EU accused of meddling in Israeli democracy

EUOBSERVER / BRUSSELS - An archly conservative group with strong links to the Israeli government has attacked the human rights community in the Jewish state, saying that it is being bankrolled by the EU in a secretive attempt to undermine democracy. Israeli diplomats are touting in Brussels the investigative work of NGO Monitor, a body which claims that a clutch of officials in the heart of the EU is plotting to delegitimise Israel by funding local human rights organisations.

Professor Gerald Steinberg, NGO Monitor president, was last week brought to Brussels by Israel's EU mission to speak to MEPs and to promote his work among journalists.
The EU gives public funds to a small group of opposition groups in an effort to manipulate the political process,he told eurodeputies.In violation of the principle that democracies do not attempt to manipulate or interfere with the internal political processes in other democracies, anonymous European officials in charge of NGO allocations seek to exploit a minority group of Israelis to impose EU-favoured policies on the wider Israeli public.I don't see it as a conspiracy,he later told reporters.But with the EU lack of transparency in general, it is very hard to sort out.He compared the sums, amounting to 68.8 million shekels (€15 million) since 2006 for Israeli civil society groups including B'Tselem, Peace Now, the Public Committee Against Torture in Israel, Mossawa and Physicians for Human Rights Israel, whom he terms radical fringe NGOs, to the €15 million annually Israel spends internationally on its public diplomacy efforts.Mr Steinberg also named Amnesty International, Human Rights Watch and Oxfam as part of what he calls third-generation warfare against Israel.First came attacks from nation-states, he says; second came violence from non-state actors such as the PLO and the Intifada uprisings; and now the new form of war that is being mounted against the Jewish state comes in the form of human rights discourse that aims to delegitimise its right to exist.Across the board, these organisations cast Israel as having a poor record on human rights. They have a structural bias against Israel and they are very active in the demonisation and delegitimisation campaign of Israel,he said.

He is especially critical of B'Tselem, saying they play fast and loose with death rates and casualty counts in particular.They are primarily an anti-occupation organisation. They should campaign for Israeli human rights as much as they do for Palestinians,he said.He highlighted a November 2008 conference in Cairo that was funded by Oxfam and the EU entitled Impunity and Prosecution of Israeli War Criminals,saying plans were hatched at the event for two Belgian lawyers to later target Israeli officials with legal claims in Belgium on war crimes.Why is the EU giving money to private Israeli organisations? he said. My speculation is that it's a group of EU bureaucrats with personal ideological interests. And with the EU and these groups clinging to secrecy so stubbornly, it suggests that there's something going on under the surface.Sarit Michaeli, of B'Tselem, dismissed the accusations, saying that NGO Monitor attacks all civil society groups in Israel no matter how moderate, as soon as they criticise the current government.Everyone, all human rights NGOs are instantly delegitimisers and demonisers of Israel. There are no shades of grey [for NGO Monitor],she told EUobserver.She added that Mr Steinberg gives the impression of being an objective academic studying NGOs in the region, but is in fact a partisan of the current administration: He maintains he is independent of the Israeli government, but he has been a consultant to the Israeli Ministry of Foreign Affairs, he has represented Israel within the Organisation for Security and Cooperation in Europe programmes. This is not in any way someone who is independent of the Israeli government.She said that NGO Monitor fits in with the Israeli government's attempt to silence internal critics, such as NGO Breaking the Silence, an organisation of former Israeli soldiers who speak out about human rights abuses perpetrated in the occupied territories. In 2009, the Israeli Ministry of Foreign Affairs had meetings with the Spanish, Dutch and British governments in an attempt to stop them funding the group.It is tantamount to the government campaigning to discredit Israeli civil society and human rights NGOs,Ms Michaeli said. What [Steinberg] is actually doing in discrediting human rights groups in Israel, he is assisting in the creation of a system of repression of the crushing of internal dissent and actually injuring Israeli democracy - the very fragile democracy we have here.Mr Steinberg's own organisation receives most of its funding from private American Jewish foundations.The Israeli mission in Brussels for its part insists that NGO Monitor is not sponsored by the foreign ministry. The Ontario government has declared that it never passed any secret emergency law allowing police to demand ID from protesters on threat of arrest in the vicinity of the G20 meeting in Toronto last weekend.Last week multiple reports suggested that police had been given unprecedented powers to to arrest anyone near the security zone who refused to identify themselves or agree to a police search.

The Toronto Star reported:The regulation was made under Ontario’s Public Works Protection Act and was not debated in the Legislature. According to a provincial spokesperson, the cabinet action came in response to an extraordinary request by Toronto Police Chief Bill Blair, who wanted additional policing powers shortly after learning the G20 was coming to Toronto.The Globe and Mail reported that there were no limits to police powers during the summit, and no clear legal precedent specifying what they could and could not do.Throughout the weekend reports flooded in of protesters and even citizens of Toronto who were merely passers by being stopped outside the security perimeter and questioned by police under the amended law.However, the truth has now emerged that no such amendment to the law was ever made.The Ontario government did not pass a secret law that gave police additional power to arrest people during the G20 summit in Toronto, said Laura Blondeau, a spokeswoman for Community Safety Minister Rick Bartolucci.Blondeau said that the rules only applied to a limited area within the security perimeter, not up to five meters outside it or beyond, as earlier reports quoting Police Chief Bill Blair had suggested.Canadian Press reports: Asked Tuesday if there actually was a five-metre rule given the ministry’s clarification, Toronto Police Chief Bill Blair smiled and said, No, but I was trying to keep the criminals out.As the Canadian Press article points out, police did cite the Public Works Protection Act when detaining and searching people outside the security fences. Furthermore, Neither the province nor police set the record straight. In fact, both made comments about the necessity of such powers in media interviews all weekend.Yesterday, the Chief said he was originally under the impression that the five-metre rule applied to an area outside the perimeter but once he was told otherwise, a directive was issued to officers on the appropriate application of that regulation.Asked if failing to clarify the five-metre rule misled the public, he said: No, I never spoke publicly again about that regulation.

Wrong, chief.Though Blondeau, the government spokesperson has said that no arrests were made under the phantom law, there is clear evidence showing that this is not true.As we highlight in our feature article today, British activist Charlie Veitch was arrested last Thursday, outside the security perimeter, for failing to provide identification which, he was told, was a crime under The Public Works Act.Veitch appeared on the Alex Jones show after he was eventually released from hours of captivity at the giant movie studio turned temporary prison during the G20 summit.Veitch even received a form documenting his arrest that said he had been detained under the phantom amendment to the law.Surely realizing that the truth would emerge, authorities re-arrested Veitch yesterday on the charge of impersonating a police officer – a weak accusation that stems from deadpan comments Veitch made in his exchange with his original arresting officer when he joked that he was a British police provocateur, in Toronto to instigate trouble so that a harsh crackdown by Canadian security would be justified.As we also highlighted in a previous article, plain clothes security were witnessed literally screeching up in black vans and abducting protesters outside the security perimeter, while kettling those who remained and eventually firing rubber bullets and tear gas at them.Below is another video of this incident which shows the makeshift movie studio prison in the background. The building is five kilometres away from the security perimeter:The long and short of this is that the Chief of police in Toronto knowingly misled his officers about a secret law granting them unfettered powers of arrest, which those officers then put into force aggressively, setting a new record for the largest mass arrest in Canadian history.Further reports of the extreme threats and abuses those arrested, including journalists, were subjected to by police have also exacerbated the situation.Despite multiple opportunities to set the record straight, Chief Blair opted to publicly state that such powers were necessary and allowed officers all over the city to detain and arrest people under laws that never existed.Given that this activity is in violation of the Canadian Charter of Rights and Freedoms and tramples over the right to peacefully protest, there needs to be an immediate investigation into the matter, and Chief Blair should face the consequences that go with such a violation.

