that Washington is a cornerstone of Japanese policy.What I detect across the region is an openness to a discussion about how we evolve our regional architecture into the future,Rudd told reporters before laying out his plan.I have not set an urgent timeline on this, I have in fact suggested a timeline of 2020,” he added. He would not say if his plans called for a common currency.

New model

Dream of integration

Vietnam is next chair

Germany's next EU commissioner is to be Guenther Oettinger, the minister president of Baden-Wuerttemberg, a politician with no European profile who did not expect to be offered the job.The announcement was made over the weekend following negotiations between Chancellor Angela Merkel's Christian Democrats (CDU) and the their future coalition partner, the Liberals (FDP).Mrs Merkel's decision surprised politicians both at home and in Brussels, having deviated from a widely quoted shortlist that had included interior minister Wolfgang Schaeuble and centre-right MEP Elmar Brok.

The 56-year old Mr Oettinger, who is an economics expert and originally studied law, has led the economically powerful region since 2005.He is not seen as being very close to the chancellor, who forced him to distance himself from remarks in 2007 when he played down the Nazi past of Hans Filbinger, one of his predecessors as minister president. German media portray the decision as Mrs Merkel seeking to remove him from the national stage after he became a thorn in her side over the years. Most recently, he crossed the chancellor by refusing to play ball on budget issues during the ongoing coalition negotiations. In Baden-Wuerttemberg itself, his popularity has been on the wane.The Financial Times Deutschland carried a piece on Sunday (25 October) headlined: Oettinger feels he has been dumped in Brussels.For his part, Mr Oettinger, who will take over from the social democrat Guenter Verheugen in charge of industry, said he was looking for the bigger economic picture,referring to his pending move to Brussels. He denied he was pressured to go the EU capital saying such offers are only made once.

Brussels taken by surprise

Brussels was apparently also wrong-footed. The Kolner Stadt-Anzeiger says EU commission president Jose Manuel Barroso, in charge of dealing out the portfolios to the various commissioners, telephoned German politicians in Brussels and asked what's all this about? EU interpreters may also be asking the same question in future. Mr Oettinger speaks a strong Swabian dialect, with his region making a play on the strength of the dialect and accent, which Germans from other regions find difficult to understand.Public relations posters for Baden-Wuerttemberg say: We can do everything except speak standard German [Wir koennen alles. Ausser Hochdeutsch)].

While Berlin will be looking for a strong portfolio in the next commission and like other capitals will be lobbying hard to this end, the decision ultimately lies with Mr Barroso.The commission's new lineup is set to be a hot topic when EU leaders gather for a summit in Brussels at the end of the week. Its current mandate runs out on 31 October. Delays in ratification of the Lisbon Treaty, a new set of EU institutional rules, in the Czech Republic is to see a late re-appointment of the EU executive, with member states keen to get the new team up and running as soon as possible.

CHA-AM, Thailand – Leaders of 16 Asian countries gave high priority Sunday to finding a new economic growth model to free half the world's population from merely serving as producers for the West, the Thai prime minister said.Prime Minister Abhisit Vejjajiva said the leaders gave such a search the utmost importance at the annual East Asian Summit, which concluded Sunday. He told a press conference that Asian nations would have to strengthen their domestic markets and further liberalize regional trade.The old growth model where, simply put, we have still to rely on consumption in the West for goods and services produced here will no longer serve us in the future,said Abhisit, who hosted the meeting.The East Asia Summit followed Saturday meetings of leaders from the 10-member Association of Southeast Asian Nations with heads of government from China, Japan and South Korea. Activists criticized the bloc for failing to take a tougher stand against one of the world's worst human rights offenders.

I'm not talking about a new Hollywood slasher film or a new line of grotesque costumes, but a possible political nightmare scenario in which the White House could be positioned to sell out U.S. sovereignty, shred the Constitution and leave you and yours to the whims of foreign powers. Flying deep under Washington's radar is an upcoming (December) global climate change conference in Copenhagen, Denmark, under the guise of the United Nations Framework Convention on Climate Change. Virtually nothing has been said about it from the White House. But then again, I'm sure they think, who could be against working together for climate change? It all sounds pretty politically benign, doesn't it? Global Warming or Global Governance? What the media refuse to tell you about so-called climate change.Not according to Lord Christopher Monckton, once science policy adviser to Lady Margaret Thatcher, who read the treaty and said the Copenhagen conference is a cover for the beginnings of a one-world government. Monckton spoke to the Minnesota Free Market Institute in St. Paul, Minn.:

I have read that treaty and what it says is this: that a world government is going to be created. The word government actually appears as the first of three purposes of the new entity. The second purpose is the transfer of wealth from the countries of the West to Third World countries, in satisfaction of what is called, coyly, climate debt – because we've been burning CO2 and they haven't. And we've been screwing up the climate and they haven't. And the third purpose of this new entity, this government, is enforcement. How many of you think the word election, or democracy or vote, or ballot occurs anywhere in the 200 pages of that treaty? Quite right, it doesn't appear once.Monckton then warned, if Obama signs the treaty, he would be flushing U.S. sovereignty down the global toilet. He cautioned, But, in the next few weeks, unless you stop it, your president will sign your freedom, your democracy and your prosperity away forever – and neither you nor any subsequent government you may elect would have any power whatsoever to take it back again.
Monckton further pointed out that, even though ratification of our president's signature on that treaty would take a 67 supermajority (two-thirds) of the Senate, it could pass a simple majority as an amendment to the cap-and-trade bill.

Politifact.com (as well as many Left-leaning blogs) quickly criticized Monckton's conclusions as conspiratorial and climate-skepticism rhetoric, based upon the notion that the treaty is a draft and not a finalized document. But the apologetic of Politifact.com leaves the impression that the current draft is the roughest of cuts, when in reality it is the result of seven sessions of deliberations and revisions from several subgroups, including representatives from developed and developing countries (parties),with a view to modifying it in the direction of consolidation and convergence.Like with Congress' drafts of Obamacare, should we not be concerned because the current draft of the treaty may not be the final version, especially when the present language smacks of an abandonment of the principles upon which our republic was founded? As I myself read through the latest draft of the 181-page treaty, I noticed many lines that could warrant Monckton's and others' concerns (I've added italics for emphasis):
PP.6 Intending to renew and strengthen the global partnership through the creation of new levels of cooperation among Parties, according to the principles of the Convention. (Page 6)
PP.7 Affirming a Shared Vision of a long-term goal to equitably, successfully and coherently integrate the ambitious efforts of all Parties. (Page 6)
PP.8 Recognizing that sustainable development is the first priority for developing countries. Therefore, that our commitment to a low carbon society would have to be linked to our development priorities, in accordance with the provisions of the Convention. (Page 6)
PP.13 Recognizing that current and potential climate change impacts require a shift in the global investment patterns and that criteria for financing allocation shall clearly respond to the priorities identified by the international community, with climate change stabilization being one of these priorities. (Page 6)
10. Led by developed country Parties, an economic transition is needed that shifts in order to adjust global economic growth patterns towards a sustainable low-emission economy … (Page 8)
20. In order to fulfill this shared vision, Parties have agreed to establish a coherent, cohesive and integrated system of financial and technology transfer mechanisms under the Convention and a follow up/compliance mechanism. (Page 10)

36. The new agreed post-2012 institutional arrangement and legal framework to be established for the implementation, monitoring, reporting and verification of the global cooperative action for mitigation, adaptation, technology and financing, should be set under the Convention. It should include a financial mechanism and a facilitative mechanism drawn up to facilitate the design, adoption and carrying out of public policies, as the prevailing instrument, to which the market rules and related dynamics should be subordinate, in order to assure the full, effective and sustained implementation of the Convention. (Page 18)
37. The new institutional arrangement will provide technical and financial support for developing countries in the following areas: (a) preparation, implementation and follow-up through monitoring, reporting and verification of nationally appropriate mitigation actions (NAMAs) by developing countries. These activities could include options to reduce emissions from deforestation and forest degradation (REDD); (b) preparation, implementation and follow-up of national adaptation programmes of action (NAPAs) or national communications in developing countries; (c) technology needs assessments (TNAs) for adaptation and mitigation under the NAMAs and the NAPAs or national communications of developing countries; (d) capacity-building and enabling environments for adaptation and mitigation in developing countries; (e) education, awareness raising and public participation, focused on youth, women and indigenous peoples; (f) design and implementation of adaptation programmes and projects; (g) support for all technological cycle phases: research and development (R&D), diffusion and transfer, including acquisition of technologies for adaptation and mitigation, including the purchase or flexibility of patents. 38. The scheme for the new institutional arrangement under the Convention will be based on three basic pillars: government; facilitative mechanism; and financial mechanism, and the basic organization of which will include the following … (Page 18)

