Spain to test beefed-up EU budget rules

BRUSSELS - Spain, the eurozone's fourth largest economy, is becoming the first major test of the EU's fresh new rules on budget discipline as it seeks flexibility from Brussels on its deficit targets.Madrid on Monday (27 February) announced that last year's budget deficit was 8.51 percent of GDP, up from an initial estimate of 8.2 percent and well above the 6 percent target agreed with the European Commission last year.Spain, which is supposed to bring its deficit down to 4.4 percent this year and a rules-abiding 3 percent in 2013, has said it will try and negotiate a softer deal.

But the commission is indicating it will play hardball, with tougher fiscal discipline laws only in place since December after previous rules underpinning the euro were breached some 60 times.We need full information on the slippages of 2011 and the reasons for them. We also need full information on the draft budget and planned concrete measures for fiscal consolidation for 2012, EU economic affairs commissioner Olli Rehn said on Tuesday when asked by a Spanish deputy about the possibility of renegotiating the target.He added that EU finance ministers last week reaffirmed their commitment to stick to the rules of the stability and growth pact while ensuring long-term sustainability of public finances.On the same issue, a European Commission spokesperson said: We are not talking about giving any flexibility to the current rule ... We are not talking about giving more flexibility to any member state when it comes to fulfilling commitments.The commission indicated that the eurozone's credibility in the eyes of the markets is at stake.We might think about the need to maintain the credibility of our response to the crisis, said the spokesperson, with any change to Spain's deficit targets having to be agreed by both the commission and the 16 other members of the single currency.Aside from being the first serious test of the commission's enhanced budgetary surveillance powers - fellow euro country Belgium fell into line earlier this year when it was told to curb its spending - the Spanish situation highlights a wider debate about whether too harsh austerity measures risk worsening an already troubled economy.Even within the commission, some voice concerns that the deficit-focused austerity measures are not helping bring down the record unemployment figures, particularly among young people.

Social policy commissioner Laszlo Andor, speaking alongside Olli Rehn in the European Parliament on Tuesday said Spain has the worst statistics and is the greatest challenge for my portfolio.He insisted that there was not just one reason and solution to the unemployment figures and that while labour market reforms have to be part of the agenda,other measures such as improved learning opportunities and investments in the social economy also need to be put in place.Spanish officials also warn that one-sided policies will not help.The fiscal consolidation effort, that is going to be large, has to simultaneously avoid additional and further damage to growth ... his discussion is going to happen not only for Spain, but for the rest of eurozone countries,economy minister Luis de Guindos told the The Wall Street Journal.The commission, for its part says that new solutions are needed to relaunch growth pointing to opening up the internal market still further.Growth will not come through massive budget [spending], said the spokesperson, nor from using solutions of the past where growth was based on public debt.

Ireland to hold referendum on fiscal compact

BRUSSELS - In a surprise move, the Irish government on Tuesday (28 February) decided to hold a referendum on the new intergovernmental treaty on fiscal discipline demanded by Germany for future eurozone bail-outs.The Irish people will be asked for their authorisation in a referendum to ratify the European stability treaty, Prime Minister Enda Kenny told parliament in an unplanned intervention.His announcement came after a legal opinion by the country's attorney general which was largely expected to say no referendum would be needed for the ratification of the brief legal text. The new treaty enshrines a balanced budget rule in national legislation and gives the European Court of Justice the right to impose sanctions if the rule is not transposed properly.The so-called fiscal compact, initially planned to be an amendment to the existing EU treaty, was vetoed by the UK in December, which forced other member states to draft it as a separate intergovernmental act. The Czech Republic also opted out in the end, with a formal signing ceremony at 25 - including Ireland - expected on Friday in Brussels.I am very confident that when the importance and merit are communicated to the Irish people that they will endorse it emphatically by voting yes to continuing economic stability and recovery,Kenny said.

