A story came out a little while ago that, quite honestly, I can't believe I missed, but someone sent it to me. It's about the presidential assassination program, where American citizens are targeted for killings far away from any battlefield, based exclusively on unchecked accusations by the executive branch that they're involved in terrorism.There are allegedly dozens of Americans on this hit list who pose a threat to the United States. National Security Adviser John Brennan said this:

So, we just shoot them on the spot and don't worry about their Miranda rights as American citizens? Now if it were on the battlefield — fine, I get it. But away from the battlefield? Let's refresh our memories on what this administration said they believed:
- There's no terrorism, just man-caused disasters
- Won't use the term enemy combatant
- Changed the War on Terror to overseas contingency operation
- Brennan proclaimed that jihadists aren't the enemy:

Obama campaigned on closing down Gitmo, because of all the horrors and atrocities being committed there. By the way, has anyone seen the story covered by Fox that Gitmo inmates are watching Twilight on brand new flat panel TVs? Sounds horrible, doesn't it?. But Obama said Gitmo had to be closed because it didn't line up with America's values and ideals — sitting around all day watching TV on the government's dime does seems to be the new American ideal, but I digress.
- Obama promised, if elected, to end the Bush administration system of warrant-less wiretaps. He believed it was an affront to human rights if phone calls to terrorists were monitored.But it's totally cool to just shoot Americans suspected of terrorism?

I'm a little confused; those values don't seem to line up. They're against the death penalty and they're against sending someone to prison without a trial, but pro-shooting American citizens without a trial? They claim to be pro-trial, but seem to be going against that. Is it possible they are trying to do to the court system what they've already done to Congress: Make it irrelevant? Where are the people who are not playing politics? Where are there principles? What do they really believe in? We can disagree in America. But to disagree and have an honest debate, we need principles. Where does this administration actually stand? They'll tell you one thing and do the exact opposite.I want to stop here for a second, because I guarantee you the lowlifes at George Soros' blogs like Media Matters have put down their World of Warcraft 3 controllers and have rushed back to call me all kinds of names. We are so polarized now that it's an automatic reaction: If Glenn Beck brings it up it's a lie! But, I mentioned that someone sent me this story, which I hadn't seen originally. The quotes we used a moment ago were from the far left-site Salon.com and the segment I watched was from the ever-conservative MSNBC:

I don't think I would have looked into this story if it had been reported on some GOP blog. But these guys are so in the bag for Obama, it bears investigating.
Assassinating American citizens without due process? What happened to Miranda rights? Even the ACLU expressed: profound concern about recent reports indicating that you have authorized a program that contemplates the killing of suspected terrorists — including U.S. citizens — located far away from zones of actual armed conflict. If accurately described, this program violates international law and, at least insofar as it affects U.S. citizens, it is also unconstitutional.Notice the ACLU says if accurately described. We asked the White House if we are accurately describing the presidential assassination program and were told to call the CIA.

America, you are in trouble.I am one of the strongest guys out there on terror and probably many people on the list are bona fide terrorists who — if I was on a jury to determine if they were terrorists or not — if they were, I'd probably vote to shoot them in the head. Instead of attacking the mayor of Owen Sound for her concern that projects are done with proper care and safety,the writer of the editorial in the July 14,edition should first get his facts straight.

To educate and inform the public there must be informed and correct writting.Why does Bruce Power continuously stress that all openings of the steam generators are being safeguarded by welded seals to keep all dangerous radiation from escaping?

Here the writer talks about the non-radioactive material in them,some 90%,will be broken down and recycled.Those hundreds of small pipes inside,part of the primary circuit containing heavy water,having accumulated large amounts of radioactive fission products over 20-odd years of service that makes them so dangerous.Those contents have to be decontaminated in Sweden to get the worst radiation hazard out and then recycled into the consumer market. The hulls of those behemoths as he calls them contain radiation like all other parts of refurbishing waste.

I have the strong feeling that the medical officer of health has not really got a grip on the process and just takes Bruce Power's assertions for real. Has she not heard about the alpha radiation contamination of almost 200 workers where Bruce Power was sure it did'nt exist at that site. Another grossly misleading statement I find in the writer's often obnoxious reasoning for defending the need for nuclear power generation ex-ie fuel cars with rainwater and heat our homes with dirt. tellng us that two-thirds of this provinces power is nuclear.Well even the energy ministry's website calls it only about 50%(or half)and if one looks at the daily output of all of Ontario's generating sources on www.sygration.com/gendata/to day even that doesn't hold true much of the time. (At 2PM on the day this was written from a total of about 22,000 MW of all generation sources only a little more than 9,000 MW was from nuclear).

The writer blasts the mayor for fretting publicly about steam generators falling into Owen Sound's harbour and then accusing her of apparently having no knowledge of engineering equipment and resources. I for one,would tell this writer with all those false statements to get educated on the real facts in the real world before accusing someone in authority who is applying precautionary principle(if he knows what that is)to protect her constituents from harm that can not be reversed.