The expiration of the five-metre rule that had Toronto residents fearing arrest if they strayed too close to the G20 security perimeter came with a startling revelation Tuesday – it never existed. The rule seemed straightforward when the news broke last Friday that the Ontario government made a regulatory change to a little-known act in secret.Come within five metres of the summit security fence and you’d better have some identification or risk arrest. The temporary regulation, which was passed in secret June 2, did decree that all streets and sidewalks inside the fence were a public work until 11:59 p.m. Monday. Under the Ontario Public Works Protection Act, that allowed police to search people trying to enter that area.But there was no power to search people coming within five metres of the fence, said ministry spokeswoman Laura Blondeau.The area designated by the regulation as a public work does not extend outside the boundary of the fence, Ms. Blondeau said.

Asked Tuesday if there actually was a five-metre rule given the ministry’s clarification, Toronto Police Chief Bill Blair smiled and said, No, but I was trying to keep the criminals out.The confusion, it seems, came from the wording of the regulation. The phrase five metres does appear, but it references land well within the fence that is neither a sidewalk nor street – land near a parking lot and land behind the Rogers Centre. Toronto lawyer Rob Kittredge, an avid photographer who works near the G20 site, said Tuesday he was handcuffed and searched by police last week for taking pictures of the security fence, from the outside.Mr. Kittredge said he knows his rights – or at least thought he did in this case – and always politely refuses to comply with police demands for identification if he feels they have no grounds. They told me that I did in fact have an obligation to answer their questions and provide identification and cited the Public Works Protection Act,said Mr. Kittredge.They explained they had the right to ask me the purpose of my being there, they had the right to ask my name and demand identification and my address.Mr. McGuinty still hasn’t explained why cabinet passed the regulation change in secret, and then kept it secret.They knew that this was going to be a live issue and that people were going to be getting legal advice and that chances are if they didn’t publicize it, the legal advice would be wrong and misleading, said lawyer Jonathan Dawe, who has argued cases before the Supreme Court of Canada on the scope of police powers. New York (CNN) -- The dollar is an unreliable international currency and should be replaced by a more stable system, the United Nations Department of Economic and Social Affairs said in a report released Tuesday.The use of the dollar for international trade came under increasing scrutiny when the U.S. economy fell into recession.The dollar has proved not to be a stable store of value, which is a requisite for a stable reserve currency, the report said.Many countries, in Asia in particular, have been building up massive dollar reserves. As a result, those countries' currencies have become undervalued, decreasing their ability to import goods from abroad.The World Economic and Social Survey 2010 is supporting a proposal long advocated by the International Monetary Fund to create a standardized international system for liquidity transfer.Under this proposed system, countries would no longer have to buy up foreign currencies, as China has long done with the U.S. dollar. Rather, they would accumulate the right to claim foreign currencies, or special drawing rights, or SDRs, rather than the currencies themselves.The special drawing rights would be backed by a basket of currencies, which would make them less susceptible to volatility in any one currency. And because the value of a special drawing right is defined by the IMF, changes in the value of any one currency could be adjusted for.

These initiatives, supported by U.N. Secretary-general Ban Ki-moon, are meant to help sustain the international trade and financial systems that will allow less-developed countries to participate and integrate into the global economy.In addition to the proposed reforms regarding international currency, the survey also offered guidance on increasing social well-being.The survey said that the number of the poor in the world living on less than $1.25 a day decreased from 1.8 billion in 1990 to 1.4 billion in 2005, but nearly all of this reduction was concentrated in China.The number of poor increased in sub-Saharan Africa and South Asia over the same period. Hurricane Alex could make land late Wednesday

MEXICO CITY (Reuters) – Hurricane Alex strengthened in the Gulf of Mexico early on Wednesday and was expected to make landfall later in the day but skirt Mexican oil rigs and U.S. oil fields, alleviating concerns in crude markets.The first named storm of the Atlantic season became a Category 1 hurricane late Tuesday night as it slowly moved west toward northern Mexico where it was expected to drop as much as a foot of rain.While the storm was forecast to miss major oil drilling sites, rough seas and rain were already hampering efforts to control damage left by an ongoing spill from the major leak at a BP Plc facility south of Louisiana.Waves as high as 12 feet were expected to delay for several days the company's plans to hook up a further system to capture much more oil from the blown-out oil well.Controlled burns of crude on the oil's surface, flights spraying dispersant chemicals and booming operations were all halted on Tuesday, officials said.The storm was not expected to interrupt the company's plans to drill a pair of relief wells intended to plug the leak by August, BP has said.Some energy companies evacuated personnel and shut down some production as a precautionary measure.Forecasters expected Alex to make land on Wednesday night, bringing 6 to 12 inches of rain to northeastern Mexico and southern Texas as well as dangerous storm surges along the coast.Alex was packing winds of 80 mph and was located about 235 miles southeast of Brownsville, Texas. It was moving west at 7 mph, the U.S. National Hurricane Center said at 5 a.m. EDT.

A hurricane warning was issued for the coast of Texas south of Baffin Bay down to the mouth of the Rio Grande, and along the coast of Mexico La Cruz. A tropical storm warning extended down to Cabo Rojo, just south of the port city of Tampico.Officials in south Texas readied rescue vehicles, shelters in San Antonio and Laredo and rushed supplies to the Rio Grande Valley. Bob Pinkerton, mayor of South Padre Island, a coastal community where the entire economy rests on tourism, urged residents and visitors to evacuate.Mexico has closed its Gulf coast ports of Dos Bocas and Cayo Arcas -- which handle around 80 percent of the country's oil exports -- since Sunday due to strong surf.The Atlantic hurricane season runs from June 1 to Nov 30 and meteorologists predict an active storm season. HOUSTON (Reuters) – The season's first Atlantic hurricane is disrupting cleanup of BP's massive oil spill in the Gulf of Mexico, delaying plans to boost containment capacity and threatening to push more oily water onshore.The Gulf oil spill disaster has reached day 72, with environmental and economic costs to tourism, wildlife, fishing and other industries still mounting and the future of BP, the London-based energy giant, far from clear.Local residents are braced for heavy rains and flooding from Alex, which strengthened into a hurricane late on Tuesday. The storm was on track to make landfall near the Texas-Mexico border late on Wednesday.Obama administration officials continue to beat a path to the Gulf region, the latest being Vice President Joe Biden.We're not going to end this until everyone is made whole,Biden said in Pensacola, Florida, on Tuesday.

INTERNATIONAL HELP

With strong winds, waves as high as 12 feet and flooding rains on the way, controlled burns of oil on the ocean, flights spraying dispersant chemicals and booming operations are on hold for now, officials said.The State Department said it would accept offers of help from a dozen countries and international agencies to contain and clean up the spill, including two high-speed skimmers and a fire containment boom from Japan.Although Alex will not make a direct hit on oil platforms in the Gulf, the storm is potent enough that several companies have evacuated rigs. About a quarter of oil production and 9.4 percent of natural gas output in the Gulf of Mexico have been shut, U.S. officials said.Work continued for the time being at the BP oil spill site, about 50 miles 80 km off the Louisiana coast -- siphoning crude oil to surface containment vessels, flaring natural gas and drilling two relief wells.U.S. government officials estimate 35,000 to 60,000 barrels are gushing from the blown-out well each day. The current containment system can handle up to 28,000 barrels daily. The planned addition could raise that to 53,000 barrels.