EU-related votes have a sorry history in Ireland, where the Lisbon Treaty had to be put twice to a referendum, as voters in first said no to the EU legal text and only reluctantly agreed to it in 2010, amid worsening economic conditions and increased pressure from other member states and the EU commission to approve it.Even as Ireland is currently being portrayed as a 'role model' for the way it has stuck to the austerity programme linked to the €90 billion bail-out it received at the end of 2010, popular anger is high as people see that the money was mostly used to bail out banks, not to create more employment and growth.A Yes vote seems unlikely, especially since other euro-countries do not rely on Ireland to allow for the treaty to come into force.A minimum of 12 out of eurozone's 17 member states have to ratify the text for it to come into force.But if Ireland does not ratify the treaty, it will no longer be eligible for future bail-outs from the European Stability Mechanism - a permanent, €500 billion-strong fund to be set up in July.

Belarus kicks out EU, Polish ambassadors

BRUSSELS - Belarus has effectively kicked out the EU and Polish ambassadors to Minsk, with the Union considering diplomatic counter-measures.The Belarusian foreign ministry made the announcement on its website on Tuesday (28 February) - one day after the Union imposed sanctions on 21 jurists and policemen said to have mistreated opposition activists and amid talk of blacklisting President Alexander Lukashenko's ice hockey buddy and regime bankroller, oligarch Yuriy Chizh, in March.

Its press release said: In response, the Belarusian side will close the entry to Belarus to those of the European Union which contributed to the introduction of restrictive measures.It also said that Minsk has pulled back its envoys from Brussels and Warsaw (a leading proponent of sanctions) and suggested that the EU and Polish ambassadors in Minsk should hold consultations with their ministries back home.A Minsk-based ambassador from one EU country told this website: This is what they promised to do earlier.He added: They didn't call it expulsion.It's one step lower. But I guess the EU ambassador will be recalled to Brussels otherwise they will expel her. The same thing happened in 2008 with the US ambassador.The speaker of the Polish parliament Grzegorz Schetyna told press in Warsaw he expects solidarity from other EU countries on the matter. The Polish foreign ministry said it is an unfriendly act against the whole Union.For her part, EU foreign relations chief Catherine Ashton in Brussels called a snap meeting of her EU crisis group, the Political and Security Committee, to discuss potential reactions.An EU diplomat told EUobserver she earlier told foreign and EU affairs ministers gathered in Brussels for a separate council meeting that she is keen for all EU countries to recall their envoys from Minsk.At least one large member state swiftly said it would not recall its envoy, however.Meanwhile, EU neighbourhood commissioner Stefan Fuele told press in the EU capital that the whole affair is a distraction from the real issue - how to get Belarus to free political prisoners.

US Chairman of the Joint Chiefs of Staff Gen. Martin Dempsey on Tuesday told a Senate panel he did not counsel Israel against attacking Iran over its nuclear program.We’ve had a conversation with them about time, the issue of time, Dempsey said, referring to his visit to Israel a month ago.Grilled during a Senate Budget Committee meeting, Dempsey also defended his comment that Iran was a rational actor from Senator Lindsey Graham.We can’t afford to underestimate our potential adversaries by writing them off as irrational, Dempsey said.Asked pointedly by Graham if a military strike by the US was off the table, Dempsey responded, Absolutely not.He stressed the danger of nuclear weapons reaching terrorist groups and the beginning of a nuclear arms race in the Middle East involving countries threatened by Iran.Observers say Graham's decision to corner Dempsey in committee and on the record on Israel and Iran wasn’t surprising.Earlier this month, Dempsey said in a CNN interview that an Israeli strike on Iranian nuclear facilities would be imprudent, destabilizing and would not achieve Israel's long-term objectives.