Owen Sound's mayor is backing away from her opposition to Bruce Power's plan to ship 16 low-level radioactive steam generators out of the city this autumn. But many issues are unresolved. Ruth Lovell Stanners said Thursday that after investigating the matter further, she has decided that the Canadian Nuclear Safety Commission might be able to convince her that the shipment is safe. The federal regulator said Wednesday that the 100-tonne decommissioned generators do not present a risk to people or the environment.CNSC officials have accepted an invitation to speak at city council's July 26 meeting.If I get a comfort with their saying that it's safe, then I will have a comfort with that as well, Lovell Stanners said in an interview.

But then there remains the other extraneous issues, such as the security and the conversations that must go on with our police about closing roads — 16 days of closing roads — and security at the site itself . . . and insurance.At a council meeting Monday, Lovell Stanners told Bruce Power officials that she is concerned about the health and safety risk the shipments pose to residents of Owen Sound. She said accidents do happen, pointing to an incident in October 2008 when two 107-tonne turbines fell off a barge and to the bottom of Saint John Harbour. She questioned what would happen if a steam generator fell into Owen Sound Harbour. The more that I have learned, the less I am comfortable with this plan at all,she said during the meeting. Lovell Stanners said after Monday's meeting she spoke with her husband, Dr. Bruce Stanners, who referred her to a highly respected doctor of nuclear medicine.The doctor said the best thing to do to get sound information was to go to the Canadian Nuclear Safety Commission. So, given that that was the advice of this man, I thought it's exactly what I will do,Lovell Stanners said.Bruce Power says the plan is safe. So does Dr. Hazel Lynn, Grey-Bruce's medical officer of health.

Council has also invited Lynn to speak July 26.Lynn issued a statement Tuesday, in which she said she does not think the steam generators pose any risk to the public.
She said the boilers will be sealed and emit a very low level of gamma radiation that will not be measurable from two metres away. Lovell Stanners said it has been very difficult to get a true understanding of the issue because information is from one end of the spectrum to the other.Nuclear watchdog and environmental groups, along with Sarnia Mayor Mike Bradley, are opposing the shipments, saying they pose too much of a risk to the Great Lakes. The CNSC is considering an application from Bruce Power to transport the school bus-sized steam generators through the Great Lakes and to Sweden for recycling. The steel vessels will be loaded one by one onto a docked ship — about the same size as the Chi-Cheemaun — over three weeks, starting in mid-September. About 90% of the metal will be recycled. The CNSC said in its statement that those concerned by Bruce Power's proposed shipment of used steam generators can be confident that no licence will be issued unless the regulator is convinced that the shipment will be completed safely, without risk to the health, safety or security of Canadians or the environment.Bruce Power needs only a heavy load permit from Owen Sound, which cannot be denied due to health and safety concerns unrelated to the actual transportation of the components on city streets.

The majority of Owen Sound councillors said Thursday they do not share the mayor's level of concern about Bruce Power's plan to ship 16 low-level radioactive steam generators out of Owen Sound Harbour. Coun. Tom Pink said he is not convinced the health concerns addressed by Mayor Ruth Lovell Stanners are valid. For me, I use my intellect and not my innards to make a decision, he said in an interview. He said in everything that I've read and seen Bruce Power is trying to alleviate concerns in a reasonable and responsible manner. And yet we still act in, I would say, an unreasonable manner.He cited as an example Bruce Power's decision to alter its plan to store the steam generators by the harbour for five weeks until the ship arrives. The company now plans to pay for the ship to be docked in Owen Sound for three weeks and have each generator loaded within a day of its arrival in the city.Lovell Stanners expressed concerns to The Sun Times and Toronto media about the potential risks of storing the school bus-sized components by the harbour for weeks.Pink said Owen Sound enjoys relatively cheap power thanks to Bruce Power, so it must also accept the consequences of that benefit -- playing a part in getting rid of waste.

Despite assurances by Bruce Power, Lovell Stanners said earlier this week that she is concerned a steam generator could fall into the harbour, which is near the city's water treatment plant. On Thursday, she said she will feel comfortable with Bruce Power's plan if the Canadian Nuclear Safety Commission can convince her it is safe.
Coun. Bill Twaddle said council had not been involved in any discussions about the shipments before Monday night's meeting, even though the mayor had prior meetings with Bruce Power.He said he is not jumping to conclusions about the safety of the shipments, saying it is the responsibility of every elected politician to be as informed as possible before forming a decision.f the scientists -- the knowledgeable, educated people -- are comfortable and believe what is happening is safe, then I can't see that I can have any reason to vote against it,he said. Coun. John Christie said he believes the appropriate precautions are being taken by Bruce Power to ensure the shipments are safe.I think if we're going to develop our port more effectively as a commercial shipping point and a transshipping point for goods, then we need to face the fact that as far as wear and tear on the streets are concerned that that's one of the prices you pay for that, he said.

I'm not concerned about the hazardous element of this.Coun. Arlene Wright, Grey County's warden, said she sees no fault in the mayor's position, but does not share her concerns. If the nuclear agency says there isn't a problem with it, then that's fine, she said.She said it's unfortunate, however, that Bruce Power has not yet consulted with Owen Sound Police Services about the transportation of the vessels through the city. The company said Monday it will speak to the city police force.

