In April, a whistleblower told Congress’ House Judiciary Committee that the “United States federal government has become the ‘middleman’ in a multibillion-dollar human trafficking operation targeting unaccompanied minors at the southern border.”In May, U.S. Customs and Border Protection encountered an average of 435 unaccompanied minors per day. One study suggests that drug cartels and traffickers will exploit 60% of these children in prostitution, forced labor, and child pornography. To make matters worse, in June alone, the Biden administration released 344 kids to non-related adults in the U.S.—most of whom already had multiple children in their care. These children are prime targets for traffickers—for sex or labor.Notably, half of U.S. Immigration and Customs Enforcement’s “most wanted” criminals for child trafficking are from Mexico.Social Media-Social media platforms like Instagram and TikTok provide market access for traffickers and pedophiles in the United States. These men first meet and groom minors for sexual encounters over social media, often posing as boyfriends. Once they have lured their victims in, they then use social media to advertise and sell the minors for sex.One organization, United Against Human Trafficking, estimates that “55% of victims of U.S. sex trafficking aged 7 to 11 are recruited through social media apps and websites. … [Because of this,] fewer than 10% of cases happen by kidnapping.”Traffickers and pedophiles also use social media platforms like TikTok to distribute child pornography.Pornography-Child traffickers also frequently use minors to produce pornography. This creates a double harm: Not only are children sexually abused, but videos of their abuse are uploaded to major pornography websites like Pornhub, and their abuse is played over and over again.This is one area where public outrage and action have made progress. After a series of articles exposing Pornhub’s hosting of child pornography, the website deleted 80% of its content overnight—about 10 million videos. And Discover, Mastercard, and Visa immediately cut ties with the site.Broken Families-The most vulnerable children in the United States are those raised in single-parent homes, especially if an unrelated male is present. Children are 11 times more likely to suffer sexual and physical abuse in such situations. Without the protection of a mother and father in the home, children are more likely to run away, go missing, or spend time in the foster care system. In 2016, the National Center for Missing and Exploited Children found that 86% of sex trafficking victims were in the care of social services when they went missing.It’s Everywhere-Child trafficking is easy to find if you know where to look. For example, an exit off an interstate highway with a truck stop, an Asian massage parlor, and an adult superstore. Each of these locations separately is statistically more likely to be a location for trafficking, including the interstate itself. If they are grouped together, the statistical possibilities increase dramatically.It’s also not hard to figure out the types of public policies that could reduce trafficking. Policymakers should focus on social media use, the porn industry, and broken families—all complex matters that demand thoughtful solutions.But one thing that can be done immediately is less complex and more direct: The Biden administration must follow our existing laws and seal our porous southern border. On average, over 12,000 UACs are entering the nation monthly in 2023.Since taking office, the Biden administration has reported over 300,000 alien minor encounters. The Department of Health and Human Services reports that between Jan. 20, 2021, and Feb. 7, 2022, it placed nearly 150,000 unaccompanied children with sponsors in the U.S. It has been estimated that this influx of students will cost school districts an extra $4.6 billion annually.Rather than attempting to lower these large numbers, the Biden administration has embraced the Trafficking Victims Protection Reauthorization Act in a way calculated to increase them. Section 235 of the act, misleadingly titled “Enhancing Efforts to Combat the Trafficking of Children,” grants UACs special accommodations, such as expedited processing and benefits.“Not surprisingly, after Congress passed that provision, the number of UACs from non-contiguous countries soared, as parents (and more importantly smugglers) realized that section 235 … all but guaranteed that any such child who could make it illegally into the United States would be released into this country,” said Andrew Arthur of the Center for Immigration Studies.Section 235, coupled with Homeland Security Secretary Alejandro Mayorkas’ public statements that “we are not expelling unaccompanied children,” has only enticed more minors into making life-threatening decisions.The increased flow of UACs increased the demand for “sponsors”—i.e., people willing to house and care for the children so they can be processed out of Health and Human Services housing. To “remedy” this, the administration lowered the standards for sponsors, slashing the vetting process times to meet the deadlines set to meet Mr. Biden’s self-induced emergency.According to an HHS whistleblower, the lowered standards led to more of these children falling into the hands of cartels, pedophiles and pimps. Many were claimed by “family members” they had never met and then subjected to horrendous conditions.To curtail human trafficking, especially of children, the Trump administration allowed Immigration and Customs Enforcement to run DNA tests on immigrants claiming to