BP's market capitalization has shrunk by about $100 billion since its Deepwater Horizon drilling rig sank in 5,000 feet of water on April 22, two days after an explosion and fire killed 11 workers.The company's shares have lost more than half their value, but have seen sporadic bargain-hunting on the way down. MEXICO CITY (Reuters) – A strong 6.2-magnitude earthquake struck southern Mexico early on Wednesday, shaking buildings as far away as Mexico City but not causing serious damage or casualties.The U.S. Geological Survey said the quake struck near the town of Pinotepa Nacional around 80 miles southwest of the colonial city of Oaxaca, but police patrols checking surrounding towns did not report problems.The USGS reported the quake as strong as magnitude 6.5 but later revised the figure to 6.2, also moving the epicenter slightly.It was pretty strong, said Jorge Cervantes, a security guard at Hotel Las Gaviotas in Pinotepa Nacional.Some guests went downstairs but the building is fine and nobody is hurt.In Oaxaca's cobblestone historic center people felt the tremor strongly and guests at several hotels evacuated briefly.Fortunately, we do not have any reports of injured people or damage to buildings. Not here or on the coast, said civil protection official Alberto Narvaez in Oaxaca.It woke me up, I was scared too,said a colleague, Gilberto Mateo.The Pacific Tsunami Warning Center had no warning or advisory in place and hotels in beach resorts like Puerto Angel also reported no damage.The temblor awoke residents in Mexico City nearly 300 miles to the north, and cut power in some districts. Some people filed onto the street in their pajamas, but there were no reports of casualties in the city, where many have grim memories of a devastating earthquake in 1985.

Spain ends invisible EU presidency

EUOBSERVER / BRUSSELS - Spain's EU presidency will be remembered for its messy foreign policy and the invisibility of Spanish Prime Minister Jose Luis Zapatero.It began with a hacker putting the face of a TV character, Mr Bean, a comic bumbler who bears a passing resemblance to the Spanish leader, on the Spanish presidency website at the moment of its launch in January.US President Barack Obama's decision in February to skip an EU-US summit in Madrid later in the year, to have been the jewel in the crown of Spain's EU chairmanship, made the Spanish premier again look silly.

The cancellation of an EU summit with Arab and Israeli leaders in May took away another chance to shine on the international stage.But Mr Zapatero's lack of visibility was the most striking on the big issue dominating the past six months - the eurozone debt crisis.Spain ceded control of the EU response, the creation of a eurozone bail-out fund and new rules on joint economic governance, to EU Council chief Herman Van Rompuy, France and Germany. Its most direct contribution was making sure that stress-testing of EU banks is made public. One reading is that Mr Zapatero took a back seat in line with the Lisbon Treaty, which installed Mr Van Rompuy and which came into force in December, giving Madrid the difficult task of handling the transition period.He was in the right place, in the shadows, supporting Mr Van Rompuy, a Spanish diplomat said.Another reading is that he hid behind Mr Van Rompuy in order to deflect attention from the near-collapse of Spain's economy. They wanted to avoid the question: what kind of action should be taken? What are you going to do given that you have your own crisis? an EU diplomat said.On a positive note, it shepherded through a number of behind-the-scenes agreements. It unblocked an EU law against the trade in illegal timber. It helped defuse a row with the European Parliament over the Swift counter-terrorism pact and it launched a new committee, COSI, of EU diplomats on internal EU security. It could have been worse, another EU diplomat said.Imagine if it had been Sarkozy, the contact added, on how the hyperactive French leader might have reacted to sharing power with Mr Van Rompuy.

Mr Zapatero's right-hand man, foreign minister Miguel Angel Moratinos, developed a prickly relationship with the EU's new foreign relations chief, Catherine Ashton, however.The Spanish foreign ministry made a number of unilateral moves that made the EU high representative look weak. The Spanish ambassador in Beijing said the EU should lift an arms embargo on China. Then Mr Moratinos said the EU should normalise relations with Cuba. And following the Gaza flotilla attack, he wrote a letter to media with French and Italian ministers instead of Ms Ashton. The Cuba initiative, which failed, prompted accusations that Spain was more interested in making money in its former colony than generating EU pressure on human rights. It was messy,one EU diplomat said on Spain's overall foreign policy performance.They misjudged the EU mood,another diplomatic contact said.A Spanish diplomat defended Mr Moratinos' work, saying he helped Ms Ashton to clinch a deal on the European External Action Service with member states and with the parliament.I don't think there can be any doubt about his loyalty to Ms Ashton,the diplomat said.On Cuba, the contact added: Spain said the European position, which dates back to 1996, should be looked at. Unfortunately the Cubans have moved very little. Unfortunately, they gave us reasons to do the opposite with their treatment of prisoners, particularly [Orlando Zapata Tamayo], who died in prison.

Warsaw looks on

Poland, the next big country to hold the EU chairmanship, has noted the shrinking role of the rotating presidency under Spain and the Lisbon Treaty.Warsaw in May signaled big ambitions for its turn at the EU helm, due in late 2011, by sending an unprecedented 22 ministers and junior ministers to meet with the European Commission in Brussels. It wants to impact talks about the bloc's 2014 to 2020 budget, to launch enhanced co-operation on defence, and to press on with EU integration of post-Soviet countries such as Ukraine.Pjotr Kaczynski, an analyst at the Centre for European Policy Studies, a Brussels-based think-tank, said Warsaw should focus on technical issues such as Ukrainian visa-free travel and leave the big CFSP [EU foreign policy] to Ashton.It will be tempting to give Prime Minister Donald Tusk a bigger role than Mr Zapatero, he added. They need a project to make him [Mr Tusk] look like a good husband of state, but not to undermine Van Rompuy or Ashton. Well, a little, but not too much,Mr Kaczynski said.

The sources said that the current caretaker administration has worked out a detailed agenda for the coming six months which could be put in jeopardy by the advent of a new government.The current government still has full powers, a senior Belgian official told press in an off-the-record briefing on Sunday (27 June). Everything we have decided on for the EU presidency has been agreed by all parties from both French and Flemish-speaking communities.The current set of ministers has built up detailed knowledge of the issues set to dominate the presidency's to-do list as well as constructive personal relationships with their EU counterparts, another contact said. The danger is that the new government forms just at the moment of another crisis in the EU, the second Belgian official explained, citing a potential member state application to the eurozone's recently-agreed emergency funding mechanism as an example.The comments - which could be seen by cynics as designed to help the existing cabinet stay in power for longer - come after Belgian snap elections on 13 June.The election saw the New-Flemish Alliance party of Bart De Wever, who advocates splitting Belgium in two, win the most seats, with coalition-forming talks threatening to drag out for months.Concern has been raised in EU circles over the transitionary government's ability to effectively chair the 27-member union. Earlier delays in producing the agenda for next month's meeting of EU finance ministers have already been cited as one example.

EUOBSERVER / BRUSSELS - For some in Brussels the words Latin America still conjure up an image of basket-case economies, but the message from a recent high-level conference in the EU capital was loud and clear: ignore this region at your peril.

One-by-one, speakers at Tuesday's (29 June) gathering, hosted by the Friends of Europe think-tank, warned that while Europe dawdles, China and the US are pushing ahead in the region of over 500 million people, spread out over 20 states and two continents.We are determined to keep our top spot,declared EU trade commissioner Karel De Gucht, in reference to Europe's foreign direct investment in Latin America.