Those comments led Israeli Prime Minister Binyamin Netanyahu to charge Dempsey as being unwilling to aid Israel in ensuring Iran does not obtain nuclear weapons.
Netanyahu said Dempsey's comments served Iran.Within hours Graham and fellow Senator John McCain, who had just met with Netanyahu, took Dempsey to task.Graham told reporters that, while he respected Dempsey, obviously it’s not helpful if there is a well-publicized tension between the US and Israel. We would like to see the United States and Israel agree on a course of action that will lead us toward a goal we both share.People are giving Israel a lot of advice here lately from America, Graham said. I just want to tell our Israeli friends that my advice to you is never lose control of your destiny.Never allow a situation to develop that would destroy the Jewish state, he added.Standing next to Graham, McCain said, There should be no daylight between America and Israel in our assessment of the [Iranian] threat.Unfortunately there clearly is some, added the Senator.Over the weekend, McCain lashed out at the Obama administration’s handling of rising tensions between Israel and Iran.McCain told CNN’s State of the Union that the administration intentionally leaked to the media the reason for the US national security adviser’s trip to Israel – to try to persuade the country not to attack Iran.The prime minister has every reason to be upset,McCain said. Iran would be able to dictate far higher oil prices and, by so doing, choke the world economy.Anyone who is interested in stopping the manipulative use of oil production, its influence on world markets, the threats to the world's economies, must also for that reason enlist to stop Iran's nuclear race, he added.His comments come amid world concern over spiking oil prices due to Iran's ability to negatively impact energy markets.
Israel, the United States, its Western allies, and Gulf Arab states fear Iran's self-proclaimed peaceful nuclear program is a weak facade for a nuclear weapons program.Tehran denies the charge, but the International Atomic Energy Agency said in a report on Friday that Iran had tripled its capacity to enrich uranium to 20-percent purity since November.Enriching uranium to 20 percent is a major step towards purifying it to the 90-percent level needed for a nuclear weapon.Most analysts believe Iran already has a sufficient stockpile of 20% enriched uranium to produce a 15 kiloton nuclear weapon should Tehran decide to push for weaponization. That process, they say, would take Iran 2.5 to 3 months.

Israel, which maintains a policy of nuclear ambiguity is widely considered to the sole nuclear power in the Middle East, and has said all options - meaning a potential military strike - are on the table ensure Iran doesn't join the so-called nuclear club.Iranian officials have repeatedly called for the destruction of Jewish state and called Israel a one bomb state.However, Jerusalem is under intense pressure from Washington and Europe not to launch a pre-emptive military strike, leading Israeli officials to charge they are more concerned about oil prices and imminent electoral races than world security.Netanyahu has said Iran will top the agenda when he meets with US President Barack Obama for talks in the White House on March 5.

Human Rights Council on Tuesday.Faysal Khabbaz Hamoui charged that sanctions imposed on the regime of Syrian President Bashar al-Assad for its brutal year-long crackdown on civilians, prevented Damascus from buying medicines and fuel. He then abruptly walked out the council's emergency debate on Syria.We declare our withdrawal from this sterile discussion, Hamoui said before leaving a room filled with government ministers and senior officials who had gathered for the session.We reaffirm to all those alleged friends of the Syrian people that the simple step to immediately help the Syrian people is to stop inciting sectarianism, providing arms and weapons and funding and putting the Syrian people one against the other, he said.Unjust and unilateral sanctions imposed by some countries on the Syrian people are preventing access to medicines, to fuel in all forms as well as electricity, and are also impeding bank transfers to buy these materials,he said.He accused some members of wanting to use the opening “high-level” segment and convert it into slander and libel.We are convinced that the real aim is to cover up for the violence and murder perpetrated by armed groups against innocent civilians,said Hamoui.

