LONDON (AP) — The World Health Organization estimates that nearly 15 million people were killed either by coronavirus or by its impact on overwhelmed health systems during the first two years of the pandemic, more than double the current official death toll of over 6 million.Most of the deaths occurred in Southeast Asia, Europe and the Americas, according to a WHO report issued Thursday.The UN health agency’s director-general, Tedros Adhanom Ghebreyesus, described the calculated figure as “sobering,” saying it should prompt countries to invest more in their capacities to quell future health emergencies.On Wednesday, reports indicated that in the United States alone, the number of COVID-19 deaths had surpassed 1 million, some 27 months after the country confirmed its first case.WHO tasked scientists with determining the actual number of COVID-19 deaths between January 2020 and the end of last year. They estimated that between 13.3 million and 16.6 million people died either due to the coronavirus directly or because of factors somehow attributed to the pandemic’s impact on health systems, such as cancer patients who were unable to seek treatment when hospitals were full of COVID patients.Based on that range, the scientists came up with an approximated total of 14.9 million.The estimate was based on country-reported data and statistical modeling, but only about half of countries provided information. WHO said it wasn’t yet able to break down the data to distinguish between direct deaths from COVID-19 and those related to the effects of the pandemic, but the agency plans a future project examining death certificates.“This may seem like just a bean-counting exercise, but having these WHO numbers is so critical to understanding how we should combat future pandemics and continue to respond to this one,” said Dr. Albert Ko, an infectious diseases specialist at the Yale School of Public Health who was not linked to the WHO research.For example, Ko said, South Korea’s decision to invest heavily in public health after it suffered a severe outbreak of MERS allowed it to escape COVID-19 with a per-capita death rate around a 20th of the one in the US.Accurately counting COVID-19 deaths has been problematic throughout the pandemic, as reports of confirmed cases represent only a fraction of the devastation wrought by the virus, largely because of limited testing. Government figures reported to WHO and a separate tally kept by Johns Hopkins University show more than 6.2 million reported virus deaths to date.Scientists at the Institute of Health Metrics and Evaluation at the University of Washington calculated in a recent study published in the journal Lancet that there were more than 18 million COVID deaths from January 2020 to December 2021.A team led by Canadian researchers estimated there were more than 3 million uncounted coronavirus deaths in India alone. WHO’s new analysis estimated that missed deaths in India ranged between 3.3 million to 6.5 million.In a statement following the release of WHO’s data, India disputed the UN agency’s methodology. India’s Health and Family Welfare Ministry called the analysis and data collection methods “questionable” and complained that the new death estimates were released “without adequately addressing India’s concerns.”Samira Asma, a senior WHO director, acknowledged that “numbers are sometimes controversial” and that all estimates are only an approximation of the virus’ catastrophic effects.“It has become very obvious during the entire course of the pandemic there have been data that is missing,” Asma told reporters during a press briefing on Thursday. “Basically, all of us were caught unprepared.”Ko said the new figures from WHO might also explain some lingering mysteries about the pandemic, like why Africa appears to have been one of the least affected by the virus, despite its low vaccination rates.“Were the mortality rates so low because we couldn’t count the deaths, or was there some other factor to explain that?” he asked, citing the far higher mortality rates in the US and Europe.Dr. Bharat Pankhania, a public health specialist at Britain’s University of Exeter, said the world may never get close to measuring the true toll of COVID-19, particularly in poor countries.“When you have a massive outbreak where people are dying in the streets because of a lack of oxygen, bodies were abandoned or people had to be cremated quickly because of cultural beliefs, we end up never knowing just how many people died,” he explained.Pankhania said that while the estimated COVID-19 death toll still pales in comparison to the 1918 Spanish flu pandemic, which experts estimate caused up to 100 million deaths, the fact that so many people died despite the advances of modern medicine, including vaccines, is shameful.He also warned that the cost of COVID-19 could be far more damaging in the long term, given the increasing burden of caring for people with long COVID.“With the Spanish flu, there was the flu and then there were some [lung] illnesses people suffered, but that was it,” he said. “There was not an enduring immunological condition that we’re seeing right now with COVID.”“We do not know the extent to which people with long COVID will have their lives cut short and if they will have repeated infections that will cause them even more problems,” Pankhania said.Times of Israel staff contributed to this report.

