Today there have been some sightings of objects reported by ships in the search area but none were associated with MH370 (as at 1900 AEDT).The Royal Australian Navy, using the Towed Pinger Locator from the United States Navy on Australian Defence Vessel Ocean Shield, and the Royal Navy, with a similar capability on HMS Echo, today began the underwater search for emissions from the black-box pinger from Malaysia Airlines flight MH370.A total of 14 aircraft and 11 ships were involved in today's search activities. The Australian Maritime Safety Authority determined a search area of about 217,000 square kilometres, 1700 kilometres North West of Perth.Weather in the search area was good, with visibility greater than 10 kilometres.

The Royal Australian Navy and Royal Navy have today commenced a sub-surface search for emissions from the black-box pinger from Malaysia Airlines flight MH370.Using the Towed Pinger Locator (TPL) from the United States Navy on Australian Defence Vessel Ocean Shield and a similar capability on HMS Echo, the two ships will search a single 240 kilometre track, converging on each other.This will be the first time that a sub-surface search will have been conducted in the search, in an attempt to detect the signal from the black-box of MH370.The Commander of Joint Task Force 658, Commodore Peter Leavy, said the two ships and their towed-pinger equipment would be operating at significantly reduced speed to search at depths of three thousand metres or more.“There has not been any change in the search,” Commodore Leavy said.“No hard evidence has been found to date so we have made the decision to search a sub-surface area on which the analysis has predicted MH370 is likely to have flown.“While the preference for search operations is to use physical evidence and then drift modelling to determine a smaller sub-surface search area, the search track is considered to be the best estimate possible for an area likely to contain the crashed aircraft.“The equipment on Australian Defence Vessel (ADV) Ocean Shield and HMS Echo can only operate effectively at reduced speed, around three knots.“The search using sub-surface equipment needs to be methodical and carefully executed in order to effectively detect the faint signal of the pinger.”Functionality tests were carried out on the TPL, Autonomous Underwater Vehicle (AUV) and transducer pole to prove its effectiveness during transit to the search area. All the acoustic sensors, GPS positioning, tracking and frequency systems and positioning of the equipment completed a functionality test.

PERTH (Reuters) - The search for missing Malaysia Airlines Flight MH370 in remote seas off Australia headed underwater on Friday, with a U.S. Navy high tech "black box" locator deployed for the first time as the battery life of the cockpit data recorder dwindles.Australian authorities said the so-called Towed Pinger Locator will be pulled behind navy ship HMAS Ocean Shield, searching a converging course on a 240 km (150 miles) track with British hydrographic survey ship HMS Echo."The area of highest probability as to where the aircraft might have entered the water is the area where the underwater search will commence," Retired Air Chief Marshal Angus Houston, the head of the Australian agency coordinating the operation, told reporters in Perth."On best advice the locator beacon will last about a month before it ceases its transmissions so we're now getting pretty close to the time when it might expire."On Monday it will be 30 days since the jetliner lost communications and disappeared from civilian radar less than an hour into an overnight flight from Kuala Lumpur to Beijing on March 8.The Boeing 777 was briefly picked up on military radar on the other side of Malaysia and analysis of subsequent hourly electronic "handshakes" exchanged with a satellite led investigators to conclude the plane crashed far off the west Australian coast hours later.Sonar may help find the plane's black box voice and data recorders that are key to unlocking what happened on the flight. The black box is equipped with a locator beacon that transmits "pings" when underwater, but which only has an expected battery life of around 30 days.Experts have warned the Towed Pinger Locator may be of little use unless investigators can get a much better idea of exactly where the plane went into water, because its limited range and the slow speed at which it must be pulled behind the ship mean it cannot cover large areas of ocean quickly.Houston said the start of the underwater search in earnest did not override the need to keep searching for surface wreckage of the plane, as a find would be the most effective way to pinpoint a sub-sea hunt."This is a vast area, an area that's quite remote. We will continue the surface search for a good deal more time," he said."I think there's still a great possibility of finding something on the surface," he said. "There's lots of things in aircraft that float. In previous searches life jackets have appeared which can be connected to the aircraft that was lost."