52. Particular effort should be taken to enhance cooperation amongst intergovernmental organizations. (Page 47)
28. A global fund shall be established to support a global feed-in tariff programme, providing guaranteed purchase prices, over and above the retail energy price in developing countries. … The Global Fund shall aim at both inducing a shift to renewable energy without compromising development momentum in developing countries, and achieving economies of scale and a sustained reduction in the costs of generating renewable energy. (Page 138)
29. A special fund shall be established: (a) For the economic and social consequences of response measures … (b) To assist countries whose economies are highly dependent on income generated from the production, processing and export, and/or on consumption of fossil fuels … (Page 138)

That last point (No. 29) is one of the most shocking. Not only are developed countries (like the U.S.) mandated in this treaty to provide for developing countries despite global or financial crises (p. 11). After becoming the wealthiest nations on the planet from the production and sale of oil, like those in the Middle East, this global governing body will establish a special fund to give them financial aid when the world is no longer dependent upon their commodities! Are they kidding?! Now, if that isn't one powerful intergovernmental or global-governmental group overseeing and manipulating ours and others economic and political conditions, I don't know what is. Even if some of Lord Christopher Monckton's claims about the United Nations Framework Convention on Climate Change are overstated, concerns about the extent of this body's political power and global economic sway are no more conspiratorial than the concern for Al Gore's comments in July (2009) at Oxford that change will be driven through global governance.And does anyone doubt that our president, as a Nobel peace laureate who believes he can negotiate with terrorists and dictators, has a global desire for international coalescence? Or should it not concern us that at the G-20 conference he would push world leaders to reshape the global economy? If he is already selling our nation to communist countries like China via our skyrocketing national debt, how much more difficult would it be to progressively replace the tenets of our Constitution with principles of The Communist Manifesto? Have we already started?

I've been so flabbergasted lately by Washington's abandonment of our founder's vision and principles that I expanded (to more than 300 pages) the new paperback version of my No. 14 New York Times best-seller,Black Belt Patriotism (available in Jan. 2010). It includes new materials in every chapter explaining how, in just one year, the Obama administration has progressively dismantled our Constitution, buried our economy, forsaken our posterity, disintegrated our borders, abandoned our godly heritage, impaled the traditional family and crippled America's health and future. (Amended are also copies of the Ten Commandments, the Declaration of Independence and our Constitution.)One thing is certain: Obama wasn't kidding on the campaign trail when he said it's time for the U.S. to turn the page on its trivial culture wars. But who knew just how many pages he would be turning, even in his first year in office? Who knew he would actually swap the play books? But then again, I'm sure the White House just thinks I've been watching too much Fox News.

President Obama is on a path toward establishing a one-world government. This is the warning of Christopher Monckton, a former major policy adviser to British Prime Minister Margaret Thatcher. In December, world leaders will descend upon Copenhagen to sign a United Nations climate change treaty that will succeed the 1997 Kyoto Protocol, which is aimed at reducing greenhouse gases and set to expire in 2012. An agreement has been drafted. The goal of the Copenhagen treaty is to erect an international cap-and-trade regime to curb carbon dioxide (CO2) emissions, said to be responsible for man-made global warming. Recently, British Prime Minister Gordon Brown warned of a climate catastrophe - a rising wave of floods, droughts and shrinking food crops - unless the treaty is signed. Mr. Brown even said global warming would inflict more damage than both world wars and the Great Depression combined; the world has only several weeks to save itself from impending doom. If we do not reach a deal at this time, let us be in no doubt: once the damage from unchecked emissions growth is done, no retrospective global agreement, in some future period, can undo that choice,he said. Mr. Brown has thus outdone former Vice President Al Gore in fear-mongering and inciting public hysteria. Global-warming alarmists are using the myth of climate change to impose an embryonic socialist world government. Following the collapse of communism, the West's progressive elites desperately searched for a viable ideological alternative. They found it in environmentalism.

Although the Green movement wraps itself in the flag of empirical science, it represents the very opposite: a dogma that provides meaning and purpose to its rabid followers. The ideology justifies massive tax increases and government control of the economy; it seeks to cripple free enterprise and curtail market-driven growth. The Greens are poised to succeed where the Reds failed.The Copenhagen treaty must still be negotiated. Final agreement is far from certain, especially from emerging industrial powers like China, India and Brazil. Yet the draft version is clear about the treaty's essential elements. It calls for a massive transfer of wealth from the developed world to the developing world. The United States would be forced to spend billions of dollars a year in foreign aid to pay for a so-called climate debt - a provision to punish wealthy countries for having historically emitted large amounts of CO2, while compensating poor ones for not contributing to greenhouse gases.

The Copenhagen treaty seeks to implement a bureaucratic redistributionist agenda; it is a way for Third World kleptocracies to extort enormous sums of money from America and other rich nations.Moreover, Mr. Monckton points out that, in paragraph 38, Annex 1, the Copenhagen draft calls for a U.N.-created government responsible for taxation, enforcement and redistribution. In other words, the draft treaty explicitly demands that the world body erect an international mechanism with the power to impose emission-reduction targets for each country, determine acceptable levels of CO2 and levy global taxes. The United States would lose control over its environmental policy. Also, it would sign its death warrant as a functioning democracy, enabling the United Nations to administer a fledgling world government possessing the authority to regulate and tax the American economy. The treaty is a sword aimed at the heart of our national sovereignty.If Mr. Obama signs the Copenhagen treaty, he will sign your freedom, your democracy, and your prosperity away forever,Mr. Monckton recently told an audience in Minnesota. I read that treaty and what it says is this: that a world government is going to be created.Yet the U.S. Senate can avoid this disastrous course. A supermajority of 67 votes is required to ratify the treaty. In 1997, the Senate in a 95-0 vote rejected the Kyoto Protocol, thereby preventing the United States from joining. Mr. Monckton believes that, in order to avoid defeat, Mr. Obama will try to circumvent the ratification process. JAKARTA (AFP) – A major quake with tsunami potential hit off eastern Indonesia Saturday, seismologists said, but there were no immediate reports of any damage and the tsunami warning was later lifted.The 7.3-magnitude quake struck at 11:40 pm (1440GMT) about 209 kilometres (130 miles) northwest of Saumlaki, Maluku province, at a depth of 165 kilometres, the Indonesian Meteorology and Geophysics Agency said.A later US Geological Survey report registered the quake, in the Banda Sea, at a magnitude of 7.0.Indonesia sits on the Pacific Ring of Fire,where the meeting of continental plates causes high volcanic and seismic activity.There is no report of any death toll yet. The Maluku health agency is sending a team to Saumlaki to check on the situation. Communication there is difficult,health ministry crisis centre head Rustam Pakaya said in a text message.The quake was not felt in Ambon but it was felt strongly in Manokwari in west Papua.The Meteorology and Geophysics Agency technical head Suharjono said the tsunami warning had been lifted and that the quake had no potential to damage surrounding areas.

(IsraelNN.com) The Health Ministry announced on Sunday that the number of people in Israel infected by the H1N1 swine-flu virus has reached 4,330 during the current international pandemic.More than 99 percent have recovered, but the virus has been blamed for 32 deaths. Most of those who died suffered from other illnesses or conditions. Nine people diagnosed with the disease are listed in serious condition at various hospitals throughout the country.

Obama has declared a 2009 H1N1 swine flu a national emergency. It is not clear if this declaration falls under the National Emergencies Act (50 U.S.C. 1601–1651). The act is not mentioned in media reports.The National Emergencies Act was passed in 1976. It has been extended six times. In 2007, the declaration was strengthened with the issuance of National Security Presidential Directive 51 (NSPD-51) which gave the president the authority to do whatever he deems necessary in a vaguely defined catastrophic emergency including everything from canceling elections to suspending the Constitution.NSPD-51 (National Security and Homeland Security Presidential Directive) is unconstitutional. It was created on May 4, 2007, as a presidential directive (bypassing Congress) and signed by George W. Bush. It claims the power to execute procedures for continuity of the federal government in the event of a catastrophic emergency.Such an emergency is construed as any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions.In other words, it is a martial law directive. On May 10, 2007, The Washington Post characterized NSPD-51 is a shadow government directive.The John Warner National Defense Authorization Act (NDAA) for Fiscal Year 2007 states that the military may be used during a national emergency.Sec 1076 is extremely explicit, notes Michel Chossudovsky, and virtually creates a Pinochet style environment for the mass arrest of political dissidents without trial, the storming of public rallies, etc.NDAA specifically mentions epidemic as an excuse to declare martial law.