We are not done with this virus mutating," he said.The biggest risk in the fall, if boosting is delayed, is the potential for hospitals to fill up with those that are the most vulnerable all over again, Bancel said.The increased circulation from the intersection of waning immunity and a more transmissible variant, as is being observed with more Omicron subvariants in the U.S. and abroad, is the real risk, he said."We have a risk in the fall — if we don't have the booster campaign early enough —that we might not be in a great spot in the fall," Bancel said.Meanwhile, increased global circulation also feeds into the sprouting of more variants.Of the $5.9 billion in revenue from the vaccine in the first quarter of this year — a significant jump from $1.7 billion in Q1 2021 — a majority is coming from countries other than the U.S., according to Moderna.Meanwhile, the World Health Organization has been pushing the company to share its vaccine recipe even as it fails to order more doses through the COVAX facility program for lower and middle income countries.Moderna said during its annual shareholder meeting that it is selling its vaccine as low as $7 per dose to those countries and has waived its patent enforcement of the vaccine, in addition to its plans for a plant in Kenya in the coming years.In an earnings call Wednesday, chief financial officer David Meline said COVAX is another source of uncertainty for the company's 2022 projections.COVAX is "actually the consolidator of demand from countries" and needs to confirm the requests per country before confirming its order to Moderna, Meline said.

ATLANTA  (AP) — Georgia Secretary of State Brad Raffensperger accepted a judge’s findings Friday and said US Rep. Marjorie Taylor Greene is qualified to run for reelection despite claims by a group of voters that she had engaged in insurrection.Georgia Administrative Law Judge Charles Beaudrot issued a decision just hours earlier that Green was eligible to run, finding that the voters hadn’t produced sufficient evidence to support their claims. After Raffensperger adopted the judge’s decision, the group that filed the complaint on behalf of the voters vowed to appeal.Before reaching his decision, Beaudrot had held a daylong hearing in April that included arguments from lawyers for the voters and for Greene, as well as extensive questioning of Greene herself. He also received additional filings from both sides.Raffensperger is being challenged by a candidate backed by former President Donald Trump in the state’s May 24 GOP primary after he refused to bend to pressure from Trump to overturn Joe Biden’s victory in Georgia. Raffensperger could have faced huge blowback from right-wing voters if he had disagreed with Beaudrot’s findings.Raffensperger wrote in his “final decision” that typical challenges to a candidate’s eligibility have to do with questions about residency or whether they have paid their taxes. Such challenges are allowed under a procedure outlined in Georgia law.“In this case, Challengers assert that Representative Greene’s political statements and actions disqualify her from office,” Raffensperger’s decision said. “That is rightfully a question for the voters of Georgia’s 14th Congressional District.”The challenge to Greene’s eligibility was filed by Free Speech for People, a national election and campaign finance reform group, for five voters in her district who allege the GOP congresswoman played a significant role in the Jan. 6, 2021, riot that disrupted Congress’ certification of Biden’s presidential victory. They had argued that put her in violation of a seldom-invoked part of the 14th Amendment having to do with insurrection and makes her ineligible to run for reelection.Greene applauded Beaudrot’s decision and called the challenge to her eligibility an “unprecedented attack on free speech, on our elections, and on you, the voter.”“But the battle is only beginning,” she said in a statement. “The left will never stop their war to take away our freedoms.” She added, “This ruling gives me hope that we can win and save our country.”Free Speech for People, a national election and campaign finance reform group, filed the challenge on behalf of the voters. The group had sent a letter to Raffensperger on Friday urging him to reject the judge’s recommendation. They have 10 days to appeal his decision in Fulton County Superior Court.The group said in a statement that Beaudrot’s decision “betrays the fundamental purpose of the Fourteenth Amendment’s Insurrectionist Disqualification Clause and gives a pass to political violence as a tool for disrupting and overturning free and fair elections.”During the April 22 hearing, Ron Fein, a lawyer for the voters, noted that in a TV interview the day before the attack at the US Capitol, Greene said the next day would be “our 1776 moment.” Lawyers for the voters said some supporters of then-President Trump used that reference to the American Revolution as a call to violence.