On Friday, up to 14 planes and nine ships were scouring the search area of about 223,000 sq km (86,000 sq miles) - roughly the size of the U.S. state of Minnesota - some 1,680 km (1,040 miles) west-north-west of Perth, he said.Britain is also sending HMS Tireless, a Trafalgar-class nuclear submarine with sonar capabilities and a Malaysian frigate was due to arrive in the search area on Saturday.Malaysian Prime Minister Najib Razak on Thursday joined his Australian counterpart Tony Abbott in a tour of RAAF Base Pearce, near Perth, where aircrews from seven countries have been flying dozens of missions deep into the southern Indian Ocean.Malaysian authorities have faced heavy criticism, particularly from China, for mismanaging the search, now in its fourth fruitless week, and holding back information. Most of the 239 people on board the flight were Chinese."The world expects us to do our level best, and I'm very confident we will indeed show what we can do together as a group of nations; that we want to find answers, that we want to provide comfort to the families and we will not rest until answers are indeed found," Najib said. 04 Apr. 2014-A new strategic reality in Europe-Speech by NATO Deputy Secretary General Ambassador Alexander Vershbow to the 21st International Conference on Euro-Atlantic Security, Krakow, Poland---NATO SITE

Let me start by thanking the Foundation Institute for Strategic Studies for organising today’s conference, together with the Konrad Adenauer Stiftung and the Polish Institute of International Affairs.  It’s a pleasure to visit beautiful Krakow once again, and this year’s conference comes at an especially opportune moment.For 20 years, the security of the Euro-Atlantic region has been based on the premise that we do not face an adversary to our east. This premise is now in doubt.Russia’s recent actions against Ukraine have been a wake-up call for everyone in the Euro-Atlantic community.  They follow a pattern of behaviour that we already observed in Transnistria, South Ossetia and Abkhazia.  The pattern is to influence, destabilize and even intervene in countries on Russia’s borders, to prolong “frozen” conflicts by supporting corrupt, separatist groups, and to thereby deny sovereign states the ability to choose their own security arrangements and to chart their own political destinies.President Putin’s goal is to create a sphere of influence in Eurasia and to prevent the emergence of stable democracies that could call into question the legitimacy of Russia’s authoritarian system.  This behaviour is more typical of predatory nation-states from the 19th century – and it is far removed from the cooperative and peace-building behaviour we expect to see from modern states today. It rips up the rulebook of inter-state relations that we have painstakingly written since the end of the Second World War, and it violates the many principles that Russia swore to uphold after the end of the Cold War.  It recreates new dividing lines in Europe, some 25 years after all of us – including more enlightened leaders in Moscow – erased them and committed ourselves to the values of liberty and democracy.Russia’s actions – altering legally recognized borders by force and actively subverting the government of a friendly neighbouring state – pose a real threat to an open, rules-based international system, a system based on respect for the sovereignty and territorial integrity of all states and their right to make their own choices without fear of intimidation or interference.In response, we in NATO have to make a painful and necessary choice of our own. If President Putin continues to guide Russia along its present path of aggression, confrontation and escalation, we will be forced to consider Russia less of a partner and more of an adversary.

This is not a choice that we want to make. Since the end of the Cold War, we have tried hard to reach out to Russia.  Our nations provided substantial economic assistance to Russia after 1991 and we made it a full and equal member of some of our leading global institutions, such as the G-8. When the new democracies of Central and Eastern Europe sought to join the Atlantic Alliance, we made a special effort to ensure that NATO enlargement went hand in hand with the development of a substantial partnership with Russia.  We believed that it was in our mutual interest for a democratic Russia to be a full partner within an all-inclusive Euro-Atlantic security system. Moreover, to make crystal clear that NATO enlargement was not directed against Russia, the Alliance made a series of unilateral commitments to refrain from deploying substantial combat forces or nuclear weapons on the territories of new Alliance member states. We partnered with the Russians as fellow peacekeepers in Bosnia and Kosovo. And we worked hard to engage Russia in dialogue and cooperation on many issues of common concern.Regrettably, while there were some success stories, NATO-Russia relations never achieved their full potential, much less the strategic partnership we set as our goal at the Lisbon Summit four years ago.  The unfortunate fact is that, even before the recent crisis, the scope of NATO-Russia cooperation was narrowing as Moscow assumed an obstructionist, zero-sum stance on virtually all major issues – including missile defence cooperation, non- strategic nuclear weapons and military transparency.Now, however, Russia has gone far beyond ‘agreeing to disagree.’   It is expressing its disagreement through unjustified military deployments, illegal referendums, and crude propaganda reminiscent of Stalin’s times, rather than engaging in an honest debate and search for common ground.  And Russia’s leaders appear to be falling victim to their own propaganda, seeing a Western anti-Russian conspiracy behind the legitimate strivings of its neighbours for honest government and mutually beneficial cooperation with the European Union and NATO.Our NATO Foreign Ministers’ meeting earlier this week made clear that there is still a broad consensus across the Alliance that engagement with Russia remains our preferred way forward.  This crisis is not ideological, and we do not face a renewed Cold War competition across the globe with the total paralysis of any cooperation that such a situation would entail.  Our past cooperation has borne real fruit and, in many areas, this cooperation could continue when conditions are right.  But we must face the possibility that for the foreseeable future, Russia will present a challenge to our aspiration for a Europe that is whole, free and at peace. So far, NATO has responded to the crisis in Ukraine in four ways, in tandem with the sanctions and other measures undertaken by our member states and the European Union. First, we have reaffirmed our full support for the sovereignty and the territorial integrity of Ukraine and the inviolability of its international recognised borders.  In this regard, I’m confident that Allies will maintain a long-term “non-recognition” policy regarding Russia’s annexation of Crimea.