Prior to Warner and NSPD-51, legislation passed by the Clinton administration allowed the military to intervene in judicial and civilian law enforcement activities. In 1996, legislation was passed which allowed the military to intervene in the case of a national emergency. In 1999, Clinton’s Defense Authorization Act (DAA) extended those powers (under the 1996 legislation) by creating an exception to the Posse Comitatus Act, which permits the military to be involved in civilian affairs regardless of whether there is an emergency,according to Chossudovsky.In 2005, a month after Hurricane Rita, a so-called bird flu crisis was hyped by the government and the corporate media.I am concerned about avian flu. I’m concerned about what an avian flu outbreak could mean for the United States and the world… I have thought through the scenarios of what an avian flu outbreak could mean,Bush declared at the time.One option is the use of a military that’s able to plan and move. So that’s why I put it on the table. As noted earlier today, a CBS investigative report reveals that H1N1 flu cases are not as prevalent as we are told by the government, the CDC, WHO, and the corporate media. The so-called epidemic is bogus.Millions of people are refusing to take the H1N1 vaccine. In the weeks ahead — if Obama’s emergency declaration falls under the above directives — we may witness a move toward martial law, forced vaccination, and internment of those who refuse.At best, Obama’s declaration is a flimsy attempt to scare people into taking the toxic soft kill vaccination. Emergency powers trump the Bill of Rights

That’s the public explanation for this, but the real agenda behind this declaration may be far more sinister. Declaring a national emergency immediately gives federal authorities dangerous new powers that can now be enforced at gunpoint, including:
-The power to force mandatory swine flu vaccinations on the entire population.
-The power to arrest, quarantine or involuntarily transport anyone who refuses a swine flu vaccination.
-The power to quarantine an entire city and halt all travel in or out of that city.
-The power to enter any home or office without a search warrant and order the destruction of any belongings or structures deemed to be a threat to public health.
-The effective nullification of the Bill of Rights. Your right to due process, to being safe from government search and seizure, and to remain silent to avoid self-incrimination are all null and void under a Presidential declaration of a national emergency.None of this means that federal agents are going to march door to door arresting people at gunpoint if they refuse the vaccine, but they could if they wanted to. Your rights as an American are no longer recognized under this national emergency declaration.

The declaration of this national emergency seems suspicious from the start. Where’s the emergency? The number of people killed by swine flu in the United States is far smaller than the number of people killed each year from seasonal flu, according to CDC statistics. People obviously aren’t dropping dead by the millions from H1N1 influenza. Most people are just getting mild flu symptoms and a few days later they’re fine.

So where’s the emergency?

The only emergency I can see is the emergency fabricated by Big Pharma to sell more vaccines. By declaring a national emergency over the H1N1 pandemic, Obama is playing right into their hands.I find the timing of all this curious. Two days ago, New York gave up on its efforts to require mandatory vaccinations of health care workers. This was designed to defuse a large number of planned protests from health freedom-conscious people who don’t want government-mandated chemicals pumped into their veins.The planned protests in New York would have fueled yet more resistance among health care workers across the country, and had it been allowed to continue, it could have resulted in a huge nationwide backlash against swine flu vaccines. So why declare a national emergency in the first place? The media reports this was done to allow hospitals to bypass federal regulations concerning the setting up of large-scale triage sites — emergency medical camps quickly constructed to deal with large numbers of sick people.But at the same time, H1N1 isn’t causing large-scale sickness. As USA Today reported, an expert on infectious disease, P.J. Brennan (the chief medical officer for the Penn Health System at the University of Pennsylvania in Philadelphia) said, The public ought to take some solace, some relief in this. It’s not a suggestion that things have deteriorated in any way. In no way is the virus more severe or more difficult to manage.So let me get this straight. The H1N1 virus remains mild. The CDC reports that swine flu infections already peaked out in mid-October. There have been no new developments in swine flu that would be cause for alarm and no reason to suspect huge numbers of sick people flooding into the hospitals. And yet, for some reason, the Obama administration has declared a national pandemic emergency specifically for the purpose of speeding the ability of hospitals to process large masses of sick people through emergency medical triage tents?

What are these people not telling us?

Something doesn’t add up here. Why would the U.S. government need to declare a national emergency to enable hospitals to handle a flood of sick people when there is no flood of sick people (and the pandemic seems to be fizzling out)? This is more like the kind of preparation you might expect in advance of a biological terrorism attack, not for a flu that appears no more dangerous than the seasonal sniffles.

The National Emergencies Act and FEMA

Meanwhile, the media ignores the rest of the story about what dangerous powers a declaration of a national emergency puts into play. As reported here on NaturalNews, this declaration effectively ends many civil liberties in America and, at least on paper, puts the U.S. government in the position of having the legal authority to force vaccinations on the entire population at gunpoint (if they wanted to).The National Emergencies Act passed in 1976 has some peculiar realities attached to it. By declaring a national emergency, Obama invokes a set of laws that not only override important sections of the U.S. Constitution, but that also activate FEMA to take charge of responding to the emergency.Now we know why they need all those emergency medical tent camps near the hospitals. FEMA’s in charge! And if FEMA handles the swine flu pandemic in the same way the agency handled the Hurricane Katrina disaster, we may indeed need all those emergency triage tents after all.
Those of you who have been following the ongoing march to destroy the freedoms of the American People already know about FEMA camps. These aren’t Boy Scout field trip camps; they’re detention centers designed to hold large numbers of people for emergency purposes. They could conceivably be used to quarantine people who are infected with a dangerous pandemic virus. On the other hand, they might also be used to isolated and detain people who refuse to be vaccinated against any declared pandemic. Under the National Emergencies Act and related U.S. law, FEMA would have two years of near-total control over the civilian population, during which people could be subjected to forced vaccinations, mandatory searches of their homes, gunpoint detainment and involuntary transportation to a FEMA detainment facility, and so on.I’m not saying they’re going to do all this, but they could if they wanted to! And that’s not freedom. Real freedom means you have the guaranteed right to be safe from being detained, or arrested without cause, or injected with a government-mandated chemical. Under a declaration of a national emergency, your freedom is at the whim of those who maintain police state powers over you. You’re only free if they decide to refrain from exercising the power they have over you. It’s the same kind of freedom you might get as a peasant in some Medieval kingdom where the king says, You’re free to go.Now, some of these freedom-restricting actions might conceivably be justifiable if a truly dangerous pandemic virus were sweeping through the population killing millions, causing huge disruptions in the national infrastructure and threatening the nation with a partial or total shutdown of essential services. But that is not happening here. H1N1 is a mild virus that rates astonishingly low on the severity scale. If H1N1 were a hurricane, it would be little more than a tropical depression.It is not a category five hurricane, nor a phase six pandemic. Virtually everyone who is exposed to H1N1 generates their own antibodies and cures themselves naturally. According to hospital reports, those who have died from the H1N1 virus are almost exclusively people who were already suffering from preexisting conditions that compromised their health such as asthma or extreme obesity.By any measure, H1N1 as currently configured appears to present no extraordinary threat to the health of the population. So once again, we must ask: Why declare a national emergency and initiate a FEMA response to something that’s not really an emergency?

Why I’m concerned
For the first time in this whole pandemic situation, I’m concerned. Not due to the virus itself, because that’s a mild virus that presents no real threat to the population at large. I’m concerned about what we don’t know might be going on behind the scenes here.These preparations for large-scale medical triage tents and the emergency activation of FEMA have me worried that the American people aren’t being told the whole story. Perhaps a terrorist organization is planning on releasing a wildly dangerous mutation of H1N1 in some major U.S. city. Or perhaps some vaccine maker is, in fact, that terrorist organization. (The best way to sell more vaccines would be to release a mutated form of H1N1 into the population and scare up some more sales…)Or maybe, as some creative thinkers have suggested, the vaccine itself IS a bioweapon, and the U.S. government is preparation for large-scale fatalities it expects to see soon.Or maybe these are just fleeting, dark visions from crazy people, and the U.S. government is a benevolent organization with all our best interests in mind, and they’re jumping through these bureaucratic hoops to make sure there are plenty of hospital beds to go ’round just in case more people get really sick.But even that explanation doesn’t hold water. A “national emergency declaration” isn’t necessary to waive hospital tent rules. Obama could have easily accomplished the same thing with an Executive Order, without having to invoke the National Emergencies Act or put FEMA in charge at all.He chose the emergency declaration for a specific reason. (IsraelNN.com) At a special conference Sunday night at Heichal Shlomo in Jerusalem, Zionist rabbis are calling for Jewish ascent to the Temple Mount and for an end to the use of the Temple Mount as a platform for Muslim incitement.The rabbis participating in the conference include Rabbi Dov Lior, Rabbi Yuval Cherlow, Rabbi Elyakim Levanon, Rabbi Yaakov Madan and Kotel Rabbi Shmuel Rabinovich. Also participating are Knesset Members Uri Ariel, Aryeh Eldad and Michael Ben-Ari of the National Union, MK Uri Orbach (Jewish Home) and Kadima's Otniel Schneller. Jerusalem Deputy Mayor David Hadari and Moshe Feiglin are also among the scheduled speakers.