Others said the EU needs to rethink its current strategy in a region that is forecast to grow by an average of four percent of GDP this year, four times faster than Europe.We see that Latin America in not a top priority on the EU's political agenda,said Carlos Lopez Blanco, director of international affairs at Spanish multinational Telefonica.For us this is a big, big mistake.The former Spanish minister said foreign companies are increasingly looking to emerging markets as sources of growth in the post-financial crisis environment, pointing to the fact that China is set to overtake the EU as Latin America's second largest trading partner after the US.In addition, EU trade and investment is dominated by states with colonial links such as Spain, Portugal, France and the Netherlands.The rest of the countries, especially the new EU member states, do not know our region very well,said Mexico's ambassador to the EU, Sandra Fuentes-Berain.Recent statistics by the Paris-based OECD economic club have helped rebrand the image of a region which accounts for three G20 members, and which, according to the club, in many ways constitutes a less risky investment environment than Europe.Argentina's debt crisis (2001) has given way to Greek panic in the public consciousness (2010), although significant differences remain between the two sides in terms of poverty levels and income inequality.Latin America's businesses such as Brazilian company JBS, the world's largest beef producer, are among a growing number of home-grown firms looking to snap up bargains in Europe, but the EU's imperfect single market complicates opportunities.For us it would be easier to deal with one partner rather than 27,said Ms Fuentes-Berain, referring to a recent report by former EU commissioner Mario Monti on the need to relaunch the single market.

Trade deals

The out-going Spanish presidency has worked hard to correct Europe's perceived lack of attention, with the EU initialing free trade agreements with Peru, Colombia and a collection of Central American states in Madrid this May.Spurred on by the country's top CEOs who stand to make huge savings through a reduction in tariffs, Spain has also been a key supporter of restarting trade negotiations with the South American trade bloc Mercosur.After years of stalled talks, the European Commission is set to sit down at the negotiation table this week for the first time since 2006.Newly empowered MEPs, who under the Lisbon Treaty have to approve international agreements, have indicated their reservations over the Colombian agreement however, with the country home to the highest rate of trade union deaths in the world. We are certainly going to face a deep discussion on the Peru and Colombia deals, to put it mildly,conceded Mr De Gucht.

EU Says Removing Illegal Arab Structures an Obstacle to Peace

The European Union has declared that Israel’s plan to tear down illegal Arab dwellings to make way for an archaeological park and tourist center is an “obstacle to peace.Catherine Ashton, chief of EU foreign affairs, reminded Israel that the EU never has recognized Jewish sovereignty over what is generally referred to as eastern Jerusalem, where it backs the Palestinian Authority demand to base a capital for a new Arab country. The areas actually include neighborhoods in southern, northern and eastern Jerusalem, most of them almost exclusively Jewish areas where 300,000 people live.Ashton asserted that the Jewish homes in these areas are in effect “settlements, and the demolition of [Arab] homes are illegal under international law, constitute an obstacle to peace and threaten to make a two-state solution impossible.The homes in question were built without a legal permit.Her comments coincided with U.S. Middle East envoy George Mitchell’s resumption of indirect discussions, dubbed proximity talks, with his shuttling back and forth between Jerusalem and Ramallah.Ashton called on Israel to refrain from measures which may undermine the ongoing proximity talks, [which] enjoy our full support. U.S. Middle East envoy George Mitchell begins three days of talks with Israel and the Palestinian Authority Wednesday following PA Chairman Mahmoud Abbas’ statement he will accept direct talks in return for an extension of the building freeze. Abbas’ move gives him the upper hand in what has become a diplomatic struggle over which side can blame the other for what is widely viewed as fruitless efforts by the United States.Mitchell began his visit by examining the flow of previously embargoed commodities being transferred by Israel to Gaza via the Kerem Shalom crossing. Earlier in the morning, Gaza terrorists attacked a nearby Jewish community in the western Negev with a powerful Kassam rocket that destroyed a packing house. Residents told Voice of Israel government radio that Mitchell should be concerned with their humanitarian situation in the face of Gaza terror instead of worrying about increased shipments for Gaza while its terrorists continue to attack Israel.

Mitchell is armed by mainstream American media that generally have accepted U.S. President Barack Obama’s view that Israel should freeze all building for Jews in areas of Jerusalem claimed by the PA, as well as all of Judea and Samaria. Last fall, Prime Minister Netanyahu agreed to a 10-month freeze as a concession to both the Obama administration and Abbas.The PA leader now has made a permanent freeze a condition for returning to face-to-face talks with the Prime Minister’s negotiating team.Foreign Minister Avigdor Lieberman threw ice water on Mitchell’s attempts Tuesday, telling his visiting Russian counterpart, Sergey Lavrov, that there is no chance of the PA becoming an independent state before 2012.Prime Minister Netanyahu has strong backing for a thaw in the building freeze that has left growing families and schools without solutions. Gershon Mesika, chairman of the Samaria (Shomron) Regional Council, told the Knesset Education Committee Wednesday morning that the September school year cannot be opened unless immediate approval is given for 27 permits for classrooms.The Likud party has lined up solidly for Prime Minister Netanyahu to fulfill his promise that the 10-month freeze will not be extended, despite support for Mitchell's stand from left-wing Israeli media such as Haaretz, and the highly influential American weekly news magazine Newsweek.The publication carried an article in early June that alleged similarities between the Bush and Netanyahu governments. Newsweek described both leaders as ideological and right-wing, with a population traumatized by terrorist attacks and a government of military officers as advisers who advocate a campaign against Muslim terrorism.

The Newsweek article continued its comparison and added,The world doesn’t see it that way, and despite impressive deployments of troops—and plenty of military victories—the nation becomes more and more diplomatically isolated, tarnishing its reputation as a beacon of freedom.Newsweek’s conclusion resembles the strategy of the Obama administration. The Knesset Education Committee, following wall-to-wall criticism of Defense Minister Ehud Barak for his freeze of additional classrooms in Judea and Samaria, resolved that it’s time for the entire government to intervene.The background for Wednesday’s debate was the urgent need for the approval of 177 new classrooms. Though originally the 10-month freeze on Jewish construction in Judea and Samaria did not include public buildings such as schools, Defense Minister Ehud Barak unilaterally decided that this exception was no longer valid.New classrooms in this context generally does not mean new construction, but rather bringing in caravans, which are mobile-home-like structures without wheels.Prime Minister Binyamin Netanyahu, the Likud and the government have all come under sharp attack from the nationalist camp for allowing Barak, who commands the loyalty of only 8-9 Knesset Members (the other 4-5 Labor Party members have declared themselves an internal party opposition) to have such a strong say in political matters.The various localities in Judea and Samaria and the Education Ministry have submitted 250 requests for new classrooms, 73 of which have been approved. Of the remainder, 27 more have received Defense Ministry approval but are stuck somewhere in bureaucracy-land, while the remaining 150 have not even received the Defense Ministry’s OK.