Second, we have agreed to strengthen our support for Ukraine through intensified political and military cooperation. This includes helping Ukraine’s armed forces transform into modern and effective institutions that can defend their country against external threats while providing credible deterrence. It includes improving the ability of Ukrainian forces to operate together with Allied forces and greater participation in NATO exercises, so that Ukraine can continue to be a contributor to global security as we have seen in the Balkans, in Afghanistan and, most recently, in our maritime counter-piracy mission, Ocean Shield.Third, we have also reaffirmed our commitment to collective defence, deterrence and reassurance for NATO’s own members.  We have reaffirmed that Article 5 of the Washington Treaty is unbreakable and absolute, and that NATO will come to the defence of any of its members now and in the future.  Allies have already deployed additional fighter jets to police the airspace of our Baltic members. We have begun surveillance flights over Poland and Romania.  We remain ready to take additional steps if circumstances warrant, and we will apply the lessons of this crisis to future assessments of our strategy and force posture.Finally, we have suspended virtually all practical civilian and military cooperation in the NATO-Russia Council framework.  Our political dialogue will continue to allow us to exchange views on the current crisis and its resolution.  But business as usual is clearly not an option. NATO Foreign Ministers will review our relationship with Russia again when they next meet in June.  But in the next weeks and months, we will also assess the implications of Russia’s violation of the letter and spirit of its obligations, including those it assumed in the NATO-Russia Founding Act of 1997 and the Rome Declaration of 2002.  Clearly, our own assumptions about the nature of the relationship with Russia, and the unilateral commitments we made in the 1990s, will need to be reassessed. Russia’s actions over the past few weeks put our next NATO Summit in Wales in September in a very different light.  It will still be about “Future NATO” and set priorities for the Alliance for the period after 2014, following the completion of our decade-long mission in Afghanistan.  Many of our Summit deliverables may, in fact, be the same.  But we will need to work towards them with a new sense of urgency, taking into account the additional challenge we now must reckon with to the East.A first, crucial lesson from the recent crisis is that we must maintain a strong defence and deterrence in Europe.  If there was ever any doubt, the crisis now makes clear why we must invest sufficiently in defence and security, and why we cannot just keep cutting our defence budgets every year while others around the world continue to boost theirs.NATO’s greatest responsibility is to protect and defend our territory and our populations. To do that, we must ensure that we have the full range of capabilities to deter and defend against any threat.  This means high-end capabilities to deter and defend against large-scale threats to our territory, and expeditionary forces for future crisis management missions.  We need to be prepared for all threats.  And our people and platforms need to be ready to deploy wherever and whenever required, with the high level of interoperability we have attained through nearly two decades of non-stop operations.  This puts a premium on our Smart Defence and Connected Forces Initiatives, including a robust program of training and exercises.A second key lesson from the recent crisis is that we need not only the right capabilities to project stability, but also the right relationships. And so we must deepen our partnerships with other nations and organisations and explore ways to help others to project stability in their own region.  This must include doing what we can to support Ukraine and our other Eastern partners such as Georgia and the Republic of Moldova – in close coordination with the efforts of the European Union and other organizations.  And we must keep our door open for new countries to join our Alliance, making clear that no outside power can have a veto.Finally, the Ukraine crisis has highlighted the importance of the transatlantic bond.  In the tough economic climate of the past few years, the temptation to act alone – or in some cases, to opt out – has been strong.  But if we want to protect our shared security and our common values, America and Europe must continue to stand together, work together, and act together.The United States will continue to be involved in Europe’s security, and that involvement is constantly being updated and modernized.  We now need European nations to make a greater effort to match the U.S. commitment – both politically and militarily. Therefore, we need to redouble our efforts to work together to fill key capability gaps, including missile defence, cyber defence, and joint intelligence, surveillance and reconnaissance.  We need to more closely combine our efforts to address security challenges on our European doorstep – such as Ukraine.  And we need to continue to work together on challenges beyond Europe.  The Increased danger in Europe doesn’t mean we can pay any less attention to challenges in the Middle East, Africa or Asia.We also need to find a better balance of responsibilities between Allies – both between the United States and Europe and between Allies within Europe.  Increased multinational cooperation – NATO Smart Defence, EU ‘Pooling and Sharing’ – can make a difference.  But ultimately, a better balance can only be achieved by adequate levels of defence spending on the part of all allies, whether measured as a percentage of GDP or in terms of increasing the share of defence budgets devoted to modernization and investment.