“In fact, it turned out to be an 1861 moment,” Fein said, alluding to the start of the Civil War..Greene is a conservative firebrand and Trump ally who has become one of the GOP’s biggest fundraisers in Congress by stirring controversy and pushing baseless conspiracy theories. During the recent hearing, she repeated the unfounded claim that widespread fraud led to Trump’s loss in the 2020 election, said she didn’t recall various incendiary statements and social media posts attributed to her. She denied ever supporting violence.Greene acknowledged encouraging a rally to support Trump, but she said she wasn’t aware of plans to storm the Capitol or disrupt the electoral count using violence. ROME (AP) — Pope Francis on Saturday blasted Catholics who, hewing to old-school versions of liturgy like the Latin Mass, have made an ideological battleground of the issue, decrying what he described as devil-inspired divisiveness in the church.Francis pressed his papacy’s battle against traditionalists, whose prominent members include some ultra-conservative cardinals. They have resisted restrictions, imposed last year by the Vatican, on celebrations of the old Mass in Latin in St. Peter’s Basilica and, more generally, for years have disparaged the modernizing reforms of the Second Vatican Council in the 1960s.Speaking at the Vatican to instructors and students of the Pontifical Liturgical Institute, Francis said it’s not possible to worship God while using the liturgy as a “battleground” for nonessential questions that divide the church.Francis has made clear he prefers Mass celebrated in local languages, with the priest facing the congregation instead of with his back to the pews. This includes a project for 56 homes in Negohot, which will be advanced through the deposit stage, and a plan for 534 homes in Shevut Rachel and 114 homes in Ma’aleh Michmash that are expected to be advanced through the final planning stage.In addition to adding thousands of new homes, the plans will retroactively legalize the Mitzpeh Dani and Oz V’gaon outposts. Israel is set to advance plans for nearly 4,000 housing units in Israeli settlements in the West Bank next week, despite firm American opposition to settlement construction.The Defense Ministry said 2,536 units are slated to be green-lit through the final planning stage by the Civil Administration’s Higher Planning Subcommittee at the Thursday meeting, while another 1,452 will advance through an earlier stage in the permitting process known as deposit.The expected approvals will come just over a month before a planned visit to Israel by US President Joe Biden.Washington has repeatedly said Israeli settlements threaten a two-state solution to the Israeli-Palestinian conflict. Some have been enriched up to 60% purity — a short technical step from weapons-grade levels of 90%. Meanwhile, Iran has stopped the IAEA from accessing some of its surveillance camera footage.Iran has long insisted that its nuclear program is for peaceful purposes. However, US intelligence agencies and the IAEA believe Iran had an organized military nuclear program up until 2003, while Israel has insisted that Tehran has continued to pursue nuclear weapons since then.

Syrian state media reported explosions on Saturday morning in the Deir Ezzor region in the east of the country.The SANA report said the blasts were caused by airstrikes and targeted an area surrounding a bridge.There were no immediate reports of casualties and the alleged strikes were not attributed to any country.As a rule, Israel’s military does not comment on specific strikes in Syria, but has acknowledged conducting hundreds of sorties against Iran-backed groups attempting to gain a foothold in the country. It says it also attacks arms shipments believed to be bound for those groups.Thousands of Iran-backed militiamen are deployed in different parts of Syria, with many of them in areas along the border with Iraq, including the region surrounding Deir Ezzor.Last month, Israel was alleged to have carried out strikes in Syria on three separate occasions, also including a daytime strike.In the most recent of the raids on April 27, four Syrian soldiers were killed and three were hurt in a strike near the capital Damascus, Syria’s state media said.Syrian state media quoted an unidentified Syrian military official as saying surface-to-surface missiles were fired from northern Israel at military positions near Damascus.The official claimed most of the Israeli missiles were shot down and that the Syrian military was looking into the “results of the aggression.”The Syrian military claims to shoot down incoming missiles after nearly every alleged Israeli strike, which Israeli military officials and civilian defense analysts largely dismiss as empty boasts.After the alleged daytime attack last month, local media reported explosions near the town of Masyaf, which is thought to be used as a base for Iranian forces and pro-Iranian militias and has been repeatedly targeted in recent years in attacks attributed to Israel.The Israeli strikes have continued in Syrian airspace, which is largely controlled by Russia, even since Moscow began its invasion of Ukraine.Israel has found itself at odds with Russia as it has increasingly supported Ukraine, while seeking to maintain freedom of movement in Syria’s skies.Emanuel Fabian contributed to this report.