Coun. Jim McManaman said he has no problem with Owen Sound Harbour being used as the port of choice for the shipments, as the city and region have enjoyed a lot of benefit from Bruce Power. I don't have the same level of concern as the mayor has expressed, he said.City staff will review Bruce Power's security and safety plan, he said. Coun. Deb Haswell said she has some concern about the stability of the harbour wall and wants assurance from Bruce Power that the company will pay for repairs if something goes wrong. I'm not convinced that there is a high risk of contamination. There's also the fact that Bruce Power is essentially our neighbour and sometimes it would be helpful to be a good neighbour, she said. Mayor Ruth Lovell Stanners is dead against a plan by Bruce Power to load 16 low-level radioactive steam generators onto a ship in Owen Sound Harbour and ship them to Sweden, but it seems unlikely she can stop it. The Tiverton-based nuclear generation company requires only a heavy load permit from the city, which cannot be denied based on health and safety concerns unrelated to the actual transportation of the 100-tonne vessels through Owen Sound, said city manager Jim Harrold. Bruce Power has already secured the support of Transport Canada, which owns the harbour, conditional upon the approval of a licence from the Canadian Nuclear Safety Commission. An application is now before the CNSC. It would be the first time a licence has been issued to ship nuclear waste across the Great Lakes. Bruce Power spokesman Ross Lamont suggested to council that the city would be in a legal fight if it refuses to issue the heavy-load permit, based on concerns with storing the steam generators by the harbour and shipping them out of Owen Sound.I find life is a lot simpler when we don't use lawyers. I would hope we would have a fulsome discussion as to why,he told council after being asked what would happen if the city said no. He said Bruce Power has no alternate plan to shipping the generators out of Owen Sound Harbour. Other harbours, including one in Goderich, have been ruled out.

Lovell Stanners would also require the support of her council colleagues to stop the plan. Owen Sound councillors Peter Lemon and Tom Pink said they support Bruce Power's proposal.Lemon said he is more concerned about invasive aquatic species, such as zebra mussels, hitching a ride on the ocean-going vessel and remaining in harbour than the risks of the low-level radioactive waste.Other councillors wanted more information.Lamont laid out for council Bruce Power's plan to ship the school bus-sized, decommissioned generators from its Tiverton site to the Owen Sound harbour. The steel vessels will be loaded one by one onto a docked ship -- about the same size as the Chi-Cheemaun -- over three weeks, starting in mid-September, and then shipped to a recycling facility in Sweden.Lovell Stanners said she is concerned about the impact the steam generators might have on the health and safety of Owen Sound residents. She questioned what would happen if one were to fall into the harbour.The more that I have learned, the less I am comfortable with this plan at all,she said during the meeting. Lamont said Bruce Power has chosen to ship the steam generators to Sweden to reduce the amount of waste that will be stored at the Bruce site property. About 90% of the generators' metal will be melted down in Sweden for reuse and the rest will be shipped back to Canada and stored as low-level nuclear waste. He said the generators will be welded shut and will not pose a danger to the public or environment. There will be a protected, guarded staging area in Owen Sound, he said.Bruce Power changed its plan to store the generators at the harbour for five weeks. Now, the plan is to load them on an awaiting ship over three weeks. The longest one will be stored along the harbour will be one night, Lamont said. He said standing next to one of the generators for two hours will deliver no more radiation than a chest X-ray.Bruce Power plans to ship another 16 generators across the Great Lakes, as part of the refurbishment of Units 1 and 2, in a few years. More will be shipped through Owen Sound as other units are refurbished.

Bruce Power is holding a public meeting July 27 at 5 p.m. at the Grey Bruce Health Unit building. It is also holding meetings in Saugeen Shores and at its visitor centre. The only decision council made on Bruce Power's plan Monday was to approve a motion by Coun. Bill Twaddle to invite medical officer of health Dr. Hazel Lynn to speak to council about it. Lamont said she is supportive. Bruce Power must submit its application for a heavy load permit to Owen Sound within 30 days of the shipments. Several anti-nuclear and environmental groups are circulating a petition to oppose Bruce Power's plan. Sarnia Mayor Mike Bradley and two state representatives from Michigan are among the people who have signed so far. Gordon Edwards, president of the Canadian Coalition for Nuclear Responsibility, said it is foolish to ship the steam generators, which have 5,000 corroded pipes inside, on the Great Lakes.The danger is that accidents do happen, he said. There's lots of radioactive junk inside those steam generators. In fact, Bruce Power doesn't even know the complete inventory of the radioactive material inside because it's impossible to measure from the outside and no one wants to go inside because it's too dangerous. If this material were to somehow find a pathway out into the environment, through either a puncture or a crack or just to corrosion, then you have this material leaking into the Great Lakes.Shipping the generators across the Great Lakes also sets precedence, he said, for larger and more dangerous shipments.