KIEV (Reuters) - The Kiev government will stick to unpopular austerity measures "as the price of independence" as Russia steps up pressure on Ukraine to destabilise it, including by raising the price of gas, Prime Minister Arseny Yatseniuk told Reuters.Yatseniuk, 39, who stepped in as interim prime minister last month after Viktor Yanukovich and his ministers fled the "Euromaidan" protests, conceded that it would be very difficult "under the current Russian presence" to undo what he described as Russia's "international crime" in seizing Crimea.But he said Ukraine would never recognise the Russian takeover in exchange for re- establishing good relations."I want to be perfectly clear. We will never recognise the annexation of Crimea ... The time will come when Ukraine will take over control of Crimea," he said, speaking in English, seated in his cavernous, Soviet-built government headquarters beneath the blue and yellow Ukrainian flag.He has called himself the leader of a "kamikaze" government, doomed by unpopular austerity measures it must take, but he said Ukraine would stick to the measures, which include doubling gas prices for domestic consumers from May 1 and holding down state pensions and salaries against a background of a 3 percent contraction of the economy and double-digit inflation.IMF support - a $14-18 billion financial lifeline in return for tough economic reforms - would be a "tremendous step forward", he said."We will regain trust and credibility from foreign investors. Estonia, like every NATO member, can count on Allied solidarity at all times and against any threat”, the Secretary General said.Speaking about the measures taken by NATO in response to Russia’s aggression against Ukraine, Mr. Fogh Rasmussen underlined that NATO has more than doubled the number of fighter aircraft allocated to the Alliance’s air policing mission in the Baltic States.“And we will make sure we have updated military plans, enhanced exercises and appropriate deployments”, he said. The Secretary General also praised Estonia’s commitment to the Alliance. “It is now ten years since Estonia joined our Alliance.  Throughout, Estonia has made NATO stronger, and NATO has made Estonia stronger”, the Secretary General said. ”Over the years, brave and professional Estonian troops have made a substantial contribution to our challenging mission in Afghanistan. Pope Francis handed the queen a precious stone globe with a cross on it for Prince George, who is about to depart on his first overseas trip to Australia and New Zealand.The queen was given an antique parchment, which dates back to May 1679 with an “Urbi et Orbi” message by Cardinal Cesare Facchinetti. The pope traditionally gives a "urbi et orbi" message - meaning "to the city and the world" - at Easter and Christmas. The queen gave the pope a hamper of what the Vatican said was "jams and drinks" produced on lands owned by the royal family. FORT HOOD, Texas (AP) — The soldier who killed three people before committing suicide in an attack on the same Texas military base where more than a dozen people were slain in 2009 had shown no recent risks of violence, authorities said Thursday.The shooter, identified as Ivan Lopez by Texas Rep. Michael McCaul, chairman of the House Homeland Security Committee, opened fire Fort Hood on Wednesday afternoon. He wounded more than a dozen others.Military officials declined to formally identify the gunman, an enlisted soldier with the rank of specialist, by name until his family members had been officially notified.But Army Secretary John McHugh said the soldier saw no combat during a four-month deployment to Iraq as a truck driver from August to December 2011. A review of his service record showed no Purple Heart, which indicates he never was wounded.The soldier saw a psychiatrist last month and showed no "sign of any likely violence either to himself or others," McHugh said. When we think of the term "extremist" the average American automatically assumes the discussion is around Islam, or Muslims.  After all, extremism is regulated only to the Middle East countries and America is free of this ideology, right? If you think extremism is only a Muslim problem than you have another thing coming.  American extremist actions are gaining more ground every day.  Pat Dollard a former talent agent turned war correspondent tweets tonight "if 1 more act of Muslim terrorism, its time for Americans to slaughter Muslims in the streets, all of them."  If a Muslim says it's time to kill Americans we are ready to go to war but if an American says it's time to kill Muslims we call it free speech?  Calling for a blatant genocide over a terrorist act is about as extreme as you can get.What Dollard fails to realize is that extremists exist in every religious sect, heck any sect for that matter have had extremists for thousands of years to deal with.  Lest we forget the KKK claimed their actions in the name of Christianity persecuting any religion, creed, or race that was not the same as theirs.  I don't recall Americans calling for the death of all Christians if another act of violence was committed by the group. German Nazi's in war torn Europe marched millions of Jew's to their deaths in a real genocide yet Jewish Americans didn't go out and mass murder Germans in the streets of New York. Another Man in Florida burned down his neighbors home tonight because "they are lesbians."  Two adults, and 8 children were in the home he ignited all over his "beliefs."  I don't see LGBT groups sacrificing straight people in the courtyards tonight over the incident.Dollard and any of his followers who condone these types of actions are no better than the extremists they also condemn.  Muslims are bound to have some bad apples, in fact any sizable religion is going to have a few.  If you need a reminder of this we can look much closer to home, Timothy Mcveigh.  Mcveigh as we all know detonated a fertilizer bomb at the Federal Building in Oklahoma over the government actions in Waco, Texas and general American Policy.  Prior to learning that an American committed this horrific act of terror, Ibrahim Ahmad a Jordanian who resided in Oklahoma was the prime suspect, albeit falsely accused out of the media jumping the gun and pure coincidence. America has become so "Islamaphobic" that even the media goes to extremes when reporting suspected terror acts.  Glenn Beck is now being sued by Abdulrahman Alharbi for falsely identifying Alharbi as a prime suspect in the Boston Marathon Bombings.  Beck accused Alharbi of funding the attacks even after it was proven Alharbi was merely a witness to the attack.  Glenn Beck destroyed this mans name over the airwaves even after he was cleared by authorities.  There is no accountability in modern media.  Speculation reporting is doing more damage to our societal norms all in the name of ratings.  What's worse is the speculation fuels a growing fire within our sharply divided country spewing hate to those who do not understand what they are hating.  Instead, people are blindly following the speculation as if it were truth encouraging others to hate along with them.John McCain famously corrected a "supporter" whom stated to Senator McCain during the 2008 campaign "I can't trust Obama. I have read about him and he's not, he's not uh — he's an Arab. He's not — "  McCain quickly took the microphone back stating "No, ma'am. He's a decent family man [and] citizen that I just happen to have disagreements with on fundamental issues and that's what this campaign's all about. He's not [an Arab]."  If you followed the 2008 campaign you would find it easy to see how this supporter gained her facts.  Extreme right wing organizations were trying to drive fear toward the Obama campaign almost daily.  Birther's were attempting to prove Obama was born in Kenya thus ineligible to take the oath of office, and Fox News was inferring he was a Muslim because his middle name is Hussein and his Father was Muslim.  Obama is a Christian.Extremism takes many forms, and no one is safe from extremist people or extremist views.  However, extremism only takes shape when those who are being extreme do not, or are unwilling to understand the world outside of their own.