Israeli forces demolished the home of a suspected terrorist overnight in the northern West Bank, clashing with Palestinian rioters on the scene, the military said Saturday morning.The Israel Defense Forces destroyed the floor where the home of Omar Ahmed Yassin Jaradat was located in a building in the village of Silat al-Harithiya.The operation was initially reported by Palestinian media outlets, and later confirmed by the military.Jaradat’s home on one floor of a building was destroyed, but the external structure was left standing. The demolition took place after legal appeals by Jaradat’s family were rejected.The IDF said that during the operation, “riots developed in various hotspots, during which suspects threw stones and threw Molotov cocktails at forces.” The military said troops also heard gunfire.According to the IDF, soldiers responded with low-caliber Ruger rounds, which are considered less lethal than the larger caliber rounds typically used by the IDF. Human rights groups have condemned the use of Ruger fire for riot control, as the weapon can still kill.The Red Crescent said that three Palestinians were wounded during clashes with Israeli forces during the demolition. There were no further details given on their conditions.Jaradat is accused of being part of a Palestinian Islamic Jihad cell that shot and killed Yehuda Dimentman near the Homesh outpost in December. Two other Israelis were lightly wounded in the shooting. Jaradat was arrested days after the killing.Israel demolishes the homes of Palestinians accused of carrying out deadly terror attacks as a matter of policy. Homesh was evacuated in 2005 following Israel’s withdrawal from Gaza and some West Bank settlements.While Israeli law bans resettling at Homesh, the army has tolerated the presence of the yeshiva for over a decade and a half. The area has also been the site of repeated clashes between the outpost’s hard-right Jewish settlers and local Palestinians.Since the attack, settlers have sought to pressure the government to legalize the yeshiva.Last month, several thousand right-wing Israelis marched to the dismantled Homesh settlement. Several opposition politicians participated, as well as former coalition whip Idit Silman, despite the fact that the march amounted to a violation of military law, which bars Israelis from returning to the grounds of the four settlements the government vacated in 2005. Jordan on Friday issued a warning against a planned eviction of 1,300 Palestinians living in eight villages in the South Hebron Hills, as well as plans to approve the construction of nearly 4,000 settlement homes in other areas of the West Bank.Jordanian Foreign Ministry spokesman, Haitham Abu Alfoul, said “the settlement expansion is a flagrant breach of international law and resolutions,” according to the official Petra news agency.“Abu Alfoul stressed that the Israeli settlement policy whether in establishing or expanding settlements, seizing lands or forcibly displacing Palestinians, is an illegal policy which is rejected and condemned,” the statement reads.The condemnation came as residents of the communities vowed to stay despite Israel’s High Court ruling late Wednesday night that the Israeli army could evict the residents of eight villages in the South Hebron Hills, after a legal battle lasting decades.The lives of thousands of Palestinians in a cluster of Bedouin communities in the southern West Bank have been on hold for more than four decades, ever since the land they cultivated and lived on was declared a military firing and training zone by Israel.Since that decision in early 1981, residents of the Masafer Yatta region have weathered demolitions, property seizures, restrictions, disruptions of food and water supplies as well as the lingering threat of expulsion.That threat grew significantly this week after Israel’s Supreme Court upheld a long-standing expulsion order against eight of the 12 Palestinian hamlets forming Masafer Yatta — potentially leaving at least 1,000 people homeless.On Friday, some residents said they are determined to stay on the land.The verdict came after a more than two-decade-long legal struggle by Palestinians to remain in their homes. Israel has argued that the residents only use the area for seasonal agriculture and that they had already rejected offers of compromise that would have given them occasional access to the land.The Palestinians say that if implemented, the ruling opens the way for the eviction of all the 12 communities that have a population of 4,000 people, mostly Bedouins who rely on animal herding and a traditional form of desert agriculture.The residents of Jinba, one the hamlets, said Friday that they have opposed any compromise because they have lived in the area long before Israel captured the West Bank in the 1967 Middle East war.Issa Abu Aram was born in a cave in the rugged mountainous terrain 48 years ago and has endured a tough life since building is banned here.In the winter, he and his family members live in a cave. In the summer, they stay in caravans near the cave. His goats are a source of income, and on Friday, he had laid out dozens of balls of hardened goat milk yogurt on the ground to dry.He said his 14 children grew up with the threat of expulsion hanging over them. His children are attending a makeshift school in Jinba, with the oldest son now in 12th grade.