be traveling in “familial units.” This program detected more than 6,000 fraudulent families. But even though the program was effective, Mr. Biden ended it.The absence of border security, in conjunction with nonexistent interior enforcement, has made the U.S. a fertile breeding ground for human trafficking.The Biden administration’s National Action Plan to Combat Human Trafficking proudly proclaims “pillars,” principles and priority actions but makes no mention of securing the southern border. It does, however, dutifully present ideas regarding equity, inclusion and gender.The administration persistently presses leftist talking points yet fails to recognize an obvious truth: Human trafficking—and the misery it causes—will continue to soar as long as there is no operational control of the southern border.Congress must act to repeal Section 235 of the Trafficking Victims Protection Reauthorization Act. Wednesday is National Human Trafficking Awareness Day, an occasion designed to draw attention to the presence of trafficking in our midst and the toll it takes on the victims. This year, for its most prominent anti-trafficking initiative, the Biden administration is urging the public to mark the day by wearing blue and sharing selfies on social media.The Biden border policies, meanwhile, have literally been contributing to the human-trafficking problem every single day since Jan. 20, 2021, when the president began dismantling immigration enforcement, resulting in the mass-migration crisis that continues today.Trafficking is the exploitation or enslavement of someone by force, fraud or coercion, for labor, domestic servitude or commercial sex. Law-enforcement agencies report that incidents have spiked in the last two years, among an astounding 2.2 million migrants apprehended in fiscal year 2022.Overwhelmed border agents are told to catch and release huge groups of illegal migrants, processing them swiftly, preventing officers from doing proper vetting of those apprehended — and often missing the opportunity to detect trafficking. The migrants are deposited on the streets of cities and towns in border states or transported to destinations around the country, where they are often isolated and vulnerable to exploitation and trafficking.State and local agencies end up having to cope. One Texas sheriff in a county along the smuggling routes told a recent conference of officials working to combat trafficking that before 2021, his deputies encountered one or two cases of trafficking a year. Last year, they dealt with 77 cases.In other horrific scenarios, smugglers persuade parents to hand over their children in pursuit of a “better life,” taking advantage of policies that virtually guarantee the release of the unaccompanied minor to a sponsor in the United States. In 2022, nearly 130,000 such minors were released to a sponsor, a new record.Under President Joe Biden, the priority is to move the minors out of government custody as quickly as possible, rather than conduct meaningful inquiry into the child’s situation or ensure the minor is placed in an appropriate and safe household. Background checks and home visits rarely take place. Instead, contractors attempt to do a well-check by phone, not a particularly effective way to ascertain if the child is being trafficked — and about one-fifth of sponsors don’t respond to the phone call, according to statistics officials gave Congress.These policies create an irresistible opportunity for labor and sex trafficking to occur. The traffickers promise naïve migrants jobs in the United States and instead lure them into indentured servitude, peonage, sex trafficking, extortion or demand they work for the smugglers to pay off their debts to the traffickers.Some traffickers prey on minors staying in the crowded, lightly supervised shelters where they cluster after crossing illegally. Other kids fall in with gangs after reaching their destination and are sexually assaulted and pimped out for profit. A Reuters report last month exposed that several Hyundai-Kia auto-parts factories in Alabama had hired dozens of Central American minors who had crossed the border illegally.The policies that govern the placement of minors who arrive unaccompanied are inadequate to prevent them from being placed in inappropriate environments that include labor and sex-trafficking situations and participation in or exposure to criminal gangs. These policies have always been inadequate, in part due to the unmanageable volume of cases, but have been relaxed even more by the Biden administration, increasing opportunity for bad actors to exploit the system. Swift release has been prioritized over the vetting of sponsors.The loose regulation of guest-worker programs, especially the H-2A and H-2B programs, also contributes to trafficking. The H-2A visa is available for farm workers, and the H-2B visa is available to employers for seasonal unskilled non-farm labor. As one study put it, conditions that create vulnerability for trafficking victimization are “built into” the temporary-work-visa programs. Under Biden, the worksite audits and raids that used to catch some of these trafficking situations have been abandoned.We can and must do better. Every trafficking victim represents a failure in border security and often a failure in government policies. Congress and the president have many options to prevent, deter and detect human trafficking. Start with securing the border, give more attention to worksite enforcement, and end the automatic release of minors into this country, instead emphasizing swift return to their home countries.Jessica M.