Shomron Regional Council head Gershon Mesika said: I find myself in a dilemma of which law to violate – either the construction freeze regulation, or the law that requires me to provide classes for all children… We will build classrooms no matter what, and I am willing to be arrested on this matter, to enable every child to have normal, minimal conditions for studying just like other students in Israel. Turkey Refuses Israel Use of Airspace

Turkey has refused to allow Israeli military planes to use its airspace over the past month – another sign of the increasing tensions between the two countries.
Israel made two requests in the past month, but both, normally a routine matter for approval, were turned down. A Turkish diplomat, speaking on condition of anonymity, told the AFP news agency that this does not mean that future requests would be rejected, and that they would be evaluated one by one.The first rebuffed request was for a flight carrying 100 IDF army officers to visit a Nazi death camp in Poland, very soon after the May 31 flotilla incident. No details were provided regarding the second rejected Israeli request.Civilian flights remain unaffected for now, as they are what the diplomat called an international obligation.Turkey’s relationship with Israel, traditionally a positive one, has been in decline over the past two years, and took a sharp plunge following the flotilla incident, organized by the Turkish terrorist-affiliated IHH group. The Turks withdrew their ambassador to Israel and stated that he would not return unless Israel apologizes for the raid, returns the seized ships, agrees to an international investigation into the raid and compensates the families of the victims.

In fact, however, the Israel Navy warned the flotilla that the Gaza region is closed to maritime traffic. In addition, during a search aboard the Mavi Marmara ship, IDF forces uncovered a cache of weapons used to violently attack the soldiers. New Zealand Jewry Threatens PM with Law Suit on Shechita Ban

Six Jewish representatives of New Zealand’s Jewish community met with Prime Minister John Key last week to discuss the country's recent ban of shechita [ritual Jewish slaughter of cattle, lambs and chickens]. They told him that if the ban was not repealed, they would have no choice but to take the matter to court – where many in the Jewish community feel they could win.The move leaves New Zealand’s Jews without kosher chicken, as the country forbids chicken imports. Kosher beef is permitted for import from Australia.Jewish sources say the ban could be attacked on grounds that it violates the legally-accepted principles of freedom of religion and discrimination, as well as New Zealand’s Animal Welfare Act, which states that animals’ rights do not override religious rights.The ban on shechita was announced a month ago, when Agriculture Minister David Carter annulled all exemptions to the country’s new commercial slaughter code, which requires stunning prior to slaughter. Carter cited concerns for animals’ suffering – and even said that though we may have upset a relatively small religious minority… frankly I don’t think any animals should suffer in the slaughter process. He later apologized.New Zealand Jewish Council chairman Geoff Levy said in a statement that legal action may be the only course open to us.New Zealand’s Jewish community numbers less than a fifth of a percent of the total population - 7,000 out of 4.1 million. JewishJournal.com reports that several thousand chickens were shechita-slaughtered in New Zealand each year. The ban also affects a small number of cattle and lambs, less than 100 each year.

The website also quoted Rabbi Moshe Gutnick of Australia, who supervises kosher certification of products in New Zealand, calling the ban outrageous. He said, Hunting is still permitted for deer and ducks, and that is certainly not humane. The government, using flawed science, institutes a new code and the only people affected by this are the Jews. People are wondering what their real motivation is.The chairman of Shechitah UK, Henry Grunwald, wrote in the Jewish Chronicle that the ban succumbs to the popular myth that shechitah is painful, ignoring ample evidence to the contrary.Just this month, the European Parliament voted to back the proposal to require special labeling on meat produced by Jewish ritual slaughter. According to the new resolution, which must still be approved by the European Union Commission, the meat would be marked as meat from slaughter without stunning – rendering it less attractive on the general market and driving up prices.(IsraelNationalNews.com)

Destruction of First Temple Commemorated with Day of Fasting

The Three Weeks of gradually-increasing mourning over the destruction of the Holy Temples and Israel's exile begins today (Tuesday) with the fast of the 17th of the Hebrew month of Tammuz. This is the day on which Nebuchadnezzar and his Babylonian forces breached the walls of Jerusalem in 422 BCE, after 18 months of siege, on their way to destroying the First Temple.The Three Weeks end on the 9th of Av - Tisha B'Av - the date on which both the First and Second Temples were destroyed, roughly 2,500 and 2,000 years ago respectively.The 17th of Tammuz marks other calamities in Jewish history as well. It is the date on which Moses, having descended from Mount Sinai for the first time, saw the people sinning with the Golden Calf and broke the first set of Ten Commandments. In addition, the priests of the First Temple era were forced on this day, a year before the Temple's destruction, to stop offering the daily sacrifice due to the shortage of sheep.The Talmud also teaches that on this date some decades earlier, the evil King Menasheh had an idol placed in the Temple's Holy Sanctuary. Later, during Second Temple times, a Roman general placed an idol in the same place and publicly burned the Torah.

TAU Works on Computer Chip Implant to Treat the Brain

A team of scientists at Tel Aviv University is working on a project that involves implanting a computer chip into the brain in order to treat conditions such as depression and Parkinson's disease.Professor Matti Mintz, a member of the Psychobiology Research Unit at the Department of Psychology, is part of a European consortium that is working on issues relating to neurophysiology, human behavior and mental health. TAU colleague Professor Yossi Shaham-Diamond is also involved, working on the issue of adding sensors while miniaturizing the size of the deep brain electrodes used to deliver the stimulation. Two other TAU scientists, Professor Hagit Messer-Yaron and Dr. Mira Kalish, are also involved in the project as well as partners from Spain, Austria and England.The Rehabilitation Nano Chip (ReNaChip), as it is called, is designed to help doctors connect computer software to the brain. If it is successful, the chip will deliver deep brain stimulation precisely to the areas where it is needed. It is hooked up to tiny electrodes implanted directly into the brain – only the electrodes are implanted. The chip itself can be placed just under the skin, like pacemakers for the heart, explained Mintz,ensuring the brain is stimulated only when it needs to be.However, scientists are working towards a chip that can be made small enough to be etched on to the electrodes themselves, rather than have to be hooked up.It is hoped that such technology may someday be used to treat neurologically-based conditions such as depression, Parkinson's disease and possibly diseases involving damage to specific areas of the brain. WASHINGTON – Ten people have been arrested for allegedly serving as secret agents of the Russian government with the goal of penetrating U.S. government policymaking circles .The Justice Department announced the arrests Monday.According to court papers in the case, the U.S. government intercepted a message from Russian intelligence headquarters in Moscow to two of the defendants. The message states that their main mission is to search and develop ties in policymaking circles in US and send intelligence reports.The court papers cited numerous examples of communications intercepted by U.S. investigators that spelled out what the 10 allegedly were trying to do.One message back to Moscow from the defendants focused on turnover at the top level of the CIA and the 2008 U.S. presidential election.

The information was described as having been received in private conversation with, among others, a former legislative counsel for Congress. The court papers deleted the name of the counsel.Another intercepted message said one of the defendants living in New Jersey, known as Cynthia Murphy, had several work-related personal meetings with a man the court papers describe as a prominent New York-based financier who was active in politics.In response, intelligence headquarters in Moscow described the man as a very interesting target and urged the defendants to try to build up little by little relations. ... Maybe he can provide Murphy with remarks re US foreign policy, roumors about White house internal kitchen,invite her to venues (to major political party HQ in NYC, for instance. ... In short, consider carefully all options in regard to the financier.The court papers described the defendants communicating with purported Russian agents using a method not previously described in espionage cases here: by establishing a short-range wireless network between laptop computers of the agents and sending encrypted messages between the computers while they were near each other.The papers also said that on Saturday an undercover FBI agent in New York and another in Washington, both posing as Russian agents, met with two of the defendants, Anna Chapman at a New York restaurant and Mikhail Semenko on a Washington street corner blocks from the White House.