The chairman of the conference, Temple Institute Director Yehudah Glick told Arutz Sheva that the conference's date was chosen because this is the anniversary of the visit by Rambam (Maimonides) to the Temple Mount. There is a worrisome phenomenon that every time two or three rocks are thrown [by Arabs], the Jews are distanced from the Temple Mount,he said.The Arabs learned this and they behave accordingly. Glick said that the police's decision to close down the Mount to Jews during the Sukkot holiday week was a move that could not go unanswered.Many Zionist rabbis support ascent to the Temple Mount but some do not, citing the Nation of Israel's current state of impurity. Security forces, who were already on high alert in Jerusalem on Sunday morning, didn't have to wait long to be called into action, dispersing a Muslim riot that broke out on the Temple Mount.Police, who were accompanying a group of tourists up to the mount, had caught several Muslim youngsters on video camera preparing to cause trouble, including preparing barrels of oil to pour onto the ground to hinder the access of security forces and the visitors.Following the discovery, police reinforcements stormed the mount and were pelted with stones by the young rioters.

One arrest was made and a tense calm was restored to the site.

The already high alert level in the capital had come in response to what police said were calls by both Jewish and Islamic religious leaders to ascend the Temple Mount.
Tensions flared in the capital three weeks ago, when Muslim leaders summoned their followers to come and defend the mount,sparking demonstrations and riots in east Jerusalem throughout Succot.Police on Saturday evening had said they would deal firmly and decisively with any attempts to disturb the peace.Jerusalem police will deploy around the Temple Mount, the alleyways of the Old City, and in east Jerusalem tomorrow, in light of calls from both [Jewish and Muslim leaders] to go up to the mount,a police spokesman said.Calls to Muslim worshipers to arrive in Jerusalem on Sunday have largely come from clerics in east Jerusalem and their counterparts from the northern branch of the Islamic Movement.While the spokesman declined to specify where the Jewish calls had come from, Sunday has been publicized as the day to commemorate the visit by Maimonides to the Temple Mount 843 years ago.To mark that anniversary, a conference is taking place Sunday in Jerusalem, calling Jews to properly arise to the Temple Mount,according to an announcement by the group called Eretz Israel Shelanu. The announcement listed several right-wing MKs and rabbis as conference participants.

In the past, Jews have ascended the mount to mark the anniversary, 6 Heshvan, which was Saturday.While there were no announcements of an organized visit to the Temple Mount on Sunday, a member of the Islamic Movement's southern branch told The Jerusalem Post on Saturday evening that the renewed calls for Muslims to arrive in the capital on Sunday had been made after extremist Jewish elements had recently made clear their intention to go up to the mount.It seems like the extremists don't want to have quiet in Jerusalem or on the Temple Mount,the Islamic Movement member, who asked to remain unnamed, said.These sorts of things used to happen once every year, or once every two years, but now the provocations have become more frequent.
The member of the southern branch, which is independent of the northern branch and considered by some as more moderate, said all sides were unified in their defense of Al-Aksa,and that any provocative visit to the site by extremist Jews would not pass peacefully.The police have to be the ones to stop this,he said.Because we don't want to go back to the violence that occurred recently, or to the riots of October 2000.

While a representative from the Temple Mount Institute was unavailable on Saturday night, the recent tensions over the Temple Mount have also seen an increase in calls by prominent rabbis forbidding Jews to access the Temple Mount, based on Jewish law.

Four International Atomic Energy Agency inspectors were due in Tehran Sunday, Oct. 25for their prearranged visit to the newly-discovered uranium enrichment facility near Qom. Aside from that inspection, not much else is left of the Obama administration's pursuit of engagement on Iran's nuclear program. Saturday, Majlis Speaker Ali Larijani threw out IAEA Director Mohamad ElBaradei's overseas enrichment plan the day after it was hailed by the big powers.Soon after Larijani's rejection, President Obama put in hurried calls to the Russian and French presidents on the new crisis.

DEBKAfile's military sources point out that even the UN watchdog visits may lead nowhere, depending on how much access they are allowed to the facilities tunneled deep in a mountain near Qom and how much incriminating evidence was removed in the two weeks since Tehran approved the visit. Some sources in Washington take the existence of this hidden plant as evidence that Iran has got several more secret facilities running - and not just for enrichment but possibly even for covertly constructing nuclear bombs and warheads. Reporting from US sources on Iran's nuclear program tends to be conflicting, fashioned to fit the policy of the moment. For instance, the Qom tunnel hiding place which the US president first revealed in Pittsburgh on Sept. 26 was in fact known to intelligence services, including the CIA, as far back as 2004.In December 2005, the National Council of Resistance of Iran called a news conference to expose details of an installation under construction in deep tunnels near Qom.Yet in 2007, a US National Intelligence Estimate stated that Iran had halted its military nuclear program in 2003! The IAEA inspectors' visit to Qom goes well, it may establish four key facts:

He underwent a series of tests and treatments but his condition did not improve and it was decided to operate upon him. As part of the recovery process, doctors anesthetized him and respirated him.Rabbi Eliyahu is one of the few living Sephardic rabbis who are also held in great esteem by the Ashkenazic community.

Conservative Anglican leaders urge change Sun Oct 25, 5:18 pm ET

LONDON – A conservative group of Anglican bishops are pushing for change in their own churches rather than suggesting the faithful turn to Rome.The Global South alliance, made up of theologically conservative primates from developing countries, said Sunday in a statement on their Web site that a proposed Anglican Covenant — a shared set of guidelines for membership in the Anglican church — should be adopted.

The statement comes in the wake of an announcement earlier this week by the Vatican, saying that Pope Benedict XVI had authorized an Apostolic Constitution. The constitution would allow Anglicans to move to the Catholic church, but keep their own liturgy and married priests.In a statement posted to their Web site, the group said they appreciated the pope's stance on the common biblical teaching on human sexuality but at the same time we believe that the proposed Anglican Covenant sets the necessary parameters.It gives Anglican churches worldwide a clear and principled way forward in pursuing God's divine purposes,the statement reads.

The Global South group is headed by Nigerian Archbishop Peter Akinola.

There are about 77 million Anglicans around the world. The church has been in turmoil since 2003, when the U.S. Episcopal Church consecrated New Hampshire Bishop V. Gene Robinson, the first openly gay bishop.It is uncertain how many Anglicans will seek to switch churches because of the pope's new policy. The Right Rev. John Broadhurst, the Bishop of Fulham, has said about 1,000 Church of England clergy will seek to join the Roman Catholic Church. VATICAN CITY – The Vatican begins talks Monday to bring a group of breakaway traditionalist Catholics back under its wing, nine months after the pope created an uproar by rehabilitating one of their bishops despite his denial of the Holocaust.A delegation from the Society of St. Pius X travels to the Vatican for a first round of meetings aimed at overcoming the deep theological differences that prompted the group to split from Rome following the modernizing reforms of the Second Vatican Council.

No breakthroughs are expected in what will likely be a lengthy negotiation.In the best case, humanly speaking, we have several years of discussions ahead of us,the society's delegation leader, Bishop Alfonso de Galarreta, said in a recent interview posted on the society's Web site.De Galarreta and three other bishops were excommunicated in 1988 after they were consecrated without papal consent by the late ultraconservative Archbishop Marcel Lefebvre. VATICAN CITY – Pope Benedict XVI ended a three-week Vatican meeting on Africa Sunday with a call for peace and reconciliation among all people on the continent, regardless of ethnic and religious differences.The pope celebrated Mass in St. Peter's basilica to cap the meeting on the role of the Catholic Church in Africa.