The Palestinians have “won” the Kerry peace initiative: the Obama administration is blaming both sides for its likely failure, not just the Palestinian side, which is the most they could have expected. The New York Times editorial goes one better: it points the finger pretty squarely at Netanyahu, which is radical for a Times editorial. So the Palestinians, having the clear sympathy of Europe and the rest of the world as the aggrieved party, can go to the UN after the talks run out on April 29 and be able to say: “We are seeking our independence here because Israel refused to give it to us.”At the same time, the BDS movement will almost certainly expand further into the mainstream – including among Jewish liberals. The Netanyahu government has shown itself on a very brightly lit stage to be the Palestinians’ rigid, punitive, mean overlord; it’s screwed itself in international opinion, which was always lousy, but now I think is going to be horrendous.So the Palestinians and their supporters – whose success is Israel’s success, regardless of their intentions – have a great opportunity. Politically, now is the time for the UN, for The Hague, for BDS, for unarmed “popular resistance.” Politically it’s the only option because if the Palestinians continue playing by America’s rules, they will never be free. From a purely selfish point of view, I hope they go for it.But if they do, they’re going to pay a high price in day-to-day suffering. Israel will crack down on them and make their lives even harsher in any number of ways. And America, as U.S. Ambassador to the United Nations Samantha Power told Congress on Wednesday, will do everything it can to block their advance in the UN. Congress will certainly cut off hundreds of millions of dollars in foreign aid. Maybe Europe, the UN and the Muslim states will make up the difference, and maybe they won’t.An Israeli crackdown, in an atmosphere of world disapproval of the Netanyahu government, will hurt Israel politically and bring more support for the Palestinian cause. That would be the dynamic of a Palestinian revolt (so long as it didn’t return to the mass killing of the Second Intifada, which the Israeli army is better equipped now to stop, and which the Palestinians seem to have realized is self-defeating). This is a practiced, successful script for oppressed peoples,  and by now the occupation has been going on for so long and Israel has become so haughty that a South African strategy, I think, can work. The world has run out of patience with Israel’s abusive game, and if the Palestinians press the issue on the ground and in the halls of power, backed by more and more international support, I believe this country will fold its hand like every haughty colonial power before it.But this is going to take time. It’s going to take several years. And victory isn’t certain. What’s certain is that millions of Palestinians will have to endure all kinds of hell before Israel cracks.So I don’t know if Abbas and the Palestinian Authority want to do this, to cut the rope after April 29 and take on Israel and the United States. But if they don’t, if they accept the bone of “restrained construction” in the West Bank or whatever other insult Kerry throws at them and agree to go on sitting still under Israel’s rule, the so-called Palestinian “street” will not sit still, not indefinitely, especially not after being conspicuously humiliated again by Israel and the United States.So if Abbas doesn’t leave the talks after their allotted time and go to the UN, he’s going to fall further in the eyes of his people and at some point the 79-year-old leader and his loyalists are going to be made irrelevant. At some point the Palestinians are going to cut the rope, because it’s only getting tighter. And when they do, we who oppose the occupation in safety and comfort will be called by our consciences to take some risks ourselves.