NEW ORLEANS – Oil from BP's blown out well is again seeping into the Gulf of Mexico, but this time, more slowly and scientists aren't convinced the cap that stopped the flow last week is making things worse.The government said Monday that oil was seeping into the Gulf after days of warning that the experimental cap on the oil well could cause more leaks.Despite what at first seemed a setback, though, the federal government declared the development insignificant and forged ahead with BP's plan for finally sealing the hole in the ocean floor.Ever since the cap was used to bottle up the oil last week, engineers have been watching underwater cameras and monitoring pressure and seismic readings to see whether the well would hold or spring a new leak, perhaps one that could rupture the sea floor and make the disaster even worse.Small amounts of oil and gas started coming from the cap late Sunday, but we do not believe it is consequential at this time, retired Coast Guard Adm. Thad Allen said.Also, seepage from the sea floor was detected over the weekend less than two miles away, but Allen said it probably has nothing to do with the well. Oil and gas are known to ooze naturally from fissures in the bottom of the Gulf of Mexico.At a Monday afternoon briefing in Washington, Allen said BP could keep the cap closed at least another 24 hours, as long as the company remained alert for leaks.Since the cap was closed Thursday, beachgoers have reported less oil fouling the shore.Bob Broadway, 41, of Huntsville, Ala., said his vacation spot in Orange Beach, Ala., has improved from a month ago.Then, he said, the oil was thick like chocolate and the beach smelled like an old mechanic's garage.

The beach looks better now than before, he said Monday.BP and the government had been at odds over the company's desire to simply leave the cap in place and employ it like a giant cork in a bottle until a relief well being drilled deep underground can be used to plug up the well permanently.Allen initially said his preference was to pipe oil through the cap to tankers on the surface to reduce the slight chance that the buildup of pressure inside the well would cause a new blowout. Thad Allen, said early Monday that government scientists had gotten the answers they wanted about how BP is monitoring the seabed around the mile-deep well, which has stopped gushing oil into the water since the experimental cap was closed Thursday.Late Sunday, Allen said a seep had been detected a distance from the busted oil well and demanded in a sharply worded letter that BP step up monitoring of the ocean floor. Allen didn't say what was coming from the seep. White House energy adviser Carol Browner told the CBS Early Show the seep was found less than two miles from the well site.The concern all along — since pressure readings on the cap weren't as high as expected — was a leak elsewhere in the well bore, meaning the cap may have to be reopened to prevent the environmental disaster from becoming even worse and harder to fix. An underground leak could let oil and gas escape uncontrolled through bedrock and mud.

The government's plan, however, is to eventually pipe oil to the surface, which would ease pressure on the fragile well but would require up to three more days of oil spilling into the Gulf.No one associated with this whole activity ... wants to see any more oil flow into the Gulf of Mexico, Doug Suttles, BP's chief operating officer, said Sunday. Right now we don't have a target to return the well to flow.An administration official familiar with the spill oversight, however, told The Associated Press that a seep and possible methane were found near the busted oil well. NEW ORLEANS – A giant oil skimmer brought in from Portugal is too big to be used in the Gulf cleanup effort.The Taiwanese vessel A Whale was deployed last week along the oil-slicked Gulf Coast. But it's been determined the skimmer didn't collect enough oil.The U.S. Coast Guard says it was too big to maneuver around the smaller patches and ribbons of oil on the water.Smaller, more agile vessels have been more useful in getting at the oil.Nearly 33 million gallons of an oil-water mix have been recovered.

This is not the first time the NSA has been tapped to help a U.S. corporation with cyber security, but the purported partnership would certainly be unique since Google’s servers house such a vast collection of user data including search histories, email, and personal documents,reports PC World.Google’s connection with the CIA and its venture capital firm extends to sharing at least one key member of personnel. In 2004, the Director of Technology Assessment at In-Q-Tel, Rob Painter, moved from his old job directly serving the CIA to become ‘Senior Federal Manager’ at Google.,writes Eric Sommer.

In-Q-Tel, a venture capital firm established by the CIA, also had a hand in creating the wildly popular social network Facebook. Finally, it also appears that Google’s widely criticized efforts to collect wireless network data on American citizens were not inadvertent, contrary to the company’s claims.As history has repeatedly shown, alliances between the U.S. intelligence community and giant corporations that collect data on American citizens can be a toxic combination where the U.S. Constitution is concerned,the letter said.In a June 9 letter to the Energy and Commerce Committee, Google director for public policy Pablo Chavez asserted that Google mistakenly included code in our software that collected samples of payload data from private WiFi networks. But review of a patent application from Google covering the gathering of WiFi data published Jan. 28 shows that the data collection program was a very deliberate effort to assemble as much information as possible about U.S. residential and business WiFi networks.

The letter continued:…what the patent does show is that Google’s recent claims about how the Street View program was designed are not accurate, and that the company always intended to collect and store the packets of wireless data that contain so-called payload information. The patent makes repeated reference to capturing packets, including paragraph [0055], which states that the system will enable geolocations so long as the equipment being used is able to capture and properly decode a packet…This raises serious questions about whether Google has engaged in a reckless effort to amass private data without giving any thought to the possible misuse of that information, and whether it can be trusted to safeguard the information it collects from the prying eyes of the U.S. government.