Benedict said during the Mass, which he co-celebrated with some of the prelates who have attended the synod.The pope also said that globalization should be regulated in order to include all nations, not just developed ones.Globalization, he said, is not governed by forces that are independent of the human will and can be adjusted by men. He added that the Catholic Church is working to promote development for all countries.Benedict said that reconciliation is necessary to ensure a just peace in Africa, and called on all people to contribute regardless of ethnic, religious, language, cultural or social background. He praised the work of missionaries as one that is both respectful of the local cultures and essential to help Africa out of hunger and disease.The two-hour ceremony, which featured traditional music, chants and prayers from Africa, formally closed the synod. Among those who co-celebrated the Mass was Cardinal Peter Turkson of Ghana, who was appointed Saturday to head the Vatican's justice and peace office.The appointment was one of the most significant pieces of news to come out of the meeting, as it cements the cardinal's standing as a possible future papal candidate. Turkson told reporters three weeks ago there was no reason there couldn't be a black pope, particularly after Barack Obama was elected U.S. president.During the meeting, the 300 bishops and cardinals looked at pressing issues such as AIDS and political corruption on the continent.

In their final message, the bishops told corrupt Catholic political leaders in Africa to repent or quit public office and stop wreaking havoc on their countries. In their final recommendations, the synod also called for starting religious dialogue with followers of Islam and African traditional religions.Speaking to the faithful after the Mass, the pope praised the dynamism of the Christian communities, which keep growing in quantity and quality in Africa.While the Vatican has been concerned about the flagging faith of some Catholics in the affluent West, Church officials are heartened by the vibrancy of churches in parts of Africa and Asia.In March, Benedict visited Cameroon and Angola, both of which have large Catholic populations.

The dollar should remain the principal currency in China's $2.27 trillion stockpile of foreign exchange reserves, but the share of the euro and yen should increase, according to an opinion piece in Monday's Financial News, a paper published by the People's Bank of China.The dollar fell to a 14-month low as word of the report spread before recouping some of its losses after the author, Zhou Hai, told Reuters he was only expressing a personal opinion.It is purely my personal view,Zhou, a division chief with the financial research department of the central bank's branch in Harbin, capital of the northeastern province of Heilongjiang.Other researchers have expressed similar views to Zhou, whose piece appeared on the Theoretics Weekly page of the paper.The composition of China's currency reserves is a state secret, but bankers estimate that at least two-thirds of the holdings are invested in dollar-denominated securities.Senior Chinese officials have expressed concern about the weakness of the dollar but have also acknowledged that the U.S. currency will remain the linchpin of the global financial system for the foreseeable future.Any diversification from the dollar is proceeding very gradually, foreign exchange strategists say, not least because Beijing has continued to buy dollars to prevent the yuan from rising since the middle of 2008.Zhou also wrote in the Financial News that China should improve the yuan's exchange rate mechanism to reduce pressure on the central bank to buy inflows of foreign exchange.China should exclude the Hong Kong dollar from its official reserves because Chinese can easily obtain the currency, and it is pegged to the U.S. dollar, Zhou added.Before Monday's piece, Zhou's most recent article was in the August edition of China Finance, according to an Internet search.The article was titled, A few thoughts on supporting modern agricultural development through finance — the example of Heilongjiang.

The G-20 finance ministers meet in Scotland on November 6th and 7th, and they will all be bleating about the fall in the dollar. France started this week, and the others will follow. Their currencies are rising in value and they do not like it.Our government, Wall Street and many Americans are basing their future on stimulation and recovery and it isn’t going to happen. om Alex Jones. Instead he attempts to discredit what Jones says.We expect other nations to follow, Mexico and Brazil in imposing a 2% tax on incoming funds and others will print their currencies and buy dollars to reduce the value of their currencies and at the same time buy US Treasuries that are decreasing in value. That will neutralize any benefit from the exercise. In addition, they will all scream for a strong dollar policy. By the time the meeting begins the dollar should be between 71 and 72 on the USDX, the dollar index. The weaker dollar means dollar debt will be cheaper to pay back. The big question is how long will it take for the dollar to fall to 40 to 55? We are often asked how does today compare with the 1930s in tax revenue and government spending? In 1930-31 tax revenue fell almost 53%. It increased 250% in 1932 and tripled in 1938. Yet, growth during the 30s went nowhere. In spite of an increase of 45% in government spending during those years by 1940 GDP had not returned to the levels of 1930. In 1939 unemployment was still 17.2% and in 1940, 16.4%. This is the same monetary policy being used today that was used during the 1930s. Keynesian monetization that does not work. The only reason the depression did not continue is that FDR arranged another war, otherwise the depression could have continued indefinitely. The debt bubble of the 1920s only lasted seven years. Our present debt bubble actually began in 1978, was purged in 1982-83 and began again in 1986. It was killed in 1989 and resurrected in 1994. The bubble of 2000-2001 was replaced by our current real estate bubble in 2003, which is now in the process of deflating. The privately owned Federal Reserve engineered all this.

The current fiasco was accompanied by a shortfall in tax collections to government spending from 2003 to 2007. 2008 held its own due to cooking the books and 2009 fell almost 18%. Unless further tax increases are implemented you can expect 2009 to fall short as well. Thus, if taxes are not increased the American economy will collapse. This is harsh and tax increases will come at just the wrong time. It can in part by temporarily covered by hyperinflation, but that would be a transitory solution. 62.8% of foreign reserves are in US dollars, so as the dollar depreciates foreign debt decreases. The flip side is that there is major imported inflation, particularly in the cost of goods and services.Present government stimulation is not going to work. It didn’t work in the 1930s and Japan has found out to its dismay that since 1992 it didn’t work for them either. Why should it work in America? The debt that has been so wantonly created is still going to be there and if taxes are not raised or costs cut, it will be even larger.Our government, Wall Street and many Americans are basing their future on stimulation and recovery and it isn’t going to happen. This supposedly is how government is going to generate its tax revenue. All we can say is good luck.At the G-20 and G-7 we hear about an exit strategy. A strategy that doesn’t exist. Others may raise taxes but we can assure you the US and UK will be the last to do so. They are currencies in disparate trouble. The dollar will find its real value somewhere between 40 & 55 on the USDX. The dollar will become a third world currency and as a result gold will climb to $2,500 to $3,000.The G-20 let us know that they would be replacing the G-7 and G-8. This desperation of power to developing countries would expedite the transfer of wealth from Western nations in the third world via carbon taxation in order to lower standards to meet those of the lower tier countries. This is being done to force the first world to accept world government.

In his address to the conclave US Treasury Secretary Tim Geithner told attendees that the US was going to legislate sweeping changes to the financial system under the guise of creating greater protection for consumers and investors and to promote a more stable financial system that would relieve taxpayers of the burden of the financial crisis.The members still want to complete the Doha trade talks that have been bogged down for four years. What the WTO is really trying to accomplish is extreme financial deregulation under the cover of trade agreements, which would undermine genuine regulation and would make the entire world a free trade zone to be further looted by transnational conglomerates. The force behind WTO deregulation is the EU and they are pushing the worst aspects of the plan.The WTO has an agreement called the FSA, the Financial Services Agreement that explicitly applies to more than 100 countries and mandates major deregulation. Mr. Geithner worked on this plan during the Clinton administration, so his regulation statements are meant for public consumption only. Incidentally, the WTO-EU rules are virtually unknown to the US Congress.Geithner was the one who closed the deregulation deal for the Clinton entourage as lead negotiator. He knows all about the existing agreements. He was directly instrumental in the destruction of Glass-Steagall. The whole new crowd in the Obama administration was responsible for setting up what has become the destruction of our financial system.The present US course is to re-regulate and that is in direct opposition to what the WTO and the EU want. There will be quite a fight over this change of direction by the US, especially over the WTO, Understanding on Commitments in Financial Services, which is severe deregulation. The Treasury will have major issuances next week. On Monday alone they will issue $116 billion in new notes and bills, 2, 5 & 7-year paper; plus another $30 billion in bills and $7 billion in TIFS. Tuesday will see $44 billion in 2-year notes. On the 28th, $41 billion in 5-year notes and on the 29th, $31 billion in 7-year notes. WASHINGTON – A Senate plan to tackle global warming would add about $100 a year to the energy costs for a typical household, according to an analysis by the Environmental Protection Agency.The analysis released late Friday by the office of Sen. Barbara Boxer, who heads the Senate Environment and Public Works Committee, generally mirrors the cost projected by the EPA when it examined similar legislation that the House passed in the summer.The Democratic bill calls for cutting greenhouse gases from power plants and large industrial facilities by shifting energy use away from fossil fuels, especially coal. It would cap emissions and allow trading of pollution allowances to mitigate the cost.Boxer, D-Calif., has scheduled hearings this coming week on the bill. The committee will hear from Obama administration officials, including the EPA, on Tuesday.President Barack Obama, in a speech Friday in Boston, said he believes a consensus is emerging in Congress on the climate issue. But he also accused some opponents of making cynical claims that contradict the overwhelming scientific evidence that the earth is becoming warmer in an attempt to derail legislation.There are those who will suggest that moving toward clean energy will destroy our economy, when it's the system we currently have that endangers our prosperity and prevents us from creating millions of new jobs,Obama told his audience at the Massachusetts Institute of Technology.Boxer said the bill provides a clean energy future, creating millions of jobs and protecting our children from dangerous pollution.Critics of the bill have called it a massive energy tax. They also say the EPA uses overly optimistic assumptions disguising the likely increase in energy costs to consumers.