Secret EU lawmaking: the triumph of the trialogue

BRUSSELS - The setting could not be less spectacular – one of the more nondescript rooms in the European Parliament's glass towers overlooking Place Luxembourg in Brussels, where a handful of officials gather with armfuls of papers.At intervals, members of the Parliament's catering staff silently walk round the room offering tea and coffee. Unless you were involved, you wouldn't know that the meeting – one of around 1,000 so-called 'trialogue' meetings to take place in 2013 – was actually happening.At this particular gathering to discuss plans to re-write the EU's accounting directive in March 2013, MEPs from the Parliament's legal affairs committee – Klaus Lehne, Arlene McCarthy, Eva Lichtenberger, Alexandra Thein and Saj Karim – made a breakthrough.They secured rules that will shine a light on the payments made to governments by companies working in the controversial extractive industries – rules that should help prevent corruption and dodgy dealing between companies and governments.An Irish government official, whose country has been tasked with leading the talks (because Ireland held the rotating EU presidency at the time), agreed that, without exception, all payments over €100,000 must be publicly disclosed. This will apply to every individual project or contract undertaken by a company.The new reporting requirements will mark a sea-change in how the industry is regulated yet the trialogue meeting where it happened remains a closed process.Search for any mention of trialogues in the EU treaties and you will draw a blank.This is because despite being an accepted part of the lawmaking landscape, in legal terms trialogues don't exist.All trialogue meetings are informal and the timing of the meetings are not known to most MEPs, let alone the ordinary public. There are no formal minutes taken. Some are over within a few minutes. Others can go on all day and well into the night.The last trialogue on the single resolution mechanism (SRM), the final, and arguably most controversial piece of banking union legislation, lasted 16 hours through the night on 19 March as lawmakers sought (successfully) to close a deal in time for the end of the parliamentary term.Despite the sense of intrigue that should surround a lawmaking process that few people are aware is happening, attending the average trialogue meeting would be a perfect cure for insomniacs, as civil servants and politicians drone through a bill line by line, article by article.But they matter. If the EU's bi-monthly leaders' summits are the glamorous (in the loosest sense of the word) side of the EU, the trialogue meetings are the main engine driving the sausage factory that churns out EU laws in Brussels.