“He did not live in any other place except Jinba, how are you going to convince him … to live somewhere else,” he said.The Palestinian leadership on Friday condemned the Supreme Court ruling, which was handed down on Wednesday — when most of Israel was shut down for the country’s Independence Day.Nabil Abu Rdeneh, a spokesman for PA President Mahmoud Abbas, said the removal order “amounts to forced displacement and ethnic cleansing, in violation of international law and relevant UN Security Council resolutions.”The West Bank has been under Israeli military rule for nearly 55 years. ZAPORIZHZHIA, Ukraine (AP) — Dozens more civilians were rescued Friday from the tunnels under the besieged steel plant where Ukrainian fighters in Mariupol have been making their last stand to prevent Moscow’s complete takeover of the strategically important port city.Russian and Ukrainian officials said 50 people were evacuated from the Azovstal steel plant and handed over to representatives of the United Nations and the International Committee of the Red Cross. The Russian military said the group included 11 children.Russian officials and Ukrainian Deputy Prime Minister Iryna Vereshchuk said evacuation efforts would continue Saturday. The latest evacuees were in addition to roughly 500 other civilians who got out of the plant and city in recent days.The fight for the last Ukrainian stronghold in a city reduced to ruins by the Russian onslaught appeared increasingly desperate amid growing speculation that President Vladimir Putin wants to finish the battle for Mariupol so he can present a triumph to the Russian people in time for Monday’s Victory Day, the biggest patriotic holiday on the Russian calendar.As the holiday commemorating the Soviet Union’s World War II victory over Nazi Germany approached, cities across Ukraine prepared for an expected increase in Russian attacks and officials urged residents to heed air raid warnings.“These symbolic dates are to the Russian aggressor like red to a bull,” said Ukraine’s first deputy interior minister, Yevhen Yenin. “While the entire civilized world remembers the victims of terrible wars on these days, the Russian Federation wants parades and is preparing to dance over bones in Mariupol.”Roughly 2,000 Ukrainian fighters, by Russia’s most recent estimate, are holed up in the vast maze of tunnels and bunkers beneath the Azovstal steelworks, and they have repeatedly refused to surrender. Ukrainian officials said before Friday’s evacuations that a few hundred civilians were also trapped there, and fears for their safety have increased as the battle has grown fiercer in recent days.Kateryna Prokopenko, whose husband, Denys Prokopenko, commands the Azov Regiment troops inside the plant, issued a desperate plea to also spare the fighters. She said they would be willing to go to a third country to wait out the war but would never surrender to Russia because that would mean “filtration camps, prison, torture and death.”If nothing is done to save her husband and his men, they will “stand to the end without surrender,” she told The Associated Press on Friday.UN officials have been tight-lipped about the evacuation efforts, but it seemed likely that the latest evacuees would be taken to Zaporizhzhia, a Ukrainian-controlled city about 140 miles (230 kilometers) northwest of Mariupol where others who escaped the port city were brought.Some of the plant’s previous evacuees spoke to the AP about the horrors of being surrounded by death in the moldy, underground bunker with little food and water, poor medical care and diminishing hope. They said the car was moving toward civilians when it was hit by shelling, and that one soldier was killed and six were wounded.Moscow did not immediately acknowledge renewed fighting there Friday.Russia took control of Mariupol, aside from the steel plant, after bombarding it for two months. Ahead of Victory Day, municipal workers and volunteers cleaned up what remains of the city, which had a prewar population of more than 400,000. Perhaps 100,000 civilians remain with little food, water, electricity or heat. Bulldozers scooped up debris and people swept streets against a backdrop of hollowed-out buildings as workers repaired a model of a warship and Russian flags were hoisted.The fall of Mariupol would deprive Ukraine of a vital port. It would also allow Russia to establish a land corridor to the Crimean Peninsula, which it seized from Ukraine in 2014, freeing some of its troops to fight elsewhere in the Donbas, the eastern industrial region that the Kremlin says is now its chief objective. Its capture also holds symbolic value since the city has been the scene of some of the worst suffering of the war and a surprisingly fierce resistance.Asked whether Russia would soon take full control of Mariupol, Ukrainian President Volodymyr Zelenskyy said: “Mariupol will never fall. I’m not talking about heroism or anything.”