EUOBSERVER / BRUSSELS - Brussels is to hold an EU summit with atheists and freemasons in the autumn, inviting them to a political dialogue parallel to the annual summit the bloc holds with Europe's religious leaders.While the EU is a secular body, the three European presidents, of the commission, parliament and EU Council, alongside two commissioners, on Monday met with 24 bishops, chief rabbis, and muftis as well as leaders from the Hindu and Sikh communities. The annual dialogue, which has taken place since 2005, is for the first time this year made legally obligatory under Article 17 of the Lisbon Treaty.Under pressure from Belgium, which constitutionally protects and financially supports humanist organisations as well as churches, the EU has been forced to hold a mirror-image summit, but of atheists, scheduled for 15 October.However, in a move that perplexed and annoyed humanist groups, the EU atheist summit will also welcome under the rubric of non-religious groups, the Freemasons, the secretive fraternal organisation, according to commission spokeswoman Katharina von Schnurbein.I find it rather odd, David Pollock, president of the European Humanist Federation, told EUobserver. Some of the Grand Lodges are secularist organisations, and strongly for separation of church and state, but they also retain all sorts of gobbledygook and myths such as the Great Architect of the Universe.

Hungary's forint, stock market fall

Hungary's currency fell sharply against the euro on Monday following the collapse of talks between Budapest and the International Monetary Fund and the EU over the country's deficit situation.The forint drooped 3.2 percent against the euro to 291.38 forints after the EU and IMF called off their review of Budapest's €20 billion bail-out, originally agreed in 2008 over the weekend, frustrated with the government's push for more spending leeway.Further endangering market confidence, the country's economy minister, Gyorgy Matolcsy, said on Hungarian television that tightening the country's austerity programme was out of the question if Hungary was to return to economic growth.More remains to be done to cement these gains and put Hungary on a strong and sustainable growth path,the IMF said on the weekend. Additional measures will need to be taken to achieve these objectives.Mr Matolcsy suggested talks with Brussels and Washington could resume in the Autumn.On Monday, commission spokesman Ton van Lierop told reporters that there were no direct, imminent consequences for Hungary at this stage.The country's centre-right leader Victor Orban had promising a lightening of the draconian austerity measures imposed by his Socialist predecessors, which had cut the country's deficit from 9.3 percent of GDP in 2006 to 3.8 percent two years later .

After the elections however, Mr Oban said that the country's economic and fiscal situation was much worse than the previous government's pronouncements had suggested and announced that he would indeed have to impose stringent austerity measures of his own.However, with an eye over their shoulder at the far-right Jobbik party's growing popularity, the prime minister's Fidesz party is politically constrained in terms of how much austerity can be implemented without a collapse in the party's support, as happened to the Socialists after their own austerity programme was announced.The government wants the EU-IMF to cut it some slack for 2011 spending after agreeing to tighten its belt this year.But the commission and the IMF feel this to be inadequate.

EUOBSERVER / BRUSSELS – With new institutions and powers granted by the Lisbon Treaty, the EU is looking to reset its relations with Switzerland, currently governed by 120-odd agreements covering everything from wrist watches to borderless travelling.We examined the state of our bilateral relations ... and looked at how to renew them in the future, based on sound legal and political foundations, EU council president Herman Van Rompuy said at a joint press conference with the Swiss president, Doris Leuthard.Mr Van Rompuy said the reset had to be based on Bern accepting the evolution of EU law, in contrast to the current situation, when nothing is adopted automatically by the Swiss side.The EU position is that this is not the way to continue. With 120 bilateral agreements in place, imagine the whole bureaucracy when you need to change one paragraph, one EU official familiar with the talks told this website.Some 60 working groups on specific issues covered by these agreements – ranging from the wrist watch industry to transport, border control and fight against fraud – currently meet twice a year, separately and with little exchange amongst each other. Ms Leuthard, switching from English into German and French, said that Switzerland too recognises the need to simplify the complex architecture of bilateral agreements. She stressed, however, that the new legal basis had to be clean, but in respect of our sovereignty.One offer made to the Swiss is a European Economic Area Lite, alluding to the current agreement with Norway, also a non-EU member who is fully integrated into the bloc's internal market and border-free Schengen area, but who unlike Bern automatically adopts any change to the EU laws.

Yet in a country where direct democracy is so deeply rooted that almost every decision is taken by referendum, the idea to adopt such legal automatism is unacceptable.Swiss voters already rejected in 1992 the country's accession to the EEA, precisely out of fear of losing sovereignty to Brussels, which is often criticised for its democratic deficit.Switzerland is against adopting EU laws automatically, using the argument that it is a sovereign country. But the EU says that as long as we are part of the internal market, we have to play by the book, Jean Russotto, a Brussels-based Swiss lawyer specialised in EU law and regulatory compliance told Euobserver.Another taboo subject for the Swiss public is the jurisdiction of the European Court of Justice, which has the ultimate say if a country infringes EU law. If Switzerland adopted the legislation automatically, it could, in theory be taken to the Luxembourg court by the European Commission in cases of non-compliance.This would be a problem, says Mr Russotto.The no-vote in 1992 was strongly influenced by the perspective of foreign judges having a say in the country. The situation has not changed very much since, although we've adopted a lot of EU aquis (legislation), but it was done by our own parliament, not automatically.A compromise solution could be found, however, as it is the case for Norway, Liechtenstein and Iceland – which form the EEA. In their case, there is a special court based in Luxembourg and confusingly named the EFTA court after the European Free Trade Agreement which also includes Switzerland. The EFTA court, however, has no jurisdiction over the Alpine country. In an odd twist, the chief judge of the EFTA court, Carl Baudenbacher, is Swiss, but representing Liechtenstein.