Oklahoma Sen. James Inhofe, the committee's top Republican, said the EPA analysis was unacceptable and he wanted a more complete economic assessment of the bill before moving ahead. He said committee Republicans may force a delay; Boxer wants a committee vote in early November.One would think that, prior to legislative hearings, the committee would have a thorough, comprehensive economic analysis to understand how an 800-plus page bill, designed to fundamentally reshape the American economy, affects consumers, small businesses, farmers, and American families,Inhofe said in a statement.The EPA analysis released by Boxer said while there are differences between the Senate and House bills, they are so small that the economic costs would be similar in the case of either bill. As a result, the EPA produced in detail the same numbers for household costs it issued earlier this year when examining the House legislation — and no revised numbers specifically for the Senate legislation.It said the cost would add between $80 to $111 a year to households energy bills as a result of higher prices, although energy consumption was expected to decline slightly as a result of increased efficiency measures.There have been widely conflicting price tags estimated for the climate bills. The Congressional Budget Office has estimated the household cost of the House-passed bill at about $175a year in 2020. It has not examined the Senate bill. But some industry-cited studies have put the cost much higher, some claiming possible added costs of as much as $3,000.Boxer also released a summary of changes to the bill that introduced by Sen. John Kerry, D-Mass., last month.The revised bill describes how pollution allowances for curbing greenhouse gases would be distributed. It is similar to the distribution in the House bill with 35 percent going to large electricity distribution companies, with an understanding that the benefits would be passed onto consumers to ease the impact of electricity prices.Free allowances also would go to smaller electricity distribution companies, natural gas distributors, providers of home heating oil and to offset costs for low and moderate-income households. UK recovery lags behind the continent

A string of new economic data suggests the UK's recovery is being left behind the EU's large continental countries.Data produced by the UK's Office for National Statistics showed the economy unexpectedly contracted by 0.4 percent of gross domestic product between July and September of this year. Analysts had been predicting that GDP - a measure of all the goods and services produced by a country –would rise by 0.2 percent.The provisional data compare poorly with that from continental powerhouses France and Germany, both of which recorded positive growth as far back as the second quarter of 2009.There are many millions of people who will be deeply concerned to see that Britain is still in recession six months after France and Germany came out of recession,said the UK's Conservative party shadow finance minister, George Osborne.It destroys the myth that Britain was better prepared [for the crisis], he said.Other figures produced by the EU's statistics office - also out on Friday (23 October) – seemed to confirm this trend.The EU saw industrial new orders for the 27-member bloc rise by 1.2 percent in August compared to the previous month, but with considerable variation among member states.The highest increases were registered in Slovakia (up 11.8 percent), the Czech Republic (up 3.2 percent) and France (up 3.0 percent).The largest declines were seen in Ireland (down 14.6 percent), Poland (down 10.6 percent) and Italy (down 6.4 percent), with the UK also slightly in the negative (down 0.3 percent).

Further national figures released in Germany and France also pointed to recovery.

Household consumption in France was up 2.3 percent in September from August, with the country's economy minister, Christine Lagarde, describing the situation as encouraging.However, Spain had to contend with news that the country's unemployment rate is not coming down.Data from the country's statistics agency said unemployment for the third quarter of 2009 remained on 17.9 percent, the highest level among EU member states.Over four million people are currently unemployed in Spain, a country which suffered badly when activity in its booming construction sector came to an abrupt halt in the wake of the global financial crisis.

European parliament abandons internet cut-off struggle

EUOBSERVER / BRUSSELS - As France finally passes its harsh anti-piracy law and Britain readies its own bill to tackle illegal file-sharing, the European Parliament in a major U-turn has dropped its opposition to cutting internet access to scofflaw downloaders.Representatives of the house have rowed back from insisting on the maintenance of an amendment to a package of telecoms laws that would have ruled out such manoeuvres.On Thursday (22 October), representatives of the parliament and the member states announced that at the beginning of November, they will hold formal talks along with the European Commission to resolve differences between the sides over the telecoms package.Parliament's delegation has agreed a compromise proposal that will serve as a basis for negotiations and towards which the Council and the commission will be able to converge, said French Socialist MEP and one of the main negotiators Catherine Trautmann.The MEPs insisted that they remained champions of citizens' fundamental rights: We will do all we can to achieve a good solution, but Council has to understand that parliament will defend without hesitation the freedom of the citizens it represents,said Spanish conservative Alejo Vidal-Quadras. However, the compromise text, which would be the basis of discussions, no longer requires that only judicial authorities be allowed to cut off internet access.

Ahead of European elections in which the issue of internet freedoms suddenly pushed its way to the centre of public debate, the chamber seemed ready to mount the barricades in its battle to stop EU member states from attempting to introduce legislation which a majority of deputies considered a breach of human rights.MEPs with strong majorities twice inserted an amendment to the telecoms package that would have forbidden member states from restricting internet access without judicial authorisation and only in exceptional circumstances.On 6 October, telecoms ministers formally rejected the parliament's key amendment - the now infamous Amendment 138.

On almost all other issues, the two sides are in agreement.

France-based internet freedom pressure group La Quadrature du Net calls the compromise text useless legalese that essentially only restates existing rights protections and does nothing to explicitly rule out internet blocking.Amendment 138 will instead be replaced by a weak provision that does not carry any new important safeguard for citizen's freedoms,said spokesman for the group, Jeremie Zimmerman.
This decision was taken consciously by rapporteur Catherine Trautmann, in order not to risk a confrontation with the Council [representing the member states] and to quickly finish with the telecoms package.The move comes as France's anti-piracy legislation, under which internet access can be cut off, fines imposed and in some cases prison sentences handed down, was finally given the green light by the country's constitutional court.Britain likewise is expected to table similar legislation in the coming weeks.Mr Zimmerman said pressure from France and other member states has been fierce.Ministers of member states, who want to be able to regulate the net without interference from the judiciary, were rushing to kill amendment 138 and put an end to the negotiations.The parliament, Council and commission delegates will meet behind closed doors on 4 November. They then have six to eight weeks to reach an overall agreement. The two sides - sitting as the full Council and parliament - then have a further six to eight weeks to approve the final agreement without amendment.

WASHINGTON – It's a big number that only tells part of the story. The number of banks that have failed so far this year topped 100 on Friday — hitting 106 by the end of the day — the most in nearly two decades. But the trouble in the banking system from bad loans and the recession goes even deeper.Dozens, perhaps hundreds, of other banks remain open even though they are as weak as many that have been shuttered. Regulators are seizing banks slowly and selectively — partly to avoid inciting panic and partly because buyers for bad banks are hard to find.Going slow buys time. An economic recovery could save some banks that would otherwise go under. But if the recovery is slow and smaller banks' finances get even worse, it could wind up costing even more.This year's 106 bank failures are the most in any year since 181 collapsed in 1992 at the end of the savings-and-loan crisis. On Friday, regulators took over three small Florida banks — Partners Bank and Hillcrest Bank Florida, both of Naples, and Flagship National Bank in Bradenton — along with four elsewhere: American United Bank of Lawrenceville, Ga., Bank of Elmwood in Racine, Wis., Riverview Community Bank in Otsego, Minn., and First Dupage Bank in Westmont, Ill.When a bank fails, the Federal Deposit Insurance Corp. swoops in, usually on a Friday afternoon. It tries to sell off the bank's assets to buyers and cover its liabilities, primarily customer deposits. It taps the insurance fund to cover the rest.Bank failures have cost the FDIC's fund that insures deposits an estimated $25 billion this year and are expected to cost $100 billion through 2013. To replenish the fund, the agency wants banks to pay in advance $45 billion in premiums that would have been due over the next three years.