“It is already devastated,” he told a meeting at London’s Chatham House think tank. He also said he remains open to negotiations with Russia, but repeated that Moscow must withdraw its forces.“We do not see the end of the war yet,” he said, calling on Russia to allow safe passage out of the steel mill to the Ukrainian troops.While they pounded away at the plant, Russian forces struggled to make significant gains elsewhere, 10 weeks into a devastating war that has killed thousands of people, forced millions to flee the country and flattened large swaths of cities.Ukrainian officials said the risk of massive shelling increased ahead of Victory Day. Serhiy Haidai accused Russian troops of checking phones and “forcibly disappearing Ukrainian patriots.” His statements could not be immediately verified. — Haidia also said more than 15,000 people remain in Severodonetsk, a city in the Luhansk region that’s seen as a key Russian target. He said he believes most residents wish to remain even though “entire blocks of houses are on fire.”— The small village of Nekhoteevk, in Russia’s southern Belgorod region bordering Ukraine, was being evacuated Friday due to shelling from Ukrainian territory, according to the regional governor, Vyacheslav Gladkov. His claims couldn’t be immediately verified. — Russian state agencies reported that two self-proclaimed separatist republics in Ukraine’s industrial east — the Donetsk People’s Republic and the Luhansk People’s Republic — appointed extraordinary ambassadors to Moscow. The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision — Planned Parenthood v. Casey — that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”Deliberations on controversial cases have in the past been fluid. Justices can and sometimes do change their votes as draft opinions circulate and major decisions can be subject to multiple drafts and vote-trading, sometimes until just days before a decision is unveiled. The court’s holding will not be final until it is published, likely in the next two months.The immediate impact of the ruling as drafted in February would be to end a half-century guarantee of federal constitutional protection of abortion rights and allow each state to decide whether to restrict or ban abortion. POLITICO received a copy of the draft opinion from a person familiar with the court’s proceedings in the Mississippi case along with other details supporting the authenticity of the document. The draft opinion runs 98 pages, including a 31-page appendix of historical state abortion laws. The document is replete with citations to previous court decisions, books and other authorities, and includes 118 footnotes. The appearances and timing of this draft are consistent with court practice.The disclosure of Alito’s draft majority opinion — a rare breach of Supreme Court secrecy and tradition around its deliberations — comes as all sides in the abortion debate are girding for the ruling. Speculation about the looming decision has been intense since the December oral arguments indicated a majority was inclined to support the Mississippi law.Under long-standing court procedures, justices hold preliminary votes on cases shortly after argument and assign a member of the majority to write a draft of the court’s opinion. Bush appointee who joined the court in 2006, Alito argues that the 1973 abortion rights ruling was an ill-conceived and deeply flawed decision that invented a right mentioned nowhere in the Constitution and unwisely sought to wrench the contentious issue away from the political branches of government.Alito’s draft ruling would overturn a decision by the New Orleans-based 5th Circuit Court of Appeals that found the Mississippi law ran afoul of Supreme Court precedent by seeking to effectively ban abortions before viability.Roe’s “survey of history ranged from the constitutionally irrelevant to the plainly incorrect,” Alito continues, adding that its reasoning was “exceptionally weak,” and that the original decision has had “damaging consequences.”“The inescapable conclusion is that a right to abortion is not deeply rooted in the Nation’s history and traditions,” Alito writes.Alito approvingly quotes a broad range of critics of the Roe decision. He also points to liberal icons such as the late Justice Ruth Bader Ginsburg and Harvard Law Professor Laurence Tribe, who at certain points in their careers took issue with the reasoning in Roe or its impact on the political process.Alito’s skewering of Roe and the endorsement of at least four other justices for that unsparing critique is also a measure of the court’s rightward turn in recent decades. Roe was decided 7-2 in 1973, with five Republican appointees joining two justices nominated by Democratic presidents.The overturning of Roe would almost immediately lead to stricter limits on abortion access in large swaths of the South and Midwest, with about half of the states set to immediately impose broad abortion bans. Any state could still legally allow the procedure.