Admiral Mike Mullen, Chairman of U.S. Joint Chief of Staffs, returned home from Israel and said that although he has no reason to trust Iran, Israel knows that attacking the Islamic Republic's nuclear sites would be incredibly destabilizing.He acknowledged that it would be incredibly dangerous if Iran builds nuclear weapons, which Central Intelligence Agency (CIA) director Leon Panetta said Sunday are not within Iran’s capability for at least one year.Speaking at a security conference, Admiral Mullen did not venture to predict what will happen up to the point when Iran can achieve the capability of manufacturing a nuclear weapon and a long-range missile that can explode it over Israel. He shot down the idea that Israel would stage a military strike to delay or destroy Iran’s nuclear development, saying that Israel is in synch with the American thinking. He acknowledged that the biggest problem for the United States is how much it does not know about Iran’s nuclear program. The U.S. National Intelligence and Defense Intelligence Agency directors told a U.S. Senate committee last year that there were no indications that Iran is refining uranium. The conclusion angered Israel, which has warned several times that Iranian President Mahmoud Ahmadinejad means what he says when he talks about the need to wipe Israel off the map.

Few analysts have said that the recently passed United Nations Security Council sanctions against Israel will convince Iran to stop producing enriched uranium without United Nations nuclear inspections. High-grade enriched uranium is a key element for producing a nuclear bomb. Mullen’s visit to Israel Sunday was the 15th time he has met with IDF Chief of Staff Gabi Ashkenazi since taking office in 2007. It could have been worse. Major damage arising from the protests against the G8 and G20 only occurred during Saturday’s protests and marches. While there were many more arrests made on Sunday, no major damage to the city occurred on that day. On Saturday, four police cruisers were torched. Windows of banks and of course Starbucks were smashed along with that of other businesses including mom and pop stores. Bottles and other objects were thrown at police by the mainly white middle class punks who are known as anarchists.One fact that is not in dispute is that there was a large police contingent; made up of police officers from all over Canada, on both days of the protests. So there must be a reason why major damage was done on Saturday but not on Sunday.Real responsibility lies with the Ontario Federation of Labour and other groups So who was responsible for all the violence? Well, the anarchists themselves, many of whom came from far away with the sole purpose of damaging private and public property. These pampered children rail against, among other things big oil that surely must be happy at all the gas they used to get here. Prime Minister Stephen Harper and the police will certainly be blamed for the massive police presence that the left will argue provoked the peaceful protesters into taking action. But the real responsibility lies with the Ontario Federation of Labour and other groups who organized their family-friendly demonstration in which approximately 10,000 people took part in.

Every time Toronto Mayor David Miller and his politically correct police chief opened their mouths, their comments were always prefaced with the phrase that people have the right to demonstrate. The organizers of Saturday’s protests clearly illustrate what’s wrong with society today; it’s all about rights and nothing about responsibilities.From what had transpired during past G8 and G20 summits, these organizers knew or ought to have known that anarchists and other groups that were bent on destruction would use the peaceful march as a cover to remain hidden until they felt the time was right to wreak havoc and cause wanton destruction. These labour unions hold demonstrations, marches and protests all the time and they had a right to protest but they didn’t have to protest on that particular day. The truth is that even though they intended to march and demonstrate peacefully, the only rational conclusion that can be drawn is that they really didn’t mind facilitating the anarchists’ objectives of doing significant property damage in downtown Toronto. The organizers and their supporters that included families with little children acted as useful idiots for all those who were intent on causing as much damage as possible.The organizers of the peaceful demonstration justified their holding the march by saying that they had a message that they wanted to deliver to the G20 leaders. What a croc! Whatever their message was, the leaders were safely tucked away, unable to hear it. The leaders will only know what they picked up from the media.The media. Sticking to the principle of if it bleeds, it leads,most of the media focused on the damage, especially the torched police cars. If the focus was not the damage or the many standoffs between the police and protesters, it was to tell the stories of the poor little dears who were arrested. We learned from some of the media that they were all innocent. INN O CENT! And in case anyone who is reading this spent the entire weekend watching CP24, there actually was a summit held in Toronto where world leaders discussed issues like the economy. They were on the other side of the fence.

The organizers of the demonstration knew or ought to have known that their message had virtually no chance of getting out this past weekend, with the anarchists in town.On Sunday, when there was no large peaceful demonstration for the little punks to hide in there was virtually no damage done. Those who organized and took part in the organized march on Saturday facilitated the damage that was done to the city; without them it would not have occurred. But they will never acknowledge that fact.

Yes, they had a right to demonstrate; but they took no responsibility aiding and sheltering those who caused the damage. It’s too much to expect the peaceful people to take any responsibility.They could have held a massive rally and marched on any other weekend and had a better chance of getting their message out. But that’s just too much to ask.

According to the Wall Street Journal, the President’s level of support is at new lows. 62% of Americans believe the country is going in the wrong direction. Since there are so many destructive and un-American policies and orders flying around by the Obama regime, let’s just focus on one nightmare, the BP oil spill.How has Obama’s leadership gone so far with the Gulf oil spill disaster? First of all, Obama didn’t even go down to Louisiana to assess the severity of this disaster and danger for 12 days. He knew early on how serious the explosion was and how potentially devastating to the gulf economy, yet he couldn’t show up. Maybe his golf game or White House rock concert took longer than he thought. I know, being President means you are very busy.Early on this President denied any financial and equipment help offers from at least 13 countries. I stand in amazement at the arrogance and stupidity in judgment of this President who desperately needed the help offered but said a big fat no to the world.Also, Governor Bobby Jindel has been beside himself, begging for the Government to dig the berms for nearly 2 months to deflect the fast approaching oil from his pristine Louisiana coastlines. Instead of swift action in response to the Governors real emergency, the Obama official instead started an Environmental Impact Study and went on the Internet for public response. Meanwhile the oil creeps closer in by the hour. Where is my headache medication?

We have seen the politically correct nonsense of the coast guard off the gulf course as well. They stopped 16 large barges who had been collecting oil in response to the emergency because they couldn’t verify enough life jackets and fire extinguishers on board. Everything was shut down. Does that even remotely pass the laugh test? Here the barges were fighting time, trying to gather up the oil so it didn’t completely ruin the local economy, animals and plants and the Coast Guard thought now was the time to inspect the barges responding to the emergency??? Could this not have been done after the critical phase of the gulf emergency? Why wasn’t it done later? I put this hideous judgment and lack of priorities in this crises right in Obama’s lap….again. Why didn’t he intercede and keep the barges going? Could it be he is benefiting from the disaster? Did the Obama Government learn anything from the first two months from this disaster? Are they finally dredging and putting in the much needed and requested berms? NO, NO and NO. Instead we see more environmental lectures from hell from this administration. The Federal Government has stopped the dredging of berms off the coast of New Orleans. The U.S. Fish and Wildlife Department apparently has much concern as to where the sand is being dredged from. The State was told to install a pipe and they haven’t had a chance yet. The Feds don’t want sand being dredged from the more sensitive area of the Chandeleur Islands. Once again we see the absurd response in time of crises by this Obama regime. When tons of oil is rushing towards your shores threatening to destroy decades of business and tourism is it the time to analyze the endless needs of types of sand being used to build a berm? We have heard Obama saying he will kick some people’s asses, he feels the victims pain, and he wants everyone to sue BP and line up for the fund.It seems the only ass to kick is his own in this disaster.

A declaration on cutting national budgetary deficits in half by 2013 was heralded as a victory by EU politicians, but European hopes for a global bank levy fell by the wayside.The summit's result reflects widespread convergence around Europe's approach,European Commission President Jose Manuel Barroso and European Council President Herman Van Rompuy said in a joint declaration after the event. Major G20 states had already agreed to similar deficit-slashing targets prior to the Canadian meeting however, with language on the continued need for short-term stimulus measures reflecting US concerns.Recent weeks have seen Washington engage in a war of words with a number of European capitals over concerns that European countries' austerity drives could put the brakes on the world's tentative economic recovery.