The FDIC won't say how deep a hole its deposit insurance fund is in. It can tap a credit line from the Treasury of up to a half-trillion dollars to cover the gap.The list of banks in trouble is getting longer. At the end of June, the FDIC had flagged 416 as being at risk of failure, up from 305 at the end of March and 252 at the beginning of the year.Yet the pace of actual bank failures appears to be slowing. The FDIC seized 24 banks in July, 11 in September and 11 in October.If any bank poses an immediate danger to customers or the broader financial system, regulators close it immediately, bank supervisors said. The issue is murkier for troubled banks that might qualify to close but whose closings might still be postponed or even prevented.The FDIC's first priority, spokesman Andrew Gray said, is to maintain public confidence in the banking system. As evidenced by the stability of insured deposits throughout last year, this mission has been a success,he said.He said public confidence isn't reason enough to delay a bank closing, because legally the decision to close rests with whoever chartered the bank — a state or federal agency.

But more than a dozen experts, including current and former regulators, bankers and lawyers, say the FDIC's mission to maintain public confidence in the banking system contributes to the go-slow approach.The FDIC was set up to create confidence and prevent bank runs,says Mark Williams, a former bank examiner for the Federal Reserve. Being too aggressive about bank closings can be counter to the mission.
Sarah Bloom Raskin, Maryland's top banking regulator, said: Technically it's the states who decide, but in reality it's the FDIC calling you to say when the bank will be closed.Last fall, the financial turmoil was rooted in bad bets that the nation's biggest banks, like Citigroup Inc. and Bank of America Corp., had made on complicated, high-risk mortgage investments.Smaller banks have been undone by something more conventional — real estate, construction and industrial loans that have soured as the recession has deepened. Defaults are up as developers abandon failing projects and landlords can't meet their loan payments.Small- and mid-sized banks hold lots of those loans and have been hurt more than big ones by the sinking commercial real estate market, especially in states like California, Georgia and Illinois. As defaults rise, these banks must set aside more money to cover losses.

For the banks, this means mounting losses and shrinking reserves.

In a healthy economy, Williams said, the Fed and the FDIC would be inclined to close such weak banks. But these days, those agencies and other regulators prefer to hold off, hoping an economic recovery will eventually restore the health of some of the banks.But the recovery is expected to be slow. Americans remain hesitant to spend money because of job losses, flat wages, tight credit and high debt. Their cutbacks have triggered tens of thousands of business failures.Abandoned retail space in downtowns and suburban malls means no rental income for property owners. As landlords default on real estate loans, they weaken the banks that hold the loans.

The situation now is especially grave in Southern California, Georgia and Illinois, which have some of the highest home foreclosure rates. Twenty banks have closed in Georgia alone.Individual bank depositors aren't at risk when a bank fails. Their money is guaranteed up to $250,000 by the government. Ever conscious of maintaining public confidence, agency officials hammer this point in public statements. When weak banks are allowed to stay open, their growing losses potentially can drain the FDIC's deposit insurance fund faster, says Bert Ely, an independent banking consultant.Federal agencies aren't the only ones with an interest in slowing the pace of bank closings. State regulators with closer ties to local communities want to avoid the ripple effects when a town loses its main source of consumer and business credit, Williams said.

But finding buyers for wobbly banks has been tough.

FDIC Chairman Sheila Bair acknowledged as much in testimony this month before a Senate panel. The FDIC has been offering to share buyers' losses on the assets being transferred, she said.In the past several months investor interest has been low, she said in prepared testimony.In an effort to find more potential buyers, the FDIC has relaxed the rules for private-equity firms to buy banks. In the past, regulators had feared such a move would allow investors to protect themselves from the cost of bank failures, escaping serious consequences while drawing down the FDIC's fund.An early success of the new strategy was a deal announced this month to sell assets from Corus Bank of Chicago to a group of private investors. But there still aren't enough buyers to absorb quickly all the assets held by at-risk banks.That's because there are so many weak and failing banks on the market — and so few others strong enough to buy them. That's one reason it's hard to know how many more banks could be closed in coming months, said Daniel Alpert, Managing Partner of the New York investment bank Westwood Capital LLC.How many banks will survive? Alpert asked.Loans are still deteriorating, but there are glimmers of hope in the economy. CAMARILLO, Calif. – The average price of regular gasoline in the United States has jumped 17.8 cents over a two-week period to $2.66. It's the first rise in the national retail price of gas since late July.That's according to the national Lundberg Survey of fuel prices released Sunday.Analyst Trilby Lundberg says the average price for a gallon of mid-grade was $2.78. Premium was at $2.90.Tucson, Ariz., had the lowest price among cities surveyed at $2.24 a gallon for regular. Anchorage was the highest at $3.25.

WASHINGTON – Nuclear energy, once vilified by environmentalists and facing a dim future, has become a pivotal bargaining chip as Senate Democrats hunt for Republican votes to pass climate legislation.The industry's long-standing campaign to rebrand itself as green is gaining footing as part of the effort to curtail greenhouse gases.

Nuclear power still faces daunting challenges, including the fate of highly radioactive reactor waste. Reactors remain a tempting target for terrorists, requiring ever vigilant security measures.But 104 power reactors in 31 states provide one-fifth of the nation's electricity. They also are producing 70 percent of essentially carbon-free power and are devoid of greenhouse gas emissions.It's something the nuclear industry has hammered away at in advertising and in lobbying on Capitol Hill for nearly a decade. Only recently, however, has the message begun to resonate among both industry supporters and skeptics.If you want to address climate change and produce electricity, nuclear has got to be a significant part of the equation,Marvin Fertel, president of Nuclear Energy Institute, the industry trade group, said in an interview.Not unexpected from a top industry lobbyist. But the same is heard from Republicans and Democrats in Congress, from a growing number of environmentalists and from the White House, where nuclear power otherwise has received tepid support.The Senate this week will kick off three committee hearings on legislation to cap greenhouse gases from m power plants and large industrial facilities. The goal is to cut them about 80 percent by 2050.The House has already passed a bill. Its chances in the Senate could hinge in part on whether demands by a few GOP senators, including Lindsey Graham of South Carolina and John McCain of Arizona, that the legislation provide help to build new reactors.

Nuclear power is pivotal to both a low carbon economy and to generate a bipartisan coalition to pass a carbon cap,says Jason Grumet, executive director of the National Commission on Energy Policy, a bipartisan group of experts created in seven years ago to advise government officials on energy matters.He says all economic models on climate legislation assume significant increases in nuclear power — an expansion binge unseen since the 1970s, before the Three Mile Island nuclear accident brought new reactor orders to a halt.A study by the industry-supported Electric Power Research Institute says 45 new reactors are needed by 2030. The Energy Information Administration puts the number at 70. An analysis by the Environmental Protection Agency assumes 180 new reactors by 2050 for an 80 percent decline in greenhouse gas emissions.The Nuclear Regulatory Commission has applications for 30 new reactors. Only a few probably would be built over the next decade, the earliest in 2016 — and then only with the government guaranteeing the private financing.Democratic sponsors of the climate bill are far short of the 60 votes needed to overcome a GOP filibuster. They hope a compromises could bring along uncommitted centrist Democrats and some Republicans. Along with talk of opening more waters to oil drilling, support for nuclear energy is seen as the carrot that might attract Republicans.The prospects of such a compromise appeared to brighten recently when Sens. John Kerry, D-Mass., the climate bill's principle sponsor, and Graham collaborated on a new bid to build consensus.Nuclear power needs to be a core component of electricity generation if we are to meet our emission reduction targets,they wrote. They called for ending cumbersome regulations that have stalled new reactors, measures to help utilities secure financing and expanded research to resolve the waste problem.

They outlined a framework that other Republicans might follow. GOP senators such as McCain, Lisa Murkowski of Alaska, Lamar Alexander of Tennessee and independent Sen. Joe Lieberman of Conn., have shown an interest in climate legislation — if nuclear energy plays a greater part.To many environmentalists, it remains a choice of dealing with one overriding environmental problem, while accepting another, to some degree.You can't dismiss nuclear power's potential as a climate solution,says Susan Vancko of the Union of Concerned Scientists. Yet, she says, with reactors costing upward to $10 billion apiece, this is one of the most expensive options out there to cut greenhouse gases.Vancko cautions against providing almost unlimited loan guarantees for reactors that could go bust.A group of 14 environmental and anti-nuclear groups expressed concern in a recent letter to senators that easing licensing requirements and rushing to build new plants would fatally undermine public confidence in the safety of U.S. reactors.Atop the nuclear industry's wish list — 26 items covering two single-line typewritten pages — is an expansion of loan guarantees for new reactors. But it also mentions eliminating some speed bumps in the road to reactor licensing, new efforts to deal with reactor waste and an array of other items.