We now overrule those decisions and return that authority to the people and their elected representatives.”The draft contains the type of caustic rhetorical flourishes Alito is known for and that has caused Roberts, his fellow Bush appointee, some discomfort in the past.At times, Alito’s draft opinion takes an almost mocking tone as it skewers the majority opinion in Roe, written by Justice Harry Blackmun, a Richard Nixon appointee who died in 1999.“Roe expressed the ‘feel[ing]’ that the Fourteenth Amendment was the provision that did the work, but its message seemed to be that the abortion right could be found somewhere in the Constitution and that specifying its exact location was not of paramount importance,” Alito writes.Alito declares that one of the central tenets of Roe, the “viability” distinction between fetuses not capable of living outside the womb and those which can, “makes no sense.”supreme court-How rare is a Supreme Court breach? Very rare-By Josh Gerstein.In several passages, he describes doctors and nurses who terminate pregnancies as “abortionists.”When Roberts voted with liberal jurists in 2020 to block a Louisiana law imposing heavier regulations on abortion clinics, his solo concurrence used the more neutral term “abortion providers.” In contrast, Justice Clarence Thomas used the word “abortionist” 25 times in a solo dissent in the same case.Alito’s use of the phrase “egregiously wrong” to describe Roe echoes language Mississippi Solicitor General Scott Stewart used in December in defending his state’s ban on abortions after 15 weeks of pregnancy. The phrase was also contained in an opinion Kavanaugh wrote as part of a 2020 ruling that jury convictions in criminal cases must be unanimous.In that opinion, Kavanaugh labeled two well-known Supreme Court decisions “egregiously wrong when decided”: the 1944 ruling upholding the detention of Japanese Americans during World War II, Korematsu v. United States, and the 1896 decision that blessed racial segregation under the rubric of “separate but equal,” Plessy v. Ferguson.The high court has never formally overturned Korematsu, but did repudiate the decision in a 2018 ruling by Roberts that upheld then-President Donald Trump’s travel ban policy.-The legacy of Plessy v. FergusonPlessy remained the law of the land for nearly six decades until the court overturned it with the Brown v. Board of Education school desegregation ruling in 1954.Quoting Kavanaugh, Alito writes of Plessy: “It was ‘egregiously wrong,’ on the day it was decided.”Alito’s draft opinion includes, in small type, a list of about two pages’ worth of decisions in which the justices overruled prior precedents — in many instances reaching results praised by liberals.The implication that allowing states to outlaw abortion is on par with ending legal racial segregation has been hotly disputed. But the comparison underscores the conservative justices’ belief that Roe is so flawed that the justices should disregard their usual hesitations about overturning precedent and wholeheartedly renounce it.Alito’s draft opinion ventures even further into this racially sensitive territory by observing in a footnote that some early proponents of abortion rights also had unsavory views in favor of eugenics.“Some such supporters have been motivated by a desire to suppress the size of the African American population,” Alito writes. “It is beyond dispute that Roe has had that demographic effect. A highly disproportionate percentage of aborted fetuses are black.”Alito writes that by raising the point he isn’t casting aspersions on anyone. “For our part, we do not question the motives of either those who have supported and those who have opposed laws restricting abortion,” he writes.Alito also addresses concern about the impact the decision could have on public discourse. “We cannot allow our decisions to be affected by any extraneous influences such as concern about the public’s reaction to our work,” Alito writes. “We do not pretend to know how our political system or society will respond to today’s decision overruling Roe and Casey. And even if we could foresee what will happen, we would have no authority to let that knowledge influence our decision.”In the main opinion in the 1992 Casey decision, Justices Sandra Day O’Connor, Anthony Kennedy and Davis Souter warned that the court would pay a “terrible price” for overruling Roe, despite criticism of the decision from some in the public and the legal community.