US President Barack Obama welcomed the G20 compromise agreement, but warned his country would no longer remain the global consumer of last resort. No nation should assume its path to prosperity is paved with exports to America,he said. Leaders also agreed to stabilise their debt levels by 2016, a statement designed to reassure jumpy financial markets that governments are serious about learning to live within their means. Weak language in the final communique highlighted the divergency of views on a global bank levy, with countries that avoided the worst of the financial crisis such as Canada, Australia and Brazil, opposing the idea. Instead, leaders agreed that there is a range of possible policy approaches for making banks pay a fair and substantial contribution toward future bank bail-outs. Some countries are pursuing a financial levy. Other countries are pursuing different approaches, said the summit's final statement.Should countries such as Germany, France and the UK decide to push ahead anyway, the weekend's decision means European levies are likely to be smaller as a result, in order to prevent banks simply moving to more lenient jurisdictions.

Under the plans, set to be finalised at the next G20 meeting this November, banks will be compelled to hold more top-grade capital. The amount of capital will be significantly higher and the quality of capital will be significantly improved when the reforms are fully implemented, said the final communique.In a move to allay European concerns that the new requirements could stifle lending if implemented too quickly, the previously mooted 2012 deadline for the shift was scrapped. The phase-in will now reflect different starting points and circumstances of G20 member states.
Meanwhile police said over 600 people had been arrested over the course of the weekend, as peaceful protests turned violent on Saturday. Windows were broken and police cars set on fire.

The centre-left British politician, a former activist in the anti-nuclear CND group, is said to distrust military types and her first priority is the kitchen-sink construction of the European External Action Service (EEAS).But she has already told EU leaders that she wants a single crisis response centre under her direct command and internal discussion on the Ashton situation room is at an advanced stage. One scenario under consideration is a crisis directorate run by a director general and situated close to Ms Ashton's office in the EEAS headquarters, most likely in the so-called Triangle building facing the EU Council in the heart of the EU quarter in Brussels. It would have a staff of some 160 people and a modest budget of €10 to €20 million a year.The situation room itself would have a conference table and banks of monitors showing breaking news and commercial satellite pictures of hotspots. In the back-rooms, the crisis directorate would have a team of IT experts, scientists and tacticians scouring open source data in search of conflict threats, such as plans by UK private security firm Saracen International to build a pirate-fighting base in Somalia.Ms Ashton's exclusive information would come from officials manning 24/7 hotlines to the EU's 136 foreign delegations and 14 civilian and military missions. Another unit would send people to crisis zones at short notice on fact-finding trips. A cell of secret-service agents seconded from key EU states would pass Ms Ashton's queries to spy agencies such as the UK's MI6 or France's DGSE and file replies.

The European Commission's existing Crisis Room and the EU Council's Joint Situation Centre (SitCen) are to form the backbone of the crisis directorate. SitCen already sends people into the field. When war broke out in Georgia in 2008 it dispatched two analysts to re-inforce the EUSR [the EU special envoy to the South Caucasus] with reporting,a contact familiar with SitCen operations told this website.In an insight into the opaque bureau's work, the source added: These are fairly normal people who have perhaps in their lives had some experience of being out in the field in a place less comfortable than Washington. They are not spooks by any means. We avoid anybody who even looks like one. They are people who can write reports. Who do not mind not staying in five star hotels. Who know how to take precautions when they go out at night.The new set-up is to see Ms Ashton simply pick up the phone or walk down the hall and task people to go overseas or to query EU countries' secret services. Current bureaucracy means that 27 EU ambassadors in the Political and Security Committee first hold a debate before tasking SitCen.The idea is to give the EU foreign relations chief a powerful asset when she asks EU foreign ministers to deploy an EU battlegroup or if she decides to send an EEAS diplomat, or even a prominent MEP, on a peace mission.Today, if you go through the normal channels to make a threat assessment in Kosovo, for example, by the time the [SitCen] officer gets to Pristina, it's all over,one PSC ambassador told this website.Imagine how effective the high representative could be if the new SitCen was to function like her shadow cabinet,a contact in the EU institutions said. Member states are afraid to give away power. But this could be the new mega-commodity in Brussels.

Wider or deeper?

One question is whether the crisis response centre will handle man-made conflicts only, or natural disasters and pandemics also. The wider portfolio could provoke turf wars between Ms Ashton and aid and development commissioners Kristalina Georgieva and Andris Piebalgs. It could also dilute EEAS resources, perpetuating the existing problems of overlooked and forgotten conflicts.But the big question is: who will be Ms Ashton's right-hand man? Former UK soldier and diplomat William Shapcott, who built and ran SitCen, walked away in June to a new position in the EU Council administration, creating the risk that his successor might take a minimalist approach to the job.One candidate for the post is French diplomat Patrice Bergamini, who worked close to Ms Ashton's predecessor, Javier Solana, and helped draft the EU's first security strategy in 2003. His appointment would give France a monopoly on the EEAS security side, however. French diplomat Christine Roger is to be the new PSC president. French official Claude-France Arnould is the new head of the EU Council's civilian-military crisis planning office. A French secret service agent manages SitCen's intelligence-sharing cell. And French diplomat Pierre Vimont is tipped to become EEAS secretary general, in charge of the body's internal security structures.It would be good to have a German appointment to make sure that Germany is engaged at the highest levels. Somebody with a diplomatic and a security or intelligence background,the source in the EU institutions said.Nationality can be overplayed. Intel is sensitive, so in that sense you do not want to play up the [director's] national connections,the contact familiar with SitCen's work said.

The sources said that the current caretaker administration has worked out a detailed agenda for the coming six months which could be put in jeopardy by the advent of a new government.The current government still has full powers, a senior Belgian official told press in an off-the-record briefing on Sunday (27 June).Everything we have decided on for the EU presidency has been agreed by all parties from both French and Flemish-speaking communities.The current set of ministers has built up detailed knowledge of the issues set to dominate the presidency's to-do list as well as constructive personal relationships with their EU counterparts, another contact said. The danger is that the new government forms just at the moment of another crisis in the EU, the second Belgian official explained, citing a potential member state application to the eurozone's recently-agreed emergency funding mechanism as an example.The comments - which could be seen by cynics as designed to help the existing cabinet stay in power for longer - come after Belgian snap elections on 13 June.The election saw the New-Flemish Alliance party of Bart De Wever, who advocates splitting Belgium in two, win the most seats, with coalition-forming talks threatening to drag out for months.Concern has been raised in EU circles over the transitionary government's ability to effectively chair the 27-member union. Earlier delays in producing the agenda for next month's meeting of EU finance ministers have already been cited as one example.