CHICAGO – Capmark Financial Group, one of the nation's largest commercial real estate lenders, has filed for bankruptcy protection amid mounting bad debt.Capmark has been hurt by rising losses on mortgage loans, and has had to foreclose on properties such as the Equitable Building in Atlanta because borrowers were not able to make loan payments. In its Chapter 11 filing Sunday in Delaware bankruptcy court, the company listed total debt of $21 billion and assets of $20.1 billion. It seeks to reorganize under court protection, reducing its debt while continuing to operate its businesses.Many U.S. banks and real estate investment trusts have been hurt by increasing losses on commercial real estate loans. With millions of jobs lost and office space remaining empty during the recession, developers have been forced to default on loans. Analysts predict that commercial real estate defaults will rise rapidly.We view this reorganization process as an unfortunate but necessary response to recent unprecedented conditions in financial and commercial real estate markets, which presented a significant challenge for Capmark and similarly situated finance companies,said Capmark President and CEO Jay Levine, in a statement. By constraining the availability of capital, these difficult market conditions had a negative effect on all our core businesses.Last month, Horsham, Pa.-based Capmark posted a $1.6 billion quarterly loss, as it set aside $345.8 million to cover loan losses during the quarter ended June 30. The company had been in talks with lenders and bondholders to restructure its debt so that it could stay in business.Capmark in September agreed to an option to sell its North American servicing and mortgage businesses to Berkadia III LLC — a joint venture of Warren Buffett's Berkshire Hathaway Inc. and Leucadia National Corp.Now that Capmark has been forced to file for bankruptcy protection, it will receive $415 million in cash and a $75 million note in the deal, minus any losses on a portfolio of mortgages. Had the transaction been completed outside of bankruptcy court, Capmark would have received $375 million in cash at the closing. Berkadia would have held $40 million to cover indemnity claims and pay the $75 million note.Capmark was created in 2006 after a private equity group led by KKR & Co., Goldman Sachs Capital Partners and Five Mile Capital Partners bought the commercial real estate business of lender GMAC LLC for $1.5 billion in cash. According to the bankruptcy filing, the group owns 75.4 percent of the company. GMAC owns 21.3 percent, with most of the remaining shares owned by employees and directors.Messages left for KKR, Goldman Sachs and Five Mile were not immediately returned on Sunday.

In a statement, Capmark said its Capmark Bank subsidiary is not part of the Chapter 11 filing. The bank, which recently received $600 million in new equity from Capmark Financial, will continue to serve its customers.As of Friday, Capmark and its units involved in the filing had more than $500 million of cash and cash equivalents available to fund operations. Capmark said it believes it has enough liquidity at this time to allow it to pay vendors for goods and services and to pay salaries and continue benefits to its employees, and has filed motions with the court to allow it to do so.The Chapter 11 process will give Capmark the opportunity to restructure our balance sheet while continuing to focus on maximizing value for our principal stakeholders,said Mohsin Meghji, the company's chief restructuring officer, in a statement.Capmark's financial advisers are Lazard Freres & Co. LLC and Loughlin Meghji + Co. The company has retained New York-based firm Dewey & LeBoeuf LLP as bankruptcy counsel.Capmark's filing marks the latest in a string of commercial real estate-linked bankruptcies. General Growth, the second largest shopping mall owner in the U.S., in April filed for bankruptcy protection in the largest U.S. real estate bankruptcy case in history with $27 billion in debt. Extended Stay Hotels LLC in June also filed for bankruptcy protection, citing massive debt stemming from its 2007 acquisition by the Lightstone Group at the peak of the hotel market and a sharp drop in business travel due to the recession.Delinquencies on commercial real estate loans also remain a hot spot of potential trouble for many regional banks.

Published on the 80th anniversary of the 1929 stock market crash, the book offers a detailed analysis of recent economic and monetary policies to show why pundits on both the left and the right didn't foresee the current calamity.Day's credibility is bolstered by his prediction seven years ago of the collapse of the housing market and the destruction of the financial services industry, in addition to some remarkably precise market forcasts.

In a Sept.23, 2002, WND column, he wrote:

There can be little doubt that the implosion of the equity markets will soon be followed by the pricking of the credit and real estate bubbles. As great financial houses such as Citigroup and JP Morgan Chase teeter on the edge of bankruptcy, it is well within the realm of possibility that the triple whammy of the equity, credit and real estate implosions will lead to the collapse of the entire global financial system.Day told WND he wrote the book in order to give people a means of understanding what created the present economic situation and why there is a severe dislocation between what they are experiencing in the daily lives and what the government and the financial media are telling them.I think it is important for future generations to know what the assumptions, the theories and the policies were that led to this ongoing debacle, so that they have a better chance of not repeating the same mistakes of their fathers and great-grandfathers,he said.Day said the ideal reader of his book is anyone who scratches his head wondering how the Dow Jones Industrial Average could rise 50 percent in six months despite a rapid increase in unemployment, massive loan defaults and declining global production.I think anyone who is shocked at the way the politicians of both parties have continued to put the interests of Wall Street ahead of the interests of American homeowners, workers and small businesses is going to get a lot out of it,he told WND.I don't know if those who were burned by the tech and real estate bubbles will necessarily enjoy reading the book and learning how the odds were always stacked against them, but it should help them avoid buying into the next investment charade.

Day writes in The Return of the Great Depression that for anyone equipped with the correct theoretical models of economics, the financial crisis was entirely predictable.He points to the bipartisan push for increased homeownership through low interest rates and relaxed lending standards,which destroyed wealth rather than creating it.But what is less well known,he writes,is that long before the subprime lending market erupted in 2004, it was already apparent to a few clear-eyed and contrarian economists that the housing market was possessed of the same irrational exuberance that had propelled the 1999 technology stock bubble to such gravity-defying extremes.He cautions: Many of the same individuals who did not see the crisis coming are now loudly assuring the public that the worst is already past, whereas those who correctly anticipated it tend to be somewhat less optimistic about the future.

The river is rising

In his detailed analysis, Day explains the U.S. economy has relied on a constant increase of the level of debt to fund its economic growth.He points out the average annual expansion of commercial bank credit since 1973 is 8.4 percent, which has sustained an average of 3 percent yearly GDP growth.But total loans and leases at commercial banks have fallen 6.8 percent this year and 8.3 percent since their peak in October 2008.This is an unprecedented decline,he warns,as the largest previous annual contraction was -1.0 percent in 1975. This strongly indicates the onset of the debt deleveraging process predicted by those who foresee a depression-sized event.The amount of failed bank deposits as a percentage of total bank deposits is more than twice as high as the rate during the first two years of the Great Depression, he points out, and the FDIC has announced its insurance fund is already in the red and does not anticipate returning to solvency until 2012 at the earliest.

Meanwhile, executives at large multinational industrial companies are privately reporting their future order books look worse for the first quarter of 2010 than they did for the first quarter of this year when the effects of the current crisis were being realized.Day told WND he believes there is no way of avoiding an economic contraction of massive proportions because there is no way of escaping the debt bomb that does not involve very serious economic costs.The level of debt in an economy is somewhat like a river rising towards its banks,he explained.It doesn't take a rocket scientist to realize that once the water reaches a certain level, it's going to spill over the sides and flood everything.Unfortunately for the American people,he continued,the Congress and the Federal Reserve have been trying to prevent the river from rising by pouring more water into it. It's simply not going to work.

Friedman's Keynesian dream-Day takes aim not only at the economic principles of John Maynard Keynes that are so influential today – based on the belief that the private sector needs the intervention of the central bank and government to maintain stability – but also at vaunted free-market champion Milton Friedman.

John Maynard Keynes-Day argues that while Friedman parted from Keynes on fiscal policy, he reached the conclusion that monetary policy could be even more effective than Keynes had ever imagined.Friedman's solution for reducing the prospect for active intervention as well as the margin of human error was to propose the establishment of monetary rules instead of monetary authorities,Day explains. Friedman's dream,he writes,remained essentially a Keynesian one of defeating the business cycle and utilizing technical measures to provide a means of permanent economic growth.Day concludes that any economic actor in the industrialized nations today needs to understand and accept that there is no easy, magical solution to a situation that has taken decades to come to fruition.Regardless of whether one traces the roots of the problem back to the 1971 creation of the full faith and credit debt-dollar, the 1933 abandonment of the gold standard, or the 1913 establishment of the Federal Reserve, this is not a crisis that developed overnight and it will not sort itself out quickly either,he writes.Noting the Great Depression brought about massive changes in American society that echo today, he believes that 80 years later,the return of the Great Depression will surely inspire changes of similar magnitude.But we must dare to hope that this time,he concludes,Americans and the people of other nations around the world will discover that the solution will not be found in more government control over society, but through an increase in human liberty and freedom for the individual economic actor.