“While it has engendered disapproval, it has not been unworkable,” the three justices wrote then. “An entire generation has come of age free to assume Roe‘s concept of liberty in defining the capacity of women to act in society, and to make reproductive decisions; no erosion of principle going to liberty or personal autonomy has left Roe‘s central holding a doctrinal remnant.”When Dobbs was argued in December, Roberts seemed out of sync with the other conservative justices, as he has been in a number of cases including one challenging the Affordable Care Act.At the argument session last fall, Roberts seemed to be searching for a way to uphold Mississippi’s 15-week ban without completely abandoning the Roe framework.“Viability, it seems to me, doesn’t have anything to do with choice. But, if it really is an issue about choice, why is 15 weeks not enough time?” Roberts asked during the arguments. “The thing that is at issue before us today is 15 weeks.”-Nods to conservative colleagues-While Alito’s draft opinion doesn’t cater much to Roberts’ views, portions of it seem intended to address the specific interests of other justices. One passage argues that social attitudes toward out-of-wedlock pregnancies “have changed drastically” since the 1970s and that increased demand for adoption makes abortion less necessary.Those points dovetail with issues that Barrett — a Trump appointee and the court’s newest member — raised at the December arguments. She suggested laws allowing people to surrender newborn babies on a no-questions-asked basis mean carrying a pregnancy to term doesn’t oblige one to engage in child rearing.“Why don’t the safe haven laws take care of that problem?” asked Barrett, who adopted two of her seven children.Much of Alito’s draft is devoted to arguing that widespread criminalization of abortion during the 19th and early 20th century belies the notion that a right to abortion is implied in the Constitution.The conservative justice attached to his draft a 31-page appendix listing laws passed to criminalize abortion during that period. Alito claims “an unbroken tradition of prohibiting abortion on pain of criminal punishment…from the earliest days of the common law until 1973.”“Until the latter part of the 20th century, there was no support in American law for a constitutional right to obtain an abortion. Zero. None. No state constitutional provision had recognized such a right,” Alito adds.Alito’s draft argues that rights protected by the Constitution but not explicitly mentioned in it — so-called unenumerated rights — must be strongly rooted in U.S. history and tradition. That form of analysis seems at odds with several of the court’s recent decisions, including many of its rulings backing gay rights.“We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision....” Justice Samuel Alito in an initial draft majority opinion-Liberal justices seem likely to take issue with Alito’s assertion in the draft opinion that overturning Roe would not jeopardize other rights the courts have grounded in privacy, such as the right to contraception, to engage in private consensual sexual activity and to marry someone of the same sex.“We emphasize that our decision concerns the constitutional right to abortion and no other right,” Alito writes. “Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion.”Alito’s draft opinion rejects the idea that abortion bans reflect the subjugation of women in American society. “Women are not without electoral or political power,” he writes. “The percentage of women who register to vote and cast ballots is consistently higher than the percentage of men who do so.”The Supreme Court remains one of Washington’s most secretive institutions, priding itself on protecting the confidentiality of its internal deliberations.“At the Supreme Court, those who know don’t talk, and those who talk don’t know,” Ginsburg was fond of saying.That tight-lipped reputation has eroded somewhat in recent decades due to a series of books by law clerks, law professors and investigative journalists. Some of these authors clearly had access to draft opinions such as the one obtained by POLITICO, but their books emerged well after the cases in question were resolved.The justices held their final arguments of the current term on Wednesday. The court has set a series of sessions over the next two months to release rulings in its still-unresolved cases, including the Mississippi abortion case.