Parliament

On top of the existing differences over a potential over-arching agreement, a new actor on the EU side is likely to complicate negotiations: the European Parliament.
Following the entry into force of the Lisbon Treaty, the EU legislature has the power to strike down any international agreements negotiated by the EU commission.It already put EU-US relations on freeze for while when it vetoed a deal on bank data transfers for anti-terrorism purposes, citing privacy concerns.We want to deepen our relationship with the European Parliament, Ms Leuthard said.It is very important to involve parliaments, because they decide ultimately on the agreements and their content,she added.

Brussels wants US-style Miranda rights across Europe

EUOBSERVER / BRUSSELS - We have all watched American police or legal dramas - whether in the original version or dubbed or subtitled - and we are all familiar with and could probably recite the warning a police officer gives to a suspect as he is being handcuffed. You have the right to remain silent. Anything you say can and will be used against you in a court of law, the cop says to the villain. You have the right to speak to an attorney. If you cannot afford an attorney, one will be appointed to you. Do you understand these rights as they have been read to you? Now here in Europe, we may soon have a similar, but pan-European, practice.On Tuesday, the European Commission proposed that a common warning about an equivalent set of rights, but in written form in equally simple language - and in the suspect's own tongue - be adopted across Europe.These words we are so familiar with from American television are Miranda Rights, or, more correctly, a Miranda warning, after the court ruling that established the practice. Police are required to repeat them to suspects in custody in order to inform them of their constitutional rights before criminal proceedings can begin.But in Europe, with 27 countries, different legal systems and multitude of languages, the situation is more complicated and the commission is worried that this could lead to miscarriages of justice - and also result in unnecessary and expensive appeals.[Imagine] a German tourist gets arrested after a bar brawl in Italy. He does not speak the language. As a result, he does not understand why he is being held and what the charge is,the commission said in its statement announcing the new proposal.

In some member states, suspects only receive spoken information about their procedural rights, while elsewhere individuals are given written documents, but in complex legal language - and sometimes not unless explicitly demanded.Individuals cannot fully exercise their defence rights unless they know what they are. Knowing what your rights are and what you are accused of is crucial for a fair trial,said fundamental rights commissioner Viviane Reding. Dealing with the law can be an intimidating process and we cannot expect people to demand respect from the authorities for their procedural rights when they don't know what those rights are.In response, the commission is proposing that anyone arrested anywhere in the EU from now on should be immediately informed in writing with a Letter of Rights listing their basic rights during criminal proceedings in simple, everyday language. It will be given to suspects upon arrest in all cases, whether asked for or not, and must be translated if necessary.Such letters do exist in some EU countries already - a total of 12, with Germany and the Netherlands introducing such a system earlier this year. But Brussels wants this extended across Europe. Countries will be free to choose their own wording, but the commission has also offered a model of the kind of thing they would like to see in 22 languages.It makes good TV, but it also serves a very serious purpose: it gives people a chance to know and assert their rights. It gives them confidence that justice will be served, wherever they are in Europe, said the commissioner.The commission first proposed such a letter of rights in 2004, but the proposal stalled as part of a broader package of reforms that met with resistance from the member states.

However, in November last year, they asked the commission to come up with a new package of measures assuring suspects of their rights in criminal proceedings, but in a step-by-step fashion over the next few years, to allow for a greater likelihood that they would be approved and also to build up mutual trust between national justice authorities, still quite suspicious of each other's legal systems and traditions.The EU Miranda Letter is actually the second such proposed measure in this overall package. The first, given political backing by the member states and the European Parliament in March, gives suspects the right to translation and interpretation.This move too must yet be approved by EU countries and the parliament.
Next year, the commission will propose a law giving individuals a right to a lawyer and another offering the right to speak with relatives, employers and their embassy.
It sounds like a TV police drama, but soon it will be reality throughout the European Union,the commission said.

EU leaders dodge Islamic veil ban issue

EUOBSERVER / BRUSSELS - EU leaders have declined to comment on moves to ban Islamic veils in some member states, saying that the controversial issue is one for national governments alone to handle.Flanked by religious leaders from the Christian, Jewish, and Muslim faiths, as well as representatives from the Sikh and Hindu communities on Monday (19 July), European Commission president Jose Manuel Barroso and president of the European Council Herman van Rompuy both dodged a question asking for their views on the matter.This is not a European Union competence ... so as president of the commission I will not take a position on this issue, said Mr Barroso. Taking refuge in the legal reading of EU treaties, he said we believe it is a national competence.