The United Nations’ main human rights body was set to condemn Syria on Tuesday for using heavy weapons on residential areas and persecuting opponents, its fourth rebuke to Assad in an 11-month uprising.UN High Commissioner for Human Rights Navi Pillay said she was appalled at the rapidly deteriorating rights and humanitarian situation in Syria and shelling of Homs.Hospitals are overwhelmed and makeshift clinics have been set up in hard-hit areas to treat the wounded, she said.Pillay, a former UN tribunal war crimes judge, reiterated that Syria should be referred to the prosecutor of the International Criminal Court (ICC).The urgent debate came at the request of Turkey and three Gulf countries, Qatar, Kuwait and Saudi Arabia, with backing from the United States and European Union.It began just days after UN investigators accused the highest levels of the Syrian government and army of ordering crimes against humanity including murder, rape and torture.The 47-member forum, which has 'moral authority' but no legal power, looked set to adopt a resolution condemning Syria’s continued widespread and systematic violations, diplomats said.Drafted by the Arab countries and Turkey, the resolution condemns the use of heavy artillery and tanks to attack residential areas ... that have led to the deaths of thousands of innocent civilians.It also voices alarm at the humanitarian crisis in areas lacking food, medicine and fuel and calls for aid agencies to be allowed to deliver vital supplies to civilians in heavily hit areas, especially Homs, Deraa and Zabadani.The meeting came as Assad sent units of an elite armored division into Homs on Tuesday as rebel-held districts came under the heaviest bombardment of a three-week offensive.UNHRC officials in January reported at least 5,400 civilians had been killed by Assad's forces during the year-long crackdown, but stopped counting due to pervasive chaos in the country.Independent human rights organizations say the number of civilian deaths has spiraled to at least 7,300 since then.

Prime Minister Benjamin Netanyahu on Tuesday vowed to continue opposing judicial reform in Israel.Speaking at an event for outgoing Supreme Court chief justice Dorit Beinisch, Netanyahu said, We will continue to act to ensure that there would be no danger to the independence of the court.In democracy there are many important institutions. A functioning legal system, however strong and independent, is what allows the existence of all other institutions, he added.That is why I'm doing and will do everything I can to keep the judicial system strong and independent, Netanyahu said. And that is why I appreciate everything you did, Justice Beinisch.For five and a half years you brought honor to your post as the head of the judiciary in Israel. It was not an easy tenure, Netanyahu said. The courts were under attack, and arrows were often aimed directly at you.These attacks were unsuccessful, both against you and the court,Netanyahu said with satisfaction.The court is strong and stable, he added.I did not let anyone harm it. In recent months I stopped every law that threatened to impair the independence of the system. I will continue to do so whenever laws that might impair the independence of the court in Israel are proposed.I wish to congratulate the president-elect, Grunis,Netanyahu concluded. I have no doubt, that under your leadership, the Supreme Court of Israel will continue shine in the world as a beacon of liberty, which the State of Israel and its temple of justice and freedom can be proud of.Critics of the outgoing Beinisch say her tenure was marked by a partisan judicial activism that frequently impinged on the prerogatives of Israel's Knesset and government, effectively overriding the sovereign will of the people expressed through their representatives.

Of particular note was her court's extensive reliance on a still-controversial decision by Israel's Supreme Court in 1997 that defined Israel's Basic Laws as Israel's formal Constitution, thereby allowing for the power of judicial review.
Israel's formal constitution has been deadlocked in committee since the founding of the state, and its Basic Laws can be altered by a simple majority vote.Under Beinisch, Israel's Supreme Court took a strong-view of its own powers and did not deem it necessary to abide by the limits - both formal and self-imposed - which its contemporaries around the world customarily observe vis-a-vis judicial review.Among the bills Netanyahu proudly killed in committee in recent months were attempts to implement the concept of legal standing in Israel's courts, and the review of Supreme Court candidates by Israeli lawmakers.In law, standing or locus standi is the term for the ability of a party to demonstrate to the court sufficient connection to and harm from the law or action challenged to support that party's right to petition the court.Standing is not only a bedrock principle in Western common law, but appears in a less crystallized form in both the Babylonian and Jerusalem Talmuds as well.The review of potential judicial candidates by lawmakers is common, but not universal, in democracies around the world and serves to ensure courts represent the plurality of Israeli views.Israel's current system of appointments for Supreme Court justices has been criticized as creating a court has a very narrow ethnic, political, and social character.Beinisch, along with Netanyahu and Attorney General Yehuda Weinstein, actively opposed all attempts to define the limits of the Supreme Court's powers, charging such moves were undemocratic.Incoming Supreme Court chief justice Asher Grunis is seen as having a far more conservative view of what is judiciable by the court, and is expected to exercise far greater restraint than Benisch did.