The triumph of the trialogue

In terms of numbers, the volume of legislation does not appear to have changed much in the past two legislatures. MEPs and ministers adopted a total of 447 laws in the 2004-9 parliament. By November 2013, politicians had signed off on 395 files and, even with a wild flurry of activity as they seek to conclude as much legislation as possible before May's elections, the total number of files is likely to be around 500.But what has changed is the way the laws are agreed.The formal structure for breaking the impasse between the institutions mentioned in the treaties is the conciliation committee.The conciliation committee, which also features MEPs together with European Commission and EU Council officials, but which is chaired by one of the parliament's vice-presidents, kicks in at the final stage of the lawmaking process – the third reading.But in the post-Lisbon treaty era, in which lawmakers are actively encouraged to go faster in agreeing legislation, the conciliation process has been almost eliminated in recent years. In the 1999-2004 parliament, 89 of the 403 pieces of EU law were completed after conciliation. In the first half of the current parliament term, the figure was down to a mere 4 percent.Around 80 percent of EU laws are now agreed at first reading, with research by the parliament estimating that the average law agreed at first reading takes 14.4 months from start to finish.The trialogue process, which starts as soon as the institutions agree an initial position on a law, is designed to speed the process up.Set up to broker agreements between MEPs and ministers, the number of trialogue attendees varies from file to file but the format remains the same. As a rule the rapporteur, shadow rapporteurs from other political groups and committee chair, comprise the Parliament's negotiating team on a law.Meanwhile, at other seats around the table are officials from the European Commission and either the minister or senior civil servants from the country holding the EU Council presidency.The participants are invariably armed with four-columned documents representing the starting position of the three institutions, with the fourth column left for the compromise text that is meant to emerge.Though they might not say so publicly, most MEPs and their staff, who frequently find themselves at the heart of lawmaking, enjoy the experience. For professional politicos, the novelty of piloting a piece of law through from the commission proposal to the end result adopted by MEPs and ministers takes a while to wear off.
Despite the ostensibly dubious health and social benefits of sitting in a poorly lit room for hours on end haggling with men and women in grey suits over the EU's milk quotas, many enjoy the sense of "being where the action is".Perhaps they have to. The staff of one MEP reveal that their boss attended over 40 trialogues in 2013. On average, around 25 separate trialogue meetings take place each week that the parliament is sitting. Tough work if you get it.

Power games

But some claim that the parliament goes into the average trialogue at an immediate disadvantage. The commission, they say, often sees itself not just as a broker between the two legislative bodies, but depending on which approach suits it best, decides whether it wants to behave like a "political executive" or as an "impartial civil service".French socialist Liem Hoang Ngoc, who locked swords with the commission over plans to increase the independence and transparency of the EU's statistical agency Eurostat, says that the EU executive tried to appoint itself as "judge and jury" on the bill."It used the full extent of its powers, including threatening to withdraw the legislation and requesting a unanimity vote at the council, to prevent the council from signing off on the agreement," he says."The civil servants we have been dealing with over the last few months seem to have some difficulties in grasping the concept of representative democracy."In one sense, the commission has an inbuilt advantage. As the EU's civil service, it is the one of the three institutions with the most permanence. Both MEPs and government ministers have to seek re-election. The rotating council presidencies only last six months.The commission also has two legal trump cards: it can withdraw its proposal, and can insist that legislation can only be adopted with the unanimous support of council.It also has an inbuilt expertise advantage from having more technical staff and experts than the other institutions."The legal affairs committee is criminally understaffed," one parliament official quips. As a result, he says, it was the EU executive which took the lead in the accounting directive negotiations, drafting compromises."It was impossible for the parliament's committee to match them so we asked them to propose possible compromises simply because they had the resources," the official adds.