Mr Van Rompuy simply added same answer.Their reticence - at a meeting to discuss tackling poverty with religious representatives - comes despite the fact that the potential bans have raised burning questions about the interplay between religious freedom, individual rights and possible wider societal demands in Europe.The lower houses in Belgium and France recently voted to ban the wearing of the full face veil such as the burqa or niqab in public while the Spain's parliament discussed the issue on Monday. Grounds cited for the ban include degradation of women and security reasons. Opponents of the move point out that only tiny percentages of Muslim women wear such veils and that banning them risks isolating the women concerned and fuelling anger within the Muslim community. The veil debate comes despite the fact that a broader debate on better integrating Muslims into educational, political and cultural life in Europe is largely left untouched. The divide is highlighted by Turkey's aspirations to join the EU. Its bid is foundering on, amongst other things, the fact that it is a predominantly Muslim country.Mr Barroso and Mr Van Rompuy were more forthcoming on the topic of the day - the fight against poverty and social exclusion - which they discussed with around 20 religious representatives.The commission president noted that over 80 million Europeans were at risk of poverty.Unemployment is the best tool to fight poverty but we must go beyond that, he added.Both he and Mr Van Rompuy pointed to the years of experience that churches and religions have in caring for those at the margins of society, now even more threatened by the extent of the economic downturn in the Europe.Mr Van Rompuy suggested that the financial crisis implies a deeper crisis of values and said that ensuring that the Union remains based on values is its added value in the world.

Although Mr Barroso instigated a religious dialogue in 2005 and it is now a legal requirement under the EU's new Lisbon Treaty, in place since December, it is unclear what concrete effects such meetings will have.Taking care to emphasize the poverty reduction element of the EU's new ten-year economic plan, Mr Barroso noted that is is not up to the EU institutions to give subsidies to religious organisations but to take on board some ideas where possible. Cardinal Erdö, President of CCEE (Council of European Bishops Conferences) said that the clause in the Lisbon Treaty promising open, transparent and regular dialogue with religious organisations had not yet been fully implemented.Jerzy Buzek, head of the European Parliament, noted that he would be meeting Catholic, Protestant and Orthodox leaders at the end of September to discuss how to make best use of the treaty article.The original version of this article mistakenly attributed the quote about the Lisbon Treaty's Article 17 on religious dialogue not yet being fully implemented to the President of the Commission of the Bishops' Conference of the European Community, Monsignor Adrianus van Luyn. Half the Public Wants to See Holy Temple Rebuilt

Half the Israeli public wants the Holy Temple (Beit HaMikdash) to be rebuilt. This is the main finding of a poll commissioned by the Knesset Television Channel and carried out by the Panels Institute. The poll was taken in advance of this Tuesday’s national day of mourning, known as Tisha B’Av, on which the two Holy Temples in Jerusalem were destroyed, 2,000 and 2,500 years ago, respectively.Forty nine percent said they want the rebuilding of the Holy Temple, while 23% said they do not. The remainder said they were unsure.The public is about evenly split on whether they believe it will happen, with a slight edge – 42% to 39% – to those who believe the Third Holy Temple will be rebuilt.Should the State of Israel take active steps towards the reconstruction? Forty-eight percent said no, while 27% said yes.The complete results of the poll will be broadcast on Channel 99, the Knesset channel, on Monday night at 9:30 P.M., right after the traditional evening prayers and mournful recitation of the Book of Lamentations in synagogues throughout the country.

Tisha B'Av Lamentations at Abandoned IDF Base of Adorayim

Dozens of Jews gathered Tuesday morning at the abandoned IDF base of Adorayim near Hevron, to recite lamentations and read from the Scroll of Eicha. The event is part of an ongoing effort to save the base from falling into hostile hands.The participants came from Jerusalem and other nearby communities including the Gush Etzion settlements, Kiryat-Arba, Hevron, Beit Haggai, Otniel and Negohot.Rabbi Reuven Tal, Chairman of the Religious Council of Har Hevron, recited the lamentations in a quiet, pained voice, and the public joined in.Rabbi Yehudah Glick, a leading activist for Jewish ascension to the Temple Mount, gave a lesson on the lack of wholeness in Jewish people's lives due to the absence of the Temple. The rabbi said that the taste of fruit nowadays is not like the taste fruit had in the Temple, and that the sky is not as blue as it was in Temple times. The foundation of the world, he said, was laid at the location of the Temple, and we are all connected to this womb, and through it to G-d. Interestingly, Opposition Leader Tzipi Livni used similar terminology in her reference to the Temple Mount Monday.