EUOBSERVER / NEW YORK – EU data privacy rules are shaping a change of attitude in American companies when dealing with information collected from their customers, but the US is still far from considering data protection as a basic human right.Whoever bought a book online or opened an email account with Google has already experienced it: tailor-made advertising landing in their inbox, based on a personal profile created by the company.The term behavioural advertising is a commonplace in marketing strategies, particularly in US-based companies such as Yahoo, Amazon or Facebook. It is seen as a reliable revenue-making tool on the Internet. But privacy issues arise especially when personal information is aggregated and passed on to other companies or when the government taps into the data warehouses held by private companies in order to track down criminals or terrorism suspects. A fundamental difference between the EU and the US' approach to data privacy is the question of ownership, law and privacy experts told a group of European journalists in New York last week.In Europe, data protection is granted even after the consumer has passed on the data, while in the US, the company's understanding is that once it has the information, it can do whatever it wants with it.When we explain to a US company for the first time how data privacy laws work in Europe, they say you must be kidding? It takes a few years to acclimate to that, said privacy lawyer Lisa J Sotto from Hunton & Williams, a New York based law firm. Ms Sotto argued that the cultural difference between the two continents stems from history.Here, privacy is not a fundamental human right, instead it's a consumer protection interest. In Europe, where people could have been put to death because of their data, here they were marketed to to death,she said.

A self-certifing scheme dubbed Safe Harbour, encompassing some 2,200 US companies, helps businesses comply with EU data protection law when doing business with European customers. Under the agreement, the Federal Trade Commission can put companies under increased scrutiny for up to 20 years and even give fines if they violate the terms they subscribed to. There is a move in having companies Safe Harbour-certified in a way that is fundamentally different from five years ago. Companies are much more tuned to the fact that they need to comply with the set of [data privacy] principles in a very significant way. It's not a rubber stamp at all, Ms Sotto said.Big companies have started to put in place chief privacy officers both in the US and in their European branches and in the upcoming years there will be even more of a push for very formal data protection structures within these businesses.But critics point to the low enforcement levels of the data protection rules and the fact that in its 10 years of existence, Safe Harbour has seen only seven cases brought to court in the US - all were companies wrongly stating they were part of the scheme, not actual non-compliance cases. None were notified to EU data protection authorities.No US company is in compliance with the EU data protection directive. If this directive was applied thoroughly, US companies couldn't do business in the EU, Adam Levitin from Georgetown Law School said. He explained that the system of self-certification meant that American businesses were only paying lip service to requirements such as access to and correction of data, security and integrity of the information and no automatic use for other purposes than the one stated in the notice to consumers.While big online names such as Yahoo, Google or Facebook are part of the Safe Harbour scheme, most US air carriers are not.

Nobody from the air sector is in Safe Harbour: Delta, American Airlines, none of them are. When you give them the information in Europe, I am sure beyond any doubt that the information goes to Atlanta (US), Edward Janger from Brooklyn Law School said.He pointed to the fact that these companies are subject to EU law if their branches operate on European soil, but that there is little scrutiny of their responsibilities. I don't know of any EU audit on whether these companies have adequate data protection,he said.

Swift agreement

One company which is part of the Safe Harbour agreement is Swift, the Belgian-based financial communications company handling some 80 percent of the world's international bank transactions.Ms Sotto's legal firm has helped Swift comply with EU data protection laws, despite its image being seriously dented by the scandal which broke out in 2006, when it emerged that the US government was secretly tapping into the company's data as part of an anti-terrorism program.We helped Swift solely with the Safe Harbour certification, not the law enforcement side. From my perspective, it was a whole bunch of nonsense. The data was being transferred in a secure way. They just put a legal framework around it, which is fine, but it cost a lot of money in legal fees, she said, in reference to the years of legal wrangling with the EU.The Swift saga seems to be nearing its end, however, as the EU and the US on Monday (28 June) formally put their signatures on a legal agreement likely to be approved by the European Parliament next week after gaining some extra layers of auditing and control over the program. Back in February, the legislature rejected an interim deal, citing privacy concerns and an inter-institutional quarrel. The veto interrupted the data flow from Swift's European server to the US authorities, triggering concerns in Washington at the security gap created thereby.If the deal wins the approval of Parliament next week, Swift will resume sending data on 1 August, including for the months lapsed since February.

Eastern European states led by Poland have recently complained that concentrating sanctions on a suspension of EU cohesion funds, intended to boost development in the EU's poorer regions, unfairly targets less well-off countries. By including farm payments, roughly 40 percent of the EU's €120 billion annual budget, together with varying types of structural funds, the commission proposals would greatly increase the size and scope of potential fines for member states that break the Stability and Growth Pact.The pact limits deficits to 3 percent of GDP and debt to 60 percent of GDP, but both barriers have been breached by numerous member states, even before the financial crisis took hold.Wednesday's text, which is still subject to changes, seeks to narrow the scope of a commission communication on European economic governance published in May, taking into account a series of member state positions that have been revealed since then.

Controversial non-financial sanctions backed by Germany, such as the suspension of voting rights for national ministers attending meetings in Brussels, are unlikely to appear in the document.Greater emphasis is set to be placed on government debt levels, with an excessive debt procedure involving suggestions from Brussels on how member states should reduce their debt piles, likely to mimic the reporting system under the current excessive deficit procedure.With the crisis leading to calls for structural economic forms, the communication is also set to list a number of macroeconomic indicators, such as the evolution of salaries, that could be used to help monitor national competitiveness levels.States that fall behind in this area could also potentially receive a financial penalty. The commission intends to bring forward the necessary legislative proposals this September in order to turn the suggested list of tougher budgetary measures into law.With EU officials hoping to start a new European Semester system in the spring of 2011, under which member states would peer review the main headings of each others' national budgets, the clock is ticking to complete the necessary legislative steps under the up-coming Belgian EU presidency. A feeling that a unique window of opportunity exists at the moment is also adding to the sense of urgency, with a return to stronger economic growth likely to diminish the reformist zeal created by eurozone's fiscal crisis.

BEIJING – Hope of finding survivors was diminishing Tuesday as rescuers used heavy machinery including bulldozers to search for at least 107 people trapped under a landslide in rain-hit southwestern China.Villagers huddled in tents set up at the site as rescuers searched for their family members.But there appeared to be little hope for survival, with no word on casualties or survivors by noon Tuesday, said Tian Maosheng, an official from Guizhou Communist Party Propaganda Department, who is helping with the rescue.The number 107 remains unchanged, and there is still no sign of life here, he said.Homes were buried when the landslide struck the village of Dazhai in Guizhou province on Monday afternoon after days of torrential rains. An official interviewed by state broadcaster CCTV said nearly half a hill had collapsed.

VILLAHERMOSA, Mexico – A strengthening Tropical Storm Alex was expected to become a hurricane Tuesday as it swirled toward the Gulf coast of northern Mexico and southern Texas, where authorities were readying emergency shelters and distributing sandbags.Forecasters said the storm's likely path would take it away from the site of the huge Gulf of Mexico oil spill off Louisiana's coast, but added that it might push oil farther inland and disrupt cleanup efforts.Alex had maximum sustained winds near 70 mph (110 kph) early Tuesday, and the U.S. National Hurricane Center in Miami predicted the storm would grow into a hurricane sometime Tuesday as it headed toward the U.S.-Mexico border at the mouth of the Rio Grande. Landfall seemed likely Wednesday night.Forecaster Todd Kimberlain said conditions Monday led the center to conclude the storm would be a less powerful hurricane than initially thought.

BUCHAREST, Romania – Authorities say ten people have died and three are missing after heavy rains and flooding in northeastern Romania.Emergency situations spokeswoman Dorina Lupu from Botosani county says torrential rains on Monday night led to floods that killed six people, most from the town of Dorohoi. She says a 15-year-old boy is missing, and hundreds of people have been temporarily evacuated.In the neighboring county of Suceava, authorities said Tuesday that four people died overnight in the flooding and two are missing.Bridges and roads have been damaged, crops have been washed away and hundreds of houses are affected. Romania's rail link to neighboring Ukraine has been shut down and dozens of villages have no electricity.