"Legislation in a black box"

Others complain that democracy and transparency are the losers. The two points at which MEPs vote for laws, in committee before and at the end of the trialogue process, and the final vote among all 751 deputies, are both in public, but this only camouflages the fact that most of the negotiations are held behind closed doors with no public access.For their part, national parliaments complain that the process makes it even tougher for them to influence the process. Back in 2009, a report by the UK parliament's EU committee noted that the use of informal trialogues "makes it harder for national parliaments to conduct effective scrutiny of EU legislation".Meanwhile, a report published by the same committee last month describes them as "something of a 'black box' for those not directly involved in them".During an evidence session with two MEPs, Elizabeth Symons, a member of the British upper house, remarked: "We have gone through this enormously complex edifice and at every point my heart sinks as I recognise the dilution of the relationship between the electors and the decision-takers."And it is not hard to have some sympathy with this stance. Only a handful of committee members are involved in a trialogue process, and the deal that emerges at the end invariably bears little resemblance to the documents agreed by lawmakers in the parliament and council.

Democracy in danger?

For one parliament official, trialogues are "an arrangement that has evolved in a way that isn't favourable to the parliament. It just simply gives way too much power to the council and commission"."The commission is able to go to the [council’s] Coreper working group meetings, the EP is not there, so you clearly have the council and commission on one side and the parliament on the other," he says, adding that "the parliament's answer to this is simply that the council and commission don't sit next to each other in the trialogues". "Members here tend to get institutionalised," he says. "They take pride in building a network, of meeting ministers and commissioners, and so there is this culture of being nice to each other."But this is not a view shared by everybody.In a report on the effects of the Lisbon treaty on the power dynamics between the institutions, Portuguese centre-right MEP Paulo Rangel says that "the commission has, in practice, lost some of its political influences within the EU institutional architecture".Meanwhile, British centre-left MEP Arlene McCarthy, a former chair of the assembly's internal market committee and rapporteur on the bloc's bank bonus legislation, is more positive about the process."The parliament punches its weight much more now than it used to and where it works as a team," she says, "particularly if we go into a negotiation with four or five key priorities and have a clear hierarchy of these and how to get them".

Improving the system

"At the end of the day political decisions in this parliament are not taken by negotiations because they've all got to go back to the political groups," says McCarthy, who puts the burden of responsibility on shadow rapporteurs to make sure that colleagues in their political group know how negotiations are going.McCarthy also has little sympathy for deputies who complain that they have little idea on what they are being asked to vote for."MEPs should know what's going on from their shadow rapporteur," she adds, commenting that "there is no reason why you can't have people informed on the main issues.""It's largely up to the shadows to take a mandate from their group and to get support from their group because at the end they've got to sell it to their group before the final vote."The parliament's internal rules also require that committees are regularly updated on the progress of negotiations. Rule 70, agreed in 2013, states that "documents reflecting the outcome of the last trialogue shall be made available to the committee".McCarthy also questions the idea that MEPs should dot every i and cross every t, arguing that they should focus instead on the main political objectives of a bill."We shouldn't spend so much time on technical detail. Our job is to set a political framework. The political priorities are what we are good at," she argues.

The public interest test

It would be easy to dismiss the trialogue process as secretive and undemocratic, and it is certainly an oddity that the EU treaties contain not a single mention of the mechanism which is now a driving force for the vast majority of the bloc's new laws.Moreover, for institutions which constantly trumpet how transparent they are, it is hard to justify the secrecy that surrounds the trialogue process. It is not as if lobbyists, NGOs and journalists do not get access to the decisions that are made. One commission official comments that it is common practice for parliament officials to leak the outcome of trialogues to sympathetic lobbyists within hours of their conclusion.An old saying, much beloved of political hacks, is that the process of making laws and sausages are things which nobody wants to really know about.Moreover, if trialogue meetings and their minutes were opened up to the public, lawmakers would just find another way of negotiating in secret.In truth, the trialogue meetings themselves are just the tip of the iceberg when it comes to secret lawmaking. The papers held by one official working on the accounting directive detail a plethora of meetings with officials and so-called 'non-papers' with offers and counter offers of compromise texts bouncing between the institutions. But that is not to say that improvements to the transparency and accountability of the system could not be made.For his part, Dick Roche, Ireland's former Europe minister, admits to having "a feeling of unease" about the democratic implications of lawmaking by trialogue, but describes the process as "an understandable but pragmatic response to enormous pressure".To McCarthy, what matters most is that parliament, and the other EU institutions, are able to assess whether good law has been made. "We should pay more attention to the transposition of law," she states. "We have to be able to demonstrate that we legislated in the public interest."