Rabbi Glick said that those who teach that the Temple will come down from the sky in one piece teach lies.The Temple will not come down from the sky, he said. Livni: Umbilical Cord Connected to the Temple Mount

Opposition leader Tzipi Livni lamented the lack of clarity surrounding the definition of the Jewish identity of the State of Israel Monday night at an event marking the fast of Tisha B'Av. The conference, which was held in Tel Aviv for the 12th year in a row, was entitled, Tonight We Do Not Learn Torah. Except for passages of sadness or warnings of punishment for Torah violations, Torah is not studied on the day of mourning for the destruction of the Holy Temples as its study causes happiness.The Kadima party chairwoman noted that one does not have to choose between intense secularism and extreme hareidi-religious observance. There is a large middle ground, and a very large public out there that is not necessarily observant but nevertheless has a Jewish connection, one that is wider than you are told about, and means more than what is written on identity cards. It is not connected to the hareidi religious Jews, it has nothing to do with them; it's about us, we who are not extremists. It's not a favor to anyone else.She added that the religious Zionist political parties do not work on a common denominator for all of us because of poitical power struggles and a terrible system of government that gives too much power to hareidi-religious parties. There are payments that give a monopoly on Jewish content to political parties that pull in their direction and theirs alone, and everyone pays the price,Livni said. The conversion law is one recent instance of that – where not relating to the common denominator is causing us to lose it.

She argued that it is time to set the parameters that define a Jewish state.It is clear what a democratic state is,she said, but less clear to everyone exactly what a Jewish state is. We are very close to the point at which we will no longer be able to do that,Livni warned. It would not be good if we split into separate societies, each of which does whatever it pleases on traditional occasions – Israel would lose her Jewish character, both nationally and religiously in the process.Livni also discussed her connection to Jerusalem, saying I live in Tel Aviv, but my umbilical cord indeed is connected to the Temple Mount, both from a personal perspective, and in my national, public life as well. The feeling of belonging to Jerusalem is not necessarily related to observance of the mitzvot (commandments), she added, although I regret it is weakening with the passage of time. The way to reconnect, Livni said, is through Jewish continuity on the national, and not the religious level.
Jerusalem must be returned to the younger generation, she said. Jerusalem is in difficulties and needs treatment. There is a need to educate the younger generation all over the country to feel a connection to Jerusalem. Hosting Company Says al-Qaeda Website Reason for Removing 73,000 Blogs

It was not copyright violations that prompted the hosting service Burst.net to pull more than 73,000 blogs offline earlier this month. It was al-Qaeda, the phony terror group created by the CIA.FBI Director Robert Mueller told a House Appropriations subcommittee in March that radical Islamist websites pose a threat to the United States.The site was shut down after FBI agents informed executives of Burst.net, Blogetery’s Web host, late on July 9 that links to al-Qaeda materials were found on Blogetery’s servers, Joe Marr, chief technology officer for Burst.net, told CNET. Sources close to the investigation say that included in those materials were the names of American citizens targeted for assassination by al-Qaeda. Messages from Osama bin Laden and other leaders of the terrorist organization, as well as bomb-making tips, were also allegedly found on the server.The FBI did not order Burst.net to pull the plug. Marr said a Burst.net employee erred in telling Blogetery’s operator and members of the media that the FBI had ordered it to terminate Blogetery’s service. He said Burst.net did that on its own, according to CNET.

Another site was taken down following the shuttering of Blogetery. Ipbfree.com, a platform for message boards, was removed within days of Blogetery. So far there is no explanation why Ipbfree.com was denied service.Many speculated that the FBI was using the Patriot Act to silence bloggers. But Marr emphasized that the FBI has never ordered Burst.net to stop service to any site it hosts without a court order and that the vast majority of Burst.net’s communication with the federal government has involved agents serving warrants related to terrorist or child porn investigations, CNET continues.Marr said the blogging platform was yanked because because bomb-making tips and a hit list are a violation of Burst.net’s terms of service.The FBI, however, did invoke 18 USC 2702, a portion of federal law that allows providers to voluntarily disclose information to police. Under the law the FBI has the right to ask that a service provider to turn over information immediately — without a court order — when the agency has reason to believe that lives may be threatened. The request also compels an ISP not to discuss the investigation, according to CNET.CNET reports that a source with knowledge of the investigation said material allegedly found on Blogetery’s server is connected to an online magazine called Inspire that supposedly recruits al-Qaeda patsies. The online magazine is reportedly edited by Samir Khan, a 24-year-old North Carolina man who moved to Yemen last October. Fox News reported that an article posted on the site was entitled Make a Bomb in the Kitchen of Your Mom.

Phoenix-based CrystalTech Web Hosting Inc. removed a popular forum for Islamic terrorists and their sympathizers in 2008, according to the Arizona Republic. Another Islamic terrorist website, alneda.com, was hosted by a company in Maryland that tracked back to Texas.In April of 2009, the Washington Post published an article reporting the Taliban had boasted about killing coalition forces in Afghanistan from a website hosted by ThePlanet in Houston, Texas. For more than a year, the militant group used the site to rally its followers and keep a running tally of suicide bombings, rocket attacks and raids against U.S. and allied troops, the newspaper reported.The United States encouraged Saudi Arabia and Pakistan to support the Taliban and provided support through the CIA and Pakistan’s ISI.A Department of Homeland Security document leaked to the alternative media last year reveals that the government considers patriot groups, returning veterans, and militia groups to be the primary terrorist threat within the United States.
